Dad with full custody found guilty of "corpse abuse" after decomposed body of 21-month-old daughter found in crib (Medina, Ohio)
We have followed this case for three years, and there has been NO EXPLANATION in the media as to how a homeless, dysfunctional, child-neglecting, cocaine-using father got custody. Who was responsible for this decision?

A man whose daughter's decomposed body was found in a crib by a cable television worker was convicted Wednesday of corpse abuse and tampering with evidence.
Investigators were unable to determine how 21-month-old Ember Warfel died last summer because her body was so badly decomposed. Prosecutors argued that her father, Eric Warfel, did not report his daughter's death because he did not want an autopsy performed.
A judge also found the 35-year-old Warfel guilty of child endangering.
Warfel, who was found competent to stand trial after pleading not guilty by reason of insanity, will be sentenced next month and faces up to six years in prison.
Ember's body was discovered last July in a Medina apartment, south of Cleveland.
Another daughter of Warfel's, a 5-month-old, died in 2013. A medical examiner ruled that case as a "sudden unexplained infant death."
Warfel's attorney has said Ember was born with severe medical problems. He also said Warfel's failure to report his daughter's death was not enough reason to convict him on the corpse abuse and tampering charges.
While the cause of the girl's death hasn't been determined, an autopsy did find traces of cocaine in her hair samples.
Warfel was arrested after a cable technician went into an apartment to upgrade the service and found the toddler's body in her crib.
Warfel, who was divorced from the girl's mother, had full custody of the child. He told investigators Ember died about a month earlier and he hadn't informed family members or anyone else about her death, according to a police report.
Warfel was arrested while he and his 7-year-old daughter were at a mall near Cleveland. He said they were living at a motel, and investigators found cocaine in his motel room, police said.

The Lod District Court on Sunday handed down two life sentences to a father who killed his two children by slitting their throats to spite his ex-wife.
Avi Levi, 43, was convicted two weeks ago of murdering his 12-year-old son and 10-year-old daughter while they were visiting him from their mother’s home in the US in 2014. He will serve the sentences back-to-back and was also ordered to pay NIS 500,000 to his ex-wife.
Levi, from Yashresh, an agricultural community near Ramle, killed the children in order to exact revenge on his former wife for divorcing him, the court found.
He was convicted two weeks ago after the court rejected a defense claim that he was unfit to stand trial, and ruled the murders were premeditated.
The trial revealed that Levi blindfolded his 12-year-old son and 10-year-old daughter on June 11, 2014, and then slit their throats with a knife he had purchased a day earlier.
Afterward, Levi walked into the police station in the nearby city of Ramle and admitted that he had killed the kids, reportedly to torment his ex-wife, saying he did it “so that their mother’s life would be over.”
Before sentencing Oren Aduhan, a childhood friend of Levi’s, told the court that the father gave his all for the children, Channel 2 reported.
“No one would believe that Avi would to something like this, but it happened. Only Avi knows what brought him to that point when he did what he did, but the regret is the most important thing,” Aduhan said.
His family and his defense attorney had claimed that being so far from his children and the fact that his ex-wife occasionally failed to send the children on twice-yearly visits to Israel as agreed had left him showing signs of depression.
However, he refused to be tested by a psychiatrist, the report said.
The mother and the children were dual US-Israeli citizens. The two children arrived for a visit in Israel a day before they were killed.
The children’s funeral took place in Columbus, Ohio, where the mother resides.
Domestic violence complaints were lodged against Levi in 2005 and in 2009, before the couple divorced.
The wife had also spent time in a battered women’s shelter before the divorce was finalized.
The ex-wife gained main custody of the children and, because the husband could not provide child support, decided to move to the US. The suspect was unsuccessful in fighting his ex-wife’s intention to leave the country but succeeded in securing twice-yearly visits.
While searching the man’s residence, police discovered a journal in which the suspect had “obsessively” recorded his feelings and actions, especially in regard to his ex-wife.

Custodial dad indicted in scalding death of 4-year-old son (Warren County, Ohio)
Evidence points toward ROBERT RITCHIE being a custodial father. There is mention of a step, but no mention of the mother at all. What happened to Mom, as often happens in these accounts, is simply ignored.

WARREN COUNTY, OH (FOX19) - The father of the 4-year-old Franklin boy who died after being placed in a bathtub of scalding water has been indicted, Warren County Prosecutor David Fornshell announced Monday.
Robert Ritchie is charged with involuntary manslaughter and endangering children for the March death of Austin Cooper. The boy's stepmother, Anna Ritchie, was charged with murder in the days after his death.
Robert is accused of failing to seek medical treatment for Cooper, thereby resulting in the child's death, according to Fornshell.
The Warren County Coroner's Office ruled the boy died from Hypovolemic shock - the loss of blood and fluid.
The boy should not have died, Fornshell said. If he had received medical treatment, he would have had a more than 95 percent survival chance.
Anna is charged with scalding her stepson to death. She pleaded not guilty to a six-count indictment including murder charges last month.
Franklin police say Anna admitted to dipping Cooper's legs in scalding water as punishment and sending him to bed early on March 15.
Fornshell said investigators believe the boy was in the 134-degree water in a bathtub for 20 to 25 minutes. His skin was falling off and he was bleeding when he was removed.
Anna then dressed the child in pajamas and socks before putting him to bed at 4:30 p.m.
No one checked on the boy until 9:30 a.m. the next morning, when his dad found him, Fornshell said.
In an interview with WDTN, Robert claimed his son was already in bed when he got home from work on March 15.
He said he found Austin unresponsive the next morning and called 911.
Anna's trial date was set for Sept. 26. She faces 15 years to life in prison.

