CORNWALL, Ontario – A Cornwall man is facing charges for inappropriately touching his five-year-old daughter.
A 27-year-old Cornwall man is facing charges for allegedly assaulting and sexually assaulting his five-year-old daughter between August, 2010 and May, 2013. He was arrested yesterday. A 27-year-old man has been charged with assault and sexual assault for crimes allegedly committed between August, 2010 and May, 2013 against his daughter.
On Oct. 30, the man turned himself in at police headquarters. He was taken into custody and charged accordingly.

SEBRING - A father who left his 2-year-old daughter to die in a car overnight plead no contest Wednesday to aggravated manslaughter.
Circuit Judge William Sites scheduled sentencing for Christopher King for Dec. 16 at 1:15 p.m. King could receive a maximum of 30 years in prison.
Shirley Whitsitt, attorney for King, said King could receive a minimum sentence of 13 years under sentencing guidelines.
Although no plea agreement was reached, Assistant State Attorney Richard Castillo said that prosecutors would not pursue sentencing for King's second charge, felony child neglect, because that would involve some duplication.
The plea agreement came a little more than a year after Amelia King died after being left overnight in King's vehicle the night of Sept. 6 to Sept. 7, 2012. King at first claimed that his son accidentally locked the child's sister in the car. But the son told authorities that King went to sleep and forgot the daughter was in the car outside King's home.
In the wake of the no contest plea, Castillo said, the goal of prosecutors was to hold King responsible by having him convicted. Whether it was through a trial or a guilty or no contest plea, "the mission was accomplished," Castillo said.
Whitsitt declined to comment on why King decided to plead no contest.
The no contest plea was an abrupt change in the direction of the case. Whitsitt on Tuesday had sought a continuance after Sites agreed that prosecutors could introduce testimony that King had used methamphetamine over a period of several days surrounding the death. Previously, the defense and the prosecution agreed the testimony would only involve the night of the child's death.
But a key prosecution witness changed his testimony and would not narrow the drug use down to a particular night.
As a result of that, Sites, who voiced reluctance about delaying the trial after a jury was selected, agreed that Whitsitt could conduct a deposition of the witness.
Sites also gave Whitsitt time to contact a toxicologist about how long the drug would last in a person's system and how long it would have an effect.
In the courtroom Wednesday, the attorneys talked with a toxicologist on the telephone who said methamphetamine would be out of a person's system within 24 hours of use. But, he also said that effects from crashing after using the stimulant could last for days and that the crash would more likely cause a person to sleep than not.
Castillo said that testimony would benefit the state, as it would show that all the effects wouldn't end in a day.

HOUSTON – A 2-month-old boy, who had been severely shaken by his dad, took one last breath in his mother’s arms before being rushed to the hospital and placed on life support, according to court documents.
His father, 36-year-old Mark Anthony Justice, was charged with felony injury to a child.
The baby boy was rushed to the hospital on October 21 after becoming unresponsive at his home.
Doctors at Memorial Hermann Hospital were told the child seemed perfectly well until he just stopped breathing, but that was inconsistent with the baby’s injuries. The infant was found to have acute subdural hemorrhage and severe retinal hemorrhages, and his brain bleed was highly suspicious for inflicted trauma.
The mother told investigators she was in the bedroom playing video games with her 1-year-old while the baby was in the living room with his dad. She said Justice came to her saying the baby did not “seem right” and handed him over to her. It was at that time, she said her son took one last breath and “died in her arms.”
The parents called 911 and began CPR until paramedics arrived to take over.
Investigators questioned Justice, who allegedly broke down and confessed about what really happened. Justice said he was watching his infant son that day and the baby would not stop crying. He said his son would not take his pacifier, either, which frustrated him because he had worked that day. That is when he shook the baby aggressively while holding him in one arm, then struck him multiple times in the back with his free hand, according to investigators.
Justice said he then dropped the baby on the floor.
Minutes later, he noticed something was wrong and ran to get the boy’s mother so they could call for help.
The child had to be placed on life support for survival.
Justice was arrested and being held without bond.

Custodial dad accused of severely injuring 7-week-old twin daughters (Clay County, West Virginia)
All through Dastardly Dads, you'll find plenty of dads who maintained their parental rights despite drug/alcohol issues. In fact, you'll find plenty with outright criminal histories involving assault, rape, and all kinds of nasty stuff. These guys not only retain their parental rights, they get visitation and even full custody.
But once again, Mom loses everything because of an (alleged) addiction problem, so SOLE CUSTODY goes to a violent, short-tempered father who apparently tortured these babies from birth. This was an improvement for these girls? Drug addictions can be overcome. But you're either a vicious @$$hole or you're not. Once again, we see how authorities create much higher standards for mothers.

Two seven-week old twin baby girls were fighting for their lives Wednesday night.
The twins from Clay County remain in Women and Children's Hospital in Charleston with bleeding on their brains, broken bones and police said more and more injuries are being discovered as time goes on. One of the babies is still unresponsive.
State Police said the injuries were suffered when their father, Richard Osborne, 29, of Wallback, snapped. The twins both have bleeding on their brains and broken ribs. One of the babies also has two broken arms and two broken legs.
State police said doctors diagnosed them with severe shaken baby syndrome, and the twins are fighting to survive.
“I visited the babies last night, and today they're about the size of a large house cat right now,” Trooper Brian Young said. “To see them this small, in this condition is very hard. One is responsive, she's up eating, the other is not responsive.”
Troopers said Osborne told them he was tired of listening to one of the babies cry, so he yanked her from her rocker Monday night and squeezed her until she stopped.
The next day, Osborne realized something was wrong with her arm and he took her to the doctor. That's when doctors realized this had not only happened once, but multiple times to both newborns because the babies had broken bones that had already healed.
Neighbor Faye Smith said Osborne grew up in the Wallback area and she was shocked at what he's accused of doing.
“He could have asked for help,” she said.
State Police said Osborne has never been in trouble and his home on Horse Fork road was well-kept.
Osborne had sole custody of the twins and was taking care of them on his own, because their mother's rights were severed due to an ongoing drug addiction.
“Parents need to remember to take a step back and remember how precious they are, before reaching down and touching them or doing anything,” Young said.
Since the mother no longer has parental rights because of her drug addiction, and Osborne is in jail facing numerous child abuse charges, that means the babies are in the hospital fighting this fight alone.
State Police said social workers have been staying around the clock to look after them and of course the nurses and doctors.
The couple also has a 2-year-old son. He was checked out and physically was OK. He is in foster care.

Dad locked up for breaking ribs of 3-month-old daughter (Carbondale, Pennsylvania)
It's a dang shame that mothers don't have decent paid maternity leaves in this country. Mom had just started a new job working the night shift. It was Daddy's FIRST NIGHT babysitting. And this short-tempered piece of crap couldn't take it. He got "frustrated" and took it out on a helpless baby.

