Custodial dad gets 40 years for murder of 2-year-old son (Searcy, Arkansas)
The "ex-girlfriend" mentioned towards the end is not the mother of the murdered child. According to one of our earlier posts, the mother lived elsewhere. In other words, killer dad JEFFERY CLIFTON was custodial.

SEARCY, Ark. (KTHV) – The Searcy father accused of killing his two-year-old son, Malik Drummond, received a sentence of 40 years in prison on Friday.
Attorneys struck a deal for a lower sentence and Jeffery Clifton took advantage of it. Clifton avoided a murder trial, and the possibility of a life sentence or death penalty.
He was charged back in December 2015 with capital murder and abuse of a corpse.
On Friday, he pled ‘no contest,’ settling for two consecutive sentences, adding up to 40 years in the Arkansas Department of Corrections.
He agreed to a second degree murder charge and abuse of a corpse.
“It's treated as a guilty plea for purposes of the law,” said Ronald Davis Jr., defense attorney. In the eyes of the court, he's found guilty, but he's not saying he did anything wrong.
“He's not admitting or taking responsibility for those actions in terms of if he actually committed them or not,” said Davis.
Prosecutor Rebecca McCoy and Davis struck a deal.
“He admitted that we had enough evidence to find him guilty,” said McCoy.
Two-year-old Malik Drummond disappeared November 23, 2014.
Hundreds of people statewide joined in on the search.
“The whole community was involved and got emotionally involved in this case,” said McCoy.
Clifton was arrested a year later in December 2015.
The only thing he admits to is burying Malik’s body in rural Jackson County.
“There’s a difference in disposing of a body and causing the death of a body,” said Davis.
McCoy satisfied with the settlement, but doesn't want this case to be forgotten.
“I hope that it's not the end. I hope the community is always aware of child abuse and hopefully can step in and prevent things like this from happening in the future,” said McCoy.
Clifton will be eligible for parole, but details as to when are unknown at this time.
His ex-girlfriend, Leslie Marcotte was also arrested and charged with helping covering up Malik’s death.

Protective mom files lawsuit against custodial dad for "missing" toddler (Waterville, Maine)
Not made clear in this particular article, but dad JUSTIN DIPIETRO had custody. Interesting coincidence that according to this article, the protective mother had filed for custody just two days before the little girl "disappeared." Seems Daddy also had previous issues with domestic violence, alcohol, assault charges , and probable child abuse. All huge red flags.

The family of a Maine toddler who went missing five years ago plans to sue the father and other adults who were with her when she was last seen.

The body of 3-month-old Janna Rivera still is missing three months after the Indianapolis child’s disappearance triggered searches through three counties and various explanations from the girl’s father.
But the person accused of killing Janna has now been charged. Jeffrey D. Fairbanks, the father whose accounts, according to court records, changed from not remembering much of May 28 to saying he picked up a lifeless body to admitting to putting a pillow on his crying daughter’s head, was charged Friday in Marion Superior Court with murder and neglect of a dependent resulting in death.
Her body has not been found.
"We are alleging that she is dead and he knowingly killed her," Marion County Deputy Prosecutor Denise Robinson said.
When asked why it took three months for charges to be filed, Robinson said prosecutors needed time to assess all the statements and evidence.
The absence of an autopsy report could pose a challenge for prosecutors in proving what caused the infant's death.
"There's a considerable amount of things we need to prove," Robinson said.
Police said they were called May 29 to a Northeastside home in the 4100 block of Candy Apple Boulevard after the infant’s mother, Yolanda Rivera-Gonzalez, called 911 to report her baby’s disappearance.
Police interviewed Fairbanks, who told detectives various stories.
He first said he couldn't remember anything about May 28.
Then, according to a probable cause affidavit, he said, "I don't wanna go to jail."
Ultimately, he told police, "let's go," signaling to them he would show them where he left the baby, the affidavit said.
The next day Fairbanks, 45, took police to a dumpster at Maison Garden Apartments on the Northeastside.
"I picked her up, and she wasn't movin' anymore," the affidavit said Fairbanks told police.
The dumpster, though, was nearly empty, the affidavit said, leading to a search of a landfill on the Southside.
Back at a police station, detectives questioned Fairbanks again.
He told police he woke up at 5:30 a.m. that day because the child was crying. He said he "muffled" her with a pillow but denied putting pressure on the pillow, the affidavit said.
Fairbanks said later that morning he noticed the baby wasn't moving and took her to the dumpster, the affidavit said.
He told his wife he buried the child in a cornfield and placed a cross at the burial site, the affidavit said.
One of the children in the home told police Fairbanks would sometimes cover the baby with a pillow when she cried.
Over the next few months investigators chased leads throughout Shelby, Hancock and Marion counties, searching fields, landfills and other undisclosed locations to no avail.
The mother of Janna said her relationship with Fairbanks had turned violent about two years ago, according to a personal protection order she filed in June. Rivera-Gonzalez alleges that Fairbanks would beat her at least once a month, leaving her scarred, bruised and afraid that she and her children were not safe when he was around.
Rivera-Gonzalez also alleges in the personal protection order that Fairbanks admitted to burying their daughter while she was at work.
He said that Janna died while he was watching her and Rivera-Gonzalez's two older children, according to the order.
The order is one of two active protection orders filed against Fairbanks.
The other, filed in June 2013, is associated with a charge of domestic battery that Fairbanks is facing in Hendricks County. Fairbanks is being held without bond in the Marion County Jail.
Judge Sheila Carlisle entered a not-guilty plea on his behalf.
A public defender has been assigned to his case.

The father of missing 6-month-old California baby Ember Graham was shot and killed in an officer-involved shooting on Monday morning, the Siskiyou County Sheriff’s Department confirmed on Facebook.
Matthew Graham, 24, was spotted by police while traveling in a vehicle he was suspected of carjacking. Graham eventually fled the vehicle, and shots were exchanged between him and officers who were attempting to take him into custody, CNN affiliate KRCR-TV reported.
#The shooting occurred around 7:45 a.m. in Dunsmuir.
On Saturday, authorities issued an arrest warrant for Graham on charges of being a felon in possession of a firearm and a felony probation violation order. Police alerted the public that Graham should be considered “armed and dangerous.”
Graham made headlines following the recent disappearance of his 6-week-old daughter Ember Graham. The baby girl was reported missing from her father’s home in Happy Valley on the morning of July 2. Graham called 911 just before 5:30 a.m. and said he last saw his daughter around 10:30 p.m. the night before and when he woke up the next morning, Ember was missing from her crib.
Police reported that Graham gave investigators several inconsistent statements surrounding his daughter’s disappearance. Authorities also said he “showed very little remorse for the disappearance of his daughter.”
The day after he reported Ember missing, Graham was booked into the Shasta County Jail for a felony probation violation. He was released from custody on Wednesday.
The Los Angeles Times previously reported Graham fled on Saturday after authorities told his relatives that they discovered a pacifier along a roadway in the Ono area.
That same day, police said Graham failed to report to the probation department as required.
Graham’s mother then reported to authorities that her son stole her cellphone, cash and a semi-automatic handgun from her purse.
Graham was never charged with any crimes related to the disappearance of his daughter. #Following Graham’s death, investigators say they have little hope of finding Ember alive.
“He was the only person who last saw baby Graham and we believe knew the whereabouts of baby Graham,” Shasta County Sheriff Tom Bosenko said Monday, the Los Angeles Times reported. “Unless this investigation finds a note or some documentation that he left behind…we may not be able to ever find her.”
Approximately 70 searchers and K-9 teams were in the area of Ono on Sunday searching for Ember.

