Yet another case where you have to read carefully between the lines. See the reference to UNNAMED DAD's girlfriend? The media virtually never says "girlfriend" when the woman in question is the child's mother. So, this obviously involved a custody/visitation situation. Whether Daddy had court-ordered full custody, joint custody, or just some informal arrangement is obviously not specified. But the media seldom makes this clear. What we do know is that the mother was clearly not in the home when this boy was beaten to death. Makes me wonder if there was prior evidence of violence, abuse, or neglect that a court chose to ignore....

Tragic news from the island of Maui.

Police have opened a murder case after the death of a four-year-old boy.

Maui police say the boy was brought to the Maui Memorial medical center just before 11 p.m. Tuesday night by his father.

The father told authorities his son was found unconscious in the shower.

The boy was pronounced dead at the hospital.

An initial examination by emergency room doctors revealed the child victim had suffered severe blunt force trauma to his internal organs and died of his injuries.

Police say the boy's 31-year-old father and his father's 27-year-old girlfriend said they didn't know what happened to the boy.

Both were arrested on suspicion of murder.

An investigation is underway.

They just want to make sure Mom is punished enough for leaving their sorry @$$es. So taking custody of the kids--or drugging them and burning them to death--it all accomplishes the same aim to them. We need to stop giving these types acccess to the kids at all.

Fifteen years for a vicious double murder? I know the European justice system is far more lenient than it is in the US, but this is a joke....

A man who murdered his two young daughters by drugging them, strapping them into his car and then setting it on fire after a custody battle with his former wife was jailed for life in Germany on Thursday.

The 41-year-old Danish man, identified only as Peter R., had taken his daughters, aged nine and ten, on holiday to Germany in August 2011, when the judge Frank Tiemann said “resentment and jealousy” towards his ex-wife drove him to kill them both.

He stopped his car in the woods in Brandenburg, sedated the children with sleeping pills, strapped them into the back seat and doused the car in petrol before setting it alight, Potsdam district court heard.

Although he was initially in the car, Peter R. got out at the last minute and was found severely burned, staggering into the road. He was taken to a specialist burns unit in Berlin.

His lawyer argued for a manslaughter conviction, saying Peter R. had been planning to kill himself along with his daughters, but the judge convicted him of murder in light of what he said had been considerable planning. He was sentenced to 15 years in prison.

Tiemann said that because Peter R. had clearly made the effort to buy sleeping pills to sedate the girls and filled up several canisters of petrol, it could not have been a spontaneous decision.

The SĂĽddeutsche Zeitung newspaper reported on Thursday that the Dane had been fighting with his ex-wife about custody of their children. He told the court that he had "killed them out of love as they should not have to live a life without him."

Psychologists instead deemed him to have a “narcissistic personality disorder.”

QUEENS — A 2-month-old Elmhurst girl is on life support after her father violently shook her — for three minutes in one case — when she refused to stop crying, authorities said.

Israel Garcia, 27, was charged with first degree assault and endangering the welfare of a child for the alleged incidents at his home on 41st Avenue, near 95th street, and held without bail at his arraignment Wednesday night, according to the office of Queens District Attorney Richard Brown.

According to officials, Garcia came home from work one day in early May frustrated and tired and heard his daughter crying.

He allegedly grabbed the child, squeezed her torso and shook her up and down. According to prosecutors, he believed he had injured the girl's ribs, but did nothing.

Then on May 28, the suspect allegedly shook his daughter, who started to cry when she woke up from a nap, for three minutes.

When he noticed that the baby stopped breathing, he tried to revive her and called 911.

At Elmhurst Hospital, doctors found that the girl was suffering from bleeding on the brain, retinal bleeding, brain injuries, rib fractures and bruises, officials said.

"Despite increased efforts by medical and law enforcement personnel to educate the public on the dangers of shaking a baby, we are still seeing far too many cases of children dying or being permanently disabled," Brown said in a statement.

A 2004 state law requires hospitals to show new parents a video on the dangers of shaking babies and the Queens DA's office has held conferences on the condition.

GAINESVILLE, Fla. - A father is charged with aggravated child abuse after authorities say he gagged and pinned his 8-year-old son to the floor and then beat him, The Gainesville Sun reports.

Police say Richard Wright, 29, was arrested Monday night after he beat his son that Saturday.

According to a Gainesville Police Department report, Wright wrapped a shirt around the boy's nose and mouth, gagging him.

He was beating the boy's buttocks with a belt, but missed once and hit him in the eye, breaking a blood vessel.

Wright's mother screamed at him to stop. When the father did, she took the boy to the hospital and then went to police. She told officers that she suspected her son was drunk.

Wright has an extensive criminal history, including arrests on charges of robbery with a deadly weapon, possession of a firearm/ammunition by a convicted felon, possession of cocaine, and resisting an officer with violence.
He was arrested without incident but denied the charges. Wright is held in the Alachua County jail with bail set at $25,000.

UNCASVILLE, Conn. (AP) _ Connecticut State Police have arrested a Waterbury man accused of leaving his infant son alone in a car for seven hours as he was inside the Mohegan Sun Casino.

Police say Kyuyoun Lee was arrested Wednesday. He was charged with leaving a child unsupervised and risk of injury to a child.

Bail was set at $5,000 for the 32-year-old Lee. He is scheduled to appear in court on Thursday.

Police say they responded to a report of the child left unattended in the car. The state Department of Children and Families was notified.

No other details were immediately available.

This article is really mealy-mouthed in the way it disguises criminal agency by using the passive verb tense. We talk about everybody dying in an "apparent" murder-suicide without coming out and saying that the father murdered his wife and their two-year-old son. It's like saying the victim just showed up in the gutter with a knife in his back. Ridiculous. Somebody PUT that knife there. Just like somebody KILLED this mother and child. And we all know with virtual certainty that it was dad DARREN WOURMS since the authorities suspect no outsider. Why can't we use plain English and say so?

The family found dead near St. Walburg has been identified as Darren Wourms, 26, wife Hayley Wourms, 23, and son Cayden, age two.

Roughly a month before a young Airdrie family was found dead in a Saskatchewan ditch, RCMP brought the husband to hospital for a psychiatric evaluation.

On Monday afternoon, the bodies of the man, his wife, and their young son were discovered on the side of a rural road close to St. Walburg, about 100 kilometres northeast of Lloydminster.

RCMP have not released the names, but friends and relatives identified the family as Darren Wourms, 26, his wife Hayley Wourms, 23, and their son Cayden, 2.

The couple and their toddler had travelled to Darren's home town to help with his brother's wedding plans, and had just attended church hours before they were found dead, said family friend Rev. Richard Doll.

A passing motorist spotted the bodies in the sparsely populated area at about 1: 20 p.m. and contacted RCMP. Officers also found a small-calibre .22 rifle as well as the family's Buick Century at the scene.

While police declined to classify the case as a murdersuicide, "there is no indication of another party being involved in the deaths of these three individuals," said RCMP spokesman Sgt. Paul Dawson.

It was about a month ago, on April 24, that RCMP responded to the family's southwest Airdrie home after receiving a call from a relative worried about the husband's well-being.

"The concerns that were raised by the third party certainly warranted an investigation to be conducted, so an investigation was conducted, statements were obtained from people and further review was done," said RCMP spokeswoman Sgt. Patricia Neely.

Darren was taken to a Calgary hospital for a mental health assessment. No criminal charges were laid in connection with the incident, she said.

Partner agencies were involved to help the family with their "ongoing struggles," though Neely declined to specify.

Neighbour Chuck Graystone said one day shortly after the family moved in, he saw four RCMP cars parked outside the two-storey home with an ambulance down the street. They remained outside for about an hour and a half, with one RCMP cruiser staying for between three and four hours.

