A father who went on the rampage and killed his wife and two of their children before killing himself spared his one-year-old daughter in the second family slaughter to shock Germany in a few days.
The 69-year old architect dumped his baby girl at a hospital before returning to his Berlin home and killing his 28-year-old wife and their two sons aged three and six. He then killed himself. A suicide note was found.
"It is a family tragedy. We believe the family was heavily indebted," a police spokesman said.
The bodies were found by firefighters who broke into the house after worried neighbours became suspicious.
The children were found in their room. Police have not disclosed how they were killed.
"We can confirm that it is the child is the daughter of the dead woman. The girl was healthy and in good, clean condition," a spokesman for the hospital said.
The girl has been transferred to an orphanage.
The killing came just days after a mother and her two children had been killed in Nuess, near Düsseldorf.
A 35-year-old man, reportedly known for being a violent husband, allegedly shot dead his 26-year-old wife and their two children, aged four and eight.
The man is on the run and police consider him as dangerous and possibly armed.
"We need to get him as soon as possible," Guido Adler, head of the murder unit, said.

Prosecutors in the northern state of Lower Saxony, Germany, said police found the bodies of the four youngsters, aged five, seven, nine and 12, in the town of Gross Ilsede on Thursday evening.
Their 36-year-old father had suffered serious injuries, "presumably" from trying to commit suicide, and was now in an induced coma in hospital.

According to the prosecutor in nearby Hildesheim, the man had left a suicide note detailing "marital problems" and said that his wife was abroad on holiday at the time.
It is believed that the man told her about the deaths of their daughter and three sons by text message. She then passed the message on to relatives, who contacted the police.
When officers arrived at the family's semi-detached home, they found the children's bodies and their seriously injured father, along with the suicide note.
According to German newspaper, The Local, prosecutors said the children had suffered "cut injuries" and were thought to be asleep at the time of the attack.
A murder inquiry has been opened and police continue to hunt for the weapon used in the killings.
The father will be arrested on suspicion of murder when he awakes.
Despite the note indicating there were marriage problems, there is no indication that the couple were separated.
The prosecutor’s office added that the man was not previously known to police and described the family as "completely ordinary."
According to reports, the mother has now returned to Germany. Autopsies are expected to be performed today.

Dad PETER R. is your classic narcissistic abuser. Child custody is just an avenue of control for these types, they don't give a sh** about the kids or raising them. They just want to make sure Mom is punished enough for leaving their sorry @$$es. So taking custody of the kids--or drugging them and burning them to death--it all accomplishes the same aim to them. We need to stop giving these types acccess to the kids at all.

A man who murdered his two young daughters by drugging them, strapping them into his car and then setting it on fire after a custody battle with his former wife was jailed for life in Germany on Thursday.
The 41-year-old Danish man, identified only as Peter R., had taken his daughters, aged nine and ten, on holiday to Germany in August 2011, when the judge Frank Tiemann said “resentment and jealousy” towards his ex-wife drove him to kill them both.
He stopped his car in the woods in Brandenburg, sedated the children with sleeping pills, strapped them into the back seat and doused the car in petrol before setting it alight, Potsdam district court heard.
Although he was initially in the car, Peter R. got out at the last minute and was found severely burned, staggering into the road. He was taken to a specialist burns unit in Berlin.
His lawyer argued for a manslaughter conviction, saying Peter R. had been planning to kill himself along with his daughters, but the judge convicted him of murder in light of what he said had been considerable planning. He was sentenced to 15 years in prison.
Tiemann said that because Peter R. had clearly made the effort to buy sleeping pills to sedate the girls and filled up several canisters of petrol, it could not have been a spontaneous decision.
The Süddeutsche Zeitung newspaper reported on Thursday that the Dane had been fighting with his ex-wife about custody of their children. He told the court that he had "killed them out of love as they should not have to live a life without him."
Psychologists instead deemed him to have a “narcissistic personality disorder.”

A German father who slept with his daughter over 500 times and produced three incest children was jailed for less than three years on Monday after a court declared he did not rape her.
A judge in the case of Adolf B., 69, stunned female and child protection rights groups by declaring that his sexual relationship with his daughter over 30 years was 'by agreement' - even though he first molested her when she was only 12-years-old.
He was accused of brutalising his wife and children, stunning them into a long-term conspiracy of silence. But the judge threw out the rape charge and sentenced him to just two years and eight months in jail for incest.
Prosecutors at the court in Nuremberg had demanded a 14 year sentence for the ordeal he inflicted on his daughter Renate.
In the media he was called the 'German Fritzl' in reference to the Austrian rapist Josef Fritzl who imprisoned his daughter Elisabeth for 24 years and fathered six incest children with her.
Adolf B. was charged with 497 rapes committed over 34 years until his arrest in March this year. His daughter, now 46, had three children by him, two of whom have since died.
'She liked it,' he said of his sexual relationship with her although Renate testified otherwise. She said he threatened to kill her if she told anyone about what happened between them.
She told the court; 'He said; 'Tell a soul and I will kill you. No matter where you go I will find you and kill you.'
The German woman lived in the family home along with her mother and siblings in Willmersbach, a village near Nuremberg.
She spoke of constant beatings, with all members of the family subjected to a routing of aggression and fear.
A prosecutor told the the Nuremberg-Fürth regional court: 'She had three sons by her father, one of whom died as a baby, another of whom died recently, while the third survived.'
Authorities only uncovered the case after the woman was convicted of blackmailing the wife of a doctor she blamed for the disability of one of her sons. She was assigned a parole officer who won her trust and eventually heard her story.
A spokeswoman for a rape crisis centre in Berlin said; 'This is a shocking judgement, for the woman (Adolf's wife and daughter), for women everywhere and for justice. What was this judge thinking? That a 12-year-old girl can make these kinds of choices?'