Sheriff's office planning 'additional actions' in criminal investigation

Two years and two days after her son's partial remains were found on Middle Mountain, Elaine Hatfield Redwine filed a wrongful death lawsuit against her ex-husband, Mark Redwine.
Hatfield filed the complaint for wrongful death and loss of consortium on Monday, June 29, in District Court in Durango.
The complaint said their son, Dylan Redwine, was visiting his father on a court-ordered visit on Nov. 18, 2012, when he disappeared. A massive search ensued, involving community members and local, state and federal investigators. On June 27, 2013, some of Dylan's remains were found approximately three miles from Redwine's home in Vallectio.
A parent in Colorado has the duty to provide proper parental care for a child, the lawsuit states. Mark Redwine breached that duty "when his conduct resulted in the death of their son, Dylan Redwine," the suit stated.
It continues, "the death of Dylan Redwine was the proximated and direct result of the negligence of defendant."
#Hatfield also has suffered the loss of consortium with her son and suffered damages from that, the suit stated.
In the lawsuit, Hatfield asks that she be compensated for damages, costs and fees, and she also requested a 12-member jury if the suit should go to trial.
The criminal investigation into Redwine's disappearance also is continuing, according to Lt. Dan Bender, a spokesman for the La Plata County Sheriff's Office.
"I have no new information to release at this time," Bender wrote in an email response to a request for an update on the case. "However, there are several activities that have taken place recently and investigators are putting a lot of effort forward and planning additional actions in the coming weeks."
Dylan Redwine, who was 13 when he disappeared, was on a court-ordered visit with his father for Thanksgiving in 2012. Mark Redwine lives on County Road 500 north of Vallecito. Dylan was raised in Bayfield and had moved that summer with his mother to Monument, near Colorado Springs. Law enforcement confirmed that Mark Redwine picked up his son at the La Plata County Airport on the evening of Nov. 18, they went to Wal-Mart and McDonald's in Durango, and that Dylan was at his father's house that evening. He texted some friends in Bayfield that night and made arrangements to meet with them the next day. The next morning, Mark Redwine told investigators he had to do some errands in Durango, and his son wouldn't wake up, so he left him sleeping on the couch. Redwine said when he returned that afternoon, Dylan was not home. He contacted his son's friends, who said they hadn't seen him, then he texted his ex-wife, asking if she had heard from home. She contacted the Bayfield Marshal's Office.
Hatfield, fiancee Mike Hall and her eldest son, Cory Redwine, then left the Front Range for Bayfield and began searching for Dylan, joined by family friends and numerous community volunteers.
Law enforcement joined in a few days later. At the height of the search, local police and sheriff's agencies, the Colorado Bureau of Investigation and the Federal Bureau of Investigation were involved.
No trace of him was ever found until some of his remains, reportedly bones from his foot, were discovered 18 months later by police and volunteers searching Middle Mountain. They were often on their hands and knees and using ropes to climb in the steep terrain.
Elaine Redwine, who now uses her maiden name, previously blamed her ex-husband for their son's death.
In November of 2013, before a memorial service for her son was held at Pine Valley Church, she said she thought Mark Redwine had killed Dylan.
"Yes, I always have from day one, when he was missing," she said in an interview with the Times. "Those who know me, who knew Mark, who knew my boys, knew that as well."
The complaint was filed by Amber Harrison of Durango, who has been Hatfield's attorney since 2008 and handled her divorce.
"I cannot comment on any other specific details, other than those in her complaint," Harrison said. But if more information becomes available from investigators, "we will certainly be amending or modifying the complaint."
Reached on his cell phone on Wednesday afternoon, Mark Redwine said he had not heard about the lawsuit.
"Good luck with that," he said. "We'll all see how it turns out for her."
Redwine said he was not in Vallecito, but declined to say where he was.
"Don't bother asking me, and I have nothing more to say to you," he said before hanging up. "Have a nice day."

A parent in Colorado has the duty to provide proper parental care for a child, the lawsuit states. Mark Redwine breached that duty "when his conduct resulted in the death of their son, Dylan Redwine," the suit stated.
It continues, "the death of Dylan Redwine was the proximated and direct result of the negligence of defendant."
#Hatfield also has suffered the loss of consortium with her son and suffered damages from that, the suit stated.
In the lawsuit, Hatfield asks that she be compensated for damages, costs and fees, and she also requested a 12-member jury if the suit should go to trial.
The criminal investigation into Redwine's disappearance also is continuing, according to Lt. Dan Bender, a spokesman for the La Plata County Sheriff's Office.
"I have no new information to release at this time," Bender wrote in an email response to a request for an update on the case. "However, there are several activities that have taken place recently and investigators are putting a lot of effort forward and planning additional actions in the coming weeks."
Dylan Redwine, who was 13 when he disappeared, was on a court-ordered visit with his father for Thanksgiving in 2012. Mark Redwine lives on County Road 500 north of Vallecito. Dylan was raised in Bayfield and had moved that summer with his mother to Monument, near Colorado Springs. Law enforcement confirmed that Mark Redwine picked up his son at the La Plata County Airport on the evening of Nov. 18, they went to Wal-Mart and McDonald's in Durango, and that Dylan was at his father's house that evening. He texted some friends in Bayfield that night and made arrangements to meet with them the next day. The next morning, Mark Redwine told investigators he had to do some errands in Durango, and his son wouldn't wake up, so he left him sleeping on the couch. Redwine said when he returned that afternoon, Dylan was not home. He contacted his son's friends, who said they hadn't seen him, then he texted his ex-wife, asking if she had heard from home. She contacted the Bayfield Marshal's Office.
Hatfield, fiancee Mike Hall and her eldest son, Cory Redwine, then left the Front Range for Bayfield and began searching for Dylan, joined by family friends and numerous community volunteers.
Law enforcement joined in a few days later. At the height of the search, local police and sheriff's agencies, the Colorado Bureau of Investigation and the Federal Bureau of Investigation were involved.
No trace of him was ever found until some of his remains, reportedly bones from his foot, were discovered 18 months later by police and volunteers searching Middle Mountain. They were often on their hands and knees and using ropes to climb in the steep terrain.
Elaine Redwine, who now uses her maiden name, previously blamed her ex-husband for their son's death.
In November of 2013, before a memorial service for her son was held at Pine Valley Church, she said she thought Mark Redwine had killed Dylan.
"Yes, I always have from day one, when he was missing," she said in an interview with the Times. "Those who know me, who knew Mark, who knew my boys, knew that as well."
The complaint was filed by Amber Harrison of Durango, who has been Hatfield's attorney since 2008 and handled her divorce.
"I cannot comment on any other specific details, other than those in her complaint," Harrison said. But if more information becomes available from investigators, "we will certainly be amending or modifying the complaint."
Reached on his cell phone on Wednesday afternoon, Mark Redwine said he had not heard about the lawsuit.
"Good luck with that," he said. "We'll all see how it turns out for her."
Redwine said he was not in Vallecito, but declined to say where he was.
"Don't bother asking me, and I have nothing more to say to you," he said before hanging up. "Have a nice day."

