Abusive, alcoholic dad gets custody of 5-year-old boy after getting help from Mexican police, U.S. State Department in tracking down mom (Knox County, Tennessee)
Judge Varlan is a woman-hating idiot who is either willfully ignorant about domestic violence or just doesn't give a sh**. 'Cause he just knows the mother is lying about the father's alcohol abuse and physical violence, cause, well he just knows. Misogynists always "know" that it's the woman who is lying.
Actually, Mom is very credible. If she wanted to sound more "convincing," she could have said the father abused the boy as well. In reality, it is not uncommon (at least in the early stages) for the father to abuse the mother but not (directly) abuse the children. (Emotionally, however, he is abusing them by diminishing their caregiver.) That the mother was dependent on him for financial assistance is also reality, and that she tried to let the abuser see the boy is also common. Battered moms really do try to be nice and accommodating. They really do. But apparently Mom couldn't take it anymore so she ran. At a terrible sacrifice to herself. This is not a decision that mothers make lightly.
And of course, because abusers are control freaks, he chased her down with the help of the Mexican police AND the U.S. State Department. Gosh, we don't have any drug dealing murderous gangs to worry about anymore? No other international issues of pressing importance? Who knew? Two governments magically cooperate and collaborate to help the batterer track down a battered woman like she was a rabid dog so he reclaim his child/property.
So now, the child is actually at very high risk. Daddy has to take on the responsibility of full-time caregiver, when he is a short-tempered abuser with a traumatized child. And, of course, he wants to punish mom in the worst possible way.
This is partly what happens when you give never married fathers "rights" over women and children. Sickening. And when you turn the Hague Convention into little more than a "slave catching" operation to benefit abusive men.

In the first ruling of its kind in East Tennessee, a federal judge is ordering the return to Mexico of a 5-year-old boy at the center of an international custody battle.
Chief U.S. District Judge Tom Varlan is siding with Mexican father Eugenio Garduno Guevara in a rare case brought under The Hague Convention of 1980 International Child Abduction Remedies Act in a fight over the boy Guevara fathered out of wedlock with Mexican mother Alma Soto Soto.
Soto spirited the boy away from Mexico and into the U.S. illegally in 2013 after the couple, who had been living together and sharing custody, split up. Guevara spent two years tracking down mother and child, using the Mexican police, The Hague Convention treaty, the U.S. State Department and Facebook, before finding the pair living in Knoxville.
The case ultimately landed in front of Varlan, the first time the federal court system here had been tapped to decide under the treaty which country — Mexico or the U.S. — had authority to decide custody.
In his ruling, Varlan noted the treaty did not authorize him to decide which of the two parents was the fittest but rather was designed to prevent parents from court-shopping among foreign nations.
"One of the main purposes of the ICARA is to prevent parents from removing children from the country of their habitual residence to a more sympathetic court in order to have a 'home court advantage' in custody determinations," Varlan wrote.
It will be up to a Mexican court now to decide the boy's custodial fate.
Guevara and Soto had the boy out of wedlock in Mexico in 2010 but lived together with him until March 2013 when Guevara moved out. A month later, the boy and his mother disappeared. Guevara eventually found mother and son via a photograph posted on Facebook, showing Soto and the boy at the Wichita Falls Park in Wichita Falls, Texas. But she disappeared with the boy again. The pair resurfaced in late May 2015 in Knoxville when she sought custody through Knox County Juvenile Court.
Although Varlan did not weigh in on which of the two was most worthy of custody, the nature of the case did require him to consider allegations typically aired in a domestic courtroom. He first had to decide if Guevara had visited and supported his son after he and Soto split.
"In the three-week period of separation when the child was in Mexico, (the father) visited with the child on four occasions, including one overnight visit," Varlan wrote. "(He) also provided (Soto) and the child with some degree of money and food support."
Varlan also had to sort out conflicting claims between the pair. Soto, via attorney Scott Saidak, claimed Guevara was a mean drunk, and the boy would not be safe in Mexico. He denied that.
Varlan didn't buy it.
"While (Soto) submits that (Guevara) had an alcohol problem and abused her in the past, she does not allege that (the father) abused the child," Varlan wrote. "(She) also allowed (him) to visit with the child multiple times when they were separated, and testified that (he) supported the child with food and money during the period of separation, both of which tend to show that plaintiff would not subject the child to serious abuse or neglect if the child were returned to Mexico."
A second case under the treaty is now pending in U.S. District Court. That one involves a father living in London and a Bangladeshi mother living in Knoxville with the couple's twin babies.