A man convicted of molesting his daughter in Tucson was arrested in Germany after 11 years on the run - largely because of his daughter's determination to track him down.
Frank Karl Hertel, 49, fled the country in August of 2000 during jury deliberations in his trial, the U.S. Marshals Service said in a news release. A warrant for his arrest was issued by Pima County Superior Court.
Hertel was tried in absentia in 2001 and found guilty of sexual conduct with a minor under the age of 15.
He faces 13 to 27 years in prison when he is brought back to Arizona, a representative from the Pima County Attorney's Office said.
Hertel also faces charges of strong-arm rape in Ohio for several sexual encounters with a minor, the release said.
Hertel's daughter said she was molested for 15 years, from the time she was 3 years old until she was 18, court records show.
Heather Orr, now 29, said the abuse started when the family lived in Ohio and continued when they moved to Tucson.
Orr, who now lives out of state, has spent the last several years trying to track down her father, whose family has ties to Germany.
In 2009 she found a story online about her grandfather, who had been arrested for tax evasion, and left a note in the story's comment section asking if anybody knew relatives of her grandfather in Germany.
One man wrote back to say the man had a son who was living with his American wife and child. Orr found that Hertel was operating a bar in Germany.
She compared photos found on the business's website with photos of her father that her brother had sent to her.
She contacted the U.S. marshal on the case, but said there was no progress for several months. Then a new marshal was assigned to the case and acted on the information Orr had provided.
Hertel was arrested on Oct. 21 in the city of Useriner-Muehle, where he had assumed the identity of his brother and was managing the Mustang Bar, the release from the U.S. Marshals said.
The arrest has been a long time coming for Orr, who says she's been let down by authorities several times.
She first reported her sexual abuse in 1991 when she was in the eighth grade and the family was living in Ohio, she said.
She told a friend her dad had molested her, records show. The friend's parents reported the incident to the Department of Child Services and the allegations were investigated by a social worker, who determined that Hertel had molested his daughter when she was in the second grade.
The agency "did a case on me and they sent it to the prosecutor's office and they said sexual abuse was indicated, and they did nothing," Orr said.
Six months later, the Hertel family moved to Tucson.
When Orr was 18, she and Hertel went to a therapy session where he admitted to molesting her.
Hertel told the therapist that it was a "sexual lesson for his daughter on how men behave," court records show.
The therapist reported the sexual abuse to Child Protective Services, court records show.
Orr then reported the abuse to the Tucson Police Department and the Pima County Sheriff's Department and taped a phone conversation with her father in which he admitted to the abuse.
She turned the tape over to the Sheriff's Department, court records show.
Hertel confessed to authorities and was charged with sexual abuse. He fled the country after posting bond during his trial.
Orr is writing a book about her experience and says her determination to bring her father to justice stems from a desire to protect others from sexual abuse.
"No child deserves to have to go through what I did and also be let down time and time again," she said

Berlin - A German father is to go on trial next week on 400 charges of sexually abusing his own daughters, justice officials disclosed Wednesday, only one day after three decades of incest in another family became public.
In the new case, a daughter who is now 24 gave birth to two children by her father. The abuse began after she was 18. Her younger sister had been abused from the age of 16, prosecutors alleged.
The 46-year-old man from Guenzberg, southern Germany, faces, for each daughter, 200 charges of obtaining sex from a person whom he was under a duty to protect. The trial opens Tuesday. His arrest had not been made public previously.
New details emerged in a case made public on Tuesday of a 69-year-old man arrested six months ago for abusing his daughter over a 34-year period and fathering three sons with congenital defects by her.
Defence lawyer Karl Herzog said an uncle of the woman, who is now 46, had fathered an additional child by her.

Berlin - A German father is to go on trial next week on 400 charges of sexually abusing his own daughters, justice officials disclosed Wednesday, only one day after three decades of incest in another family became public.
In the new case, a daughter who is now 24 gave birth to two children by her father. The abuse began after she was 18. Her younger sister had been abused from the age of 16, prosecutors alleged.
The 46-year-old man from Guenzberg, southern Germany, faces, for each daughter, 200 charges of obtaining sex from a person whom he was under a duty to protect. The trial opens Tuesday. His arrest had not been made public previously.
New details emerged in a case made public on Tuesday of a 69-year-old man arrested six months ago for abusing his daughter over a 34-year period and fathering three sons with congenital defects by her.
Defence lawyer Karl Herzog said an uncle of the woman, who is now 46, had fathered an additional child by her.

Authorities finally uncovered the horrific case after the woman, now 46, was convicted of blackmailing the wife of a doctor she blamed for the disability of one of her sons. She was assigned a parole officer who won her trust and eventually heard her story.
The man is accused of beating his daughter into submission and first raping her when she was 12 or 13, and then raping her from then on several times a week, according to a statement released on Tuesday by the state prosecutor in Nuremberg-Fürth.
Prosecutor Antje Gabriels-Gorsolke told The Local that the man lived with his wife, daughter and other children – as well as the sons she bore him as a result of his attacks.
Gabriels-Gorsolke said the man, who had had a job when his daughter was young, but has been unemployed for years, had only singled his daughter out for his despicable attention. He kept her under a regime of constant monitoring and repeated rape, apparently accompanying her whenever she left the house and not allowing her to establish any relationships with other people.
She said the woman’s mother is thought to have known of the initial rapes, but charges could not be brought against her for not helping her daughter because they would have exceeded the statute of limitations. “It would be too difficult to charge her, it was all too long ago,” she said.
“She has now moved out and is living with a son, I do not want to say where,” said Gabriels-Gorsolke.
The father is charged with 497 cases of rape – those from the last 20 years which have not yet reached the statute of limitations after which crimes cannot be pursued by the authorities.
He attacked his daughter either in the parental bedroom or her own room, the statement said, although after she got her driving license he often forced her to drive into the country and raped her in the car.
The abused woman bore her fathers three sons, one of whom died young, many years ago. The second is an adult living away from home – and who has now offered his mother sanctuary.
The third son died recently, as a child, said Gabriels-Gorsolke. She said due to the circumstances of his death, on which she would not elaborate, the local hospital undertook a post-mortem, from which tissue samples still exist and which have yielded genetic material used to prove incest.
The man was arrested this March, and has been held since then in investigative custody. He has admitted having sexual relations with his daughter but claimed that this was always consensual.
There have been several similarly horrific cases in Europe in recent years, the most infamous involving Austrian Josef Fritzl. While keeping his daughter imprisoned in a cellar for 24 years, Fritzl repeatedly raped her and fathered several children with her. He was sentenced to life in prison in 2009.

