Deputies: Dad arrested in child exchange

A child exchange turned violent Saturday afternoon in Castella, resulting in the arrest of the biological father for investigation of attempted murder, domestic violence and child abuse, the Shasta County Sheriff's Office reported.
The female victim called for help about 4:35 p.m.only after she regained consciousness from being strangled by the father, Shea Montgomery, 40, according to the sheriff's office.
The woman told deputies she was assaulted and her life was threatened by Montgomery in the child custody exchange of their 14-month-old child, deputies said.
Deputies said Montgomery strangled the woman, telling her he would kill her, their child and himself.
The woman tried to break free by scratching Montgomery on his face and elsewhere, but she lost consciousness from being strangled, deputies said.
On regaining consciousness, she said she saw Montgomery walking away with their child, deputies said.
While deputies were en route to Castella in northern Shasta County, the sheriff's office contacted the California Highway Patrol for assistance. A CHP unit found Montgomery along with the woman and child, who was found safe and unharmed, the sheriff's office said.
Deputies met up with the CHP unit and put Montgomery under arrest and then took him to jail.

FLORENCE — A Florence man pleaded guilty in the death of his 13-month-old baby Thursday, while another man pleaded guilty to a lesser charge in connection with the sexual abuse of a teenage girl.
During a plea hearing Thursday before Lauderdale County Circuit Judge Mike Jones, Justin Matthew Green, 26, 502 Mars Hill Road, Florence, pleaded guilty to criminally negligent homicide in connection with the strangulation death of his child.
Pinkie Willard, 70, 4680 Lauderdale 36, Killen, who was indicted on charges of sexual abuse of a child under 12 and second-degree sexual abuse, pleaded to the lesser charge of third-degree assault.
Lauderdale County District Attorney Chris Connolly said both cases were scheduled for trial next week.
Agrees to plea
Green was arrested in July 2014 on charges of criminally negligent homicide. In November of that year, the grand jury upgraded the charges to manslaughter.
Criminally negligent homicide is a Class A misdemeanor and is punishable by up to a year in prison.
Jones said he will sentence Green at 1:30 p.m. Sept. 24.
Lauderdale County Assistant District Attorney Will Powell said Green entered the plea Thursday after discussions with the victim’s family.
Investigators said Green was living with the baby’s mother and her two other children, who were 4 and 6, when the death occurred.
During the hearing, Powell said on Aug. 7, 2013, Green was supposed to be watching the children. He said the baby was found in her crib with a cord from a toy remote control car wrapped around her neck.
“During the course of the investigation, no evidence was discovered to indicate the cord was intentionally put around the baby’s neck,” Powell said.
A preliminary autopsy noted the state medical examiner declared the cause of death as asphyxiation and the manner of death as “accident.”
“There is dispute on how the toy got in the crib,” Powell said. “We believe (Green) put the toy in the crib to stop the baby from crying. One of the children said they put the toy in the crib, but the child has told different stories to different people.
“At the end of the day, Green was the adult there at the time, and this happened on his watch. It was his job to watch the children. He was negligent, and the baby died.”
Green then admitted to Jones he was negligent.
“He did not put the toy in the crib, but we are here today to accept responsibility for being negligent,” his attorney Tony Hughes said.
The baby’s grandmother, Tammy Cole, who attended the hearing, said she believes Green put the toy in the baby’s crib.
“And only God will make me believe any different,” said Cole, who was noticeably upset with the plea.
“I don’t like this anymore than you do,” Powell said. “But as we have talked, under the circumstances, this is a result that has some consequences.”
Sexual abuse case
Willard was accused of inappropriately touching the girl, who was 13-14 at the time.
“This was done with much discussion with the victim’s family,” Powell told Jones. “Instead of having the victim go through the trial process, they ask you to accept the plea.”
As a part of the plea agreement, the charge of sexual abuse of a child under 12 was dismissed and Willard pleaded guilty to third-degree assault, a misdemeanor, the lesser offense than second-degree sexual abuse.
“The family felt putting the victim through the trial would do more harm than good,” Powell said.
“I understand that. Hopefully, this will be an answer to the family’s wishes,” Jones said.
The judge then sentenced Willard to 12 months in the county jail, which was suspended for two years. He was placed in the Lauderdale County Community Corrections Program for two years, and he must register as a sex offender and have no contact with the victim or her family.