Custodial dad accused of keeping 13-year-old daughter chained in basement (North Toledo, Ohio)
The headline is quite misleading. It implies some random father and son kidnapped a girl. You have to go FIVE PARAGRAPHS down to find out that this was the victim's father and that this was basically a case of false imprisonment and torture, not "kidnapping" as such.
The girl has been led to believe that her mother simply took of for Las Vegas. I'm rather curious as to how she "knows" this. Is this what Daddy told her? The one who has kept her chained at the ankle?
I would seriously doubt anything this sick psychopath told this girl. And I think that it needs to be verified that the mother is in fact alive, or whether she has been "disappeared" or is deceased for any reason. Because frankly, it is very likely the father was also abusive to the mother of these kids.

Father, son accused of kidnapping 13-year-old girl
Bonds set at $500,000 each for Timothy and Esten Ciboro

Police have arrested Timothy Ciboro, 53, and his son, Esten Ciboro, 27, on a charge of kidnapping a 13-year-old girl and shackling her to a support beam in the basement of this house at 825 Noble Street in Toledo.
A 13-year-old girl rescued late Wednesday from a North Toledo home where she said she was kept shackled in a basement for as long as a year is now in foster care, along with two other children taken from the house, authorities said this afternoon.
The girl was rescued when she managed to uncuff herself around 9 p.m. Wednesday with a spare key and run away after the suspects both went for a jog in a park, according to a Toledo police report.
The girl was discovered by a woman who called police when she saw the girl walking in the 700 block of Water Street about 9:15 p.m. Wednesday. The woman told police the girl was carrying several bags and looked like a runaway. The woman told police that she went outside and convinced the victim to come indoors with her.
Once inside, the girl told the woman that her mother had left her and her two siblings and went to Las Vegas. She then told the woman her dad had taken her in but she had run away "because she gets in trouble for wetting the bed," for which he "puts handcuffs on her ankles" and "makes her sleep in the basement."
A judge set bonds at $500,000 each for the pair who were arrested at their residence early today and accused of kidnapping the girl, who told authorities she is the stepsister of younger defendant. The older defendant is a former Toledo firefighter.
During her basement captivity, the girl said she was “fed spoiled and old scraps of food and forced to defecate and void in a bucket containing ammonia,” according to court documents.
During their arraignment in Toledo Municipal Court on charges of kidnapping and child endangerment, Timothy Ciboro, 53, and Esten Ciboro, 27, were ordered held at the Lucas County jail in lieu of the bond pending their preliminary hearing May 26.
The victim told authorities she was “kept shackled by the ankle to a support beam in the basement of their [the suspects’] house for different periods of time, once lasting as long as a year,” [and] kept in the dark, according to a criminal complaint filed with the court.
The suspects were arrested about 1:40 a.m. at their house at 825 Noble St., where they live with the older suspect’s three underage children.
The girl told police her mother had left them to go to Las Vegas. The girl was afraid to talk to the woman who discovered her on the street, according to the police report, because her captors had told her if she talked to strangers she would “get into more trouble.” She told police she was put in the basement for wetting the bed.
The girl told authorities she escaped by using a key to unshackle herself when the two suspect left the house to go for a jog in a park. She also told authorities she had not been to school since the first grade.
Robin Reese, the executive director of the Lucas County Children Services said that the agency has been aware of the Ciboro family since at least 2014 when someone saw the girl pick up a discarded bag of french fries from a a garbage container in a park and then eat them.
Service employees then stopped by the house but saw no signs of child abuse and left the girl there, she said.
This time, children services removed all three children from the house and placed them in foster care, Ms. Reese said. All three are fine, she said, adding that the victim’s hygiene was poor but she did not appear malnourished. It appears that the girl was the only child targeted for abuse by the suspects, she said.
Ms. Reese said all three children were home-schooled, may be why the suspects escaped detection for a while, because “the education process is helpful to us to keep an eye on families.”
The spokesman refused to reveal the girl's name or the names and genders of her siblings.
Timothy Ciboro was previously a Toledo firefighter until 2004, according to city and court records. Fire Chief Luis Santiago confirmed Mr. Ciboro was a firefighter.
"I remember him and I remember him not being a very good employee," the chief said.
In 2007, Mr. Ciboro filed a lawsuit against the city fire department in federal court and several lawsuits in Lucas County Common Pleas Court against the city.
He filed a harassment and wrongful termination suit against the city that year. He also filed a lawsuit against his union, Toledo Firefighters Local 92 for failure to represent, and a misuse of authority lawsuit against the arbitrator who heard his case. He was fired after being accused of demanding a discount on ice cream for a friend at a South Toledo ice cream stand in the summer of 2004.
In U.S. District Court in Toledo, Mr. Ciboro filed a complaint on Feb. 21, 2007 over a separate incident at his fiancee's residence. In the lawsuit, Mr. Ciboro claimed he was assaulted by fire Lt. Rico Daugherty and Firefighter William Bruss in February, 2005, while they were treating a diabetic man, who became ill at the home of Mr. Ciboro's fiancee.
Mr. Ciboro claimed he was shoved into a doorway and struck on the head, neck, and back in an altercation with firefighters. At the time, Mr. Ciboro was charged with two counts of misdemeanor assault and misconduct at an emergency. One of the assault charges was dismissed; a jury in Toledo Municipal Court found him not guilty of the other count. A judge found him guilty of misconduct at an emergency, a minor misdemeanor.
Neighbor Maria Luna, 41, said the house was occupied by the father and three children, one of whom is believed to be the victim. They lived at the house for at least seven years.
Family members mainly kept to themselves and were always respectful.
"We've sat here watching everybody around us. We didn't notice anything. What did we miss?" she said.
Travis Bell, 23, said he was shocked by the news of his neighbor. He described Tim Ciboro as standoffish, and said he attempted once to speak with him.
"He just went into the house and closed the door," Mr. Bell said.
Mr. Bell said this incident reminded him of Ariel Castro in Cleveland. Castro hanged himself in prison in 2013 after being sentenced to more than 1,000 years when he pleaded guilty to 937 counts including kidnapping and rape involving three women he kept hostage in his home.
In 2013, three women who were held captive for more than a decade escaped when Castro left to get food from a nearby fast-food restaurant.
Amanda Berry, Michelle Knight, and Gina DeJesus had been kidnapped when lured them into his vehicle with the offer of a ride, and held in his Seymour Avenue home. They escaped May 6, 2013. Two of the survivors were acquainted with Castro.
Lucas County Children Services is still in the early stages of collecting information about the Ciboros, such as their previous employment history.
"From our information, that name has been tied to that residence for quite some time but we don't know how long yet," Julie Malkin, Lucas County Children Services spokesman, said.
"This one is an unusual situation and that's all I can say about it at this point," Ms. Malkin said. "We're still pulling information together."

