Father accused of molesting sons waives hearing
BY LISA ROOSE-CHURCH • DAILY PRESS & ARGUS • December 9, 2009
A Hamburg Township father accused of molesting his two sons, both under age 13, waived a preliminary hearing this afternoon, sending the case to Livingston County Circuit Court for trial.
Judge Theresa Brennan said the case will return to District Court if there is no plea deal reached in the higher court.
Defense attorney Donald Neville in Howell did not comment on the case.
At a preliminary hearing, Brennan would have heard testimony and decided whether there is enough evidence to send the charges against the 34-year-old father to Circuit Court for trial.
Township police allege the man molested his sons between 2006 and 2009 when they visited his home. The boys reported the assault to their mother, who immediately contacted the state Department of Human Services.
That agency notified police Oct. 1.
The father is charged with two counts of first-degree criminal sexual conduct, which means penetration occurred. The charge carries a penalty of up to life in prison.
He also is charged with eight counts of second-degree CSC. No new court dates were immediately available today.
The Daily Press & Argus is not naming the father because it could identify his sons.