A funeral was held Satruday morning to mourn the loss of Shaung Liu and her son, 5 month old Archer Liu. A vigil is scheduled to follow and will be held at the Jacksonville Commons Park.
The Liu's were found and pronounced dead by deputies near their Hunter's Creek home in Jacksonville on July 18th. Liu's boyfriend Sebastian Mendez was charged with the murder of both mother and baby.
A spokesman from the Jones Funeral Home in Jacksonville said the family received friends between 9:30 and 10:30 this morning. The funeral service started at 10:30 and drew a crowd of more than 100 people. The vigil starts at 8:30.

Disturbing new details about this past weekend's double homicide in Onslow County have been released.
Shuang Liu and her five-month-old son, Archer, were found Saturday. The baby's father, Sebastian Mendez, has been charged with two counts of murder.
Miller says the baby was found in a suitcase that was in the attic of the woman's Hunter Creek home. He died from a lack of oxygen, according to the sheriff.
The mother was found dead in a car parked three blocks away. The sheriff says she had been strangled.
Deputies were first called to the home that morning after Mendez reported he had been stabbed. After deputies discovered the bodies, they went to the hospital where they say Mendez was about to get into a cab.
He remains jailed without any bond.

PULASKI — After Howard Cole killed his infant son, he placed the body in his car and drove to purchase alcohol. He began drinking as he drove around looking for a place to bury Cory Cole’s 5-month-old body.
Cole signed a plea agreement Thursday which will spare his life: He pleaded guilty to the capital murder of his son and was sentenced to life in prison. He could have faced the death penalty if the case had gone to trial.
He was sentenced to an additional five years after pleading guilty to unlawful concealment of a body.
Cole, 33, listened as prosecutor Mike Fleenor described the details of the night Cory was murdered.
It was cold on that night – Jan. 29, 2014. Temperatures dropped to single digits. After driving for several miles, Cole pulled off Draper Valley Road a short distance from Interstate 81’s Exit 89. He walked almost 600 feet from the roadside to a line of trees where he began digging, though not very deep since the ground was frozen solid from the winter weather.
He buried his naked son less than a foot in the ground and pushed a pile of dead leaves over the burial site at the base of a tree.
The next day, authorities arrested Cole on a charge of felony child neglect, but did not know where Cory’s body was, Fleenor said on Thursday in court.
As they questioned Cole, detectives said, “We know your son is dead. We need you to help us find him. Is he in the water?” they asked.
“No,” Cole responded.
“Is he in the ground?” the detectives asked.
Cole nodded and said, “Yes.” After more questions, Cole told investigators, “I’ll take you to him.”
Investigators found Cory’s body on the south side of Draper Mountain. They later found a pair of infant pajamas in a trash bin in Pulaski. The garment was forensically analyzed and tested positive for both Cory and Howard Cole’s DNA.
Cole was indicted by a grand jury in April 2014 on a capital murder charge. Fleenor’s office said at that time the death penalty would be sought.
Fleenor did not comment in court Thursday about why his office accepted the plea deal.
According to Medical Examiner Amy Tharp’s autopsy report, Cory had 26 bruises on his head and neck. Blunt force injuries and asphyxiation by strangulation were declared as the cause of death.
Cory was reported missing Jan. 29, 2014, by his mother, Samantha Warden, who told police that Cole, her fiance at the time, had left with the child. She signed an arrest warrant affidavit on that same day, after she witnessed Cole pick Cory up and yell, “Shut the -- — up,” before throwing him 4 feet onto a nearby bed.
Warden, 30, was charged with felony child neglect in Cory’s death. She pleaded no contest in April and is serving a seven-year prison sentence.
Custody agreements stated that Cole was not supposed to be alone with the boy, but on Jan. 29, he and Warden argued and she left the baby with him.
Cole sat with his defense attorneys Jimmy Turk and Steve Milani during Thursday’s hearing. He answered Circuit Court Judge Marc Long’s questions almost entirely with either a yes or a no.
Only a handful of people sat in the almost empty courtroom — a different scene from the full courtroom when Warden was sentenced.
Long, who has often been vocal in cases regarding child abuse, made no comment to the defendant.

