Father admits shooting baby to death

ALBUQUERQUE (KRQE) - Christopher Rains agreed to a plea deal Thursday afternoon in the shooting death of his baby avoiding a trial that would have taken place later this month.

Rains was 22 when he killed his 9-month-old baby girl in December 2009. He told a 911 dispatcher at the time he shot the infant to punish the baby's mom for wanting to date another man.

Rains pleaded guilty to four counts of kidnapping and one count of intentional child abuse resulting in death. He was sentenced to 63 years, but as part of the plea agreement will face 36 years in the state Department of Corrections. He must serve at least 85 percent of the sentence.

This plea agreement means avoiding what would have been an incredibly painful trial.

Several members of the young victim's family were in court and spoke before Rains' sentencing. At one point the baby's mother was so overcome with emotion she had to be carried out of court.

Last week Rains' attorneys filed a motion asking a judge to drop the charges against him claiming his right to a speedy trial was violated. That motion was denied, and the case was expected to go to trial later this month.

Rains spoke out in court Thursday saying he is remorseful and that he deserved "Hell itself."

The baby's grandfather told KRQE News 13 he hopes his family can move on.

"We were expecting more than what he got today," LeRoy Trujillo said. "I mean, he's going to prison where he belongs. We just hope to move forward and start getting on the right road."
