XENIA, Ohio -- Authorities said a child was shaken so hard that he was left with severe brain injuries.
What initially started out as a motion by the defense to suppress evidence in the case against Matthew Diesh quickly changed when the defense withdrew that motion and the defendant issued a plea of no contest.
Judge Timothy Campbell asked Diesh “Have you discussed this plea of no contest with Mr. Ambrose or rights?” Diesh responded ”Yes, your honor.”
Diesh was in court on Wednesday accused of shaking his infant son inside a Fairborn home in April so hard that the child had to be hospitalized.
Prosecutor Stephen Haller said, “Specifically, the state alleges the defendant was holding his 2-month-old child with both hands and he shook the child and the shaking resulted in significant and severe brain injury.”
Judge Campbell said, “Based upon the facts before the court as indicated by the state Ohio, the court finds the defendant guilty.”
Diesh now awaits his sentencing. His son faces an uphill battle to try to recover from his injuries.
