A FATHER-OF-TWO caught with a “grotesque” collection of indecent images of children on his computer was spared jail.
Police swooped on Peter Clarke’s home in January after tracing a file uploaded from his computer to the file-sharing program Dropbox.
Officers seized the 42-year-old’s laptop and found nearly 3,000 indecent images of children on it, a court heard.
Prosecutor Julian Lynch said that 594 of the files were of the most severe category, including images and videos of babies as young as 18 months old being involved in sexual acts.
Mr Lynch told Oxford Crown Court on Thursday that when first questioned about the images Clarke told police he was trying to understand sexual abuse but in a second interview admitted that the images were for his own sexual gratification.
Clarke, of Van Diemans, in Stanford in the Vale, admitted three counts of making indecent images of children between November 2010 and August last year when he appeared at Oxford Magistrates’ Court last month.
Lucy Ffrench, defending, said Clarke had been exposed to pornography from a young age and hated himself for what he had done.
She added: “He is mortified to be here today. He accepts the harm he has indirectly caused to the childwren involved.
“He has stopped his use of pornography and accepts that he needs to completely withdraw from that material forever .”
Judge Ian Pringle said it was staggering that a father had downloaded the “appalling” images of children being “grotesquely abused”.
But Judge Pringle said that because of Clarke’s guilty pleas and the fact he had made frank confessions when interviewed he could suspend a prison sentence.
He added: “Where there is sufficient prospect of rehabilitation it is right that the court take it.
“For those reasons I am going to take the exceptional course of making the sentence of 14 months suspended for two years .”
He gave Clarke a two-year supervision order and ordered him to undergo a 36-session sexual offender treatment programme.
Judge Pringle also imposed a sexual harm prevention order and Clarke will have to sign the sexual offenders’ register for 10 years.

Care orders were issued earlier this year for infants who were offered for online sexual abuse and exposed to an environment where hard drugs were present, according to a new report.
The Child Care Law Reporting Project today published 30 new childcare cases, including stories of minors who were unable to find suitable treatment in Ireland when seeking to return home from facilities in other jurisdictions.
In a recent District Court ruling, a young child was ordered to be placed in care until the age of 18 after her father offered to sexually abuse her online.
The man said he would broadcast the abuse via a webcam when contacted by another user of an internet chatroom who turned out to be an undercover police officer from a different country.
The child’s mother had been groomed by his father from the age of 13 or 14 before eventually giving birth to the child at the age of 18, according to a submission by the Child and Family Agency.
Sexually exploited
She denied involvement in any abuse but admitted to being aware of child pornography images held on her husband’s computer and said it was possible that he had sexually exploited their daughter in the past.
The man was arrested by gardaí but has since left the jurisdiction. Another District Court sitting heard details of a young child who was taken away from his parents after gardaí discovered him in a car where heroin, needles and other drug-taking paraphernalia were present.
The child’s parents were homeless drug addicts who had admitted to taking drugs earlier that day and were preparing to do so again, gardaí said.
The child was discovered in the back seat of the car beside an unrelated adult male on a near-freezing night.
The toddler was subsequently taken to a hospital by a garda, who noticed a cut across his throat which the child said was a knife wound inflicted by his father.
Evidence suggested that his mother would usually sneak them into her brother’s hostel, but didn’t return on the night in question after he hit her over the head with a hatchet.
An interim care order for the child was granted.
“Some of the cases we publish . . . are very shocking and highlight the importance of the vigilance of international police forces’ specialist units monitoring such activity,” said project director Dr Carol Coulter. “However, most of the cases we report show, again, how most parents whose children come to the attention of social services are themselves vulnerable, may be suffering from cognitive or other disabilities, may have no experience of normal family life and have been in care themselves.”
The latest tranche of cases reveal how a child who was receiving psychiatric care abroad felt his human rights were being infringed as he could not return home due to a lack of suitable services.

A national child advocacy organization is criticizing Nashville District Attorney Glenn Funk for the delay in prosecuting a father accused of raping his 8-year-old son — a case the FBI turned over to the district attorney's office three years ago.
The father, a 58-year-old Missouri veterinarian, was arrested in August of 2012 after a grand jury issued indictments on four counts of child rape and one count of aggravated sexual battery. In a letter to Funk this week, Child Justice, a Washington, D.C.-based advocacy group, urged him to move forward with the trial. Executive Director Eileen King said she feared Funk would drop the case after a former prosecutor in charge of it left the district attorney's office. Funk is now serving as the chief prosecutor on the case.
"This child deserves some justice in his life after all that he has endured," wrote King. "Anything short of prosecuting this man who is believed to have committed these atrocities is, in our view, a miscarriage of justice."
Funk said he was reviewing the case as he would any other before proceeding. He will make a decision within the next three weeks about the next steps, he said.
The case has garnered national attention among advocates focused on how child sexual abuse allegations are handled in divorce courts and in the criminal justice system.
The criminal charges followed years of claims by the child's mother that her ex-husband was sexually abusing their son. A pediatrician, a child therapist and a caseworker with the Department of Children's Services also alleged the boy had been sexually abused, but no charges were filed until a 2011 FBI investigation found pornography and other items at the father's home that prosecutors said corroborate the boy's story.
By then, however, the mother had lost primary custody of the boy. A Robertson County family court judge had ruled that the mother's repeated insistence that her son was being sexually abused was untrue, "obsessive," and harmful to the child. He awarded custody of the boy to the now-accused father in 2007.
The father's attorneys have argued that the boy has been coached all along into making false accusations by the mother, who now has custody again.
The Tennessean does not identify victims of alleged sexual abuse and is withholding the parents' names to protect the identity of the child.
The case has been delayed once pending appeal on an interim order from the court, which rejected the father's efforts to require the boy undergo a psychiatric evaluation. An appeals court upheld the ruling. Then the chief prosecutor on the case resigned, among a group of lawyers who departed after Funk was elected as district attorney.

IN A case that is set to shock the nation, a Brisbane man has been charged with child pornography after promising to send explicit images of his newborn baby via the internet.
Ashley David Hill, 23, a chef from the northside suburb of Chermside, allegedly promised to send images of his newborn baby being abused to an undercover FBI agent posing as a pedophile in the US.
Hill fronted the Brisbane Magistrates Court on Saturday charged with using a carriage service for child pornography material and three counts of possessing child pornography, following his arrest by Australian Federal Police on Friday.
He was allegedly using a file-sharing service to send and receive child pornography images with another person via the internet.
It was alleged the man’s partner was just weeks away from giving birth when he allegedly brokered an online deal to supply images of his newborn baby being abused to the undercover agent in the US.
The Sunday Mail understands the soon-to-be-father provided a scanned copy of a recent ultrasound of his unborn child to the agent as proof of his preparedness to follow through with the plan.
It was not clear whether the man organised monetary payment for the abuse images of his newborn child or whether they were to be in exchange for further child exploitation images from the US contact.
Federal police searched the man’s home on Friday following a tip-off from authorities overseas and allegedly found a large number of child exploitation images on computers and hard drives in the man’s possession.
Lawyer Rhianna Batt applied for bail on the man’s behalf yesterday, subject to strict conditions requested by police.
Police prosecutor Sergeant Matt Kahler asked that the man be banned from using the internet, not have any unsupervised contact with children aged under 16, not attend any point of international departure and that he reside at a home in Chermside while on bail.
Ms Batt said her client was willing to comply with all conditions, adding that because he worked as a chef there was no reason for him to use the internet.
Magistrate Tina Previtera granted bail subject to onerous conditions, including that he surrender his passport to authorities.
No one was waiting for the man as he was released from the Brisbane City Watchhouse and he made no comment to waiting media.
He will front court again on February 13.
If convicted, the man faces up to 15 years behind bars under the Commonwealth Criminal Code.

Sickening and infuriating. I've known to many mothers who have lost all contact with their children for even alleging sexual abuse by others. Meanwhile, this piece of crap is caught red-handed with evidence that he sexually assaulted a 4-month-old baby and made and distributed child pornography based on this. And yet he gets supervised visitation with his 3-year-old son. Barf. The triumph of Fathers Rights.