CARBONDALE — Investigators in Lackawanna County are looking into a case of child abuse after a three-month-old girl was hospitalized with broken ribs.
Carbondale police said her father is locked up.
Matthew Brown, 22, is behind bars facing some serious allegations of child abuse.
Investigators accuse Brown of breaking his three month old daughter`s ribs inside an apartment at a complex in Carbondale.
Brown`s neighbors were visibly upset with the news.
“It`s not right, if you can`t handle it, walk away, don`t take it out on the baby,” said Noel Priest.
Carbondale police said Brown told police he was alone with the infant Sunday evening into Monday morning while the child’s mother was at work.
He said the baby “wouldn`t stop crying” and he got “frustrated” and “squeezed the infant tightly until she made a horrible gasping noise.”
He said he then “apologized for what he did and kissed her for what he did”.
According to police the mother told them she had just started a new job with an overnight shift beginning Sunday evening and ending Monday morning. When she returned home Monday morning, she noticed the baby was breathing funny and acting fussy, that`s when she contacted the family doctor.
Police said the girl was flown to Geisinger Children`s Hospital in Danville in critical condition with broken ribs and lung injuries.
One neighbor said she saw Children and Youth Services at the apartment complex talking to Brown and the child`s mother.
“The lady came and was knocking on the door, and the guy came back upstairs, he was like yeah you`re from Children and Youth and they came to talk to her.”
Many of Brown`s neighbors have children themselves and said violence towards children is never acceptable.
“Whether the baby sleeps one hour or two hours you should not to that to your child, it’s a disgrace,” said Dawn Jones.
Carbondale police said this is an ongoing investigation with the Lackawanna County District Attorney’s office and Children and Youth Services, and more charges could be filed.

Investigators say a Walland man intentionally pushed his six-week-old daughter from infant seat, causing severe bruising to the baby's abdomen and liver.
Jami-Dean Wesley Gregory, 30, of Walland, is charged with aggravated child abuse and neglect. He was arrested over the weekend.
Court documents indicated Gregory "knowingly and recklessly pushed infant victim from an infant seat casing the infant to fall onto a hard plastic toy."
Gregory admitted that he was responsible for the baby's injuries because he was "frustrated" that she wouldn't stop crying.

Investigators say a Walland man intentionally pushed his six-week-old daughter from infant seat, causing severe bruising to the baby's abdomen and liver.
Jami-Dean Wesley Gregory, 30, of Walland, is charged with aggravated child abuse and neglect. He was arrested over the weekend.
Court documents indicated Gregory "knowingly and recklessly pushed infant victim from an infant seat casing the infant to fall onto a hard plastic toy."
Gregory admitted that he was responsible for the baby's injuries because he was "frustrated" that she wouldn't stop crying.

GREENWOOD, S.C. (AP) - Bryan Sweatt was in the middle of a custody fight with his girlfriend over their 7-month-old daughter and facing a burglary charge that could put him in jail for years.
His girlfriend's father had warned him to stay away from his house and the dirt track Sweatt had built in the backyard for his all-terrain vehicles.
Then on Tuesday afternoon, Sweatt broke into the parents' house and waited for them and the girlfriend to come home, police said. When they did, Sweatt fatally shot his girlfriend, her parents and two children living there, before turning the gun on himself, Greenwood County Sheriff Tony Davis said.
"Once you see a horrific scene like this it never leaves you. It's with you day in and day out," he said.
The victims were identified as Richard Fields, 51; his wife, Melissa Fields, 49; their daughter Chandra Fields, 26; and two of the couple's grandchildren who lived with them: William Robinson, 9; and Tariq Robinson, 11.
Davis didn't specify a motive for the shootings, but said it appears they stemmed from a "domestic violence situation."
He said Sweatt felt that Chandra Fields wasn't allowing him to see their infant child often enough. The girl was not among the dead.
He said that Sweatt had called 911 while he was in the Fields' house, stating that he was on the edge and contemplating suicide, before hanging up.
It's unclear how many - if any - victims had been shot before he made the call at 5:54 p.m. Tuesday. A police report said a dispatcher heard a woman in the background say: "Do not point that at me" before the call was disconnected.
Sweatt allowed four children to escape - his 7-month-old daughter, the infant's cousin and two neighborhood children who came to the door after school to play with the Fields' grandchildren.
No one knows why Sweatt let them live and shot the others, Davis said.
"I cannot tell you at this point that I have all the answers for you," he said.
While they're still searching for clues, one thing is clear: Sweatt's life was spinning out of control.
Sweatt has a lengthy arrest record that dates back nearly a decade, according to state police records. Most of his charges were related to property crimes, such as burglary or forgery, although he was arrested once on aggravated assault charges.
He was supposed to be in court Tuesday on a burglary charge, Davis said. The sheriff didn't have many details about the hearing, but said Sweatt faced up to 30 years if he was convicted.
On July 6, 2012, a woman filed a complaint, saying she wanted to have Sweatt checked out because he was threatening suicide, according to a Greenwood County sheriff's office report. She also said she was afraid of him. No charges were filed.
Neighbors said that a few months ago Richard Fields started allowing Sweatt to store his recreational vehicles on his property. The Fields lived in a one-story home on a rural stretch of road south of Greenwood, a city of about 23,000 in northwestern South Carolina.
Neighbor Jeff Hicks said he didn't mind initially but things quickly changed. Strangers began showing up and racing the four-wheelers long into the night, he said, adding that Fields had complained to him about the noise and said he was going to ask Sweatt to stop coming around.
"He just couldn't take it anymore. He was just fed up," Hicks said.
Hicks said he had frequently talked with his quiet, friendly neighbor about hog hunting and other outdoor activities.
"It's a shame. It just tears you up," said Hicks, who last saw Fields Tuesday morning. "I waved to him, and now I'll never see him again. That's how short life is."
On Wednesday morning, Hicks showed an Associated Press reporter the shed and backyard that still houses more than half-a-dozen four-wheelers. Children's toys and a plastic slide were strewn about an adjoining back yard.
Sheriff Davis said Fields also believed that Sweatt had stolen property from him and told him "not to come back."
But on Tuesday, Sweatt returned.
After breaking in, he waited for the victims to come to the house.
Officers went to the home after receiving the 911 call from Sweatt. Davis said while police were on their way, a neighbor called 911 saying four children from that address had arrived at her house and told her a shot had been fired. He said the children remained at her house.
After about an hour and "several unsuccessful attempts" by officers to make contact with anyone in the home, the SWAT team entered and discovered the bodies, authorities said.
"This is a tragedy," said neighbor Ansel Brewer. "It just so hard to imagine something like this going on here. Why would someone do this?"

Father admits critically injuring infant while drunk

A Johns Creek father was sentenced to 10 years in prison Monday after admitting he abused his 5-week-old daughter.
Gregory Odell Barnett pleaded guilty to child abuse charges in the January attack that left the child with brain damage, Channel 2 Action News reported. But Barnett was too drunk at the time to remember what he did to the girl, his attorney told the courtroom.
Barnett was arrested in January after the baby’s mother returned home to find the child suffering from severe swelling to her head, police previously said. The baby’s mother, Courtney Johnson, told The Atlanta Journal-Constitution after the arrest that her boyfriend had been violent with her in the past, but she never thought he would harm their child.
The couple had a fight on Jan. 12 and Johnson said she left the home for about 20 minutes, leaving her newborn with Barnett. When she returned, she found the baby lying face down on a pillow and crying, suffering from severe swelling to her head, according to police.
“The baby’s rear, left and right side of her head looked deformed due to the massive amount of swelling,” the police report stated.
The child was flown to Children’s Healthcare of Atlanta at Scottish Rite and Barnett was arrested.
In court Monday, Johnson said the baby was left with severe brain damage and is developmentally delayed.
“I know in the back of my mind, she might not ever sit up,” Johnson said. “My daughter may never crawl, she may never walk, never feed herself. Might never say the word mama.”
In addition to prison time, Barnett was also sentenced to 10 years probation.

