COOKEVILLE -- A man found guilty of breaking his 23-month-old son's leg last year will serve three years in prison.
That's the sentence that Criminal Court Judge Leon Burns set last week for Matthew Kinnard, 24, of North Dixie Avenue, Cookeville.
Kinnard was indicted in the case last December, charged at that time with aggravated child abuse based on an investigation conducted by Cookeville Police Detective Sgt. Yvette Demming.
But at a trial held in September, a jury found Kinnard guilty of the lesser offense of reckless aggravated assault, a crime punishable by two to four years in prison.
The child was injured on Nov. 8, 2009, while he was in the care of his father.
Kinnard phoned the child's mother that day and told her to come get the boy and take him to the hospital. Doctors found that he had a broken leg, and he was sent to Vanderbilt Hospital in Nashville to be treated by a pediatric orthopedic surgeon. He has since recovered from the injury.
Demming testified at trial that Kinnard gave more than one story to explain how the child came to be injured.
Kinnard was represented by attorney Phil Parsons. Assistant District Attorneys Beth Willis and Phillip Hatch prosecuted.
Kinnard was ordered to report to jail on Nov. 7.