Former Fargo firefighter now in Duluth used work computer to store child pornography, investigators say

DULUTH - A Duluth - and former Fargo - firefighter who faces sexual misconduct and child pornography charges allegedly used a computer at a Duluth fire station to distribute pornographic images of a 4-month-old child, according to court documents.
Caleb Stuart Lofald, 32, of Hermantown already is charged with sexually assaulting the infant girl and surreptitiously recording a 6-year-old boy and an adult woman in various stages of undress in a guest room at his home.
But court documents and statements from authorities Friday suggested that he remains under investigation for possible additional charges related to the production, possession and distribution of child pornography.
“These are very serious allegations,” prosecutor Gary Bjorklund said. “The defendant is well aware that these charges are part of a much larger investigation that could be headed toward significant federal charges.”
Judge David Johnson set Lofald’s bail at $250,000 without conditions or $100,000 with conditions at an initial appearance Friday morning in State District Court in Duluth. Conditions of the lower bail would include a screening for intensive supervised release and no unsupervised contact with minors.
Lofald, lodged at the St. Louis County Jail since Tuesday, appeared in court wearing an orange jumpsuit. A half-dozen supporters, including his wife and father, sat in the courtroom.
Bjorklund, head of the criminal division of the St. Louis County Attorney’s Office, asked for significant bail, citing the serious nature of the alleged crimes and the possibility of additional state or federal charges.
“The state is concerned about the defendant being a flight risk and the well-being of the public,” Bjorklund told the judge.
Superior attorney Stephen Zuber represented Lofald at the hearing.
Zuber described Lofald as a lifelong resident of the Duluth and Hermantown area and said he has strong ties to the community. He said Lofald has been supported by family and has had numerous supervised visits with his own 3½-year-old son since the investigation was launched nearly two months ago.
“The search warrant in this case was executed on Nov. 20,” Zuber said. “The defendant has been free since that time with no issues.”
Court documents allege that investigators found numerous photographs and recordings on electronic devices seized from both Lofald’s Hermantown home and the Duluth Fire Department’s Fire Station 7.
The devices allegedly included 11 photographs of a partially nude 4-month-old girl, with several images depicting a hand manipulating the child’s genital area, according to the criminal complaint. The photos allegedly were taken in Lofald’s home in May 2013.
Investigators said that video recordings of a 6-year-old boy and adult female also were retrieved from the electronic devices. The videos were recorded by a hidden camera in a guest room at Lofald’s home on separate days in September 2014, according to the complaint.
Additional court documents allege that Lofald admitted to distributing child pornography from the fire station. Images of the 4-month-old were found on a hard drive seized from the station, according to a probable cause application filed this week by investigator Jeanine Pauly of the Lake Superior Forensic Technology and Internet Crimes Against Children Task Force.
While the devices were seized in November, the images were not recovered from the hard drive until last week, Pauly said. Lofald remains under investigation for further child pornography charges as a forensic examination of the devices continues, according to the document.
After Friday’s hearing, Bjorklund declined to elaborate on the ongoing investigation. #Zuber also declined to comment, directing comments to Lofald’s primary attorney, Rick Gondik. Gondik, a Superior attorney, did not return a call requesting comment.
Zuber said during the hearing that Lofald has been a Duluth firefighter for seven years, and previously held the same position in Fargo.
He has been on paid administrative leave since November, but Duluth Mayor Don Ness on Thursday released a statement calling the allegations “beyond heinous” and stating that the city is in the process of firing Lofald.
Noting the nature of the alleged crimes, Bjorklund said he would file a notice of intent to seek a departure from sentencing guidelines should Lofald be found guilty. The most serious charged offense, second-degree criminal sexual conduct, carries a maximum of 25 years in prison.
Lofald’s next court appearance is scheduled for Feb. 4.

“These are very serious allegations,” prosecutor Gary Bjorklund said. “The defendant is well aware that these charges are part of a much larger investigation that could be headed toward significant federal charges.”
Judge David Johnson set Lofald’s bail at $250,000 without conditions or $100,000 with conditions at an initial appearance Friday morning in State District Court in Duluth. Conditions of the lower bail would include a screening for intensive supervised release and no unsupervised contact with minors.
Lofald, lodged at the St. Louis County Jail since Tuesday, appeared in court wearing an orange jumpsuit. A half-dozen supporters, including his wife and father, sat in the courtroom.
Bjorklund, head of the criminal division of the St. Louis County Attorney’s Office, asked for significant bail, citing the serious nature of the alleged crimes and the possibility of additional state or federal charges.
“The state is concerned about the defendant being a flight risk and the well-being of the public,” Bjorklund told the judge.
Superior attorney Stephen Zuber represented Lofald at the hearing.
Zuber described Lofald as a lifelong resident of the Duluth and Hermantown area and said he has strong ties to the community. He said Lofald has been supported by family and has had numerous supervised visits with his own 3½-year-old son since the investigation was launched nearly two months ago.
“The search warrant in this case was executed on Nov. 20,” Zuber said. “The defendant has been free since that time with no issues.”
Court documents allege that investigators found numerous photographs and recordings on electronic devices seized from both Lofald’s Hermantown home and the Duluth Fire Department’s Fire Station 7.
The devices allegedly included 11 photographs of a partially nude 4-month-old girl, with several images depicting a hand manipulating the child’s genital area, according to the criminal complaint. The photos allegedly were taken in Lofald’s home in May 2013.
Investigators said that video recordings of a 6-year-old boy and adult female also were retrieved from the electronic devices. The videos were recorded by a hidden camera in a guest room at Lofald’s home on separate days in September 2014, according to the complaint.
Additional court documents allege that Lofald admitted to distributing child pornography from the fire station. Images of the 4-month-old were found on a hard drive seized from the station, according to a probable cause application filed this week by investigator Jeanine Pauly of the Lake Superior Forensic Technology and Internet Crimes Against Children Task Force.
While the devices were seized in November, the images were not recovered from the hard drive until last week, Pauly said. Lofald remains under investigation for further child pornography charges as a forensic examination of the devices continues, according to the document.
After Friday’s hearing, Bjorklund declined to elaborate on the ongoing investigation. #Zuber also declined to comment, directing comments to Lofald’s primary attorney, Rick Gondik. Gondik, a Superior attorney, did not return a call requesting comment.
Zuber said during the hearing that Lofald has been a Duluth firefighter for seven years, and previously held the same position in Fargo.
He has been on paid administrative leave since November, but Duluth Mayor Don Ness on Thursday released a statement calling the allegations “beyond heinous” and stating that the city is in the process of firing Lofald.
Noting the nature of the alleged crimes, Bjorklund said he would file a notice of intent to seek a departure from sentencing guidelines should Lofald be found guilty. The most serious charged offense, second-degree criminal sexual conduct, carries a maximum of 25 years in prison.
Lofald’s next court appearance is scheduled for Feb. 4.

City police were alerted to the man's activities early last year after Australian investigators posing as online child predators met him on an illegal image-sharing site.
The 28-year-old man posted pictures of himself abusing his daughter and a message reading: "If interested in seeing some homemade stuff with this cutie, email me."
The man posted a similar message alongside a picture of his four sons sitting in a police cruiser.
"This only stopped because police figured it out," Crown attorney Jennifer Mann said at a sentencing hearing Friday. "There were no (prior) disclosures by the children. This wasn't going to be detected for a long time, maybe never."
In an interview following his arrest, the man claimed he was a sex addict and mentally ill.
"He is both a manipulator and a liar," Mann said. "This was not an illness. This was planned, premeditated criminal behaviour on the part of (the accused) ... He essentially turned his children into on-demand sex objects."
The man told police he abused his children because they were "accessible."
According to an agreed statement of facts submitted to court, the man wasn't supposed to have any access to his children at all. In 2008, the man and his wife were living in Edmonton when Child and Family Services seized their three children after concerns were raised about the man's "interactions" with his daughter.
The man returned to Winnipeg in 2009 and Edmonton CFS agreed to return the children to his wife on the condition they have no contact with their father.
The woman later rejoined her husband in Winnipeg and the couple had two more children. The family settled into a living arrangement in which the three oldest children lived with the man's parents during the week and visited their parents on the weekend.
Police interviews with the accused and his children revealed a regime of weekly abuse that included oral sex and sex acts between siblings at their father's direction.
One child told police the man on one occasion took away his video game and only returned it after he had provided the man with oral sex.
The man admitted to grooming his daughter and in an email exchange with an online predator said he "hope(s) to break her cherry one day."
The man has sentenced his daughter "to a lifetime of wondering who has seen the pictures ... and whether someone else on the Internet is viewing them," Mann said.
The man's lawyers argued a 20-year prison term would be "crushing" to his prospects for rehabilitation and recommended he be sentenced to eight years.
Judge Kelly Moar will sentence the man at a later date.