The mother of three Michigan boys who have been missing since Thanksgiving 2010 has said that she now believes that her sons are dead.
Tanya Zuvers, 48, said she's hanging on to a sliver of hope, but she's almost certain Tanner, Alexander and Andrew Skelton are dead.
The boys were last seen at their father's home in Morenci, near the Michigan-Ohio border. Tanner was 5, Alexander was 7 and Andrew was 9. They would now be 9, 11, and 13, respectively.
Their father, John Skelton, pleaded no contest to unlawful imprisonment and is serving ten to 15 years at the Bellamy Creek Correctional Facility in Ionia, Michigan.
He maintains he didn't harm his children and could be released in 2020.
The boys' disappearance led to a large search in Ohio and Michigan. Investigators said they're still following up on new tips.
Zuvers told The Toledo Blade that she knows she'll be reunited with her boys in heaven.
'I know where they are,' Zuvers said. 'I know we will be reunited forever in heaven. That is something he (John Skelton) can never take away from us.'
Zuvers and Skelton were reportedly going through a divorce at the time of the disappearance.
The boys' father was the last person to see the boys, police said.
Michigan State Police Sgt Jeremy Brewer visits Skelton regularly attempting to get answers regarding tips he's received, but he' has been unsuccessful.
'It's still unsolved, so he's not giving me details,' Sergeant Brewer said of Skelton.
'He holds all the keys. His cooperation has not reached the point of any truth,' he added.
Zuvers told the Blade that over the last two years she's come to the realization that her children have died.
The first year was 'a nightmare' for the mother of three', family friend Kathye Herrera told the blade.
'It would be for all of us in the same (situation). She withdrew herself, didn't get out of the house. But each year she's had growth. Time doesn't erase it, but it helps you heal,' she said.
The disappearances of the boys remain unsolved.
Age progression photos for the three boys have been released more than once by the National Center for Missing and Exploited Children in hopes of finding them if they are still alive.

Custodial dad charged with probable cause 2nd-degree homicide in murder of 10-year-old son; non-custodial mom in state of "disbelief" (Crystal, Minnesota)
Finally it is revealed that this little boy indeed had a real mother--referred to here (rather condescendingly) as a "biological mother." And that her name was Louise.
My heart goes out to you, Louise. And to all the mothers who lose their children to abusive fathers.

CRYSTAL, Minn. - Authorities have taken Barway Collins' father into custody from his residence in Crystal.
Crystal Police confirmed early Monday afternoon that Pierre Collins was arrested on probable cause second degree homicide. He was transported from his apartment to the Crystal Jail then to Hennepin County Jail. Investigators will work with Hennepin County prosecutors to prepare formal charges.
According to the County Attorney's Office, charges will come no sooner than Tuesday afternoon. They must charge Collins by Wednesday at noon or release him.
At a press conference on Sunday, Crystal Police Chief Stephanie Revering said Pierre Collins is their primary suspect in the case.
Pierre has maintained his innocence throughout the investigation.
The Hennepin County Medical Examiner confirmed the body found in the Mississippi River Saturday afternoon was that of Barway Collins. The 10-year-old boy had been missing for nearly four weeks.
For some members of Twin Cities Liberian community, the arrest was a relief.
"I have never supported him," said Horace Gbanoe. "It was obvious. The little boy said, "That's my dad and my uncle." Those two were the last to see him."
Horace Gbanoe is referring to the video of Barway Collins on his school van just before he disappeared.
Pierre Collins has insisted he never saw Barway that afternoon and had nothing to do with his disappearance.
Crystal Police have said all along that he's lying. And that they have electronic evidence placing him near the spot Barway's body was found -- back on the day he disappeared.
Finally, 20 days after first calling Pierre a suspect, they arrested him.
"This is very strange for our community, that a father is being arrested for the death of his son. That is heartbreaking," said Magdalene Menyongar.
Many Liberian-Americans like Menyongar refused to believe a father in their community could do such a thing.
Larry Thomas wants everyone to know this tragedy affects many people beyond the Liberian community.
"Everybody is taking this personal. Especially people with kids," Thomas said. "This name is in everybody's household right now."
But perhaps no one's household more so than Liberian community members who now are calling for Justice for Barway.
"If he's the one who killed this boy, I believe in the justice system in America. He will be held accountable," Menyongar said.
"The full weight of the law to be applied, as quickly as possible," Gbanoe said.
Meantime, members of the Liberian Ministers Association of Minnesota say they're trying to help Barway's biological mother -- Louise Karluah -- travel from Liberia to attend Barway's funeral.
"We will see how much we can raise to help Louise come over," said Rev. Alexander Collins, executive director of the association.
"She's in disbelief. Trying to make sense out of all of this," he added.
Friends at Barway's school -- Evergreen Park World Cultures Community School -- understand.
"Everyone is grieving, staff, students, families. And so we are here to support all of them," said school principal, Sheryl Ray, adding that 15 extra staff members -- many of them social workers -- were on hand Monday to assist students.
She described Barway as: "[he] always had a great smile. He enjoyed what he was doing. He had many friends."
"[We will] grieve for some time. But hopefully find strength, too, in the memories that they do have," she said.

Dad "suspected" in death of 10-year-old son was abusive and CUSTODIAL (Hennepin County, Minnesota)
This is kind of confusing. Who is the actual mother of the little boy? Wife #2 apparently has sole custody of the two biological children she had with suspected killer dad PIERRE COLLINS. She also apparently has custody of two kids from "a previous relationship that Pierre adopted." A previous relationship of Wife #2 or a previous relationship of Pierre? Not real clear, but then the article goes on to say that Pierre would not let her adopt the little boy who is now dead. So she was not the biological mother. Meaning that Pierre was the custodial dad?
Wouldn't be surprising as his history of domestic violence and child abuse is very common among fathers who attain custody. And notice how he was pissed off about child support....
Does make me wonder what happened to the boy's mother though. An awful lot is not explained here....

(KMSP) - Saturday afternoon, investigators confirmed Jennifer Beaver's worst fears. The body pulled from the Mississippi River was of a 10-year-old boy she helped raise.
“He's not my former stepson, he's my son,” Beaver said. “I took care of him, I nurtured that little boy, I tucked him in. I was his mommy.”
On March 18, the day Barway Collins went missing, Pierre Collins was at a court hearing that Beaver was teleconferenced into.
“Pierre was ordered that day to pay child support,” she said. “The judge was not lenient on him that day at all. The day was very hard on him and he was angry.”
Divorced now for more than a year, Beaver has sole custody of their 4 children -- 2 biological and 2 others from a previous relationship that Pierre adopted. But Beaver said Pierre would not allow her to adopt Barway.
Beaver filed an order for protection against Pierre Collins in 2013 after she says he hurt her children. The order expired just days before Barway disappeared.
“I recall (Pierre) hitting (Barway) with a belt, not just a couple times -- we're talking 10 times if not more,” Beaver said. “We're talking hitting him in his head anytime he got an answer wrong on his homework. He was abusive of my children, abusive towards me.”
Police said they have electronic evidence that places Pierre Collins near the very spot Barway's body was found. Beaver and her sister, Talisha, are now waiting for word of an arrest or two, since the last we heard from Barway was his sighting of his dad and his “uncle.”
“There's somebody else who helped him with this and that person needs to be found,” Talisha said.
They also wonder about Yamah, Pierre's current wife, who has stood by her husband as the story about her his whereabouts March 18 changed multiple times. “She sat right next to him while he told that story, and she nodded and everything," Talisha said. "She lied too.”
Beaver mourns, and even worries about the 2 small children still under Pierre and Yamah's care.
“They're innocent kids, but if he can hurt my children, if he can hurt Barway, he can hurt them as well,” Beaver said.