"No one knew what it was about," Graystone said, adding he never saw much of the family. "They had just moved in and they seemed all right. It's just a really sad situation." Extended family and friends gathered at the Wourms family farm outside St. Walburg on Tuesday. Many are having difficulty coming to terms with the tragedy, said Doll, a Roman Catholic priest and longtime family friend.

"Everything looked rosy. (Hayley) was a real sweetheart. Whatever happened, we just have no idea," he said, in an interview from his kitchen table.
Darren was one of nine children and came from a family heavily involved in the church, 4-H clubs and other volunteer activities, Doll said.

Doll officiated the couple's wedding three years ago in Hayley's hometown of Assiniboia in southern Saskatchewan. He described the pair as "nice kids" who seemed very much in love and ready for what marriage would involve, having completed eight hours of marriage counselling and preparation.

In the hallway of Doll's home hangs the couple's wedding photo, one of 148 displayed.

Darren had been working in the booming oilsands community of Fort McMurray, which was taking a toll on him, Doll said.

Family members persuaded him not to return, but he was only weeks away from obtaining an engineering certificate and decided to continue, Doll said.

According to his Facebook posts, Darren worked at Kiewit Energy Canada in Calgary and had recently moved to their new home in Airdrie.

The couple wrote of their excitement in response to friends who commented on photos of the empty lot, blueprints, and the house when it was finally built.

"Housing is better priced out there and Hayley prefers the smaller community," Darren wrote.

Darren's great aunt Irene Wourms Gobeille is wondering what went wrong.

"None of us know what happened but he was such a wonderful young man," she said. "I'm having difficulty going online and looking at the pictures they've posted."

Autopsies were scheduled for Tuesday in Saskatoon, where "valuable information" is expected to come out, said Dawson.

Members from major crimes in Saskatoon, the forensic identification units in Saskatoon and North Battleford, and police dog services from North Battleford are also assisting with the case that has hit police hard.

"It's tragic enough when a 23-year-old and a 26-year-old pass away," said Neely. "But to have it in conjunction with a two-year-old certainly makes it extraordinarily sad."

Father charged in death of infant girl

BALTIMORE (WMAR) - A Baltimore man is facing charges of child abuse and murder in the death of his 6-month-old daughter.

Demante Palmer was charged with first and second degree attempted murder, child abuse, assault, and reckless endangerment after his daughter, Olivia was shaken so violently she suffered brain damage.

Police responded to to the initial call on May 22, for a non-breathing baby. Medics took Olivia to Johns Hopkins Pediatrics Hospital where she was revived. Olivia succumbed to her injuries on May 27.

Palmer told police that he shook the baby because she would not stop crying.

Police are now working with the Baltimore City State's Attorney's Office to upgrade the charges.

MUSKEGON, MI -- Joseph Michael Krypel II has been declared mentally competent to stand trial for allegedly shaking or otherwise injuring his 2-month-old son almost to death.

Muskegon County 14th Circuit Judge Timothy G. Hicks made that ruling Tuesday afternoon after receiving a report from a state-appointed psychiatrist. Krypel will be scheduled for trial.

Krypel, 25, of Norton Shores is charged with first-degree child abuse, a 15-year felony.

Police and prosecutors believe Krypel injured little Joseph Michael Krypel III early Dec. 30 in their home in the 3200 block of Victoria. The baby at one point stopped breathing, police said.

Muskegon County Child Protective Services, alerted by medical personnel at Mercy Health Partners Hackley Campus, called police around 5:30 a.m.

The baby had been taken to Hackley's emergency room with reported dehydration and difficulty breathing, police said. The boy's condition was so severe that he was transported to Spectrum hospital in Grand Rapids.

Based on doctors' statements and other interviews, the father was charged.

Disgusting. It appears that this 2-year-old had repeated signs of abuse everytime he came home from weekend visitation with dad ALLEN DUNN and the step. Mom called CPS. She was ignored. In fact, knowing how CPS works, especially in a fathers rights-dominated state like Indiana, they probably dismissed her as a lying alienator without further inquiry at all. Meanwhile, the step is getting nailed for the toddler's death while Daddy is apparently getting off scott-free. I see a "clueless daddy" defense coming on--he had NO IDEA that Evil Woman was abusing HIS child.

Bullsh**. Mothers are routinely charged with failure to protect or worse, when they "fail" to stop their 250 pound boyfriend from beating their kid. Doesn' t matter if he was beating or threatening her as well. But these fathers are virtually NEVER charged when his new female partner abuses (remember Zahra Baker's custodial dad?). And if by chance Dad really IS clueless, because he's never around, having dumped all the child care on the new step or girlfriend, then WHY ARE DADS LIKE HIM GETTING VISITATION AT ALL? If you don't want to take any role in raising your child, then DON'T GET JOINT CUSTODY and/or VISITATION. Oh, but the fathers rights people have practically made joint custody a mandatory thing, even for dads who apparently don't give a sh**. Reduces or eliminates child support you know.

CAMBY, Ind. (WISH) - A Camby woman faces multiple charges in connection with the death of her 2-year-old stepson . Now, family friends say the tragedy could have been prevented.

Skyler Dunn, 2, died Sunday after suffering skull fractures earlier this month. His stepmother, Autumn Dunn, 29, was arrested a week earlier , when he was taken to Riley Hospital for Children at IU Health.

Skyler visited his dad and stepmom on weekends at the home the couple shared with Autumn Dunn's parents, Vicky and William Patterson, in a quiet community in Camby.

But according to a probable cause affidavit , those visits sometimes left the toddler badly bruised. His stepsister told police that her mother, Autumn Dunn, "hits him in the face."

During questioning, Autumn admitted hitting the child "a couple of times" on the face hard enough to cause bruising, according to the court document.

Family friends said the toddler's mother, Jean Seal, was concerned.

"She said she was worried because he come home with bruises," close family friend Sharon Spurlock said.

Spurlock insists Skyler's mom tried to protect her son.

"She called Child Protective Services. I guess they didn't do much," said Spurlock.

But Autumn's father tells a different story. He insists his daughter and son-in-law, Allen, took good care of Skyler.

"I never seen no evidence. I never seen Autumn or Allen discipline the child or spank the child," William Patterson said.

But during her interview with police, Autumn admitted she dropped the toddler on his head, court documents said. She then picked up the child, and when he started crying she said, "I just lost my temper," the PC says.

She admits telling the little boy, "Fine if you want down so bad," just before opening her arms,
causing Skyler to fall onto the floor again, the court documents say


She told police she'd hurt the boy, but she put him to bed - only calling 911 hours later when the baby was unresponsive.

"I just can't see my daughter doing what they allege that she has done," Patterson said.

But friends believe Skyler showed the classic signs of abuse after returning from visits with his father and stepmother.

"I think this could have been prevented if Child Protective Services had stepped in," said Spurlock.

24-Hour News 8 contacted the Department of Child Services, and a spokeswoman told us that laws mandating confidentiality prohibit the agency from discussing Skyler's case.

Amanda Dunn remains jailed and currently faces charges aggravated battery and neglect charges filed when Skyler was hospitalized. The Marion County prosecutor said he may file new charges because Skyler has died.

In the mean time, family friends are collecting donations to help pay for Skyler's funeral.

The father of a 2-year-old Detroit girl who has been missing since last year will now go to trial for her disappearance.

The girl, Bianca Jones, hasn’t been seen since Dec. 2, 2011, when her father said he was carjacked with her in the back seat.

Police found the car a short time later, but the girl wasn't in it.

D'Andre Lane was bound over to trial Tuesday by Judge Ruth Carter on charges of felony murder and first-degree child abuse.