We've posted on this case before. What is interesting is how this account totally fails to mention that dad SHAYAA YUSUF FORBES had custody. Of course, it follows that there is no questioning as to why this father had custody or who gave it to him. This, unfortunately, is very typical.

The Paulding County, Ga. father accused of murder and child cruelty in the death of his 12-year-old son Eric Forbes was given bond on Oct. 29. Shayaa Yusuf Forbes remains in the Paulding County Sheriff's Office Adult Detention Facility as of Tuesday afternoon despite the $30,000 bond being set by a judge hearing the charges.
Eric Forbes' father faces one felony murder charge and two child cruelty charges in the Oct. 11 death of his son, who he says was unconscious in a bathtub when he went to check on him, and that the youth's head was "bobbing" in the water when he found him.
An autopsy conducted in the state shows that the young boy was the victim of repeated abuse that had left bite marks, bruises and lacerations all over his body. And investigators are continuing to gather information in the case.
Shayaa Yusuf Forbes and the child's mother, Ashlei Majors, also have another child together. That female child is in the custody of Georgia's Division of Family and Children Services, and she has been since the night her brother died.
A burial fundraising effort on behalf of Eric Forbes took place earlier this month following his death, and the proceeds that exceeded the burial expense were going to be used to pay for a college scholarship for the victim's younger sister Erica.
Wells Fargo Bank, along with Dallas' Crossroads Neighborhood Grille and Cedarcrest Pizza Shack were all instrumental in raising money through the Eric Forbes Fund discussed on Facebook in order to help pay the cost of the 12-year-old boy's funeral and burial expenses. The effort was well received in the community, who turned out in large numbers to contribute to the effort.

Father Who Tortured, Killed Son: ‘I Have Nightmares’

(CBS) — The story stunned anyone who heard it. A young boy was tortured, caged, killed and buried for years before being discovered — all done by members of his own family. When the public learned the story of Christian Choate, the outrage was so intense, a gag order was issued.
CBS 2′s Brad Edwards began investigating this case earlier this year and has the first interview with the boy’s father, Riley Choate, who is in an Indiana prison.
“People think I’m a monster,” said Riley Choate serving 80 years in connection with his son’s death.
When asked whether he will be going to Heaven or Hell, Choate said, “Sometimes I have that little doubt.”
The answer to that question is a simple one for the man who put Choate away, Sheriff John Buncich.
“To me he’s an animal,” says Buncich.
The gruesome discovery of the boy buried took place in a Gary, Indiana, mobile home park where Christian lived with his father, step-mother and nine other kids all in a single-wide trailer. CBS 2 found folks there angry for the attention they are getting.
“What part of this don’t you understand?” yelled one man, while another screamed, “You better not be filming!”
It has been nearly six years since he was first chained in a dog cage. It has been two-and-a-half years since his body was unearthed, yet, there is still no headstone marking his life.
“There’s a lot,” said Riley Choate. “I just don’t even know where to start.”
Choate admits what happened to his son is a horror story.
“It was no life for no one,” said Choate.
Christian once lived with his mother and her boyfriend; a household with neglect allegations. So Riley Choate won custody in 2005, which was a full year after he was accused of beating Christian.
Choate says the punishments started after Christian, who was allegedly sexually abused by a different adult, attempted to sexually abuse a relative.
“He started playing the hump game,” said Choate.
Court records say Christian’s punishment included: starvation, beatings, no school, no play time and the cage.
A prosecutor on this case said: “Christian Choate sat in that cage, losing his mind, losing his strength and probably his humanity.”
Riley Choate only takes veiled responsibility.
“Did I fail him? Yes, I failed him,” said Choate, but then said, “I think I’m the only one who loved him.”
Police say Christian died after one final beating at dad’s hand. The family then made a decision.
“Nobody’s gonna (sic) miss him anyhow,” said Choate. “We’ll just bury him.”
And they were right.
“I put him in the hole. I put him in there. I covered him up,” said Choate.
Twenty-five months later, the family long moved away, Christian’s sister reported it.
“I have nightmares. I can see him in my sleep,” said Choate. “I see his face. I see him in that cage and I’m like man, man. It’s like he reaching up towards me saying you know help me.”
In Christian’s own words, in letters outlined in a Department of Child Services accounting, he wondered when, “someone, anyone, was going to check on him”. He “wanted to be liked by his family”. He was “isolated”, “hungry” and “wanted to die”.
“I say ‘Christian, I’m sorry, you know dad let you down, you know’,” said Choate. “I just hope he forgives me.”
Not good enough for Sheriff Buncich who says there would only be one type of true justice in this case: “No less than the death penalty.”
Riley Choate says he is the fall-guy for what he believes was the fault of many.
So, what’s changed? And what’s next?
“Why weren’t more people charged?” asked Edwards .
“That’s a good question,” said Lake County Sheriff John Buncich, the only public officials to grant never-before seen access to the case file.

(CBS) — The story stunned anyone who heard it. A young boy was tortured, caged, killed and buried for years before being discovered — all done by members of his own family. When the public learned the story of Christian Choate, the outrage was so intense, a gag order was issued.
CBS 2′s Brad Edwards began investigating this case earlier this year and has the first interview with the boy’s father, Riley Choate, who is in an Indiana prison.
“People think I’m a monster,” said Riley Choate serving 80 years in connection with his son’s death.
When asked whether he will be going to Heaven or Hell, Choate said, “Sometimes I have that little doubt.”
The answer to that question is a simple one for the man who put Choate away, Sheriff John Buncich.
“To me he’s an animal,” says Buncich.
The gruesome discovery of the boy buried took place in a Gary, Indiana, mobile home park where Christian lived with his father, step-mother and nine other kids all in a single-wide trailer. CBS 2 found folks there angry for the attention they are getting.
“What part of this don’t you understand?” yelled one man, while another screamed, “You better not be filming!”
It has been nearly six years since he was first chained in a dog cage. It has been two-and-a-half years since his body was unearthed, yet, there is still no headstone marking his life.
“There’s a lot,” said Riley Choate. “I just don’t even know where to start.”
Choate admits what happened to his son is a horror story.
“It was no life for no one,” said Choate.
Christian once lived with his mother and her boyfriend; a household with neglect allegations. So Riley Choate won custody in 2005, which was a full year after he was accused of beating Christian.
Choate says the punishments started after Christian, who was allegedly sexually abused by a different adult, attempted to sexually abuse a relative.
“He started playing the hump game,” said Choate.
Court records say Christian’s punishment included: starvation, beatings, no school, no play time and the cage.
A prosecutor on this case said: “Christian Choate sat in that cage, losing his mind, losing his strength and probably his humanity.”
Riley Choate only takes veiled responsibility.
“Did I fail him? Yes, I failed him,” said Choate, but then said, “I think I’m the only one who loved him.”
Police say Christian died after one final beating at dad’s hand. The family then made a decision.
“Nobody’s gonna (sic) miss him anyhow,” said Choate. “We’ll just bury him.”
And they were right.
“I put him in the hole. I put him in there. I covered him up,” said Choate.
Twenty-five months later, the family long moved away, Christian’s sister reported it.
“I have nightmares. I can see him in my sleep,” said Choate. “I see his face. I see him in that cage and I’m like man, man. It’s like he reaching up towards me saying you know help me.”
In Christian’s own words, in letters outlined in a Department of Child Services accounting, he wondered when, “someone, anyone, was going to check on him”. He “wanted to be liked by his family”. He was “isolated”, “hungry” and “wanted to die”.
“I say ‘Christian, I’m sorry, you know dad let you down, you know’,” said Choate. “I just hope he forgives me.”
Not good enough for Sheriff Buncich who says there would only be one type of true justice in this case: “No less than the death penalty.”
Riley Choate says he is the fall-guy for what he believes was the fault of many.
So, what’s changed? And what’s next?
“Why weren’t more people charged?” asked Edwards .
“That’s a good question,” said Lake County Sheriff John Buncich, the only public officials to grant never-before seen access to the case file.