A 19-year-old father has been charged in the death of his four-month-old child.
Memphis police have charged Nathan Scarborough with First Degree Murder in Perpetration of Aggravated Child Abuse and Aggravated Child Neglect, Aggravated Child Abuse and Aggravated Child Neglect.
Officers were called to Baptist Children’s Hospital around 7 p.m. on Tuesday. Upon arrival, they located a child, who had already been pronounced dead.
Police said the victim, who was in full cardiac arrest, was taken to the hospital from the family's home in the 8000 block of Creek Way Cove.
According to MPD, Scarborough told investigators he was painting an upstairs bedroom when he checked on the child and noticed the baby was lifeless. He told police he attempted CPR and dialed 911.
But through further investigation, MPD ruled the child’s death a homicide due to injuries that were later found by the Shelby County Medical Examiner’s Officer. Police said the child suffered from apparent internal head injuries.
MPD said its investigation determined Nathan Scarborough was responsible for the child’s death. He was arrested and charged.

A Tennessee police officer has been charged with first-degree murder in the death of his 2-month old son earlier this month.
Christopher Page, 27, an officer with the Paris Police Department, was taken into custody Thursday by Tennessee Bureau of Investigation agents at the conclusion of a three-week investigation into the death of his child, Gunner Page.
The probe was set into motion September 2 when police responded to the home of Christopher Page and his domestic partner, Hope Carson, in Puryear.
Henry County Sheriff Monte Belew said earlier this month that a member of the household called 911 early that morning saying that a baby had stopped breathing, reported The Paris Post-Intelligencer.
Baby Gunner was rushed to Henry County Medical Center and later flown to Vanderbilt Medical Center in Nashville, where he ultimately passed away September 7. He was nearly three months old.
Even before Gunner Page’s death, 24th District Attorney General Matthew Stowe ordered the TBI to look into the circumstances of the case.
Information gathered by TBI agents in the course of the weeks-long investigation led them to conclude that Christopher Page was responsible for causing unspecified life-threatening injuries to his infant son.
Besides the first-degree murder charge against the Paris cop, the officer is also facing one count of aggravated child abuse.
Page was being held without bond at the Carroll County Jail. According to his late son's obituary, the officer and his girlfriend also have an older daughter together.

MEMPHIS, TN (WMC) - At the Memphis Advocacy Center, a resource for abused children and their families, a flag will be raised for 3-year-old Josiah Monday.
Meanwhile, his family is standing with state representative G.A. Hardaway in pushing for a new law to protect children.
"I was ecstatic. I was really really excited and if I'm able to do anything to assist I will," Josiah's aunt Erica Lee said.
Lee said she will stand with Hardaway, who is pushing for new legislation to make it mandatory for juvenile courts and DCS to better communicate.
"I think juvenile court failed Josiah and a lot of other children," Lee said.
Josiah was brutally beaten to death last week.
His father, Terry Patterson, a convicted felon and sex offender, was charged with first-degree murder for his death. Just days before his son was killed, Patterson was given joint custody.
DCS has confirmed they had contact with the family for the child's entire life.
"I feel like before they release a kid to another parent they should investigate a parents background," Lee said.
Lee said she hopes Hardaway's legislation is passed and children are protected in the future.
"There needs to be a law and I'm proud of G.A. Hardaway for stepping up to the plate."
Juvenile court said they are not required to check someone's background during a child support or custodial case.
Hardaway is planning to file for the new law next week.

Dad charged with severely beating 10-year-old son during visitation; dad previously a murder suspect (Chattanooga, Tennessee)
Despite an intensive criminal background, it appears dad CLARENCE SCHREANE had joint custody, or at minimum, extensive visitation. Whether this was court-ordered or not is not indicated. But then mothers are under intensive pressure to "involve" fathers regardless of how violent or abusive they are.

