Dad gets time served for sexually assaulting mom in front of 5-month-old baby (Winnipeg, Canada)

Well, isn't this SPECIAL. Daddy DARRELL DUNCALFE attacks and rapes his "estranged" wife (which means she probably no longer even lived with him). AND in front of their 5-month-old infant daughter no less. And he hit the mom in the head for "resisting" (attempting to defend her own life).

But Daddy gets to cop a guilty plea under a plea bargain, so he'll get time served. Why? And what freaking "mitigating circumstances" allowed him to get off easy? Memo to Justice Donald Bryk: there are NO "mitigating circumstances" when it comes to raping a woman. But then Canadian judges are already noted for their indulgence of rapists, aren't they? Winnipeg man gets time already served in violent sex assault in front of baby

WINNIPEG - A Winnipeg man has been sentenced to time already served for a violent domestic sexual assault in front of a five-month-old baby.

Darrell Duncalfe spent 20 months in custody before pleading guilty as part of a plea bargain.

Court heard he attacked his estranged wife and forced her to have sex in front of their daughter in the family home in June 2009.

Duncalfe hit his victim in the head when she tried to resist and forced her to clean herself up in the shower.

The judge said the minimum sentence would usually be three years, but there were mitigating circumstances.

He pointed to Duncalfe's willingness to plead guilty to spare his former partner any further distress.

Queen's Bench Justice Donald Bryk ordered a peace bond to forbid Duncalfe from contacting his former partner. He also faces a 10-year weapons ban. (CJOB)
