Durban - A 26-year-old father has been arrested for allegedly killing his 3-month-old baby son, KwaZulu-Natal police said on Thursday.

Spokesman, Major Thulani Zwane, said police received a tip-off and he was arrested on Wednesday night.

He was expected to appear in court on Friday.

On Tuesday he had arrived at the mother’s house in Ingwa­vuma in the KwaMoyana reserve, and demanded to take the baby home with him.

“The mother refused and he became angry, took the child by force and threw her on the floor. The child sustained head injuries and was taken to hospital in critical condition,” Zwane said. He died in hospital.

Earlier this week, a Western Cape father was found guilty of murdering his 3-month-old baby daughter.

Twenty-five-year-old Eugene Plaatjies was subsequently convicted in the Western Cape High Court of child abuse and assault with intent to do grievous bodily harm.

Sentencing proceedings in the case have been set down to start on June 1.

Dad with custody/visitation rights jailed for abuse death of 3-week-old son (South Africa)

Once again, you have to read between the lines. The mother has a husband who is not the biological father. Therefore, this violent sperm donor apparently had some relationship with the mother that didn't even last through the pregnancy. Some how, he was granted custody/visitation of a newborn, which is sheer foolishness. It is terrible for infants to be separated from their caregivers at this age. It was particularly foolish to grant this sh**head any access. But fathers rights, ya know.

The three-week-old baby who died in hospital after being allegedly abused by his father, has been laid to rest on Sunday in Randgate, Randfontein, on the West Rand.

Randfontein police spokesperson Captain Appel Ernst confirmed a case of child abuse (assault to cause grievous bodily harm) was reported on February 12. It is alleged the baby, Joshua Botha, was taken to Baragwanath Hospital with bruises. The infant was hospitalised and his condition deteriorated. He was placed on life support and later died.

The baby’s maternal grandmother, Brenda Williams-Ludick, said when they arrived at the hospital the baby was still connected to the ventilator, but he already had passed away, Randfontein Herald reported.

In an emotional letter, the baby’s mother, Christene Botha, 23, said: “If I knew I had such a short time with you, I would have never laid you down, would have kissed you all the time.”

Baby Joshua was laid to rest in the Greenhills Cemetery.

The funeral service, which was held at the Gemeentes van Christus Church in Randgate was led by Pastor Desmond Wessels.

A small group of friends and family came in support of Joshua’s mother, her husband Robert Putter, mother-in-law Williams-Ludick and the accused’s mother, Joshua’s grandmother.

Botha was weeping throughout the service.

After the service, the mother of the accused was seen sobbing at Joshua’s coffin, but was not seen at the Greenhills Cemetery.

Her son, Joshua’s biological father, is being held at the Krugersdorp correctional facility. He is expected to appear in court soon.

CAPE TOWN - The case against a Cape Town man accused of the murder of his two-year-old daughter has been postponed for a formal bail application.

Christopher Williams made his second appearance in the Athlone Magistrates Court today following the attack last month.

It’s alleged the 32-year-old beat the toddler at the family’s Hanover Park home following an argument with her mother.

A forlorn looking Williams appeared briefly in the dock.

Today’s court date had been set for a formal bail application but the accused’s representative was not ready to proceed.

The case has been postponed to August for further investigation.

A post-mortem found little Zoe Petersen was severely beaten at her family’s home last month.

She was taken to the Hanover Park Day Hospital the following day where she was declared dead on arrival.

Williams fled after the incident but police managed to track him down at an Athlone informal settlement days later.

Another case of child abuse hits the Western Cape. This comes after a two year old had to be hospitalised after being by her father.

It is alleged 21 year old father had assaulted his daughter with a belt several times for refusing to speak to him.

The toddler had to be hospitalised due to her injuries.

The man had been taken into custody on Sunday and charged with assault with intent to cause grievous bodily harms.

Police had also confirmed that burn marks had also been found on the child's back and shoulders.

The incident comes days after a Cape Town man appeared in the Athlone Magistrate’s Court for allegedly beating his 2-year-old daughter for six hours. She died from her injuries.

A post-mortem has revealed the Hanover Park toddler was severely beaten exactly a week ago, but the reason for the assault is still unknown.

The girl’s father, 32-year-old Christopher Williams, is believed to have fled the scene following the incident.

Fritz says action will be taken against anyone who withheld information pertaining to this case.