Custodial dad accused of sexually molesting son, who also accused him of sleeping with family court judge who awarded dad sole custody (Covington, Ohio)
It's easy to get lost in this story, and get sidetracked by dad KENNETH LALLEY's efforts to get off the child abuse registry now that his son's sexual abuse allegations have been "unsubstantiated."
But if you read this carefully there is some weird stuff going on here. First, the son is whisked away to a mental hospital (For what? Being unhappy being in an abusive father's care?) where he accuses dad of molesting him--more than 50 times. Kids seldom lie about these things, which makes what happens next particularly interesting.
He also states that his father is sleeping with the family court judge who awarded him custody (!)
Then the "system" kicks in. The case worker refuses to report the allegations regarding the family court judge. In fact, they find the allegations so "far-fetched" that they refuse to investigate!
Far-fetched? Not really. I know of many cases where inappropriate relationships between the custodial father and various persons associated with the case have arisen. The case of Alanna Krause for one.
With additional mental health "treatment" the son eventually "recants" (under pressure?) Why the "recanting" is more believable than the original allegations is never explained. Nor is it pointed out here that the use/abuse of psychological "experts" to bring kids into line with Daddy's denials has become almost commonplace with well-heeled abusers.
And now Daddy is suing the people who originally took the allegations seriously. As if we haven't seen this before too....

COVINGTON — The nightmare for Kenneth Lalley started when a state social worker showed up at his door on a late April 2012 night to take away his children, for whom he had sole custody.
Lalley got his children back the next month after authorities found no truth to an allegation that he sexually molested one of his children – but that didn’t end Lalley’s nightmare.
“This is a single father of four children who for no reason lost his kids for weeks,” said Lalley’s civil attorney, Shane Sidebottom, who advised his client not to speak with reporters. “He had to prove he didn’t do anything wrong ... just to see his kids again.”
Eighteen months later, the burly 51-year-old Union resident still has custody but is fighting to get off a little-known list of people in Kentucky who have been accused of abusing or neglecting children, called the Child Abuse and Neglect Registry, or CAN Registry for short. It is a registry for people who have been accused but not necessarily convicted in court.
Lalley filed a federal lawsuit earlier this year in Covington against Lisa Prewitt, the regional administrator for the Cabinet for Health and Family Services, and Geri Purvis, a state social worker, over their handling of his case.
“The purpose of the lawsuit is to send a message to the cabinet they can’t ruin people’s lives like they have done in this case,” Sidebottom said.
The cabinet, whose in-house legal team is representing Prewitt and Purvis, claimed in a written statement that it believes the facts of the case support its social workers and their supervisors.
“Our social workers are highly trained, caring professionals who followed Standard of Practice at all times during this difficult referral,” the statement reads. “We are very supportive of these staff and are confident that court proceedings will demonstrate that their focus, as always, has been to protect children.”
Son makes accusation against father and judge
Troubles started for Lalley when his oldest son checked into a hospital that specializes in mental health disorders and drug and alcohol addictions on April 8, 2012, in Louisville, according to the suit. The son told hospital officials his father sexually molested him.
Purvis, accompanied by a state trooper, showed up at Lalley’s door on April 10. Lalley’s three other children were taken to their maternal grandmother’s home.
The cabinet got Boone Family Court Judge Linda Bramlage to sign an Emergency Court Order, or ECO, authorizing the children to be removed on April 12 – two days after the fact, according to the suit.
One of the problems with the ECO was the affidavit the cabinet used to obtain it contained lies, according to the suit. The cabinet has admitted in court that its employees redacted an allegation from Lalley’s oldest son that Bramlage molested him more than 50 times. The son also claimed his father was also having sex with Bramlage.
“The allegations are that the social worker intentionally withheld critical information from the judge,” Sidebottom said. “In my mind that is no different than lying to the judge.” The oldest son knew Bramlage because she presided over his parents’ divorce and had awarded Lalley sole custody of the children.
The first court hearing held on the allegation Lalley abused his son was April 13 in Boone Family Court. That’s when the allegation that Bramlage also abused the child was revealed in open court.
Bramlage didn’t know she had been accused when she signed the order granting the children to be removed, according to the suit. Bramlage declined to comment. Sidebottom said the allegation against Bramlage was so far-fetched that it was never investigated.
Bramlage was taken off the case. It was taken over by a senior judge who travels around the state relieve crowded dockets and take cases where a conflict exists with the local sitting judge.
The senior judge ordered that all the children, except the oldest son, be returned to Lalley’s sole custody on May 24. The suit states the oldest son remains in a hospital to receive treatment for emotional and dependency problems. He has received psychiatric treatment on at least seven other occasions, according to the suit.
Sidebottom said the son has since recanted the allegations and said he lied because he wanted to live with his mother.
Even after being cleared, the troubles were not over
Despite the court proceedings finding that no sexual abuse or neglect had occurred against the children, the cabinet sent Lalley a letter on June 21, 2012, stating it had substantiated the son’s claims of abuse. The suit claims that is when the cabinet placed Lalley on the CAN Registry.
It’s different than the publicly accessible Kentucky Sex Offender Registry. Only people convicted of certain sex crimes are placed on that list. Someone can land on the CAN Registry if social workers find that person abused or neglected a child.
The CAN Registry isn’t accessible to the general public. Some instances of when this registry is used included background checks for employers at child care centers in their hiring process and background checks for the state’s prospective foster and adoptive parents, according to the cabinet. Volunteer groups that have staff working with children may also use it for background checks.
As long as he is on the list, anyone can stop him from volunteering at his children’s schools or being involved with other youth-related agencies.
“For all practical purposes, it is blocking him from being a complete parent to his kids,” Sidebottom said.
Lalley is still fighting to get off the CAN Registry, Sidebottom said. Individuals placed on the registry can request an administrative hearing.
Lalley has requested that hearing, and Sidebottom said the cabinet has indicated it will not object to
Lalley’s request to be removed from the CAN Registry. A year and a half later, the state has yet to set a hearing date.
Sidebottom said Bramlage was never placed on the CAN Registry.

