DETROIT (WWJ) – A Detroit dad accused of abusing his 12-year-old son and hiding him in the basement of their home has agreed to a plea deal.

Charlie Bothuell IV — father of Charlie Bothuell V, who was missing for 11 days in June, 2014 — pleaded guilty on Tuesday to a reduced charge of fourth degree child abuse.

Judge Margaret Van Houten immediately sentenced him to 18 months probation, although he could have served up to a year in jail.

He was also ordered to take anger management classes and to follow all terms set by the Wayne County Third Circuit Court Family Division and to have no contact with his son. Court costs and restitution will be determined in the future.

Bothuell IV and his wife, Monique Dillard-Bothuell, each were initially charged with second-degree child abuse and torture, but the torture charge was later dropped and Dillard-Bothuell’s case was dismissed.

The story made national headlines before the alleged victim was found hidden behind a heavy drum in the bowels of the townhome where he lived with his dad and stepmother.

The younger Bothuell testified about alleged abuse at the hands of the two, describing strenuous daily workouts, denial of food and beatings with a PVC pipe.

His father was giving an interview to cable TV host Nancy Grace when he learned that Charlie had been found by police. He expressed surprise and said he didn’t know his son was in the basement.

“I thought my son was dead,” Bothuell IV told reporters.

He fought for custody of the boy, now a teen, who was placed in the care of other family members.

ONLY ON 11: Father confesses to abuse of infant son

SLIPPERY ROCK, Pa. — A Butler County man accused of abusing his infant son confessed to the crimes on Wednesday.

“Yes I did,” Justin Craig said when Channel 11’s Amy Marcinkiewicz asked him if he hurt his son. “It was a stupid thing, I admit, but it changed me.”

Along with the confession, Craig told Marcinkiewicz that he has a problem with his anger and he took it out on his 3-month-old son.

According to court documents, the infant suffered broken arms, legs and a shoulder at the hands of his father.

Doctors said the injuries were in various stages of healing, which makes police believe the abuse started right after the child was born and continues until his mother and father brought him to the hospital last week.

According to the criminal complaint, the child’s mother and Craig’s girlfriend told police she saw the abuse, but was afraid of Craig. She told troopers she observed Craig choking the baby.

According to the child’s mother, she tried to not allow Craig to be alone with the baby. #“It made me realize that I’m a weak and pathetic person,” Craig said.

While in court, Craig continually said under his breath, “I deserve a second chance, I’m sorry.”

The baby is out of the hospital and with a foster family doing well.

Dad Arrested For Murder; 5-Year-Old Son Found Dead After Standoff

TULSA, Oklahoma - Police say they found a 5-year-old boy dead inside an apartment after a man involved in a 17-hour standoff surrendered on Friday morning.
Officers said the standoff with the unidentified man began at about 5:30 p.m. on Thursday at the Riverchase Apartments in the 7900 block of South Riverside Drive.
Bryon Creech, 36, surrendered to police at about 10:30 a.m. on Friday. Police entered the apartment and found the boy's body inside. Police said the boy was his son.
Creech has been booked into the Tulsa County Jail for first-degree murder, shooting with intent to kill, kidnapping, second-degree burglary and violating a protective order.
Police said the man came to the apartment where his wife and child live, violating a protective order. They said the couple is going through a divorce but have joint custody of the child.
Late Friday afternoon, police said the woman left the apartment to go to work on Thursday, and some time after that, Creech came to her apartment and brought their son. He had court-allowed visitation with the boy, police said. Officers said Creech broke into the apartment and barricaded himself and the boy inside, but his wife was able to see him remotely through surveillance cameras she installed.
His wife called police to report Creech was inside her residence, and shortly after officers arrived, they said Creech fired at least 10 shots.
Police evacuated the complex and set up a secure area around the apartment where the man and the child were located. Officers said the department's special operations team talked with Creech by phone all night in an effort to get him to surrender.
Court documents show Creech's wife filed a petition for a protective order in July 2014 after Creech threatened her with a gun. The woman was afraid Creech would hurt her or her son, records say. She also cited his size – Creech is 6-foot-6 and weighs 330 pounds, according to her petition.
He is a very large angry loud man. He blocked with his body in our bedroom and would not allow me to leave the bedroom. Recently his anger has been escalating. He constantly threatens and harasses me in a loud and frightening cruel way. My son is afraid of him and has told me so. The defendant has had anger management treatment before. This spring during an argument while I was trying to leave he placed a hand gun on the couch between us. I was frightened to leave because of his behavior and the gun. He has taken my cell phone away in the past to prevent me from calling 911. He has also taken my car keys in order to trap me at the house. I am very afraid of him and know that things will get really bad when I file for divorce. He threatened “to make my life a living hell” if I filed. I am afraid he will hurt me and my son. His behavior is getting worse and out of control. He has forced me to do things I did not want to do.”
Creech also filed a petition seeking a protective order against his wife. He wrote in the document that he found bruises on his son's thigh and back in January. He claimed the child said "mommy grabbed me and pushed me." Creech's request for a protective order against the woman was denied.
He was booked into the Tulsa County Jail on Friday afternoon.
In November 2014, Creech was charged with malicious injury to property, a misdemeanor. According to court documents, Creech vandalized his wife's vehicle during a meeting to exchange custody of the child. QuikTrip surveillance footage caught Creech scraping something down the side of her vehicle, an affidavit says. That case still is ongoing in Tulsa County District Court.

Dad gets 2 years in jail for assault on 2-year-old daughter; was he a custodial father? (Leonardtown, Maryland)

One of those strangely written articles that hints at a custodial father, without openly admitting it.

The signs:
* Zero mention of the mother
* If there had been a mother in the home, than her response to the child's injuries would have to be clarified. Either she was at work when it happened or otherwise out of the house. Or she "failed" to seek medical attention.  Or she was "equally" responsible. Something. But there is nothing.
* All the more suspicious when the injuries had been going on for "as long as a year"--and still there is no explanation as to the mother's response or reaction.