The fire, which occurred near Berlin earlier this month, has been reconstructed by German police, with the results of the test exposing inconsistencies in the father’s story.
The man, who is still in hospital suffering with extensive burns, was spotted staggering around in a forest 20km from Berlin on 12th August. The two girls, aged nine and ten, were found to have been alive when the car was set alight. Their disorientated father claimed it had been a tragic accident.
“We have used the same type of car in different tests where we have set it on fire. The results contradict what the father has said,” German state attorney Tom Kopping said told Politiken. “We doubt there was an accident and are now treating the case as a double murder,” he added.

So, how nice to know that the German media is just as ignorant as its counterparts around the world. When you have a father who "allegedly" drugged his daughters before murdering them in a car fire, the cause is not a visitation "squabble." What you really have is a seriously unbalanced controlling father who committed a DOUBLE MURDER, and a mother who did her best to protect her children by trying to prevent the father from gaining access to them.

Authorities acted hours after toxicology evidence emerged that 9-year-old Line Sofie and 10-year-old Marlene Marie had been given sleeping pills before the car caught fire.
The father remained Friday in hospital where he is recovering from his own burns in the incident and skin grafts.
Prosecutor Tom Koepping said a magistrate went to the hospital ward and told the father he was now in legal custody. Two policemen will permanently watch him in hospital until he can be moved to a jail.
Police suspect a dispute between the divorced parents was the motive for the killing. Danish newspapers say they had squabbled over visitation rights.
Drug traces were found in blood in the gutted small car although the girls were burned beyond recognition, proving the girls had been sedated in advance.
Police have said they are certain the girls were alive when the fire broke out in the car in a forest near Berlin.
The father alerted police after the blaze and though burned, led them to the site. He claimed to detectives the fire was an accident.
Koepping said the toxicology results and a police reconstruction of the blaze threw 'major doubt' on the father's claim.
Prosecutors said it would take two to three months to complete an inquiry and then to indict the father. They said Germany would hold the trial, although Denmark would technically also have jurisdiction since both the suspect and victims were Danish nationals.
Hospital spokewoman Angela Kijewski said doctors forecast the man would be medically fit next week to be moved to a jail and be kept in either a cell or a sick bay

The crime, which took place in 1996 in the northern state of Schleswig-Holstein, was only discovered last year when the victim's younger sister went to the police. The 69-year-old man was arrested two days before Christmas 2010.
The murdered woman, who had learning difficulties, was Turkish and had been staying with the family illegally after her tourist visa expired. Her disappearance, therefore, went unnoticed by authorities.
Her father had lived in Germany for more than 40 years and taken German citizenship in 2001.
The younger daughter, now 33, told the court that he had threatened to kill her if she did not help to hide the body.
The dental assistant told the court that her father had told her in advance of his intention to kill her sister, saying: 'I think she's pregnant, I have to get rid of her.' She came home from school shortly afterwards to find the body in a bag on the balcony.
He had first buried his victim in a garage, but later dug it up and put the remains in the rubbish. But police later found bones in the garage with the help of sniffer dogs.
The man had sent his wife away to a health resort at the time of the crime and when she later asked where her daughter was he told her that the police had deported her back to Turkey.
He then forbade her from trying to visit her daughter and later told her she had been killed in an earthquake.
It was the mother's continual demands to know what had happened to her older daughter which eventually caused her to go to the police, the younger daughter said.
Police are now investigating her for being an accessory to murder and for not reporting her father when she first heard of his intentions.

How lawyers manipulate doctors in custody cases: Do-No-Harm vs. Take-No-Prisoners