A REVIEW has found that social services were unaware that the father of a baby who was found dead at a Southampton home with a fractured skull, had a previous conviction for child cruelty.
Paramedics were called to the address after the three month old was found faced down in a moses basket in September 2011.
A post mortem concluded the infant, known as Child G in the report, had died from Sudden Death Syndrome with what were described as “non-accidental injuries” namely a fractured skull.
An examination was also carried out on the baby's twin, referred to as Child H, which identified a leg fracture and a possible healing skull fracture.
Due to the injuries the surviving twin was taken into care and both parents arrested. However, no charges were ever brought.
A serious case review was subsequently launched to discover whether the authority could have done more to prevent the death or injury to the sibling.
As a result of their findings, calls have now been made for a national register to be kept so that people who have been convicted of violent crimes against children can be tracked.
It found failings in the way information was shared by the police, probation service and between health professionals which could have alerted the authorities to the background of both parents.
Published today the report highlights how the city council was unaware that the father of the twins had served a year in prison after being convicted of fracturing the skull of his son who he had from a previous relationship.
The prosecution of the case, which happened in another part of the country, heard how the youngster had received injuries from the age of about four or five weeks and in all had five fractures to his body.
Following his release from prison the man moved to Hampshire and subsequently to Southampton where he ceased to be monitored when he completed his probation with no concerns raised.
He was told that he should contact the local authority should he have any children in the future.
The report also highlights how Hampshire police did not pass on the conviction to Southampton City Council when the couple applied for housing due to “confusion” relating to how the information was recorded on the National Police Record service.
The babies' mother also had a background of depression and both parents had a history of self harm which again was unknown to social services as records were not transferred when the couple changed GP practices.
It also outlines how health professionals dealing with the pregnancy did not adequately investigate the background of the parents.
It states: “To leave important questions about background information unanswered on an assessment form is an unprofessional and potentially dangerous practice.”
However, the SCR also states “it was difficult to see what alternative or additional actions could have been undertaken” in this particular case.
The author of the Serious Case Review recommends that the LSCB should formally support a recommendation that new arrangements be established at national level to register offenders who have committed violent offences against children. These arrangements would require offenders to record their address with the Police and be subject to monitoring arrangements for specified periods of time.
Keith Makin, the new Independent Chair of the Southampton LSCB, said: “This tragic case highlights a number of important learning points for LSCB partners as they seek to improve services for children in Southampton.
“It also highlights an important national issue: how - in the absence of a national register - agencies can best track the risks posed by offenders who have committed violent crimes against children. We have written to the Home Office about this and in the meantime our colleagues in the LSCB partner organisations are working together to develop our systems locally.”

Reddout had been charged with first-degree murder, but in September jurors convicted him of involuntary manslaughter and other, lesser charges, including child endangerment causing death and child endangerment, multiple acts.
The charges stem from the April 2011 death of Kaleb Reddout at a Cedar Falls motel. Prosecutors say Reddout choked his son in an effort to put him down for a nap with a technique he frequently used. He would lift the child's jaw and apply pressure to the back of his neck.

BROOKSVILLE - The Nodding Shade Drive home, with Halloween decorations in the front yard and an SUV in the driveway, looked like many others in the Trillium subdivision, just south of Brooksville.
However, the house at 975 Nodding Shade Drive was anything but, as it was the site of a double murder-suicide where a father took the lives of his two children, before turning the gun on himself.
Sheriff Al Nienhuis discussed the details of the double murder-suicide on Monday morning, which he said was perhaps incited by a recent divorce filing.
The shooter was identified as Daniel Castrillon-Oreggo, 39. The deceased children, Susana Castrillon, 8, and Sabastian Castrillon, 7, were students at Chocachatti Elementary School. Their mother, Luz Jimenez, 39, was not injured.
Nienhuis said Jimenez filed for divorce on Oct. 12 and moved out of the Nodding Shade Drive home, and that Castrillon-Oreggo had visitation with his children on the weekends.
On Friday, Castrillon-Oreggo picked up his children from school, and later got into an argument with Jimenez at her place of employment. Nienhuis said the two spoke later Friday evening about Castrillon-Oreggo returning to his native Colombia after the divorce was finalized.
Nienhuis said Jimenez was supposed to pick up her children to go to a birthday party on Saturday, but was unable to contact her estranged husband.
"She apparently didn't become very concerned, she just thought he did not want to give up his visitation," Nienhuis said.

"It's very difficult any time you have innocent children killed. It's even worse when they're killed by someone who is supposed to be there to take care of them," Nienhuis said.
"I feel for my deputies who had to deal with this last night," Nienhuis said, adding it was the same squad who responded to a "similar" murder suicide in Hernando Oaks in September.
Media Relations Specialist for Hernando County Schools, Roy Gordon, said Susana Castrillon was in third grade and Sebastian Castrillon in second grade.
Crisis teams were at the elementary school Monday morning, Gordon said.
"We got counselors, and for the most part that has been for the teachers," said Gordon. "Most of the students are unaware."
Gordon said the district put a call out to parents around 9:30 a.m. informing them of the tragedy and the option to pick their students up from the school if they wish.
"We've figured most of (the students) are to learn of the incident at their home," Gordon said. "There was a staff meeting and some of the teachers have taken it pretty hard. I think we had a couple substitutes for teachers who are in need of counseling."
Chocachatti principal Lara Silva could not be reached for comment.

BROOKSVILLE - The Nodding Shade Drive home, with Halloween decorations in the front yard and an SUV in the driveway, looked like many others in the Trillium subdivision, just south of Brooksville.
However, the house at 975 Nodding Shade Drive was anything but, as it was the site of a double murder-suicide where a father took the lives of his two children, before turning the gun on himself.
Sheriff Al Nienhuis discussed the details of the double murder-suicide on Monday morning, which he said was perhaps incited by a recent divorce filing.
The shooter was identified as Daniel Castrillon-Oreggo, 39. The deceased children, Susana Castrillon, 8, and Sabastian Castrillon, 7, were students at Chocachatti Elementary School. Their mother, Luz Jimenez, 39, was not injured.
Nienhuis said Jimenez filed for divorce on Oct. 12 and moved out of the Nodding Shade Drive home, and that Castrillon-Oreggo had visitation with his children on the weekends.
On Friday, Castrillon-Oreggo picked up his children from school, and later got into an argument with Jimenez at her place of employment. Nienhuis said the two spoke later Friday evening about Castrillon-Oreggo returning to his native Colombia after the divorce was finalized.
Nienhuis said Jimenez was supposed to pick up her children to go to a birthday party on Saturday, but was unable to contact her estranged husband.
"She apparently didn't become very concerned, she just thought he did not want to give up his visitation," Nienhuis said.

Yet another case where Daddy apparently murdered a child to punish Mom for leaving. Providing Daddy with access to the child just provided him with the opportunity to shoot her to death.

