RUTHERFORD COUNTY, Tenn.- A mid-state father accused of threatened to break his one-year-old child's neck in front of police faced a jury Tuesday morning.

Glenn Climer Junior was charged with attempted second degree murder charges in Rutherford County. Police said Climer brought his toddler into a Murfreesboro hospital last November, but when he refused to take the baby to the ER, Climer threatened to break the boy's neck, right in front of police.

Police said Climer placed his hands on the baby's head and neck. The actions caused officers to be concerned about the child's safety.

The boy was not seriously hurt and was placed in Department of Children's Service's custody.

Climer reached a plea deal.

AUGUSTA -- A father on Tuesday admitted he shoved his 4-month-old daughter's head into a cushion to stop her from crying last November.

That blow left swelling and some bruising, as well as an outline of fingermarks, on the infant's forehead.

Robert M. Phillips, 37, of Waterville, pleaded guilty in Kennebec County Superior Court to a charge of aggravated assault on his daughter, Chloe.

Phillips was sentenced to seven years in prison, with all but 18 months suspended, and three years of probation. Conditions of probation prohibit him from unsupervised contact with children under 12.

The baby, now 7 months old, is being watched closely for any long-term effects as a result of the assault, attorneys told Justice Nancy Mills.

The prosecutor, Assistant District Attorney Brad Grant, told the judge that Chloe, who has a twin sister, had awakened the night of Nov. 12, and Phillips took the crying baby downstairs.

Grand said Phillips placed the baby on a cushion on a small couch or love seat, turned her on her stomach and twice pushed her head into the cushion, which had a wooden board underneath.

"Ultimately the child fell asleep," Grant said.

Chloe's mother, Brittney Young, saw the swelling and brought the baby to a local hospital and the child was later transferred to Maine Medical Center in Portland. She was released after several days, and Grant so far there are no evident long-term problems as a result of the injury.

"There is some concern the development of the child may be delayed some," he said.

Initially, Phillips told Waterville Police Detective Chris Paradis that Chloe fell from a couch. "It's clear no one believed that at all," Grant said.

Shortly afterward, Phillips confessed.

Phillips, who has been jailed since his arrest on Nov. 14, told the judge on Tuesday he had nothing to say.

However, his attorney, Pam Ames said, "He understands he will have a long row to hoe if he's ever going to have contact with his children."

Ames said the state Department of Health & Human Services had become involved in the case and placed both girls with their maternal grandmother.

"Everyone is watching this child," Ames said.

Mills added conditions of probation that require Phillips to accept any pending or final orders of the Department of Health & Human Services and to undergo parenting classes to the satisfaction of his probation officer. He is banned from contact with his daughter unless his probation officer agrees to it.

Grant said the baby's mother agreed with the sentence.

"The mother feels like a substantial jail sentence is necessary," Grant said.

THE gay fathers of a six-year-old Australian boy have been arrested in Los Angeles after being indicted on child sexual exploitation charges relating to their own son.

The men, XX, 42, a citizen of the United States and resident of Australian, and his partner, ZZ, 32, an Australian citizen, were arrested in a 6am raid at the home of XX’s aunt in Los Angeles, on Thursday morning.

A third man, ABC, a lawyer from Florida, has also been arrested and indicted, and is named as the lead defendant. He is further charged with procuring a boy aged between eight or nine for sexual exploitation.

The indictment alleges the gay couple’s son was induced and coerced by all three defendants to appear in sexually explicit images and videos, either by himself or with the lead defendant, ABC.

All men are charged with counts of conspiracy to sexually exploit a child and the sexual exploitation of a child. The indictment carries no direct information on what the seized material allegedly depicts.

The boy is a joint Australian and US citizen with grandparents and relatives both in both Australian and the United States.

In October last year, Los Angeles police pulled another Australian man, a friend of XX’s and ZZ’s, who was driving on a freeway with the boy in the car after taking him for a museum visit. This man has not been arrested and has returned to Australia.

The boy was taken in the custody of the Los Angeles Department of Children and Family Services and has been in their care since.

The boy’s fathers have had long discussions with certain members of the press, including this reporter, and vehemently protested their innocence.

Both men claimed they were being victimized as gay fathers. Both claimed they were not aware of any explicit material involving their son.

The couple said they thought the authorities had some harmless video material of their son fooling around which had been misconstrued as sexual material.

The indictment claims XX and ZZ knowingly gave RJP access to the boy for explicit sexual purposes and that material was distributed on the internet.

ZZ’s father, speaking from Brisbane, and who was at the Lakewood home in California when the arrests were made last week, said he was shocked to see ZZ and XX handcuffed and led away wearing little but their underpants.

He said he was deeply concerned that his son would be persecuted in prison as a child molester.

He saw his grandson at a supervised visit the afternoon before the arrests and is anxious for the boy. “I don’t think he’s OK. He’s Australian - he’s grown up here in north Queensland.”

ZZ’s mother said she had nursed her grandson since he was three weeks old and strongly believed he had never been molested by his parents.

“I’m so close with him,” she said of the boy. “I know him inside out. I know everything about him. He is a happy and healthy boy. We want him home. If he was adoZZed out to strangers it would be a disaster for both our families.”

She was afraid of the therapy the boy was receiving from the LA Children and Family Services, fearing he was being coached to be a victim.

XX’s father, speaking from Arizona, said he had been unable to talk to his son since his arrest, and both families were trying to regain shared custody of the boy.

“It’s affecting all of us,” the man said. “Because he’s our grandson. We’re trying to get him here in Arizona. He’s got cousins, uncles and grandparents. He’s an Australian citizen but he’s also a US citizen. He’s our biological grandson.”

XX and ZZ are in the custody of US Marshalls in a federal detention centre.

XX’s aunt, who believes in her nephew’s and ZZ’s innocence and was present during the arrests, said she was deeply distressed by what had happened.

“I know they’re innocent in my heart,” the aunt said. “We know them and the type of people they are. They just walked into this.”

Three associates of ZZ and XX were arrested in an international child porn internet swoop last year, which may have been the genesis of the case against the couple. They claim they had no knowledge of their acquaintances’ alleged activities.

It is understood the fathers, who were represented by public defenders at a brief hearing on the day of their arrest, will be shifted from Los Angeles to Indianapolis, Indiana, where the grand jury indicted the three men.

One of the charges relates to an alleged incident on October 21, last year, in Indiana.

The child protection agency and the Immigrations and Customs Enforcement, a division of US Homeland Security, declined to comment on the case.

In conversations and correspondence, the fathers were distraught that their son, who had been born to a surrogate mother, had been taken from them. They said they were only allowed strictly supervised visits and insisted their son had made no complaints of abuse.

Court documents show XX has asserted his Fifth and Sixth Amendment rights to remain silent.

Family members said there was a court hearing relating to the future of the child held in LA last Tuesday, at which no new information against the two dads was forthcoming.

This appears this provoked US authorities to act, holding a grand jury session in Indiana the following day, where charges were laid.

A police officer was denied bail after facing charges of the defilement of his 11-year-old daughter.

The officer, whose name cannot be published by court order, is a driver to an assistant commissioner.

He was arrested after a police report was filed by his estranged wife. The two are undergoing separation procedures.

It was the daughter who allegedly told the mother about the abuse she sustained at the hands of her father.

Prosecuting inspector Marie-Louise Calleja insisted that this was a serious crime committed by a public officer and that all precautions were taken during investigation.

The defence, led by lawyers José Herrera and Michael Sciriha, argued that their client is undergoing separation procedures with his wife and that there are outstanding issues on the biological paternity of their child, and over the father's disciplinarian parenting.

The defence argued that their client has served for 25 years in the police force and was due to retire in a month, and asked the courts to consider how delicate this case was given the hardship he would endure even if eventually acquitted.

Inspector Calleja assured the defence that it was her priority, as in any case, to see whether this was a matter of spousal pique, but from the evidence she had collected this was not the case.