Agents say the account holder, 65-year-old Timothy Robert Guilfoyle, was in cahoots with his 21-year-old son, Sean Michael Guilfoyle.
The pair this week were ordered to stand trial on child sexually abusive activity that could put them behind bars for 20 years. #Sean Guilfoyle may have it worse than his father: he pleaded guilty last fall to child pornography charges stemming from a separate investigation in Caledonia.
He's scheduled to be sentenced next week in Kent County Circuit Court for child sexually abusive commercial activity. Investigators say he posted to Facebook a topless image of a 16-year-old. The girl used to date his brother's girlfriend, court records show.
The younger Guilfoyle told the teen he was battling an addiction to child pornography, court records show. After his October arrest, Kent County detectives found at his Caledonia home several thumb drives containing images of naked children and children engaged in sex acts, court records show.
Timothy Guilfoyle, who lives on Grand Rapids' northwest side, has been under investigation since Aug. 2011, when Homeland Security agents signed into an undercover account and discovered child porn being offered by a subject with the screen name Windsage22.
The user was sharing more than 262 images of child pornography, court records show. The account was later linked to the Guilfoyles.
Father and son admitted to downloading, viewing and sharing child pornography on the Internet, according to a probable cause affidavit in Kent County Circuit Court.
Timothy Guilfoyle was arrested Dec. 23 and charged with four counts of child sexually abusive criminal activity and four counts of using a computer to commit a crime. The offenses are punishable by 20 years in prison. He's being held in the Kent County Jail on a $25,000 bond.
Sean Guilfoyle is charged with one count of each offense. He's been in the Kent County Jail since October, when he was arrested in the case involving the 16-year-old victim.

A Rochester man has pleaded guilty to possession of child pornography after he was arrested in an undercover investigation.
Alan Dale Burns, 34, appeared in shackles Monday at Thurston County Superior Court. He pleaded guilty to two counts of first-degree possession of depictions of a minor engaged in sexually explicit conduct. Burns had initially been charged with 16 counts, but 14 of those counts were dismissed Monday as part of the plea agreement.
Prosecutors have recommended a sentence of 34 months in prison, followed by 36 months of community custody. Burns will be required to register as a sex offender and undergo sexual deviancy evaluation and treatment, according to the court. Sentencing is set for Feb. 9. In an undercover operation, the FBI Dallas Child Exploitation Task Force in Texas had obtained several images of child pornography from a computer with an IP address from Rochester, according to court documents.
The IP address was eventually linked to Burns. Thurston County Sheriff’s Office detectives obtained a search warrant and arrested Burns on Sept. 11 at his Rochester home. At the time of his arrest, Burns was actively deleting files from his computer and Internet browsing history, according to documents.
Many of the images depicted sexual assaults against infants and toddlers by adult males, according to documents, with the ages of the victims estimated between six months and 8 years old.
Burns is the father of twin 2-year-olds, according to detectives, and it is unknown at this time whether the children were involved in the images or abuse. Documents state that detectives had seized an external hard drive, three computers and thumb drives, and a forensic analysis is underway.

Laplante, a father with biological and adopted children, was taken into custody after the Anchorage Police Department Cyber Crimes Unit and the Alaska Bureau of Investigation’s Technical Crimes Unit served search warrants of his home and office at the Dimond Center, the DOL said.
APD learned of the 48-year-old’s alleged crimes Oct. 2 when the National Center for Missing and Exploited Children (NCMEC) filed two “Cybertip” Anchorage area reports, according to charging documents.
In one case, Instagram — a photo-sharing phone application — reported through NCMEC that user “thematthewwhartley” uploaded 13 images of child sexual exploitation to the account, the charges say. Authorities determined the account belonged to Laplante and that one of the IP addresses used to upload the pictures originated from his home address.
In a second instance, an image flagged by Google was linked to an IP address that originated at Clear Channel Communications, Laplante’s employer, located in the Dimond Center.
A search by authorities of Laplante’s home and office revealed more than 1,000 images of child sexual exploitation on the external hard drive connected to his work computer. Investigators also found evidence he used the social media texting app “KIK” to “solicit child pornography images from children directly,” charging documents said.
In a non-custodial interview with authorities in his work office, Laplante admitted to creating the Instagram account and allowing about 50 other users to also access it. He denied producing images of child exploitation involving his own children — biological and adopted.
“Investigation is ongoing as to any potential sexual abuse that may have occurred,” the charges say.

A FATHER-of-two has been jailed after being found with hundreds of "horrific" images of child abuse.
At Newport Crown Court Mark Stoneman, 34, of Porthkerry Caravan Park, Rhoose, had asked to be spared a jail sentence in favour of treatment in the community. Judge William Gaskell told him: "I'm afraid that is an approach that is not only not attractive, but not likely", before jailing Stoneman for 16 months.
The court heard how Stoneman - who has been separated from his children's mother for some time - was tracked down as part of Operation Notarise, a UK wide police incentive which targeted users of peer to peer websites trading in child pornography.
When investigations found Stoneman to be a subscriber to one such website, he was arrested and had his home computer, iPhone and tablet seized.
On these devices police found 235 photographs and 89 movies of children being abused. Of these, 38 photos and 54 movies were "Category A" - the worst and highest classification.
Police also recovered 71 images of "extreme pornography". Stoneman initially gave a "no comment" police interview but later pleaded guilty to all charges.
Tim Naylor, defending Stoneman, told the court: "There isn't much in the way of mitigation, given the horrific material on his computer, phone and tablet.
"This was a bad period of his life where he was using alcohol and drugs, both of which he has resolved his issues with."
The court heard how Stoneman claimed to have initially looked at the images "out of curiosity" and it "spiralled" from there. He said he had experienced a sense of clarity since.
Mr Naylor said: "He thought, 'What if it was his own children in those images?'. He realised that what he was viewing was actually real life abuse, something at the time he didn't recognise.
"He's ashamed and disgusted with himself."
Stoneman had hoped to avoid a jail sentence in order to complete a three-year course of treatment for sexual offenders in the community, but Judge William Gaskell declined.
He told him that if he wanted to seek treatment he could do so after his 16 month sentence, half of which will be served behind bars.
Judge William Gaskell described and detailed some of the horrendous images Stoneman had viewed before telling him: "You downloaded these images for the purpose of getting sexual pleasure.
"You gave no mind to the fact that you were watching children who were being raped, who were the victims of sexual offences. you watched these children being abused for your pleasure.
"You won't get any 'good character' credit, because you aren't one."
The court heard how Stoneman had a list of previous offences including burglary, ABH, drink driving and battery.
In addition to the 16 month jail term, Stoneman was ordered to register as a sex offender for the next 10 years, to have his internet and computer use monitored upon release and to pay a £100 surcharge.

But in the VPO filed Sept. 18, it states Leo Henry's own mother told the fiancée she witnessed Henry sexually molesting one of his children. It also states Henry threatened one of the children, held a gun to her head, and said he would kill her if she didn't keep their secret.
That secret was him taking photographs of her private parts; Disturbing news considering Henry's own father is currently in prison for possession of child pornography.
The mom wrote, “I am afraid he is going to hurt me and the children because I reported the abuse."
Police tell News 9 the young mother was stabbed several times and is pregnant, but is expected to recover from her injuries. Henry is also expected to recover from his injuries. And all the children have been placed in protective custody.