Robin Reese, the executive director of the Lucas County Children Services said that the agency has been aware of the Ciboro family since at least 2014 when someone saw the girl pick up a discarded bag of french fries from a a garbage container in a park and then eat them.
Service employees then stopped by the house but saw no signs of child abuse and left the girl there, she said.
This time, children services removed all three children from the house and placed them in foster care, Ms. Reese said. All three are fine, she said, adding that the victim’s hygiene was poor but she did not appear malnourished. It appears that the girl was the only child targeted for abuse by the suspects, she said.
Ms. Reese said all three children were home-schooled, may be why the suspects escaped detection for a while, because “the education process is helpful to us to keep an eye on families.”
The spokesman refused to reveal the girl's name or the names and genders of her siblings.
Timothy Ciboro was previously a Toledo firefighter until 2004, according to city and court records. Fire Chief Luis Santiago confirmed Mr. Ciboro was a firefighter.
"I remember him and I remember him not being a very good employee," the chief said.
In 2007, Mr. Ciboro filed a lawsuit against the city fire department in federal court and several lawsuits in Lucas County Common Pleas Court against the city.
He filed a harassment and wrongful termination suit against the city that year. He also filed a lawsuit against his union, Toledo Firefighters Local 92 for failure to represent, and a misuse of authority lawsuit against the arbitrator who heard his case. He was fired after being accused of demanding a discount on ice cream for a friend at a South Toledo ice cream stand in the summer of 2004.
In U.S. District Court in Toledo, Mr. Ciboro filed a complaint on Feb. 21, 2007 over a separate incident at his fiancee's residence. In the lawsuit, Mr. Ciboro claimed he was assaulted by fire Lt. Rico Daugherty and Firefighter William Bruss in February, 2005, while they were treating a diabetic man, who became ill at the home of Mr. Ciboro's fiancee.
Mr. Ciboro claimed he was shoved into a doorway and struck on the head, neck, and back in an altercation with firefighters. At the time, Mr. Ciboro was charged with two counts of misdemeanor assault and misconduct at an emergency. One of the assault charges was dismissed; a jury in Toledo Municipal Court found him not guilty of the other count. A judge found him guilty of misconduct at an emergency, a minor misdemeanor.
Neighbor Maria Luna, 41, said the house was occupied by the father and three children, one of whom is believed to be the victim. They lived at the house for at least seven years.
Family members mainly kept to themselves and were always respectful.
"We've sat here watching everybody around us. We didn't notice anything. What did we miss?" she said.
Travis Bell, 23, said he was shocked by the news of his neighbor. He described Tim Ciboro as standoffish, and said he attempted once to speak with him.
"He just went into the house and closed the door," Mr. Bell said.
Mr. Bell said this incident reminded him of Ariel Castro in Cleveland. Castro hanged himself in prison in 2013 after being sentenced to more than 1,000 years when he pleaded guilty to 937 counts including kidnapping and rape involving three women he kept hostage in his home.
In 2013, three women who were held captive for more than a decade escaped when Castro left to get food from a nearby fast-food restaurant.
Amanda Berry, Michelle Knight, and Gina DeJesus had been kidnapped when lured them into his vehicle with the offer of a ride, and held in his Seymour Avenue home. They escaped May 6, 2013. Two of the survivors were acquainted with Castro.
Lucas County Children Services is still in the early stages of collecting information about the Ciboros, such as their previous employment history.
"From our information, that name has been tied to that residence for quite some time but we don't know how long yet," Julie Malkin, Lucas County Children Services spokesman, said.
"This one is an unusual situation and that's all I can say about it at this point," Ms. Malkin said. "We're still pulling information together."

