Abuser dad gets case transferred to...Veterans Court? (Orange County, California)

Remember this case from last summer? Dad SLOAN STEVEN BRILES, the one who threw his son off a boat during his visitation? Well, he's having his felony child abuse case transferred to...Veterans Court.

I've heard of child abusers who get the their cases transferred to family court--where they're often dismissed. But I've never heard of a child abuser getting their case transferred to Veterans Court.

​Sloane Steven Briles, the Irvine father accused of tossing his crying 7-year-old son off a Newport Harbor cruise boat in August, will reportedly face the criminal music next month in Orange County's Veterans Court.

The 35-year-old, who was scheduled to enter a plea today in Orange County Superior Court to child endangerment and resisting arrest charges, had his case moved to the special court created in 2008 for military veterans dealing with mental-health issues.

The Orange County Register's Doug Irving reports today that the Veterans Court will hear the case in early December. The reporter cites Briles' Facebook page stating that the defendant served as a sergeant in the U.S. Marines between 1995 and 2000.

On Aug. 28, Briles was aboard The Queen with his girlfriend and two young sons he had with his ex-wife when, according to prosecutors, he began poking the older boy in the chest and repeatedly slapped his face. When the lad cried and asked his allegedly intoxicated father to stop, Briles is accused of tossing the child 10 feet overboard into the drink.

The ship's first mate reportedly had to stall the engines to avoid hitting the youngster treading water in front of the vessel. Several surrounding boaters jumped in after the boy, as did Briles before, his accusers claim, he swam away.

The case became a local sensation, with Briles trying to explain away via the media that he was not drunk, that he and his son were only playing a game where the boy pretends to cry and that his child was never in danger having only been tossed into the harbor's "shallows."

The Orange County Sheriff's Harbor Patrol, the Orange County District Attorney's office and several witnesses have begged to differ. Briles was charged with a felony child abuse and endangerment count and a misdemeanor resisting an officer count and was looking at up to six years in state prison.

He made his $100,000 bail and pleaded not guilty at his his original September arraignment hearing, which at the time was continued to today. That hearing was postponed to move the case to Veterans Court.

The latest post on Briles' Facebook page, from mid-November, reveals he was approaching 60 days of sobriety after a Veterans Affairs treatment program "so u can call me 'sobie-wan-kenobi.'" It will be interesting to see in Veterans Court whether Briles changes his story, admits to wrongs and, like Obi-Wan, ultimately falls on his lightsaber.

RAMONA, Calif. -- A six-year-old boy who was blind and in hospice for a long while passed away in Ramona early Tuesday, which might mean a homicide charge against his father who has been in prison for shaking him as an infant and causing his physical ailments, according to the boy's adopted sister.

The child, identified as Sam, never recovered from being shaken as an infant and was adopted at 2 months old into a family of five other adopted special needs children and seven biological children, according to the boy's sister through adoption, Barbara Smith.

Smith said Sam died in his sleep and was unable to be revived by paramedics.

Investigators were called out to the residence in the 1000 block of Olive Avenue in Ramona at about 1:15 a.m., according to sheriff's Lt. David Gilmore.

San Diego County sheriff's detectives are believed to be investigating as part of the case against the boy's father.

A father killed his toddler son in Romford in the 30 minutes he was left alone with him, the Old Bailey has heard.

Fletcher Allen was found collapsed after his father Nathan Allen called partner Danielle Hands to return home.

The 14-month-old had been struck in the abdomen and died from internal bleeding.

Allen, 27, of Erith Crescent, Romford, Essex, denies murdering Fletcher in January but admits his manslaughter.

Richard Whittam QC, prosecuting, told the jury it must decide Allen's intention when he struck the child.

Fletcher had been left with Allen in the morning while his mother went to visit her family. Half-an-hour later, Allen sent a message for her to return.

"Danielle Hands saw Fletcher lying naked on their bed with his eyes closed," said Mr Whittam. Allen had then telephoned for an ambulance, telling the operator: "I've left my son in the bath and he's slipped and he's... I can't wake him up."

He had kept up the lies to police, insisting he left the boy for a few moments and then found him lying in the water.

The toddler had been taken to hospital but was pronounced dead. He had a bite mark which matched Allen's teeth on his right cheek. Mr Whittam said Fletcher did not drown in the bath. He had been struck so hard that his kidneys had been damaged.

"This defendant admits he assaulted the child and as a result of that assault, the child died," added Mr Whittam. The trial was adjourned to Wednesday.

Why is it called "endangering" when dad JONATHAN DOMINQUEZ almost killed this baby? Moms get nailed for endangering by having a dirty house or for running out to get a gallon of milk and leaving the toddler at home. Shows you how low the threshhold is for daddies. Had this been a mom, I'm pretty sure we would have been looking at an assault charge.

Notice that this assault took place during the weekend, which was Daddy's time to play caregiver while Mom worked. Another testosterone-fueled dude who couldn't stand a crying baby....

Father, 24, found guilty of child endangering

Jonathan Dominguez was tired, and his young son would not stop crying.

But instead of walking away, he grabbed the infant and one day squeezed him until he broke three ribs and the next day shook him, causing a brain injury, a Lucas County assistant prosecutor said.

Dominguez, 24, pleaded no contest and was found guilty in common pleas court Monday to one count of child endangering. He faces up to eight years in prison when sentenced Dec. 28 by Judge Gene Zmuda.

Initial reports were that the injury was fatal, and [the child] was transferred to Hospice,” Assistant Prosecutor Kevin Pituch said. “In a turn of events that could be described as miraculous, the child survived and is now home.”

The extent of his longtime injuries is still unknown, Mr. Pituch said.

Dominguez was arrested Aug. 15, a day after his then-4-month-old son was taken to the hospital with bruising and brain injuries. He has been in custody since his arrest.

Mr. Pituch said that Dominguez lived with his son, Averik, and the baby’s mother, Miranda Hughes, on Stirrup Lane. On Aug. 11, just three days before he was admitted to Toledo Children’s Hospital, Averik was given a clean bill of health by his physician at his regularly scheduled check-up, Mr. Pituch said.

Dominguez worked full time during the week, and Ms. Hughes worked weekends, Mr. Pituch added. It was on the weekend during Ms. Hughes’ work shifts that Dominguez was the sole caregiver of the infant.

“The defendant was tired, and Averik would not stop crying,” Mr. Pituch said.

On Aug. 13, Dominguez squeezed the child with enough strength to leave bruises on his back and fracture three ribs. The next day, he shook Averik with such force that it caused bleeding on the brain, Mr. Pituch said. When interviewed by police, Dominguez admitted both instances of abuse, he added.

Attorney John McMahon said after the hearing his client was “kind of shocked” by what he had done, noting that Dominguez had no previous criminal record. He said his client knows he should have just walked away.

“He’s very remorseful. He wishes the best for his son, and he hopes someday that he can have a relationship with his son,” Mr. McMahon said.

A two-month old child was dropped onto an open oven door causing burns to both of the infants arms as well as its head on Saturday, according to a Lexington Police report.

Police received a report fat 6:50 p.m. Saturday that a 2-month old child had been burned. The father of the child was holding the child after consuming alcohol when he dropped the child on the oven, according to the report.

"He tripped and dropped the baby on the open oven door," Lexington Police Lt. Robby Rummage said.

The child's mother made the report of the incident that occurred on Mendota Avenue.

The child was transported to Brenner Children's Hospital and Child Protective Services was contacted. Rummage said Tuesday that the child had been released from the hospital.

An arrest had not been made in connection to the incident on Tuesday. The Lexington Police Department is continuing its investigation into the incident

OKLAHOMA CITY -- Oklahoma City police say a metro man took his daughter and her sister along for a night of drinking and doing drugs.

According to a police report, Michael Sparks, 33, took the children and their mother’s GMC Jimmy sometime during the day on November 13.

The children’s grandmother became worried and started driving around looking for the children. The children's mother called Sparks and though he would not say where he was, she heard Mexican music playing in the background.

