Man accused in son's death appears in court

(WKTV) - The Bridgewater father charged in his infant son's death entered a not guilty plea Monday in Oneida County Court.

Ian Gulbin was originally arrested for manslaughter in the death of 13-month-old Brayden Gulbin. The child's mother returned home from work early one November morning to find the baby unresponsive on the floor near his crib. An autopsy revealed the child suffered skull fractures, facial injuries, internal bleeding and a lacerated liver. The felony complaint against him claims Ian Gulbin slammed the child against a hard object.

An Oneida County Grand Jury last week indicted Gulbin on a second-degree murder charge and two manslaughter charges. The murder charge is not one that reflects intent.

"Defendant has to be over the age of 18, child under the age of 11 and it has to do with depraved indifference and recklessness," said Dawn Catera Lupi, a prosecutor. "So that's how it's distinguished from the other charges of murder that were possible."

Gulbin pleaded not guilty to all three charges. The prosecutor told the judge she intends to use statements Gulbin made to police at trial. While attorneys discussed possible plea offers at the bench before the judge, Gulbin began repeatedly asking "What?" It was not clear to whom he was posing the question.

The Oneida County District Attorney's Office did extend a plea offer to Gulbin, but neither attorney would disclose the details. Gulbin is due back in court in two weeks to let the judge know if he wants to take the offer or go to trial.

He remains in the Oneida County Jail without bail.