Notice that this moron is playing the I-have-no-idea-how-the-baby-got-hurt game--often played by abusers who are experts at throwing up "smoke and mirrors."

And in fact, the father has a history of criminal assault.

So how did MARQUIS BARNES manage to become a custodial father, or at minimum, the apparent primary caretaker? Whey does no one wonder here why a father with a violent criminal history has possession of a 2-year-old little girl that he had apparently physically abused for at least a year? What happened to Mom? How did she get shut out of the picture?

Two-year-old abused, father sentenced

Leonardtown, MD -- A California, MD man has been sentenced for neglect of his daughter, who was two years old at the time of the incident. Marquis Barnes, 26, was sentenced Feb. 9 to two years in jail. The sentence was imposed by Judge Michael Stamm after a hearing.

Barnes entered an Alford plea in the case, which meant he didn’t admit guilt but conceded the state had enough evidence to prove its case. Barnes’ attorney, public defender Sean Moran, said his client didn’t know what happened and he was the one who took her to the hospital. “When he looks at the pictures (of his daughter’s injuries) his stomach turns, too,” Moran said.

But Judge Stamm, looking at the picture of the girl at the hospital, observed the extent of the injuries, including broken right and left collarbones, rib fractures and aggressive chest compression. Assistant State’s Attorney Julie White said the injuries indicated that the abuse had been going on for as long as a year.

Judge Stamm called Barnes’ contention of not knowing what happened “all smoke and mirrors.” The judge noted that Barnes’ criminal record showed a history of “assault behavior.” The judge said even if Barnes didn’t inflict the injuries himself, he was responsible for his daughter. “You had an obligation to that angel to make sure that angel was safe,” Stamm said.

Before the sentencing Moran said of his client, “He misses the child and the child misses him.” He said that all his client wanted was to be a good father and he would do whatever the court wanted, including anger management and parenting counseling.

Whatever counseling Barnes gets will have to be in the Maryland Department of Corrections. The judge imposed a five-year sentence but suspended all but two years. Barnes will be on five years of supervised probation when he is released. He will be under the supervision of a domestic violence agent in the Department of Parole and Probation. He also will be prohibited from having any contact with a child under 12 without the agent’s consent.

They should be able to take some time off and take care of their babies, and bond with them. And either we need to make paid maternity leave the law of the land and/or force useless crap like this Daddy to quit bitching about how "angry" he is and GET A JOB and support his kids. Guess what? DCS documents: Father had anger issues prior to baby death

INDIANAPOLIS - Records show a Greenwood father accused of shaking and killing his 2-month-old baby had no prior history with the Indiana Department of Child Services, Call 6 Investigator Kara Kenney.

Following the October death of Roarak Defenderfer, Kenney requested the Greenwood family's file with DCS.

Ian Defenderfer, 20, is charged with aggravated battery and battery resulting in death of a person.

Sarah Naum, the baby's mother, is not facing any charges.

DCS became involved when Roarak was taken to the hospital Oct. 3 with breathing problems.

According to the DCS family case manager interviews with family members of the baby, Ian Defenderfer had a history of anger issues.

DCS interviewed Brett and Susan Naum, the maternal grandparents of Roarak, who said Defenderfer had abused animals including breaking a cat's leg.

"Susan stated she was afraid this was going to happen," read the DCS documents.

"She didn't want Sarah to leave Ian alone with Roark after the cat incident."

Ian Defenderfer's father told DCS their son had temper tantrums as a teenager, but was excited about the baby.

According to court documents, Defenderfer called 911 that day to report Roarak had stopped breathing.

Medics took the infant to an area hospital before he was airlifted to Riley Hospital for Children.

Defenderfer first confessed to his girlfriend that he shook the baby, according to documents.

Authorities said Defenderfer admitted to police he shook the child the following day.

The child died at the hospital Oct. 5 of blunt force trauma to the head, officials said.

Authorities said the child also had signs of shaken baby syndrome. Defenderfer later admitted to police that he was frustrated and annoyed with the child for crying and was not happy the child's mother had to work late.

Defenderfer is expected in court Jan. 22. His defense attorney has not yet returned a call from Kenney.

Dad with joint custody finally has contact with daughter severed after repeated abuse, death threats; Dad now running for office and angry that abuse is brought up (Austin, Texas)

Great piece of investigative journalism. Too often the public still doesn't get how abusers like this are successful in getting joint custody. Mom is very lucky she was able to get this violent creep out of the picture before her daughter was seriously injured or killed, especially in Texas. Most moms are not so lucky.

Notice how Daddy reacts in a typical abuser fashion. Claims he's being lied about, claims ignorance about the medical evidence regarding the abuse, arrogantly refuses to take (useless) parenting classes or anger management classes. Refuses to explain why the injuries only occurred during his visitation time. Refuses any restriction on his guns. Not even so he can see his kid.

Notice he doesn't seem to be protesting that Mom let him off the hook for $15,000 in medical expenses just to keep her daughter safe. That alone proves for me that she's telling the truth. Moms will do away with the money if it means safety for their kids.

When I got custody back, I knew that it meant I would never get child support and that the corrupt Chautauqua County Family Court would never enforce any decree. And I was absolutely right. But it was worth it to keep my kid safe too.

District 6 Council candidate Don Zimmerman injured, alienated daughter, court records state

District 6 candidate Donald Shelly “Don” Zimmerman, founder of the Travis County Taxpayers Union, is an aggressive leader who as president of a municipal utility district brought two lawsuits, one of which resulted in winning a case before the U.S. Supreme Court.

But aggression in disciplining his daughter, Marina Zimmerman, resulted in documented physical and emotional damage and permanent loss of parental rights through civil court action.