A Leola father and his son have been arrested and charged with possession of child pornography.
Karl Alan Neuenschwander, 44, and his 19-year-old son, Jack Thomas Neuenschwander, were charged with child pornography offenses by East Lampeter Township Police Detective Preston Gentzler on Aug. 27.
The offenses are alleged to have occurred between January and May of this year.
The investigation was initiated by police and the Lancaster County Computer Crimes Unit after information was provided to local police by the National Center for Missing and Exploited Children. As a result, the two were found to be in possession of numerous child pornography images and videos, police said.
Karl Neuenschwander was charged with three counts of sexual abuse of children – child pornography.
Jack Neuenschwander was charged with one count sexual abuse of children – dissemination of photographs videotapes, computer depictions and films and five counts of sexual abuse of children – child pornography.
Both men were arraigned before Magisterial District Judge B. Denise Commins and released on $50,000 unsecured bail each.

The revelation follows controversy surrounding West Australian couple David and Wendy Farnell, who had surrogate twins in Thailand and were accused of abandoning one, baby Gammy, because he had Down Syndrome.
In the NSW case, according to an investigative report by Nine’s A Current Affair, once the couple had arrived back in Australia the man struggled with fatherhood and the marriage ended soon after, with his ex-wife taking sole custody of the children.
Police will allege the man began sexually abusing the children from the ages of four to five years. He will appear in NSW court in December.
ACA claimed the woman was in hospital and had no other option but to ask her ex-husband to care for them in her absence.
The man also faces charges of possession of 53 child pornography images. He has denied all charges and will appear in court in December.
The Thai surrogate mother, now 30, — who has two children of her own — said her mother was paid $7000 through a Thai agency, which is about half the normal rate.
For legal reasons, the gender of the twins cannot be revealed.

Courts gave father full custody of two sons despite evidence of evidence of abuse, control issues; dad stopped mom from having contact--then stabs the boys to death along with his parents (Santa Barbara County, California)
Horrifying case. The mother's concerns about the father's physical and sexual abuse of the boys were ignored and belittled. She was drowned out by her husband's money and power (the fact that she was Hispanic and he was white didn't help her case either).
Kudos to Lara Cooper for writing this and NAMING THE NAMES of the whores of the court who severed this woman's parental rights and placed these poor children with the father who brutally murdered them.

Bitter Custody Battle May Offer Clues in Holzer Family’s Gruesome Mass Murder
With Nicolas Holzer charged as suspect, investigators still seeking motive in killings of his sons and their grandparents as ex-wife grapples with grief