Sobbing family members held each other tight after learning the unbearable news from investigators Sunday.
According to investigators, Camryn Shultz, 1, had been shot and killed by her father Nick, who then turned the gun on himself.
Grandfather Tom Hess said shortly before the killings, Nick called Camryn’s mother Jessee with a chilling message.
“Told her to say good-bye to her daughter, she said ‘What do you mean?’ he said, ‘I’ve got one bullet for her and one for me,’” said Hess.
Family members said the parents split up about a week and a half ago.
“We thought he was just trying to scare us, we called 911 and said to get the police over here,” said Hess.
Just one day before, the family celebrated the little girl’s second birthday, which would have been on Tuesday.
“She loved Minnie Mouse, that was the big theme of the party, Minnie Mouse, she loved it, first thing in the door in the morning she would say that I want to see Minnie.”
It was Camryn’s Minnie Mouse doll that Luzerne County District Attorney Stephanie Salavantis removed from the house on Wesley street in Forty Fort and presented to her sobbing mother.
“We are still conducting our investigation, but our quick run through is that he has not had a criminal history, or any domestic disputes,” said Salavantis.
Now a stunned family is left to grieve.
“She was just a gorgeous little two-year old she liked to call me “pop pop” and grammy was “mom mom,” added Hess.

A missing Deltona mother and her children are dead.
Yessenia Suarez, 28, Thalia Otto, 9, and Michael Otto, 8, were last seen Tuesday, the same day that Suarez's husband was accused of slapping her during an argument at her workplace in Lake Mary.
"They found them dead. The boy. The girl. All three, they're dead," a woman sobbed as she ran into the arms of other mourners in the driveway of Suarez's parents' home in Deltona.
However, deputies would not reveal how they learned that the mother and children had died, saying they didn't want to share any information that might jeopardize their investigation.
A sheriff's spokesman said Thursday evening that deputies were still searching for the bodies.
"It's a very sensitive investigation," sheriff's spokesman Brandon Haught said. "We've been following leads wherever they may take us."
Relatives and friends shuffled in and out of the house on Paddington Place, pressing cellphones to their faces to inform others of the tragedy. Some spoke in whispers. Others wailed.
Suarez's husband, Luis Toledo, 31, was arrested Wednesday on a domestic-violence battery charge. Toledo became upset about text messages that he found on Suarez's phone and went to her office Tuesday at American K-9 Detection Services on Primera Boulevard to tell a manager about "her indiscretions," an arrest report states.
He got into an argument with Suarez and slapped her, leaving a red mark on her cheek, according to the report.
That was the last time anyone at work saw Suarez, a company spokesman said.
Deputies called Toledo a "person of interest" in the deaths and were interviewing him. He acknowledged arguing with his wife but denied hitting her, deputies said.
Suarez's family told investigators that she and her husband had been talking about separating. Records show they were married on New Year's Day 2011.
Toledo's sister-in-law, Kimberly LaSanta, sought a domestic-violence injunction against Toledo last year after he sent more than 50 threatening text and voicemail messages to her in two days, according to court records.
Lasanta had just served Toledo's brother with divorce papers when she began receiving the threats, according to her court petition.
"He has threatened to take my kids, send someone to come in my house and hurt me," LaSanta wrote. "He threatened to put me in jail and hurt me. I have saved all 54 text messages for the judge to see. I am in fear of this man."
A judge rejected her request.
Earlier Thursday, Suarez's stepfather, Ruben Perez, told reporters at his home that he had not seen his daughter or her children since Tuesday. Deputies began looking for the mother and children after relatives raised alarm at not hearing from Suarez.

A MAN, 36, accused of killing his ex-wife, 26, and five-year-old son in Malaga told a judge that they began fighting because she told him he had to sleep on the sofa.
They had split up in July and he went to her home in September because she was going out with some friends and he was going to look after their son. He told the judge that he wanted to sleep in the double bed with the boy, but she said he had to sleep on the sofa, and an argument broke out.
However, he claimed that he “wasn’t himself”, “lost control” and could not remember how he killed his ex-wife and son.

A MAN, 36, accused of killing his ex-wife, 26, and five-year-old son in Malaga told a judge that they began fighting because she told him he had to sleep on the sofa.
They had split up in July and he went to her home in September because she was going out with some friends and he was going to look after their son. He told the judge that he wanted to sleep in the double bed with the boy, but she said he had to sleep on the sofa, and an argument broke out.
However, he claimed that he “wasn’t himself”, “lost control” and could not remember how he killed his ex-wife and son.

State police have arrested a Mansfield man accused of assaulting his 5-month-old baby.
David Saegaert, 19, 414 Warrenville Road, was taken Monday into custody on charges of first-degree assault and risk of injury to a minor.
Troopers from the Troop C barracks in Tolland, and the Eastern District Major Crime Squad, began the investigation on May 31 after getting a report of a 5-month-old infant who received numerous unexplained injuries, according to a police press release.
The injuries included "new fractures as well as old ones" that the baby sustained in the process of healing, the release said.

Four of the children found in the house were taken to hospital for check-ups. When their father returned home, he was arrested on suspicion of child neglect.
After being interviewed, he was bailed until December 4.
A police spokesman said: “We had to kick the door down to gain entry.
“The house was not clean. It was dirty.
“We had enough concerns to take the children because of the condition of the house and the children themselves. We contacted social services who took care of the children.”
All eight children, who cannot be identified for legal reasons, were placed in emergency care by council social workers.
Meanwhile, a joint investigation into the family and the father’s conduct was launched by police and social services in Blackburn, Lancs.
Paul Lee, head of safeguarding at Blackburn with Darwen Council, said: “I can confirm we were alerted by police to an alleged case of child neglect.

That’s how a man from Huntington describes what he is feeling after State Police say he put his baby daughter in the hospital as the result of child abuse.
Thursday, troopers arrested and charged William Alan Andrews, 35, with child abuse by a parent or guardian.
They say Andrews admitted losing his temper Wednesday morning when his three month old wouldn't stop crying.
Troopers say that around 7 a.m., Andrews' wife left home to take their other child to school and left her husband to watch the baby. She told troopers the baby either sleeps in her bed or in a car seat with a pillow.
In the criminal complaint, Mrs. Andrews says when returned home she found her daughter limp, her eyes rolling back, and her tongue going down her throat. The couple then immediately took the infant to the emergency room.
State Police say at first, Mr. Andrews told them he couldn’t explain what happened to his daughter. But Thursday afternoon after he was arrested, he confessed to shaking the 3-month-old harder than he should have due to the fact that she would not stop crying. Andrews also told troopers that after shaking her, he “slammed” her back into the car seat.
Not only did Andrews confess to investigators according to the criminal complaint, he also confessed to our camera during his arraignment in Cabell County Magistrate Court.
"It just happened all at once." And then was it instant regret? "More or less, yes."
He also had a message for anyone who feels anger around children.
"My message would be to other folks who start to lose it, is try to go seek help to keep from losing it to hurt other people," said Andrews.
"It's not the norm. And that's why we can't wrap our head around why these individuals do what they do. And that's what makes it tough. It's just mentally exhausting, and hoping tomorrow's a better day,” said Trooper Will Hash."
State Police say the baby had brain bleeds, bruising on the cheeks and retinal hemorrhages. She is currently in fair condition at Cabell Huntington Hospital.
Andrews is being held in the Western Regional jail on a $200,000 cash only bond.

