Victim’s mother filed an FIR after the accused asked her to bury the body in their home
Bareilly: In a shocking case, a four-year-old Muslim girl was allegedly thrashed to death by her father for failing to cover her head while eating her food in a village near Bareilly, according to reports.
Uttar Pradesh police said that the incident took place on Friday noon, when the little girl Farheen was having lunch with her mother. The father of the girl, Jafar Hussain flew into a rage when he saw that his daughter did not have her head covered. Hussain then picked the little girl up from the floor and repeatedly flung her against the ground for failing to notice that her dupatta had slipped from her head.
The mother who was eyewitness to the gruesome incident, told the police in her statement that the incident had happened in front of the entire family. The girl’s mother claims that she tried to intervene and save the child, but the accused beat her up. She failed to stop him and he continued to assault the child till she died from the impact of her injuries. Hussain then allegedly asked his wife to bury little Farheen inside their house, but the mother refused to comply with his demand and filed a FIR against him.
“Police have arrested the father for killing his daughter and we are questioning him about the incident,” superintendent of police BK Srivastav said.
The police questioned some of the neighbours, who described the accused as “mentally unstable”, they said that he was a staunch Muslim who did not interact with anybody, not even his relatives. Hussain lives with his wife Naeem and their four children in the village, while their eldest child is five, the youngest is a ten month old baby.
According to the neighbours, the family is extremely poor and sometimes would have to go without food. Fear gripped them when they came to know about Farheen’s murder, and nobody dared enter the house until the police arrived at the crime scene.

Judge argues "cultural context" on why abusive, wife-beating father should get custodial rights over child he battered (United Kingdom)
Meet the new fathers rights tactic--a brilliant cooptation of neo-liberal ideology: "Cultural Context" as the latest way to minimize domestic violence and child abuse. In this particular case, we learn that "cultural context" basically means the following:
1) Don't believe women and children when they describe child abuse--believe Daddy (and his lies)
2) When faced with a preponderance of evidence that the father had STRANGLED the mother (a huge and proven red flag for lethal violence in the future), admit the facts but STILL say Daddy should have access to the traumatized child
So basically the same old crap in a new shiny bag.
Mom was clearly not on board with this "cultural context" thing. She sought out an order of protection and is trying to keep herself and her son out of harm's way. But her views on culture clearly don't matter. Only Daddy's and those of the abuser friendly judge.
Again, same old crap...
And in reality, just a way of reasserting colonialist ideology, i.e. that non-European people have a lesser developed sense of morality, and that non-Europeans women and children are "lesser than" and less deserving than their European counterparts.