Shortly after two young boys and their grandparents were found murdered inside their home near Goleta earlier this month, Santa Barbara County Sheriff Bill Brown said investigators were searching for an explanation.
“There’s nothing that points out any motive or anything that would have preceded this terrible tragedy,” Brown told a news conference on Aug. 12, the day after Nicolas Holzer, 45, was arrested on murder charges.
Holzer is accused of fatally stabbing his sons, Sebastian, 13, and Vincent, 10; his parents, Sheila Garard Holzer, 74, and William Charles Holzer, 73; and the family dog at the home they all shared on Walnut Park Lane, a quiet cul-de-sac off Ribera Drive near Foothill School.
At the news conference, Brown said “Holzer told detectives that he had killed his family to fulfill what he believed was his destiny.” He said Holzer was waiting outside the house when deputies arrived and was taken into custody without incident.
To date, Brown and his department have released no additional information about what might have spurred the second mass murder to rock the South Coast this year.
But clues to what triggered the carnage may lie, in part, in the nasty custody fight between Holzer and his former wife that began in 2006 as the couple was going through a divorce.
An inches-thick Superior Court file obtained by Noozhawk chronicles the battle between Holzer and Juana Holzer, replete with accusations of mental illness, aggressive and controlling behavior, and sexual abuse. The court ultimately granted Holzer full custody of their children, and largely cut off Juana from contact with the two boys.
But the matter was last in court more than four years ago, so it’s unclear if anything transpired in the interim to yield such a violent outcome.
However, court documents suggest that a family situation that may have seemed normal and amiable to friends and neighbors may have had a much darker side.
Family law attorney Matthew Long, who represented Holzer in the divorce, told Noozhawk that the case was one of the more protracted court custody cases he’s handled. But he said there was nothing in the custody case and Holzer’s interaction with the family court system that raised a concern. “He always presented as a normal guy, which I know sounds preposterous given the events that unfolded,” Long said. “That’s what’s so disturbing about this. We want to have some kind of an explanation.”
Long said he last spoke with Holzer four years ago and last saw him six years ago.
“That’s the scary part ... A lot can happen in six years,” he said. “Obviously something happened.”
Neighbors of the Holzers have been reluctant to speak about the incident or the family.
One neighbor said the killings had been “devastating for those of us on the cul-de-sac as well as others within the neighborhood and the community.”
“The Holzers were always a very private family,” said the neighbor, who asked that her name not be used.
In a more public forum, last week’s Board of Supervisors meeting was adjourned in the family’s honor by Supervisor Janet Wolf, whose second district includes the Holzer home.
Wolf described William Holzer as a “brilliant scientist” and his wife, Sheila, as a “loving and devoted grandmother.”
She said she did not know the family personally, but has had many close to the family reach out to her office since the murders occurred.
Wolf described Vincent as a “boy with an electric smile who would have been joining his classmates starting fifth grade and was a standout on his school’s intramural Foothill Falcons football team.”
Sebastian was an incoming eighth-grader at La Colina Junior High School “who was a bright, spirited and gentle boy who loved being with his friends and participated in the school’s AVID program and while only 13 was already planning for college.”
Those close to Holzer’s ex-wife, Juana, are speaking out even as they are grieving the death of the boys, whose funerals were held last weekend.
Noozhawk spoke with Charles Sirois, Juana’s fiancé, who said her family is consumed with grief.
“It’s a tragic loss of life,” he said.
The custody battle was costly and protracted, and taxed Juana to the brink, Sirois said.
“To take on that family that was financially capable of doing whatever it took ...,” he said. “Juana is an immigrant. She didn’t stand a chance.”
Sirois said Juana had not been in touch with the children for a number of years because the court order had become so restrictive “it pretty much eliminated all contact.”
“She was under the impression that since the Holzers had financial resources, that they would be able to take care of the children and that they’d be in a safe place,” he said of the grandparents.
Sirois has reviewed the detailed court file of the couple’s custody battle. More than two inches thick and spanning more than five years, the file outlines a contentious custody battle for the boys, which began at the divorce, and details accusations of sexual abuse.
The records paint a heartbreaking picture of two young children caught in the crossfire. The file also depicts a mother who had little recourse or money to fight a financially secure father in the court battle, and who gradually lost more and more contact with her sons.
The file outlines the beginning of their relationship, stating that Nicolas and Juana were married Jan. 13, 2001, and separated and divorced in 2006. At the time of the divorce, their sons, Sebastian and Vincent, were 6 and 3 years old, respectively.
The paperwork contains income statements and background of both parents used to sort out support payments and provide some personal history of the couple.
Holzer was listed as a graduate of UC Santa Barbara, but was enrolled at a trade school and living with his parents at the time of the divorce.
As part of the asset documentation, the file states that Nicolas had inherited some money prior to the marriage and the pair purchased a condo with the help of his parents in 2002.
Juana Holzer is described as having graduated the seventh grade in Mexico, where she was born, and had been unemployed during the marriage.
She lived in San Diego with other family members at the time of the divorce filing, and the documents state it was uncertain whether she had a driver’s license.
“Because of her educational background and lack of fluency with the English language, she will likely not be qualified for other than a minimum-wage occupation,” court records state.
When the couple separated, Juana moved into her sister’s house with the children. At the time, she had physical custody of the boys and Holzer was required to drive to San Diego for visitation.
“The evaluator recommends that physical custody be awarded to their father in Santa Barbara,” because it would be difficult for the mother to arrange transportation to get to Santa Barbara when the court arranged for custody visits with their father.
The document also acknowledged that the children would be spending time with their grandparents while Nicolas was attending classes in Ventura County.
Holzer previously worked at Raytheon, but layoffs were on the horizon and both he and his wife agreed that Holzer should be proactive and look to find a job with flexible hours and begin taking business classes, documents stated.
When the two separated, Holzer was working at Bargain Network in Goleta and shortly thereafter moved to another sales position at Select Personnel Services.
Holzer began attending ITT Technical Institute in Oxnard to become a record-coding specialist in hopes of earning what he had previously made at Raytheon.
Beginning in November 2006, Holzer was required to pay Juana $833 in child support and $490 in spousal support, with a $250 per month travel credit, leaving a monthly support obligation of $1,074.
Juana was not working at the time of the separation, and the court gave warning that she was expected to make “reasonable efforts to assist in providing for her support needs.”
In the court file, Juana expressed concern about Holzer’s mental stability and aggression toward the children. However, a 2006 statement from Holzer explained that doctors initially thought he was depressed but eventually diagnosed him with a thyroid condition.
Holzer’s parent were described as being supportive of the boys living with them in the Walnut Park Lane home.
“My parents are both in good health and good spirits and would very much like to provide a stable and loving home for Sebastian and Vincent,” Holzer wrote.
The divorce was just the beginning of the battle over the boys.
Perhaps the most revealing parts of the file are the notes about custody and visitation of the children, which chronicle a tumultuous battle between the parents.
A judge-appointed psychologist, paid by Holzer, performed a child custody evaluation on Oct. 3, 2007, and issued a 58-page report, which is not public record, recommending that Holzer be given custody.
Psychologist Gary Rick, who practices out of Ventura and is listed as an adjunct professor at Antioch University Santa Barbara, was hired by Holzer to evaluate the children and recommend who should be granted custody.
Rick did not respond to Noozhawk’s request for comment.
“The living situation and personal traits of the father were more likely to meet the emotional and educational needs of the minor children than those of the mother. Primary custody to the father is recommended,” Rick’s notes in the court file state.
Juana maintained that her ex-husband had mental-health problems and was aggressive and controlling toward her and the children, but Rick’s report indicates that “these allegations were not born out by the investigation.”
A chilling account from Juana in June 2008 states the contrary.
She noted that she was seeing the children every other weekend, and would go to Santa Barbara to pick them up and Holzer would retrieve them in San Diego.
“Vincent always cries because he doesn’t want to go with his father,” she said, adding that problems began when Holzer met her in the parking lot of a San Diego grocery store to hand off the children after a visit one weekend.
“As usual, Nicolas began to scream and offend me, then aggressively yanked Vincent from my arms,” she said. “I told him not to abuse my son, and he told me, ‘I have custody. I can do what I want.’”
Juana said William Holzer was out of the truck and saw the situation unfold. She said she asked him for help to stop his son from mistreating Vincent.
But her ex-husband told her to “go away” and that she “could not talk to his father.”
When she threatened to call the police if he didn’t stop abusing Vincent, Holzer taunted her, saying, “You remember who has custody? I do, not you, and I decide what to do with my children.”
Nicolas Holzer’s position in the court files was that his wife “refused to work on marital issues and was under the under influence of her family to act unilaterally and was not meeting the educational and emotional needs of the children.”
Her visitation rights were suspended in March 2008 when Vincent made “disturbing statements to his grandmother, me and his therapist,” Holzer wrote, saying that the boys reported they had been sexually abused by their mother and her sisters.
Juana stated that her ex-husband was telling the children to make those claims.
“I am concerned about the mental and emotional well-being of our children,” she wrote. “Because of the serious nature of the false accusations that are being made against me and my sisters, I began to investigate my options with several authorities, including the San Diego police, Santa Barbara police and La Casa de la Raza.”
“I have requested that similar investigations be made of Nicolas regarding his treatment of our children,” she wrote. “If someone is doing harm to my children, including putting ideas into their heads that their mother and aunts have sexually abused them, then I want this to be stopped.”
When the couple had been married, Juana said, she had seen Nicolas do things to their sons that she did not agree with and thought were abusive.
She said she reported these acts to Rick during the evaluation process.
Juana alleged that Holzer would touch the babies’ genitals while changing them, shower with the children and allow them to touch his genitals.
She also stated that at their home when they had been married and at his parents’ home, Holzer would touch himself in front of the children, even while his parents were present and would regularly look at child pornography.
“There were times when the children would wake up crying in the middle of the night, and he would go to into their rooms without turning on the light, grab them and cover their mouth so they couldn’t scream and put them in the car and drive away with them for as long as two or three hours at a time,” she wrote.
Attorneys for both parties expressed concern about the sexual-abuse allegations, and the documents record that sheriff's Deputy Michael Emens interviewed Holzer and one of the boys on March 11, 2008.
It’s unclear whether a forensic examination of the child was ever done.
Noozhawk has requested more information about this interview with Holzer from the Sheriff’s Department, but has not been provided any information about it.
Court documents state the children’s mother was diligent to call each night to speak with the children, but Holzer said that the calls proved to be “stressful for everyone in our household.”
Whenever the mother called, Holzer told the court, he would ask each child if they wanted to talk to their mother. They would always say no, he said.
“I encourage them to talk with their mother, but given her unwillingness to put in the effort to visit them, they are apparently angry with her and I don’t feel that it is appropriate to force them to talk on the telephone,” he said.
The paperwork details that the day before Sebastian’s eighth birthday in 2009, when Juana asked to see the children without following the supervision procedures in the court order, she announced to Sebastian, “Well, anyway, I will see you tomorrow,” and then hung up the phone.
“While she did not end up driving to Santa Barbara, this incident caused tremendous stress, confusion and sadness on a day that should have been one of family celebration and unity,” Holzer stated at the time.
He said he believed there had been a “significant negative, cumulative emotional and spiritual effect” from not visiting but continuing with the nightly phone calls.
The court ordered that Juana’s right to telephone calls be terminated, and that her visitation with the children should be supervised by a psychologist for “the purpose of addressing the children’s anger towards their mother.” The court said Juana would be responsible for the cost as long as it continued.
Juana maintained that Holzer was the one who did not want her to speak to her children.
In 2008, Juana’s attorney at the time stated that she was unable to afford the cost of professional supervised visitation.
“(She) currently has no resources available to her to challenge the findings and recommendation issued by Dr. Rick, and is dissatisfied with the manner in which the investigation was conducted,” her counsel said.
The documents also say that she contacted Catholic Charities, La Casa de la Raza, CALM (Child Abuse Listening Mediation), CASA of Santa Barbara County (Court-Appointed Special Advocates) and the Family Therapy Institute of Santa Barbara but “to date no such services have been obtained by her.”
The court case last came before Judge Thomas Anderle in June 2010. Holzer was present with his attorney, but Juana was not with her attorney.
Since then, she has had almost no contact with her children, her fiancé stated.

Bitter Custody Battle May Offer Clues in Holzer Family’s Gruesome Mass Murder
With Nicolas Holzer charged as suspect, investigators still seeking motive in killings of his sons and their grandparents as ex-wife grapples with grief

