Y'all remember the Texas mom who is accused of dismembering her baby, right? You must have been in a coma if you missed it, because it was all over the media this summer. Do you remember Texas dad JOHN ALLEN RUBIO who was convicted of beheading his three kids in 2006? Didn't think so. Anyway, Rubio is heading back to court on an appeal.

BROWNSVILLE - The man accused of beheading his three children is returning to court this week.

John Allen Rubio is expected in court on Thursday. His defense team has made efforts to stop the Cameron County District Attorney's Office from prosecuting the case.

They cited a conflict of interest with Rubio's former attorney. The lawyer was working for the district attorney's office when Rubio's conviction was overturned.

The 13th Court of Appeals denied the defense's request last month. It was the second time the defense tries to throw the district attorney's office off the case.

Rubio was convicted of killing his three children in 2006, but an appeals court gave him a new trial.