Witnesses and officers have testified that Lane might have beaten and killed the girl.

However, her body has still not been found.

Carter said she made her decision based on testimony from people who were inside the house the night before the girl went missing.

Lane's own girlfriend said she awoke to hear Bianca crying and being disciplined by Lane for wetting the bed. She said he used a stick he had made by wrapping a sponge with duct tape. She said she heard Lane hit Bianca “three or four times" before everything was quiet.

Others said Bianca was never seen the following morning and that Lane carried her out to his car and covered her with a blanket once she was inside the car.

Police said there was also a 45 minute gap between when they were told about the girl's disappearance.

Lane is scheduled to be arraigned June 5.

Cleveland father charged with murder, assault in suffocation death of 6-month-old daughter

CLEVELAND - A Cleveland man has been indicted in connection with the suffocation death of his infant daughter.

The Cuyahoga County Prosecutor’s Office said a grand jury indicted 27-year-old Michael Beard Friday on murder, felonious assault, endangering children charges.

The Cuyahoga County Medical Examiner’s Office said 6-month-old Lynniah Beard was unresponsive when she was taken to Lakewood Hospital on May 8, 2011. The child died more than a month later of asphyxia by suffocation.

The ME’s office ruled Lynniah’s death a homicide in January.

The indictment alleges Michael Beard “did recklessly create a substantial risk to the health or safety” of the child.

Michael Beard is scheduled to be arraigned on the charges June 11 at 8:30 a.m.

A father in Greenbrier County is arrested for child abuse after his two children suffered hits to the face.

Jonathon Ferrell of Rainelle was arrested Wednesday, along with his live-in girlfriend, Virginia Hanshew, and are both charged with child abuse with injury.

Rainelle Police Officer James Layne said the five-year-old and the two-year-old girls had visible marks on their cheek bones.

The children's mother contacted 911 after picking the children up from the weekend visitation with their father.

Child Protective Services and the Child and Youth Advocacy Center are working with Rainelle police in this case.

Ferrell was released on bond, but Hanshew remains at Southern Regional Jail.

Prosecutor wants lengthy prison terms for man who sexually abused kids

EDMONTON - A serial predator convicted of more than a decade of sexual abuse against his own children and others should serve 20 years in prison for his crimes, court heard Friday.

The 41-year-old, who cannot be named to protect the identity of his victims, has been convicted of 26 charges, including sexual touching, child pornography, unlawful confinement, incest and bestiality. From 1999 to 2010, the man’s victims included his son, his daughter, the daughter of a girlfriend and two daughters of a fiancĂ©e. Four of five victims were minors.

Crown prosecutor Diane Hollinshead said the man’s crimes were planned and did not stop until he moved onto another relationship or a victim severed ties with him.

“He has a total lack of understanding of his conduct. He has a lack of empathy and remorse over 10 years of abuse,” Hollinshead told court. “This is about as serious an offender as you can get. The impact on his family has been devastating.”

As the man’s family watched from the court gallery, Hollinshead asked the court to impose a sentence of 18 to 20 years.

Defence lawyer Mark Facundo argued for a sentence of nine to 10 years.

“These facts are admittedly terrible facts,” he said. “No matter how abhorrent these facts are, we are not here for revenge.”

The man’s daughter, now 18, told police of sexual abuse that started when she was six years old, though she didn’t recognize it as abuse until she was 11.

When the girl was 11, her father ordered her and her 10-year-old brother to have sex. Her father had sexual intercourse with her. There were numerous instances of abuse.

The man’s son, now 17, said his father often asked him to participate in sexual activity with himself and women over the years. The teen declined.

The siblings were afraid to tell anyone of their father’s crimes and both attempted suicide as a direct result of the abuse.

In victim impact statements submitted to court, the man’s son called him “sick and perverted” and said he would never again refer to him as ‘Dad.’

The children’s mother said she struggles with self-blame and questions how a father is capable of such acts.

“He has taken their innocence and they can never get that back,” she wrote. “I hope this weighs on your mind everyday. I hope you rot in Hell forever.”

From 2003 to 2008, the man was in a relationship with a woman who had a young daughter. When they were alone, the accused sexually touched the girl. More recently, the man abused two daughters of a woman he was engaged to in 2009 and 2010.

Police began investigating the man shortly after that relationship ended. They searched the man’s home and found 10,455 images and 8,355 videos of child pornography.

A sentencing decision in the case has been scheduled for June 27.

A Phoenix dad has been arrested after his 6-month-old son was taken to Phoenix Children's Hospital with multiple skull fractures.

The Phoenix Police Department said the boy's parents brought him to the hospital on May 11 and neither parent had an explanation for the child's injuries.

On May 23, Child Protective Services told police they received a letter from the child's grandmother informing CPS that the boy's father, Jullian Kirkland, confessed to his pastor that he intentionally injured the baby.

Kirkland was taken into custody and told police he "hit him in the head twice with a closed fist."

Kirkland also admitted to shaking the child when he was 3 months old.

Kirkland was arrested on two counts of child abuse.

After going off on the baby, this POS did nothing for three hours till Mom got home. Only then did the baby get medical attention. Despite Mom's apparently prompt response, she has lost custody anyway. A working father would never get slammed if a stay-at-home mom had abused the baby. Which just goes to show that nobody really regards the situations as equivalent, despite all the Sunday newspaper articles glorifying stay-at-home fathers. Mom is STILL regarded as the one who is ultimately responsible, no matter what.

Anthony Sewejkis, the stay-at-home father convicted in the near-fatal Dec. 7 abuse of his then-4-month-old son, Hunter, failed to persuade a judge from giving him the maximum sentence — 10-15 years in prison, the Canton Observer reported.

Sewejkis, 26, was found guilty of first-degree child abuse earlier this month for his role in the abuse, where he was accused of twice slamming his young son's head against the carpeted living room floor of the Michigan Avenue home in Canton he shared with the boy's 29-year-old mother, Leanne Garlick.

Garlick said she was at work as a cab driver in Ann Arbor when the incident occurred. She has since lost parental rights to Hunter, who remains partially blind and severely brain damaged, but is in the process of being adopted by his maternal grandparents, Sal and Theresa Alongi of Belleville.

According to the Observer's report, Wayne County Circuit Judge Margaret Van Houten said Sewejkis never sought help for Hunter after the infant was injured, waiting about three hours until Garlick returned home from work to take the infant to the hospital.

Under Dominick's Law, new state legislation passed by the House in the wake of the death of four-year-old Dominick Calhoun of Argentine Township, first-degree child abuse offenders could face up to life in prison instead of the existing 15-year maximum sentence.

A FATHER has been jailed for 19 years and told he is partly to blame for the death of his daughter whom he repeatedly raped.

Claire Warrener took her own life last December when she was barely into her 20s, just months after she broke her silence about what her dad had done to her when she was a young girl.

Just before she killed herself, Claire sent a text to a loved one saying she could not cope because of what her dad Michael Warrener had done.

Warrener, of Thorney Close, denied one charge of indecent assault and three of rape but was found guilty after a trial at Newcastle Crown Court last week.

The lengthy, harrowing statement Claire made when she reported her horrendous ordeal to the police was used as evidence against her father.

Her grieving family were in court to see the 59-year-old finally face justice for his sickening crimes and said: “We hope he rots in hell”.

Judge John Milford told Warrener: “I am satisfied you are, at least in part, responsible for her death.

“Though other factors may have played a part in the decision she took to end her life, she sent a text saying she could not cope any longer because of what you had done to her.

“You have demonstrated no remorse.”

Warrener appeared defiant and shook his head during the proceedings yesterday.