Shortly after two young boys and their grandparents were found murdered inside their home near Goleta earlier this month, Santa Barbara County Sheriff Bill Brown said investigators were searching for an explanation.
“There’s nothing that points out any motive or anything that would have preceded this terrible tragedy,” Brown told a news conference on Aug. 12, the day after Nicolas Holzer, 45, was arrested on murder charges.
Holzer is accused of fatally stabbing his sons, Sebastian, 13, and Vincent, 10; his parents, Sheila Garard Holzer, 74, and William Charles Holzer, 73; and the family dog at the home they all shared on Walnut Park Lane, a quiet cul-de-sac off Ribera Drive near Foothill School.
At the news conference, Brown said “Holzer told detectives that he had killed his family to fulfill what he believed was his destiny.” He said Holzer was waiting outside the house when deputies arrived and was taken into custody without incident.
To date, Brown and his department have released no additional information about what might have spurred the second mass murder to rock the South Coast this year.
But clues to what triggered the carnage may lie, in part, in the nasty custody fight between Holzer and his former wife that began in 2006 as the couple was going through a divorce.
An inches-thick Superior Court file obtained by Noozhawk chronicles the battle between Holzer and Juana Holzer, replete with accusations of mental illness, aggressive and controlling behavior, and sexual abuse. The court ultimately granted Holzer full custody of their children, and largely cut off Juana from contact with the two boys.
But the matter was last in court more than four years ago, so it’s unclear if anything transpired in the interim to yield such a violent outcome.
However, court documents suggest that a family situation that may have seemed normal and amiable to friends and neighbors may have had a much darker side.
Family law attorney Matthew Long, who represented Holzer in the divorce, told Noozhawk that the case was one of the more protracted court custody cases he’s handled. But he said there was nothing in the custody case and Holzer’s interaction with the family court system that raised a concern. “He always presented as a normal guy, which I know sounds preposterous given the events that unfolded,” Long said. “That’s what’s so disturbing about this. We want to have some kind of an explanation.”
Long said he last spoke with Holzer four years ago and last saw him six years ago.
“That’s the scary part ... A lot can happen in six years,” he said. “Obviously something happened.”
Neighbors of the Holzers have been reluctant to speak about the incident or the family.
One neighbor said the killings had been “devastating for those of us on the cul-de-sac as well as others within the neighborhood and the community.”
“The Holzers were always a very private family,” said the neighbor, who asked that her name not be used.
In a more public forum, last week’s Board of Supervisors meeting was adjourned in the family’s honor by Supervisor Janet Wolf, whose second district includes the Holzer home.
Wolf described William Holzer as a “brilliant scientist” and his wife, Sheila, as a “loving and devoted grandmother.”
She said she did not know the family personally, but has had many close to the family reach out to her office since the murders occurred.
Wolf described Vincent as a “boy with an electric smile who would have been joining his classmates starting fifth grade and was a standout on his school’s intramural Foothill Falcons football team.”
Sebastian was an incoming eighth-grader at La Colina Junior High School “who was a bright, spirited and gentle boy who loved being with his friends and participated in the school’s AVID program and while only 13 was already planning for college.”
Those close to Holzer’s ex-wife, Juana, are speaking out even as they are grieving the death of the boys, whose funerals were held last weekend.
Noozhawk spoke with Charles Sirois, Juana’s fiancé, who said her family is consumed with grief.
“It’s a tragic loss of life,” he said.
The custody battle was costly and protracted, and taxed Juana to the brink, Sirois said.
“To take on that family that was financially capable of doing whatever it took ...,” he said. “Juana is an immigrant. She didn’t stand a chance.”
Sirois said Juana had not been in touch with the children for a number of years because the court order had become so restrictive “it pretty much eliminated all contact.”
“She was under the impression that since the Holzers had financial resources, that they would be able to take care of the children and that they’d be in a safe place,” he said of the grandparents.
Sirois has reviewed the detailed court file of the couple’s custody battle. More than two inches thick and spanning more than five years, the file outlines a contentious custody battle for the boys, which began at the divorce, and details accusations of sexual abuse.
The records paint a heartbreaking picture of two young children caught in the crossfire. The file also depicts a mother who had little recourse or money to fight a financially secure father in the court battle, and who gradually lost more and more contact with her sons.
The file outlines the beginning of their relationship, stating that Nicolas and Juana were married Jan. 13, 2001, and separated and divorced in 2006. At the time of the divorce, their sons, Sebastian and Vincent, were 6 and 3 years old, respectively.
The paperwork contains income statements and background of both parents used to sort out support payments and provide some personal history of the couple.
Holzer was listed as a graduate of UC Santa Barbara, but was enrolled at a trade school and living with his parents at the time of the divorce.
As part of the asset documentation, the file states that Nicolas had inherited some money prior to the marriage and the pair purchased a condo with the help of his parents in 2002.
Juana Holzer is described as having graduated the seventh grade in Mexico, where she was born, and had been unemployed during the marriage.
She lived in San Diego with other family members at the time of the divorce filing, and the documents state it was uncertain whether she had a driver’s license.
“Because of her educational background and lack of fluency with the English language, she will likely not be qualified for other than a minimum-wage occupation,” court records state.
When the couple separated, Juana moved into her sister’s house with the children. At the time, she had physical custody of the boys and Holzer was required to drive to San Diego for visitation.
“The evaluator recommends that physical custody be awarded to their father in Santa Barbara,” because it would be difficult for the mother to arrange transportation to get to Santa Barbara when the court arranged for custody visits with their father.
The document also acknowledged that the children would be spending time with their grandparents while Nicolas was attending classes in Ventura County.
Holzer previously worked at Raytheon, but layoffs were on the horizon and both he and his wife agreed that Holzer should be proactive and look to find a job with flexible hours and begin taking business classes, documents stated.
When the two separated, Holzer was working at Bargain Network in Goleta and shortly thereafter moved to another sales position at Select Personnel Services.
Holzer began attending ITT Technical Institute in Oxnard to become a record-coding specialist in hopes of earning what he had previously made at Raytheon.
Beginning in November 2006, Holzer was required to pay Juana $833 in child support and $490 in spousal support, with a $250 per month travel credit, leaving a monthly support obligation of $1,074.
Juana was not working at the time of the separation, and the court gave warning that she was expected to make “reasonable efforts to assist in providing for her support needs.”
In the court file, Juana expressed concern about Holzer’s mental stability and aggression toward the children. However, a 2006 statement from Holzer explained that doctors initially thought he was depressed but eventually diagnosed him with a thyroid condition.
Holzer’s parent were described as being supportive of the boys living with them in the Walnut Park Lane home.
“My parents are both in good health and good spirits and would very much like to provide a stable and loving home for Sebastian and Vincent,” Holzer wrote.
The divorce was just the beginning of the battle over the boys.
Perhaps the most revealing parts of the file are the notes about custody and visitation of the children, which chronicle a tumultuous battle between the parents.
A judge-appointed psychologist, paid by Holzer, performed a child custody evaluation on Oct. 3, 2007, and issued a 58-page report, which is not public record, recommending that Holzer be given custody.
Psychologist Gary Rick, who practices out of Ventura and is listed as an adjunct professor at Antioch University Santa Barbara, was hired by Holzer to evaluate the children and recommend who should be granted custody.
Rick did not respond to Noozhawk’s request for comment.
“The living situation and personal traits of the father were more likely to meet the emotional and educational needs of the minor children than those of the mother. Primary custody to the father is recommended,” Rick’s notes in the court file state.
Juana maintained that her ex-husband had mental-health problems and was aggressive and controlling toward her and the children, but Rick’s report indicates that “these allegations were not born out by the investigation.”
A chilling account from Juana in June 2008 states the contrary.
She noted that she was seeing the children every other weekend, and would go to Santa Barbara to pick them up and Holzer would retrieve them in San Diego.
“Vincent always cries because he doesn’t want to go with his father,” she said, adding that problems began when Holzer met her in the parking lot of a San Diego grocery store to hand off the children after a visit one weekend.
“As usual, Nicolas began to scream and offend me, then aggressively yanked Vincent from my arms,” she said. “I told him not to abuse my son, and he told me, ‘I have custody. I can do what I want.’”
Juana said William Holzer was out of the truck and saw the situation unfold. She said she asked him for help to stop his son from mistreating Vincent.
But her ex-husband told her to “go away” and that she “could not talk to his father.”
When she threatened to call the police if he didn’t stop abusing Vincent, Holzer taunted her, saying, “You remember who has custody? I do, not you, and I decide what to do with my children.”
Nicolas Holzer’s position in the court files was that his wife “refused to work on marital issues and was under the under influence of her family to act unilaterally and was not meeting the educational and emotional needs of the children.”
Her visitation rights were suspended in March 2008 when Vincent made “disturbing statements to his grandmother, me and his therapist,” Holzer wrote, saying that the boys reported they had been sexually abused by their mother and her sisters.
Juana stated that her ex-husband was telling the children to make those claims.
“I am concerned about the mental and emotional well-being of our children,” she wrote. “Because of the serious nature of the false accusations that are being made against me and my sisters, I began to investigate my options with several authorities, including the San Diego police, Santa Barbara police and La Casa de la Raza.”
“I have requested that similar investigations be made of Nicolas regarding his treatment of our children,” she wrote. “If someone is doing harm to my children, including putting ideas into their heads that their mother and aunts have sexually abused them, then I want this to be stopped.”
When the couple had been married, Juana said, she had seen Nicolas do things to their sons that she did not agree with and thought were abusive.
She said she reported these acts to Rick during the evaluation process.
Juana alleged that Holzer would touch the babies’ genitals while changing them, shower with the children and allow them to touch his genitals.
She also stated that at their home when they had been married and at his parents’ home, Holzer would touch himself in front of the children, even while his parents were present and would regularly look at child pornography.
“There were times when the children would wake up crying in the middle of the night, and he would go to into their rooms without turning on the light, grab them and cover their mouth so they couldn’t scream and put them in the car and drive away with them for as long as two or three hours at a time,” she wrote.
Attorneys for both parties expressed concern about the sexual-abuse allegations, and the documents record that sheriff's Deputy Michael Emens interviewed Holzer and one of the boys on March 11, 2008.
It’s unclear whether a forensic examination of the child was ever done.
Noozhawk has requested more information about this interview with Holzer from the Sheriff’s Department, but has not been provided any information about it.
Court documents state the children’s mother was diligent to call each night to speak with the children, but Holzer said that the calls proved to be “stressful for everyone in our household.”
Whenever the mother called, Holzer told the court, he would ask each child if they wanted to talk to their mother. They would always say no, he said.
“I encourage them to talk with their mother, but given her unwillingness to put in the effort to visit them, they are apparently angry with her and I don’t feel that it is appropriate to force them to talk on the telephone,” he said.
The paperwork details that the day before Sebastian’s eighth birthday in 2009, when Juana asked to see the children without following the supervision procedures in the court order, she announced to Sebastian, “Well, anyway, I will see you tomorrow,” and then hung up the phone.
“While she did not end up driving to Santa Barbara, this incident caused tremendous stress, confusion and sadness on a day that should have been one of family celebration and unity,” Holzer stated at the time.
He said he believed there had been a “significant negative, cumulative emotional and spiritual effect” from not visiting but continuing with the nightly phone calls.
The court ordered that Juana’s right to telephone calls be terminated, and that her visitation with the children should be supervised by a psychologist for “the purpose of addressing the children’s anger towards their mother.” The court said Juana would be responsible for the cost as long as it continued.
Juana maintained that Holzer was the one who did not want her to speak to her children.
In 2008, Juana’s attorney at the time stated that she was unable to afford the cost of professional supervised visitation.
“(She) currently has no resources available to her to challenge the findings and recommendation issued by Dr. Rick, and is dissatisfied with the manner in which the investigation was conducted,” her counsel said.

