Why is it considered assault when the victim died?
Dad is identified as AUSTIN S. MORRIS. No mention of a mother in the home.

FAIRFAX, OH (FOX19) - A Fairfield father has been charged in the death of his 2-month-old son after the infant died last Monday from severe head injuries which a social worker said may have resulted from child abuse, according to authorities.
Austin S, Morris, 23, faces one count of second-degree felonious assault, and one second-degree felonious count of endangering children. He was held in the Butler County Jail on $15,000 bond.
Morris' infant son, Benjamin, died Monday after being taken to an area hospital. A social worker notified Fairfield Police that Benjamin's injuries may have resulted from child abuse.