Files from a Travis County District Court case include three reports from Deborah Neitsch, MD, from early 2011. The reports state that on separate occasions Zimmerman inflicted bruises, pulled Marina’s hair, pushed her, and “threatened to kill her.” The records indicate the doctor would contact Child Protective Services (CPS). Such reporting is required within 48 hours by Texas Family Code Section 261.101, which states, “A professional may not delegate to or rely on another person to make this report.”

“I got a call from CPS and consulted a couple of attorney friends and was told when lies are made you should demand proof of the allegations and if don't get proof you should not cooperate,” Zimmerman told The Austin Bulldog in a Tuesday telephone interview.

Three documented incidents

The first incident occurred just three days after Marina’s twelfth birthday, then twice more, all within a three-week period in January and February 2011, according to the medical records. She weighed 84 pounds at the time. Each incident occurred during evening or weekend visits when Zimmerman had sole possession as authorized in the divorce decree.

Asked if he did those things to his daughter, Zimmerman replied, “Those are unequivocal lies. They are outright fabrications and absolute lies.”

Doctor’s first examination—January 24, 2011, the physician’s record indicates a “very minor bruise” was found on Marina’s right forearm. “There are concerns that her father is being physically and emotionally abusive to her when she is visiting him.” The record further states, “We will contact the CPS caseworker that is in charge of her case. No serious injury seems to have occurred but I worry about the psychological toll on her.”

Doctor’s second examination—January 28, 2011, the doctor found that Marina had a bruise on her left shoulder blade and a stiff neck. “He wanted to take her phone away and she walked away and he grabbed her shoulder and spun her around and pushed her backwards...He pushed her from behind and now she has a bruise on her left scapula (shoulder blade). Her neck is stiff after he pushed her....”

“[C]ontinued concern of her dad being physically forceful with her,” the record states. “[W]ill keep document for CPS case worker.”

Doctor’s third examination—February 11, 2011, the record states, “Her dad was harsh with her yesterday and pushed her against the microwave and now she has right hip pain and right shoulder pain. ... Her dad has been yelling at her and threatened to hit her but didn’t. He has threatened to kill her and she has fears of (him) shooting her...Her parents are worried that she needs therapy but her dad refuses.”

Zimmerman’s threat to hit Marina was overheard by her mother and stepfather in a phone call that she made to her mother during that confrontation, according to a sworn affidavit filed by her stepfather, Eric “Ani” Fox.

The February 11, 2011, doctor’s record also states, “Concerns of abuse with hip and shoulder strain. Recommended if CPS does not intervene this could lead to a life threatening situation. I recommend they persue (sic) legal full custody as soon as possible. We will contact CPS about the situation.”

For prevention the doctor stated, “Counseling: Domestic violence, warned this was the most common cause of homicide in Texas and in our area and needs to be taken seriously. [T]he situation seems to be escalating quickly due to CPS investigation.”

Zimmerman’s responses

When questioned in the Tuesday interview about the alleged threat to kill his daughter, Zimmerman replied, “That's an outright lie. None of this has ever been shown to me.” When reminded that the cited medical reports are in the files for his divorce case, Zimmerman replied, “These allegations are news to me. I’ve never seen them before. These are offensive lies and I’ve never seen them before. I’m not afraid because these are lies.”

Zimmerman said he has a license to carry a concealed handgun and he has guns and ammunition in the house.

“(Bochenkova) demanded I move all guns and ammunition out of the house,” Zimmerman said. “Why would that demand be made? I can agree to do it or refuse to do it. She's a brilliant manipulator and liar. If I agree to move the guns and ammunition out of the house, then I'm agreeing I'm a violent person who can't be trusted around guns and ammunition. If I do not agree, I'm in denial and won't acknowledge that I'm a violent and dangerous person. The demand is a lie.

“I’m 54 and never in my life have I been violent against anyone. I’ve never shown violence. I get angry. I’m angry now when someone lies and attacks my character.”

Zimmerman met Kateryna “Katya” Bochenkova in Kiev, Ukraine, when he was there teaching English as a second language. She was one of his students. They met again when she was a student at Texas A&M University in College Station. They were married in Brazos County December 6, 1997, when he was 38 and she was 20.

Marina was born in January 1999.

A Final Decree of Divorce was approved May 27, 2005. The marriage was “dissolved on the ground of insupportability,” which is defined in Family Code Section 6.001 as “without regard to fault.”

Mother followed doctor’s advice

The doctor recommended pursuing full legal custody and Bochenkova quickly did so. On February 16, 2011, she petitioned for a Temporary Restraining Order. Included in the petition was a request for the court to order Zimmerman to attend parenting classes and anger-management classes.

Bochenkova told The Austin Bulldog she wanted Zimmerman to take those classes so that he “could modify the behavior that brought us into that conflict situation in the first place.”

Asked if he took those classes, Zimmerman replied, “I did not.”

In response to Bochenkova’s petition, the court issued an Agreed Temporary Injunction to bar Zimmerman from contacting or communicating with his daughter or taking possession of her, rights that had been established by the divorce decree.

Asked to comment on the injunction, Zimmerman said, “The crux of it is that with people willing to lie under oath I'm not going to see my daughter any more. If I persist what would have come next would be false allegations of sexual abuse,” Zimmerman said.

“I’ve seen this bad movie before,” he added. “I won’t see my daughter anymore. I won’t let you play this game.”

There has been no communication between Zimmerman and his daughter in more than three years, both he and Bochenkova said.

Dormant case revived, concluded

On March 10, 2014 Zimmerman’s new attorney, Round Rock-based Stephen Casey of the Casey Law Office PC, filed a motion to enter a final order in the case, stating that Zimmerman’s “relationship with the minor child has become fairly non-existent. ... Respondent remains willing and able to communicate but until it is initiated by the minor child there is no interaction.”

Bochenkova told The Austin Bulldog that Marina has not seen her father in more than three years and does not want to.

The girl’s mother responded to Casey’s motion by filing petitions of her own in April and June of this year.