VINTON | A Vinton man who assaulted a woman and held his two children captive Thursday has been charged with domestic abuse assault and child endangerment.
According to a release from the Vinton Police Department, officers with the Benton County Sheriff’s Office and Vinton police responded to a call of a man breaking things in a rage at 820 E. Fourth Street.
Police said upon arriving at the scene, the man, identified as Joshua Carl Hendryx, 34, had shut himself in the home alone with his two children, a 5-year-old and a 20-month-old.
Hendryx had assaulted the mother of the children, who had abrasions, bruises and scratches to her head and torso from being punched, choked and thrown against the wall and furniture, police said.
Police said Hendryx refused to allow the children to leave the house and would not cooperate with officers.
Police said the 5-year-old was able to escape the home unharmed. Police then entered the residence and found Hendryx holding the 20-month-old, shielding himself from police. Police said he remained highly agitated and refused to hand the child to officers despite their efforts to negotiate with him.
Police eventually were forced to physically control Hendryx while attempting to remove the child. Hendryx continued to fight back and police deployed a Taser.
Police said during the brief struggle Hendryx placed the child in the path of one of the four Taser probes that were fired. Three of the probes hit Hendryx, but one probe struck the child in the left foot. Officers were then able to remove the child and take Hendryx into custody.
The child was treated at Virginia Gay Hospital and then transferred to the University of Iowa Hospitals and Clinics, where the probe was successfully removed. There were no complications with the removal of the probe and no other signs of injury to the child.
Hendryx was taken to the Benton County Jail. He has been charged with domestic abuse assault and child endangerment, both class D felonies, and interference with officials acts, a simple misdemeanor.

EASTPOINTE, Mich. (WXYZ) - An Eastpointe man has been charged with 3 counts of felony murder following the deaths of his wife and two children.
Timothy Fradeneck appeared in court to face the charges Wednesday afternoon. Loved ones on both sides of the family were in the courtroom. Fradeneck was also charged with four counts of child abuse.
He's accused of strangling his 37-year-old wife Christie Fradeneck, 2-year-old daughter Celest and 8-year-old son Timothy. According to police, Fradeneck told police he used a USB cable to strangle his family as they slept. Investigators say he told them he'd been planning the murders since August of 2014, but carried it out late Sunday night because "the opportunity presented itself". They say they still don't know the motive for the murders.
The wife and two children were found dead in their home on Monday, April 13 in the 22000 block of Cushing Avenue.
The judge entered a plea of not guilty on Fradeneck's behalf. When the judge asked him if he had anything say, he muttered that he would like to plead not guilty by reason of insanity. The judge advised him that he would need to take that up with an attorney.
Christie's husband, and the father of the two kids, was arrested at the house without a fight. Police had responded do a welfare check. Timothy Fradeneck answered and told police his family was sleeping. The police officers said they needed to see them. After a few moments, police say Timothy Fradeneck confessed. He is now being held without bond.
"We've got families trying to prepare for funerals of a 2 year-old and an 8 year-old. No one should ever have to do that. No family should ever have to do that .. That's outside of my area of expertise, but what is in my area of experties .. is ensuring this defendant pays for what he did .. and we will ensure that," says Eric Smith, Macomb County Prosecutor.
Court records show the husband and wife had a chapter 7 bankruptcy in 2011. Christie was a part owner of a salon and had a Michigan Cosmetology license. The records show her husband was unemployed for a couple of years.
A family friend says his parents owned the home in which they lived.
Court records also show the husband had a domestic assault case in 2009 involving his own brother. It was pleaded down to a fine and one year probation.

Though much is made of the mother's substance abuse issues, note the following: "Broward County child protection investigators discounted the possibility of abuse and left him with a father who had a lengthy rap sheet — including aggravated assault charges — and a history of alleged drug use." Oh, so a dad with substance abuse issues AND a history of assault is a fitter parent than a mom with just a history of substance abuse? Right.