Speaking after the hearing, Claire’s devastated family said: “The most important part of all this is we got justice for Claire.

“We hope he rots in hell. We have always said Claire did what she did because of the abuse he put her through, now the judge has publicly said that that was in fact one of the reasons for her taking her own life.

“Even though 19 years sounds like a long time, for us, no sentence could be long enough.

“As a family we have got a life sentence because of what he did, we will never get Claire back even after he has served the 19 years.”

The court had heard how Warrener repeatedly abused Claire from the age of about 13.

Prosecutor Penny Moreland told the court how Claire, whose parents had split up, was living with her dad when the abuse started.

She said: “He came to her bedroom when she was asleep.”

Claire told police in her statement: “I didn’t know what had happened to me.”

After the first incident of abuse, which happened when Warrener’s then girlfriend had walked out on him, Claire’s ordeal got worse.

It wasn’t until 2010 Claire felt able to report her dad for what he had done.

Warrener was found guilty of indecent assaults on two other child victims during the trial.

Man gets 1 year in death of infant son

NEW HAVEN — Prosecutors don’t know who killed 5-month-old Morries Hill Jr., but they believe it had to be Morries Hill Sr. or his younger brother.

However, lacking any evidence connecting either of them to the infant’s death, Assistant State’s Attorney Stacey Miranda Friday reluctantly had to settle for seeking and receiving a sentence of serving one year in prison for the child’s father for risk of injury to a minor.

“This is a horrible case,” Miranda told Superior Court Judge Roland Fasano. “A year is not enough. We just don’t know which one of these two did it.”

But, Miranda added, “This is a cover-up. The defendant and his brother know exactly what happened to this child. That’s something they’ll have to live with for the rest of their lives.”

Hill, 22, stood in the courtroom with his head down for nearly the entire session. He wore a white sweater because his supportive family had many months ago posted $200,000 bail.

But when Fasano asked Hill if he wished to say anything, the defendant quietly said he loved his son. He added, “I know I was a good father.”

“I have a beautiful young daughter,” he noted, “and I love her dearly, and her mother.”

However, the mother of the victim, Sarai Beall, also delivered a statement. “For the past four years,” she said, “I’ve been living with a broken heart.”

If you did not do it,” she told Hill, “you know who did it. I will never, ever forgive you or your family. One day, you will face the final judgement, because God knows.”

Before Miranda laid out the details of the boy’s death, she noted Hill had pleaded nolo contendere to the risk of injury charge, accepting a finding of guilty but not necessarily agreeing with the allegations.

Miranda said the child was found unresponsive by police and medical respondents the morning of Aug. 4, 2008. Police said Hill, who at that time was 19, and his brother, then 13, were the only others at the Eastern Street home. The child’s mother reportedly was working her night shift job.

Miranda listed the child’s injuries: fractured ribs, bruises all over his head and face, a lacerated liver, retinal hemorrhaging and head trauma. The chief state’s medical examiner determined the baby died as a result of multiple blunt traumatic injuries.

But Miranda said the father waited up to 90 minutes after becoming aware of the injuries before he called 911.

“This man was responsible for that child,” she said. “He knew the baby was injured. He should have called police immediately.”

Defense attorney Robert M. Berke disputed the 90-minute figure. He also read excerpts from about a dozen letters attesting to the defendant’s “good moral character” and “kind heart.” They said he deserved a second chance.

“Morries loved that child with all his heart,” his uncle wrote.

The defendant’s mother, Sharon Hill, came to the courtroom to read a statement asserting that putting him in prison would “devastate” her son and the family.

“My son has lost his beloved son,” she said, and he is still grieving.

“Morries has overcome great obstacles in his life,” she added. She said he “stepped up to be a young father,” which many other men of his age will not do.

She also said he “enjoys helping others” and “gives his all to anything he dedicates himself to.”

Berke noted Morries Hill is a high school graduate and landed retail jobs, securing several promotions. “He is making an effort toward rehabilitation and living a productive life.”

But Fasano said he could not agree to the pleas to keep Hill out of prison. Studying photos of the smiling baby, he said, “I can’t help but see how well-cared for he was. Then to sustain the type of injuries recited by the state — it’s hard to understand how somebody taking care of this child could not be aware.”

Fasano said that while prosecutors could not prove Hill was responsible for the child’s injuries, “the state could prove that this defendant was responsible for the delay in seeking treatment for a child in dire straits.”

Fasano did say he was impressed by the testimonial letters. “He’s from a good family; he has potential. This is not a criminal. This is not a bad kid.”

“But under the circumstances,” Fasano added, “when seconds could have made the difference, this was the worst sort of judgement, especially given the condition of the child.”

“You did not take care of your child,” he told Hill. Fasano said he could not “in good conscience” impose a sentence of less than one year to serve in prison.

He then announced a 6-year sentence, to be suspended after Hill serves one year, followed by three years’ probation.

Even as Fasano was announcing the sentence, judicial marshals were applying handcuffs to Hill and preparing to lead him away. A woman sitting next to the young victim’s mother applauded but was hushed by other marshals.

LARGO — A Largo man abandoned his one-year-old son in his car when he got out of the vehicle to flee police Tuesday night, police said.

Terry Lewis, 35, was pulled over at about 9:15 p.m. on suspicion of driving with a suspended or revoked license, according to the Largo Police Department. With him he had his one-year-old infant son "unrestrained" in the front passenger seat.

After he was pulled over, Lewis ran away from the vehicle — and the baby.

He was later apprehended at the Bay Pointe Apartments complex on Roosevelt Boulevard. Police returned the baby boy to his mother at her apartment.

Allen was charged with neglect of a child, a felony, and resisting an officer and driving with a suspended or revoked license, both misdemeanors. He was being held at the Pinellas County jail in lieu of $11,150 bail.

STOCKTON - The court has ordered the release of a father charged with killing his infant child after attorneys reached a plea deal Wednesday.

Donald Lee Wilson, 23, had been headed for trial in the death of his 4-month-old son, Brandon Wilson, who medical doctors determined had traumatic brain injuries.

But in a sudden agreement at a pretrial hearing Wednesday, the prosecutor and defense attorney made a deal that allowed Wilson to be released from the San Joaquin County Jail immediately.

Wilson pleaded no contest to felony child abuse and an enhancement of infliction of great bodily injury.

The conviction is attached to a nine-year prison sentence, but that penalty was replaced with probation time by San Joaquin County Superior Court Judge Xapuri Villapudua who made the attorneys' agreement official.

"He would be allowed to return with his wife and stepchildren," Villapudua said. Wilson will serve five years probation and is ordered to attend a one-year child-abuser treatment program.

If Wilson violates the sentence terms, he may be ordered to serve the nine-year prison sentence.

San Joaquin County Deputy District Attorney Angela Hayes dropped charges of child abuse resulting in death, corporal injury to a child and two other great bodily injury enhancements.

On Aug. 1, 2011, Wilson called for emergency help after his son stopped breathing, according to testimony in a preliminary hearing. He told emergency responders Brandon had a choking episode.

The following day, the baby was transported to a children's intensive-care facility in Sacramento, where he remained comatose and on a ventilator.

Physicians decided the child's injuries reflected child abuse.

San Joaquin County's chief medical examiner, Bennet Omalu, concluded that Brandon was hit on the head with great force, and he said the baby's death was caused by traumatic head injuries.

Private defense attorney Peter Johnson said Wilson withdrew his original plea of not guilty to no contest because he faced a possible life sentence if convicted by a jury.

"He's going home. That's all I have to say," Johnson said.

Hayes couldn't be reached for comment after the ruling.

Wilson's family and wife - the child's mother - declined to comment on the resolution.