In a final agreed order filed June 16, the court ordered that Zimmerman “shall have no possession of or access to the child.”

As part of that order, the court found that Zimmerman owed nearly $15,000 in arrearage for the child’s medical support expenses, and that “Bochenkova has agreed to waive all past medical support.”

“We wanted Don out of our life and that was the easiest way to achieve that,” Bochenkova told The Austin Bulldog. “It was the easiest way to close the deal, and we gave up that money in exchange for the freedom of our daughter.”

The court action in June also removed the requirement for Marina to live in Austin. She recently moved to Bound Brook, New Jersey, with her mother and stepfather.

On the “About Don Zimmerman” page on his campaign website, Zimmerman states, “I have one remarkable daughter, Marina Lorna Zimmerman.”

But the girl long ago quit using her father’s name. In 2012 and 2013 she won medals in fencing competition and performed classical piano music as Marina Bochenkova, her mother’s maiden name.

“She says she will take my name legally when she is 18,” Bochenkova said.

Dad pleads no contest to assaulting 15-year-old son; dad ordered to stay away unless family court "orders visitation contact" (Long Beach, California)

Not even a slap on the wrist. Dad SALIM MICHAEL KHOURY wastes the tax payers money on useless classes. Even the 10-year ban from seeing the assault victim, his son, means nothing since it can be overturned by family court at any time. And probably will be given that this is California. Long Beach father pleads no contest to assaulting son

Posted: 05/29/14, 3:36 PM PDT | A Long Beach man accused of assaulting his so pleaded no contest to child abuse charges Wednesday and was ordered to stay away from the teen for the next decade, the Los Angeles County District Attorney’s Office announced Thursday.

Salim Michael Khoury, 57, was immediately sentenced by Los Angeles County Superior Court Judge Jessie I. Rodriguez to five years of formal probation.

Under the terms of the negotiated plea agreement, Khoury also is required to attend parenting and anger management classes for one year and perform 120 days of Caltrans service.

Khoury was also ordered to stay away from his 15-year-old son for 10 years unless a family court orders visitation contact.

Authorities say Khoury beat up his son after a family disagreement on Feb. 10. The extent of his injuries at the time of the attack were not disclosed.

MIDWEST CITY, Oklahoma - A Midwest City father has been charged with child abuse after police say he attacked his autistic son when he was intoxicated.

According to police, on Friday, April 4, officers responded to a child abuse report at Carl Albert Middle School, located at 2515 S. Post in Midwest City. A 7th grader at the school told officers that his father, 51-year-old Dominic Joseph Durazo, was intoxicated when he told him he was going to teach him how to fight.

The child told police that Durazo hit him multiple times in the chest, arms and neck with his fist and elbow. Officers say they observed bruises on the victim's chest and arms.

The victim says he was too afraid to go home because his father was an alcoholic and had anger issues.

When officers spoke with Durazo, he said he was play-fighting with the victim and did not hurt him.

According to court documents released on Thursday, April 10, Durazo has been charged with one count of child abuse. The child was placed in the custody of his mother pending a DHS investigation.

Dad pleads guilty to assaulting son and daughter; gets probation, anger management, and parenting classes (Mobile, Alabama)

The assistant DA blames the light sentence on the fact that the mother refused to testify.

In reality, victims of DV have very good reasons not to testify. These dudes tend to get light sentences regardless, but if you testify, they are pissed. Notice that he beat Mom too.

Father of two pleads guilty to assaulting son and daughter

MOBILE, Alabama – A Whistler man pleaded guilty on Tuesday to misdemeanor assault related to injuries he gave his two children around New Year’s Eve 2013.

Emmanuel Gales, 30, was in District Court Judge Jay York’s courtroom and originally faced two counts of child abuse and one count of third-degree domestic violence before accepting a plea deal with prosecutors. His pleaded guilty to third-degree assault and was sentenced to one year in jail, which was suspended in favor of two years supervised probation, with provisions requiring anger-management training and parenting classes.

Assistant District Attorney Nicki Patterson told Judge York that officers responded to a domestic violence call Gales’ home on Dec. 31 and found his wife and 5-year-old son suffering “busted lips” and his young daughter with “belt marks across her chest.” Gales’ wife also had a black eye and his son a “large bruise to his ribcage that appeared to come from a fist.”

Patterson said the defendant’s wife refused to testify against her husband, which made the misdemeanor charge the best the prosecution could hope for. She said she normally pushes for felony charges when the injured children require treatment for their injuries.

MUNCIE, Ind. (WISH) – A Delaware County father is in jail facing charges of child abuse.

Muncie police told 24-Hour News 8 that Daniel Strunk lost parental rights to his two older children before and he could lose those rights again.

“He’s one of those that should never be around children,” said Muncie Police Sgt. Linda Cook.

Strunk, 27, admitted to Muncie police he’s getting counseling for anger issues, but what police said he did last Friday night to his 1-month-old son is far from making a change.

“I think he was more concerned about himself than the welfare of this child,” Sgt. Cook said.

Sgt. Cook said Strunk was left to care for his 7-week-old son and a 5-year-old inside this home on West Jackson Street. Police said the children’s mother returned home to find the baby in severe pain.

“She had some concerns because it wasn’t eating, it was vomiting and when it moved its left leg, it cried a lot,” Sgt. Cook said.

Police said it was a day later when the mother took the baby boy to IU Health Ball Memorial Hospital. Doctors performed a CT head scan and skeletal survey and found a fracture to his left tibia. They also discovered the boy had prior injuries to three of his ribs.

“The explanation given by the mother was that she sat on the baby’s leg while it was lying on the couch about a week ago,” said Sgt. Cook.

But police knew that wasn’t the case. They interviewed the boy’s mom first, then his father.

“He kept saying he didn’t know how the leg was broken, but we know that he had some problems with dealing with children and (disciplining) them,” said Sgt. Cook.