She added that as soon as the officer's wife got wind of the accusations from her daughter, the mother fled the matrimonial home and is now living in a social shelter. "Granting the accused bail would leave the mother and daughter as victims, and privilege the abuser by leaving him in the matrimonial home."

Magistrate Claire Zammit Stafrace denied the request for bail on the grounds of the seriousness of the charges and the possibility of tampering of evidence.

She recommended the director of prisons to provide for the security of the police officer while in custody.

MAYWOOD — Police arrested a father after investigators found marijuana and a digital scale hidden in a car seat being used to restrain one of his four children in the vehicle, authorities said.

The arrest happened during a motor vehicle stop on West Passaic Street about 3:15 p.m. Tuesday. Damenn C. Nelson, 38, of Passaic, was arrested on a child support warrant, and police searched the vehicle after smelling marijuana inside, authorities said.

Investigators found the scale and several bags of marijuana inside the car seat in the vehicle, which Nelson’s children and their mother were also riding in, police said in a statement. Nelson was charged with possession of marijuana with intent to distribute, possession of marijuana with intent to distribute in a school zone, endangering the welfare of a child and motor vehicle summonses, police said.

Nelson told police he did not know why he had a child support warrant.

He was taken to Bergen County Jail on a $25,000 bail.

Dad UDA HILDAGO, the Buffalo News tells us, "chose" to be a "stay-at-home" dad. Sounds so liberal and groovy. But that's not the reality for a lot of moms. They don't often "choose" for Daddy to have this lifestyle at all. They're merely stuck with it, because the deadbeat won't work and they can't get rid of him--without losing their lives. Which, in the end, is what happened to this mom.

Unlike "stay-at-home" moms who are often financially vulnerable, Hildago controlled the household finances through his violence. And despite his violence, notice that he still managed to stay at home with the kids after this couple apparently separated. Mom had a long commute and worked long hours--only to be treated like jacksh** by this useless piece of crap. Mom was trying to plan an escape with the kids. But Daddy mowed her down--in front of two of the kids--before she could execute the plan.

Helyna Rivera's four young children "became orphans in a horrible flash" last August when their father fatally shot their mother four times in his last violent act against her, their grandmother said today in Erie County Court.

"He killed her spirit long before her physical death," Alexandrine Hess said of Uda Hidalgo's escalating domestic violence against Rivera.

For ending her life, Hidalgo was sentenced to 25 years in prison, the maximum punishment for his first-degree manslaughter conviction.

Rivera, 25, was trying to break free of his grip -- gaining promotions at work and planning to move to another community -- which only fueled Hidalgo's fear he was losing control of her, Hess said during the sentencing.

Rivera had gone to Hidalgo's home on Virginia Street to pick up their children after her workday when a confrontation occurred outside the residence.
Hidalgo shot her three times in the back and then fired a fourth shot into her head, in front of two of the children.

Erie County Court Judge Sheila A. DiTullio quoted from a letter sent to court by Rivera's and Hidalgo's 7-year-old daughter, a second-grader.

"You can see he wasn't a good father, especially to my mommy," the girl wrote, according to the judge.

Hidalgo told the judge that he did not believe the girl wrote that letter.

"Helyna's life changed when she met you, Mr. Hidalgo," DiTullio said. "You're a violent man. You're a coward.

"You showed no mercy," the judge said. "You'll get no mercy from this court. You won't see the light of day for a long time, Mr. Hidalgo."

Rivera's extended family now cares for her three daughters and one son -- ages 7, 6, 4 and 2 -- in Fort Erie, Ont.

Rivera worked as an auditor at Seneca Niagara Casino and Hotel in Niagara Falls. Hidalgo did not work, choosing to stay home to watch the children.

He chose to be a stay-at-home dad, professing concern for the children's safety, Hess said.

Meanwhile, Rivera took the 6 a.m. bus to Niagara Falls each workday and returned to Buffalo 12 hours later, earning money to provide for the family, Hess said. Even so, Hidalgo took control of the family's finances, spending money on expensive gold chains for himself and wearing stylish clothes, Hess said.

As Rivera's career flourished, he could see "she was moving ahead without him," Hess said. "He saw he was losing control."

After the sentencing, Linda John, Rivera's mother, said the family can look for closure now.

She remembered her daughter as a "beautiful, graceful dancer."

"She wanted out. She was going for her freedom," John said.

Defense attorney Joseph J. Terranova said Hidalgo is "absolutely crushed to be in this position today."

Hidalgo feared Rivera would take the children and leave the area, Terranova said.

"My client couldn't control the rage he felt," Terranova said.

The son of alcoholics, Hidalgo was the target of domestic violence himself as a child, Terranova said.

"All he knew his whole life was domestic violence," he said.

Hidalgo apologized in court to Rivera's family, many of whom watched the sentencing.

"I'm sorry for all the pain I caused," he said. "I wish I could take everything back. I apologize to everybody here. I'm sorry."

DiTullio acknowledged the domestic violence Hidalgo suffered as a child.

But that did not excuse him for the violence he directed at Rivera, DiTullio said.

"I hope the next generation can break that cycle," she said.

TARPON SPRINGS — The 2-year-old girl was found with her head stuck in a hole in a wooden privacy fence.

The fence was between the apartment complex off Martin Luther King Jr. Dr. where the girl lives, and the day care center next door. An employee of the center saw the child and flagged down a police officer for help.

At the apartment complex, police eventually found the child's father sound asleep in a filthy, fly-ridden apartment, authorities said.

He told officers that his daughter must have left home through an open sliding door because she always wanted to play with kids at the day care center during recess.

The father — Philip Joseph Benoit, 22, of Tarpon Springs — was arrested Tuesday on child neglect charges. He remained in the Pinellas County Jail on Wednesday in lieu of $10,000 bail.

After paramedics checked out the 2-year-old girl, police said she was placed in the custody of her mother, who had been at work during the incident.

TROY, Ohio — An adoptive father in western Ohio has been accused of raping three children and allowing other men to have sex with one of them, allegations that a family services official on Wednesday called “heinous.”

The 39-year-old man was being held on $800,000 bond on three counts of rape and one of compelling prostitution. A message left for the county public defender’s office, which is representing him, wasn’t immediately returned. The Associated Press is withholding the man’s name to protect the children’s identities.

The man was jailed Feb. 24. He lives in Troy, a city of some 25,000 people about 20 miles from Dayton.

The Dayton Daily News reported earlier that the man had adopted three children and was in the process of adopting a fourth who lived with him.

Troy police said one boy, age 10, told them two other men besides the suspect had sex with him. The children aren’t all birth siblings and include three boys and a 9-year-old girl. Police said the other two boys, ages 9 and 12, also said the suspect had sex with them.

Further details about the children weren’t released. A message left at the Miami County children’s services agency wasn’t immediately answered.

Troy police said an undercover detective from Franklin County had talked to the suspect online about setting up sex with the 10-year-old boy, leading to his arrest.

“We’re hoping that we don’t have any other (victims) and we hope that we have stopped this before it got any further,” Troy police Capt. Chris Anderson said.

The children had been adopted through a private agency. Ben Johnson of the Ohio Department of Job and Family Services said the state will review how the adoptions took place. He called the allegations “heinous, horrific, awful.”

Custodial dad convicted of voluntary manslaughter in death of 2-month-old son (Chesterfield County, Virginia)

Interesting what the media chooses to highlight. They tell you that dad BRANDON L. PARKER was young--still a teenager--but they don't make it clear that he was custodial or what idiot(s) would choose to grant him custody.

But Parker was custodial. Notice that the BABY LIVED WITH DAD and Dad's parents, and that Mom--who apparently was forced to work to support herself--did NOT live there, but was only a "visitor." Why doesn't the reporter just come out and say that Parker was a custodial dad? Politically incorrect? Does that mean we might call undue attention to some idiotic social workers or other court-appointed people who were involved in this fiasco? Who the hell thought it was a good idea to give a 17-year-old dude custody? As a demographic group, this age/sex is the MOST likely to be involved in violent activity, including child abuse.