“We also want to find out exactly what happened to this child. In this regard we're making all our investigations together with the NGO tasked with working with this girl.”

Violent father who threw 2-day-old baby and killed her "not violent" - huh? (Pretoria, South Africa)

Typical of the gas lighting denials that you see around male violence, especially by fathers.

Despite the fact that the subject committed a violent act, he is not violent...not really. 'Cause he seemed nice you know.

Oh yes he is violent.

In reality, you are what you do. What you practice. How you conduct yourself in the world. To say there is some "essence" of you that is utterly distinct from how you actually live your life is totally and utterly bogus. If you act violently then you are violent. The fact that some people were unaware of the fact that you were violent before in no way changes the fact that you viciously murdered a baby. A father who smashes a baby to the ground and kills her is violent.

Neighbours of a man accused of killing his two-day-old baby in Pretoria said he was not known as being a violent individual.

“We are all still shocked at what he did. We did not know him as a violent man. He was a nice person,” a neighbour told Rekord Centurion.

Alexander Sorda, a foreign national, appeared in the Pretoria Magistrates’ Court on Tuesday and will be back in court on February 24 to apply for bail.

Sorda was arrested for the murder of his daughter after he allegedly swung the infant at her mother and then at the floor at a Pretoria West filling station on Church Street on Sunday.

The girl later died in hospital.

The neighbour said when Sorda and his partner argued, it sometimes led to things being thrown around.

“I do not want to lie; I do not know what happened, but all I heard was a woman screaming. It is truly heartbreaking what happened,” the neighbour said.

The little girl died in hospital.

According to media reports, the baby girl had not yet been named, owing to tradition. She would have been named a week or month after birth, but she was unofficially named Precious for the time being.

Funeral arrangements have yet to be announced.

16 February 2015 at 11:36 by Sapa - A man accused of killing his two-day-old baby when he used her as a weapon to attack his girlfriend, is expected to appear in the Pretoria Magistrate's Court on Monday, Gauteng police said.

The woman told the police that, during an argument in their flat, the man asked her if he was the baby's father, Warrant Officer Wanda Olivier said. "He then hit the mother with the baby," she said.

The couple then left the flat and walked to a petrol station at the corner of Church and Rebecca streets in Pretoria West.

The police called Best Care ambulance services, which arrived to treat the baby around 3am on Sunday.

They found the infant wrapped in a towel and drowning in its own vomit, spokesman Xander Loubser said.

According to Beeld, the mother told paramedics that, after hitting her with the child, the father threw it on the ground.

She apparently had a wound on her forehead.

The two were taken to a nearby hospital where the baby died.

JOHANNESBURG – Gauteng police have arrested a man in Thokoza for allegedly abusing six children in his home.

The Daily Sun is reporting the children were locked up for years by the man, who is believed to be their father.

The paper says he kept the eldest child locked up in the house for over 21 years and often tied him up before leaving the building.

The children, aged between two and 21, apparently never went to school and one daughter, aged 15, says she was repeatedly raped.

But police could not confirm this.

Police spokesman Captain Mega Ndobe says that officers were called to the house to investigate claims of assault this week when they found the children.

Ndobe tells Eyewitness News that a 53-year-old man was arrested for assault and intent to cause grievous bodily harm and a case of abuse will be added.

He says the children were taken to hospital and are now being cared for at a place of safety.

A Plettenberg Bay father will remain behind bars after he allegedly stabbed and killed his 18-month-old daughter last weekend.

The 25-year-old man is believed to have argued with his girlfriend when he pulled out a knife and stabbed the child.

Matla a Bana’s Monique Strydom said, “It’s a terrible case and there is no excuse because he intended to harm the child, he is supposed to protect the child.”

Daily Sun (July 18 2014) - It is almost impossible to imagine what happened on that evil night when little Nkosinathi died. What is known is that the body of the three-year-old boy was found with burn marks on his back, thighs and stomach.

It appears the child had been tortured to death over the open flame of a primus stove. Last Saturday, Nkosinathi Mbatha was found dead by his great grandmother Olpha Nxusa (63) in Majasane, south of Jozi, where he was visiting his father. Nkosinathi's mother Nomfundo Mbatha (21) said it was the first time the boy had stayed with his father, Sandile Nxusa (24).

