Lynn father gets 9 to 12 years for shaking baby

SALEM — Superior Court Judge Howard Whitehead sentenced a Lynn man to nine to 12 years in state prison after he was convicted of violently shaking his then-infant baby during an incident in July 2009.

Whitehead imposed the sentence this morning after hearing Assistant District Attorney Kate MacDougall's argument that Jose Aquino, 29, of Lynn “violently shook” his then 2-month-old daughter for what doctors testified had to be a minimum of one minute, causing serious and permanent brain injuries.

A social worker who works with the now 2-year-old girl read an impact statement on behalf of the child's foster parents, who asked that the maximum sentence of 15 years be imposed.

Aquino, wearing a denim jacket, jeans and white sneakers, did not react outwardly to the sentencing, and his family was not present at the hearing.