A High Court judge has enraged child protection experts after saying that “cultural context” should be taken into account when investigating allegations of parental child abuse.
Mrs Justice Pauffley said that within “many communities newly arrived” in Britain, children were “slapped and hit” for misbehaviour in a way which “at first excites the interest of child protection professionals.” Speaking about a particular case involving a boy who claimed he had been hit with a belt by his father, she said “proper allowance must be made” for the fact the family came from another culture - in this case, India.
Child protection experts have expressed their astonishment at the statement, saying that culture can never be a factor in assessing whether child abuse is taking place. An NSPCC spokesman said of the judge’s comments: “Children need to be protected irrespective of cultural sensitivities. Different practices are no excuse for child abuse taking place in this country and the law doesn’t make that distinction. Every child deserves the right to be safe and protected from physical abuse and the courts must reflect this.”
The Family Division High Court judge was deciding on a case in which a boy, who turns eight this month, complained that his father had physically assaulted him. The boy’s parents, who met and married in India, came to England on a six month visa and ended up staying on in the country.
The father opened the case because he wanted his son returned to his care after he was arrested on suspicion of assaulting his wife and told to stay away from her and the boy.
Mrs Justice Pauffley had to make a preliminary decision about whether it was likely the man had attacked his wife and son. She concluded, following a hearing in London, that he had assaulted his wife but had not physically abused his son.
The boy had told investigators of physical assault, saying: “With his belt, he kind of hits me.” He described being hit on his back and leg with a “long belt”.
When asked how he felt, he replied: “Sad ... But I'm little brave ... I'm not scared of him... But normally I'm sad.” He nodded when asked whether it hurt, or left marks and whether they “went quite quickly”.
The father denied ever striking his son “with a belt or otherwise” but said he would give him a “slap or a tap”. He claimed: “this was not to slap [him] badly but to keep him disciplined.”
The man’s wife said she had seen him slap their son twice - as well as seeing him push and shout at their son.
But Mrs Justice Pauffley said: “I do not believe there was punitively harsh treatment of (the boy) of the kind that would merit the term physical abuse. Proper allowance must be made for what is, almost certainly, a different cultural context. #“Within many communities newly arrived in this country, children are slapped and hit for misbehaviour in a way which at first excites the interest of child protection professionals.”
She added: “In this instance ... (the boy) did not appear to have suffered more than sadness and transient pain from what was done to him.”
Alan Wood, head of children’s services in the London Borough of Hackney and former president of the Association of Directors of Children’s Services, said: “I can’t see what cultural practices are acceptable that involve physically hitting and restraining children. It seems a very unusual comment by the judge and I’d be surprised if the matter isn’t looked into at the Ministry of Justice.”
A press spokesman for the Judiciary said they were not yet looking into it but would do if they received formal complaints.
Mrs Justice Pauffley concluded that the man had subjected his wife to a “horribly aggressive and violent assault” in October 2014, where he attempted to strangle her and “violently pushed” her. She said the woman was extremely distressed and the boy “worried, even terrified.” The judge gave no detail about the progress of any police investigation.
It is not illegal for a parent to hit their child as long as the smack amounts to “reasonable punishment”. Unreasonable punishment is classed as a smack that leaves a mark on the child, or the use of an implement to hit the child, such as a belt or cane.

Dad murders 6- and 10-year-old sons, their mom; neighbors praise him as "kind" and "gentle" (Tulsa, Oklahoma)
This is almost a parody of the badly written domestic violence newspaper article. All the tell-tale signs:
1) Moronic police scrambling for a "motive"--apparently with no idea that these kinds of murders have already been thoroughly researched examined and tend to have similar motives, i.e. controlling, narcissistic father who sees women and kids as nothing but extensions of his own ego that can be disposed of as it suits him.
2) Moronic neighbors who praise the family (and Dad SUDHEER KHAMITKAR by implication) as "kind" and "gentle" with really no clue as to what the father is really like behind a shallow public presentation
3) Moronic neighbors who apparently believe that domestic violence murder only happens in "unsafe" unban neighborhoods and not in suburban cul-de-sacs. So they are "shocked" that such a thing would happen in "their neighborhood." Street crime may tend to be limited to certain areas, but that is NOT the case with domestic violence. Yet all this ignorance is reported without any correction. As a result, the myth that a "nice" neighborhood keeps you safe from male interpersonal violence is perpetuated.
4) The fact that the mother (allegedly) never contacted the police is taken as evidence of no previous domestic violence. Ridiculous, and anybody who knows ANYTHING about domestic violence knows this is a meaningless factoid--if true.. MOST victims do not report, and non-reporting is especially prevalent among educated, middle-class women AND women who are immigrants.