When soldiers are ordered to "take no prisoners," it means to annihilate their enemies. Physicians who vow to "do no harm" step onto a treacherous path when they sell their expertise to lawyers trained to take no prisoners in adversarial lawsuits.
For more than two decades, I have researched domestic abuse custody cases in Rhode Island Family Court, trying to understand how this publicly financed process crushes children and families. In many of these cases, lawyers, who are officers of the court, have manipulated clinicians. (Below I am naming only those lawyers and physicians specifically responsible to protect children.)
First Case: At Hasbro Hospital's Child Protection Program (CPP), Providence, Rhode Island, in 1997, a 6-year-old girl sat rigid, a blanket over her head. Children often try to disappear when life gets intolerable.
The girl's father had a documented history of aggression against his first two wives and their children. This child, the youngest, showed symptoms of sexual abuse. CPP Director Dr. Carole Jenny reported: "There is no doubt in my mind that some event happened because of the child's clear and consistent disclosure."
The father harassed those who tried to help his families: a security guard, social workers, therapists, teachers, pastors. He bullied a Providence Journal editor. He took aim at Kevin Aucoin, chief legal counsel at the Department of Children, Youth and Families (DCYF), for not responding quickly enough after the father appealed DCYF's findings against him. When he threatened to sue, Aucoin needed Dr. Jenny to revise her assessment.
She listed warning signs in the father's behavior, then minimized them in a summary of court documents. Her new "forensic review" freed the father to demand possession of his children. He held them for thirty months, until the eleventh Family Court judge to hear the case denounced his behavior in 2003 and sent the children home to their mother with damage that has not yet healed.
Second Case: In March 2006, attorney Lise Iwon began writing letters to the CPP about a case in which she purported to be a neutral guardian ad litem. She secured an astonishing report from Dr. Nancy S. Harper at CPP. Instead of medical information, Harper's report glibly summarized court documents Iwon had provided, repeating the conjecture, hearsay, and biased rhetoric in the father's defense strategy.
Harper's supervisor, Dr. Jenny, never saw or signed off on her CPP report before Iwon whisked it off to the judge who ordered DCYF to remove two young girls that day from their mother for a "psychiatric evaluation." Police arrived with a social worker to take them from their schools into "temporary" custody. The children remained in foster homes and a shelter at taxpayer expense for more than sixteen months before the state awarded the younger girl to the father she had accused of sexually assaulting her; the older girl went to yet another foster home.
Scores of neighbors, teachers, and others wrote letters attesting to the mother's superb parenting, but Iwon never interviewed them. Dr. Jenny told me the mother's behavior sounded "bizarre" but candidly admitted she herself might seem bizarre if she believed her children were in danger.
Third Case: A German father, head of a vast multinational corporate empire, retained several law firms in the U.S. and Germany to retrieve his two American sons after his estranged wife brought them here to her parents for one to have surgery in 2007.
The mother told me she had confronted her husband in Germany with evidence that he was sexually abusing their sons. She said she had walked in on this happening and found disturbing photos on a laptop computer her husband had given her. She related that her sons had pointed out a store where their father got hardcore pornography. They allegedly told her that he forced them to watch it and act it out.
The father hired a former U.S. official (at $700 an hour) as one of his lawyers, who reached out to Family Court Chief Judge Jeremiah S. Jeremiah, Jr., and paid the chief's assistant David Tassoni over $2,300 to help. The father's attorneys met alone in chambers with U.S. District Judge William E. Smith and intervened to end the involvement of Family Court, DCYF, and the FBI. They secured attorney Sharon O'Keefe, who had been assistant child advocate in Rhode Island, to serve as guardian ad litem.
O'Keefe contracted with Dr. Jenny to evaluate some of the father's photographs and a stack of German legal documents with apparent translations. O'Keefe's bill exceeded $13,000, including at least $2,000 to be paid directly to Dr. Jenny.
O'Keefe hardly talked with the boys, and Jenny never met them. Both concluded they saw no evidence the father was a pedophile. Judge Smith gave the boys and their American passports to their father, who took them back to Germany in April 2007.
Judge Smith ordered the father to give the boys plenty of time with their mother. But she has not been allowed to see or communicate with them since 2007. On Mothers Day 2010, one son wrote a plaintive note asking why "these people" would not at least let them Skype her.
It is troubling that Dr. Jenny never talked to the boys, who might have helped her interpret the photos. Nor did she demand an independent search of the hard drive by state police who are trained and equipped to examine electronic evidence of child pornography--and who do not accept private payment for their services.

First Case: P92-4797 in Rhode Island Family Court; Carole Jenny, MD, signed the Child Safe Clinic #0629-23-38 report of January 14, 1997. After an extensive sexual abuse assessment by St. Mary's Home (April 16, 1997), DCYF sent a letter (April 18, 1997) to notify the father he had been "indicated." He appealed and a year later threatened to sue DCYF and its senior counsel Kevin Aucoin for failure to schedule a hearing. DCYF asked Dr. Jenny to review her records. Her report (July 29, 1998) was followed by a revised DCYF report (August 6, 1998), and Aucoin's motions (August 6, 1998, etc.) to launch an expedited trial. DCYF investigator Edward J. O'Donnell sent a letter (August 18, 1998) to the father stating that the findings against him "are hereby overturned . . . pursuant to . . . a forensic review of the investigation and all associated material conducted by Dr. Carole Jenny" (DCYF Administrative Appeal of SCR 425142 I/6).
Second Case: N04-0106 in Rhode Island Family Court and 1676-86-32 AC 000119896231 at Rhode Island Hospital. The court file, which is now sealed and presumably held at the Rhode Island Supreme Court, contains Lise Iwon's Motion (March 31, 2006) regarding her communications with Nancy Harper, and Iwon's Motion (April 5, 2006) asking to release clinical reports and court documents to Harper, whose report (March 21, 2006, signed April 5, 2006), shows that Harper already had those documents. I interviewed the mother and secured documents from her and the court file until Judge John Mutter imposed a gag order forbidding all parties to disclose anything further about the case and sealed both the divorce and DCYF files, on or about August 16, 2007.
Third Case: 07-46S in the U.S. District Court for Rhode Island, which holds transcripts, including the ex parte chamber conference of January 31, 2007, and court orders, including the decisive order of March 28, 2007; Jenny's report to O'Keefe (March 15, 2007); and the father's documentation of payments to Tassoni and others. The mother provided scores of documents, including the rental list from the German video store (October 2005), an initial DCYF report by Paul Ventura (January 31, 2007), O'Keefe's bills (March 12 and 28, 2007), hundreds of photographs from the laptop, and her son's letter (Mother's Day 2010).