His body was stuffed into garbage bags tucked inside a box in a laundry room. Wednesday, police announced that his stepmother and father had been arrested in connection with his death.
The body of Ahziya Drew Osceola was found in the family's residence in the 5400 block of Johnson Street.
His stepmother, Analiz Rodezno Osceola, 24, was charged Wednesday with aggravated manslaughter; child neglect and providing false information to law enforcement, Hollywood police said.
Her husband of 10 months, Nelson Drew Osceola, 24, who is the child's father, was charged with child neglect, according to the agency.
The father and stepmother of a toddler who was reported missing and later found dead Thursday in his Hollywood home face charges after their arrests Wednesday, police said.
Nelson Osceola was freed on a $50,000 bond from Broward County's main jail Thursday morning.
His wife remained behind bars with a $230,000 bond after appearing in court.
"In his first three years of life, he endured what we believe to be a significant amount of pain," Hollywood Police Chief Frank Fernandez said during a press conference Wednesday. "No child should ever, ever endure this life, the life of little Ahziya."
The cause of the child's death, ruled a homicide, was from blunt impact abdominal trauma, according to the Broward Medical Examiner's Office.
Ahziya's body was wrapped in plastic bags and found inside a Baby Einstein toy box in a laundry room, according to police. A search warrant said two bags of clothing were on top of the box.
His face and body were bruised; his pancreas was broken into three pieces. Enzymes from that organ were let loose and were breaking down internal organs, the medical examiner's office said.
The autopsy also found a spiral fracture of the child's left shin bone that was probably an old break. The medical examiner's office estimated Ahziya died late Wednesday night or Thursday morning.
Rodezno Osceola checked into a psychiatric ward March 20 for reasons authorities did not disclose. The couple were taken into custody Wednesday at a Fort Lauderdale hospital after Rodezno Osceola had been discharged, Fernandez said.
The deceased child's father and mother, Karen Cypress, 26, are members of the Seminole Tribe of Florida. Cypress lives elsewhere in Hollywood as well as on the Big Cypress Seminole Indian reservation in Clewiston. Her son was buried there Sunday, said Kenneth Tommie, the child's maternal grandfather.
He called Ahziya "an outgoing boy" who loved to play with classmates at the Seminole preschool on the reservation in Hollywood.
After a court hearing Monday, when the couple were temporarily barred from visiting two other children who had been removed from the home, Nelson Osceola was asked what happened to the baby.
"I just buried my son yesterday," Osceola said. "I'm just trying to find peace with myself right now, you understand? My son is gone."
The investigation began at 11:48 a.m. Thursday when Seminole Police called Hollywood Police to report that the child was missing from the house, Fernandez said.
Rodezno Osceola told detectives she last saw the boy in the house that morning about 10 a.m. and found the back door ajar, her wallet containing $160 gone and an additional $3,000 missing, Hollywood Police spokeswoman Officer Meredith Elrich said.
That prompted simultaneous investigations of a possible abduction and a search for the missing child, Fernandez said. Those efforts, including bloodhounds to track the child, were canceled when the body was found.
"There were many details [Rodezno Osceola] discussed, some of which were contradicting," Fernandez said. "She knew the child was injured [and needed medical attention.]"
From the report of Ahziya's disappearance and the discovery of his body inside the house about 12 hours later, Fernandez said his agency, Seminole Police, Broward Sheriff's deputies and Community Emergency Response Team volunteers did a "2- to 3-square-mile area" search.
During Ahziya's short life, there were four reports to the Florida Department of Children and Families hotline, according to the department. Three described injuries and allegations of harm that prompted home visits, doctor exams, interviews with teachers and relatives, counseling and training for the parents. But physical abuse allegations were not substantiated.
Ahziya had a purple bruise on his left cheek that was blamed on a fall onto a wooden bed frame, an August 2013 report said.
In April 2014, fingerprints and a bruise on the lower side of each jawbone, scratches on both sides of Ahziya's neck and bruises on his left back ribcage were observed, a report states. His father attributed some of the marks to a fall in the bathroom and rough play with kids at an Easter party, and said his son fell all the time.
A bruise and abrasion were noticed beneath Ahziya's eye in December 2014. The child's bottom was also sore. His mother took him to an emergency room doctor who found small abrasions in his rectum that could have been from constipation, a report said. He was otherwise described as "very happy, rambunctious and talkative" and denied being harmed by anyone.
A fourth report said child investigators determined there was inadequate supervision and medical neglect when in January 2014 Ahziya left his mother in a fifth-floor hotel room, got into an elevator and was found in the hotel lobby. Karen Cypress was arrested and pleaded not guilty to criminal charges including child neglect. The case is open, according to Broward court records. The boy was placed with his father and Cypress was allowed to visit her son.
State reports listed investigators — from the Broward Sheriff's Child Protection Investigation Section, who work on behalf of DCF; the medically oriented Child Protection Team and Seminole Family Services — that had looked into allegations of abuse of Ahziya.
"There is no fail-safe system, other than a responsible parent," Fernandez said.