Investigators are trying to determine why a man shot his wife and two young sons before killing himself at the family's home in a quiet Oklahoma suburb this week.
Sudheer Khamitkar, 42, shot his 38-year-old wife, Smita Haval Khamitkar, and their sons Arnav Khamitkar, 10 and Arush Khamitkar, 6, in separate rooms at their Tulsa home, police said.
The bodies were found on Wednesday as officers conducted a welfare check requested by the mother's employer after she failed to show up for work or call in sick for two days.
'Right now we still don't know the motive behind the murder-suicide,' said Sergeant Shane Tuell. On Thursday, Tuell said the father had recently changed jobs and that detectives would interview his current and former employers in an effort to learn if he was having personal troubles.
There was no indication of forced entry and no suspects are being sought, authorities said.
A backdoor was unlocked and a handgun was found near the father's body.
'The evidence indicates that the father shot and killed the children and the wife before turning the gun on himself,' said homicide Sergeant Dave Walker in a news release.
'There is evidence of multiple gunshots throughout the house. All the bodies were found in different rooms throughout the house.' Sergeant Walker added that the family had lived at the home for 10 years and there had been no previous history of domestic violence or criminal activity at the home,
Newson6 reported. Mrs Khamitkar, whose Facebook page indicates she was originally from Pune in India, had worked as an Android app developer for American Airlines.
'Smita Khamitkar was a member of the American Airlines team in Tulsa for nearly five years and we're deeply saddened by the news of her passing,' the company said in a statement. 'Our thoughts and prayers are with Smita's family, friends and colleagues during this very difficult time.'
Online profiles for Mr Khamitkar show he had trained and worked as a mechanical engineer for companies including Oseco, a relief systems company, and Wellman Products Group, a company that develops car parts.
He had also secured multiple patents in previous years for new types of rupture discs - a device that prevents equipment or a system from being damaged by too much pressure.
Neighbors said they were shocked by the events and called the area safe.
Most every property in the neighborhood has a large fence, so children can play or swim in privacy, though some play basketball in the driveway or at a cul-de-sac.
'I love this neighborhood. It's very quiet here,' Mercedes Perez told The Associated Press.
Her husband, Vinicio Perez, said he would sometimes see two children playing and bouncing around in the front yard of the home where the bodies were found. 'I'm shocked,' he said.
'This place should be a place surrounded by security.' Stephen Wiseman lived next door to the family for almost ten years.
He said: They were wonderful, the most kind [and] gentle people you'd ever meet.
Our kids played with them all day on Saturday, and … we saw the kids on Sunday.'

Her dad is then said to have filled up the pit to chest level, with pictures showing the young girl with her arms and head above the dirt floor.
When Abdul's wife returned home he put a bamboo basket over their daughter's head, with the intention of burying her completely later on, NDTV reports.
But his wife began to question where the little girl was, and she was soon discovered by neighbours.
They are said to have beaten up the dad before calling police.
Abdul was then arrested, and now faces a charge of attempted murder.
The case comes four months after a seven-year-old girl clawed her way to safety after allegedly being strangled and buried alive in the Uttar Pradesh region of India.
The youngster was found by shocked villagers after they heard her cries for help.
The little girl, named Tanu, told police her aunt and uncle had taken her from her mother's house days earlier and buried her in the field.

Morena (MP): A local court has directed a man, accused of raping a minor girl, that he should take care of her child while being lodged in the jail.
The boy, who is now six months old, was born to the girl after she was allegedly abducted and raped by Vikas Singh, the accused.
Singh kept the girl in confinement at Jeemni village in the district before the police arrested him and rescued the girl on November 27.
Public prosecutor Mahendra Kulshestra said that on November 28, when Vikas was produced before the sessions court, the court remanded him in police custody and the girl was sent to a shelter home.
However, as she is a minor, under the law the boy can not be handed over to her as yet, said the prosecutor.
Therefore, the court ordered Vikas to take care of the child while in jail.
Morena jail's chief warden Dattaram Maurya said that the jail administration had made all necessary arrangements to take care of the child.

If UNNAMED DAD was truly crazy and being instructed by a "ghost in dreams" to rape his daughter, he would have had little to no awareness that what he was doing was wrong and against the law. In reality, he acted like lots of other rapist daddies when the mom finds out--with beatings and death threats if she went to the authorities. So what we have here is your basic abuser with a little more creativity than most.