"Missing" 3-year-old boy found dead in home of custodial father (Hollywood, Florida)
As often happens, a careful reading reveals that dad NELSON OSCEOLA is apparently custodial, though custody issues are buried here under lots of confusing prose. This is typical. Utterly unexplained here is why this little boy lived with his father and who was responsible for this custody decision. Florida has generally led the US in terms of fathers on the Killer Dads and Custody list.

A 3-year-old boy whose body was found in his father's Hollywood home Thursday night will be buried at the Big Cypress Seminole Indian reservation in Clewiston once it is released by the Broward Medical Examiner's Office, a family member said..
The death of Ahizya Osceola — whose body was discovered in an "obscure" place in a house on the 5400 block of Johnson Street — is the subject of a "criminal investigation until proven otherwise," Hollywood Police Chief Frank Fernandez said in a Friday morning press conference.
No one was in custody midday Friday and family members were cooperating with police, the agency said.
Ahizya Osceola was the son of Nelson Osceola, who lives at the home with his wife and two other children, and Karen Cypress, who lives elsewhere in the city. Cypress is a homemaker and cares full-time for her 18-month-old twins, a boy and a girl, said her father, Kenneth Tommie.
She had made a tearful public plea Thursday for the safe return of her son.
"Please, please call the police department, so I can have my baby back," Cypress said at a news conference. "He's my heart, he's my life. I don't know what I would do…I just want him home." Osceola said Thursday he last saw his son at 4 a.m. when he went to check on Ahizya's 8-month-old sister. When Osceola left for work at about 7:30 a.m., his wife was awake and Ahizya was still sleeping, he said.
Osceola stayed in contact with his wife until about 9 a.m., when she fell asleep with the baby.
"She woke up and he was gone," said Osceola, who learned about his son's disappearance in a text message from his wife. "I just want to see my son."
The child's parents are members of the Seminole Tribe of Florida, and family members gathered around Karen at her home Friday to support her, Tommie said.
"She is waiting on a phone call from the lead investigator about when they will release the body," Tommie said. "He will have a regular funeral [at the reservation], but they will do Indian medicine after."
Tribal members "are sad," said Gary Bitner, a spokesman for the Seminoles. "Everybody's sad. It's a terrible tragedy."
Fernandez said he felt "heartfelt sorrow" that his officers' "exhaustive search" did not end with the child's safe recovery.
Though bloodhounds were used around the exterior of the home, the dogs did not search inside, Fernandez said.
The incident began at 11:48 a.m. Thursday when Seminole police called Hollywood police to report that the child was missing from the house, Fernandez said. #The toddler's body was found about 12 hours later.
In the hours in between the report of the child's disappearance and the tragic discovery, Fernandez said a "two-to-three square mile area" was searched by his agency with the help of the Broward Sheriff's Office and Community Emergency Response Team volunteers.
At 5 a.m. Friday, a physician from the Broward Medical Examiner's Office was called and as the sun rose, the agency's SUV and two crime scene investigation trucks were parked in front of the single-story white house. Yellow police tape enveloped the home as well as neighboring properties. Citing the investigation, the police chief would not say where the body was found and would not describe whether the child had experienced any trauma.
"We are interviewing anyone who had access to the household," Fernandez said. "Part of the investigation is, how did we find the child deceased? Why did he end up in the condition that he ended up in?"
Mayor Peter Bober called the child's death "a real tragedy for the family and definitely a loss for the city of Hollywood."

Early Friday morning Hollywood police said the public's help was no longer being sought in searching for a 3-year-old boy who had been reporting missing.

A 3-year-old boy whose body was found in his father's Hollywood home Thursday night will be buried at the Big Cypress Seminole Indian reservation in Clewiston once it is released by the Broward Medical Examiner's Office, a family member said..
The death of Ahizya Osceola — whose body was discovered in an "obscure" place in a house on the 5400 block of Johnson Street — is the subject of a "criminal investigation until proven otherwise," Hollywood Police Chief Frank Fernandez said in a Friday morning press conference.
No one was in custody midday Friday and family members were cooperating with police, the agency said.
Ahizya Osceola was the son of Nelson Osceola, who lives at the home with his wife and two other children, and Karen Cypress, who lives elsewhere in the city. Cypress is a homemaker and cares full-time for her 18-month-old twins, a boy and a girl, said her father, Kenneth Tommie.
She had made a tearful public plea Thursday for the safe return of her son.
"Please, please call the police department, so I can have my baby back," Cypress said at a news conference. "He's my heart, he's my life. I don't know what I would do…I just want him home." Osceola said Thursday he last saw his son at 4 a.m. when he went to check on Ahizya's 8-month-old sister. When Osceola left for work at about 7:30 a.m., his wife was awake and Ahizya was still sleeping, he said.
Osceola stayed in contact with his wife until about 9 a.m., when she fell asleep with the baby.
"She woke up and he was gone," said Osceola, who learned about his son's disappearance in a text message from his wife. "I just want to see my son."
The child's parents are members of the Seminole Tribe of Florida, and family members gathered around Karen at her home Friday to support her, Tommie said.
"She is waiting on a phone call from the lead investigator about when they will release the body," Tommie said. "He will have a regular funeral [at the reservation], but they will do Indian medicine after."
Tribal members "are sad," said Gary Bitner, a spokesman for the Seminoles. "Everybody's sad. It's a terrible tragedy."
Fernandez said he felt "heartfelt sorrow" that his officers' "exhaustive search" did not end with the child's safe recovery.
Though bloodhounds were used around the exterior of the home, the dogs did not search inside, Fernandez said.
The incident began at 11:48 a.m. Thursday when Seminole police called Hollywood police to report that the child was missing from the house, Fernandez said. #The toddler's body was found about 12 hours later.
In the hours in between the report of the child's disappearance and the tragic discovery, Fernandez said a "two-to-three square mile area" was searched by his agency with the help of the Broward Sheriff's Office and Community Emergency Response Team volunteers.
At 5 a.m. Friday, a physician from the Broward Medical Examiner's Office was called and as the sun rose, the agency's SUV and two crime scene investigation trucks were parked in front of the single-story white house. Yellow police tape enveloped the home as well as neighboring properties. Citing the investigation, the police chief would not say where the body was found and would not describe whether the child had experienced any trauma.
"We are interviewing anyone who had access to the household," Fernandez said. "Part of the investigation is, how did we find the child deceased? Why did he end up in the condition that he ended up in?"
Mayor Peter Bober called the child's death "a real tragedy for the family and definitely a loss for the city of Hollywood."