Instead of medical information, Harper's report glibly summarized court documents Iwon had provided, repeating the conjecture, hearsay, and biased rhetoric in the father's defense strategy.
Harper's supervisor, Dr. Jenny, never saw or signed off on her CPP report before Iwon whisked it off to the judge who ordered DCYF to remove two young girls that day from their mother for a "psychiatric evaluation." Police arrived with a social worker to take them from their schools into "temporary" custody. The children remained in foster homes and a shelter at taxpayer expense for more than sixteen months before the state awarded the younger girl to the father she had accused of sexually assaulting her; the older girl went to yet another foster home.
Scores of neighbors, teachers, and others wrote letters attesting to the mother's superb parenting, but Iwon never interviewed them. Dr. Jenny told me the mother's behavior sounded "bizarre" but candidly admitted she herself might seem bizarre if she believed her children were in danger.
Third Case: A German father, head of a vast multinational corporate empire, retained several law firms in the U.S. and Germany to retrieve his two American sons after his estranged wife brought them here to her parents for one to have surgery in 2007.
The mother told me she had confronted her husband in Germany with evidence that he was sexually abusing their sons. She said she had walked in on this happening and found disturbing photos on a laptop computer her husband had given her. She related that her sons had pointed out a store where their father got hardcore pornography. They allegedly told her that he forced them to watch it and act it out.
The father hired a former U.S. official (at $700 an hour) as one of his lawyers, who reached out to Family Court Chief Judge Jeremiah S. Jeremiah, Jr., and paid the chief's assistant David Tassoni over $2,300 to help. The father's attorneys met alone in chambers with U.S. District Judge William E. Smith and intervened to end the involvement of Family Court, DCYF, and the FBI. They secured attorney Sharon O'Keefe, who had been assistant child advocate in Rhode Island, to serve as guardian ad litem.
O'Keefe contracted with Dr. Jenny to evaluate some of the father's photographs and a stack of German legal documents with apparent translations. O'Keefe's bill exceeded $13,000, including at least $2,000 to be paid directly to Dr. Jenny.
O'Keefe hardly talked with the boys, and Jenny never met them. Both concluded they saw no evidence the father was a pedophile. Judge Smith gave the boys and their American passports to their father, who took them back to Germany in April 2007.
Judge Smith ordered the father to give the boys plenty of time with their mother. But she has not been allowed to see or communicate with them since 2007. On Mothers Day 2010, one son wrote a plaintive note asking why "these people" would not at least let them Skype her.
It is troubling that Dr. Jenny never talked to the boys, who might have helped her interpret the photos. Nor did she demand an independent search of the hard drive by state police who are trained and equipped to examine electronic evidence of child pornography--and who do not accept private payment for their services.
In January, I wrote expressing these concerns and asked Dr. Jenny to improve CPP's protection of children by:
- Establishing ethical standards that forbid CPP staff to produce reports for private clients in litigation without a full investigation into the family's history;
- Making a complete inventory of past reports produced by CPP or its staff to see how these have been used in litigation and to examine the outcomes for children;
- Providing CPP staff with training in domestic abuse, coercive control, and the symptoms of post-traumatic stress disorder (PTSD) that clinicians need to recognize in protective parents who may seem "bizarre" in their appropriate efforts to protect their children.
Notes
In order to protect children's identities, I am referring only to case numbers.
First Case: P92-4797 in Rhode Island Family Court; Carole Jenny, MD, signed the Child Safe Clinic #0629-23-38 report of January 14, 1997. After an extensive sexual abuse assessment by St. Mary's Home (April 16, 1997), DCYF sent a letter (April 18, 1997) to notify the father he had been "indicated." He appealed and a year later threatened to sue DCYF and its senior counsel Kevin Aucoin for failure to schedule a hearing. DCYF asked Dr. Jenny to review her records. Her report (July 29, 1998) was followed by a revised DCYF report (August 6, 1998), and Aucoin's motions (August 6, 1998, etc.) to launch an expedited trial. DCYF investigator Edward J. O'Donnell sent a letter (August 18, 1998) to the father stating that the findings against him "are hereby overturned . . . pursuant to . . . a forensic review of the investigation and all associated material conducted by Dr. Carole Jenny" (DCYF Administrative Appeal of SCR 425142 I/6).
Second Case: N04-0106 in Rhode Island Family Court and 1676-86-32 AC 000119896231 at Rhode Island Hospital. The court file, which is now sealed and presumably held at the Rhode Island Supreme Court, contains Lise Iwon's Motion (March 31, 2006) regarding her communications with Nancy Harper, and Iwon's Motion (April 5, 2006) asking to release clinical reports and court documents to Harper, whose report (March 21, 2006, signed April 5, 2006), shows that Harper already had those documents. I interviewed the mother and secured documents from her and the court file until Judge John Mutter imposed a gag order forbidding all parties to disclose anything further about the case and sealed both the divorce and DCYF files, on or about August 16, 2007.
Third Case: 07-46S in the U.S. District Court for Rhode Island, which holds transcripts, including the ex parte chamber conference of January 31, 2007, and court orders, including the decisive order of March 28, 2007; Jenny's report to O'Keefe (March 15, 2007); and the father's documentation of payments to Tassoni and others. The mother provided scores of documents, including the rental list from the German video store (October 2005), an initial DCYF report by Paul Ventura (January 31, 2007), O'Keefe's bills (March 12 and 28, 2007), hundreds of photographs from the laptop, and her son's letter (Mother's Day 2010).