"I arranged with Sandile's grandmother to bring Nkosinathi for the weekend because my family had a burial in KZN. Nkosinathi wasn't close to his father but they seemed to be friendly when they saw each other on the streets," said the devastated mother. "I spoke to Nkosinathi every day he was with his father. He didn't sound unhappy. I last spoke to him on Thursday and he told me he would be coming back home before schools reopened. "He told me he loved me."

Things seemed to go wrong on Friday when Nomfundo phoned Sandile. "Sandile told me he wasn't at home and I couldn't speak to Nkosinathi," she said. "Late on Saturday night I heard from Sandile's uncle, telling me that my child had been found by gogo Olpha and he was dead."

Nomfundo went to Sandile's house where she found her baby's body. "I found a primus stove in the shack." Nomfundo's mother Brunnette Mbatha (55) said this was the third death in the family in three months.

"In May I buried my firstborn, last month it was her father, now it is my grandson," she said.

Gogo Olpha said she found Nkosinathi's body on the bed in the shack. "His body was ice cold. It appeared he had died in the early hours of Saturday morning," said gogo Olpha.

Constable Xolani Mkheze said a murder case had been opened and the suspect was arrested on Sunday.

"He appeared in the Vereeniging Magistrates Court on Tuesday and was denied bail."

Investigating officer Rudolf Jansen told the court of the torture and assault the children aged between two and 16 had allegedly been put through by their father.

The man’s 11-year-old son alleged that his father had hung him from the wrists for two days using a rope.

When asked to be set free, his father used teargas on him. He was also assaulted.

A woman dressed in a pink jersey sitting in the court gallery removed her glasses and wiped tears from her eyes.

Reading from the young boy’s medical report, Jansen told the court of the bruises and scars that the child had sustained.

He had numerous scars on his body, one of which was a scar on the head which had come from being struck with a knobkerrie, said Jansen.

The accused, who may not be named to protect the identity of his wife and children, faces charges of assault and kidnapping.

Further charges, including one of rape, were expected to be brought against him after allegations that he had forcefully had sex with his wife.

Jansen told the court in Afrikaans the house in which the family had been kept captive was in a dire state.

“There were live rats and rat droppings in the kitchen of the house.”

There was also lots of pornographic material.

The accused had rented out some outside dwellings on his property.

Jansen told the court that the tenants feared him.

Locals and non-governmental organisations demonstrating outside the court called for the accused to be kept behind bars.

Some carried placards with the words “stop child abuse” or “monster”.

Jansen told the court the accused was a flight risk.

The Springs man was arrested last month after his son fled the house and sought help from neighbours.

They alerted the police.

The matter continues.

A South African businessman has been ­accused of keeping his family captive and abusing them for more than a decade.

His five children, aged between two and 16, were allegedly tortured with electric cables and burned with a blow torch. The man’s wife told police her husband, 36, also regularly stripped her naked, then handcuffed and assaulted her.

Police told a court east of ­Johannesburg yesterday a doctor’s report showed the 16-year-old daughter was sexually active, but had never left the house.

Police are investigating claims that the man, described as a successful Afrikaans businessman, kept his family captive for as many as 16 years.

The court ordered the man not be named to protect the children.

Neighbours in the mining town of Springs, east of Johannesburg, told Beeld newspaper they never knew the well-dressed husband and wife had children.

The neighbours called the police after the man’s 11-year-old son escaped last week.

The accused took his son back from the neighbours, held his head under water in his swimming pool, beat him and then hid the wounded boy in the ceiling when police arrived, according to police investigator Rudi Jansen.

Police took four children from the house, but the accused said the 11-year old had run away. He then secretly took the boy to relatives in a neighbouring province.

After a few days, the wife broke down and told authorities where the child was, and about years of abuse at her husband’s hands. The children are being kept in a safe place, separate from their mother, while police investigate charges against her.

The court roll showed charges of assault and child abuse against the man, but police said charges of attempted murder would follow.

The man was remanded in custody until next Wednesday.

  Johannesburg - A 33-year-old man who allegedly killed his 2-year-old daughter handed himself over to police on Monday, Limpopo police said.

"It is alleged the suspect went to his 23-year-old girlfriend's house at Madibeng village in Bolobedu on Sunday night, [and] an argument allegedly ensued between him and his girlfriend's 42-year-old father," said police spokesperson Hangwani Mulaudzi.

He said the man took out a knife and allegedly stabbed his girlfriend and her father several times.

"The two fled the scene with stab wounds, leaving the 2-year-old in the house, the suspect then vented his anger on his daughter by allegedly crashing her against the wall before setting the house alight with the little girl inside," said Mulaudzi.