The IMPD violent crime unit took Wilson into custody Wednesday afternoon.
Missing Persons detectives and the Marion County Prosecutor’s Office have prepared a probable cause affidavit to charge Wilson despite the absence of a body. Such a case would be based on circumstantial evidence, such as inconsistent statements from Wilson, cooperation from another witness or evidence seized during the search.
Indianapolis Metropolitan police investigated the disappearance of the 6-week-old child, which was reported on Wednesday, August 27, 2014. The baby’s father told police a man and a woman approached him in an alley in the 1400 block of Henry Street, robbed him and then took the baby. The case triggered an Amber Alert.
In his report to police, Wilson claimed that he had been punched in the mouth and pistol-whipped by one of the robbers who abducted his infant. No visible injuries to Wilson’s face or mouth were observed by officers on the day of the reported abduction.
The probable cause affidavit alleges that there were internet searches related to child abductions and missing infants conducted on a phone in Wilson’s possession and made prior to the reported abduction.
On August 27, search and rescue dogs were used to conduct a search for Delano Wilson. The dogs tracked Delano’s scent to a wooded area bordered by South Harding Street, Oliver Street and CSX railroad tracks. In a second search on August 28, using a scent sample from Willie Wilson’s clothing, search dogs tracked to the same wooded area. The baby was never found.
A day after Delano disappeared, Taniasha Perkins, the child’s mother and Wilson’s girlfriend, spoke to the media and made an impassioned plea for her son’s safe return. Police also released audio from Wilson’s 911 call in which he said, “All I want is my son. I am begging, please search. I love my son.”
The Amber Alert was cancelled on August 29 at the request of IMPD.
The search for baby Delano went on for several weeks, although police never found him. On Sept. 1, police served a search warrant at the home of the boy’s parents. Police questioned Perkins at the home and eventually took her away in a police car. She was not handcuffed.
Days later, investigators searched Little Eagle Creek and a nearby wooded area on the west side. The FBI also became involved in the investigation. Two federal agents questioned the family.
The Ten Point Coalition held a faith walk on Sept. 5 encouraging the community to come together and urging anyone with information about the case to step forward. Delano’s family attended the event.
On Sept. 27, a month after the baby disappeared, his family released sketches of the suspects who allegedly took Delano in hopes of generating more tips in the case.
After that, the case remained quiet. Few updates were provided in the months to follow although police said the investigation remained open.
Last month, Wilson appeared in court in an unrelated case. He told FOX59 he thinks about his son all the time.

Mother "disappears" after being dropped off for visitation; was in process of regaining custody (Hunter Valley, Australia)
I don't think this is any great mystery. This is the most likely scenario. An abusive UNNAMED DAD gained custody to punish/control the mother. He tolerated her visitation as long as he was had power over her and was able to humiliate her. But once she was regaining custody, she had to be "dealt with" as abusers see things. Basically a case where the batterer hid the body well.
The more relevant question is who gave this father custody and who supported the decision? They basically put this woman at supreme risk and set up her death.

SOMETHING didn’t feel quite right to Sayle Newson the September day when he dropped off his partner, Carly McBride, to visit her young daughter in the NSW Hunter Valley.
Perhaps it was the fact Ms McBride had told him that morning she feared that something bad was going to happen.
Maybe it was that things didn’t go quite like they usually did when he said goodbye.
Whatever the case, that gnawing gut feeling turned into something much more painful just hours later, when it emerged that his “beautiful, happy and smiling” girlfriend — a mother-of-two — had gone missing, seemingly without a trace.
After two-and-a-half months of searching by police, family, friends and an anguished Mr Newson, the investigation into Ms McBride’s disappearance switched last week from a straightforward missing person case into suspected homicide.
Mr Newson told The Daily Telegraph yesterday that he dated the 31-year-old since June after meeting her at the start of 2013.
By the time she went missing on the afternoon of September 30, the pair spent most days together. And once a week, they would drive up from the home she shared with a friend in Lake Macquarie to visit her three-year-old daughter, who had been living with the girl’s father in Muswellbrook in the Hunter Valley.
After turbulent recent times, Ms McBride was poised to resume custody of her daughter, and an older son to a different previous partner.
“It would be exactly the same thing every time. I would drop her off, she would get out and go to the front door, she would have her daughter in her arms and turn around and wave me off,” Mr Newson said.
“She would ring me twice and text me twice every visit to let me know she was OK.”
“But on that day I dropped her off about 12.30pm and things were just different. And I didn’t hear from her again — not a thing. I texted her, I called her, but the phone just rang out.”
Mr Newson said he turned up at the house about 4.30pm as usual to pick up Ms McBride, only to be told by her ex that she had left after an argument earlier that afternoon and headed on foot towards a McDonald’s restaurant about 2km away.
But staff at McDonald’s never saw her. #Nor did neighbours or residents who live along the quiet suburban route she would most likely have taken.
Police last week searched fields behind a nearby housing estate for clues, but a spokesman for Strike Force Karabi set up to investigate the case said that “nothing of great note” had been found, but added the investigation was ongoing.
Anyone with information about Ms McBride’s disappearance is urged to call Crimestoppers.
She was last seen wearing blue jeans, sandals and a yellow T-shirt, and she was carrying a tan handbag.

RALEIGH, N.C. - The search for missing Raleigh 2-year-old Tristan Blue has now turned into a homicide investigation after Raleigh police charged Tristan's father with murder.
Steven Daniel Blue, 31, has been charged with murder and has been transferred to the Wake County Detention Center. He is being held without bond.

Neighbors said the news was heartbreaking for the community. "It's a somber mood," said neighbor, Ms. Mitchell. "Everybody is just kind of moseying around and doing the best they can. Of course there were several plenty of police officers patrolling so everybody is just kind of in a downward type of mood."
An Amber Alert was issued Wednesday evening for the toddler after he went missing at approximately 1 p.m. in the 5400 block of Portree Place in Raleigh.
The body of Tristan Blue has not been recovered and the case remains under investigation, Raleigh police said.
In a 911 called released Friday by Raleigh police, the caller told the dispatcher she woke up 15 minutes previously to find a 3-year-old missing.
The caller said there was a package outside the house and the child was gone.
The caller tells 911 she has walked around the complex screaming for the child and that neighbors are out looking for him.
She also says she isn't sure if the child can open the door to get out of the apartment.
“He can close it and unlock it but I haven't seen him able to open it,” the caller said.
Anyone with knowledge that might assist detectives is asked to contact the Raleigh police tip line at 919-834-HELP.

CLAYTON COUNTY, Ga. — Clayton County police say they rescued a 13-year-old boy who has been reported missing for four years Saturday morning.
Clayton County police Sgt. Kevin Hughes said officers first went to the home near Jonesboro about 11 p.m. Friday to conduct a welfare check on a child.
“Upon initial arrival, responding officers made contact with several occupants at the location who denied having knowledge of any information concerning the victim,” Hughes said. “After a brief search of the premises, the officers left without locating the victim.”
At about 2 a.m., police said they received a second call about the boy and returned to the house. When officers arrived and after several minutes of questioning adults in the house, officers found the child hidden behind a panel behind a linen closet in an insulation area in the garage.
“While at the location during the second call, the victim was able to establish phone contact with his mother and she in turn passed on additional information to the officers on the scene,” Clayton County police Sgt. Kevin Hughes said. “The victim was found behind a false wall within the residence.”
The boy repeatedly thanked the officers, police said.
Police arrested five people at the home, including the boy’s father, 37-year-old Gregory Jean, and 42-year-old Samantha Joy Davis, and charged them with false imprisonment, cruelty to children and obstruction. The other three people arrested were juveniles, Hughes said.
Authorities said the boy was visiting his father from Florida in 2010 and refused to return him to his mother.
The boy told authorities he used an app on a cell phone to get in touch with his mother.
The boy was reunited with his mother just after 11 a.m. at the Clayton County police department.
A neighbor told Winne the boy was frequently outside the house, mostly doing yard work but sometimes playing.
Authorities say they have a lot of unanswered questions and they are working with the boy's mother.
Authorities said the child’s mother apparently reported the boy missing to child welfare authorities but not previously to police possibly because she’s an immigrant unfamiliar with the system.
Deputy Chief Mike register there were too many unanswered questions this morning as to who has custody and why police weren’t brought in earlier. The boy will likely stay in the custody of Division of Family and Children Services to ensure the child’s safety, the police department’s primary concern.
Police told Channel 2 Action News they believe Davis was convicted of child cruelty charge in Henry County in 2006. We're working on investigating the alleged charge.