His girlfriend, Brittney Hopkins, 26, was charged with trafficking in drugs.
Garcia is currently being held in Lorain County Jail on $150,000 bond, reported the Chronicle-Telegram.

CANTON, OH (WOIO) - The death of a 3-year-old girl is under investigation and charges have been filed. Canton Police say around 11:15 a.m. Friday, dispatch received a call regarding an unconscious child at 1007 Dewalt Avenue. Police say Mathew Miku called 911 and said he found his daughter, Hailey, dead in her bed. He sounded distraught during the call and said Hailey had fallen on the steps a week ago.
Further investigation led detectives to treat this as a homicide.
Later Friday, 22-year-old Mathew Miku was charged with murder (F-1) and child endangering (F-2). His bond was set at $1 million. His live-in girlfriend, 21-year-old Jessica Bender, was charged with child endangering (F-3). Her bond was set at $250,000.
Police say both suspects are residents at the home.
Hailey's grandparents are devastated. They want answers, and most of all, they want justice for Hailey.
"She always had a smile on her face. She was beautiful. She was an angel. There's no reason she had to die like this," said grandmother Karen Miku.
The last time Karen saw Hailey was in November.
"I still have gifts from Christmas I should've given her at Thanksgiving. But I thought she would be home for Christmas," said Karen.
Karen says she hasn't seen Mathew in two years.
"We haven't spoken to Mathew in a very long time. We always had problems with Mat. We never stopped loving him," she said.
Karen has so many questions and says no matter what it is, she wants the truth to come out.
"Losing a child, no one should have to go through that. A child you cherish. A gift from heaven. You don't abuse a child, no matter what," she said. "If someone did kill her, they need to pay to the fullest of the law. There is no excuse. Nobody should be able to get away with killing a child."
The grandparents have set up a GoFundMe page to help pay for funeral arrangements.

CLEVELAND, Ohio -– An appeals court ordered a special-needs child returned immediately to her mother, citing an abuse of discretion by a Cuyahoga County Juvenile Court magistrate and judge who supervises her.
The Ohio 8th District Court of Appeals this week said Magistrate Eleanore Hilow awarded full custody to the child's father even though "there was no evidence to support her decision."

The court said Hilow improperly considered evidence that was never introduced during a custody trial.
Her decision, the court found, was based on her review of reports not in evidence and the unsworn statements of the father to whom she awarded custody.
Juvenile Court Judge Thomas F. O'Malley, who is supposed to review Hilow's decisions independently, failed to do so numerous times during the case, according to the opinion authored by Judge Kathleen Ann Keough.
O'Malley approved Hilow's decisions without reviewing transcripts of hearings. He also let stand her decision to immediately jail the child's mother, Jennifer Rocks, on multiple occasions for contempt of court -- despite the fact a magistrate doesn't have the power to do so without a judge's approval, according to the opinion.
It was after one of those instances, in 2013, that the child's father asked for custody. He argued that the mother was in jail and couldn't care for her. Hilow later awarded him full custody.
The father, who was not represented by an attorney, could not immediately be reached for comment.
"This woman has destroyed me mentally, physically and emotionally," said Rocks, who fought for two years to regain custody of her daughter who has epilepsy.
Rocks said Thursday that her daughter is now back with her, and for that she's grateful.
John V. Heutsche, who represents Rocks, told the appellate court that "in the more than 40 years this practitioner has been licensed and engaged in family law, he has never witnessed such a gross miscarriage of justice or such an abuse by a magistrate office or lack of oversight by a judicial officer."
He likened O'Malley's behavior to that of an "absentee landlord" in a November Plain Dealer story that chronicled numerous complaints and a higher-than-normal number of custody cases -– nine since 2011 -- stemming from Hilow's courtroom later overturned by the appeals court. Counting this week's case, the number of overturned cases is now 11.
Through a court spokeswoman, Hilow and O'Malley have said it is improper to comment on cases before the court.
Multiple attorneys told the Plain Dealer that O'Malley rarely agreed with objections to Hilow's decisions.
But things may have changed since that November story.
In one high-profile case involving an infant removed from her mother, who used marijuana tea during pregnancy, O'Malley ordered the baby returned home.
In the five weeks since November, he's twice sustained, or agreed, with objections her decisions.