Using that information, the grandmother drove to the Rio Bravo Bar at 712 South Walker Ave.

She said she found her daughter's SUV there with the two girls inside.

One of the girls told investigators that her father took them to McDonald's to get something to eat, then to a friend’s house where the girl believed her father smoked marijuana.

After that, they drove to the bar where Sparks left them in the vehicle while he drank beer, according to police.

The girl said her father would occasionally check on them but they were starting to get scared because it was dark outside.

She estimated that they had been at the bar for more than two hours.

Officers said they found Sparks, drunk, inside the bar.

The girls and the vehicle were returned to their mother.

Sparks has been charged with child neglect and two counts of public drunkenness.

HOUSTON – A 19-year-old father was being held on $150,000 bond Tuesday after police say he violently shook his 3-month-old son.

Dakoda Lee Clawson is charged with injury to a child.

According to court documents, Clawson was babysitting his son on November 12, 2011, when the baby suffered serious head injuries and was rushed to the hospital.

Police interviewed Clawson and the baby’s mother at Memorial Hermann the next day.

The mother told investigators she was at work on November 12 when she got a call from Clawson, saying the baby had fallen off of his lap and was injured.

Clawson told the officer that he was burping the baby while seated on the couch, and the baby threw himself backward and hit his head on the floor.

Clawson said he immediately picked the baby up, called 911 and began CPR.

But doctors told investigators that the baby suffered bilateral retinal hemorrhages, a subdural hematoma and a broken clavicle, and those injuries were not consistent with Clawson’s story.

Doctors said the injuries were likely caused by severe shaking.

Court documents state that on November 14, the officer interviewed Clawson again, and Clawson repeated his story about the baby falling off of his lap.

But three days later, police said Clawson called the investigator, saying he wanted to talk about what happened to his son.

Police said Clawson told them he was burping the baby when he dropped him on the floor.

Clawson said the baby started crying and wouldn’t stop, so he shook him.

It wasn’t until the baby stopped crying that Clawson said he realized the child wasn’t breathing and had gone limp.

Clawson said he’d lied about what happened before, because he didn’t want his girlfriend to find out.

Charges were filed against him on November 21, 2011.

A FATHER jailed for nine years for raping his son claimed evidence of his violence towards his entire family should not have been used in his trial.

The Court of Appeal upheld the man's appeal and ordered a new trial, but did not on the domestic violence evidence being allowed to go to the jury.

Instead the Court of Appeal upheld the appeal on two other grounds and found the domestic violence issue could be argued at the new trial.

Earlier this year, a District Court jury found the man guilty of two counts of indecently treating a child under 12 and one count of rape.

He was sentenced to nine years jail.

The trial heard the complainant was the man's son, the third of five children and the offences were alleged to have occurred between July 1996 and February 2002 in the family’s home at Alexandra Hills, on Brisbane south east outskirts.

The boy was aged between five and eight at the time.

The man appealed on three grounds, the first being that evidence of domestic violence by him on the boy, the boy's mother and siblings should have been excluded because its prejudicial effect outweighed its probative value.

He also claimed there was a miscarriage of justice as a result of inadmissible and prejudicial opinion evidence given by a psychiatrist and the judge failed to direct the jury properly as to the use the psychiatrist's evidence.

The court heard the physchiatrist treated the boy for anorexia nervosa in 2007 and also diagnosed him as suffering from obsessive compulsive disorder.

At the trial the psychiatrist also gave evidence that the boy had kept a diary of "real events".

On appeal the man's lawyers argued the psychiatrist's endorsement of the complainant’s reliability was inadmissible and prejudiced his case.

The Court of Appeal, in an unanimous judgment, upheld the appeal and ordered a new trial.

On the ground of domestic violence alleged against the man Justice Richard Chesterman said it did not appear to be a case in which the man's violence towards his family had any real relevance to, or connection with, the charges.

But he said the matter of its admissibility could be re-argued, if thought appropriate, at the next trial.

Father allegedly abuses 6-month-old

BALDWIN COUNTY, Ala. (WALA) - A 6-month-old infant is on a ventilator after authorities said her father, Scott Durham, bounced her on a bed out of anger. Baldwin County Deputies said the alleged abuse happened November 18 in Foley.

They said Durham admitted to losing his temper due to stress and being tired. He told deputies he aggressively bounced the infant on the bed.

“Once we started the interview process and started to talk with him about it, within just a limited amount of time he ended making a statement and confessing to it,” said Baldwin County Sheriff Huey Mack. “What we find is even though these people assault children, in the back of their mind, they realize that’s not the proper thing to do, and so the guilt does starts to take over, and I think that was the case in this.”

The 6-month-old girl suffered a hemorrhage on the brain and severe retinal hemorrhage. She was air lifted by Life-Flight to Sacred Heart Hospital in Pensacola, where she is still in intensive care.

“The nature of the injuries fall in line with what we call shaken baby syndrome, and that’s simply where a child’s head is moved about so violently that it causes an internal injury,” said Mack.

Durham has been charged with first degree domestic violence and is at the Baldwin County Corrections Center under no bond.

Officials said this is the third time Durham has been arrested in the past two years for domestic violence. They want to keep him in jail as long as they can.
“We're hoping not only for the judge to set for a high bond, but we typically ask for conditions [in addition to] bond, such as no contact with the family, can’t return to the residence - those type of things,” said Mack.

Neighbors FOX10 spoke with said the child's mother just got back from being with her daughter in Pensacola. She was too upset to speak with us.

SALEM - A Salem man is behind bars, accused of injuring his 14-month-old son because the child woke up too early and wouldn't go back to sleep.

WNYT's media partners at The Post-Star say 28-year-old Roger Hill admitted to causing numerous facial injuries to the boy and biting the child's arm.

The sheriff's department says Hill also admitted to smoking herbal incense before the incident.

The boy was treated at Glens Falls hospital and released.

Father James Horton faces jail after daughter's arm was broken

A father is facing sentence after being convicted of causing his baby daughter serious injury.

James Horton left the child with a broken arm by mistreating and abusing her, Maidstone Crown Court heard.

Scarlet Horton was also found to have several older fractures to her ribs.

She was just three months old when she was taken to the William Harvey Hospital in Ashford on March 30 last year.

He had been looking after Scarlet while her mother was visiting friends.

He later claimed the injury to the child's upper left arm may have been caused by her getting tangled up in the bars of her cot.

But the jury of eight men and four women was told he could not explain how she also had fractures to two of her left ribs and five of her right ribs.

Horton, of St Theresa's Close, Ashford, denied cruelty to a person under 16, causing grievous bodily harm with intent and a lesser offence of inflicting grievous bodily harm.

He was convicted of inflicting grievous bodily harm by an 11-1 majority and cleared of the other charges.

Prosecutor Ian Acheson said 26-year-old Horton "mistreated and abused" the baby while caring for her.

"Those stresses and tensions (of caring for a baby) can be difficult to keep a lid on and it may be that the lid came off and the desire, albeit fleetingly, to shut her up may have formed the intent at the time," he said.

Horton, who left Swadelands School in Lenham with six GCSEs, denied in evidence that he had harmed his daughter in any way.

Asked if it was true he had assaulted and mistreated Scarlet, he replied: "No, of course it isn't. I loved her."

Granting bail and adjourning sentence until after January 9, Judge David Griffith-Jones QC told Horton: "Before deciding on the appropriate sentence I need to know more about you."

Dad EMMIT CORBIN "allegedly" assaulted the mother (hit her in the head with a hammer), and then abducted their 18-month-old baby. But the police figured that since there were "custody issues" in play here, the baby would be safe--since the abductor was the dad and all. WTF? Fathers who assault the mothers of their children are usually more than willing to do the same to the kids. Get a clue, people.

MOULTRIE — An 18-month-old baby has been returned to his mother, who reported Tuesday being attacked by the toddler’s father before the man left with the child, a Moultrie Police Department spokesman said.