Dad charged in starving death of 15-month-old daughter; other kids found severely malnourished as well (Gwinnett County, Georgia)
Update: We see here that the 23-year-old woman is this man's adult daughter, and yes she also is the mother of some of these children. So he had obviously been grooming her and sexually abusing her for a long time. The starving woman is also the mother of some of the children.

Was the 23-year-old woman deprived of food by the vicious freak as well?

Notice that the 23-year-old woman has also been charged with murder, though the article reports that the decision to withhold food was made by Daddy. Typical, in that women are held responsible for men's crimes even when--especially when?--there is little they can do to stop them.

Police: Father charged in baby's starving death could be cult member
GWINNETT COUNTY, Ga. — UPDATE: Police say the woman who was found weighing just 59 pounds in an Extended Stay motel was reported missing in 2010.
Her aunt told Channel 2’s Tony Thomas that she disappeared at the age of 17. Her aunt said the family filed missing person reports for her which listed her as weighing 103 pounds. They have been doing their own investigations ever since but never could track down exactly where she was. They say they then got a call Tuesday night from police saying they had found her in Peachtree Corners.
Police are investigating the starving death of a 15-month-old infant girl.
They say she died at the Extended Stay on Jimmy Carter Boulevard in Gwinnett County.
Channel 2’s Tony Thomas started digging into the case Wednesday and learned disturbing details about charges that the family members face.
Police say the child, Alcenti McIntosh, was taken to the hospital by her father, 44-year-old Calvin McIntosh. The child was determined to be dead upon arrival, police said.
Medical personnel determined that based on the child’s physical appearance, her death was most likely a case of neglect and abuse.
Police executed a search warrant at the location where the family was staying, where investigators said they met with a 23-year-old woman identified as Najilla McIntosh.
There were three other children in the motel room, ages 5, 3, and 3, according to police. The children were severely malnourished and in need of medical attention, police said.
Also in the room was a 21-year-old woman lying on the floor. She was wrapped in blankets and in desperate need of medical attention, weighing only 59 pounds, police said.
While executing the search warrant, police said they found large amounts of literature and notes pertaining to ritualistic behavior and the Nuwaubian Nation of Moors, an Islam-based cult which is known for being a sovereign group, police said.
Investigators later learned that Calvin McIntosh fathered all four children.
Police said they learned Calvin McIntosh would deprive the children of food when they were disobedient.
The Gwinnett County Medical Examiner ruled starvation as the cause of death for Alcenti McIntosh, police said.
Thomas asked a witness if she suspected any abuse going on in the motel room that she walked by on a regular basis.
“I didn’t know what was going on,” the witness said. “For the last week and a half, I would go past the door and I would hear a lot of crying. Just crying, crying, crying.”
The three surviving children are in the Department of Family and Child Services custody, while the woman who was malnourished remains hospitalized in serious condition.
Calvin McIntosh and Najilla McIntosh have been charged with felony murder, malice murder, first-degree cruelty to children, second-degree cruelty to children, and cruelty to a physically disabled adult.
Calvin McIntosh was also charged with rape, incest, and aggravated sodomy.

Kind of confusing article. Who is the mother of these children? The 23-year-old woman? The 21-year-old woman found on the floor in a state of severe starvation? Both?
Was the 23-year-old woman deprived of food by the vicious freak as well?
And what the hell is the Nuwaubian Nation of Moors? Sounds like just more bullsh** that men make up to justify their torture of women and children.
Notice that the 23-year-old woman has also been charged with murder, though the article reports that the decision to withhold food was made by Daddy. Typical, in that women are held responsible for men's crimes even when--especially when?--there is little they can do to stop them.

Court: No conflict of interest in Mesiti case

The quest to place Mark Edward Mesiti on trial for the murder of his 14-year-old Ceres daughter has been fraught with delays from the start.
The latest delay, however, was resolved recently by an appellate court which ruled that a prosecutor should not have been removed by Stanislaus Superior Court Judge John Freeland last August. Freeland removed Deputy District Attorney Annette Rees from the case saying that Mesiti planned to call her as a witness and thus presenting a conflict of interest.
The former Ceres man has been behind bars since March 28, 2009 to stand trial for the first-degree murder of his daughter, Alycia Augusta Mesiti. Authorities say he raped and sexually molested Alycia during 2005 and 2006, and then killed her on or around August 16, 2006. On March 25, 2009, Ceres Police found her body in the backyard of 3576 Alexis Avenue in Ceres where the family was living at the time of her murder.
Justices from the 5th District Court of Appeals -- Herbert Levy.Jennifer Detjen and Donald R. Franson Jr. - met on June 18 to hear the argument and determined that no conflict of interest was established.
Mesiti claimed there was a conflict with Rees because he said he spoke to Rees about a 2005 case that convicted his acquaintance, Gregory Joseph Ulrich, of sexually molesting Alycia. Ulrich went to jail after pleading no contest but has since died from cancer. Rees denied ever speaking to Mesiti about Ulrich and said she didn't recall a detective question the girl about Ulrich molesting her during her Child Abuse Interviews, Referrals and Evaluation (CAIRE) interview. The testimony of several others investigating the case cast doubts on the truthfulmess of Mesiti's claim.
Mesiti's move to get Rees off the case, said Deputy District Attorney Meghan Greerty last year, was nothing more than a lie designed to delay his death penalty case.
The three appellate court justices cited the fact that Judge Freeland viewed Mesiti's remarks as untruthful. Freeland defended his decision in the Fresno court saying it was a matter of admissibility of evidence and not his personal views that Mesiti was less than honest. The justices disagreed with Freeland and said they felt there was no conflict of interest with Rees helping to prosecuting the case against Mesiti.
"When ruling on a recusal motion, the trial court bears the responsibility of assessing the credibility of evidence before it," wrote Justice Levy in his opinion.
Mesiti claims that he's innocent of murder and that Ulrich murdered his daughter. Ulrich reportedly had been released from jail three days prior to Alycia's believed murder date. Ulrich was a registered sex offender who worked for Mesiti's home-based computer business on Faith Home Road.
District Attorney Birgit Fladager said her office looks forward to moving the case forward, although it's unclear who will represent Mesiti in court. His prior defense team of Robert Orenstein and Mark Sullivan are off the case. Mesiti had sent a communication to Orenstein that led to the "complete breakdown of the attorney-client relationship," said Orenstein.
In late 2012, Judge Freeland relieved defense attorney Robert Chase from the Mesiti case. Chase announced to the court that he had a potential conflict of interest. Chase was designated as Mesiti's "Keenan counsel," or the attorney who would represent Mesiti during the penalty phase should a jury find him guilty. Chase said he did not wish to abandon Mesiti but was forced to do so.
Death penalty cases require two lawyers defending a suspect. The second lawyer is required because the lawyer handling the trial may blow credibility with the jury after a finding of guilt, so a second attorney would represent the defendant during the sentencing phase.
Mesiti faces the death penalty if convicted of the murder and a total of 44 criminal counts, mostly sexual abuse charges. Rees has charged Mesiti with sexually assaulting two other female victims. The girls were not identified but their ages were listed as eight years of age and the other who was both 16 and 17 during the alleged abuse. The seven felony charges involving his alleged actions against the girls -- between July 2006 and July 2008 -- include unlawful sexual intercourse, committing lewd acts on a child, and furnishing illegal narcotics to a minor.
Mesiti moved from Ceres about six months after Alycia was reported missing; but three days after the body was unearthed police traced him to a Los Angeles apartment which had been used as a methamphetamine lab. Mesiti's girlfriend, Shelly Welborn Walker helped testify against Mesiti in the drug trial in which he was convicted on March 18, 2011 and sentenced to five years. He was turned over to Stanislaus County for the murder prosecution in June 2011.
Authorities say Mesiti drugged Alycia from July 2005 through May 2006 so that he could commit lewd and sexual acts with her.
Alycia had been reported missing two days after her alleged Aug. 13, 2006 disappearance. Mark Mesiti told police that Alycia traveled to the San Jose area on August 11, 2006, to spend the weekend with a friend and that she telephoned on August 13, reporting that she had instead gone camping with other friends but would not disclose her location nor who she was with. Police say Mr. Mesiti claimed to receive periodic calls from Alycia who assured her things were okay.
Mesiti's criminal record includes domestic violence against Alycia's mother, Roberta Allen, drunk driving and bank fraud. The girl reportedly did not get along with her mother, Roberta Allen, who has a history of mental depression and attempted suicide. Court officials expressed concerns about Alycia's handling and turned her over to her father in November 2005 despite his criminal record.
In 2005 Mark Mesiti moved from the Bay area to Alexis Avenue, a neighborhood west of Morgan Road and just blocks from Sinclear Elementary School. Alycia had been enrolled by her father to attend Central Valley High School on Sept. 15, 2005, but never attended. On Oct. 6, 2005 CUSD received a request for her records to be sent to Harbor High School in Santa Cruz.
Roberta Allen told Ceres police that she did not believe her daughter ran away and suspected foul play. That's when police stepped up their investigation of the property and brought in a cadaver-detecting canine. The body was found wrapped in heavy black plastic and bound with duct tape near the patio buried under feet of dirt.
Mesiti is scheduled to be back in court on July 25.