ALLEGAN, MI -- A 22-year-old Allegan man is now charged with murder after his 3-month-old son died in December from what police allege was abuse.
Allegan County prosecutors recently added charges of open murder and felony murder in the case against Jonathan Joseph Colby.
He initially was charged with first-degree child abuse after the child died Dec. 3.
The case had been on hold pending the results of a psychiatric exam.
Earlier this month, Colby was found competent to stand trial.
Allegan County sheriff's detectives say a medical examiner determined his son, Jase, suffered a cracked skull and injuries consistent with strangulation and suffocation.
In an interview with detectives, Colby admitted to hitting, slapping and choking Jase on several different occasions, including the night that Jase died, detectives said. Colby allegedly hurt his son because he was tired and frustrated.
An April 14 probable cause hearing is scheduled for Colby in Allegan County District Court.

PORT ST. LUCIE — A Port St. Lucie man took his own life Wednesday night after he first tried to strangle his 7-year-old daughter, city police said.

Police are investigating the incident as a suicide and an attempted murder, authorities said Thursday. Officers were called shortly before 9 p.m. Wednesday to a Southwest Newport Isles home. According to a police report released Thursday night, Botta was found dead on the living room floor in front of the sofa.
A kitchen knife was lodged just between his chin and several zip ties and a USB cable were tightened around his neck, indicating an attempt at self-asphyxiation, the report said.
The officers found a 7-year-old girl who had injuries that were consistent with an attempt at strangulation, the report said. The girl told officers her father was making her a necklace and used a string to measure her neck. The girl said her father pulled the string too tightly, causing her pain.
The girl had heavy bruising on her neck and discoloration in her eyes, nose and mouth. It was not clear if she was conscious when Botta committed suicide, police said.
Police found a suicide note addressed to Botta’s estranged wife. After returning to the home, Botta’s wife told police she and Botta were in the process of separating. His wife said Botta had a history of medical issues, but had never exhibited violent behavior toward her or the children in the past.
The woman said she left Wednesday night to pick up two children from a church where the children also attend school. She received a call from the 7-year-old girl and called 911. The woman hurriedly retrieved the other children before returning home, police said. She told police she and Botta had recently argued about child-custody arrangements once their separation became final.

Police found a suicide note addressed to Botta’s estranged wife. After returning to the home, Botta’s wife told police she and Botta were in the process of separating. His wife said Botta had a history of medical issues, but had never exhibited violent behavior toward her or the children in the past.
The woman said she left Wednesday night to pick up two children from a church where the children also attend school. She received a call from the 7-year-old girl and called 911. The woman hurriedly retrieved the other children before returning home, police said. She told police she and Botta had recently argued about child-custody arrangements once their separation became final.

A young father who strangled his two sons and then sent a picture of a dead body to their mother will not face execution.
Gabriel Armandariz, 32, of Graham, Texas was sentenced to life in prison without parole on Thursday at Young County Court.
Armandariz killed his two sons, Gatlin, two, and Luke, who was just eight-months-old in April 2011 before sending a string of chilling text messages to their mother, Lauren Smith.
One of the messages included a graphic image that appeared to show Luke dead, dangling from the closet held by cloth attached to his neck.
While he will not be put to death, defense attorneys insist he will have a miserable life in prison.
Armandariz was convicted of the murders on February 27 which was followed by four weeks of testimony that the court heard before deciding his fate, according to the Graham Leader.
The jury decided to spare him his life after stating there were mitigating circumstances to not execute him.
The father was deemed too dangerous to society to live by prosecutors from the attorney general's office, according to the Star-Telegram.
Earlier in the trial, prosecutor Tom Cloudt said: 'Gabriel is a lying, manipulating baby killer, and the evidence has shown this. 'Luke is dead, and Gabriel is trying to get a beer. Gabriel is not concerned.'