Taney Davis, 300 block Ninth Street Southeast, told an officer that Emmitt Corbin came to the back door of her residence, and that she answered thinking it was someone else. When she opened the door, Corbin forced his way inside and hit her in the face.

She reported that he hit her in the head with a hammer while she was holding the child, and she said he left in a white pickup truck.

Corbin, 24, was charged with aggravated assault, said Cpl. Dave Underwood, a police investigator. Underwood said he is looking to determine whether or not there was a court custody agreement in place that would prohibit Corbin from taking the baby.

“It’s still under investigation,” he said. “We’re still trying to determine if his action would warrant him being charged with kidnapping.”

There are some questions “because of custody issues,” he said.

“The child is safe. We didn’t have any concerns about the safety of the child because the guy who took the child is the father of the child. If the investigation shows any additional circumstances that warrant any other charges, certainly they will be filed.”

Corbin had injuries to the head, but did not seek medical attention, police said.

A Jersey City man has been sentenced to 15 years in prison for having his 4-year-old daughter perform oral sex on him and he must serve more than 12 years before being eligible for parole, officials said today.

In February, the Arlington Avenue man who turns 28 tomorrow was found guilty of aggravated sexual assault and endangering the welfare of his daughter, who is now 8.

"The victim will be well over 18 by the time her father is released," said Hudson County Assistant Prosecutor John Mulkeen today of the sentence meted out by Hudson County Superior Court Judge Sheila Venable Friday. "It was a well investigated case by the Hudson County Prosecutor's Office's Special Victims Unit."

The name of the convicted child molester is being withheld to protect the identity of the victim.

The child was 6 years old on Aug. 21, 2009 when she told her baby-sitter what her father had made her do and the baby-sitter told the girl's mother the next day. The mother had not yet contacted police when an anonymous caller gave the information to the state Division of Youth and Family Services on Aug. 24, Mulkeen said.

The mother, who was 28 years old at the time, was not prosecuted, but the victim and her younger sister were taken away by DYFS at that time. The mother testified for the prosecution at trial.

The father was arrested on Aug. 25, 2009 and at the end of a recorded interview he asked a female officer to leave the room and tearfully "expressed guilt, felt bad, and admitted that he did it and gave even more details than the baby-sitter had," Mulkeen said.

When the victim testified at trial she clearly identified her father as the one person that had touched her inappropriately, Mulkeen said. The father testified that he had been forced to make the incriminating statement, but the jury didn't buy it.

After his arrest, the man posted bail on Sept. 15, 2009, but his bail was revoked when he was convicted on Feb. 16, 2011. He must register as a sex offender and undergo supervision for life.

Hot-headed dads like IAN LANGHORNE shouldn't even have child visitation/custody rights. If Daddy slashes tires when he "loses his temper," what is he going to do when faced with a crying child?

I'm more convinced than ever that alcoholic, never-married fathers should have no rights. You want to raise a child? Then straighten out your life and make a loving commitment to the mother (e.g. marry her).

A FATHER lost his temper and slashed two of a relative’s tyres after being told he could not see his child.

Ian Langhorne, 32, of St Annes Road East, St Annes, admitted causing damage and failing to answer bail. He was jailed for 14 days and ordered to pay £100 compensation by Blackpool magistrates.

Sandra Ardern, prosecuting, said Langhorne damaged two tyres on a car belonging to his ex-partner’s mother, while it was parked outside her home on October 13.

Steven Townley, defending, said his client had something of a drink problem and had been going through a difficult break-up with his girlfriend, with whom he had a child. Mr Townley added: “In his opinion she and her family have been obstructive.

“He was told he would not be able to see his child and this festered with him.

“As he walk past his ex’s mother’s he picked up a piece of metal and popped two tyres.”

(KMOV) -- People who live near Amberg Park in south St. Louis called police around 2 p.m., Thursday to report an infant had been abandoned in the park.

Helen Edwards says her nephew ran home and reported that baby was in a stroller, alone. Edwards says she and another relative went to the park and found the baby, crying. Edwards says whoever left the child also left a diaper bag with clothing, diapers, and a can of formula.

Edwards says she sat with the baby until police arrived. It's unclear how long the child was alone in the park.

St. Louis Police said officers located the mother, who told them that the child's father was caring for the baby earlier in the day.

A detective said investigators determined the mother was not at fault and are looking for the father.

The mother was reunited with her baby.

CHALMETTE, La. -- A 4-month-old girl was hospitalized after her father threw her on a bed while angry, St. Bernard Parish Sheriff's deputies said.

Investigators said the girl suffered two bilateral skull fractures when her father grew angry and tossed her on the bed, resulting in her striking her head against the wall and hitting the floor.

The incident happened about noon on Wednesday, according to investigators.

Deputies arrested the father, William Bertoniere, 24, on Wednesday night on a charge of felony cruelty to a juvenile.

Bertoniere and the girl’s mother, who police said was at work at the time of the incident, brought her to Children’s Hospital.

The baby, who also suffered an injury to her bone in one leg, was hospitalized for two nights and released, Sheriff-Elect James Pohlmann said.

When questioned, Bertoniere told the Sheriff's Office that the incident started after he had finished bathing and dressing his daughter and was leaving the bathroom, carrying her. While holding her, he slipped and fell into the corner of a door, injuring one of her legs, he told deputies.

Even though the baby cried for a long period, investigators said Bertoniere didn’t seek medical help.

Bertoniere told sheriff’s detectives that as the crying continued, he “lost his cool,’’ and threw the girl on a bed, then she struck her head against a wall and fell to the floor.

Police said Bertoniere called the mother at work and told her of the injuries. Then they met at a doctor’s office in Chalmette, and afterward brought the child to Children’s Hospital for emergency treatment, Pohlmann said.

After giving his statement to detectives and state child protection officials, Bertoniere was arrested and jailed, Pohlmann said.

Bertoniere was being held in St. Bernard Parish Prison in lieu of $50,000 bond set on Friday.

JUPITER — A 47-year-old father was arrested Saturday after a neighbor saw him beating his 7-year-old son, police say.

Nicholas DePalo, of Jupiter, was arrested on a charge of child abuse with assault or battery.

On Nov. 26 around noon, Jupiter Police officers arrived to DePalo's residence after a neighbor called police saying a child was being beaten.

The neighbor, Daniel Combs, said he heard a male screaming and looked out his back window and saw a child on the ground being "kicked and punched," a Jupiter Police probable cause affidavit says.

Combs said the boy was holding his mother's hands when DePalo picked him up by his feet and dropped him. He then kicked the child in the "back, legs, and hit him in the face," the affidavit says.

When officers arrived they spoke with DePalo who was hanging up Christmas lights.

DePalo told police his son was "acting up," the affidavit says.

The boy was in his bedroom and told police his dad hit him with his fist and kicked him while on the ground.

Officers examined the boy and found a "welt/abrasion" on his back.

DePalo admitted to hitting his son in the past with a sandal and sometimes the "situation gets out of control," the affidavit says.

DePalo was arrested at the scene and the Department of Children and Families were notified.

It is not known if the child was taken from the residence.

UTICA — A man holding a child threatened his former girlfriend with a knife, according to Utica Police.

Around midnight Sunday, police responded to a residence on Whitesboro Street for a domestic incident where a woman told them her ex-boyfriend and father of her child, Toby Gaston, 29, of Lenox Avenue, showed up at her residence very late.

Police said Gaston demanded to see their child. Police said she refused because it was late and the child was sleeping.

Police said Gaston pushed his way into the apartment and picked up the child. While he was holding the child, the two began to argue, and during the argument, Gaston threatened her with a knife, police said.

When officers arrived, Gaston was gone. Later Monday morning, the man was located and charged with menacing, endangering the welfare of a child, criminal trespass, all misdemeanors; and unlawful possession of marijuana, a violation.

A FATHER may have inflicted fatal injuries on his seven-week-old son out of frustration because he did not have everything he needed to change his nappy, a jury was told today.

A prosecutor told Sheffield Crown Court how Kieron Hutchinson suffered catastrophic brain damage after he was left for a short time with his father Ian Hutchinson.