Bail set at $100K for dad in child abuse case

TROY — UPDATE @ 6:19 p.m. (Sept. 30): Bail of $100,000 was ordered for a Troy man on felony child endangering/abuse charges accusing him of causing head injuries to his 5-month-old son.
Dillon A. Spade, 22, remains in Miami County Jail following arraignment in county Municipal Court. Troy police reports state they were called early Tuesday to Dayton Children’s Hospital on a report of the child having several skull fractures that appeared to be non-accidental.
The boy initially was taken from a Troy motel where he was staying with his dad, mother and a 3-year-old girl to Upper Valley Medical Center, and then transferred to Children’s.
Police said during questioning they learned Dillon Spade was caring for the two children while their mother was at work. He at first said nothing happened but after added that he “admitted to shaking (the child) and hitting his head on the wall mirror” after he would not stop crying.
Police said the child’s mother then admitted that her husband told her what had happened earlier. She added that after the child’s head hit the mirror, Dillon Spade said he “threw (the child) on the bed and he bounced off the bed and onto the floor on top of (the other child),” police reported. Dillon Spade’s next court hearing is scheduled for Oct. 6.

Dillon Spade was booked into the Miami County Jail just after 6 p.m. on a single count of felony child endangering, according to online jail records.
Spade is believed to be the child’s father and there are no other children involved as far as police know, Troy Patrolman Tim Weaver said. Spade’s wife, believed to be 21, has not been accused in the investigation, the officer said.
Weaver said the case involving the 5-month-old began Monday night as a squad run to the Royal Inn Motel, on Brukner Drive.
The infant was taken to Upper Valley Medical Center for an apparent seizure, then transferred to Dayton Children’s Hospital. Weaver said a social worker from the hospital called police.
We’re told the injuries are believed to involve a skull fracture.
Weaver said police are not sure why the Spades were at the motel.
Spade remained in jail on Tuesday night, awaiting arraignment.

MEDINA, Ohio -- A Medina father accused of leaving his dead baby daughter in a crib for a month is facing additional charges.
A Medina County grand jury on Wednesday handed up a four-count indictment charging Eric Warfel, 35, with child endangering and possession of cocaine charges, according to court documents.
The new charges were added to the gross abuse of a corpse and tampering with evidence charges that Warfel already faced after a cable company employee discovered 1-year-old Ember's body in a crib in Warfel's apartment in the Forest Meadows complex July 29.
Warfel remains jailed on $1 million bond after he pleaded not guilty by reason of insanity to the gross abuse of a corpse and tampering with evidence charges.
The child's death remains under investigation, according to the Medina County Coroner's Office.
The new charges allege that on June 18, the day investigators estimate that Ember died, as well as on July 26-28, Warfel endangered a 7-year-old child whose name was redacted.
Warfel's father wrote in a letter asking Judge Christopher Collier to reduce his $1 million bond that Warfel's 7-year-old daughter "means everything to him."
The 7 year old has been in the custody of other family members since Warfel's arrest, officials said.
The new indictment also alleges Warfel possessed an unspecified amount of cocaine on July 28 and 29.
Detectives said in late July that they found what they suspected was cocaine in a room at a Middleburg Heights motel where Warfel had been staying in the days leading up to the discovery of the child's body.
Warfel's case is set to go to trial in November.

The new charges were added to the gross abuse of a corpse and tampering with evidence charges that Warfel already faced after a cable company employee discovered 1-year-old Ember's body in a crib in Warfel's apartment in the Forest Meadows complex July 29.
Warfel remains jailed on $1 million bond after he pleaded not guilty by reason of insanity to the gross abuse of a corpse and tampering with evidence charges.
The child's death remains under investigation, according to the Medina County Coroner's Office.
The new charges allege that on June 18, the day investigators estimate that Ember died, as well as on July 26-28, Warfel endangered a 7-year-old child whose name was redacted.
Warfel's father wrote in a letter asking Judge Christopher Collier to reduce his $1 million bond that Warfel's 7-year-old daughter "means everything to him."
The 7 year old has been in the custody of other family members since Warfel's arrest, officials said.
The new indictment also alleges Warfel possessed an unspecified amount of cocaine on July 28 and 29.
Detectives said in late July that they found what they suspected was cocaine in a room at a Middleburg Heights motel where Warfel had been staying in the days leading up to the discovery of the child's body.
Warfel's case is set to go to trial in November.