Custodial dad to go on trial for antifreeze poisoning-torture murders of 5-year-old daughter, 2-year-old son (Mobile, Alabama)
We have reported on torture killer daddy JOHN DEBLASE since this case first broke four years ago. What is not reported here is that this CUSTODIAL FATHER viciously kept these children he considered a "personal liability" away from their mother. Daddy, like many abusive fathers, denied all contact while the authorities did nothing. According to the mother, she had not seen the kids in at least a year. See previous posts here.

An Alabama father accused of torturing and poisoning his two children with antifreeze before dumping their bodies in trash bags four years ago is finally going to trial.
The capital murder trial for John DeBlase, 30, is set to begin in Mobile Tuesday in the sickening deaths of his two children, Natalie, 5, and Chase, 3, in 2010.
DeBlase and his common-law wife, Heather Leavell-Keaton, have both pleaded not guilty after the children's skeletal remains were recovered in Alabama and Mississippi, one month after they were reported missing, though they had not been seen for months, Mobile's Press-Register reported.
Chase, who was described as only wearing diapers when he was found in woods north of Vancleave, Miss., on Dec. 8, 2010, is believed to have died on June 20 after enduring months of abuse and poisoned meals that left him violently ill.
His older sister, whose body was found two days later in woods near Citronelle, Ala., is believed to have died earlier on March 4 after facing similar, if not worse, abuse.
The little girl had been burned with cigarettes and hot candle wax, had her hair pulled and was beaten with a fly swatter by Leavell-Keaton, who was her stepmother, before she was heartlessly locked in a suitcase on the day she died, Mobile police Detective Angela Prine testified in September 2011.
Leavell-Keaton — whose trial is scheduled to begin on March 25 — has been accused of being jealous of the little girl and of torturing both children before teaming up with DeBlase to kill them for a life free of responsibilities.
Authorities have said that Chase survived a bit longer than his sister when the couple considered keeping him alive despite previous poisonings.
He was ultimately considered a "liability," however, when he was seen crying and asking for his sister in public after her death, according to the detective's testimony.
Among the horrific allegations of abuse, Prine said Leavell-Keaton confessed to killing the children to a fellow inmate and that DeBlase first poisoned their dog with antifreeze "to see how long it would take to kill a living thing," the Press Register reported. Authorities search woods near Citronelle, Ala. where the body of 5-year-old Natalie DeBlase was found in December 2010. Her recovery came two days after her brother's in Mississippi. Authorities said they bought gallons of antifreeze at a Walmart to prepare. In addition to three counts of capital murder with DeBlase, Leavell-Keaton also faces two counts of aggravated child abuse.

Baby Kate father's murder charge dismissal to be appealed by prosecutor, Attorney General Bill Schuette

MASON COUNTY, MI -- Michigan Attorney General Bill Schuette and Mason County Prosecutor Paul Spaniola will appeal the decision announced Monday, Sept. 15, by a district court judge to dismiss an open murder charge against Sean Phillips, Baby Kate's father.
Phillips was charged with open murder of his daughter, Katherine "Baby Kate" Phillips who disappeared in Mason County on June 29, 2011. She was 4½ months old when she disappeared.
District Court Judge Peter J. Wadel dismissed the charge against Phillips on Monday. The attorney general said he will continue to fight for justice. In a seven-page written opinion from Wadel, the judge simply states there wasn't enough evidence to charge Phillips with the baby's death.
"Baby Kate deserves full justice. We will not settle for any less," Schuette said in a press release. "As Attorney General, it is my job to ensure every victim across our state has a voice no matter who you are or where you live."
Spaniola said a circuit judge will review the case on the appeal.
"We have already decided that the pursuit of justice for Baby Kate is to appeal this decision and have the circuit judge review the evidence which we presented at the preliminary examination," Spaniola said in the same press release.
As of Sept. 15, 2014, the child remained missing.
Phillips is already serving a prison term of 10 to 15 years for unlawful imprisonment of his daughter. A Mason County jury convicted him of that in April 2012.

MASON COUNTY, MI -- Michigan Attorney General Bill Schuette and Mason County Prosecutor Paul Spaniola will appeal the decision announced Monday, Sept. 15, by a district court judge to dismiss an open murder charge against Sean Phillips, Baby Kate's father.
Phillips was charged with open murder of his daughter, Katherine "Baby Kate" Phillips who disappeared in Mason County on June 29, 2011. She was 4½ months old when she disappeared.

Child-porn discovery on Josh Powell’s computer might have averted death of boys
The FBI found child pornography while investigating Josh Powell in the 2009 disappearance of his wife, Susan Powell, according to documents. Josh Powell killed himself and his children in 2012.