Teenage Chesterfield father convicted of fatally shaking infant son

An 18-year-old Chesterfield County father has been convicted of fatally shaking his infant son after telling police that he found the child limp and unresponsive in his baby swing.

Brandon L. Parker, who was 17 at the time and weeks away from entering the U.S. Air Force, entered an Alford guilty plea in Chesterfield Circuit Court to voluntary manslaughter — reduced from second-degree murder — in the June 2010 death of his 2-month-old son, Elijah.

Under an Alford plea, the defendant does not admit guilt but acknowledges there is sufficient evidence for a judge or jury to find him guilty.

Parker is the second Chesterfield parent to be convicted of killing a child this year. Earlier this month, Robin Imani Varner, 25, pleaded guilty to inadvertently smothering her 5-month-old daughter by placing pillows and a blanket over the baby's head to muffle her incessant crying.

According to a summary of evidence by Chesterfield prosecutor B.J. McGee, Parker and his son were living at his parents' home in the 4000 block of Clipper Bay Drive. He was caring for the child on the evening of June 22 after the 20-year-old mother — who was visiting but didn't live in the home — left for work.

After Parker told his stepmother that Elijah was restless and unable to fall asleep, he fed the infant, placed him in his child swing in the teen's bedroom about 10:30 p.m. and began watching television. About an hour later, Parker told officers that Elijah had fallen forward in his child swing and was limp and unresponsive.

Parker said he then placed the baby on his stomach and "shook him a little bit."

Police were called about 11:45 p.m. and when officers arrived they found the infant lying motionless at the top of the stairs. The child had no injuries, but a white fluid was coming from the baby's nose.

"They tried unsuccessfully to resuscitate Elijah, but there was no pulse," McGee said.

The infant was flaccid and unresponsive when he was transferred to VCU Medical Center from Southside Regional Medical Center.

Dr. Robin Foster, director of Pediatric Emergency Services and Pediatric Critical Care Transport at VCU Medical Center, examined the child and concluded that Elijah suffered a traumatic head injury consistent with being shaken.

The shaking was severe enough to cause diffuse bleeding about the child's brain, brain tissue damage and retinal hemorrhaging of his eyes, Foster testified at an earlier hearing.

Elijah died four days later at the hospital of blunt-force trauma of the head.

After entering his pleas, Parker — who had been monitored electronically under home incarceration — was remanded to jail pending sentencing on May 17. He faces up to 10 years in prison.

Once again, we have to read between the lines. Notice that the murdered girl's mother filed a paternity suit back in 2007--which would have been shortly after the girl's birth. So obviously, dad MATHEW CARR had no real pre-existing relationship with the mother and the child within a family unit. Yet HE STILL HAD ACCESS. Court-ordered, I'd imagine. But even if it wasn't, there is so much pressure these days on mothers to "encourage" a relationship between their children and their children's sperm donor, er, FATHER. And too often, this "relationship" ends up being a total disaster....

Bail Denied For Father Charged In 5-Year-Old Daughter’s Death

BALTIMORE (WJZ) — A 5-year-old child dies in Northwest Baltimore and city police say it was no accident.

Monique Griego reports her father is now charged with her murder.

Police aren’t saying much about the case. But they say it started with a frantic effort to save the little girl’s life and is now a murder investigation.

Police say it happened in the 3400-block of Callaway Avenue in Northwest Baltimore. Police aren’t releasing many details about the case but say on Monday, Mya Carr, 5, was taken to the hospital and later died, the victim of a homicide.

“Police car was sittin’ there but the lights weren’t on. But I just thought they were looking around for somebody,” said Clarence Hall.

According to court documents, her father, Mathew Carr, 22, was taken into custody on Tuesday. He’s charged with murder. Carr was denied bail Wednesday morning because officials say he is a threat to public safety and a flight risk.

Residents say this neighborhood is normally quiet and those WJZ spoke with were saddened to learn that a child had died.

“Who wants to hear about a child, you know, getting hurt or, you know, anything happening to ‘em? You know what I mean, breaks anybody’s heart who’s got any heart at all,” Hall said.

According to court records, Mya’s mother filed a paternity suit against Carr in 2007. He was ordered to pay support.

In addition to first-degree murder, Carr faces a host of other charges, including child abuse, assault and reckless endangerment. Investigators haven’t said how the girl was killed.

Carr was represented by a public defender. He doesn’t have a prior record, and he waived his right to a public reading of charges. No family members were present during Carr’s bail review.

Oklahoma Mom And Child Dead; Father Found Dead In Vegas

OKLAHOMA CITY -- A man whose wife and daughter were found dead in an Oklahoma City home Tuesday, has been found dead in a Las Vegas hotel room, according to police.

Police say Tara Johnston, 29, and her daughter, Allison Johnston, 17 months, were found dead in their home.

Police also say Tara Johnston’s husband husband, Daniel Johnston, 29, was found dead in a Las Vegas hotel room late Tuesday night. Police say Daniel Johnston's death appears to be a suicide. Investigators say they believe Daniel Johnston killed his wife and daughter before flying to Las Vegas on Sunday.

"We found out it was child involved. How an adult or anyone could harm a child is unbelievable to us," said neighbor Allen Fielder.

The medical examiner will determine the cause of death for Tara Johnston and Allison Johnston.

Danville Father gets 14 years for killing infant son

The man accused of killing his infant son two years ago was sentenced to 14 years in prison Tuesday.

Michael Anthony Motley Sr. had been charged with child abuse, neglect and murder in the death of 10-week-old Michael Anthony Motley Jr.

Motley entered an Alford plea in Danville Circuit Court Tuesday, which is a type of guilty plea where the defendant chooses against going to a jury trial to avoid being found guilty based on the evidence against him.

It’s a way for a defendant to plead guilty to a charge but avoid the harsher sentence that may be handed down by a jury, said defense attorney Glenn Berger, who, with Greg Haymore, represented Motley.

On March 20, 2010, emergency crews responded to the 300 block of Wendell Scott Drive for a report of an unresponsive infant. When they arrived, they found 10-week-old Michael Anthony Motley Jr. not breathing and tried to resuscitate him. He was transported to Danville Regional Medical Center and later airlifted to Duke University Medical Center, where he was declared dead on March 22.

According to Danville Commonwealth's Attorney Michael Newman, Motley called 911 at 1:46 p.m. saying that he thought his son was dead. Rescue personnel arrived to find the infant in cardiac arrest.

The child regained a pulse at the hospital but couldn’t breathe on his own, Newman said. The 10-week-old was airlifted to Duke University Medical Center and later pronounced dead.

A CT scan showed the child had rib fractures and subdural hematoma — or bleeding on the brain.

Motley told the court he tripped, fell and hit the child on an armchair and fell on him. The Medical Examiner in Roanoke declared the child had died from a traumatic brain injury, Newman said.

Newman said there were no skull fractures or external injuries to the child. The child’s mother had gone to work when the incident occurred and there were no witnesses.

Newman said the 14-year sentence was fair and that it was better than taking chances on whether a jury would find Motley guilty.

But Berger disagreed with the judge’s decision.

“I think it was a harsh sentence,” Berger said during an interview Wednesday.

The case was complicated, Berger said. The child had broken ribs, but the state’s records indicated they were broken on three different occasions and some breaks may have occurred at birth, he said.

The state failed to do a bone scan determine bone strength and the child — who had a pre-existing subdural hematoma — may have suffered from vitamin D deficiency and rickets, Berger said.

It is sometimes hard to get a handle on child abuse committed by fathers--especially by fathers with custody/visitation rights--and this article shows why.