We posted on dad ERIC WARFEL earlier. Notice that the press is no longer mentioning that this POS had sole custody, much less delving into what POS judge gave it to him.
We've been previously told that the mother had drug problems too. Fine. But Daddy now claims he's crazy in addition to his OWN drug problems and basically being homeless.
Please explain to me just how it is the Killer Daddy is the superior parent. I'm not seeing it.

CLEVELAND — A man who told police he put bags of garbage in his young daughter’s room to mask the smell of her decomposing body was granted sole custody of the toddler during a divorce last year.
Eric Warfel, 34, of Medina, a suburb south of Cleveland, was ordered held on a $1 million bond on Thursday after being charged with abuse of a corpse. He was arrested on Wednesday after a cable television technician was allowed inside his apartment to upgrade the service and found the body of 21-month-old Ember Warfel in her crib.
A magistrate in Medina read from a report at the bond hearing that said Warfel told police Ember died on June 18 and he hadn’t informed family members or anyone else about her death. The report said Warfel had put garbage in the girl’s room to mask the smell and had moved into a motel with a 7-year-old daughter. Police found Warfel and the girl on Wednesday at a shopping center in the Cleveland suburb of Westlake.
An autopsy will be conducted to determine how Ember died. Additional charges are expected, police said.
Medina police said on Thursday that a substance suspected to be cocaine was found during a search of Warfel’s hotel room.
Warfel and his ex-wife, Malinali Galdamez, had another child who died. Five-month-old Erin Warfel died March 31, 2013, after being taken by paramedics to a hospital while in full cardiac arrest, according to an autopsy report. Her death was ruled as “sudden unexplained infant death."
Warfel and Galdamez married Feb. 14, 2012. A divorce decree indicates the 7-year-old has the same last name as her mother. The girl was removed from Warfel and Galdamez’s home before their divorce by the Cuyahoga County Department of Job and Family Services and moved in with Warfel’s parents.
Galdamez did not seek any parenting rights beyond limited visitations. There are numerous references in the divorce decree to her substance abuse problems. It was Galdamez’s fifth marriage and Warfel’s first. Medina Police Chief Patrick Berarducci said Galdamez lives somewhere in New York.
Prosecutors asked for a high bond because they consider Warfel a flight risk. The magistrate said Warfel had previously discussed moving out of state. He told the magistrate on Thursday that he last worked for an insurance company in 2012.

Whoa. What kind of father fights for custody of a baby who is not much more than a newborn--then abandons him?
A sociopathic control freak, that's who. A sociopathic control freak who obviously had no interest in actually raising a child but no doubt a lot of interest in terrorizing/punishing the mother.
But notice that the mother has been erased from this story totally. No explanation as to what happened to her, how Daddy gained custody, and who allowed this to happen.
And at this point, everybody is eager to push this baby into the foster care/adoption system. Even though we still don't know anything about the mother. Typical.

CLEVELAND, Ohio – Police are searching for the father of a 2-month-old baby who was found abandoned in an alley.
Authorities say the infant was found on the sidewalk by a passerby, who then called police.
John Dorsey was driving by the area with his children when he spotted the car seat.
He says he stopped the car and asked his son to make sure there wasn’t a child in the car seat.
“He walked up to the car seat, and he was like, ‘This is a baby, pops!’ So I just jumped back the car, and grabbed the baby and put him in the backseat,” Dorsey said. “It was like somebody threw the diaper bag out the window because all the stuff was scattered down the street. Yeah, so we had to like, pick everything up and put it in the bag once we put him in the car.”
Dorsey took the child home where he and his family cleaned up the baby and fed him until police arrived.
“Why? That’s all I want to know. Why would somebody do this? And he was a beautiful little baby,” Dorsey said.
The baby was taken to a hospital to be checked out before being placed in protective custody.
WJW obtained surveillance video that captured the baby being left behind by a car.
Officials say the boy’s father, DeShawn Holiday, had custody of the child at the time he was abandoned.
Now, a child endangerment warrant has been issued for his arrest.
Workers say the child won’t be in protective custody for long since there is already another family waiting to gain custody.
“I want him,” Dorsey said. “I do, my whole family wants that baby. We called him little brother.”
Dorsey, a father of four, says he hopes the child is healthy and knows he is lucky to have found the baby when he did.

Anthony B. Grove, 34, pleaded guilty to involuntary manslaughter, a first-degree felony. The original charge was murder.
He also pleaded guilty to a count of endangering children. Grove had faced up to 11 years in prison on the involuntary manslaughter charge.
Stark County Common Pleas Court Judge Chryssa Hartnett accepted the plea agreement Wednesday, explaining she supported it because it keeps the boy’s mother from reliving the tragedy during courtroom testimony.
Investigators initially reported the child’s name as Zeeland Grove but court records use a slightly different spelling of Zeland.
“I’m really sorry this happened,” the defendant said in court, adding that he didn’t intend to harm the nearly 2-month-old child.