A 50-year-old Thane resident has been arrested for allegedly raping his 14-year-old daughter repeatedly over one year because, according to him, a ghost used to come in his dreams every night asking him to rape the child.
The accused, charged for rape and under other relevant sections of Indian Penal Code and Protection of Children from Sexual Offences Act, 2012, was produced in court and has been sent to police custody till December 9.
The incident came to light on Thursday during a routine check-up by doctors from Thane civil hospital in Kharegaon school number 93, where the victim studies. The students had queued up for counselling when doctors saw the victim, who too was in line, dozing off. When asked if she was feeling all right, the girl broke down and told them that her father had been raping her repeatedly and not letting her sleep at night.
The shocked doctors and members of an NGO, which had organised the medical check-up, immediately informed Thane civil surgeon Gauri Rathod.
"When I came to know about the incident, I immediately called up joint commissioner of police VV Laxminarayan and informed him about it. He then sent a team to rescue the girl and arrest her father," said Rathod.
Laxminarayan said, "The girl has been sent to Bhiwandi remand home. Further investigation is on."
"We have found out that the girl is really keen on studying but due to her father's atrocities she wasn't able to focus on them. Also, her mother knew what was going on and tried to put a stop to it several times. But every time she raised her voice against it, the accused would beat her up and threaten to kill her and their daughter. He even threw the mother out of the house a few times," said senior inspector from Child Protection Unit Madan Bhallal.

HYDERABAD: It was indeed a moment of joy at ADR Hospital in Anandbagh for one family. Yashwita, an 8-year-old, was dancing with joy as she saw her two-day-old brother. Her relatives gathered outside the cabin just to get a glimpse of the new born.
In a sharp contrast to that, the people in the adjacent room were in a state of shock for the irreparable loss. The mother of two, Suhasini was lying clueless on the bed while her family tried their best to boost her morale.
It has been more than 24 hours that she got the news of her children being brutally murdered by their father. “I still remember their last words,” said Suhasini’s brother, Swaroop, remembering the time he spent with his nephews. “The second child, Nanda Vihari, suggested that I badly need a haircut. Owing to his advice, I had gone to get one and by the time I had returned, they were gone,” he said, as he tried to swallow his pain. Speaking of Guruprasad, the father of the children, Swaroop said, “Ever since we got the verdict from the family court magistrate, we have been extremely worried,” he said. “Suhasini had literally begged the judge not to give the custody of the kids to him. She had suffered for 7 years and did not want her kids to go through the same,” he added.
He hinted that Guruprasad did not share a good relation with his family also. “Guruprasad had two sisters and they have a long drawn dispute over money and ancestral plots, which he did not want to share with his sisters,” he said, further adding, “He never gave his mother any money. She used to depend on my mother for all her financial needs.”
Vijayanand, the maternal grandfather of the children, voiced a similar opinion of Guruprasad. “He took away all her credit cards and never spent anything from his own savings,” he alleged. Suahsini, being an IT employee, used to come home late at nights. While he used to return home at the same time, he never offered her a lift in the car even though he saw her on the roads,” he said. “Even when he came home early, he never opened the door on time. He used to make her wait outside for hours,” he alleged.
The family, at present is focused on tendering moral support to Suhasini, who was admitted in hospital and is still undergoing treatment. The last rights of her children were performed at Bansilalpet graveyard after which she was admitted in the hospital. “She did not eat anything on the day the kids went missing hence she became weak. Right now, she is recovering and we are trying our best to give her all the help she needs,” her brother said.