1996 attempted murder suspect now charged with child abuse

CHATTANOOGA, Tennessee(WDEF) -A man who was once a murder suspect back in 1996 is now suspected of severely beating his young son.
Clarence Schreane, 39, of Chattanooga was charged with one count of aggravated child abuse.
Deputies from the Hamilton County fugitives division transported Schreane back to Hamilton County after he was picked up by authorities in Washington County Tennessee.
Back on may 12, police were called to T.C. Thompson Children's Hospital after the staff suspected a 10-year old boy had been physically abused.
According to the arrest affidavit, the child had visible signs of deep dark bruises covering his buttocks and upper thighs.
This child told authorities his father whipped him with a belt.
The boy's mother told police that she dropped him off at his fathers house two days prior and had not seen him again until the day she went to pick him up from school.
The boy told his mother the pain was so bad that he could not sit down.
A child protective service worker reportedly spoke to Mr. Schreane and told him about the bruising. According to the CPS worker, Schreane's response to her was to talk to his lawyer.
A warrant had been issued for Schreane's arrest and he was finally taken into custody in Washington County. He was transported back to Hamilton County on Tuesday and booked into the Hamilton County jail on a $25,000 bond.
Schreane is no stranger to trouble.
According to a News 12 background check, Schreane was arrested back in 1996 and charged with attempted first degree murder. The case was bound over to criminal court where it was dismissed. The following year, Schreane plead guilty to aggravated robbery.
In 1995, Schreane plead guilty to theft and reckless endangerment.
His next court date is scheduled for September 23.

Dad with joint custody charged with 1st-degree murder in death of 3-year-old son; mom had been fighting for sole custody (Memphis, Tennessee)
Thanks to the fathers rights movement and the related corruption of the family court/CPS system, the carnage just never ends.
A TV station of deadline was able to figure out that dad TERRY PATTERSON was a child sex offender. CPS couldn't?
WHO gave this father joint custody, despite what I can presume (given the typical trajectories of these cases) was a history of child abuse and/or domestic violence?
WHO at CPS decided to continually ignore abuse complaints about a father with joint custody? Did they just write off all the complaints as women lying like they usually do without looking at the evidence?
WHO in the courts continually stonewalled this mother's efforts to get sole custody of this boy so she could protect him from his father's abuse?
WHEN are theses people going to be held responsible for the young lives that are lost due to their actions or failure to take action?

Father charged with first degree murder of 3-year-old

MEMPHIS, TN (WMC) - A father is behind bars following the death of his 3-year-old son that was found unresponsive Saturday.
The child was found in the 1200 block of Evergreen Street.
The child was taken to Le Bonheur Saturday morning, and later died.
Terry Patterson, 47, has been charged with first-degree murder in perpetration of aggravated child abuse and neglect.
Patterson told MPD that he found his son unresponsive on the couch.
Investigators ruled the child's death a homicide from blunt force trauma.
Family members of 3-year-old Josiah said he went to visit his father's house and never came home.
"My sister dropped him off. She said she went the night before and he was fine.
The next morning she got a phone call saying her son had passed."
They said Josiah's mother, Kiera Quin, and his father, Terry Patterson, had joint custody and his mother was fighting for sole custody after finding bruises on his body.
Family said they called the Department of Children Services multiple times since 2013, but nothing was ever done.
Family members said Josiah's mother brought him to his father's house Friday night and at 5 a.m. Saturday, she found out he was gone.
They said Josiah constantly came home with bruises.

MEMPHIS, TN (WMC) - A father is behind bars following the death of his 3-year-old son that was found unresponsive Saturday.
The child was found in the 1200 block of Evergreen Street.
The child was taken to Le Bonheur Saturday morning, and later died.
Terry Patterson, 47, has been charged with first-degree murder in perpetration of aggravated child abuse and neglect.
Patterson told MPD that he found his son unresponsive on the couch.
Investigators ruled the child's death a homicide from blunt force trauma.
Family members of 3-year-old Josiah said he went to visit his father's house and never came home.
"My sister dropped him off. She said she went the night before and he was fine.
The next morning she got a phone call saying her son had passed."
They said Josiah's mother, Kiera Quin, and his father, Terry Patterson, had joint custody and his mother was fighting for sole custody after finding bruises on his body.
Family said they called the Department of Children Services multiple times since 2013, but nothing was ever done.
Family members said Josiah's mother brought him to his father's house Friday night and at 5 a.m. Saturday, she found out he was gone.
They said Josiah constantly came home with bruises.