Villapudua on Wednesday said the court finds there is no substantial risk of harm to Wilson's wife or children.

UTICA, N.Y. (AP) — Authorities say an 8-year-old upstate New York boy is recovering after being struck in the head by a samurai sword swung by his father during a fight with another man.

Police in Utica tell local media outlets that 42-year-old Thar Kyi (kye) barged into the home where his three children were getting ready for school Tuesday morning and began swinging the sword at the boyfriend of the children's mother.

Officials say Kye missed the boyfriend but struck his son in the head. The boy was treated at the hospital for non-life-threatening injuries.

Kyi was eventually found in the Syracuse area and charged with assault, burglary, criminal contempt and criminal possession of a weapon. He's being held in Oneida County Jail.

It couldn't immediately be determined if he had a lawyer.

EDWARDSVILLE, IL (KPLR) – A Wood River man accused of beating his son when he was only 5 months old is now behind bars. According to the Associated Press, Alexander Brooks, 19, is jailed on a $250,000 bond.

Authorities say the child’s mother brought the baby to a St. Louis hospital for an exam last year. That’s when the investigation began. Prosecutors say investigators determined Brooks had shaken and squeezed the child. The child is now 10 months old.

Investigators say the baby’s father was living in the home but the mother did not know about the abuse.

The baby is in the care of another family member. Brooks is charged with two counts of Aggravated Battery of a Child. If convicted, Brooks could face up to 30 years in jail.

WEST PALM BEACH, Fla. -- A suburban West Palm Beach man was arrested Monday after his 5-year-old son told authorities that his father had struck him with a broomstick.

Jason Javon Marin, 26, was released from the Palm Beach County Jail on Tuesday after posting a $6,000 surety bond. He is facing charges of aggravated child abuse, aggravated battery with a deadly weapon, possession of marijuana and keeping a structure for drug activity.

Authorities began investigating the case of the boy after he showed up at school with a large black-and-blue bruise underneath his right eye Monday. A Florida Department of Children and Families investigator and a Palm Beach County sheriff's deputy were dispatched to the boy's school.

The boy told them he had received the bruise when his father hit him with the broom because he had not cleaned his room, according to the arrest report.

Asked if the strike was an accident, the boy, whose name is withheld in the report, said, "No," the deputy said.

No other bruises were found on the boy, the deputy said. The boy's brother also shared the same account.

The deputy confronted Marin the same day. Marin allegedly told the deputy he struck his son with the broom stick on purpose.

"Jason stated that he has anger issues and needs help," the deputy said. "He didn't mean to push the top of the broom into his son's eye so hard."

The deputy said he spotted what looked like marijuana "loose all over the table" and a "paraphernalia pipe" that had "burnt residue." An on-scene test was performed, which revealed that the substance was marijuana.

MARTINSBURG, W.Va. — A couple charged in the New Year’s Day death of a 3-year-old boy were indicted Wednesday by a Berkeley County grand jury.

James N. Mauldin, 20, and Jasmine K. Dawkins, 23, were indicted under different sections of state law for death of a child by parent, guardian and/or custodian by child abuse, according to the indictment, which was released by Berkeley County Prosecuting Attorney Pamela Games-Neely’s office.

Mauldin and Dawkins also were charged with two counts of gross child neglect creating substantial risk of serious bodily injury and one count of presentation of false information regarding a child’s injuries in the death of Kaiwon Connelly, according to the indictment.

Mauldin, who is the boy’s father, also was indicted on one count of child abuse causing serious bodily and malicious assault , according to the indictment.

The indictment alleges Dawkins knowingly allowed Mauldin to inflict injuries on the boy that led to the his death.

Both are accused of failing to seek medical care for burns on the child’s buttocks and legs and after knowing that Mauldin struck the boy in the head, according to the indictment.

The indictment alleges the couple also falsely stated to authorities that Kaiwon fell and struck his head, causing the injuries in question.

Dawkins, whose address on her indictment was listed as 2749 Pinewood Drive in Waldorf, Md., is not the boy’s biological mother, authorities said.

Police have said Kaiwon had multiple head injuries, including a fractured skull and brain bleeds. Dawkins told police the injuries were the result of Mauldin punching the boy several times a few days before the boy was hospitalized.

The boy died at 10:55 a.m. on Jan. 1 at Children’s National Medical Center inWashington, D.C., police have said.

Dawkins told police she did not report Mauldin’s alleged mistreatment of his son because she was afraid of being abused herself and indicated she had been previously abused.

At the time of the boy’s death, the couple’s address was listed in court records as 214 Joshua Drive, Apt. 616, which is where police responded to investigate an “EMS assist-cardiac arrest” about 6 p.m. on New Year’s Eve.

Dawkins told police that the boy was burned with skillets and pans that were heated and placed underneath the child to keep him from sitting on the floor. The boy was expected to remain in a squatted position while being disciplined, police have said.

The skillets and pans, along with two pair of children’s underwear, which police believe contained remnants of burned skin, were seized as part of the investigation, police have said.

Police were told that Kaiwon, who would have turned 4 on April 6, was eating eggs and was choking on them just before he collapsed.

Mauldin is being held at Eastern Regional Jail in Martinsburg.

Prosecutors are seeking the death penalty for a California man accused to raping and killing his 14-year-old-daughter before burying her body in the backyard of their home.

Mark Edward Mesiti, 44, allegedly drugged and sexually abused his daughter Alycia before killing her in August 2006, just months after a judge granted him custody of his daughter and son, according to court documents.

The Stanislaus County District Attorney's Office said it is seeking the death penalty because of a 'special enhancement' to charges against Mr Mesiti. Those charges accuse Mesiti of committing murder 'before or during' rape, sodomy and oral copulation, according to court documents.

Prosecutor Annette Rees made the announcement Monday during a pretrial hearing.

Mesiti also faces additional charges of molesting two other girls, one age 8 and the other while she was 16 and 17, according to prosecutors.

Mesiti committed most of the sexual assaults against his daughter while she was drugged, sometimes with anesthesia, according to criminal complaint documents obtained by the Modesto Bee.

The documents claim Mesiti molested Alycia from July 2005 through May 2006.

A Santa Clara County Superior Court judge awarded Mesiti custody of Alycia and her brother despite Mesiti's substantial criminal history.

Mesiti, records show, had committed several federal and state crimes, including bank fraud and drunk driving. He had also been charged with domestic violence and ordered to attend anger-management classes, according to the San Jose Mercury News.

Alycia disappeared from her home in Ceres, California in August 2006. At the time Mr Mesiti told police investigators that his daughter had vanished after setting off on a camping trip with some friends and her pet Chihuahua.

The case was elevated from a disappearance to a homicide investigation in 2009 only after the retirement of a Ceres detective who had been assigned to the case. At that point Ceres police officials ordered a new round of interviews in the case.

Shortly afterwards, police officials obtained a search warrant for Mr Mesiti's former home. Alycia's body was found in a grave beneath the backyard by cadaver-sniffing dogs. Three years had passed since her disappearance.

Only days after finding Alycia's body, police authorities obtained a search warrant for Mesiti's Los Angeles apartment and found a meth lab.

Mesiti was arrested and later convicted of manufacturing methamphetamine.

Alycia and her brother lived with Mesiti for nine months before she disappeared, despite repeated warnings filed by police authorities and child welfare workers.

Court appointed lawyers recommended only temporary placement with Mesiti due to 'sufficient issues and risks to these minors,' the Modesto Bee reports.

A Rochester father, who burned his seven-year-old daughter's hands on a gas stove and then ordered two dogs to attack, was sentenced Tuesday.

Pedro Cordero will have to serve one and a half to three years in prison for attempted assault. Judge Francis Affronti told Cordero he hopes he never has contact with his daughter again.