The court found 48-year-old defendant, identified only as Detlef S., guilty of 162 counts of sexually abusing his children and forcing his daughter and stepdaughter into prostitution between 1987 and 2010.
He has confessed to the charges.
Detlef S., whose last name was withheld because of German privacy laws, first began molesting his daughter when she was nine, and after her 12th birthday party he regularly sexually assaulted her, the DAPD news agency reported.
Detlef S. had already been abusing his twin stepchildren, who are now 28. He started in 1987 when they were only four years old, and continued until 2010.
DNA samples confirmed Detlef S., a truck driver who lived in Fluterschen near Bonn, fathered seven of his stepdaughter's children. An eighth child passed away before DNA tests could be done, but he later admitted to fathering all eight children.
Shortly before the court announced the verdict, stepson Bjoern B., a co-plaintiff in the trial, told reporters that "Today is the day of truth, the day of justice."
"We have waited 13 years for this day," Bjoern B. said of himself and his siblings who were also abused by Detlef S.
Germany's Bild newspaper has called the suspect the "German Fritzl" — a reference to Europe's most infamous case of incest. Austrian Josef Fritzl was found guilty in 2009 of locking his daughter in a dungeon for 24 years and fathering seven children with her. He is serving a life sentence.

In a case that has sent shockwaves through Germany, a father has unexpectedly confessed to hundreds of counts of sexually abusing his children. Detlef S. admitted to "behaving in a fundamentally wrong manner," his lawyer told the court in Koblenz on Monday.
The lawyers of the accused have asked for a prison sentence of nine and a half years, and opposed the inclusion of preventive custody in the sentence, saying their client did not pose a danger to the general public because all the crimes took place within the family.
In the previous week, the public prosecutor had called for a prison sentence of 14 years and six months with preventive custody to follow afterwards. Preventive custody aims to stop someone from committing further crimes, but is not imposed as a punishment in itself.
Detlef S. from Fluterschen is on trial for 160 counts of sexual abuse and rape as well as aiding and abetting these crimes.
The victims were his children: a daughter, who is now 18, a 27-year-old step-daughter and her twin brother. He began abusing his daughter when she was nine years old.

On Monday he admitted to forcing his daughter and step-daughter into prostitution with men and receiving money for this.
Until now Detlef S. had only admitted to abusing his daughter and fathering seven children with his step-daughter.

Notice that while this dad--identified only as DETLEF S.--is accused of fathering 7 children with his stepdaughter, he's also accused of sexually abusing his own daughter. The man, identified only as Detlef S. in line with German privacy rules, is charged with sexually abusing minors in his care in a town near Bonn between 1987 and 2010, and with facilitating sexual acts with minors, Koblenz court spokesman Alexander Walter said.
The suspect is accused of abusing his daughter and stepdaughter himself, and of forcing both to have sex with other men for money. Two of those men also face charges and will be tried separately, Walter said.
"He is accused of grave sexual abuse of minors," he said.
Detlef S. has been in custody since August after his daughter came forward to authorities, Walter said. The case was first reported by a local newspaper Thursday and the court spokesman said it was not made public before in a bid to protect the victims.

Dad murders 4-year-old daughter, critically injures 1-year-old son during visitation (Berlin, Germany)
Horrible. But interesting. Germany has thoroughly institutionalized fathers rights--even unmarried fathers now get automatic joint custody. You figure all the "frustrated" daddies would be as happy as clams now, right? Nope. What it means is that it's become very difficult for mothers to protect their children from daddy nutcases like UNNAMED DAD. If anything, one gets the impression that these crimes are increasing.

Berlin - A man committed suicide after killing his daughter, 4, and critically injuring his son, 1, German police in the central city of Kassel said Thursday.
The three were found in a car Thursday morning at Trendelburg-Eberschuetz outside the city after the separated man, 52, had failed to return Wednesday from an outing with the children under his visitation rights.
The boy was in hospital and it was not yet clear if he would live.
An explosion in the car had blown out the windscreen and side window but it was unclear what had exploded or whether this was the cause of any of the deaths.
In a separate case in southern Germany, police were still hunting for a 48-year-old man suspected of killing his ex-wife, 37, and their son, 3, in the town of Rosenheim on Monday

UNNAMED DAD had just separated from the mother of their 3-year-old child, and had reportedly just been released from prison. Once again, we see that separation from abusers is one of the most dangerous times for women and children. In this case, it appears the mother was beaten to death, while the 3-year-old was found hanged.

Women's Shelters criticize automatic joint custody for unwed fathers ruling (Germany)
I've been following this story for a while, which is the decision in Germany to grant unwed fathers more or less automatic joint custody, with no regard to the mother's wishes or the father's overall fitness. Finally we are seeing German women speaking out against this as it becomes clear what the implications will be for protective mothers and all unmarried mother in general. It's basically having a husband control your life, but it's a guy you never agreed to marry in the first place who's doing the controlling.

Germany's women's shelters criticize custody ruling

Women's shelters in Germany fear a court ruling to grant unwed fathers custody will put abused women in greater danger. Others hailed the Federal Constitutional Court's decision as a victory for single fathers.
Germany's women's shelters have joined the country's largest single parents' organization in opposing increased rights for unmarried fathers.
Until now, the fathers of children born out of wedlock in Germany had no legally guaranteed custody rights. Mothers had the right to withhold joint custody, leaving the father to sue the mother for visitation rights.
But Edith Schwab, head of Germany's Association of Single Mothers and Fathers, says the Federal Constitutional Court's decision last week to grant custody rights to unwed fathers is bad news for single mothers, who themselves will now have to fight to keep unfit fathers from raising their children.

"Mothers who refuse to share custody have very, very good reasons for their decision -meaning that the potential for conflict between the parents is so great that the mother has rightly chosen to deny joint custody," she said.
Worse yet - according to Heike Herold, who works with an organization that coordinates women's shelters across Germany - in abuse scenarios, increasing fathers' rights can undermine the safety of mother and child.
"It becomes problematic when there's domestic violence, but also when you think of cases in which children are conceived by rape," Herold told Deutsche Welle. "When you think of the legislature automatically giving these fathers custody, it becomes quite critical."
A victory for single fathers
On August 3, Germany's Constitutional Court in the southwestern city of Karlsruhe deemed that "the current legal situation excessively encroached on paternity rights for fathers of children born out of wedlock, because they could only take part in raising the child with the mother's consent," according to spokeswoman Judith Blohm.