He said the girl suffered serious burn wounds and was pronounced dead on arrival at Ga-Kgapane Hospital.

Provincial police commissioner Lieutenant General Fannie Masemola said the trend of people venting their anger on innocent children had to end.

"This disturbing trend of people venting their anger on innocent children has to end, this is the third child we have lost in two weeks," said Masemola.

He said he would have used all the resources at his disposal to arrest the man, if he had not handed himself over to police.

The two adults who were stabbed were taken to hospital and are recovering.

Durban - An Inanda father accused of fatally stabbing his 2-year-old son was on Tuesday described by the State as an “exceptionally clever witness” who had tailored his evidence according to the testimony of other witnesses.

Simphiwe Ngetshu, 34, had told the Durban Regional Court that on August 23 last year that at 2.30pm he had been walking in Ryde Place, Durban North, carrying his son, Smangaliso Nhlengetwa, on his shoulders when they were approached by three men.

He said his child was taken into the bushes while he was being robbed. When he went to look for his son, he found him crying and bleeding from the left side of his chest.

Ngetshu had pleaded not guilty to murder and defeating the course of justice by making a false police statement.

Prosecutor Krishen Shah called for a conviction as there had been overwhelming evidence against the accused.

Ngetshu said he had walked for 20 to 30 minutes to his part-time employer’s house, who had lived close to where he said they were attacked, for help.

He claimed he had unsuccessfully tried to stop passing motorists for assistance.

Shah referred to the testimony of Dr Grant Bekker, a general practitioner, who declared the boy dead. He said the child’s body was cold and rigor mortis had already set in. He estimated Smangaliso had been dead for at least six hours.

“This is one tragic incident. No one saw Smangaliso’s father as a suspect until police had taken him home that night and he opened his mouth,” Shah said, referring to Ngetshu’s confession to police, which he claimed he was coerced into making. Ngetshu had confessed he was possessed by evil spirits, driving him to commit the crime.

Shah argued that from the evidence, Ngetshu showed no emotion or any urgency in getting his child to the hospital for treatment, despite two stab-wounds to the chest.

Ngetshu had tried to stop passing motorists, but did not stop for help at other houses, shops and a pharmacy en route to his part-time employer’s house, he said.

Shah referred to Ngetshu being an “exceptionally clever witness”, tailoring evidence. For example, forensic pathologist, Dr Threnesan Naidoo, said there were no tears or holes in the child’s sweater or T-shirt in the area he had been wounded.

Naidoo had concluded that the boy was either not wearing the clothes at the time or they were pulled up. He felt it was more likely the former because there was minimal blood and the sleeve of the boy’s T-shirt was worn inside out - not a natural way of wearing a T-shirt.

In his evidence-in-chief, Ngetshu said when he ran into the bushes to find his son, he noticed the child’s T-shirt was inside out.

His lawyer, Hycenth Mlotshwa, argued that Bekker had only estimated the time of death and that Naidoo had testified that rigor mortis set in quicker in a child than in an adult. Mlotshwa argued that Ngetshu did not stop at other houses because no one was home. His part-time employer testified to Ngetshu looking very shocked and wanting to be taken to the hospital.

“The State’s evidence that the accused was responsible for his son’s death is not sufficient for a conviction,” he said.

Judgment is expected later this week.

It is reported that the child's mother "passed away a long time ago" and that the child lived with the grandmother. Gee, do we know for a fact that Mom died from natural causes?

Too bad the grandmother let Daddy come anywhere near this little girl, since he admits that he strangled her to death. But boy, he didn't rape her. No sirree!

I sure wouldn't take Daddy's word for it. This piece of sh** thinks that semen just sort of found its way to his daughter's genitals without him raping her?

Father admits to killing epileptic daughter, but denies raping her

Sunnyboy Phakimpi Mnisi, 32, from KaMhlushwa near Malalane, pleaded guilty to murder and pleaded not guilty to two charges of rape, a Sapa correspondent reported.

He voluntarily admitted that he unlawfully caused the death of his daughter, Ayanda Nokuvela Mnisi, 7, by strangling her after she started having seizures.

He admitted to forcefully hitting Ayanda’s head against the floor on August 16, 2012, and running away after he realised that she was dead.

Mnisi testified that he then called his mother and informed her that he had killed his own daughter.