The abuse happened last year inside Cordero's Electric Avenue while the victim's two-year-old sister was also there.

Cordero was originally charged with assault and endangering a child and would have faced up to seven years in prison but the prosecution reached a plea agreement because the victim was seven years old and developmentally delayed. That posed a risk of losing at trial.

Monroe County Assistant district Attorney Kyle Rossi said, “If we lost, there's a chance that she would have to go back to him and we certainly could not have let that happen. These girls did not want to talk, they were threatened, they were terrified.”

Cordero's wife, but not the mother of the victim, was in court today but she had no comment.

The victim and her little sister are living with their grandmother.

Man assaults estranged wife and child

BRADFORD — A man is being sought for assaulting his estranged wife and young daughter in two separate incidents, Tuesday.

According to South Simcoe police, a call came in around 6:30 p.m. from a Bradford home about the man's attempt to drag his daughter from the residence she was staying at.

Officers learned the man's six-year-old daughter was playing in the rear yard of family friend's home and her mother was not present.

Police say the estranged father went to the home, began arguing with the friends and he grabbed his daughter by the hair, pulled her towards him and tried to leave with the child.

Police were called and the man fled on foot through the town core without the child.

An investigation revealed the father had assaulted the child's mother earlier in the day.

A warrant has been issued for the 35-year-old man, of no fixed address, for who counts of assault.

He is known to police.

Man's children living in filth; 'It's like camping'

BAKER — A 29-year-old father of two was arrested May 15 on charges of felony child neglect after deputies found his home to be unlivable while serving him a warrant.

Records indicate that David Daniel Paul Purselley’s U.S. Highway 2 home had not had electricity for at least three weeks and no running water for a week, according to an Okaloosa County Sheriff’s arrest report. At the time of Purselley’s arrest the temperature in his home was around 85 degrees.

Throughout the home deputies found cigarettes butts, and spilled food and drinks. The master bathroom toilet was filled with feces and soiled toilet paper, which had spilled onto the floor. The children’s bathroom was filled with dirty water and hair, and to the right of the sink was a butter tub that was also filled with old water and facial hair.

Purselley’s two children were asleep on a mattress in the middle of the living room and sweating profusely, according to the report. No windows were open in the home at the time.

The deputy on duty reported multiple run-ins with Purselley and had requested that the electricity be restored and the living conditions be approved for more than three weeks.

When deputies asked Purselley if thought his home was sanitary enough for his children he replied, “They like it. It’s like camping.”

The details are not real clear here, but this is apparently how this happened. Dad ULRICH ESTIMOT seems to have killed his three sons the day after he broke up with Mom #2, the mother of the two youngest sons who were also killed by Daddy Dearest. Like a lot of abuser/control freak dads, he had already stripped Mom #1 of custody. And like a lot of non-custodial moms, she comes across as tentative (probably because she's been badly traumatized). Notice how her murdered son wanted to live with her, but she wouldn't pursue it because she knew his dad would never "let it." Typical abuser crap. Must be in charge. Would rather see his "chattel" destroyed then give "it" up to somebody else, namely a loving mother.

Mother of child killed in fire set by father speaks to NEWS9

 
COLUMBIANA COUNTY, Ohio —

A mother is speaking out for the first time about the death of her son in an East Liverpool arson set by the boy's father.

The fire killed Traci Heath's 11-year-old son, Trey Estimot, on March 17.

The Columbiana County coroner said Trey's father, 37-year-old Ulrick Estimot, set fire to the home on Vine Street. Ulrick Estimot died along with his sons: Trey; 7-year-old Terrell; and 5-year-old Trenton.

The Columbiana County coroner's report, which was finalized Monday, determined that the blaze was a triple murder-suicide and all four died as a result of the fire that Estimot set.

Heath -- Trey's mother -- now lives in South Carolina and spoke to NEWS9's Kelly Camarote by phone Wednesday morning.

Heath said she said goodbye to her son weeks ago with a funeral and memorial service, but she is still processing the new details surrounding his death at his father's home.

When asked if she could say something to Ulrick Estimot, Health said, sobbing, "Rot in hell."

Heath said until the day of the arson, Estimot "was an awesome dad."

Authorities suggest the murders and suicide happened the day after Estimot and Angela Latshaw -- the mother of Terrell and Trenton -- broke up. Heath learned about investigators' details of the deaths and the connection to the breakup over the phone, because she doesn't live in the area.

"I just don't believe any of it. I don't know where the story originated from. I just know it's not true," Heath said.

But that doesn't mean Heath can easily forgive her son's father for something she describes as disgusting, or herself for wishing she did more.

"(Trey) wanted me to write his dad a letter telling him that I wanted Trey to come live with me, and I would tell him, 'I will write the letter.' And I kept telling him, 'I'll write the letter.' And I just never did because I knew it would never happen. His dad would never let it," Heath said. "It is a whole lot of guilt because now I wish I would have written the letter, you know, and maybe tried. … I didn't because I just assumed, you know, that he was in the best place he could be. And then this happened."

The coroner ruled the boys' deaths as murder by arson and the father's death as suicide by arson. All died from smoke inhalation.

Ulrick and Trenton Estimot were found on the first floor of the home, and Trey and Terrell were found on the second floor, according to the coroner's office.

(SPRINGFIELD TWP., OH) - - A father is accused of repeatedly abusing his baby daughter by biting her over an extended period of time.

Clifton Jordan, 21, admitted to police he bit his 7-month-old infant to get her to stop crying at their residence in the 6400 block of

Greenfield Drive in Springfield Township, Police Detective Jim Stroud wrote in a sworn statement filed in Hamilton County Municipal Court.

He is held without bond at the county jail on a child endangering charge.

The baby was admitted to Cincinnati Children's Hospital Medical Center on Monday with several scars from bite marks and at least one fresh wound, records state.

Her left ankle also was fractured, and she was malnourished for her age and size.


It is not clear this morning if the baby is in foster care or staying with a relative, or if there were other children in the home.

Today, a 6-year-old kindergarten student at Campbell Park Elementary School showed a teacher marijuana and a scale that were in the child's backpack.

St. Petersburg Police have arrested the child's father, 25-year-old Larry Stephens of 1726 Queen St. S., and charged him with child abuse and possession of Marijuana with the intent to sell.

Police said Stephens placed the marijuana in the child's backpack before dropping the child off at school this morning.

Stephens, police said, returned a short time later and tried to get the marijuana back, but the drugs had already been turned over to the teacher, so the father left the campus.

According to the arrest affidavit, Stephens told a witness at the school that he had come back to the school to get the marijuana because he uses it to "take care of his business and take care of his family."

The marijuana in the backpack weighed 89 grams, which makes it a felony amount.

According to police, officers were looking for Stephens when his attorney, Daryl Rouson, brought him to the St. Petersburg Police Department and turned him in.

Stephens, police said, admitted to the investigating officers that the marijuana belonged to him, but insisted it was for personal use only.

According to the arrest affidavit, a scale found in the backpack (and Stephen's statement to a witness mentioned earlier) indicated the marijuana was not intended for personal use.

The 6-year-old child was released to the child's mother, police said.

Pueblo County Father Arrested on Child Abuse Charges
(PUEBLO COUNTY, Colo.) -- A Pueblo County father was arrested this week on child abuse charges, ABC News Colorado Springs affiliate KRDO-TV reports.

Kurt Keetch, 19, reportedly caused severe head injuries to his 2-year-old son earlier this month. Authorities opened up an investigation on Keetch after the incident.

The baby is under the care of Children's Hospital Colorado in Denver and is in the custody of the Department of Social Services. His condition is unknown. The baby reportedly showed signs of abuse from previous injuries that have been unaccounted for, according to authorities.