Two Arrested For Child Abuse in Wakulla County

Wakulla County, Florida - Feb. 29, 2012 -

Wakulla County Sheriff’s Office detectives arrested two Wakulla County men in connection with February aggravated child abuse cases, according to Sheriff Donnie Crum.

The male suspects, ages 29 and 27 from Crawfordville, were arrested and transported to the Wakulla County Jail at the conclusion of their separate investigations. The two men have since posted $10,000 bonds and been released from jail.

The first case involved a six-year-old male child. The victim’s mother noticed marks and bruising on his legs from his buttocks to his knees as she was picking him up from the suspect.

She contacted the Florida Department of Children and Families Child Protection Team. During the medical examination, the doctor discovered multiple bruises, impact marks, small puncture wounds and lacerations to the child’s legs. The marks on the child were consistent with three items being used to inflict the abuse including a belt and an electrical cord.

DCF removed the child from the suspect’s home and he was arrested for aggravated child abuse,” according to Undersheriff Maurice Langston.

The second case involved a five year old female child. The Florida Department of Children and Families was contacted after a school administrator discovered bruising on the child’s head. A medical examination was performed and the doctor determined that the child had been struck in the head area and abrasions that were observed were consistent with partial strangulation.

As the investigation unfolded, medical personnel determined that the child’s father struck her in the face with a shoe, which caused her to fall, and put one of his hands on her neck and the other on her mouth and nose so the child could not breathe.

“There are methods in which to discipline your child,” said Sheriff Crum. “But this is not how to do it.” Detective Erika Buckley, Detective Josh Langston, Lt. Mike Kemp and Deputy Lorne Whaley investigated the cases.

HARLINGEN — A 24-year-old Harlingen man was arrested Monday and charged with injury to his 5-month-old child.

On Feb. 2, a police officer was dispatched to the 600 block of Rangerville Road in response to a report of possible child abuse.

A Child Protective Services caseworker told the officer that a 5-month-old boy showed signs of abuse, including bite marks, bruises and abrasions to his legs, thighs, buttocks and cheeks, according to a Harlingen Police press release.

The baby’s mother, a 19-year-old Harlingen woman, told the caseworker that the child’s father, Yonder Leiva Izquierdo, caused the baby’s injuries.

The baby was taken to Valley Baptist Medical Center by EMS for treatment.

HPD Sgt. John Parrish said the child’s injuries were not life-threatening, and added that CPS removed the baby from the home and placed him in foster care.

After investigating the report, a detective identified Izquierdo as the suspect, according to a HPD press release.

Izquierdo was later arrested, and was arraigned Tuesday, with his bond was set at $40,000.

According to the Texas Penal Code, a third-degree felony is punishable by no more than 10 years or less than two years in the Texas Department of Criminal Justice.

A fine not to exceed $10,000 may be levied.

Greenwich Father Accused Of Assaulting Child

GREENWICH—A 19-year-old Greenwich father has been charged with felony assault and child endangerment for allegedly injuring his three-year-old child.

Duke N. Barrett was arrested Tuesday at his residence after investigation revealed that he shook his three-year-old child by the arms and then pushed the child onto a couch causing physical injury to both arms of his child.

He was arraigned in the Greenwich Town Court and was remanded to the Washington County Jail in lieu of bail and is to reappear in the Town of Greenwich Court on March 12.

A bill passed by a South Carolina House committee, and now on the full House schedule for debate, would prohibit judges from granting custody of a child to a parent, guardian or anyone else who's been found guilty of criminal sexual conduct with a minor in the first degree.

Rep. Chip Limehouse, R-Charleston, sponsored the bill after a recent Lowcountry case, in which a judge gave custody of a child to the child's biological father in another state, even though the father had a previous conviction for abuse.


"I don't know if it happens very often, but if it ever happens one time only, that is too many times. So we're going to err on the side of child safety. We're going to keep children away from pedophiles," Limehouse says.

The bill originally would have prohibited anyone on the sex offender registry from being given custody, but the House Judiciary Committee changed the bill to apply only to those convicted of first degree criminal sexual conduct with a minor.

The state already prohibits anyone on the sex offender registry, or who's been guilty of abuse or neglect, from becoming a foster parent.

Carl Brown, director of the South Carolina Foster Parent Association and a foster dad to more than 150 children, says, "Before you can even be pre-trained to become a foster parent, you have to have a background check, SLED check, fingerprint, three references. So there are a lot of things you have to do before you can even begin. And of course then you have 14 hours of pre-service training."

The state Department of Social Services says in fiscal year 2010-11, it investigated 368 cases of child sexual abuse. It didn't have a breakdown of how many of those involved a parent or guardian.

But don't judges already look at parents' or guardians' backgrounds before granting custody? Rep. Limehouse says, "Well, I think that's probably happening right now, but when there's a state law in effect, that leaves no wiggle room, no latitude and the law is the law."

Father jailed for leaving infant

WOODSTOCK -- A 29-year-old man accused of leaving his infant home alone is being held without bond in the Shenandoah County Jail, according to Shenandoah County Sheriff's Lt. Darcy Dellinger.

Deputies were dispatched to 460 Jess Sine Road at about 7:30 p.m. Sunday for a welfare check, Dellinger said.

When they arrived, they learned an 8-month-old baby boy had been left alone in his crib for three hours, he said.

The baby's father, John Ashley Outland, of 460 Jess Sine Road, was charged with child neglect, Dellinger said.

Custodial dad who dumped 4-year-old son on Interstate acquitted for insanity (Sweetwater, Texas)

We first reported on this case last summer. At that time, the media (reluctantly?) revealed that dad CARLOS RICO had custody of this boy. Why a father who has been now deemed officially "not guilty by reason of insanity" had custody to begin with has not been explained, at least as far as I can tell. Man Who Dumped Son On Texas Interstate Acquitted For Insanity
A man who abandoned his 4-year-old son along a rural stretch of Texas interstate has been found not guilty by reason of insanity.

SWEETWATER (February 28, 2012)--A judge has found a West Texas man accused of abandoning his 4-year-old son along Interstate 20 near Sweetwater in June has been found not guilty of capital murder by reason of insanity.

State District Judge Glen Harrison ordered Carlos Rico to be committed to the maximum-security North Texas State Hospital in Vernon for examination.

In 30 days, Rico will be returned to Harrison's Nolan County courtroom for assessment of his mental progress.

At that time, the judge will decide whether to keep Rico hospitalized.

A passing motorist found Rico's son at around 3 a.m. on June 28 along Interstate 20 near Sweetwater.

Rico was accused of choking the boy and dumping him on the road.

Police said the boy was picked up by a local high school basketball coach and taken to a hospital, where doctors removed at least 500 cactus spines from his body.

He was released from the hospital and was placed into foster care.


Rico was driving from Lubbock to Saginaw when he abandoned his son, and was later taken into custody by police in the Fort Worth suburb.

Rico's cousin called police after Rico showed up to see him without his son, and investigators determined that Rico was the boy's father, he said.

Al Hunt, the Sweetwater High coach who found the boy, said he initially thought he was looking at a guardrail post until it moved.

"It took me seconds to realize, `it's a little kid there,"' the 54-year-old said.

He said he pulled over and, not seeing a vehicle that the child might have been in, ran across the road and scooped the boy into his arms.

He said the boy's lips were cracked as if he were dehydrated, and that the only response the boy was able to give to his questions was to hold up four fingers when Hunt asked his age.

St. Charles Man Arrested for Endangering Life of a Child
Geneva police reports: A St. Charles man with four children is arrested at Wheeler Park for public intoxication, violating an order of protection and endangering the health and life of a child.

Geneva police arrested James Schnaitman, 41, of St. Charles on charges of violating an order of protection, public intoxication and endangering the health and life of a child after an incident at around 1:49 p.m. Feb. 18 at Wheeler Park, 822 N. First St., reports said.