According to Shelby County District Attorney General Amy Weirich, a judge sentenced 28-year-old Jamie Jones to life in prison. In January 2013, Jones said he found 3-year-old Landon Stokes unresponsive. He told investigators that he had sent the child out to the car to wait for him. When Jones came outside, he said he found the boy at the bottom of the stairs. Jones then took the boy to Le Bonheur Children's Hospital, where he was pronounced dead.
During his trial, Jones admitted spanking the child the day he took him to the hospital. Medical personnel said the serious head and body injuries that Stokes sustained didn't look consistent with a fall down the stairs.
The Shelby County Medical Examiner said the boy had 116 external injures and several internal injuries.
Jones was found guilty on two counts of first-degree murder, one in perpetration of aggravated child abuse and one in perpetration of aggravated child neglect.
A judge will sentence Jones on the child abuse and neglect charges in September.

How did dad managed to shake this baby "nearly every day" without detection? Appears that either dad was either a deadbeat "caretaker" while mom worked, or this was a custody/visitation situation.

He is now blind as a result of suffering bilateral retinal hemorrhages and bilateral subdural hemorrhages to the brain, according to testimony from Le Bonheur pediatrician Dr. Karen Lakin.
Sgt. Jim Byars with the Memphis Police Department testified that Grayson admitted shaking the baby nearly every day for several weeks in late 2010.
Grayson's sentence will be served without the possibility for parole.

CLARKSVILLE, Tenn. – A father who beat his 4-year-old daughter to death could face up to 89 years in prison after being convicted of felony murder, aggravated child abuse and aggravated child neglect Thursday, but the child’s mother could potentially avoid jail time after being found guilty of much lesser charges.
DeMarkus Taylor and Rawny Taylor had both been charged with aggravated child neglect, felony child murder and giving false police reports in the death of their 4-year-old daughter, Arianna Taylor, who was found dead inside her bedroom on July 12, 2013.
DeMarkus Taylor also was charged with aggravated child abuse and felony murder in the case.
He was found guilty on all counts.
But Rawny Taylor, who now goes by her maiden name of Alvarez, was found guilty of the lesser charges of reckless endangerment and criminally negligent homicide. She was also found guilty of false report, which of the three charges, could carry the stiffest penalty of 2 to 4 years in prison. But attorneys on both sides said she could potentially get a suspended sentence and probation and possibly even avoid jail time.
Both parents still face two counts of aggravated child abuse in connection with injuries found on their other two children, then ages 3 and 6, when the Montgomery County Sheriff’s Office investigated Arianna’s death. The siblings both live together with a new family now.
Circuit Court Judge William Goodman III will sentence the two on Sept.14 and Assistant District Attorney Kimberly Lund said that may be when the other abuse charges are set for trial. Those charges were severed from Arianna Taylor’s case before trial.
A juror who did not want to be identified said jurors convicted Rawny Taylor of the lesser charges because she was at work at the time of the abuse. She said she was not aware that the children had been removed from the parents’ home because of previous abuse and had only been returned to their custody several months before Arianna was found dead on July 12, 2013, a day after her father beat her and then put her to bed.
He was the only adult in the home that afternoon, and the only one who could have inflicted the injuries that ultimately led to Arianna’s death, Lund told the jury during closing arguments Thursday.
“There is no doubt about it, this child was beaten,” she said. “She was beaten and he was the only one home... If he didn’t do it, who did?”
The jury apparently agreed and returned with a verdict after only an hour and 15 minutes of deliberations, finding him guilty of two counts of felony murder, aggravated child abuse and aggravated child neglect.
He could face 60 years in prison on the felony murder charges; 15 to 25 for the aggravated child abuse; and two to four years in prison on the false report, said his attorney Chase Smith.
“We’re disappointed by the verdict and we await sentencing and we will appeal the decision of the jury,” Smith said.
Rawny Taylor’s attorney Chris Clark had argued that she was not home when her husband beat their daughter and had no reason to believe anything was wrong when she came home and found her daughter snoring in bed.
The child never woke up, and Lund had argued Rawny Taylor must have seen the severe bruising on the child’s body and should have been concerned by the “agonal breathing” that precedes death and doesn’t sound like regular snoring.
She said the mother should have been concerned when the child didn’t get up that night and could potentially have saved her life by calling 911 before the child’s brain swelled so much that she died.
An autopsy showed bleeding and blod clots on her brain that were consistent with a severe car wreck or a fall from a second or third story building, Lund said, again showing them a photo taken during the autopsy.
But Clark told the jurors that to find her guilty as charged they would have to believe to a moral certainty that she knowingly neglected her child and that that led to her death.
“The question is not, ‘should she have known,’” he said. “The question is not, ‘could she have known.’”
Clark said the jury had to be certain beyond any reasonable doubt that she knew her child was hurt and did nothing. He said the state failed to meet that burden.