Blohm said that until now "the fathers also didn't have the right to have a court determine what arrangement was in the best interest of the child."
The case for increased rights was mounted by a father who had no way to prevent the mother of his child from moving to another city and taking the child with her. The decision, which is expected to be drafted into law when the legislature returns from its summer break, was heralded as a victory for fathers' rights.
Thorsten Nitz, an underground train driver, was one of the many fathers across Germany who welcomed the decision. Nitz, who has been denied custody of his children since splitting up with his former partner, said he was "relieved when the ruling came," adding, "It's been overdue for years."
Harder to cut ties with abusive partners
Herold sees the flipside to this new right. Although she welcomes increased paternity rights in principle, she feels there needs to be a system in place to review fathers' suitability before granting them joint custody.
The decision makes it much more difficult for unmarried women to cut off ties with abusive partners, Herold said, adding that unmarried women who left abusive relationships "didn't have the problem that their partner, as the biological father of the child, necessarily had access to the child as part of his visitation and custody rights."

"Giving the father custody rights also means that the mother cannot decide alone to move to another city or switch her child's school," Herold added.
Tracking down mothers through their children
As it is, she said, visitation rights alone often give abusive fathers the opportunity to track down their child's mother, forcing abused mothers to flee from one halfway home to the next.
Herold added that, in cases of children born within wedlock, German courts already assume that contact to the father is nearly always in the child's best interest. She worries that more children will now have to live with abusive fathers.
"We know from experience that many family courts operate on the premise that joint custody is the new way of doing things. They ask the parents to ‘please settle their disputes in the interest of the child' – but that doesn't work when one side uses violence against the other," she said.

Germany's women's shelters criticize custody ruling

Women's shelters in Germany fear a court ruling to grant unwed fathers custody will put abused women in greater danger. Others hailed the Federal Constitutional Court's decision as a victory for single fathers.
Germany's women's shelters have joined the country's largest single parents' organization in opposing increased rights for unmarried fathers.
Until now, the fathers of children born out of wedlock in Germany had no legally guaranteed custody rights. Mothers had the right to withhold joint custody, leaving the father to sue the mother for visitation rights.
But Edith Schwab, head of Germany's Association of Single Mothers and Fathers, says the Federal Constitutional Court's decision last week to grant custody rights to unwed fathers is bad news for single mothers, who themselves will now have to fight to keep unfit fathers from raising their children.

"Mothers who refuse to share custody have very, very good reasons for their decision -meaning that the potential for conflict between the parents is so great that the mother has rightly chosen to deny joint custody," she said.
Worse yet - according to Heike Herold, who works with an organization that coordinates women's shelters across Germany - in abuse scenarios, increasing fathers' rights can undermine the safety of mother and child.
"It becomes problematic when there's domestic violence, but also when you think of cases in which children are conceived by rape," Herold told Deutsche Welle. "When you think of the legislature automatically giving these fathers custody, it becomes quite critical."
A victory for single fathers
On August 3, Germany's Constitutional Court in the southwestern city of Karlsruhe deemed that "the current legal situation excessively encroached on paternity rights for fathers of children born out of wedlock, because they could only take part in raising the child with the mother's consent," according to spokeswoman Judith Blohm.

Blohm said that until now "the fathers also didn't have the right to have a court determine what arrangement was in the best interest of the child."
The case for increased rights was mounted by a father who had no way to prevent the mother of his child from moving to another city and taking the child with her. The decision, which is expected to be drafted into law when the legislature returns from its summer break, was heralded as a victory for fathers' rights.
Thorsten Nitz, an underground train driver, was one of the many fathers across Germany who welcomed the decision. Nitz, who has been denied custody of his children since splitting up with his former partner, said he was "relieved when the ruling came," adding, "It's been overdue for years."
Harder to cut ties with abusive partners
Herold sees the flipside to this new right. Although she welcomes increased paternity rights in principle, she feels there needs to be a system in place to review fathers' suitability before granting them joint custody.
The decision makes it much more difficult for unmarried women to cut off ties with abusive partners, Herold said, adding that unmarried women who left abusive relationships "didn't have the problem that their partner, as the biological father of the child, necessarily had access to the child as part of his visitation and custody rights."

"Giving the father custody rights also means that the mother cannot decide alone to move to another city or switch her child's school," Herold added.
Tracking down mothers through their children
As it is, she said, visitation rights alone often give abusive fathers the opportunity to track down their child's mother, forcing abused mothers to flee from one halfway home to the next.
Herold added that, in cases of children born within wedlock, German courts already assume that contact to the father is nearly always in the child's best interest. She worries that more children will now have to live with abusive fathers.
"We know from experience that many family courts operate on the premise that joint custody is the new way of doing things. They ask the parents to ‘please settle their disputes in the interest of the child' – but that doesn't work when one side uses violence against the other," she said.

When motorists saw the teenager walking on the side of the road at dusk, they called the police.
Officers picked up the boy and called his father, who was already north of Frankfurt, about 130 kilometres away.
"The man said he wanted to teach his son a lesson," police said in a statement, adding that he recommended the child be kept for a night at the police station.
Officers finally convinced the man to return to collect his son in Bavaria.
"After father and son had hugged and promised each other to get along again, they started off together on the 400 kilometer (249 mile) journey home," the statement said.
Police informed child welfare authorities of the case.