In the vast majority of these kinds of cases, the media never reports how or why the father had custody. In this case, however, we are told that the mother died. Daddy apparently started abusing these grieving children almost immediately, one he had full control.

RCMP say the girls were forced to perform sexual acts with the adults, including some that were captured on film. They were often starved and locked in their rooms for "most of the day" while being repeatedly assaulted with weapons.
Court documents show their 37-year-old biological father is facing a total of 18 charges, while his 24-year-old wife has 16 offences. They include making child pornography, making obscene matter, forcible confinement, failing to provide the necessities of life, sexual assault and assault with a weapon.
None of the allegations has been proven, and both are presumed innocent.
The children's birth mother died in 2011. It was just weeks later the alleged abuse began. The father then married the accused in 2013. Photos of the couple, along with the children, are posted on their Facebook sites.
RCMP say they first received information on Aug. 7 that "child abuse was occurring in the home and that two girls were being abused physically and sexually by their custodial parents." No other information was disclosed.
The Free Press has learned it was another family member who initially contacted authorities with concern about the state of the children.
RCMP immediately removed the girls, along with a younger sibling who was not allegedly abused, and placed them in CFS care. Officers with the child-exploitation unit carried out a search warrant at the home on Aug. 14 and seized a number of materials, including computer equipment, which is still being reviewed. Further charges could be laid as the investigation continues.
Both accused made their first court appearances Tuesday in Dauphin.
The father has had his case adjourned until Sept. 2 and remains in custody.
The stepmother made a bail application Tuesday afternoon and was released by provincial court Judge Don Slough under strict conditions.
The Crown was opposed to her release. A court-ordered ban prevents specific details of the hearing, including evidence and submissions presented by lawyers, from being published.
The woman's bail includes a $2,000 surety and an order she reside in Winnipeg with her mother. She is also banned from having any contact with her husband, her stepdaughters or any children under the age of 16. She is also on a nightly curfew of 6 p.m. to 7 a.m.

A 37-year old father of two from Co Down was today placed on probation for three years after he admitted possessing 258 indecent images of children.
As part of his probation Michael Stuart Jackson, from Craigarusky Road in Killinchy, will undergo the Internet Sexual Offenders Treatment Programme. In addition, he was made the subject of a five-year Sexual Offences Prevention Order.
Downpatrick Crown Court, sitting in Belfast, heard that police called at Jackson’s home with a warrant on February 28 last year and that during the course of a search, Jackson’s laptop was seized. When the laptop was forensically tested, a total of 258 indecent images of children were discovered in a file marked ‘Michael’s downloads’. Also present were several extreme pornographic images of bestiality.
Crown prosecutor Rosemary Walsh said that some of the images in the more serious categories included oral sex being performed on a baby by a female adult, and children as young as four being raped and forced to perform oral sex on adult males.
Ms Walsh also revealed that during police interviews, Jackson said he had been looking at over 18 porn websites, but that other images had popped up from websites he would not normally go to. He also admitted that some of these images that “inadvertantly” popped up were of children as young as ten.
The court heard Jackson was interviewed a second time last August, and on this occasion he claimed he had been under the influence of drugs during the first interview and had given “incorrect answers to police.” He did, however, accept he had viewed images of children on the Internet.
It also emerged that both Jackson’s wife and two children has access to the laptop used by him to view and download child porn images. They have since moved overseas.
Jackson - who worked for the family furniture business - subsequently pleaded guilty to seven counts of making indecent photographs of children, two counts of possessing indecent photographs of children and three counts of possessing an extreme pornographic image.
Defence lawyer Darren Duncan told the court that whilst on the surface Jackson had a good family background, there were “issues” between his client and his father. These problems, Mr Duncan said, led to Jackson having “issues about control”, especially concerning his wife and two children.
Regarding the offending, the lawyer said this also came down to control. He said that the pop-up images “intrigued” Jackson, who “acknowledged thereafter that he searched for other images”.
Mr Duncan added: “He felt this gave him an element of control in that he could look at whatever he wished.” Mr Duncan told Judge Geoffrey Miller QC that Jackson looked at these images whilst on legal highs. He also spoke of the “clear implications” his client’s actions have had both on him and his family - adding “he is far from proud at what he had done.”
Passing sentence, Judge Miller said that he accepted Jackson had displayed both a level of victim empathy and also embarrassment and remorse for his actions. He also acknowledged Jackson’s clear criminal record.
However, the Judge told Jackson that by viewing these images, he had “contributed” to the perpetuation of child sexual abuse where youngsters are subjected to acts of violence and depravity.
Placing Jackson under a three year probation order, Jackson was told by Judge Miller: “It is clearly apparent from your background and from the reports I have that programmes that exist are of a necessity for you to fulfil, in order that the underlying deviancy within your character which has led to these offences being committed needs to be addressed.”

Mr Duncan added: “He felt this gave him an element of control in that he could look at whatever he wished.” Mr Duncan told Judge Geoffrey Miller QC that Jackson looked at these images whilst on legal highs. He also spoke of the “clear implications” his client’s actions have had both on him and his family - adding “he is far from proud at what he had done.”
Passing sentence, Judge Miller said that he accepted Jackson had displayed both a level of victim empathy and also embarrassment and remorse for his actions. He also acknowledged Jackson’s clear criminal record.
However, the Judge told Jackson that by viewing these images, he had “contributed” to the perpetuation of child sexual abuse where youngsters are subjected to acts of violence and depravity.
Placing Jackson under a three year probation order, Jackson was told by Judge Miller: “It is clearly apparent from your background and from the reports I have that programmes that exist are of a necessity for you to fulfil, in order that the underlying deviancy within your character which has led to these offences being committed needs to be addressed.”

Once again, an article that manages to muddle the important issues--or ignore them altogether. Why was a father who had previously CONVICTED of possessing CHILD PORN allowed to live with 3 YOUNG DAUGHTERS in a NUDIST COLONY? And where was the mother in this? Did she live with the father, and have no previous knowledge of his child porn habit? Did the father have custody?
Notice that the girls went into foster care, but the mother has regained custody. A lot of back story is being omitted here....