Custodial dad charged with 1st-degre murder in death of 5-year-old son to appear in court (Bellefontaine, Ohio)
As often happens, a killer dad's custodial status is "forgotten" as time goes on. Earlier articles made it clear that dad ANTHONY BARTON, despite a history of domestic violence again the mother, was awarded joint custody. He then refused the mother access. Apparently those in authority did nothing to address the situation. And we still see that those who allowed this father to secure sole possession of the victim are not named or held responsible. THIS HAS GOT TO STOP.

Anthony Barton, a 24-year-old Bellefontaine man accused of killing his five-year-old son, Michael, remains jailed as early legal processes continue.
Accused of first-degree felony murder and second-degree felonies of felonious assault and felony child endangering, the defendant is set to appear Friday before Bellefontaine Municipal Court Judge Ann Beck.
Judge Beck’s job is to determine whether or not there is sufficient evidence to support the charges and to move the case on to the Logan County Common Pleas Court jurisdiction.
The defendant appeared Tuesday with his court-appointed attorney Marc Triplett, who declined Judge Beck’s invitation to comment on the suspect’s $1 million bond.
Logan County Prosecutor William T. Goslee attended the hearing in case Mr. Triplett decided to ask for a lower bond.
Friday’s hearing may give more insight into the severity of Michael’s injuries and a glimpse at what investigators believe happened May 18 at Skybree Schindler’s 1076 Heritage Court residence.
Mr. Goslee indicated after Tuesday’s appearance he would ask the Franklin County Coroner’s Office medical examiner who handled Michael’s autopsy to appear and provide testimony.
Michael was lifeless and limp around 12:15 p.m. May 18 when paramedics with the Bellefontaine Fire & EMS Department and officers of the Bellefontaine Police Department were called to Skybree Schindler’s 1076 Heritage Court residence.
He had sustained obvious signs of trauma and was transported by helicopter to Nationwide Children’s Hospital in Columbus.
By early May 20, he was dead. Preliminary autopsy results indicated Michael died from bilateral multiple blunt force trauma to his head, meaning he was hit on both sides of his head.
There is no indication a weapon was used, Mr. Goslee said, noting the suspect is a six-foot, four inch 240-pound mixed martial arts fighter who has done seven bouts.
Other obvious injuries from Michael’s lower back down exceeded the normal bounds of discipline, Mr. Goslee said, but did not contribute to Michael’s death.
Bellefontaine detectives continue to work on the circumstances of Michael’s death.
They have charged Ms. Schindler with felony obstructing official business as they believe she intentionally misled officers from the start.
She and the father were the only two in the residence.
The woman’s two daughters were at school and they have not provided any insight into Michael’s fatal injuries.
Mr. Goslee believes evidence supports the charges, noting there is nothing to indicate the father planned the child’s death nor intended to kill him.
“It doesn’t meet the standards for a charge of capital murder,” he said. “Prior calculation and design are not there.
“It is absolutely horrendous what happened to Michael and it may be worse than a capital murder case when you consider Michael’s truly tender age and the fact it was at the hands of his father, who was in a position of trust.”
If convicted of murder, the defendant would face 15 years to life in prison.
Mr. Goslee believes the case will be bound over to the common pleas court and he is preparing for grand jury in early June.
Autopsy work continues with the examiner focusing on trauma to Michael’s brain.
They are conducting tests that will take up to eight weeks to determine a history and extent of trauma while ruling out other possible causes for the boy’s death.
Michael was the son of Stephanie Hartline and her family is organizing a vigil from 7 to 9 p.m. Thursday at Mary Rutan Park’s Kaleidoscope Playground.
Brian Hartline, Michael’s grandfather, said the event is intended to provide an opportunity to show support for both the Hartline and Barton families.
No funeral services have been set for Michael.