Keetch is currently being held on $200,000 bond in Pueblo County. An arrest warrant was also issued for Keetch's wife, Chelsia Keetch, 20.

PASCO COUNTY, Fla. - Even before baby Lukuz Gelb was born, his mother already nicknamed him Lucky. She says he was the perfect little boy.

But in September 2008, when Lukuz was just two months old, Leann Rodriguez came home to where she lived in Port Richey and found her son wasn't breathing. Doctors told her the boy had severe brain injuries and broken bones in his legs.

"Worst case of shaken baby syndrome that they've seen in the state of Florida," Rodriguez was told.

Authorities soon arrested the man they say is responsible for hurting Lukuz. It wasn't a baby sitter or daycare worker --but the boy's own father, Jonathan Gelb.
Wednesday morning at the Pasco County courthouse in New Port Richey, testimony began in Gelb's trial. He is charged with aggravated child abuse.

The prosecution's first witness was Rodriguez, who calmly recalled the day she came home from work and found her son struggling to breath.

She says Gelb was sitting with the child on his lap and had not called 911.

The defense says Gelb was arrested because he was the only adult home at the time. And the child's condition is the result of health issues and mistakes made at the hospital.

Last summer at her home in Hudson, Rodriguez told me what she hoped for from the trial. "Whether he walks or not, I don't care but I want justice done for my son. I need to know what happened. And why this happened."

As for Lukuz, he turns four in July. Life isn't easy. The right side of his skull was removed, his vision is non-existent, and he eats through a feeding tube. "It's difficult to wake up every morning and see one of your own like this."

Doctors aren't sure about his future. "They've told us to enjoy the time that we have because he may not last very long."

Despite all he's gone through, Leann says Lukuz is a tough little boy. And just like when he was infant, his favorite spot is still resting his head on mom's shoulder.

The trial is expected to last three days.

SOUTHINGTON, Conn. (WTNH) -- A Southington teen was arrested after he fractured several of his 4-month-old son's ribs and then failed to get the baby medical treatment.

The infant was taken to the Connecticut Children's Medical Center on March 21 after the baby was having issues breathing. Officials say the baby has a pre-existing medical issues.

Doctors at the hospital determined the child had multiple fractured ribs and contacted the Department of Children and Families to investigate.

Officials from DCF contacted the baby's father, 18-year-old Tyler Maia, who admitted to causing the injury. Maia told officials that on March 19 he was feeding the baby when the infant began to vomit. Maia then shifted the baby in his arms in a "violent manner."

Maia noticed something was wrong, but never sought medical help.

The teen was arrested on May 23 and held on a court set bond of $75,000. He faces charges of second degree assault and risk of injury.

Salem family of 5 dead in suspected murder-suicide

SALEM -- A mother and three children were found dead during a house fire in Northeast Salem Tuesday, according to police.

Investigators said it appeared that the three young children and their mother died of "homicidal violence" and not due to the fire, according to Lt. Dave Okada with the Salem Police Department.

Firefighters carried the four bodies out of the burning home in the 2500 block of Fisher Road around 5:30 a.m. Tuesday morning.

The husband is a "person of interest" in the murders, Okada said. He was found dead around 11 a.m., inside a vehicle in Cottage Grove, about 60 miles away.

"At this time investigators believe this to be a domestic related murder-suicide situation," Okada said.

Police have not yet released any names. They said the dead woman's husband was also the father of the slain children.
"It was just really surreal what was going on down there. I basically witnessed people screaming and saying that there were people in the house and I just feel bad for the family,” said neighbor Dan Grove.

Nearby, a delivery driver on Tuesday discovered the body of a man along the road about 4:20 a.m. near the intersection of Fisher and Devonshire Streets. The two scenes were being treated as separate investigations.

Dad forces Mom to watch as he shoots 3-year-old daughter to death, burns down house (Broome County, New York)

"Divorce" didn't cause this crime. It's pretty clear that dad LARRY ONEY was just another sick f--- who wanted total control, and that he was going to totally make Mom suffer whether she stayed "in" or tried to get out. This guy sounds like a textbook sociopath through and through. This type doesn't suddenly "snap" or "lose it." This is what they are. Notice he also assaulted the mother, injured her legs so she couldn't flee, tied her up, and threatened to kill her as well. But then he decided that he preferred the basic sadism of forcing her to watch as he killed their daughter.  I suspect that this dude has a "history" that just isn't known yet or hasn't been told.

TRIANGLE — Larry Oney wanted his wife to watch while he and their 3-year-old daughter burned to death in their rural Broome County farmhouse Saturday night.

"It was part of his torture to her to tell her how he was going to kill the daughter and himself and burn the house down," Broome County Sheriff David Harder said Monday, "(so) she could watch and remember it for the rest of her life."

Authorities on Monday recounted the details of the Saturday night murder-suicide in which Oney, a 61-year-old physician's assistant, shot himself and his daughter and burned their house to the ground -- destroying his family, rather than facing a divorce.

Oney, along with his 30-year-old wife, Melissa, and their daughter Allison, 3, had returned from a family outing that was believed to have included a trip to the zoo, Harder said during a news conference.

Melissa Oney informed her husband she was requesting a divorce when they got home, setting off a horrific sequence of events.

Oney punched his wife, cut one of her Achilles tendons and tied her up with neckties before placing her in a car outside 54 Old Catskill Turnpike in the Town of Triangle, Harder said.

"He said (he was going) to kill her, then he changed his mind, and decided to kill just the daughter and himself while she would watch," Harder said.

Harder said there was no history of domestic violence between the two, and no evidence that drugs or alcohol were involved in the incident.

Eventually, Melissa Oney wiggled out of her binds and started the vehicle where she was held captive, Harder said. After a short drive toward the Village of Whitney Point on Route 206, she was able to summon help and call 911.

At 7:44 p.m. Saturday, deputies were dispatched to the scene.

The report deputies responded to was of "a male barricaded inside of a residence with a gun, threatening to burn the house down with his 3-year-old daughter inside," according to the Broome County Sheriff's Office.

Authorities arrived at the scene to the sound of gunshots coming from a century-old farmhouse that was already ablaze.

"It turns out that the gunshots were ammunition going off because of the fire," Harder said.

The fire, which was accelerated with gasoline, was extinguished in a matter of hours, Harder said.

Allison's body was discovered early Sunday with a gunshot wound to the chest and Larry's was found with a gunshot wound to the head. It isn't known in which part of the house the shootings occurred.

Although they both suffered gunshot wounds, the official cause of death is they died of smoke inhalation. Allison's death has been listed as a murder and Larry's as a suicide, Harder said.

It is believed the fire was set before Larry shot himself, Harder said, but some details are unclear.

"He could have shot his daughter first and then set the fire and then shot himself," Harder said. "It's hard to say because nobody's alive to tell us."

Larry Oney was educated at Kings College in Wilkes Barre, Pa., and was employed by United Health Services as a physician's assistant in their urology facility in Johnson City, according to information on UHS's website.

He had been licensed to work as a physician assistant since November 1980, and Melissa became a licensed physical therapist in July 2004, according to the state Office of the Professions database.

Property records show the 117-acre property at 54 Old Catskill Turnpike in the Town of Triangle was purchased by Larry Oney and Melissa Shive in February 2007.

Melissa gave birth to Allison on Nov. 5, 2008, according to Press & Sun-Bulletin archives.

Melissa Oney underwent surgery at UHS Wilson Medical Center on Saturday and continues to recover from the injuries she suffered in what Harder called a "tragic event."

"You've got a 3-year-old girl who died for really no reason," he said, "other than her father just lost it, basically, from being told the mother wanted a divorce."