What a country. Mothers of five children--including a 3-month-old baby--forced to work to support their families while apparently deadbeat "stay-at-home" fathers like this one abuse the kids. Looks like this charming fellow basically abused this baby from birth, given the evidence of the healing injuries. The other kids say he strangled the baby for crying too. What a useless piece of crap.
But really what were the mother's options here given the cuts in social services and the high cost of daycare? Not to mention potential custody fights by this loser.

St. Petersburg, Florida -- A St. Petersburg man is behind bars, accused of abusing his 3-month-old son. Police say on Wednesday, the infant was brought to All Children's Hospital by his mother with what was later determined to be a broken arm.
The mother says she was at work when she got a call from her husband, 24-year-old Norman Williams, telling her their baby had fallen off the bend and appeared to be injured.
Further examination of the child revealed he also had multiple rib fractures that were in different stages of healing.
Investigators went to the Mosley Motel, where the family was staying, to speak with Williams. At the motel, police found he him in custody of five other children -- ages 1 through 8 -- two of whom had bruises all over their body.
Those children, ages 5 and 6, stated they got the injuries after Williams struck them with a belt. Two of the children also stated that they saw Williams strangle the baby victim when he wouldn't stop crying.
All children were taken into the protective custody of DCF.
Williams was arrested and charged with one count of aggravated child abuse and two counts of child abuse.
But really what were the mother's options here given the cuts in social services and the high cost of daycare? Not to mention potential custody fights by this loser.

BAY CITY, MI — A 25-year-old Bay City father who abused his infant daughter is heading to prison for up to the next three decades.
Bay County Circuit Judge Harry P. Gill on Monday, Jan. 26, sentenced Garrett D. Gwizdala to concurrent prison terms of 10 to 15 years and 15 to 30 years' imprisonment. The judge gave him credit for 214 days already served.
Gwizdala in November pleaded no contest to single counts of first-degree child abuse and assault by strangulation. The former is a life offense, while the latter is a 10-year felony.
In exchange for his pleas, the prosecution dismissed one count of second-degree child abuse.
Gwizdala's charges stem from an incident that occurred at his residence in the 3400 block of North Euclid Avenue the afternoon of Wednesday, June 25. According to police, Gwizdala called 911 at 5:32 p.m., requesting medical attention for his 3-month-old daughter, who was not breathing.
A Bay County Sheriff's deputy also responded to the house. Gwizdala initially said he was lying on a couch with the baby on his chest, and that the child fell off and landed face-down on the floor, Undersheriff Troy Cunningham previously said.
"He later made admissions to what really happened, and we learned his original story was completely false," Cunningham said, adding the child's mother was not home at the time of the alleged incident.
Cunningham said Gwizdala told detectives he knowingly hurt the child. Gwizdala told detectives he obstructed the child's breathing and was upset because she wouldn't stop crying, Cunningham said.
The baby was taken via ambulance to McLaren Bay Region hospital and later transferred to Covenant HealthCare in Saginaw for further treatment. Cunningham said the baby also had injuries that indicated prior abuse.

On Friday, 22-year-old Jonathan Colby was arraigned on a first-degree child abuse charge.
Records show 3-month-old Jase Colby died of blunt force trauma to the head, and his father has admitted to striking the baby while under the influence of drugs and alcohol.
In court on Friday, Colby looked down as the judge read his charge.
3-month-old Jase Colby was taken to the hospital on Wednesday after he was found unresponsive in his crib.
Shortly thereafter, the baby was pronounced dead.
Records show that the death was no accident.
In the course of their investigation, detectives were informed that Jase had a cracked skull "and injuries consistent with strangulation and suffocation."
Detectives later interviewed Jonathan, who admitted to abusing his son. If convicted, Jonathan Colby could face up to life in prison.
The Allegan County Prosecutor says that child abuse charge could be modified later, as they are still waiting on a final determination from the medical examiner.