The baby suffered bleeding eyes and a seven-and-a-half centimetre skull fracture - injuries which must have been caused by an impact with a hard object and violent shaking, the court heard.

Prosecutor Bryan Cox QC said: “What precisely caused the defendant to inflict such serious injury to Kieron is not entirely clear.

“It may have been something as trivial as a sense of frustration that he’d been alone with Kieron without the wherewithal to change his nappy.”

Mr Cox said paramedics were called to the defendant’s mother’s house in Chapeltown, Sheffield, on September 3, last year.

Kieron was taken to Sheffield Children’s Hospital where he died four days later.

The court heard how the youngster had been seen by his GP earlier on September 3 for a routine appointment and nothing of concern was noted.

Later, Hutchinson was left alone with Kieron after his wife, Rebecca Hutchinson, and his mother, Georgina Hutchinson, went to the supermarket.

The defendant told doctors and police he had begun to change his son after the women left the house but found there were no wipes in the changing bag.

He rang his wife to tell her this. Hutchinson told police that his son then became upset, coughed, went quiet and then stopped breathing.

But Mr Cox told the jury of 10 women and two men how numerous medical experts had concluded Kieron’s severe injuries could only have been the result of a violent, non-accidental trauma.

He said: “There must have been substantial violence.

“In the opinion of the doctors, there must have been an impact against a hard object and violent shaking.”

He said a consultant ophthalmic pathologist said the bleeding in the baby’s eyes was at the extreme end of seriousness.

Mr Cox said a staff nurse at the hospital heard the defendant tell his wife: “I’m sorry. I’m really sorry.”

Hutchinson, 24, of Elizabeth Street, Goldthorpe, Barnsley, South Yorkshire, denies murder.

He sat listening to the prosecution opening of the case in the dock flanked by a security officer.

He was wearing a dark suit with a purple shirt and purple tie.

The case continues.

A father has been accused of killing his three-year-old son by locking him in a washing machine and starting a cold wash cycle in France.

Christophe Chempenois, 33, inflicted the "punishment" on the toddler for misbehaving at his nursery school, police said.

The child named Bastien had thrown a drawing by a classmate down a toilet earlier that day.

On Friday evening, Champenois allegedly forced the child naked into the washing machine and let it run for "several minutes", reports said.

Neighbour Alice told the French capital's newspaper Le Parisien the toddler's mother Charlene, 25, had rushed to her door carrying his body after the incident, claiming he had fallen down some stairs.

"I took him in my arms like a broken doll," Alice told the newspaper.

"I felt the last beat of his heart. Charlene didn't move. She was red all over. She didn't understand he was dead."

Bastien is said to have died within minutes of being taken out of the family's home, near the Paris suburb of Meaux.

A local police spokesman said: "A 33-year-old man has been arrested for murder of a minor.

"The man's wife has also been arrested for non-assistance of a person in danger.

"This man... will be held in custody until a date for his trial can be set."

COLORADO SPRINGS, Colo. -- Colorado Springs police arrested a father on Saturday night after he attacked and choked his wife in front of their four children, police said.

The 27-year-old victim was taken to the hospital with non-life-threatening injuries.

The father was arrested on suspicion of attempted second-degree murder, felony menacing, child abuse and third-degree assault, police said.

Just months after it was confirmed he was her father, Jackson police Detective Natyyo Gray is accused of killing his 1-year-old daughter.

Gray, initially arrested Sunday on a felony child abuse charge, was charged with capital murder on Monday after an autopsy showed Aubrey Brown did not die of natural causes.

Internal bleeding caused by severe blunt force trauma to the abdomen killed Aubrey, according to Hinds County Coroner Sharon Grisham-Stewart.

Assistant Chief Lee Vance called the death "an unspeakable tragedy, an outrage. This is as bad as it gets."

As required when there are signs of abuse, doctors called police to the University of Mississippi Medical Center on Sunday. Aubrey was taken there at 2:41 p.m. and died about 4:30 p.m.

Gray, 36, was living with the child's mother on Monroe Street, but Aubrey was in his sole custody when the injuries seem to have been inflicted, officials said.

The child's mother, Phyllis Brown, could not be reached for comment. She took Gray to court over paternity and child support. In March, she was awarded full custody, $280 a month in child support plus $1,680 in arrears to be paid $100 a month until the balance was paid off, based on a Hinds County Chancery Court order. There were also various arrangements for medical and life insurance to be paid by the parents.

Court papers show Gray also goes by the name Devon Whitfield, but when the child was conceived Gray had not changed his name.

"Due to the uncertainty of what the actual legal name of the father is, the court finds that it is in the child's best interest to retain her original name," the document states.

Vance said he was unaware Gray had been using that alias. "That's the first I've heard of that," he said.

Gray also has a son and a daughter under the age of 10.

His Myspace page said he graduated from Chicago State University in 1999 with a degree in computer information.

Neither Vance nor other officers would discuss Gray's departmental record. He has been with JPD since July 2001 and was assigned to the vice and narcotics unit.

But several people, including fellow officers, have been commenting on social media sites such as Facebook and Twitter about Gray's arrest.

"I have known him for 10 years, I know the way he lives and works for his kids," said Jackson police officer Joseph Daughtry on his Facebook wall. "I can not believe what he is being accused of."

Former JPD officer Chris Barnhart said in the two years he worked with Gray, he knew him to be professional and tactful.

"We would sit and speak about the events that he takes his older children to," he said. "He loves his children and would go out of his way to ensure that they had everything and then some that they needed."

On his Myspace page, Gray said, "I'm young and living life to the max. My life, my two beautiful children, all else is secondary."

Father gets 22 years for abuse of infant son

BLOUNTVILLE — A Kingsport man whose infant son was hospitalized in October 2008 with a brain injury, fractured skull and other broken bones has been sentenced to 22 years in prison for aggravated child abuse and aggravated child neglect.

Jeffery Scott Gold, 30, 1005 Catawba St., was sentenced Monday to 22 years in prison with 100 percent service required at the end of a lengthy sentencing hearing in Sullivan County Circuit Court. He was also fined $100,000.

Gold had faced 15 to 25 years on each count, with Sullivan County Assistant District Attorney Julie Canter arguing in favor of lengthy, consecutive sentences.

Gold’s convictions stem from allegations that he intentionally caused his infant son to suffer a fractured skull, bleeding on the brain, six broken ribs, a broken leg, and bruising all over his body sometime during the first 44 days of his life. The abuse was believed to have occurred sometime between Oct. 1, 2008, and Oct. 19, 2008. During the sentencing hearing, the toddler was described as suffering no lasting ill-effects from his injuries.

During his sentencing, Gold read a prepared statement in which he thanked family and friends for their support, apologized to his son, and pleaded with the judge to be merciful.

“I’m sorry to my son, Colton, with all my love in the world,” Gold said.

He also expressed regret that the boy might someday read of the charges against him and expressed the hope that “he won’t remember the accident.”

Several family members and friends testified on Gold’s behalf. They described him as a man of good character and rejected medical testimony Canter cited that said the child’s injuries were not accidental.

Several agreed with Sullivan County Assistant Public Defender Andrew Gibbons, who asked whether they would consider it “an aberration, rather than the norm,” if Gold did what he was accused of doing to his son.

Gold’s mother, Judy Kibler, and stepfather, Frank Kibler, who have been awarded permanent guardianship of the boy, each described Gold as a responsible, hard-working adult.

“I did not, and still do not, believe he willfully or purposefully harmed his child,” Frank Kibler said.

Judy Kibler echoed her husband’s position.

When questioned about her son’s failure to get immediate medical help for his son, she said: “He was scared out of his mind.”

One friend and former co-worker, David Anderson, said Gold is the godfather of one of his children.

“Whatever happened, I know that wasn’t Gold, just by the way he is,” Anderson said.