(WASHINGTON D.C.) - Nurturing and loving mothers losing permanent custody of their children is such depressing subject matter. But we cannot indefinitely avoid depressing subject matter, particularly if it is true.
Most individuals prefer not to hear the story of how a cultured people turned a blind eye to consenting to the "legal kidnapping of children through America's family courts" and how the majority of our society, consisting of cultured people, remained silent.
Losing permanent custody and visitation of your children feels like being doused in oil and set on fire. Healing is slow and difficult. The pain never goes away. One doctor describes removing a nursing infant from a mother similiar to castrating a man.
Connie Valentine and other advocates for protective parents call the family courts broken and corrupt and say the system not only puts children into the hands of abusive parents, it also bankrupts and punishes the protective parents who fight for them.
Advocates realize that it is difficult to reform the system because the people it hurts are hiding from abusers and anxious to avoid publicity. (1)
Many of us live under address confidentiality programs for our safety due to escaping physical and sexual violence in our marriages.
In 1994, Mothers of Lost Children http://mothers-of-lost-children.com
was formed by a group of Davis, California women, whose children had been abused. Their children's lives were devastated, not only by the abusers, but by the very governmental and private agencies designed to protect them. Similiar to my own experiences and others ncadv.org/files/Bonshea.php, these women looked in vain for help, and found only betrayal.
Although from different faith practices, they began to meet each week in the park in silent protest to pray for their children. As "mothers of lost children," they believe there is a precedent for success in protecting captives through spiritual and ethical means.
Mothers of Lost Children found a role model in the actions of a small group of German women who, in 1943, began a vigil that grew to a group one thousand strong, to protest the imprisonment of their Jewish husbands. They called themselves "The Rose Street Women," offbeattravel.com/rosenstrasse-monument-berlin-germany.html and stood defiant, refusing Nazi orders to leave the site where their husbands were held.
The SS troops waited six days before giving in to the Rose Street Women and releasing twenty-five men, already tattooed and bound for Auschwitz. The February 27, 1993 Sacramento Bee article noted, "It's still unclear why the Nazis buckled to the Rose Street Women."
Mothers of Lost Children relate to the persistence of "The Rose Street Women."
Mothers of Lost Children are inspired by all individuals who "give voice to the violence" throughout the world.
We understand Alice Walker's wise words, "Resistance is the secret of joy, we should challenge whatever oppresses us, anything we love can be saved, the way forward is with a broken heart, we should lead and not project on others what they should do for us, and we are the ones we have been waiting for." In my own research and studies, I found a profound quote on responsibility and accountability in Lucy Dawidowicz’s book, “War Against the Jews.” Her words accurately portray how I feel. I believe that many of the injustices of innocent people in this country are a result of specific individuals, especially those in power, ignoring their own responsibility in given situations.
Dawidowicz writes: “Responsibility means accountability or answerability for one’s actions and their consequences. Historical responsibility is defined as an individual’s answerability for committing or failing to commit acts that would have affected the outcome of any given situation.”
When my children are adults and ask me what I did to help them, I will tell them, “I spoke the truth.” When they ask me why my case remained unchallenged, I hope I don’t have to tell them, “Nobody cared.”
No matter what the court had decided, I put the beautiful memories I had of my children in a sacred place. Each one of my children had shown me a new and beautiful universe through his/her eyes. As a mother, each day was a journey of new experiences and new joys. I am still in awe in the gift of motherhood and am grateful for the days, months, and years I shared with each one of my children.
I will continue to share my truths in a legal and "non violent" manner. Non-violence does not threaten. Non-violence "leans" until something, someday "moves."
I believe in seeking to defeat injustice, not people.
I believe that the Universe is on the side of "justice" and that right will prevail.

When human lives are endangered, when human dignity is in jeopardy, national borders and sensitivities become irrelevant. In my quiet times, I still feel moments of raw pain from my past. I look at it for what it is, a catalyst for me to find the sacredness of my inner being–to realize more of myself and who I truly am. I believe how we think and act and how beautifully our spirit responds to our challenges is all that matters. I believe "The Gift of Healing is Our Birthright."

I received this letter of encouragement last month from one of my readers.
Kathleen Sullivan, a clinical therapist in Chattanooga, Tennessee, wrote, "Even if your children choose not to have further contact with you (that is always our greatest fear as estranged parents); it doesn't mean that our children won't know -unconsciously at the minimum - that they are cherished and loved by someone outside their lives with the perpetrators. They may not be able to remember that we were the source of that love, but they will still have a strong sense that it's out there. They may equate the big, powerful outside with a god or goddess; that's okay. It still works to help them to feel truly loved, and protected, and cared about - in the most secret compartment of their soul, where it is not touched by any invader.
"Even if our children are too young to remember when they're removed from us, or if they have been brainwashed by their new caregivers to think of us as other than who we really are - and criminal sociopaths are usually quite good at that - our children's earliest sensory memories of our love and nurturing will remain a mental/emotional protective factor for the rest of their lives.
"I've learned enough about childhood neurobiological development and secure attachment to understand why it happens that way. Our conscious memories of our parents' love - if we experienced such love - may fade away completely or be suppressed out of necessity to conform with our new family system and keep them from turning on us in anger. Still, the neurobiological/sensory imprint of our parents' love is like a fossil imprinted deeply in a dense rock. The nonverbal neurological/sensory imprint remains for life and is a part of everything we are and do; even if we're completely aware of its influence.
"Nobody can erase the imprint without killing us because the imprint of love is strong, more natural, and more resilient than the effects of human evil. As I read this work, I laughed, I cried, and I grew angry. You cannot walk away from this work without having strong emotions - whether positive or negative, for good or bad, is for you to say. Many of the ideas that it contains are I at first considered too radical. But, often, after some reflection, I had to admit that she spoke the truth.