Police responded to Wheeler Park in reference to a report of a missing juvenile. The father of the child told police that his daughter had been missing for about five minutes. The father was at the park with three of his other children. Police noted that Schnaitman “appeared oblivious” to the children, who were “running around the park approximately 60 or 70 feet away from (Schnaitman) and were unsupervised.”

Tri-Com Central Dispatch advised the officers that there was an active order of protection against Schnaitman, with all four of the children listed as protective parties

LAS VEGAS -- A father is accused of murdering his own child. Police say Justin Forsgren abused his three-month-old little girl, causing the helpless victim to die.

He claims he was holding his baby daughter, heard the phone ring, and accidentally dropped her. Police don't buy Forsgren's story. Detectives believe he caused three-year-old Rayea Forsgren to die, and that it was no accident.

Kimberly Rodriguez knows the family and says her heart is with Rayea and the baby's mother Karen Marshall.

"When I was there, he was changing the baby, feeding the baby, and everything, you know, just being gentle and everything," Rodriguez said.

Marshall told investigators she left her boyfriend Justin Forsgren to babysit Rayea for 20 minutes Thursday night at their home at the Shelter Island Apartments. She returned to find Forsgren performing CPR on the infant, who was in grave condition. Rayea died the next day.

"I knew Karen. She was the sweetest woman in the world. She would never have hurt that baby. She would never hurt that baby. Him, it's a different story," Rodriguez said.

Court documents reveal a pattern of trouble. Rayea had nine injuries that included fractures, old bruises and a brain injury. A doctor at Sunrise Hospital found Rayea had been violently shaken and abused.

"How can any parent shake their child or move your child the wrong way or anything?" Rodriguez said. "They're fragile. They're too fragile."

Forsgren told police he smoked meth the day before babysitting, but says he did not have any the day of the incident.

"Sometimes, he'd be shaky and stuff, and you could kind of tell," Rodriguez said.

"This story today has touched my heart, and I'm sad," concerned resident Michael Degen said.

As strangers mourn, so does Rodriguez who hopes Forsgren pays for this tragic killing.

"J., if you can see me and listen to me, I hope they throw you up underneath the jail," she said.

Marshall, who has not been charged, is said to be taking this death very hard. Forsgren is charged with one count of murder by child abuse and two counts of child abuse and neglect. He remains jailed, and is due in court Wednesday morning.

Dad attacks "estranged" wife, torches his home with children inside; kids in critical condition (Northglenn, Colorado)

Notice that abuser dad WILLIAM JOHNSTON had these kids living with HIM; they were not living with the "estranged" mom. Mom was concerned about the kids' welfare (with good reason, as it turns out), so she stopped by Dad's duplex. He then attacked her, and set the home on fire with the kids inside. The kids are now in critical condition.

Suffice it to say that it's very likely that Dad has a history of domestic violence and threats--and that because he was so abusive and dominating, he was successful in securing at least temporary custody of these children. That's because the authorities never challenge these men. Quite the opposite: they cater to them.

So. Did having "possession" of these kids placate Daddy? Not in the slightest. So we need to discredit once and for all the FR myth that daddies are "forced" into killing their families because their so bloody grief-stricken from lack of child custody/visitation. It's all bullsh**. Abusers kill because they can. They can because they have access to their victims. Their motive: Ultimate control and revenge against the mother.

If anything, this case illustrates how much the rights of mothers and protective parents in general have deteriorated over the past 30 years or so. Who determined that Daddy should have "possession"? Was Mom pressured/threatened into letting him have the kids? Or was this court-ordered?

2 Children, Dad Still Critical After Duplex Torched
Family Dog Died

NORTHGLENN, Colo. -- The two children rescued from a duplex fire last week in Northglenn were still listed in critical condition on Monday.

A toddler and his 6-year-old sister were rescued by firefighters last Thursday. Police said they believe the children's father, William Johnson, set the fire after attacking his estranged wife and locking her outside the home.

The boy has massive smoke inhalation; his sister has burns over 50 percent of her body, according to the children's grandfather.

Johnson was also rescued from the fire. He, too, is in critical condition, according to Northglenn Police Sgt. Ron Haralson.

The mother of the children issued a statement on Monday thanking the community for their support.

"We want to say 'thank you' to everyone for their prayer and support," said Rosie Johnson. "If people wish to donate, they may go to any 1st Bank branch and donate to the Rosie Johnson Fund or any Wells Fargo branch and donate to the Little Heroes Fund. Thank you again for all the prayers and please continue to do so."

Duplex Fire

Rosie Johnson called Northglenn police about 4:20 a.m. last Thursday, saying her estranged husband had attacked her outside the duplex.

Johnson filed for divorce last month and was not living with him, Johnson's father said.

Johnson went to the duplex because she was concerned about the children's welfare.

She went to the duplex and used a garage-door opener to enter the home. That's when she saw smoke pouring out of the garage and called 911.

Police said the smoke was actually from the car which had been left running in the garage.

As Johnson was on the phone with 911 dispatchers, her estranged husband walked out of the home through the garage and began attacking her, slamming her head into the garage wall, the grandfather said.

William Johnson then rushed back into the home and used furniture to barricade himself inside, police said.

Police responding to the 911 call found the distraught, battered mother outside, telling them she had been assaulted by her estranged husband. Rosie Johnson said her estranged husband was inside the home and possibly trying to kill their children.

A neighbor, Jeanne Sparkman, told 7NEWS Rosie Johnson was holding her hand to a huge bump on her forehead.

"Her face ... her head ... her forehead was like, two times the size of a normal forehead. She had blood running down the side of her face. Her eyes were practically closed. It was awful," said Sparkman.

Officers Tried To Reach Children

When police officers tried to contact William Johnson at the front door, they discovered the duplex was on fire.

Two police officers forced their way past a barricaded front door after seeing a flash-fire inside.

The officers were forced back by heavy smoke. They were treated for smoke inhalation at a hospital and released.

North Metro Fire Rescue firefighters responded and found a large fire on the stairs leading to the second floor.

Firefighters managed to rescue Johnson, the two children and a dog from the second floor. All were unconscious. They said each person was in a separate bedroom when they were rescued.

The dog was taken to the vet, but the pet died.

WEST PALM BEACH — Former Wellington mortgage broker Neal Jacobson has been sentenced this afternoon to three life terms, to be served consecutively, for the murders of his wife and twin sons two years ago.

Prosecutors had originally sought the death penalty against Jacobson, 51, but reached a deal with Jacobson's attorneys sparing him that possible sentence.

Jacobson, who appeared before Circuit Judge Stephen Rapp this afternoon, was charged with three counts of first degree murder with a firearm.

Palm Beach Public Defender Carey Haughwout filed a notice with Rapp last week saying there was an agreement in place between her office and prosecutors.

Jacobson, a failed mortgage broker struggling with debt and depression, shot his family on Jan. 24, 2010, the day his twin 7-year-old twin boys, Eric and Joshua, were to celebrate their birthday. He is charged with three counts of first-degree murder with a firearm.

Jacobson at the time of his arrest told investigators that he "just snapped."

Prosecutors had planned to seek the death penalty against Jacobson. Jacobson's defense team in August revealed they planned to pursue an insanity defense, attributing Jacobson's actions to the anti-depressent drugs he was on at the time of the killing.

One of defense's planned witnesses had the case gone to trial was Dr. Peter Breggin, who has testified on behalf of numerous accused killers who were taking high-powered drugs. He was expected to testify that "psychotropic medications prescribed to Mr. Jacobson ... pivotally contributed to Mr. Jacobson's state of mind at the time of the crime," assistant public defender Elizabeth Ramsey wrote in court papers.

Another psychologist was expected to testify that Jacobson is bipolar.

Assistant State Attorney Andrew Slater is the lead prosecutor in the case. Palm Beach County State Attorney Michael McAuliffe had planned to be the second chair in the case, but he is leaving the office next month before the end of his first term for a job in the private sector.