Contrary to their image as protectors, fathers and uncles have emerged as the top violators in cases of child sexual abuse, a study by NGO Arpan has revealed. The organisation evaluated newspaper reports on such cases over the period between 2007 and 2011 and found that in 64 per cent of accused were by father or stepfather.
At 17 per cent, uncles sit on the second spot. According to Arpan's findings, maximum crimes were committed at the victim's own home – the figure stood at 27.4, while other familiar spots such as school, tuitions and neighbourhood comprised 56.6 per cent.
The study solely focuses on Mumbai edition of four national newspapers. The researchers collected 1,711 newspaper reports on child sexual abuse (CSA). Fathers turned monsters in 56.63 per cent cases, while stepfathers were accused in 7.43 per cent cases. Grandfathers too figures in the survey though the figure was less than one per cent.
Seema Hingorani, clinical psychologist and trauma expert, said, "I completely agree that a lot of crimes happen at home. I have many young adults who were sexually abused as kids and are still undergoing trauma. They tell me the perpetrator was their grandfather, uncle and domestic help, watchman, driver or cook."
She said the figure about father could be true as it might pertain to upper middle class and middle class. "Parents need to be more aware where they are sending a child and make every possible efforts to question the child."
Arundhati Chavan, president of United Forum, shared similar sentiments. "Parents have shared such stories with us. There is a need for regular awareness programmes for children on their safety."

A 15-day-old baby girl was allegedly beaten to death by her father, who was unhappy with the birth of a female child, at a village in Surat district, police said today.
An inebriated Raju U Thakre beat up the infant yesterday at their home in Chalthan village under Palsana taluka of Surat after a quarrel with his wife Minaben Thakre, Kadadra police station house officer Bhagabhai Dhirbhai Bhagol said, quoting the complaint filed by the girl's mother.
He said the deceased's mother also mentioned in her complaint that her husband wanted a male child and used to frequently quarrel with her since their daughter was born about 15 days back.
On Sunday night, he beat up the child and also hit her on the head following which she became unconscious.
The accused then left the home following which Minaben went out in search of him.
When she could not find him and returned home in the early hours yesterday, she found the baby dead, Bhagol said, adding that she subsequently lodged the police complaint against her husband.
The body was later sent for postmortem, he said, adding that a search has been launched a search to nab the accused.
The couple, from Tokar Talav village in Maharashtra's Nandurbar district, had been staying in Chalthan village and were engaged in collecting scrap from the area for their livelihood, he said.