Police said the mother wasn’t charged, but she knew her children were put in danger.

“I think she was under the impression that he would never hurt this child, but the things that she told us, I was very concerned what she left him with him,” said Sgt. Cook.

Strunk is facing a charge of battery on a child under 14 and two charges of neglect of a dependent. The children are OK and have been placed in the custody of Child Protective Services.

Typical abuser daddy coddling. This guy almost killed a newborn, and he gets just 3 years (oops, 3 1/2 years) in prison. Big whoop.

In reality, a father like JACOB MORALES should have been kept away from the baby, period. Men with histories of domestic violence and "anger management" problems are very prone to become child abusers, if they aren't child abusers yet. Especially when the poor dears are pissed off at the mother as this one was.

I'm sure there are moralistic little tight @$$es who will blame the mother, but in reality she had very little maneuvering room here. Her own life would have been at risk if she left the guy, and in today's pro-fathers rights legal environment, it would have been almost certain that this creep would have got joint custody/visitation. Which would have allowed Daddy even more time to get "frustrated" and take out all his "anger management" issues on an infant.

Man who injured baby’s skull gets 3.5 years in prison.

A man who nearly killed his infant son was sentenced Tues­day to 3.5 years in prison.

When paramedics arrived at Jacob Morales’ home on May 25 they found his 12-week-old son in critical condition with a displaced skull fracture. Morales meanwhile had fled.

His wife told officers the couple had gotten into an argument earlier at Walmart. When they got home, in the 1100 block of William Tell Circle, she laid their baby in his crib and stepped outside to cool down and call her mother, according to a police report.

“Twenty minutes later, she heard the child screaming and when she went back inside and picked the child up, she noticed that the child was choking and had a head injury,” said Shawn Fuller, chief deputy county attorney, who prosecuted the case.

When she confronted Morales, he denied any wrongdoing and fled.

Officers searched for Morales for hours while doctors worked to stabilize the boy, who was airlifted to the Valley in critical condition.

Detectives learned Morales had previously been convicted of misdemeanor domestic violence and he was attending anger management classes at Southwest Behavioral. He was also on probation for a separate offense in Mesa.

The woman said she had left Morales before, but felt pressured to return to him, according to police reports.

Through text messaging, Det. Matt Van Camp convinced Morales to turn himself in the next morning.

Morales pleaded guilty to child abuse on Dec. 12.

Fuller argued for five years in prison given the age of the child, his injuries and Morales criminal record.

Judge Robert Duber II, with Gila County Superior Court, sentenced Morales to 3.5 years.

BARTOW | A 23-year-old Lakeland man was sentenced this morning to about 19 months in prison for abusing his 3-month-old son.

Jeremy Richard Miller was arrested in September 2012 after his son suffered a skull fracture and bleeding in his brain.

Police say Miller reported that his son hit his head on a door and then again at a changing table.

Under further questioning, Miller told officers that he was rocking his son when he hit him on his head, according to police.

Miller accepted a plea deal this morning with prosecutors to resolve his case. He pleaded no contest to child abuse.

Circuit Judge Catherine Combee ordered Miller to serve 3 years of probation following his prison sentence.

As conditions of his probation, Miller must undergo a mental health evaluation and follow any recommended treatment. He must also complete an anger management course.

WESTFIELD, Mass. (The Westfield News) - A father will be on probation for two years after he pleaded guilty last week to a charge of assault and battery on a child with injury. Jason D. Woody, 30, of 40 City View Boulevard, was also ordered to make no threats or violence toward the victim, his six-year-old son, and to strictly abide by all abuse prevention orders.

Westfield police became involved with the family when a five-year-old boy was treated at Baystate Medical Center after arriving with an almost completely bruised face with one eye swollen almost shut, ears which had been bruised inside and out and red marks and bruises on his back and torso.

Dets. Roxanne Bradley and Daniel Gustafson were notified of the boy’s injuries and went to the hospital. Bradley reports that when they initially spoke with the boy’s mother she appeared to be upset when she realized that there was official interest in her son’s injuries. The detective reported that the woman immediately said that she didn’t hit her son and didn’t think her husband hit him either.

Bradley said that she was told that the little boy had been beaten up on the school bus the day before. The woman said that she had slept with her son the night before because she feared he might have a concussion and had taken him to her pediatrician who referred her to the hospital.

The boy was interviewed and said that he had been hit on the bus. He denied that his injuries happened at home but said that his father had helped him clean up after the bus. Bradley reports that the bus driver said that she took particular notice of the boy when she brought him home on the day in question because his father, a stay-at-home dad, was not at the bus stop when she got there so she kept him on the bus. The bus driver said that the little boy was cheerful and showed no signs of injury while he waited for her to contact her dispatcher to obtain permission, per policy, to keep the boy on the bus and return later on her route.

She was allowed to do so but, before she could leave, the boy’s father came on the run and the boy went home with him.

When Woody was interviewed he said that his son looked like he had fallen down when he got him from the bus and said that a girl hit him. Woody said he did not want to make a fuss about the boy being punched by a girl and let the matter drop.

He also told the detectives that his son wet his pants but he said he does not spank the boy.

The detectives and a Department of Families and Children investigator were also able to interview the boy’s three-year-old sister who told them how her brother got his “boo boos”.

The girl said that her daddy squeezed her brother and gave him boo boos in the bathroom because he “peed his pants” on the bus.

Bradley reports the little girl said that “Her daddy doesn’t give her boo boos because she doesn’t pee on the bus.”

Bradley said Woody “denies and denies and denies, even after what his daughter said” but she said that the investigators had other evidence. Not only had the bus driver paid attention to the boy before she let him off the bus but the principal spoke with the other kindergarten pupils who had been seated with him that day. The principal told the investigators that the children denied there had been any physical altercation that day but said that one of the five-year-old girls acknowledged that, on the day before, she had playfully slapped the boy’s arm.