Authorities originally charged Justin Green with criminally negligent homicide, but a Lauderdale County grand jury thought the evidence warranted a more serious charge.
The district attorney presented the case to a grand jury last week, and they decided to upgrade the father's charges to manslaughter.
According to the police report, Justin Green told investigators the little girl got wrapped up in a cord from a remote-controlled truck last August.
Investigators said Green was the only adult at the home.
They said he had two other small children inside the Hermitage Hills apartment at the time.
An autopsy found marks around the child's neck, but investigators said evidence from the crime scene suggests it was more than just an accident.
Lauderdale County Assistant District Attorney Will Powell said it was always their intention to present this case to a grand jury, but says these types of cases take time to fully investigate.
"It's hard to believe from the evidence that's available in this case that this was just an accident," Powell said. "It's the state's intention to hold the adult that was in charge of those children responsible for that child's death."
"This is a tragic case. A... child was strangled and somebody needs to be held accountable," he added.
Justin Green is out of jail on a $10,000 bond. An arraignment date has not yet been set.

Jury selection in the trial of Garrett D. Gwizdala is to begin the morning of Tuesday, Dec. 2, before Bay County Circuit Judge Harry P. Gill. In the event that date doesn't work out, the trial will instead commence Tuesday, Jan. 13.
Gwizdala is charged single counts of first- and second-degree child abuse and assault by strangulation. First-degree child abuse is punishable by up to life imprisonment, while the other two counts are 10-year felonies.
Earlier in October, prosecutors made Gwizdala the offer that if he pleads guilty or no contest to first-degree child abuse and assault by strangulation, they'll dismiss the second-degree child abuse charge.
Gwizdala's charges stem from an incident that occurred at his residence in the 3400 block of North Euclid Avenue the afternoon of Wednesday, June 25. According to police, Gwizdala called 911 at 5:32 p.m., requesting medical attention for his daughter who was not breathing.
A Bay County Sheriff's deputy heard the call go out and responded to the house as well. Gwizdala initially said he was lying on a couch with the baby on his chest, and that the child fell off and landed face-down on the floor, Undersheriff Troy Cunningham previously said.
"He later made admissions to what really happened, and we learned his original story was completely false," Cunningham said, adding the child's mother was not home at the time of the alleged incident.
Cunningham said Gwizdala told detectives he knowingly hurt the child. Gwizdala told detectives he obstructed the child's breathing and was upset because she wouldn't stop crying, Cunningham said.
The baby was taken via ambulance to McLaren Bay Region hospital and later transferred to Covenant HealthCare in Saginaw for further treatment, according to police reports. Cunningham said the baby had injuries that indicated prior abuse.
Gwizdala previously served a three-year probation term after pleading guilty to second-degree home invasion, a crime he committed in October 2008. He was discharged from probation on Feb. 1, 2012.

BAY CITY, MI — If he doesn't accept a plea offer beforehand, a 24-year-old Bay City father charged with a life offense in his baby daughter's alleged abuse is set to face a trial.

BUCKEYE, Ariz. -- A Buckeye father has been arrested on suspicion of assaulting his 14-year-old son over grades.

The officer says he observed fresh bruises and marks on the left side of the teen's neck, according to the police report. The teen said he tried to punch his dad in self-defense. The fight moved upstairs, where the teen said he was thrown onto a bed.
The teen also told police his father punched him with a closed fist on his back. The victim said that once they heard police arriving, the attack stopped. According to court paperwork, the teen said fights like this one have occurred in the past, but have been escalating.
Covarrubias was booked into jail on charges of child abuse, aggravated assault of a minor and disorderly conduct.

If Garrett D. Gwizdala, 25, pleads guilty or no contest to single counts of first-degree child abuse and assault by strangulation, prosecutors say they'll dismiss one count of second-degree child abuse. First-degree child abuse is a life offense, while the other two charges are 10-year felonies.
The plea agreement stipulates that Gwizdala would also be subject to a habitual offender, second offense, sentencing enhancement.
Gwizdala on Friday, Oct. 3, waived his right to have a preliminary examination in Bay County District Court and was bound over to Circuit Court. No date has been set there, either for Gwizdala to plead or face trial.