A trial in Jacobson's case had previously been scheduled for December, but attorneys in the case asked for a delay. A status hearing had been scheduled for last Friday but was canceled after the attorneys reached the agreement.

A FATHER who "tortured" his son over a two-week period, forcing him to stay in his room and hitting him with a 2ft screwdriver and a piece of wire, has been jailed.

The man, who is in his 30s, fed the boy only bread for a week and a half and, for two days, made him go to the toilet in a bucket inside his room.

​The Derby father, who cannot be named because it would identify the boy, also hung his 12-year-old son out of a window, dragged him across the floor and punched him.

After the beatings, he forced the boy into ice-cold baths.

Derby Crown Court heard that the man had carried out the abuse after he became frustrated with his son for lying to him.

Jailing the man for three years, Recorder David Mason QC told him: "Anyone listening to the facts in this case would be horrified at the way you treated your own son.

"It was not a one-off incident – in a flash of anger – but a persistent course of conduct over a two-week period, through which you effectively tortured your son."

Prosecutor Sarah Slater said the boy, who usually lived with his mother, had gone to stay with his dad last summer.

She said that, the day after he arrived, his father woke him by slapping his face, then dragged him out of the bed by his ankle and punched him.

He then told him to go back to his room and stay there. Miss Slater said that, two hours later, the man made his son stand against a wall while he hit him on the back of his legs and hands with a 2ft screwdriver.

"He said he couldn't walk because of this, so his father put ice in a bath and made him sit in it," said Miss Slater.

The court heard that the boy had also been made to stand against the wall, while he was hit with a piece of wire.

The beatings caused the boy's legs to bleed.

Miss Slater said the boy was left in his room for about one-and-a-half weeks, with just bread to eat, and he felt like he was in prison.

The boy also said that, on his final day there, before his mother went to collect him because she became concerned, his father had strangled him.

A doctor examined him and found he had scratch marks on his neck and abrasions all over his body.The man admitted cruelty to a child by ill treatment and two charges of assault causing actual bodily harm.

His lawyer Chudi Grant said: "It wasn't planned or premeditated.

"In daily life, children present difficulties. He started to try to get to grips with his son's behaviour.

"He sat down and spoke to him to get to the bottom of his behaviour and lies were told to him.

"His frustration spilled over in a totally inappropriate and grossly wrong way. He is deeply remorseful for the suffering he caused."

The court heard that the man had been brought up with "harsh, physical punishment" and, to him, it was normal.

A FATHER-of-two with a babe in arms headbutted a police sergeant and sank his teeth into him, a court heard.

Anthony Horrocks (36) who was feeding the four-month-old infant, bit Sgt Peter Law’s finger, leaving him bleeding, after two officers turned up at the defendant’s family home.

Horrocks, said by his solicitor to have had a “serious criminal past”, but to be a changed man since his release from a long stretch behind bars, had drunk too much at a funeral when he struck.

Burnley magistrates were told how Horrocks claimed he had been pepper-sprayed while he was holding the tot, but the police were adamant he had only been sprayed later, after he put the baby down.

The defendant, of St John’s Road, Burnley, admitted assault by beating on January 21st.

He was given a 12-month community order, with supervision and 100 hours’ unpaid work. He must pay £100 compensation and £85 costs.

Andrew Robinson (prosecuting) said police were called to a report of a domestic incident in Scarlett Street, Burnley.

When they got there, the defendant was present, but his partner had gone.

Horrocks had a baby in his arms and was feeding the youngster from a bottle. Another child was asleep on the sofa.

He told the officers he hated the police, his kids would hate them, he was aggressive and threatened to assault them – all the while holding the infant.

Mr Robinson said Horrocks lunged towards Sgt Law, butted him, and when the officer raised his arms to protect himself, the defendant bit his finger.

Eventually, Horrocks handed over the child to his mother, he was arrested, tried to punch the victim, threatened violence and was parva-sprayed.

Mark Williams (defending) said it would seem there had never been any allegation made by the defendant’s partner.

Mr Williams said the defendant, who was to reconcile with his partner, was “very much a changed man,” since he was freed from custody.

A man was being held by police on Monday after allegedly trying to set fire to his grown-up daughter in central Paris.

Le Parisien newspaper reported that the man sprayed teargas in the young woman's face and then covered her in petrol on Saturday evening.

The father was apparently annoyed that the woman planned to go out with a group of friends that evening and considered her "too emancipated".

The newspaper quoted a source describing him as a "Muslim fundamentalist."

The 23-year-old daughter has a room in a building in the city's 11th arrondissement, close to the Place de la Bastille.

The 49-year-old man went there at around 11.30pm on Saturday evening and started arguing with her in the hall of the building.

He then attacked her with the teargas and poured petrol over her head and face, after which he pulled out a lighter, causing her to scream.

"She managed to grab the lighter from his hands while passers-by heard her screams," said a source close to the inquiry. "The man quickly made a run for it."

The woman told police her father had been harassing her for several weeks. "She explained he was unhappy that she had a Jewish boyfriend," said the source.

Police caught up with the man on Sunday and are questioning him in connection with attempted murder.

The newspaper reported that the man had only recently reconnected with his daughter, after abandoning her as a child.

He had recently taken her to his native country of Tunisia where he had tried to arrange a marriage for her.

She had resisted, while promising to behave in accordance with his wishes back in Paris.

Indy woman finds boy, 2, in diaper on doorstep; child had wandered from family's apartment
INDIANAPOLIS — An Indianapolis woman who heard a banging on her front door found a 2-year-old boy chilled and wearing only a diaper on her doorstep.

The Indianapolis Star reports (http://indy.st/w13dZ6) that the 24-year-old woman brought the crying child inside, wrapped him in a blanket and called 911 shortly before 7 a.m. Sunday.

The boy was red from being out in the cold and police determined that the toddler had wandered away from his family's nearby apartment while his father slept and after his mother had left for work. A 9-year-old brother was also at the apartment on Indianapolis' south side.

The boy was taken to Riley Hospital for Children and was later released in good condition to his family after child protective services was notified.

A man accused of killing his three-year-old son appeared in the Koster Magistrate's Court on Monday, North West police said.

Michael Letebele was also accused of stabbing and wounding his five-year-old son, Warrant Officer Sam Tselanyane said.

The case was postponed to March 1 for further investigation. Tselanyane said the father had made a confession to police, claiming he was drunk and had blacked out during the crime.

Letebele was meant to look after his two children on February 18 while his wife was in hospital with their ill two-month-old baby.

“He allegedly grabbed the younger son by his legs and hit him against a concrete wall, and assaulted the five-year-old with a beer bottle. He said he was drunk and had a blackout and couldn't remember this.”

He faces charges of murder and attempted murder.

A Sligo man has today been convicted of the rape and sexual abuse of his then 13-year-old daughter, who claims he fathered her child.

The 48-year-old man, who has a previous conviction for rape and sexual abuse of another teenage girl, has been remanded in custody pending sentence next month.

He had pleaded not guilty at the Central Criminal Court to eight counts of sexual assault and seven counts of rape at the family home between September 2005 and September 2007.

The complainant, now aged 19, said that her father sexually abused her once every two to three weeks from when she was aged 13.

The jury previously heard evidence of DNA tests which showed that the man is 12,000 times more likely to have fathered his daughter’s child than anyone else unrelated to him.

The jury of eight men and four women took just over one hour considering the verdict before returning unanimous guilty verdicts on all counts. It was day-nine of the trial.

Mr Justice Patrick McCarthy thanked the members of the jury for their service and excused them from duty for 10 years. He ordered a victim impact report and registered the man a sex offender.

During the trial, the victim gave evidence that after the first incident of rape, her father smiled at her and told her she was no longer a virgin.

The court heard that the girl's father sexually abused her once every two to three weeks, with the abuse beginning shortly before her 13th birthday.

She said that he would wake her up in her bed and, after cuddling her, would touch her and then rape her. She told prosecuting counsel, Isobel Kennedy SC, that her father took her virginity in March 2006.