Another friend, Laurey Conway, said that as his mother’s best friend she has known Gold his entire life. She said that Gold’s purchase of a house, baby furniture and baby clothes for the child, and his act of taking in the baby’s mother when she lost her job, all demonstrate his “character” and “integrity.” She added that Gold has kept her son before, and that she trusts him.

“I don’t think Jeffrey intentionally inflicted these injuries on the child,” she said. “I think there are other circumstances that could have been looked at.”

In deciding to give Gold less than the maximum and choosing not to order consecutive sentencing, Circuit Judge Jerry Beck said he was giving Gold “some consideration of the life he’s lived up to point that he committed these crimes.”

“Generally, up until his conviction — and he’s got a drug problem now that’s not been tried, and he’s got a serious problem involving the child — but in many respects, you can’t judge a man’s whole life on one or two problems he’s had in his life with the law,” Beck said.

Beck went on to add, “I guess all men are judged on how they conduct themselves, and the defendant has shown, approximately 25 years, I guess, of following the law, doing the right thing, working every day, doing the things we expect ordinary people to do according to their ability. So that deserves some consideration.”

Prior to committing the offenses, Beck noted that Gold had graduated from high school, attended some college classes, and had received an honorable discharge from the U.S. Army in 2006 after three years of service due to a service-related injury to his left hand. He also noted that Gold had maintained steady employment after his military service ended. He also considered that, although Gold acquired some drug charges while out on bond in this case, he is innocent of those offenses until the case is tried.

Beck said that while the acts Gold committed “were certainly dangerous,” he did not find Gold to be a “dangerous offender,” and therefore consecutive sentencing did not apply.

In sentencing Gold to more than the minimum, however, Beck further noted that the extent of the victim’s vulnerability also deserved some weight.

“This case is a horrible case from the standpoint of the injuries inflicted,” he said.

According to testimony at Gold’s September trial, the baby’s injuries were discovered when his mother, Shannon Evans — then Gold’s live-in girlfriend — took him to Holston Valley Medical Center on the evening of Oct. 19, 2008. Gold allegedly refused to accompany Evans and the baby to the hospital, telling Evans the cost of the visit was “not coming out of my pocket.” He did join them there about an hour later.

Gold had initially told Kingsport police that he didn’t know how his son’s injuries had occurred. During the trial, he testified that on Oct. 19, 2008, he had fallen down a flight of stairs in his home while holding the infant that morning. He said Evans was sleeping at the time.

In the state’s final closing argument, Canter questioned why Gold never gave police that explanation. She also cited medical testimony that some of the infant’s injuries appeared older than others, and that it would be difficult to attribute such an array of injuries to a single incident.

In his closing argument, Gibbons reiterated Gold’s defense — that the injuries were the result of an accident. He challenged whether the state had proven otherwise beyond a reasonable doubt and told the jury that “evidence of injuries” was not equal to “evidence of abuse.”

After the hearing, Gibbons announced his intent to file a motion for a new trial.

Baby girl Aurora Breakthrough died of a blunt-force injury to her head, the court heard Thursday at her father's trial.

Dr. Marnie Wood, a medical examiner, described the baby's cause of death as Ashiqur Rahman's trial continued Thursday in Halifax.

Aurora was seven weeks old when she died at the IWK Health Centre in July 2009.

Wood said she didn't know how the baby was injured. She said the girl was either hit on the head or her head was smashed into an object, or she was shaken.

"There were a number of injuries to the bones of this baby — broken ribs, broken arm and leg bones that were observed, and blunt force trauma to the head," said Crown attorney Denise Smith.

"The medical examiner has offered the opinion [that] was the cause of death in this case."

Rahman, 25, is charged with manslaughter and aggravated assault.

Wood testified some of the baby's fractures happened when she was three weeks old. Aurora's wrist was broken from being bent or struck, court heard, and her leg had been hurt from someone twisting it.

As Wood gave her testimony, she encircled her hands, as if to show the squeezing force that broke the baby's ribs. She said almost all of the girl's ribs were broken — some were broken twice. Three were fractured during CPR.

Ashiqur Rahman's trial began in Halifax last week. CBCCourt heard that by the time the baby was rushed to hospital, her brain was so severely injured that parts of her brain were liquefied.

Last week, a doctor testified that Aurora was in a deep coma when she arrived in the hospital's emergency department.

Dr. Brian Norman said when he first saw the baby, she was suffering from severe brain damage. He said her brain had swelled to the point that the soft spot on her head was pushed outward.

Norman also said tests showed the baby had suffered previous "non-accidental" injuries, including broken ribs.

The baby's mother, 24-year-old Jane Gomes, pleaded guilty last year to a charge of failing to provide the necessities of life.

Gomes is expected to testify at Rahman's trial in two weeks.

PEABODY — A Peabody man who allegedly admitted shaking and "head-butting" his infant daughter last month was indicted yesterday by an Essex County grand jury.

Richard Elias, 22, who had been living on Magnolia Way before his arrest, will face two counts of assault and battery on a child causing substantial bodily injury. He's expected to be arraigned within the next several weeks at Salem Superior Court.

The abuse took place on two occasions, prosecutors say.

The first incident, on Oct. 20, happened while Elias' wife was out picking up her older children from a prior relationship.

Elias later confessed to police that on that afternoon, he became frustrated with the then-5-week-old Isabella because she soiled a freshly changed diaper, prosecutors say.

He said he shook her while she was on the changing table, according to investigators.

The infant began suffering seizures, and her mother took her to a pediatrician and to the hospital, not knowing the reason for the seizures.

Nine days later, the mother went to a Halloween party, her first time out with friends since the birth of the baby.

Elias later told investigators that he was trying to play Xbox and drink beer but was disturbed by the infant's crying, so he head-butted her.

The baby almost immediately started suffering seizures. Elias allegedly ignored the advice of other online Xbox players to call 911.

Prosecutor Kate MacDougall said during a hearing last month that the infant suffered significant brain injury from bleeding, as well as eye damage.

A judge earlier this month called the allegations "horrifying" and ordered Elias held without bail.

A Hatboro father accused of assaulting his infant son earlier this month will be home for the holidays – although his contact with the 5-month-old boy must be supervised.

Jarrett Tourish, 21, of North York Road in Hatboro, on Wednesday waived his preliminary hearing in District Judge Paul Leo’s court and was freed from the Montgomery County Correctional Facility after his father, Brian Tourish, posted bail. One of the conditions Leo placed on Tourish’s release was that he must reside with his father and visits with his child must be supervised by an adult age 21 or older.

Tourish must also attend anger management and parenting classes stemming from the Nov. 10 incident, in which Tourish is alleged to have thrown the baby down on a crib and struck the infant repeatedly because he would not stop crying.

Tourish’s attorney, Chris Perry, said the child is “doing well” and had no permanent damage stemming from the alleged abuse. Following the incident, the infant’s mother, Tourish’s wife, had noticed bruising on the child and took him for medical treatment, police said. He was admitted to Children's Hospital of Philadelphia with injuries consistent with being physically assaulted, police said. The child was released from the hospital several days later.

Perry said the “best interests of the child” are of utmost importance.

“He is remorseful about what happened,” Perry said of his client, who works in a store. “He understands that he does need some assistance dealing with his anger.”

Tourish faces charges of aggravated assault, simple assaut, endangering the welfare of children, recklessly endangering another person and unsworn falsification to authorities after Hatboro Police said he initially lied about - and later confesed to - throwing his baby down on a crib and striking the infant repeatedly because he would not stop crying.

He is scheduled to be formally arraigned on Jan. 4 in the Court of Common Pleas in Norristown.

LARGO — A 6-foot-1, 220-pound man is accused of slamming his infant son against a crib, causing severe brain injuries to the 5-month-old baby.

Largo police said 32-year-old Michael Alan Hopkins of 14330 58th St. N, No. 1024 first said his son fell off a couch, but later admitted he was violent with the infant.

Police learned of the case about 7:40 p.m. Tuesday when they were called to Morton Plant Hospital in Clearwater about a baby with a head injury.