Bradley reports that the detectives completed their investigation into the boy’s injuries which were far in excess of what a five-year-old girl could have inflicted and which could not have been missed by the bus driver. She said the detectives had planned to arrest Woody but, when they went looking for him, they found he had checked himself into the psychiatric unit of a local medical facility.

Within days of the incident, Woody and his wife had agreed to DCF service plans which included stipulation that Woody “reside outside the home” and that he have no unsupervised contact with his children.

Woody was charged with assault and battery on a child with injury. When he appeared before Judge Philip A. Contant in Westfield District Court on Nov. 25, the judge found that the evidence would support a guilty finding and allowed him to plead guilty.

Woody was placed on probation for two years, ordered to comply with DCF service plans, to submit to a mental health evaluation and to complete treatment prescribed, and to complete an anger management program. He was assessed $90.

A 6-month-old baby girl is hospitalized in serious condition. A 19-year-old man is in Greene County Jail accused of shaking the infant until her brain began to bleed.

Greene County deputies Tuesday arrested Taylor Jordan Mayes, the baby’s father, after he admitted — allegedly — to losing his patience and shaking his daughter.

“I was just trying to get her to stop crying,” Mayes, of Springfield, told deputies, according to documents filed Tuesday in Greene County court.

“I shook her a few times, but not too many,” he said, according to the documents. Deputies say the father’s statements are videotaped.

Mayes allegedly said he had “really bad anger problems.” He estimated he shook the baby “seven or eight times,” the documents say.

After he shook her, Mayes reportedly told investigators, the baby had trouble breathing; she arched her back and her neck went limp.

Then, the documents say, the baby started to seize.

Prosecutors say Mayes tried to avoid law enforcement scrutiny by not calling 911 and instead driving the baby to the hospital.

At the hospital, the infant had to have emergency surgery to relieve pressure on her brain.

The baby is on a ventilator and her condition, prosecutors said today, remains “serious.”

Prosecutors say Mayes is currently on probation for several counts of theft in Lawrence County.

For now, prosecutors have charged Mayes with child abuse but have indicated the charge could be elevated depending on the evidence and condition of the child.

LINCOLN COUNTY • A father charged with one count of felony child abuse 11 months ago is now facing upgraded charges after police say he caused serious injuries to his 3-month-old daughter.

Mark Alan Bingle, 25, of the first block of Green Oaks Lane, was arrested last September after the staff at Cardinal Glennon Children's Hospital, where the child was treated, alerted police. The girl's injuries included multiple rib fractures and bruises on her left knee and back. She also showed signs of a previous right leg fracture, abnormal liver problems and eye hemorrhaging, according to court documents.

According to police, Bingle admitted to placing his daughter between his thigh and chest numerous times while forcibly squeezing her. He said he heard a noise on more than one occasion that could have been a rib or ribs breaking.

In addition, Bingle told police he pushed his baby's face down into a pillow to stop her from crying. He also threw her on a couch with enough force to cause injury, police said.

Bingle told investigators he suffered from anger and other mental issues. Bingle acknowledged he could have killed his daughter by squeezing her the way he did.

Bingle's original charge was dropped and upgraded charges of three counts of felony first-degree domestic assault causing serious physical injury and two counts of felony second-degree domestic assault were filed Monday. He currently is housed at the Lincoln County Jail in lieu of $75,000 cash-only bail.

The girl is recovering, police say, and is living with her mother.

Homestead man charged with shaking toddler to death

A Homestead man has been charged with shaking his 2-year-old son to death last week — one month after state child welfare administrators gave him custody of the toddler even though he was unemployed, living in a one-bedroom home with eight other children, had been repeatedly accused of domestic violence and had admitted to child-welfare authorities that he had “an anger issue.”

Two-year-old Jayden Antonio Villegas-Morales became the fifth Florida youngster to die since May after having already come to the attention of state child-protection administrators.

The deaths may also have claimed the job of Department of Children & Families Secretary David Wilkins, who had been Gov. Rick Scott’s longest-serving agency head.

Wilkins abruptly resigned last week amid a growing scandal over the deaths of children whose safety had already been investigated by DCF.

Jayden’s father, 28-year-old Angel Luis Villegas, was charged Sunday with second-degree murder.
Last week, before Jayden succumbed to his injuries, Villegas told Miami-Dade police he “became frustrated” with the little boy, who had been vomiting for much of the day on July 17, and “threw the victim on the bed, which resulted in [his] striking his head against the wall,” a police report says.

In an unusual move for an agency that had remained extremely tight-lipped as the child death scandal unfolded, DCF’s interim secretary, Esther Jacobo, released nearly 100 pages of records Monday, and discussed Jayden’s death openly with a reporter.

The head of DCF’s privately run foster care agency in Miami, called Our Kids, also discussed the case. “

All of the professionals involved are grieving the senseless and brutal way Jayden’s young life ended,” said a statement released Monday jointly by Our Kids and the Children’s Home Society, a group that had been involved with Jayden’s family.

“These tragedies should not happen. We are working with our partners to understand exactly what happened and what changes need to be made immediately,” the statement added.

Both DCF and Our Kids have launched a “painstaking review of every detail of what went wrong with this family,” the agencies said. “The murder of an innocent child at the hands of his father while the family was under state supervision is completely unacceptable. The review of the details of this case is gut-wrenching for all of the professionals involved.”

LONG HISTORY

Jayden and his siblings had been the subject of at least five prior investigations by DCF. An investigation last month, which resulted in Jayden being removed from his mother’s care and sent to live with his father, was not provided to the newspaper because it involved a sibling whose records are confidential, DCF said.

The Herald filed suit in Miami-Dade court Monday to obtain the records of that investigation, and Jacobo said her department would not fight the request.

The toddler’s involvement with the state appears to have begun in February 2011, with allegations that he was living in a “filthy” home overrun with cockroaches and littered with dirty diapers.