Child sexual abuse has been a consistently shameful blot on almost every established community across the globe, and it is one that continues to haunt us decade after decade.
In the latest exposé, India’s Punjab has been unveiled as the next culprit in the child sexual abuse scandal. The Government Medical College and Rajindra Hospital in Patiala have seen a growing number of female patients under 1 and 2 years of age suffering from ‘vaginal bleeding’.
These girls have been sexually abused in their own homes by their own fathers, who were reportedly under the influence of substances and alcohol.
In one case, a father tried to insert a toothbrush into his three-month-old daughter’s vagina, which was only ‘half-an-inch’.
Another incident saw a nine-month girl who had been abused with a carrot, which was still stuck inside of her. Later, a five-year-old girl had been forced upon by her father and suffered a tear in her vulva.
In all three cases, it was the mother who brought the daughter to the hospital, confessing that the father had been either drunk or a drug addict. The mother of the latter victim admitted that she had tried to stop the father raping the child, but was beaten and locked outside of her house for ‘the entire night’.
Bharti Ali from HAQ, which promotes child rights, says: “We deal with sexually abused children and have come across several cases where the father is the abuser. Parents with drinking or drug abuse problems are a high-risk factor for child sex abuse.”
In the majority of these incidents, little can be done by the mother to stop violent abuse from taking place.
There is also little support available to educate illiterate communities in rural areas about abuse towards children, where young boys are just as susceptible to sexual abuse as girls.
Chairman for PCRC, Punjab Child Rights Commission, Swaran Salaria, says: “The problem of drug and liquor abuse is on the rise in Punjab. There are bound to be social implications. But there is a social stigma attached to sexual abuse.
“When the father is an abuser it becomes a bigger taboo. They also fear further victimisation by the police. Our commission can refer the matter to the police only when we get a complaint. We cannot intrude into the private space of families unwilling to do so.”
Such sexual taboos however are not only limited to Indian Punjab, and the same horrific crimes are also taking place in the UK among the British Asian community.
According to NSPCC national statistics, 1 in 20 children have been sexually abused in their lifetime, and 90 percent of these children were abused by someone they knew; 80 per cent of assaults took place in a familiar environment, like the home.
From the British Asian community, a 15-year-old girl, Farah from Oldham became involved with a young boy called Irfan. She was later blackmailed by an elder cousin of Irfan’s and was forced to sleep with other men.
In another case, a 13-year-old girl called Anita was abused by her stepfather for almost 18 months in London. Despite being a victim of abuse, Anita was stigmatised in her family for no longer being a virgin, receiving no support.
Child sexual abuse remains one of the most horrific crimes of the 21st century, but it remains an ongoing wrongdoing because the majority of elders cover up the issue as they refuse (either through fear, honour or shame) to combat it.
The South Asian community in Britain is known for being riddled with taboos and sensitivities that cannot be openly addressed. As human rights activist, Mandy Sanghera explains:
“We are sitting on a time bomb if we do not address the issue of abuse within the Asian community. Many Asian families will put up a wall of silence when it comes to reporting sexual abuse and sexual exploitation, because of honour/izatt.”
According to ChildLine India, sexual abuse involves, ‘engaging a child in any sexual activity that he/she does not understand or cannot give informed consent for or is not physically, mentally or emotionally prepared for’.
This type of abuse can be carried out by an ‘adult or another child who is developmentally superior to the victim. This includes using a child for pornography, sexual materials, prostitution and unlawful sexual practises’.
Illiteracy and a lack of education are great contributors of abuse, but can they be the only reason? How does a lack of education fit into the British Asian sphere?
Have parents and families simply brought over the same values and traditions from their homelands, or does the UK offer a different kind of facilitator to commit such horrors?
Raising awareness of the issue is one thing, but urging men and women who have suffered first hand or even second hand to speak out is another.
While misogyny and patriarchy are important factors, so is oppression; not only of the opposite sex, but of those who are both vulnerable and inferior, no matter whether they are male or female.
What strikes fear the most is the prospect of a parent harming its own child in such a way. One wonders, if not their own guardians, then who will be the voice of these vulnerable children who cannot protect themselves.

The mother of the latter victim admitted that she had tried to stop the father raping the child, but was beaten and locked outside of her house for ‘the entire night’.
Bharti Ali from HAQ, which promotes child rights, says: “We deal with sexually abused children and have come across several cases where the father is the abuser. Parents with drinking or drug abuse problems are a high-risk factor for child sex abuse.”
In the majority of these incidents, little can be done by the mother to stop violent abuse from taking place.
There is also little support available to educate illiterate communities in rural areas about abuse towards children, where young boys are just as susceptible to sexual abuse as girls.
Chairman for PCRC, Punjab Child Rights Commission, Swaran Salaria, says: “The problem of drug and liquor abuse is on the rise in Punjab. There are bound to be social implications. But there is a social stigma attached to sexual abuse.
“When the father is an abuser it becomes a bigger taboo. They also fear further victimisation by the police. Our commission can refer the matter to the police only when we get a complaint. We cannot intrude into the private space of families unwilling to do so.”
Such sexual taboos however are not only limited to Indian Punjab, and the same horrific crimes are also taking place in the UK among the British Asian community.
According to NSPCC national statistics, 1 in 20 children have been sexually abused in their lifetime, and 90 percent of these children were abused by someone they knew; 80 per cent of assaults took place in a familiar environment, like the home.
From the British Asian community, a 15-year-old girl, Farah from Oldham became involved with a young boy called Irfan. She was later blackmailed by an elder cousin of Irfan’s and was forced to sleep with other men.
In another case, a 13-year-old girl called Anita was abused by her stepfather for almost 18 months in London. Despite being a victim of abuse, Anita was stigmatised in her family for no longer being a virgin, receiving no support.
Child sexual abuse remains one of the most horrific crimes of the 21st century, but it remains an ongoing wrongdoing because the majority of elders cover up the issue as they refuse (either through fear, honour or shame) to combat it.
The South Asian community in Britain is known for being riddled with taboos and sensitivities that cannot be openly addressed. As human rights activist, Mandy Sanghera explains:
“We are sitting on a time bomb if we do not address the issue of abuse within the Asian community. Many Asian families will put up a wall of silence when it comes to reporting sexual abuse and sexual exploitation, because of honour/izatt.”
According to ChildLine India, sexual abuse involves, ‘engaging a child in any sexual activity that he/she does not understand or cannot give informed consent for or is not physically, mentally or emotionally prepared for’.
This type of abuse can be carried out by an ‘adult or another child who is developmentally superior to the victim. This includes using a child for pornography, sexual materials, prostitution and unlawful sexual practises’.
Illiteracy and a lack of education are great contributors of abuse, but can they be the only reason? How does a lack of education fit into the British Asian sphere?
Have parents and families simply brought over the same values and traditions from their homelands, or does the UK offer a different kind of facilitator to commit such horrors?
Raising awareness of the issue is one thing, but urging men and women who have suffered first hand or even second hand to speak out is another.
While misogyny and patriarchy are important factors, so is oppression; not only of the opposite sex, but of those who are both vulnerable and inferior, no matter whether they are male or female.
What strikes fear the most is the prospect of a parent harming its own child in such a way. One wonders, if not their own guardians, then who will be the voice of these vulnerable children who cannot protect themselves.