Doctors determined the infant had a skull fracture and was suffering from brain and retinal hemorrhaging, police said. The infant was transferred to All Children's Hospital in St. Petersburg.

During their investigation, police discovered Hopkins had been home alone with his son when the incident happened. The baby's mother, who is Hopkins' girlfriend, was at work at the time, police said. The family recently moved to the area from Connecticut, said Largo police Lt. Edward Sohoski.

After the infant was injured, Hopkins was able to reach his girlfriend's parents, who got in touch with their daughter. The woman and her parents went to the apartment. They and Hopkins took the baby to the hospital, Sohoski said.

Hopkins originally told detectives the baby may have been injured from falling off the couch onto a carpeted floor, police said.

He agreed to go back to the apartment he shares with his girlfriend to show investigators what happened, Sohoski said.

"It was at the apartment they started finding some inconsistencies in his story and it ended up with him admitting what he did," Sohoski said.

Hopkins told detectives he had become angry when the baby fell off the couch and said he "violently" picked the infant up before hitting the baby's head against a wooden crib railing, according to Largo police.

Hopkins said he then snatched the baby out of the crib, which caused the infant's head to snap backward, police said.

Hopkins was charged with aggravated child abuse. On Wednesday afternoon, he was being held in the Pinellas County Jail in lieu of $100,000 bail. He does not have a criminal record in Florida, according to the Florida Department of Law Enforcement.

Pinellas court records show Hopkins was appointed a public defender and ordered not to have any contact with his girlfriend.

The baby's condition was not released Wednesday, but police characterized the injuries as "severe" and said testing and observation were ongoing.

In hindsight, all the warning signs were there.

One of the teenagers came to school with bruises, but wouldn’t say how they occurred. Her angry younger sister was skipping classes, her grades plummeting. Both were desperate to leave home. And hovering over everything was the spectre of a controlling, often violent father, of whom they were clearly terrified.

In short, what appears to have transpired was a profound and – it’s alleged– ultimately murderous clash of cultures.

Listening to teachers and social workers on Thursday, the jury weighing the fate of three Afghan-Canadians accused of committing multiple so-called honour killings heard a wealth of testimony pointing to a deeply dysfunctional, male-dominated Montreal household.

On trial are Kabul-born businessman Mohammad Shafia, 58; his second wife, Tooba Mohammad Yahya, 41; and their eldest son, Hamed, 20. They stand jointly accused of murdering three of Mr. Shafia’s and Ms. Yahya’s teenaged daughters, Zainab, Sahar and Geeti, aged 19, 17 and 13 respectively, along with Mr. Shafia’s first wife, Rona Amir Mohammad, 53.

The four bodies were discovered in a car at the bottom of a lock on the Rideau Canal just east of Kingston in June, 2009.

The jury has already heard that Sahar attempted suicide, and fresh testimony Thursday underscored the depths of her misery and fear, and the similar plight of her younger sister Geeti. Both attended Antoine de Saint-Exupery high school in the Montreal borough of St. Leonard.

Teacher Claudia Deslauriers told the jury of seeing bruises, scratches and scars on Sahar’s forearms. When she asked the teen what had happened, “she didn’t say anything,” Ms. Deslauriers testified.

Ms. Deslauriers also recounted meeting the children’s “really angry” mother, Ms. Yahya, who demanded to know if Sahar had a boyfriend, and if Ms. Deslauriers had seen her kissing him. The teacher said no, she had not, which was false, because, “I didn’t want her to have any problems at the house.” Ms. Yahya told the teacher she could not tolerate her daughter kissing a boy “because it did not fall within her values,” Ms. Deslauriers testified.

Also testifying Thursday was social worker Stephanie Benjamin, summoned by the school psychologist just weeks before Sahar and the others died.

“She feared being beaten by her father, who had just come back to Canada [from a business trip],” Ms. Benjamin said of Sahar, who was anxious to leave home and get a job. Her long-term hope was to become a gynecologist and work in Afghanistan, but her immediate need was to get away from her father and older brother, Hamed, who more than once had physically abused her – on one occasion by flinging scissors at her from across the table. “She was asking me to help,” Ms. Benjamin testified.

It was not only her parents and older brother whom Sahar feared, the trial heard. She worried about one of her other male relatives telling the adults that she was associating with boys at school. “She was afraid [the relative] would tell her father she was a whore,” former teacher Antonella Enea told the jury.

“She said she couldn't live a normal life – to see her friends, things of that nature,” Ms. Enea said of Sahar, who attended classes for new immigrants at the school. Geeti, too, showed signs of being profoundly unhappy at home and afraid of her father, manifested in poor attendance and mood swings, the jury heard.

On two separate occasions – in 2008 and then in 2009, just weeks before the teens died – child-welfare authorities in Montreal were contacted. Both times there was no intervention. Part of the difficulty, the trial has been told, was that Sahar and Geeti were reluctant to confront their domineering father.

The trial is in its sixth week, and the prosecution is expected to wrap up its case on Dec. 5.

FLOYD — A Floyd County man faces a capital murder charge after the death Wednesday night of a toddler.

Eder Rodriguez-Guzman, 29, was being held without bond Thursday in the New River Valley Regional Jail.

Neighbors identified the slain 2-year-old girl as Rodriguez-Guzman’s daughter, Jocelyn, and said they could not imagine him harming her.

“He was calm, always joking,” said Marcella Morales, who lived next to Rodriguez-Guzman, his wife and their daughter in Longview Court, a small mobile home park just outside the town of Floyd.

Morales, who said she often baby-sat Jocelyn, recalled the family as friendly and religious.

“What do you call the people that come to your door and want to talk about Jesus? They were like that,” Morales said Thursday.

Rodriguez-Guzman was from Mexico and had lived in Longview Court for about a year and a half, Morales said. He worked at a Christmas tree farm and his wife at a restaurant in Blacksburg, Morales said.

Nelson Morales, Marcella Morales’ cousin, said he’d known Rodriguez-Guzman for years through soccer circles. He also recalled Rodriguez-Guzman as religious-minded and level-headed, calling him “just a really good guy.”

Rodriguez-Guzman also seemed to be a devoted father, Nelson Morales said. “He used to always have her with him,” he said of Rodriguez-Guzman and his child.

The Moraleses said they had no idea what happened Wednesday night. Like other neighbors, they said they heard no commotion and had no indication anything was wrong.

Authorities gave out little information on the circumstances of the toddler’s death. A news release from the Floyd County Sheriff’s Office did not name the victim and said only that officers were called to a home in the 100 block of Lance Drive at 9:39 p.m. and found a girl dead.

Virginia law allows capital murder charges in a number of situations, including when a victim is younger than 14 and the suspect older than 20. Rodriguez-Guzman also was charged with assault and battery of a member of his household. The sheriff’s office did not say if the assault victim was the toddler or someone else.

On Thanksgiving afternoon, the porch light was still on at the Rodriguez-Guzmans’ mobile home. A brightly colored child’s seat sat in the back of a car parked next to a pickup truck in front of the home, and a child’s swing dangled from a tree behind the house. A climbing toy sat on the porch.

Misleading headline. It wasn't as a "soldier" (or as an accountant or mechanic or what-have-you) that dad JONATHAN JAMES "allegedly" committed this crime. It was as a FATHER with access to a helpless infant. We report these crimes all the time, and they are committed by fathers from every vocation and profession--though in many cases the daddy was an unemployed "caretaker" at the time of the "shaking" assaults/murders. Even this baby was in his father's "sole care" while Mum was running errands. And even though Mum was gone for only a few minutes, that's all it took for Daddy to freak out on the baby in a "fit of rage" and kill him.

A SOLDIER violently shook his baby son to death in a fit of rage while home on leave, a court has heard.

Five-month-old Theo Davies died of severe brain injuries and suffered extensive bleeding behind the eyes after being shaken by his ‘proud and capable father’ Private Jonathan James, a jury were told.

The 25-year-old was said to have acted in a ‘momentary loss of temper or control” while Theo’s mother Leanne Davies was down the shops fetching milk.