“The baby bottles are nasty and not cleaned after use,” a caller to DCF said, adding that both Villegas and Jayden’s mom, Lourdes Morales, were smoking marijuana “in front of the children.”

The investigation was closed on March 31, 2011, with an investigator concluding he could not substantiate the allegations.

But the case has an odd asterisk: The DCF investigator, Jean Lacroix, was arrested a year later on charges that he was pimping out foster children assigned to his care as part of a sexual trafficking ring.

Lacroix’s supervisor in the case, Duray Smith, resigned in May after the Herald reported he had been moonlighting as a substitute teacher — sometimes on the same days he was working at DCF — without seeking the approval of the department.

For several months, Jayden lived with both Villegas and Morales in an unusual Homestead household: Villegas was living with his girlfriend, 24-year-old Guadalupe Jaramillo, with whom he was expecting a child, and her four children. Morales was living in the home with the couple, and was expecting her fourth child with Villegas.

When an investigator arrived at the home, Jaramillo at first identified herself as Villegas’ sister.

ABUSE

Villegas had been repeatedly accused of abusing Morales, and in April, he was charged with domestic battery after he allegedly “grabbed” Morales “violently, causing injury to her right arm,” according to a Florida City police report.

Prosecutors dropped the charges against Villegas on the same day he is alleged to have attacked Jayden, however, when Morales could not be located, records show.

Villegas acknowledged to a DCF investigator in March 2012 that he had “an anger issue and wants counseling.” It is unclear whether Villegas ever received the treatment, however, when the March 2012 investigation was closed.

“We are really saddened, and pretty upset about this child’s death,” said Jacobo. “There were a lot of missed opportunities in this case.”

An earlier version of this story incorrectly reported the manner in which Duray Smith, a former DCF supervisor, left the agency. Smith resigned in May.

FREMONT — An area man was sentenced to five years probation Wednesday for spanking his 10-year-old son with a belt.

Lindsey resident Carlos Molina, 36, accepted a deal and pleaded guilty to attempted endangering of children, a fifth-degree felony, before Sandusky County Common Pleas Judge John Dewey.

Molina was initially charged with third-degree felonious child endangering and fourth-degree domestic violence.

Court documents show Molina is currently enrolled in an anger management treatment. Dewey ordered Molina to complete that treatment as well as 50 hours of community service and parenting classes on dealing with a child who has autism.

Violation of sentencing terms will result in an 11-month prison sentence.

Last July, Molina dropped off his son at the boy’s mother’s house after visitation, according to an incident report. The woman reportedly noticed a large welt on the left side of her son’s face. She checked the rest of the boy’s body and reportedly found marks on his legs and back.

She told police her son said his father spanked him with a belt. The woman reportedly called Molina to find out what had happened.

“That kid is out of control,” Molina allegedly told the woman. “He hurt my dog and was hitting his younger brother.”

The woman notified authorities and the Sandusky County Sheriff’s Office investigated the complaint.

SACRAMENTO, CA - Three weeks ago, Alias McLaughlin was a new father. Now, he's a suspect in his baby's death.

"I was actually accused of murdering my own little girl and now, well, here I am," McLaughlin said from Sacramento County Jail.

Sacramento police believe McLaughlin violently shook and threw his newborn daughter last Friday after the baby woke up crying. In a jailhouse interview, McLaughlin said he never hurt his daughter, but was trying to stop her from choking on milk.

"We [the child's mother and McLaughlin] specifically saw her aspirate with milk in her throat," said McLaughlin. "But they're telling us there was no milk or fluid in her lungs."

At one point, McLaughlin said his daughter started gasping for air.

"I didn't know what to do. I was going out of my head. I was freaking out. So I went outside to have a cigarette and talked to my girlfriend, and she said we should call 911."

McLaughlin said he didn't want to wait for paramedics, so he performed CPR on his daughter three times. When the little girl finally arrived at UC Davis Medical Center, she wasn't breathing and appeared to have injuries. Doctors called police.

The coroner's report says the baby died of blunt force trauma to her head.

McLaughlin's girlfriend also told police it was McLaughlin who shook their child and threw her down on the ground. When she tried to protect their daughter, she claimed McLaughlin attacked her.

From jail, McLaughlin said he never hurt his child, but does admit to shoving his girlfriend.

"I was going like that, grabbing her and pushing her, 'Why were you not giving her the bottle?'" McLaughlin said he yelled at his girlfriend while the baby was crying.

McLaughlin says he attended anger management classes in the past.

News10 efforts to reach the baby's mother at the home the couple shared were unsuccessful.

McLaughlin faces murder charges for his daughter's death, but says he doesn't understand what happened that night or what he could have done differently.

"I didn't mean to do anything. I just wanted to take care of her," he said. "That's all. That's all I wanted to do was take care of my daughter."

McLaughlin wears a padded suit for his own protection and has seen a psychiatrist while in jail, according to officials.

Mom is very lucky that she was able to move away, and is (apparently) not being required to "co-parent" with this thug after he gets out of jail in 18 months.

Father sentenced for abusing his infant child

A Charlotte Hall man has been sentenced to 18 months in jail for the second degree assault on his infant son. Jacob Wilkins, 20, was sentenced Wednesday in St. Mary’s County Circuit Court by Judge Michael Stamm. Wilkins also has a Waldorf address in court records.

Wilkins was indicted on charges of Child Abuse/2nd Degree – Custodial and Assault-Second Degree. A warrant for his arrest was served on February 23, 2012. He pled guilty to the second degree assault charge on January 25 of this year.

Deputy State’s Attorney Julie White told the judge than the child, who is now 20 months old, obviously could not testify as to what happened to him. She said the child was taken to Children’s Hospital when he was just one month old. The child had several fractured ribs and a broken leg. “Punishment will never be enough to take back what he (Wilkins) has taken from his family.”

White said, “He has an incredible anger problem.” She added, “In a fit of anger he broke his son’s leg. That requires an incredible amount of force.”