He had been prescribed the valium and dalmaine pills but had them for illegal sale or supply when he was searched.
Judge Victor Blake sentenced him at Dublin District Court after hearing he had prior convictions for dealing.
Brady, with an address at Turvey Woods, Donabate, had denied possession of drugs with intent to sell or supply on February 13.
Gda Emmett Brannigan told the court he was on plain-clothes duty near Dominick Street in the north inner city when he saw Brady pushing a buggy up the street.
When a woman approached the accused he gave her something and she handed over cash.
A total of 132 pills and €810 in cash were found on Brady when he was searched.
He was arrested and brought to Store Street Garda Station where he was given an opportunity to account for the drugs but he failed to do so.
In cross-examination, Gda Brannigan told defence solicitor Declan Fahy the woman who approached the accused was aged around 30 and was a "small dark-haired girl with the appearance of a drug addict".

Another garda had spoken to her and there was no evidence of anything having been found on her.
Gda Brannigan said it had not been a complex incident and he recalled the details of what he had observed.
"It wouldn't be every day you see somebody wheeling a buggy up the road engaged in this, so it would be something that would stick out in my mind", he said.
Gda Brannigan said benzodiazepines were one of the biggest problem drugs around the city after heroin and it was not unusual for them to be sold.
Judge Blake imposed two concurrent sentences and set bail terms in the event of an appeal.

(Frankly, I suspect the judge was pissing in his pants, he was so afraid of this guy. So he just gave him what he wanted--full access/control over a child.)
We're never given the names of the social workers who visited 20 TIMES and we're too cowardly/stupid and/or brainwashed by fathers rights ideology to intervene and protect this boy.

The blond boy was 10 when he put a gun to the head of his sleeping neo-Nazi father and pulled the trigger.
It was over in an instant for Jeff Hall, but deciding the fate of his son has been a two-and-a-half-year journey that approaches its final stage on Friday in a hearing to determine where he will spend his teens and, possibly, his early adult years.
The judge hearing the case must decide not how to punish a child for second-degree murder, but how to rehabilitate someone who grew up in an abusive home, attacked his school teachers and was indoctrinated in the beliefs of white supremacy.
Lawyers have argued for months over what is best for the boy. He has been living in the county's juvenile hall since the killing, but spent about three months at a state youth detention centre where he was evaluated to see whether a placement there could serve his needs.
In the meantime, the small child who scribbled on a notepad and looked bored during his trial as prosecutors displayed photos of his father's blood-splattered body has grown into a gangly teenager.
He attends class, gets regular therapy and has made progress in controlling the violent outbursts that got him kicked out of almost every school he attended. He has even won the affection of the prosecutor who got him convicted.
"I have grown attached to him in an odd way. I enjoy watching him grow and change, but I am convinced he has done better in a quasi-military penal environment," said the deputy district attorney, Michael Soccio. "He seems to like it, he knows what the rules are and what is expected and he is treated with dignity."
That's why Soccio believes the boy, now 13, would do best in the state's juvenile justice system, where he would go to school and live in a dorm-like setting at a high-security facility for young offenders, possibly until he is 23.
Defence lawyers, however, say he has serious emotional disabilities that the state is not equipped to handle. They want to see him placed in a residential treatment centre, where security would be lighter and the therapy would be more intense.
Punam Patel Grewal, the boy's lawyer, said he would also be at risk in a state facility because of his father's neo-Nazi beliefs. "It is a very dangerous place for him. He's got a lot of vulnerability here," she said. "When he comes out at 23, we've got a huge problem."
Murders by defendants as young as the one in Riverside are extremely rare and usually involve children who have mental health issues and have lived through extreme physical and psychological trauma, said Sarah Bryer, the director of the National Juvenile Justice Network. "
If the end goal is rehabilitation, then that youth's mental health concerns are going to have to be front and centre," she said. "I think the judge has to ask the question, when this kid walks out – and this kid will walk out eventually – how is this kid going to be better?"
Hall's killing on 1 May 2011 attracted national attention, and not just because of the defendant's age. Hall, an out-of-work plumber, was also a regional leader of the National Socialist Movement who organized neo-Nazi rallies at synagogues and day labour sites and had hosted a meeting of the group at his house the day before he died. Hall, 32, ran unsuccessfully for a water board in 2010 and alarmed voters with his white supremacist rhetoric.
Prosecutors said the boy shot his father behind the ear at point-blank range as he slept on the sofa after coming home from a night of drinking. The child took the .357 Magnum from his parents' bedroom and later told police he was afraid he would have to choose between living with his father and his stepmother, who had been fighting and were headed for a divorce.
The boy's stepmother initially told police she had killed her husband, but later recanted and said she was trying to protect her stepson. His sister testified that he told her of his plan the day before.
During the trial, the boy's lawyer portrayed him as a victim of both his father's racist beliefs and of his violent upbringing.
The boy's stepmother told authorities that Hall had hit, kicked and yelled at his son for being too loud or getting in the way. Hall and the boy's biological mother had each accused the other of child abuse during a protracted custody dispute. Social workers visited 20 times, but never removed the boy or his siblings from Hall's custody.
The child had a history of being expelled from school for violent outbursts, starting aged five when he stabbed a teacher with a pencil on the first day of kindergarten. He also tried to strangle a teacher with a telephone cord.