He denies the manslaughter of his son and his trial began at Worcester Crown Court.

The court heard little Theo had suddenly collapsed at his home in Stourport, Worcs, on August 24 2009 while in the care of his father.

He died a day later in hospital, the court was told.

Opening the prosecution, Mr Christopher Millington QC said extensive checks had been carried out by experts who had not been able to find a medical condition to account for the injuries.

He said no account of an accident which could explain the injuries had been put forward by any party and said experts had concluded it had been caused by a trauma which occurred near the time of his collapse.

Mr Millington said the prosecution believed it “probable” the youngster had been the victim of “violent and unlawful shaking” while in the sole care of his father.

But he told the court James, now of MoD St Athan, Barry in the Vale of Glamorgan, had denied ever shaking his son and had told police he could not account for how the brain damage had occurred.

Mr Millington said on August 24 James, who had been on leave from the armed forces, had got up first and heard his son stirring.

He went in and gave him a feed and medication the youngster was taking for an ear infection.

When James’ partner, the baby’s mother, had got up they realised they had no milk. He had given her GBP10 to get some from a local store.

Mr Millington said she had returned minutes later to James calling for the emergency services and Theo to be in an unresponsive state.

Paramedics and doctors battled to save the youngster – first at Worcestershire Royal Hospital and then in Birmingham.

Although they restarted his heart he was unable breath independently.

“What the exact circumstances were may never be known. There were only two people present at the time. One was the baby, the other the defendant.

“We believe it probable that Theo was the victim of violent and vigorous shaking.

“We do not say this was inflicted intentionally. There is much evidence to suggest the defendant was a proud and capable father.

“The action was probably the result of a momentary loss of temper or control.”

But the court heard James said he had been alerted something was wrong with his son when he heard a “bumping sound and a gurgle”.

The trial continues.

Dad sexually abused daughter for 10 years, gets 15 years in prison (Victoria, Australia)

Actually, it's not a good thing that this sexually abusive UNNAMED DAD is referred to as a "monster"--even though he clearly is one. Unfortunately, using the word "moster" makes the public think that sexual predators look like Frankenstein or Peter Lorre in a trench coat hanging around a dark alley. The fact is that these guys come across to the public as...normal men. Charming, intelligent, the whole bit. That's the bad part. SARAH'S story will take you out of your comfort zone because it deals with the sort of abuse so sickening, many in our civilised society would prefer to think it does not exist.

For 10 years this young Victorian woman was sexually abused by the very man who should have been her protector - her biological father.

She remembers the abuse starting when she was about four. She told me: "I was so fed up and sick of what my dad was doing to me, I wanted it to stop. (But) he said he would kill my mum if I told her."

That's what sexual predators do, particularly within a family circle. They bully and threaten and blackmail and impose their will on the weak. It's such a betrayal of the human condition that many of us shrink away from such crimes.

I find it hard to confront myself, but here's the thing. If Sarah is prepared to talk about it publicly for the first time, we should pay her the respect of listening and perhaps her courage will give strength to other young victims of sexual abuse.

Sarah wants them to know that there is always someone willing to listen, believe in them and support them through what will be a harrowing journey to see the perpetrator punished. She wants those suffering in silence to know that they are not alone.

"I have a lot of guilt about the family breaking up," she told me tearfully. "I just wanted it to stop."

Standing alongside her is her mother. She said it still made her angry to think that the constant, shocking abuse of her only daughter was happening under her roof by a man she loved.

She thought they had the perfect family and a great marriage.

Sarah is not her real name, but her wounds are still too deep and raw and she is not yet ready to reveal all to close friends.

How can she when she is still trying to comprehend the horror that happened to her? To understand why she was regularly woken at 2am by her father and abused or why, as she became older, he became more aggressive and controlling, demanding sexual acts in exchange for allowing her to go out with friends.

Sarah is now 20; a delicate, beautiful young woman. Her father was a monster who used every trick in the book to manipulate, frighten and abuse his own child.

He said it was something all little girls did with their fathers and that he loved her and that she must not tell anyone because it was their secret.

Jo Mealia said that tactic was known as "grooming". A member of a Victoria Police Sexual Offence and Child Abuse Investigation Team (SOCIT), Det Mealia investigated the case from the time Sarah told her mother she was ready to press charges and she stayed with it until the end.

That's the whole idea of this specialist unit; victims deal with one or two investigators through the entire process and the rapport between Det Mealia and Sarah shows it works. She was with Sarah and her mother during the years it took to have Sarah's father charged and convicted. And she was there for her last year when Sarah's father was charged with 26 counts of incest, 25 counts of an indecent act with a child under 16 and one threat to kill.

"When I saw him (in court) I thought, 'How can you do that to your own flesh and blood? I'm your daughter'. It was just sick."

Sarah's father was sentenced to 15 years in jail with a 12-year non-parole period. An appeal was dismissed.

In the end, what made Sarah come forward was the fear he could abuse another child.

"My dad put me through hell for 10 years and I was scared he was going to go off and have another family and do it to their kids and I didn't want that."

She said the process of making the statement was horrible.

"You feel a whole lot better. It was a load off my chest, but you have to be ready because you have to go through every single detail."

And that is the message she wants to share with other young victims. Her mother is warm and friendly, but fiercely protective of her three children. The day she confronted her husband was the day she ordered him out of the family home they had shared for 18 years.

How could she not know?

It is a question she has asked herself many times.

Her first reaction, she said, was anger.

"The anger was unbelievable. That it was happening for so long. I'm angry with me for not seeing it."

Now divorced from the man she says had broken her family, she is working with Sarah to put their lives back together.

But despite the trauma, Sarah has a remarkable strength and tenacity. Aware that only one in seven sexual assaults are reported, she wants victims to know that they can stand up and say when something is not right.

ONE day she would also like to talk to school groups to warn children that adults -- men and women -- do commit sexual assaults against children and that it is not acceptable.

"I'm not the only one this has happened to," Sarah told me. "I want other children to know that. I also want them to know that there will always be somebody out there to help you, no matter what."

Man jailed for killing daughter

MADURAI: A 28-year-old man was arrested in Theni in southern Tamil Nadu on the charge of practising female infanticide on Saturday after police found that his eight-month-old daughter had died of poisoning.

It was his 24-year-old wife who put him behind bars for the brutal 'murder' of their daughter. The woman, who grew suspicious over the untimely death of their eight-month-old infant , had lodged a police complaint seeking an investigation. The postmortem report found that the infant was poisoned. and investigations revealed that the baby's father was behind the death.

Though female infanticide is prevalent in many southern districts, including parts of Madurai, Theni, a backward district, is notorious for the practice. However, during the recent census, the child sex ratio increased from 891 in 2001 census to 937 in 2011, throwing a surprise. The increase in CSR was due to concerted efforts by the government and NGOs. However, the killing of the eight-month-old baby has come as a shocker.

Police said Alagesapandian (28), a daily wage worker from Anumathampatti near Uthamapalayam, was married to Nandhini of the same village and the couple gave birth to a girl in 2010. When the infant reached eight months, it died mysteriously. Alagesapandian convinced his relatives and villagers that the baby was suffering from poor health and had died as treatment failed. However, Nandhini grew suspicious of the claim and lodged a police complaint. alleging a mystery in the death of her child.

Subsequently, a postmortem was performed and the viscera of the baby was sent for laboratory tests which revealed death due to poisoning. Even As the needle of suspicion turned towards Alagesapandian, who also sensed the police were zeroing in on him, he moved to Chennai and was working as a lorry driver. "We received the chemical analysis report of the viscera only on Friday. We immediately arrested Alagesapandian," said a police official. However, police said they were probing as to whether the motive for the murder was because the infant was a female. "During interrogation, the man claimed he did not kill the baby just because it was female. He said he had an clandestine affair with another woman who was reportedly insisted that their child be his legal heir," rather than the one born to Nandhini,'' police said.

Alagesapandian reportedly told the police that this was the motive behind the murder of the baby.