The victim and his mother have since moved out of the area.

Wilkins’ attorney, Public Defender Gerald Riviello said neither parent (the mother is now 17) was prepared for parenthood. He said the event came “out of ignorance” not anger. “I don’t think it was horrific,” he said. The attorney noted his client had taken responsibility and enrolled in a parenting class but said counselors felt he didn’t need anger management classes.

Wilkin’s father, Henry, testified at the sentencing hearing that he couldn’t believe his son did what he was charged with. He said, “He is not denying something happened. He is not an angry person.” He added, “I really don’t believe there was any intent for this child to be hurt.”

Wilkin told the judge, “I have never been an angry person. I have always been a shy guy.” He said in talking to police he changed his story, “because I was scared to death.” He testified he picked up his son and didn’t know how the injuries occurred.

The judge listened to Wilkins intently and then said, “Never once did you mention your child. Everything was about you. As a father the center of your universe is your child.” The judge said when he looked at pictures of Wilkins’ son, “I see a darling child. I see a baby.”

The judge’s sentence was five year in the Department of Corrections, suspended to 18 months in the county jail so he can have work release and continue to support his son, which testimony indicated he had been doing. Also the judge ordered that one-thirds of his salary go to support the child. He will be on five year’s supervised probation after he is released.

Dad gets 10 years for abusing infant daughter during weekend visitation (Wellford, South Carolina)

No explanation here as to whether this weekend visitation plan was court-ordered. But the research is quite clear. Babies do not benefit in any way, shape, or form by being subjected to visitation plans, especially overnights and weekends. Babies like consistent care giving, which is one reason they are more likely to become "fussy" when traded around like a hot potato. Too many men just cannot deal with a crying infant...that's why fathers and boyfriends dominate as perpetrators of abusive head trauma. 

The idea that a never married father should have weekend visitation with a baby is a fathers rights notion that has long outlived any usefulness. It belongs in the dust pan of Bad Ideas.

Truck driver under pressure snapped

A Wellford man admitted to shaking his infant daughter after he “snapped,” causing a life-threatening brain injury from which the child is still recovering.

James N. Davis Jr., 28, of 26 Springbrook Court, pleaded guilty Friday to felony child abuse inflicting great bodily injury.

Circuit Judge Derham Cole imposed the maximum 20-year sentence, suspended upon the service of 10 years and 5 years’ probation.

Davis said in court that he and the infant’s mother, Amy Owensby, had separated and he kept their child, Cheyenne, on the weekends.

Davis said on Aug. 17, Owensby told him that Cheyenne had been “fussy” that week. Davis said after dinner, he took Cheyenne to his home, laid her down and shut a door after she began crying.

He said she began screaming about half an hour later. He said he tried comforting her, but she continued to cry. He said that, along with other pressures he faced, pushed him over the edge.

“All that came crashing down. … I snapped. There’s no reason for it. I don’t know why I did it,” Davis said.

Seventh Circuit Assistant Solicitor Jennifer Jordan said in court that Davis called 911 dispatchers shortly before 7 p.m. and reported Cheyenne wasn’t breathing.

Jordan said the baby could be heard gasping for breath in the 911 call. Jordan said Davis gave two statements to officers. Davis initially claimed he did not know what happened to his daughter.

In a second statement provided on Aug. 18, she said Davis stated that he tried bouncing, swaying and rubbing the infant’s head, but could not calm her down. Davis stated that he yelled at Cheyenne, asking why she had to be that way, Jordan said, before shaking her with such force that her jaw chattered three times and she began breathing heavily.

Jordan said Cheyenne was a perfectly healthy child broken in a moment of anger.

Cheyenne was unresponsive when an officer arrived at Davis’ home, according to a Spartanburg County Sheriff’s Office incident report.

She was taken by helicopter to Greenville Memorial Hospital for treatment and spent a little more than two hours in surgery for brain injuries she sustained.

Cheyenne remained in the hospital for a month. One month after she was released, she was readmitted for another operation.

Jordan said Cheyenne has made “significant improvements” and is now eating. A feeding tube she has soon might be removed, Jordan added.

Yet, she still suffers. One side of her body has been affected. Jordan said that due to her young age, 16 months, the permanent physical, emotional and mental impacts are unknown and there’s no definite prognosis. Cheyenne continues to receive therapy and visit doctors.

 Davis’ attorney, Timothy Ray, said Davis was a truck driver when the incident occurred and had worked 120 hours in the two weeks leading up to the incident.

“He told me he wanted to be Superman,” Ray said of Davis’ long work hours and determination to care for his daughter without others’ help.

Ray said Davis has suffered with guilt and is remorseful for a “split-second decision” that resulted in horrible consequences.

“What has hurt him the most is the struggles that his daughter has gone through,” Ray said.

Davis had no criminal record prior to abusing his daughter.

“This was something that was completely out of character,” Ray said.

Ray said that although Davis didn’t immediately confess, he did not hide his actions and immediately called 911.

No victims addressed the court. Owensby was in the courtroom with several supporters. Davis’ family also was there.

Davis’ voice cracked at times as he addressed Cole before sentencing.

Davis said he prays every night that God will heal and protect his daughter and that she won’t suffer for what he’s done.

“I love her so much,” Davis said.

He said he cried for hours after receiving a photograph of his daughter.

He also told Cole that upon learning he could possibly have supervised visitation if he completes parenting classes, anger management and other requirements, has a “glimmer of hope” that his daughter will forgive him and some day might be a “daddy’s girl.”

After the hearing, Jordan said, “I just hope that Cheyenne continues to improve.”

Those who love the toddler are certain she will.

“She’s a very determined baby who’s not going to give up fighting. She’ll fight to the end,” said Kandy Cannon, a family friend and Cheyenne’s “adopted aunt.”

Cannon said Cole’s ruling was fair, and justice was served.

Owensby would not comment.
