EBENSBURG — A Johnstown father was sentenced this morning to five to 10 years in state prison for shaking his infant son so severly that it caused bleeding into the baby’s brain and eyes.
Judge David Tulowitzki refused to allow Joshua Miller to remain out of prison while he appeals his conviction, but the judge gave Miller 24 hours to report to the county prison.

Miller was convicted last November by a jury of aggravated assault and related charges in the incident in January 2009. The defendant, both at his trial and again today, denied that he had shaken the baby or did anything even accidentally to injure the child.

During the trial there was conflicting medical testimony by the prosecution and defense over the cause of the bleeding, and that debate continued in court today. The judge denied defense motions that asked him to overturn the jury’s verdict.