Some of the abuse took place in her father's bedroom when she would go there at night because of a fear of ghosts.

She said: “I would get into my Dad's bed because he was my Dad and I felt safe. I was young.”

“I was brainwashed by this man. He was my only parent. I had no Mum. I had no-one else to turn to. He was the only one looking after me. I did feel safe around my Dad at some stage.”

Her father would punch her and kick her out of the bed when she asked him to stop touching her.

She became pregnant over a year after the abuse began and she said she knew the child was her father's because she had not had sex with anyone else.

Valerie Tomlinson, a biologist with the UK’s Forensic Science Service said that she compared the three DNA profiles of the man, his daughter and her baby child.

She said that after eliminating the DNA bands belonging to the mother, the remaining “paternal bands” of DNA were all found to be in the DNA profile of the man.

Ms Tomlinson said these comparisons showed he was 20,000 times more likely to be the child’s father than an unknown man unrelated to the accused.

Ms Tomlinson said: “In my opinion the DNA profiles provide very strong support for the assertion that [the accused] is the natural father of [the named child] rather than an unknown man unrelated to [the accused]”.

Dorothy Ramsbottom from the Forensic Science Laboratory in Dublin said that her tests on the DNA profiles concluded that the man is 12,000 times more likely to be the biological father than an unknown man unrelated to him.

She said that the fact that the man and the mother of the child are related did not alter the strength of this evidence.

Detective Garda Pauline O'Neill told the court that during garda interviews the man told them he had a clear conscience.

He told them: “I believe in God. My conscience is clear. There have been worse sinners in this life. God forgives.”

“I have my own justice,” he later told detectives. “I have remorse for every wrong I've done. I'm a human being, not a red arsed red neck”.

When gardaí told the man that he had done a lot of good things in raising his daughter on his own he replied: “I had good intentions. I didn't start off with bad intentions. I failed.”

He also told gardaí during interview: “Everyone makes mistakes”.

He said that he had spoken to his daughter on the telephone since she had reported the abuse and he told gardaí that they were “OK” now.

He said: “I love her and tell her every day. I resided myself to the fact that everyone makes mistakes.”

HOUSTON (KPRC) -- A man shot his two young daughters and his wife before taking his own life with the same gun Sunday, police said.

The shooting happened inside a condo on Reims Drive and Hornwood in Southwest Houston.

Officials said one daughter, 12, was shot multiple times and later died. Her 14-year-old sister was shot in the neck and was taken to the hospital in critical condition, officials said.

The man's wife was also shot.

"She's 43 years of age, also at Ben Taub, shot in the back," John Cannon with the Houston Police Department said. "Doctors say she's believed to be paralyzed."

Adam Dalami owns a convenience store across the street from the complex, and said he ran out of the store after hearing a single gunshot.

Dalami said he recognized the man on the ground instantly. He said it was one of his frequent customers, a man he said he'd known for 20 years.

Jaqueline Johnson drove up after seeing the man fall to the ground.

"When I walked up to the body, I saw the gun," Johnson said. "Another lady standing there told me police are on the way."

Neighbors, including police were left stunned and wondering what could have happened inside these walls to end in such a tragic way.

Some neighbors who claimed to have known the family said the couple lived together, but were divorced.

West Bolivar father to go on trial in death of newborn

A Bolivar man accused of killing his 20-day-old daughter will face trial for criminal homicide, a district judge ruled Thursday.

Clayton Daniel Mibroda, 25, of West Bolivar has pleaded not guilty in the death of baby Natalie.

Indiana County Coroner Michael Baker testified that the infant died of blunt-force trauma to the head and chest and that "the child would have been immediately symptomatic upon infliction of those injuries."

State police Trooper Timothy Lipniskis testified that Mibroda told police that he was caring for Natalie at her time of death.

Lipniskis testified that Mibroda gave three different accounts of what happened on Dec. 29, when Natalie was taken to the Indiana Regional Medical Center by ambulance and pronounced dead.

Lipniskis said that after he described for Mibroda the extent of Natalie's injuries, Mibroda said that the baby was crying and woke him up. Mibroda said he picked the child out of her infant seat, jogged down the hall to a back bedroom to get her formula, tripped over a bucket, dropped the baby, accidentally kicked her in the head and then fell on top of her, the trooper testified.

Lipniskis said the baby's mother, Kayla Jo Lichtenfels, was at a doctor's appointment when this occurred.

After the hearing, Mibroda's mother, Vicki Fetterman, said her son's story doesn't make sense and she believes he's taking responsibility for a crime he didn't commit.

Lichtenfels' and Mibroda's 1-year-old son has been in Fetterman's custody since Mibroda's arrest, she said.

"Not all the facts came out during the hearing," Fetterman said. "And we don't know all the facts either. I love my son, and I would still love him whether he was guilty or not. It would break my heart, but I would still love him. But we just want the truth at this point. There's too many things that don't add up."

Baker testified that the baby had some older injuries, including a tear beneath her tongue and bruises, which were not life-threatening.

Mibroda is being held in the Westmoreland County Prison without bail.

GLENDALE, AZ (CBS5) - A Glendale father is behind bars today after his 6-year-old daughter told school officials he used pliers to punish her.

According to the police report, the girl told staff her dad put pliers around her neck Dec. 15, 2011, because she was reading a book instead of cleaning as told.

The school called police and scabs were found on the child's neck.

The girl's mother told investigators that there had been long-term on-going domestic violence issues at the home, including violence to her.

On Feb. 22, Samuel Navarrette, 35, was charged with one count of child abuse.

Navarrette denied the incident.

There were warning signs that Michael Utley was a danger to his toddler son.

Utley had been charged with assaulting the mother of his child 18 months before the Gallatin County man attacked his live-in girlfriend and then shot and killed their 3-year-old son and himself in February 2009.

When the mother attempted to drive her "trashed" partner home from a local bar in September 2007, Utley slapped her hard enough to give her a black eye as 17-month-old Owen James Utley sat in the back seat.

A state adult-protection worker substantiated "partner abuse." But social workers never considered Owen's safety, according to an internal review of the boy's death conducted by the Cabinet for Health and Family Services, which handles child and adult protection in Kentucky.

Social workers should have formally assessed the "risk of harm" to Owen after the domestic violence episode, according to the internal review that focused on the handling of the case before the deaths.

That oversight was one of several problems related to domestic violence documented in internal reviews completed after children with whom the cabinet had previous contact died or were seriously harmed in 2009 and 2010.

A Lexington Herald-Leader analysis of the 85 reviews found that domestic violence in the family was mentioned in 48 of them and that an episode of domestic violence played a direct role in the injury or death of a child in five instances, including the death of Owen, who was killed shortly after his father had beaten his mother.

Among the shortcomings identified in the reviews:

■ Social workers don't always emphasize the safety of the child when domestic violence is discovered in a family.
■ Social workers sometimes fail to thoroughly assess whether domestic violence has occurred.
■ People living in some rural areas don't have convenient access to domestic violence shelters.
According to a 2011 report on deaths and near-deaths from child abuse and neglect in Kentucky, domestic violence was identified as a risk factor in 68 percent of cases from 2007 to 2011.

Another report released in January 2011 said studies have shown that there is an overlap of 30 percent to 60 percent between violence against children and violence against women in the same families.

In Kentucky, police must send the state a report of all incidents of domestic violence, and adult-protection workers are supposed to investigate those cases, although people are not required to accept the workers' help. Additionally, state regulations say that the cabinet must conduct an assessment to see whether a child is at risk of harm from domestic violence.

According to Jim Grace, assistant director of the cabinet's Division of Protection and Permanency, simultaneous child protection and domestic violence investigations are launched under a variety of circumstances, including if the child has been harmed, is prevented from leaving the premises by an abuser or is considered at risk of being harmed.