Police say Hite told them he grabbed his son ‘by the neck and popped him several times with a belt on his stomach and legs.’
He said he later found the boy in the tub.
The medical examiner ruled Davis died due to blunt force trauma to his head and stomach area which caused massive internal injuries as well as brain hemorrhaging.
Hite is charged with four counts of aggravated child abuse, four counts of first degree murder and violation of the seat belt law.
He will appear in court on Friday.

Bunmi Paul Adeoye, Jr., 27, has been charged with possession of a firearm with intent to go armed and domestic assault. Police said he had warrants on file for his arrest in Michigan and Illinois.
Police said Adeoye arrived in Knoxville with his girl at 12:24 p.m. Thursday. They said they arrived at the Greyhound bus station, located on Magnolia, to partially move-in with a relative.
Adeoye’s girlfriend told officers that he became agitated and assaulted her. She drove her boyfriend to the bus station so he could get a bus back to Ohio. According to her, he exited the vehicle with their 3-week-old baby and disappeared. Officers said they located Adeoye and the child at a loading dock of a business on Morgan Street near Depot. They said he was confused and never threatened to harm the child or officers. The child was returned, unharmed to his mother. When police took Adeoye into custody, they found a loaded gun in his pocket.

GREENE COUNTY, TN (WJHL) - Stephen Jennings, the man accused in the murder death of his 8-month-old daughter in September 2012, will face trial this week.
A jury was seated in Jennings' trial Monday morning in Greeneville Criminal Court. Opening statements are scheduled to begin Tuesday.

Custodial dad with criminal history (including battery involving a police officer) insists he did not beat his kids; claims ex-wife "instructing" them (Chatanooga, Tennessee)
This a very fathers rights oriented article. Poor little custodial dad JOHNNY FIELDS---who incidentally has a criminal history with at least one reported case of battery against a police officer--is totally innocent!
It's that lying ex alienating the kids against me! I'm telling the truth but at least three other people are lying!!!

It's starts with the deliberately confusing language that FRs are very fond of, that some varying chunk of child allegations are "false." That language is never used. CPS says "unfounded" or "unsubstantiated", which means that the allegations supposedly can't be proven. And CPS is infamous for supposedly finding no proof of child abuse allegations even in the most egregious cases, especially when fathers are involved. Partly because they are brainwashed into believing that fathers must be "involved" no matter what.
And no, women are actually less likely to lie about abuse than men, especially men with violent histories.
But despite that, FRs insist that vindictive mothers are doing all this "alienation" and lying while insisting on the dude's total innocence--even when the father has a documented history of violence.. This is what they teach their guys. It's totally out of their playbook on how to get custody.
How much you want to bet that this guy has a history of domestic violence too? But he won't own up to that, I'm sure.
And yes, violent fathers are more likely to get custody too. Partly because they tend to be pathological liars who are intent on smearing the mom, and partly because they intent on destroying and punishing her by taking her kids away from her.