ROME — Police in northern Italy say a father has thrown his two young children to their deaths from a sixth floor apartment balcony before jumping to his death.

Brescia police spokeswoman Nicoletta Di Maio says the mother, who was home at the time, is currently in the hospital under sedation.

Italian news agency ANSA said the 41-year-old man had lost his job a year ago, but it wasn't clear if economic difficulties were to blame. Italy, which is back in recession, has seen a rash of suicides in recent weeks.

Di Maio said the man first threw his children, aged four and 14 months, and then threw himself off the balcony. He died immediately; the children were pronounced dead at the hospital.

OTTAWA — A “great father” who brought his three-year-old daughter to a crack deal shouldn’t spend a day in jail, his lawyer argued Friday.

The smiling little girl in the Mickey Mouse T-shirt held father Terry Phillips’s hand on the way to one of five drug deals in March and April 2010. The moment was captured on police surveillance photos taken of the 38-year-old father of two and repeat drug dealer. In total, Phillips sold the officer 15.4 grams of crack cocaine over the five meetings.

Phillips, 38, also brought the child to his sentencing hearing before Ontario Superior Court Justice Lynn Ratushny deemed it inappropriate and asked her mother to remove her from the courtroom.

His lawyer, James Harbic, argued the “caring and thoughtful” family man who previously served six months in jail for dealing crack should be sentenced to two years’ less a day of house arrest and other conditions.

Federal prosecutor CĂ©line Harrington argued that was absurd. She asked for 2½ to three years in federal prison.

Harrington said nothing could be more aggravating than bringing an innocent child to what could have been “a very volatile, dangerous situation.”

“He brings his three-year-old toddler with him ... despite the violence associated with drug dealing,” Harrington argued.

“An innocent three-year-old girl holding her dad’s hand to do a drug deal,” she said, holding the photo up, so Ratushny could see it. “Are those the actions of a good father?”

Harbic acknowledged Phillips’s decision to bring the child was “stupid” but argued his client had turned his life around. The former addict was committed to his full-time job at a hotel and taking care of his teenaged autistic son and young daughter.

“He has very serious responsibilities as a family man,” said Harbic. “He really understands that important role.”

Society would be better served if Phillips was allowed to serve his time in the community, Harbic argued.



“We can’t hide behind our children but ultimately, the court can’t have a blind eye,” said Harbic. “A period of incarceration will have a negative impact on this man, his family and the community as a whole.”



Phillips himself told Ratushny he denounced drugs, was committed to becoming a “positive person” and wanted to make a better life for his family, even though a probation report said he still smoked marijuana on weekends.

Harrington argued that was the same “song and dance” he presented the last time Phillips admitted to dealing crack.

Nothing has changed, she said.

Phillips is expected to be sentenced June 25.

Father vowed to kill mom and youngest child as they drove around the metro area for six to seven hours, charges say.

A Brooklyn Park man kept the mother of his three children captive in a car for six to seven hours Wednesday, circling the Twin Cities while threatening to kill her and their youngest child, authorities say.

At one point, the woman pressed her face against the window and mouthed "Help me!" to another driver, according to charges filed Friday against Chia Vang, 27.

He is scheduled to appear Monday in Ramsey County District Court, charged with one count of kidnapping, two counts of terroristic threats and one of methamphetamine possession.

The victim, identified as M.V., told police that Vang was her ex-boyfriend; he said they were married in the Hmong tradition.

According to the charges, M.V. had stayed in domestic-abuse shelters after Vang allegedly head-butted and choked her in their home last week.

The woman, 29, asked her nephew to pick her up to run errands Wednesday, and as they rode with the couple's two oldest children, they noticed Vang following them in her car. He had learned of her whereabouts by looking at the caller ID on her mother's phone, he later told police.

The woman called 911 from a St. Paul market, and police arrived to speak with Vang. Police sent him and the couple's youngest child away on foot after learning that an order for protection that the mother had sought was not yet valid, authorities say.

Vang reappeared, threw the couple's youngest child into the mother's car, blocked in the nephew's vehicle and forced M.V. into the car.

During the drive, he threatened to pick up the other two children to "kill them all in a car crash," the complaint states.

He was arrested in Washington County. M.V. and the child were not hurt.

The reporter leaves a lot of this story rather vague. The daughter was brought to Texas "illegally"? Does this mean she was an undocumented person from Mexico? That she was abducted from her custodial mother? All the above? At any rate, it sounds like this poor young woman lived only with her UNNAMED DAD, with no mother in the home.

WEATHERFORD, Texas — A Parker County man has been sentenced to 40 years in prison for repeatedly impregnating his daughter over more than a decade of sexual assault.

The assaults resulted in a child, a miscarriage and two abortions, Assistant District Attorney Jeff Swain said.

The 48-year-old man pleaded guilty to aggravated sexual assault. He will have to serve half of his sentence before being eligible for parole, Swain said.

The woman “is certainly happy with the result,” Swain said, adding that it is “a deserving sentence.”

The daughter, who is in her mid- to late 20s, came forward last July.

“She did not want the same thing to happen to other girls,” Swain said.

The girl was reportedly was brought to Texas illegally when she was 13 and lived with her father in Weatherford, according to the Weatherford Democrat.

The abuse started as early as 1997 and was still going on last year when she reported it to the Parker County Sheriff’s Department.

When she was an adult, she became pregnant by the man again and was sent to Mexico to have the pregnancy terminated, the Democrat reported. When she was 25 years old, she miscarried a third pregnancy by her father. In January 2011, the woman became pregnant again and had an abortion in Dallas, the newspaper said.

Swain said no other children in the home apparently were abused.

The plea was entered May 10 in the 415th District Court.

Attorney Mac Smith, who was retained by the man shortly after his arrest last summer, declined comment.

Dad-of-three faces 36 abuse charges

A father who allegedly bashed his three children with a machete and cricket bats during a three-year reign of terror is facing eight years behind bars.

Police allege the 43-year-old West Auckland dad frequently beat his three children, now aged between 6 and 14, with garden rakes, tree branches and metal pipes from a vacuum cleaner.

When one of the children tried to run away, the father chased him into traffic and he was struck by a car.

The man appeared in the Waitakere District Court on Friday for a sentencing indication where his wheelchair-bound wife broke down in tears as the 36 charges against him were read out. He cannot be named to protect the identity of the children.

The father turned on his 8-year-old son by whacking him with the flat part of a machete while he was sleeping, causing him to fall off the top of his bunk bed on to the floor where he continued to beat him.

Police said the boy had to miss school for a month after a large bruise became infected.

Crown lawyer Sarzana Nizam suggested the father be imprisoned for 7 to 8 years.

His counsel Trunelle Massyn argued a sentence of 3 years would be more appropriate.

In February last year, he allegedly slapped his 14-year-old in the face before pushing him up against the wall and strangled him while yelling, "I'm gonna kill you. I'm gonna squeeze the living shit out of you".

During the next two months he allegedly whipped the same son with a garden hose and a computer wire, and bashed him with a metal pipe from the vacuum cleaner.

He then held him in a choke hold and scratched his face.

Court documents revealed that in April last year, the son was hit by a car outside his home while being pursued by the father.

Police claimed the boy wasn't hurt in the accident so got up and continued to run. But the father got into his car and chased his son along a street in Massey where he ran him down before grabbing him by his hair and dragging him into the car.

When they arrived home, the father allegedly threw him on to the couch before beating him with a garden hose across his legs, hands and stomach.

Judge Lisa Tremewan said the family lived in an over-crowded house with little money.

The children were taken away by Child, Youth and Family and are now in the care of their step-sister.