But cabinet officials conducting the fatality reviews said workers sometimes missed opportunities to protect children whose families experienced domestic violence.

For example, the cabinet's review of one 3-year-old's death raised questions about why the state found in a case involving the child's family that "there are no child-protection issues" even though a female relative told authorities, "I'm scared for my life and my child's life." The woman said she was being physically abused on a regular basis.

The review of Jeffrey B. Fields' death also questions whether a child-protection investigation should have been initiated after a report said, "Child has seen mother's paramour beat mommy up."

In the end, Jeffrey died in a traffic accident in 2010 when he was thrown from a car driven by a woman who was not his parent and who allegedly could not pass a drug test after the crash, according to the review of his death. There were previous reports of domestic violence in the child's family and the driver's family.

In an April 2009 case in Larue County, a child was taken to Hardin Memorial Hospital with 16 fractures and "multiple brain bleeds" and nearly died. A man in the child's home — his relationship to the mother was not made clear in documents — was criminally charged, and the cabinet found that the mother was neglectful for not protecting her child.

The review in that case noted that another child in the family was injured in 2007 during a domestic violence case involving the mother's previous boyfriend. That boyfriend assaulted the mother when she had an infant in her arms, cutting and bruising her and leaving a bruise and swelling on the baby's head.
The cabinet's review said staff should "continue to emphasize child safety and assessment" when conducting concurrent child-protection and adult-protection cases.

Grace said the cabinet is conducting training "on the dynamics of domestic violence and how it relates to a child's protection."

Once cabinet officials identify a systemic problem as a result of a fatality review, "there's the expectation that we would correct it," he said.

Shelters not always close

The death of Owen Utley also highlighted a lack of domestic violence shelters in rural portions of Kentucky.

After the initial 2007 report of domestic violence against Owen's mother, a social worker spoke with her about financial resources and alternative living arrangements that were available to her. But going to a shelter in her own community was not an option.

Ultimately, the cabinet's review said Michael Utley beat Owen's mother in February 2009 until she had two black eyes and cuts to her ear, and was missing chunks hair. When she ran to a neighbor's home for help, he killed the child and himself.

The "lack of shelter options in rural counties could be a deterrent to victims utilizing ... services," the review said.

Sherry Currens, executive director of the Kentucky Domestic Violence Association, said there are 15 regional shelters with a total of 466 beds, which are nearly always full. All 120 counties are served by a shelter, but some residents have to travel farther than others, Currens said.

It's unlikely that shelters could expand their services without additional funding, she said, and domestic violence shelters in Kentucky got less state funding per resident in 2011 than in 1996.

Coordination lacking

Beyond the problems noted in the fatality reviews, there are other gaps, domestic violence victim advocates said.

Currens said she knows of instances when adult-protection workers have dropped a case after child-protection workers got involved. But both kinds of workers are needed to help the non-offending parent figure out "how to deal with the threat to the children," she said.

Coordination between advocates and cabinet workers has at times been lacking, advocates said.

Darlene Thomas, executive director of the Lexington-based Bluegrass Domestic Violence Program, said advocates are sometimes not told by cabinet workers about domestic violence incidents. In other cases, advocates who contract with the cabinet to provide victim services don't have enough staff to attend team meetings about the family.

Lisa Holmes, the director of a domestic violence shelter in Elizabethtown, was concerned recently that she couldn't immediately get an answer at an intake line for the local child-protection office.

Holmes said she was "scared to death" for the safety of a child whose mother decided to leave the shelter.

Police had brought the mother to the SpringHaven shelter after "her boyfriend told her that the best way to handle his anger was to beat her 3-year-old child. So he picked her up and threw her, and she has a bruise on her face," Holmes said, referring to the child.

Holmes was trying to confirm that the boyfriend was in jail and that the mother and child would be safe if they returned home.

Holmes said she thought it would help "if we were quicker and better at adjudicating domestic violence cases and women had the support of CPS (child protection workers) instead of being afraid of them."

Removing children

Advocates and child-protection workers are sometimes at odds about the best way to keep safe a child who has been exposed to domestic violence.

Members of Currens' group are concerned that the cabinet sometimes unfairly recommends that judges remove children from a domestic violence victim's custody under the theory that the victim is failing to protect the child.

As a matter of policy, the cabinet does not recommend removal of any child from a parent's home unless there is risk to the child's physical safety or well-being, cabinet spokeswoman Anya Weber said.

Recommendations are presented to the court, where the ultimate decision is made related to removal of the child, Weber said.

Thomas, the Lexington-based domestic violence advocate, said children should be protected from a parent who is a batterer. But she and other advocates said every attempt should be made to allow the child to remain with the non-offending parent.

The 2009 near-death of a 2-month-old girl demonstrates the difficult decisions that child-protection workers must sometimes make in cases of domestic violence.

A state review of the case noted that the cabinet substantiated neglect by the child's mother due to a "history of engaging in abusive relationships," not following through once she was granted domestic violence protection orders, and not being cooperative in previous law enforcement interventions involving domestic violence with the child's alleged abuser.

According to the review, the unidentified child was taken to the University of Kentucky Hospital in 2009 with a traumatic brain injury after her mother's paramour admitted to shaking her and handling her roughly.

Solutions

There are at least two legislative proposals this year to create task forces that would study the effect of domestic violence on Kentucky's children and come up with proposed laws for the 2013 General Assembly.

The sponsor of one proposal, Democratic state Rep. Joni Jenkins of Shively, said she worked in a domestic violence shelter for 10 years. She said expanding the services of domestic violence shelters would be beneficial.

"No kid gets beat in shelters. No kid gets neglected in shelters," she said.

Meanwhile, Sen. Mike Wilson, R-Bowling Green, and Rep. Johnny Bell, D-Glasgow, have introduced bills that would require the cabinet to assess the needs of children and custodial parents who have been exposed to domestic violence and to provide prevention services to help the child live at home. So far, neither bill has been considered by a legislative committee.

Other states have found success in having police, child-protection workers and domestic violence advocates working together on a team.

In Fresno, Calif., police Sgt. Daniel Macias is a member of the Children Exposed to Domestic Violence Team, which operates with a $200,000-a-year federal grant. The team's social workers and advocates, along with police detectives, investigate and provide services after domestic violence cases in which children are present, Macias said.

The team follows up with adult victims, Macias said, and "with the children, which are really the key to trying to stop the cycle of violence."

In Kentucky, Thomas said she would like to see collaborative efforts between the cabinet, which investigates allegations of abuse, and agencies that provide services for spouse-abuse victims to make sure families "have all available supports."

Having domestic violence advocates attend cabinet team meetings about individual families would help, she said.

But, Thomas said, "it all comes down to resources."

Man arrested after chase with 3-year-old son in truck

LORAIN — A Lorain father was charged with endangering his son after he led police on a short but reckless chase with his 3-year-old son in the vehicle, according to a police report.

The chase happened shortly after 8 p.m. Friday. According to police, dispatchers radioed that a man, later identified as David Phelps, 26, had threatened a woman at a home on Eastlawn Avenue and was last seen driving west on West Erie Avenue. Officers recognized that the man had been the subject of a manhunt by the Lorain Police Department Community Impact Unit for several weeks.

He had two warrants for his arrest, including one for grand theft auto.

Officers searched the area of the 1300 block of West Erie Street and eventually found Phelps near West Fifth Street. He was driving the truck that was the subject of the grand theft warrant.

When Phelps saw police, the report said, he sped off. After a series of quick and reckless turns at high speeds, Phelps drove into the driveway of a home on West Sixth Street and jumped out of the truck, police said.

He was soon caught by police, who tackled him in the street. Officers found his 3-year-old son and the child’s mother in the truck. They were unharmed, and the toddler and woman were released from the scene. A copy of the report was sent to Children Services.

Phelps was charged with endangering children, obstructing official business, resisting arrest, driving under suspension and reckless operation. He was also booked on the two outstanding warrants.