The blond boy was 10 when he put a gun to the head of his sleeping neo-Nazi father and pulled the trigger.
It was over in an instant for Jeff Hall, but deciding the fate of his son has been a two-and-a-half-year journey that approaches its final stage on Friday in a hearing to determine where he will spend his teens and, possibly, his early adult years.
The judge hearing the case must decide not how to punish a child for second-degree murder, but how to rehabilitate someone who grew up in an abusive home, attacked his school teachers and was indoctrinated in the beliefs of white supremacy.
Lawyers have argued for months over what is best for the boy. He has been living in the county's juvenile hall since the killing, but spent about three months at a state youth detention centre where he was evaluated to see whether a placement there could serve his needs.
In the meantime, the small child who scribbled on a notepad and looked bored during his trial as prosecutors displayed photos of his father's blood-splattered body has grown into a gangly teenager.
He attends class, gets regular therapy and has made progress in controlling the violent outbursts that got him kicked out of almost every school he attended. He has even won the affection of the prosecutor who got him convicted.
"I have grown attached to him in an odd way. I enjoy watching him grow and change, but I am convinced he has done better in a quasi-military penal environment," said the deputy district attorney, Michael Soccio. "He seems to like it, he knows what the rules are and what is expected and he is treated with dignity."
That's why Soccio believes the boy, now 13, would do best in the state's juvenile justice system, where he would go to school and live in a dorm-like setting at a high-security facility for young offenders, possibly until he is 23.
Defence lawyers, however, say he has serious emotional disabilities that the state is not equipped to handle. They want to see him placed in a residential treatment centre, where security would be lighter and the therapy would be more intense.
Punam Patel Grewal, the boy's lawyer, said he would also be at risk in a state facility because of his father's neo-Nazi beliefs. "It is a very dangerous place for him. He's got a lot of vulnerability here," she said. "When he comes out at 23, we've got a huge problem."
Murders by defendants as young as the one in Riverside are extremely rare and usually involve children who have mental health issues and have lived through extreme physical and psychological trauma, said Sarah Bryer, the director of the National Juvenile Justice Network. "
If the end goal is rehabilitation, then that youth's mental health concerns are going to have to be front and centre," she said. "I think the judge has to ask the question, when this kid walks out – and this kid will walk out eventually – how is this kid going to be better?"
Hall's killing on 1 May 2011 attracted national attention, and not just because of the defendant's age. Hall, an out-of-work plumber, was also a regional leader of the National Socialist Movement who organized neo-Nazi rallies at synagogues and day labour sites and had hosted a meeting of the group at his house the day before he died. Hall, 32, ran unsuccessfully for a water board in 2010 and alarmed voters with his white supremacist rhetoric.
Prosecutors said the boy shot his father behind the ear at point-blank range as he slept on the sofa after coming home from a night of drinking. The child took the .357 Magnum from his parents' bedroom and later told police he was afraid he would have to choose between living with his father and his stepmother, who had been fighting and were headed for a divorce.
The boy's stepmother initially told police she had killed her husband, but later recanted and said she was trying to protect her stepson. His sister testified that he told her of his plan the day before.
During the trial, the boy's lawyer portrayed him as a victim of both his father's racist beliefs and of his violent upbringing.
The boy's stepmother told authorities that Hall had hit, kicked and yelled at his son for being too loud or getting in the way. Hall and the boy's biological mother had each accused the other of child abuse during a protracted custody dispute. Social workers visited 20 times, but never removed the boy or his siblings from Hall's custody.
The child had a history of being expelled from school for violent outbursts, starting aged five when he stabbed a teacher with a pencil on the first day of kindergarten. He also tried to strangle a teacher with a telephone cord.

For a time, Japan had a reputation as the last hold out in terms of countries/societies that favored mothers as the natural caretakers of children. Because of this, they have been targeted by the international fathers rights crowd for "reforms," such as forcing Japan to sign on the the Hague Convention.
Now we see the logical results of that about face. Which is that violent, manipulative fathers like KAZUKI HARA get custody, with the mother "disappearing"--at least from official sight. Meanwhile, the child protective agencies, newly brainwashed in Father Exaltation Ideology (Every child needs a father! Fathers can do no wrong!), ignore/deny all evidence of child abuse. A month and a half after Daddy gets full custody back, Daddy kills the boy.
Same pattern we see in so many places now....
Right down to a total lack of curiosity as to what happened to the mother. How much do you want to bet that she was beaten as well? The main (unanswered) question here is what happened to her. Did Daddy kill her--and hide the body well? Maybe that's why she's "missing." Or did she flee for her life? Or did Daddy strip her of custody through official channels?

A spokesperson for the child welfare agency that took care of the boy since 2011 said that the then 2-year-old Seri was brought to their attention after his father repeatedly stomped on him which led to several of his bones to be broken. The District Public Prosecutor’s Office in Wakayama however could not find any hard evidence to directly link Hara to the attack and so they had to settle for a suspension of indictment.
During this time, when the child was still under the care of the welfare agency, he and his father met 25 times and he even stayed over at his father’s house 35 times. Eventually, they decided to return Seri to his father June of this year after judging it was actually safe for the two of them to live together unsupervised. But if the child abuse allegations are true, then this was a horrible mistake on their part as the boy died just a month and a half later. Hara has so far denied that he had any intent to kill or even injure his son. There was no mention if the mother of the boy was alive or in any way still part of their lives.

A Rogers Park man charged with his infant son's death had dropped him on the floor, shook him, then covered his nose and mouth until he died, prosecutors said in court today.
Rahsaan Condiff, 25, was charged with murder this week after a yearlong investigation into the death of his 4-month-old son Clayton and ordered held without bail in a Cook County Bond Court hearing today.
The baby's twin sister was removed from the home in the 7500 block of North Seeley Avenue shortly after the death, and the Illinois Department of Children and Family Services says it continues to investigate allegations of abuse and neglect against both the father and the mother, officials said. The mother has not been been charged with any crime, according to police.
The baby boy was found unresponsive in the couple's home on Sept. 2 of last year.
Condiff and the mother told police they had fed Clayton about 8 a.m. and went to their bedroom an hour later and slept until 12:45 p.m. when they found Clayton “blue in color’’ in his sleeper chair, according to the police report.
Condiff told police Clayton seemed to have turned himself on his side and his mouth was partially covered with blankets, possibly obstructing his airway, the report said.
But an autopsy found Clayton had suffered several injuries and fractures to the spine, ribs, head and thigh bone, they said. Clayton's twin sister was removed from the home and placed in the care of a relative, police said.
During the investigation, authorities said they learned Condiff had beaten and suffocated his baby son after the infant's crying woke him up,according to Assistant State's Attorney Heather Kent.
When the boy's mother asked Condiff to feed the babies who were in their sleepers, Condiff, who had gone out the night before drinking, picked Clayton up and dropped him to the ground, facing up, hitting the victim's head on the floor, according to Kent.
When the victim continued crying, Condiff then "yanked the victim's head, leg and body up from the floor, grabbed him with both hands and shook him," Kent said.
Condiff then "swadddled the victim with a blanket tightly, covering the victim's nose and mouth while the victim had a pacifier in his mouth, restricting his breathing, according to Kent. Condiff went back into the bedroom as the mother went into the bathroom but moments later, Condiff came rushing into the bathroom carrying Clayton, who had turned blue and was not breathing.
Clatyon was taken to Saint Francis Hospital in Evanston where he was pronounced dead at 1:56 p.m. that day, according to the Cook County medical examiner's office.
An autopsy later found that Clayton suffered multiple fractures at different stages of healing, according to Kent. Some of the injuries included several rib fractures, spine fractures, arm fracutres, a femur fracture, and hemorrhaging to the scalp, Kent said.
Condiff admitted to suffocating, squeezing, shaking and grabbing Clayton forcefully by the arms on previous occasions, Kent said.
Condiff was arrested and charged this week and appeared in court today. At the hearing, Condiff wore a black long-sleeved shirt, gray pants and gym shoes. He did not say anything to Judge James Brown and kept his hands clasped behind his back.
Defense attorney Kathleen Moriarty told the judge Condiff is a full-time worker and has been taking psychology classes at a college. His next hearing is Nov. 12.
DCFS is investigating allegations of neglect and abuse against the mother and father involving both babies, according to DCFS spokeswoman Karen Hawkins. She said the agency had no prior contact with the family.
Records show Condiff was charged with misdemeanor domestic battery in October of 2010, but the charge was dropped the next month.

The headline bends over backwards to be politically correct and gender "neutral"--but let's speak plainly. This is about violent fathers using mandatory joint custody laws (which were inspired by the fathers rights propaganda /lie that "every" child "needs" a father--no matter how addicted, sick, neglectful, or just plain evil he is). This is the logical result. Abuser daddies get full custody. But if you read the fathers rights literature going back 30 years or so, this was the goal all along.