CHATTANOOGA, Tennessee(WDEF) - A father accused of child abuse vows to fight tooth and nail to clear his name.
Last week WDEF first reported on Johnny Fields, 51, of Chattanooga after he was booked into the Hamilton County jail on a charge of child abuse and neglect.
After posting bail, Fields contacted WDEF and requested that his side of the story be told.
"It's been a struggle to me. I've been standing like a man and doing the best I can do for my kids and they just wipe this in my face," Fields said while tears rolled down his eyes.
According to the arrest affidavit, Fields repeatedly punched his 12-year old daughters face. He is also accused of pulling her hair and beating her ribs.
Police found a small red scratch under the the girls eye and took Fields into custody.
Another child who said he witnessed the attack told officers he had to pull Fields off of the girl.
Both kids told police, "This happens a lot at home."
Child protective services was called to further investigate.
But Fields; a physically handicapped father with only one hand told WDEF a different version of what happened.
He said he came and found his children fighting over a lap top computer. He said his 12 year old was combative and even took swings at him. Fields told WDEF that he was trying to protect himself from being hit so he held her head down to keep her from using both hands to swing at him.
WDEF asked Fields about the scratch police found under her eye.
"If she had a red spot under her eye, I didn't do it. I'm her daddy and I would never hurt my kids or do anything to harm them," Fields said.
WDEF then asked Fields about a quote in the arrest report where the children say the abuse happens all the time.
"That's a darn lie. My kids know that's a lie. I've done everything I could do; selling scraps and fixing law mowers; trying to provide food for them and to take care of them like a father should. And this is the only thank I get; a slap in the face," Fields said.
Fields told WDEF he believes his ex-wife has been instructing the children to tell police they were abused so he could loose custody of his children. WDEF was never able to get in contact with his ex-wife to get her reaction to that allegation.
But according to legal experts who have defended clients with similar claims, there are cases where one parent has coerced children into making false accusation against another parent. WDEF spoke to defense attorney Jerry Summers who has experience defending clients who are believed to be falsely accused of child abuse. Summers said he always look for red flags that may determine motive for making a false claim of abuse.
"Is there a pending child custody battle? Is there a divorce pending. Are government benefits involved? Is one party trying to get child support by getting a custody change from one parent to another? Those are things you look for," Summers said.
Unfortunately, while there are many legitimate cases of child abuse by a parent, there is also illegitimate claims that end up in the court system.
"It's more prevalent than you realize. Usually the ones that the prosecution and the DA's have the ultimate decision where they think it's a valid case or not. Sometimes they objectively look at it and realize there's not a case, those cases go away," summer said.
According to the U.S. Department of Health and Human Services, in 2010, 40-percent of child abuse cases in this country were proven false.
"40-percent of false charges; that still leaves an awful lot of scars on a lot of people. You can get rid of the charge but you may not get rid of the stigma," Summers said.
Fields is trying to avoid the stigma of being labeled an abusive parent. During an interview with Fields, he tried hard not to cry but emotions eventually took over.
"I getting out of jail with tears coming out of my eyes because I know I did the best I could do," Fields said.
WDEF contacted Child Advocacy Center of Chattanooga but officials declined to comment about how they weed out false claims from legitimate ones. In full disclosure, Fields admitted to WDEF that he has a criminal past which includes battery on a police officer. But he maintains that was a long time ago and that he has turned his life around.
Fields is currently out of jail on a $3,000 bond awaiting a May 8th court date.

SMITH COUNTY, Tenn. (WKRN) – A Smith County father was arrested and charged for allegedly abusing his daughter.
Joe Green Jr., 33, was taken into custody Wednesday and charged with one count of aggravated child abuse.
The Tennessee Bureau of Investigation started investigating Green at the request of the 15th District Attorney General Tom Thompson.
During their investigation, authorities learned that Green reportedly struck his 10-year-old daughter multiple times with a cattle stick while staying with her at his parents’ residence in Pleasant Shade.
The alleged incident occurred on Saturday, April 4.
Green was booked into the Smith County Jail on $15,000 bond.

A national child advocacy organization is criticizing Nashville District Attorney Glenn Funk for the delay in prosecuting a father accused of raping his 8-year-old son — a case the FBI turned over to the district attorney's office three years ago.
The father, a 58-year-old Missouri veterinarian, was arrested in August of 2012 after a grand jury issued indictments on four counts of child rape and one count of aggravated sexual battery. In a letter to Funk this week, Child Justice, a Washington, D.C.-based advocacy group, urged him to move forward with the trial. Executive Director Eileen King said she feared Funk would drop the case after a former prosecutor in charge of it left the district attorney's office. Funk is now serving as the chief prosecutor on the case.
"This child deserves some justice in his life after all that he has endured," wrote King. "Anything short of prosecuting this man who is believed to have committed these atrocities is, in our view, a miscarriage of justice."
Funk said he was reviewing the case as he would any other before proceeding. He will make a decision within the next three weeks about the next steps, he said.
The case has garnered national attention among advocates focused on how child sexual abuse allegations are handled in divorce courts and in the criminal justice system.
The criminal charges followed years of claims by the child's mother that her ex-husband was sexually abusing their son. A pediatrician, a child therapist and a caseworker with the Department of Children's Services also alleged the boy had been sexually abused, but no charges were filed until a 2011 FBI investigation found pornography and other items at the father's home that prosecutors said corroborate the boy's story.
By then, however, the mother had lost primary custody of the boy. A Robertson County family court judge had ruled that the mother's repeated insistence that her son was being sexually abused was untrue, "obsessive," and harmful to the child. He awarded custody of the boy to the now-accused father in 2007.
The father's attorneys have argued that the boy has been coached all along into making false accusations by the mother, who now has custody again.
The Tennessean does not identify victims of alleged sexual abuse and is withholding the parents' names to protect the identity of the child.
The case has been delayed once pending appeal on an interim order from the court, which rejected the father's efforts to require the boy undergo a psychiatric evaluation. An appeals court upheld the ruling. Then the chief prosecutor on the case resigned, among a group of lawyers who departed after Funk was elected as district attorney.