A Florida nudist pleaded guilty to possession of child pornography Friday after being accused of taking photographs of his three young daughters, aged 8 to 12, and sharing them with other men.
Brian Martens, 54, who lived with his children at a nudist colony in Palm Beach County, faces 10 to 17 years in prison for possession of child pornography, including images of children who were not related to him, according to the Sun Sentinel.
Martens had asserted that the pictures of his daughters were “family portraits” of a naturist family, however two judges who saw the photos did not agree.
Martens came to the attention of authorities last year after investigators discovered photos of his daughters on a computer belonging to a neighbor, Leslie Grey Vanaman, 45, now serving 60 years in federal prison for possession of child pornography.
Vanaman, a professional photographer and owner of A Shade of Grey Photography, had a prior 2004 state conviction in New Jersey for possessing child pornography.
Investigators discovered thousands of emails between Martens and Vanaman, including one containing a series of nude photos of children between the ages of 8 and 11 that were taken in a studio setting. According to prosecutors, the photographs showed their genitals and involved unnatural poses for children suggesting “sexual coyness” or “an apparent willingness to engage in sexual activity.”
The report states Martens, Vanaman and a third man had emailed discussions about “the sensuality and sexuality” of the images.
“[Martens] shared these photographs with an email group of approximately a dozen members,” prosecutors wrote.
When Marten was arrested by Homeland Security agents, he was carrying a computer thumb drive containing images of naked children. A search of his laptop turned up more child pornography, some of it downloaded from the Internet.
“He feels terrible about this,” Marten’s attorney James Eisenberg said.
According to Eisenberg, Marten’s three daughters were taken into foster care when their father was arrested and will be released to the custody of their mother.

Victoria police have been accused of not passing on a death threat made by Luke Batty’s father, who killed his son on a public cricket pitch just weeks afterwards.
A former housemate of Greg Anderson, Luke’s father, told ABC’s Four Corners on Monday night that Anderson had threatened to cut his head off.
The threat followed Anderson’s arrest for looking at child pornography on computers in a public library.
Rosie Batty, Luke’s mother and Anderson’s former partner, was not initially informed of the pornography arrest and was unaware of the death threat, even when police called her to ask where Anderson was living.
Just a week after the call from police, Anderson turned up at Luke’s midweek cricket practice in Tyabb, Victoria, on 12 February this year.
He killed Luke with a cricket bat and a knife in front of an eight-year-old child. Police shot Anderson at the scene and he died in hospital.
Rosie Batty said the police’s failure to inform her of the threat was “gravely concerning".
"A lot of us are very careless, saying, 'I could kill you, you know, you're driving me mad,' or throwaway angry comments, but to actually say ... to decapitate someone. They're not light comments."
Ken Lay, Victoria’s police commissioner, said a coronial inquest constrained what he could say about the case. “Look, if I put myself in the position of the victim, you want to be in possession of every bit of information you possibly can be,” he told Four Corners.
“I wasn’t aware of that, but again that may well be indicative of police members not being in possession of all the facts, once again.”
There were four warrants out for Anderson’s arrest at the time of Luke’s murder. He had previously been served an intervention order after threatening Rosie at her home, but was allowed to have contact with Luke away from the house.
Rosie said her son had told her of a conversation he had had with Anderson about a knife. She said Anderson had “said something like, ‘It could all end with this,’ and mentioned to Luke that he wished he could go into the next life, that he was tired of this life”.
She added: “And from my memory, I got the impression that that was a journey he’d like to go on with Luke. And I immediately felt sickened, and that all the years I’d defended my decision for Greg to be Luke’s father, and totally convinced that Luke was always safe with Greg, when Luke shared that with me I no longer had that confidence at all, ever again.”
A court ordered that Anderson have no further contact with his son. Anderson challenged the ruling and Batty learned of the child pornography charge against him at the hearing.
“I just thought, ‘Is there anything more that I’m going to find out about this man?’ ” she said.
Since her son’s death, Batty has become an advocate for family violence prevention, with the topic becoming an election issue in Victoria.
“I had a beautiful boy and in Feb something happened to take him away from me,” she said. “Greg won. He took him and he said to me I can make you suffer for the rest of your life. But inside all of us is amazing strength … he may have taken Luke but he hasn’t taken me.”
Dr Chris Atmore, senior policy adviser at the Federation of Community Legal Centres, said the issues highlighted by Luke’s murder needed to be met with urgent government action.
“Sadly, many women remain outside the system supposed to help them, while those within it are placed at often lethal risk by fundamental systemic flaws,” she said.
“Different parts of the system – police, courts and child protection – need to share information to enable proper risk assessment and management, including sharing all relevant information with women who have intervention orders.
“We also need to tighten the net around men who commit family violence by holding them to account when they commit violence and flout intervention orders, and work intensively with them where change is possible.
“Above all, however, we need to strengthen the supports for women and children facing family violence, including the free legal support that can be vital in securing their safety.”

The FBI found child pornography while investigating Josh Powell in the 2009 disappearance of his wife, Susan Powell, according to documents. Josh Powell killed himself and his children in 2012.

SALT LAKE CITY — Investigators found child pornography on Josh Powell’s computer at least 17 months before he killed his children and himself, according to FBI documents obtained by The Salt Lake Tribune.
The paper reported Saturday that documents show the FBI was investigating Powell in the disappearance of his wife, Susan Powell, who was last seen at her West Valley City, Utah, home on Dec. 6, 2009, as well as for possession of child pornography.
Anne Bremner, an attorney for Susan Powell’s parents, said the family was never told the FBI was investigating Josh Powell for child pornography. If the state of Washington’s Department of Social and Health Services had known about the suspected child pornography, Bremner said, it “never would have let him have those kids.”
When a state worker delivered 7-year-old Charlie and 5-year-old Braden to Josh Powell’s rented home in Graham, Pierce County, on Feb. 5, 2012, Josh Powell locked out the worker and ignited a fire that killed him and his sons.
Powell for years had been considered a person of interest in his wife’s disappearance, and eventually he moved back to the Puyallup area, where both his father and his wife’s parents lived.
He lost custody of the boys after his father was arrested for possessing child pornography in another house they previously shared. The boys were in the custody of the state, but living with Susan Powell’s parents. However, Josh Powell was allowed supervised visitation.
Shortly before their deaths, Charlie and Braden Powell had begun talking to their grandparents about things they remembered from the night their mother vanished, a lawyer for the grandparents has said.
On the day of the fire, a state contract worker from Foster Care Resource Network brought the boys for a visit to Powell’s house. Powell answered the door, pulled the boys inside, slammed the door and locked it. The caseworker banged on doors and windows and called 911, but soon smelled gasoline and the fire erupted.
Josh Powell had been previously linked to child pornography, The Tribune reported. At hearings in Washington state to determine custody of his children, then-Assistant Washington Attorney General John M. Long said Powell was under investigation for child pornography after cartoon images of incest between mothers and children were found on his computer in late 2009 or early 2010.
The paper reported that the FBI appeared to be trying to discover what other images might be on Josh Powell’s computer, but the machine had been successfully encrypted by Powell.
Last month, a federal judge ruled that insurance proceeds from the fatal fire could be split between Josh Powell’s parents and sister and Susan Powell’s family.

ELGIN, Okla. – An Oklahoma father is in police custody after authorities intercepted an internet chat regarding lewd proposals with his young child.
According to the Canadian County Sheriff’s Office, Lieutenant Adam Flowers, a member of the OSBI’s Internet Crimes against Children state wide task force took Frankie Tahsequah, 39, of Elgin, into custody after authorities intercepted an internet chat where Tahsequah offered an adult male the opportunity to have sex with his four year old son.
Police say during a lengthy interview and examination of a cell phone, Lt. Flowers determined Tahsequah was in possession of child pornography, and that he had been actively trading in child pornography as well.
The Elgin man allegedly admitted to authorities that he possessed the long time fantasy of having a sexual relationship with a small child.
However, he denied ever acting on it.
Canadian County Sheriff Randall Edwards said, “These monsters will do anything to fulfill their twisted fantasies, and while Tahsequah denies ever having abused a child, it’s only a matter of time until these people act out their fantasy and destroy a child’s life.”
Tahsequah was booked into the Commanche County Jail with charges of Possession of Child Pornography and Violations of the Computer Crimes Act.