Senior inspector Gorakh Gojare said that the victim has alleged that he had sexually assaulted her five times between August 2013 and April 2014, when her mother was not at home.
The victim stayed with her grandmother when she was a child and, in June 2013, she came to stay with her parents. She confided in her mother but she did not believe her. She finally approached her neighbours and they accompanied her to the police station.
"The father was immediately arrested and booked under Section 376 (punishment for rape) of the IPC, along with Section 4 and 8 of The Protection of Children from Sexual Offences Act," Gojare added.

"The testimony of the victim clearly brings out her plight and agony. It is noteworthy that due to the acts of the convict, the victim as well as her younger sisters and brother are now living a life of orphans in a children's home.
"The deplorable and unthinkable acts of convict do not call for any leniency and I hereby award life imprisonment to the convict for having committed offences under section 376 (2)(f) (rape of a girl under the age of 12 years) of the IPC," Additional Sessions Judge Illa Rawat said.
The court noted that mother of the victim had gone missing in 2011 in suspicious circumstances and the 40-year- old man, father of four kids, was the only parental support for the children.
"The convict was only parent available for the victim child and her younger siblings to look upon for their financial needs i.E. Shelter, food, clothing as well as for their moral and psychological support.
"Since convict was required to discharge the role of both the parents i.E. Mother and father of the victim, his responsibility was even greater and he ought to have lived up to the faith and trust reposed in him by his children, including the victim," the court said and also imposed a fine of Rs 10,000 on the man, a native of Odisha.
It directed the Delhi government to pay a compensation of Rs two lakhs to the victim for her welfare and rehabilitation under the 'Restorative and Compensatory Justice Scheme'.
According to the prosecution, the incident took place early morning in August 2012, when the minor girl was sleeping in her house along with her father and three younger siblings.
Her father, who had consumed alcohol before sleeping, raped her and on feeling pain she screamed and raised an alarm after which her siblings also woke up, it said.
On hearing the girl's cries, neighbours gathered there and the man took the child to a doctor as she was bleeding, the prosecution said.
Police was called by the child's relatives who were residing nearby and the man was arrested by the officials of Kanjhawala Police Station.
During the trial, the man claimed that he was falsely implicated in the case by his daughter as she was tutored by his brother with whom he was having a dispute over ancestral property and that no such incident had ever taken place.
The judge, however, rejected his submission saying, "I find no reason as to why a child of such tender age would implicate her own father for an offence which was indisputably committed with her."
The court said that the testimony of the child clearly brought out the "traumatic experience" she suffered at the hands of her father.