SALT LAKE CITY — Investigators found child pornography on Josh Powell’s computer at least 17 months before he killed his children and himself, according to FBI documents obtained by The Salt Lake Tribune.
The paper reported Saturday that documents show the FBI was investigating Powell in the disappearance of his wife, Susan Powell, who was last seen at her West Valley City, Utah, home on Dec. 6, 2009, as well as for possession of child pornography.
Anne Bremner, an attorney for Susan Powell’s parents, said the family was never told the FBI was investigating Josh Powell for child pornography. If the state of Washington’s Department of Social and Health Services had known about the suspected child pornography, Bremner said, it “never would have let him have those kids.”
When a state worker delivered 7-year-old Charlie and 5-year-old Braden to Josh Powell’s rented home in Graham, Pierce County, on Feb. 5, 2012, Josh Powell locked out the worker and ignited a fire that killed him and his sons.
Powell for years had been considered a person of interest in his wife’s disappearance, and eventually he moved back to the Puyallup area, where both his father and his wife’s parents lived.
He lost custody of the boys after his father was arrested for possessing child pornography in another house they previously shared. The boys were in the custody of the state, but living with Susan Powell’s parents. However, Josh Powell was allowed supervised visitation.
Shortly before their deaths, Charlie and Braden Powell had begun talking to their grandparents about things they remembered from the night their mother vanished, a lawyer for the grandparents has said.
On the day of the fire, a state contract worker from Foster Care Resource Network brought the boys for a visit to Powell’s house. Powell answered the door, pulled the boys inside, slammed the door and locked it. The caseworker banged on doors and windows and called 911, but soon smelled gasoline and the fire erupted.
Josh Powell had been previously linked to child pornography, The Tribune reported. At hearings in Washington state to determine custody of his children, then-Assistant Washington Attorney General John M. Long said Powell was under investigation for child pornography after cartoon images of incest between mothers and children were found on his computer in late 2009 or early 2010.
The paper reported that the FBI appeared to be trying to discover what other images might be on Josh Powell’s computer, but the machine had been successfully encrypted by Powell.
Last month, a federal judge ruled that insurance proceeds from the fatal fire could be split between Josh Powell’s parents and sister and Susan Powell’s family.

Josh Powell's two young sons suffered sexual abuse at the hands of their father before he killed them with a hatchet and blew up their home in 2012, according to a new tell-all book.
Gregg Olsen and Rebecca Morris, the authors of 'If I Can’t Have You: Susan Powell, Her Mysterious Disappearance, and the Murder of Her Children,' claim that they uncovered evidence proving that John and Susan Powell’s children, 7-year-old Charlie and 5-year-old Braden, were molested while living with their father and paternal grandfather.
The boys’ maternal grandparents, Chuck and Judy Cox, first noticed that something was amiss with their grandkids when Charlie and Braden moved into their Utah home in 2011, two years after their mother's disappearance.
The book, based on interviews with the couple’s family and friends, claims that one night, the siblings refused to put on their pajamas while getting ready for bedtime, according to Radar Online.
'Who told you it’s okay to be naked?' Mr Cox asked the boys, to which they allegedly replied, 'Our daddy!'
After talking to Charlie, the grandfather learned that he and his brother slept naked in bed with John Powell, who also slept in the nude.
One of the brothers later drew a picture for Chuck Cox showing what appears to be a child next to an adult, accompanied by the chilling words, 'Don’t play with me!'
The book, which is out in stores today, suggests that there is also a possibility that Braden was molested by Josh's father, Steve, who was later charged with voyeurism for taking pictures of young girls who lived next door to him.
When the boys were taken from the custody of their father, Braden was diagnosed with a fungal skin infection; one way to contract this infection is through sexual contact, the authors said.
Charlie and Braden's maternal grandparents also noted that the kids started getting violent with one another.
One night when the two were taking a bath together, Mr Cox walked in on Charlie holding his brother's head underwater.
The man later recalled that a few more seconds and the toddler likely would have suffocated.
Olson and Morris' book contains other disturbing allegations surrounding the Powell family drama, inclding claims that the father starved Braden to the point of malnutrition and possibly poisoned his wife, Susan, before she vanished in 2009.
While 29-year-old Susan Powell's body has never been found, her husband was long suspected of having a role in her disappearance. Then in February 2012, he attacked his sons with a hatchet and blew them - and himself - up in his Washington state home.
Speaking to authors Olsen and Morris for their book, 'If I Can't Have You', the couple's friends have given a terrifying insight into the Powell household.
They claim that Josh Powell, who was unemployed, controlled the family's finances - ordering his broker wife only to buy the cheapest groceries and refusing to feed the children three meals a day.
'Susan had to research what was on sale at what store,' Michele Oreno told the authors. 'Then she had to come home and put it into the computer, what she spent on every item.
'[Josh] was really ticked off because the week before she had spent two cents more on a can of peas than he found at another store... It got so he wouldn’t give her money for food or anything.'
Susan even called friends to ask if she could sneak hot dogs from them because the boys were so hungry, friends said.
Then, when Charlie Powell was a year old, a doctor diagnosed him with malnutrition, the book said.
'He gets one meal a day at day care. That's all he needs,' Josh told Susan, according to friend Rachel Marini. 'You’re not wasting my food on him because he’s just going to poop it out!'
Friends added that they started to suspect him of poisoning his wife in October 2009, two months before she vanished.
She began to feel nauseous so wondered if she was pregnant before miscarrying, friends said.
'He made a lot of organic products for her to drink, a lot of thick yogurt stuff and fermented drinks with kefir,' friend Amber Hardman explained.
Susan's body was never found, although the search still continues.
Josh has claimed that his wife was at home when he took his sons, Charlie and Braden, on a winter camping trip in Utah's West Desert.
In February 2012, 36-year-old Josh Powell took his two sons into his home from a state supervisor, attacked them with a hatchet and then blew up the family home, killing all three.
Police documents from May 2012 reveal that Utah officials believe that Josh killed his wife and that his brother Michael helped dispose of her body. Michael killed himself in February 2013.

Dad loses appeal of conviction for assaulting 7-month-old daughter during visitation (Monticello, New York)
This is one of the very first cases we covered here at Dastardly Dads. But notice that a very interesting thing has happened here: The reporter has "forgotten" to mention that this crime took place during Daddy's very first visitation with the baby. Proof once again, that unmarried sperm donors who never made a commitment to the mother or to forming a family should not be treated as it they had with all the "rights" thereof. On July 4,2009, Clarke reported that his 7-month-old daughter had gone missing from her stroller near Walmart in the Town of Thompson. Security videos from Walmart and elsewhere contradicted his story.
The baby was found that evening in a wooded area behind the store, wearing only a light shirt.
Clarke's appeal lawyer argued that his trial lawyer, Fred Neroni, provided ineffective assistant of counsel by failing to properly waive Clarke's right to be present for trial sidebar conferences or to argue certain other issues; and that Clarke was denied a fair trial by the prosecution's use of photos to document the baby's injuries, by use of "inflammatory" language, and because prosecutors were allowed to use police testimony about his demeanor during the search for the baby.
The Appellate Division, Third Department of State Supreme Court denied all of Clarke's arguments, finding that his lawyer "pursued a consistent, cogent theory of defense, made successful objections, engaged in thorough cross-examination of the People's witnesses and otherwise provided defendant with 'meaningful representation.'"