"Cases of female infanticide indeed came down in Theni. Still, these kind of incidents are a stark reminder for us to intensify our efforts," said V R Vanaja, programme director of Development Action Consortium Trust, a forum of nine NGOs.

Nationwide manhunt for dad who murdered 2-year-old daughter during court-approved visitation

Dad ARTHUR MORGAN III got "court-approved visitation" and took advantage of his quality time with his 2-year-old daughter to drown her in a stream like some unwanted puppy. Now Daddy is missing, and the subject of a nationwide manhunt.

What I'd like to know is what judge "approved" this father's visitation with this helpless toddler, and what allegations of abuse/neglect existed before--allegations that were no doubt completely ignored so this criminal thug could have his father's rights. Let's see the names of all the people who supported this daddy's "right" to unhindered access to this poor child. Because they have blood on their hands too.

Nationwide manhunt continues for Monmouth County fugitive in toddler's murder

FREEHOLD — An intense nationwide manhunt continues for Arthur Morgan III, the 27-year-old Monmouth County man wanted on murder charges stemming from the brutal slaying of his 2-year-old daughter, authorities said.

Christopher J. Gramiccioni, First Assistant Monmouth County Prosecutor, said the FBI and U.S. Marshals are participating in the nationwide search for Morgan that includes the NY/NJ Regional Fugitive Task Force. Gramiccioni said authorities have to consider that Morgan has left the state.

Morgan was the featured fugitive Saturday on the website for the “America’s Most Wanted” television show. The website says Morgan has ties in California, New Mexico and Texas. He also lived in Eatontown, police said.

About 100 people gathered at Shark River Park Friday night to honor Tierra Morgan-Glover.

The child’s mother, Imani Benton, 24, of Lakehurst, was among those attending the vigil and was visibly distraught throughout the event. She had to be physically supported by other attendees and repeatedly cried out “she was my baby girl” during the vigil.

Authorities have been asking the public to help in providing any information about the whereabouts of Morgan since the body was discovered by a group of teens shortly before 2:30 p.m. Tuesday in Wall. The child’s body was strapped in a car seat and she was partially submerged in a stream in Shark River Park.

Morgan picked up his daughter from Benton on Monday for a court-approved visit. Morgan was supposed to return the child by 6 p.m., authorities said. When Morgan failed to return, the mother called police. Morgan was last seen on the platform of the Asbury Park train station between 7 and 8 p.m. Monday, authorities said.

An autopsy showed the child died from “homicidal violence.”

Dad "tips off" man who employed/abused his 10-year-old son; boy fears dad will beat him (New Delhi, India)

Notice that this appears to involve a custodial UNNAMED DAD, who hired out his 10-year-old son as domestic help. The employer than tortured the little boy. And then check out what happened next. Daddy "tipped off" the employer as to the upcoming charges so he and his wife could escape. Wow. Talk about where your loyalties lie.

The little boy doesn't want to return to his father has he fears he will be beaten. But he'd like to be returned to his mother who lives in another city. So the parents were obviously divorced or separated.

This is institutionalized fathers rights at work. And this doesn't just happen in "foreign" countries either. Before reforms that began in the nineteenth century, American fathers had total control over their children too, including the right to hire them out as they saw fit. Mothers had no right to object either way. In fact, the majority of American children were probably forced out of their homes and into wage work at some point--and that's not even including children in slavery.

And here's the interesting thing. Mothers did not really gain a legal preference in child custody decisions ("tender years doctrine"-- all but dead now thanks to the resurgence of fathers rights activism) until child labor was abolished. Fathers lost their financial interest in maintaining child custody control. And as a group, they didn't show a revived interest until the federal government stepped into child support enforcement in the late 80s/early 90s.

You think it's a coincidence that many of the more conservative fathers rights people also want to revive child labor in the US?

A professor of Jamia Millia Islamia (JMI), accused of torturing his 10-year-old domestic help, finally appeared before the Child Welfare Committee (CWC) on Friday. After taking his statement, the CWC issued an order, asking Mohammed Ghazi Shahnawaz, 42, to pay compensation to the boy.

Shahnawaz had been absconding since the incident came to light. He joined the investigation after taking a stay from a sessions court till November 30.

"We will wait for the order of sessions court and will then proceed to arrest Shahnawaz. The CWC has found him and his wife guilty of abusing and torturing the 10-year-old," a senior police officer said.

HT had earlier reported that the boy's father had tipped-off the professor about the entire incident, thus helping him escape. CWC order has also blamed the boy's father.

"The boy is not willing to go with his father as he fears that he will be beaten up. But as the child wants to go back to his home town, the CWC has asked the NGO, Butterflies, to take the child to Araria in Bihar and hand him over to his mother," the officer added.

The CWC has also asked the professor to open an account in the child's name at his hometown and deposit the compensation in that account.

On August 17, a badly injured 10-year-old had been found on Mathura Road near Badarpur on August 17. At that time, the child had been unable to tell anyone where he worked or give any details about who tortured him.

Later, he had accused his employer, a professor at JMI, of torturing him. He had burn marks on his body to prove the allegations.

Sorry. Dad TIMOTHY JARMUZEK was not "really nice people." He just had the knack of coming across as such to clueless people who aren't paying attention. Really nice people don't gun down and slaughter their own kids.

Father killed daughter, himself in Swatara Township shooting, officials say

Domestic violence goes beyond dating and marriage partners.

In a rare, horrifying turn this weekend, a Rutherford teenager was shot to death by her father, who then committed suicide.

Taysia Anyee Jarmuzek, 16, was killed by her father, Timothy Jarmuzek, 35, a Hummelstown barber, on Friday night in the Jarmuzek home in the Sunpointe housing development on Kristy Lane in Rutherford, officials said.

Swatara Township police called it a homicide-suicide. Judy Yupcavage, Pennsylvania Coalition Against Domestic Violence spokeswoman, called it domestic violence.

She said murder-suicides involving a parent and child aren’t as common as murder-suicides between intimate partners, but they do happen.

“There are cases of parents who kill children and children who kill parents,” she said. “Last year [in Pennsylvania], one daughter killed her mother, eight sons killed a parent, four fathers killed their children, two mothers killed their children and a grandson killed a grandparent. This case is a terrible tragedy. Our hearts go out to the family.”

Taysia Anyee Jarmuzek was a Central Dauphin East High School junior.

“We are deeply saddened by this tragic loss,” said Shannon Leib, Central Dauphin School District spokeswoman. “Our thoughts and prayers are with her family. We will be providing grief counseling services for students when they return to school on Tuesday.”

Yupcavage said that in homes with access to firearms, the risk for homicide increases significantly. “Guns are used in more than half of all domestic homicides,” she said.

The Pennsylvania Coalition Against Domestic Violence reported that Pennsylvania had 133 domestic-violence deaths in 2010, including five in Dauphin County, ranging in age from 3½ weeks to 87 years old. Additionally, 36 perpetrators either killed themselves or were killed by police or others intervening to protect victims, bringing the domestic violence death total to 169, according to coalition statistics.

Between 2001 and 2010, Pennsylvania lost 1,532 women, men and children to domestic violence, the coalition said.

Neighbors of the Jarmuzeks, who seemed stunned by the deaths, had divided assessments about the Jarmuzek family.

Yolanda Smyth, 40, who lived next to them, called them “really nice people,” describing them as a tight-knit, normal suburban family.

Nadine Nesbit, a neighbor living across the street, said she understood that there was arguing shortly before the shootings. Maria Ramirez-Dennis, the mother of Taysia’s best friend Jasmine Barber, said the family often fought, even if friends were over.

Police said they don’t know what sparked the violence.

Since the shooting, friends and relatives set up a memorial with candles, flowers and stuffed animals on the front stoop of the town house where the violence occurred.

Taysia Jarmuzek’s friends lamented her death.

Lashay Anderson, who lives across the street from the Jarmuzek home, said she often let her children play with Taysia outside. Anderson called Taysia Jarmuzek a beautiful person.