Rourkela: A tribal farmer was arrested and sent to jail for allegedly killing his two-month-old daughter here, police said.
Francis (30) allegedly killed his baby girl on Saturday at his residence in the Birsa Police Station area and then tried to escape when his wife raised an alarm following which locals caught him and took to the police station where he was arrested, police said.
The farmer, his wife Ameni alleged, has been threatening to kill the baby girl, their second child, since her birth because he always wanted a boy, they said.
The wife also alleged that Francis used to misbehave with her as their first child was also a girl and the ill-treatment aggravated after she gave birth to another girl, police said.
Fearing a threat to the new-born, Ameni had shifted to his parent's home two months back but Francis convinced them of not harming the baby and brought them back on Friday last.
Francis was produced at a local court which ordered a 14-day jail custody, police said.

Police have taken a 42-year-old man into custody after his five-year-old succumbed to 100 per cent burn injuries sustained yesterday. The shocking incident took place at 4 am near Pathare Landge Talim in Bhosari.
Police said that they are questioning the father after neighbours alleged that the injured child while being taken to the hospital told them that his father had set him on fire.
The father has been identified as Joginder Kisan Yadav, while his deceased son has been identified as Akshay Joginder Yadav.
According to the police, after the boy was set ablaze, his loud screams had alerted the neighbours. The neighbours allege that when Joginder was himself rushing his son to the hospital, the five-year-old told them that his father had set him on fire.
Joginder took his son to a nearby hospital, after which he transferred to Sassoon hospital for further treatment where he breathed his last. Joginder’s wife died four years ago and one of his sons was living with his relatives.
Police said father and son were residing together in a rented room and Joginder was working for a private company, but a few days ago he was fired from the job. Since then he went into depression and often beat up his son.
C D Bhosale, police inspector, Bhosari police station, said, “We have not yet found any evidence that Joginder burnt his son, as he himself has sustained 35 per cent burns.
Our investigation is ongoing and we are recording statements of the neighbours. Joginder is in our custody now and we are interrogating him about the case. If found guilty, we will file an FIR against him under Section 304 (B) of the IPC.”

According to the information, the wife of the man died 3 years ago. After the death of his wife, his two children used to live at their maternal home with their grandparents. The elder daughter was living with the father. The girl had stopped coming out of the house since some time. One day when she came out regarding some work, people saw her enlarged stomach and doubted that she was pregnant.
When the villagers asked her about it, she told them that her father used to rape her and she is pregnant with his child. The villagers beat up his father when he returned home and informed about the tragic incident to the grandparents of the girl.

RAIGARH: A baby boy was killed by his drunkard father after he allegedly threw the infant into a lit earthen stove here in a fit of rage, police said on Friday.
The incident took place last night at Lakhpatara area of Bayasi village after accused Asiya Ram Rathiya (45) quarrelled with his wife Ras Kunwar and killed the child under the influence of liquor, Raigarh Superintendent of Police, Rahul Bhagat said.
The seventh-month-old Rajju, who received serious burn injuries on his back died on the spot.
On hearing the mother scream, villagers rushed to the house and later informed the police, he said.
Later Asiya Ram was arrested and the body of Rajju was sent to the Civil Hospital for postmortem, he added.
While Asiya said the child accidentally fell into the stove, his wife accused him of throwing the baby into the stove, the SP said.
According to police, earlier Asiya was jailed for three years in connection with the murder of his ex-wife.
He married Ras Kunwar two years back.

Later Asiya Ram was arrested and the body of Rajju was sent to the Civil Hospital for postmortem, he added.
While Asiya said the child accidentally fell into the stove, his wife accused him of throwing the baby into the stove, the SP said.
According to police, earlier Asiya was jailed for three years in connection with the murder of his ex-wife.
He married Ras Kunwar two years back.