A 21-year-old Lebanon father accused of killing his 3-month-old son in August had a request for a lower bail amount denied Thursday at a scheduling court hearing in Wilson County.

An East Tennessee couple has been sentenced to 35 years in prison each for their role in the death of a 5-year-old girl forced to drink so much grape soda it caused her brain to swell.
Randall Lee Vaughn, 41, and Mary Lavonne Vaughn, 58, of Surgoinsville were sentenced Monday in Hawkins County Criminal Court. #Randall is the girl's biological father.
The Tennessean reports that the couple entered a guilty plea to second-degree murder and aggravated child neglect.
Alexa Linboom was suffering from extreme brain damage when she was brought to an emergency room on January 1, 2012, by her father, Randall Vaughn and her stepmother, Mary.
An investigation found the young girl had been forced to drink the water and soda in one to two hours as punishment after taking one of her stepmother's drinks.
The huge intake of fluid caused her brain to swell and herniate, which led to her death on January 3, 2012.
Attorney-general Berkeley Bell told the Times News that after allegedly forcing their child to drink an excessive amount of fluid, they failed to seek immediate medical help.
'Our position is it was a matter of several hours after the child started exhibiting serious symptoms, after the child was screaming out in pain, went into a paralyzed state, and became unconscious [that they sought help,' Bell said.
After a two-year investiagtion it was found that Alexa was killed by acute fluid intoxication , which caused hyponatremic encephalopathy.
Bell said there was no history of abuse on record at the Vaughan family home, but added: 'They did employ some alternative forms of punishment.'
'Allegedly the child, as a form of punishment, was forced to drink grape drinks, as well as a great deal of water, to the point that her body became water intoxicated,' Bell said. 'That led to her brain swelling and all of her systems shutting down, and to her eventual brain death.' .

An East Tennessee couple has been sentenced to 35 years in prison each for their role in the death of a 5-year-old girl forced to drink so much grape soda it caused her brain to swell.
Randall Lee Vaughn, 41, and Mary Lavonne Vaughn, 58, of Surgoinsville were sentenced Monday in Hawkins County Criminal Court. #Randall is the girl's biological father.
The Tennessean reports that the couple entered a guilty plea to second-degree murder and aggravated child neglect.
Alexa Linboom was suffering from extreme brain damage when she was brought to an emergency room on January 1, 2012, by her father, Randall Vaughn and her stepmother, Mary.
An investigation found the young girl had been forced to drink the water and soda in one to two hours as punishment after taking one of her stepmother's drinks.
The huge intake of fluid caused her brain to swell and herniate, which led to her death on January 3, 2012.
Attorney-general Berkeley Bell told the Times News that after allegedly forcing their child to drink an excessive amount of fluid, they failed to seek immediate medical help.
'Our position is it was a matter of several hours after the child started exhibiting serious symptoms, after the child was screaming out in pain, went into a paralyzed state, and became unconscious [that they sought help,' Bell said.
After a two-year investiagtion it was found that Alexa was killed by acute fluid intoxication , which caused hyponatremic encephalopathy.
Bell said there was no history of abuse on record at the Vaughan family home, but added: 'They did employ some alternative forms of punishment.'
'Allegedly the child, as a form of punishment, was forced to drink grape drinks, as well as a great deal of water, to the point that her body became water intoxicated,' Bell said. 'That led to her brain swelling and all of her systems shutting down, and to her eventual brain death.' .

CHATTANOOGA, TN (WRCB) - Police have charged a local father with child abuse and neglect for hitting his daughter.
Chattanooga police arrested Raphael Colvin December 2 after he admitted to assaulting his daughter for being disrespectful.
Colvin's juvenile daughter told police he slapped her, pinned her to the ground and punched her in the face repeatedly.
The daughter called police and Colvin was arrested on the scene after they found her shirt covered in blood.
He was booked in the Hamilton County jail on a $10,000 bond and is due in court January 16.