Accused of first-degree felony murder and second-degree felonies of felonious assault and felony child endangering, the defendant is set to appear Friday before Bellefontaine Municipal Court Judge Ann Beck.
Judge Beck’s job is to determine whether or not there is sufficient evidence to support the charges and to move the case on to the Logan County Common Pleas Court jurisdiction.
The defendant appeared Tuesday with his court-appointed attorney Marc Triplett, who declined Judge Beck’s invitation to comment on the suspect’s $1 million bond.
Logan County Prosecutor William T. Goslee attended the hearing in case Mr. Triplett decided to ask for a lower bond.
Friday’s hearing may give more insight into the severity of Michael’s injuries and a glimpse at what investigators believe happened May 18 at Skybree Schindler’s 1076 Heritage Court residence.
Mr. Goslee indicated after Tuesday’s appearance he would ask the Franklin County Coroner’s Office medical examiner who handled Michael’s autopsy to appear and provide testimony.
Michael was lifeless and limp around 12:15 p.m. May 18 when paramedics with the Bellefontaine Fire & EMS Department and officers of the Bellefontaine Police Department were called to Skybree Schindler’s 1076 Heritage Court residence.
He had sustained obvious signs of trauma and was transported by helicopter to Nationwide Children’s Hospital in Columbus.
By early May 20, he was dead. Preliminary autopsy results indicated Michael died from bilateral multiple blunt force trauma to his head, meaning he was hit on both sides of his head.
There is no indication a weapon was used, Mr. Goslee said, noting the suspect is a six-foot, four inch 240-pound mixed martial arts fighter who has done seven bouts.
Other obvious injuries from Michael’s lower back down exceeded the normal bounds of discipline, Mr. Goslee said, but did not contribute to Michael’s death.
Bellefontaine detectives continue to work on the circumstances of Michael’s death.
They have charged Ms. Schindler with felony obstructing official business as they believe she intentionally misled officers from the start.
She and the father were the only two in the residence.
The woman’s two daughters were at school and they have not provided any insight into Michael’s fatal injuries.
Mr. Goslee believes evidence supports the charges, noting there is nothing to indicate the father planned the child’s death nor intended to kill him.
“It doesn’t meet the standards for a charge of capital murder,” he said. “Prior calculation and design are not there.
“It is absolutely horrendous what happened to Michael and it may be worse than a capital murder case when you consider Michael’s truly tender age and the fact it was at the hands of his father, who was in a position of trust.”
If convicted of murder, the defendant would face 15 years to life in prison.
Mr. Goslee believes the case will be bound over to the common pleas court and he is preparing for grand jury in early June.
Autopsy work continues with the examiner focusing on trauma to Michael’s brain.
They are conducting tests that will take up to eight weeks to determine a history and extent of trauma while ruling out other possible causes for the boy’s death.
Michael was the son of Stephanie Hartline and her family is organizing a vigil from 7 to 9 p.m. Thursday at Mary Rutan Park’s Kaleidoscope Playground.
Brian Hartline, Michael’s grandfather, said the event is intended to provide an opportunity to show support for both the Hartline and Barton families.
No funeral services have been set for Michael.

Insane that any judge would have granted dad MICHAEL G. BARTON any custody/visitation rights after he had had a history of domestic violence with the mother. Fathers like this are at a very high risk for violence against that mother's children--partly because Daddy is just a violent person and partly to hurt/punish the mother. The risk REALLY escalates when the father has powerful control impulses and cuts off the mother's access to the child, as happened here. Why didn't the authorities intervene before this little boy's brutal murder? We need to see a judge's name, and the names of the people who allowed this to happen.
Barton has been added to the Killer Dads and Custody list for Ohio.

An autopsy to be performed on Thursday may help Bellefontaine authorities determine how a 5-year-old boy died early Wednesday.
Just after noon on Monday, a woman called 911 seeking medical attention for her boyfriend’s son, Michael G. Barton.
“He’s 5 years old. He is not breathing and we’re not feeling a heartbeat,” Skybree Schindler said from her home in Bellefontaine.
Dispatchers instructed Schindler and the boy’s father, Anthony Barton, 24, also of Bellfontaine St., to perform CPR until medics arrived.
As Schindler talks to dispatchers, Barton can be heard in the background saying, “Come on buddy. We’ve done this before. Come on.”
The boy was taken to Nationwide Children’s Hospital where he was pronounced dead just before 1 a.m. Wednesday.
The Franklin County coroner’s findings are “likely going to yield more evidence and point us in the direction of how much trauma the child received before they called 911,” said Bellefontaine Police Chief Brandon Standley. “I think that the picture will become clearer to us.”
Authorities already know that the boy had welts on his body, said Bill Goslee, Logan County prosecutor.
Barton told police that “he was using a plastic wand common on blinds to open and close the slats" as a switch on the child, Goslee said.
“The child has numerous points on his body where corporal punishment exceeded the bounds of decency,” Goslee said.
That admission was sufficient to charge Barton with felony child endangering. He is in the Logan County jail and could face additional charges.

In 2011 and 2012, he was charged with domestic violence for attacks on Hartline, who has not seen the boy for several months, Goslee said.
“I always told Stephanie to be careful. He was a ticking time bomb,” said Stephanie’s father, Brian Hartline, 48, of Russells Point in Logan County.
Hartline was told to prepare for a funeral when he arrived at Children’s Hospital. “He was black and blue from the middle of his back to the bottom of his feet,” said Hartline.
His neck was broken at the base of the skull.
“What I saw it would have taken a big person to do. It wasn’t just a spanking. It was a complete beating.” Mr. Hartline will remember his grandson, who often pretended to be a policeman, “The most loving, best boy you’d ever meet in your life. He didn’t deserve what he got.”

HAMILTON, Ohio —The Fairfield father charged with fatally beating his 2-month-old son says he was insane at the time of the alleged crime.
Austin Morris, 23, was originally charged with felonious assault, aggravated assault and child endangering charges, which were upgraded to include a murder charge.
Morris’ son’s mother took the child to the hospital after she said he suffered a severe head injury. The baby was then transferred to Cincinnati Children’s Hospital, where he died.
Morris entered a plea of not guilty by reason of insanity Tuesday. His plea also asks for evaluations to determine his mental status at the time of the alleged beating.
Morris will appear before a Butler County judge Wednesday morning for arraignment on the murder charge.