When State prosecutor George Baloyi asked the court to keep the accused in police custody as he had pleaded guilty to the murder charge, Mnisi refused to be detained.

“No, no, no! This will not happen. I am not going inside there. You asked me to plead, and now you want to lock me up. Call my mother first or this is not going to happen,” Mnisi said to the court orderly.

He tried fighting two policemen who were ordered to take him to his cell, but they overpowered him.

His mother was called and she went to comfort him as he was escorted to police cells.

Before the case was adjourned, Mnisi’s sister, Norma Prudence Mnisi, testified that she received a call from their mother informing her that Mnisi had killed Ayanda.

“As I was a member of the Community Policing Forum (CPF), we went to his house to investigate and found the doors wide open. After entering, we found the child lying on the floor inside his bedroom. She was already dead,” she said.

Norma said the naked child’s face was covered with a T-shirt and her private parts with her school dress.

“I walked out of the house and contacted my sector manager and the police. The child’s mother passed away a long time ago and the girl lived with our mother.

“The accused arrived home the next day crying, after his brother fetched him from the veld where he was hiding. He apologised to the family, saying he had done something wrong by killing the child. He was shaking and did not say much,” Norma testified.

Dr Jan Marais, who conducted the post-mortem on the child, testified that she suffered an injury to the back of the head and died as a result of strangulation.

He added that there was semen on both her private parts, indicating she had been raped.

Marais said as he had performed the post-mortem six days after the girl’s death, he could not establish whether the rapes happened before or after her death.

Judge Ebenhaezer Jordaan said the court needed to call a pathologist to establish whether the rapes happened before or during or after the victim was murdered.

KIMBERLEY - A man has been arrested after the burnt remains of his baby boy were found in a trench in Galeshewe, Kimberley on Sunday, Northern Cape police said.

The 27-year-old father was charged with murder, Lieutenant Olebogeng Tawana said.

Police believed the one-year-old may have been murdered on Thursday, and the father reported him missing the next day in an attempt to mislead them. The toddler's mother raised suspicions after she told police she did not believe the father's story about the boy going missing.

Local residents found the body after noticing the smell.

"[He] was wrapped in a towel and burned not far away from their house," said Tawana.

Cape Town - Police have charged a father with murder after he allegedly buried his 14-month-old son in a shallow grave under his bed.

Zolani Malanga, 32, is expected to appear on Monday at the Bellville Magistrates’ Court for the murder of his son Zondre Parks.

Cops are trying to determine how Zondre died.

They are not sure if he was buried alive, poisoned or suffocated to death.

Police spokesperson Elvis Mahote says: “A 33-year-old father has been charged after the dead body of his baby was found buried in a grave inside his shack.”

Malanga was allegedly found with the naked corpse of his son inside his shack during the early hours of on Thursday morning in Botterboom Street, Delft-South.

The shallow grave could still be seen under Malanga’s bed.

Zondre’s distraught mother Nadia Parks, 35, says she and Malanga had a rocky relationship and that he was a maintenance dodger.

Nadia says that although Malanga never supported his son, he often fetched him for small visits.

It was one such visit that ended in tragedy on Wednesday night.

She says Malanga came to her home at 9pm, while she was playing with Zondre. “He asked to take Zondre to the shop and said I must put a warm top on for him,” says Nadia.

“I didn’t think he was going to be away for long.”

But after a while, Nadia became worried when they did not return.

“I walked down the street and I sent my seven-year-old son Nevan to look at the shop,” she says.

“I then SMSed his (Malanga’s) uncle and asked if Malanga was there with Zondre.”

Sick with worry, Nadia says she also contacted the detectives dealing with her maintenance case against Malanga.

Then she received an SMS from the uncle saying she should come fetch Zondre.

“It was already after 11pm. I SMSed back it was late and that Malanga should bring the child back to me,” says Nadia.

Another hour passed before a police van came to collect her and took her to Botterboom street.

It was there where she saw a hive of activity – including police vans and an ambulance.

“A captain told me my child is late and that he is sorry, I already knew my child is gone,” she says.

“I asked to see his body because I wanted to see his smile, his dimples.

“I saw the grave was inside his shack, Zondre lay stiff with his arms and legs pulled out.”

Malanga’s aunts, who are 46 and 36 years old, say they were alerted to Zondre’s death after Malanga’s drinking buddy came to them to say he had done something to the boy.

“Malanga told the friend he took a decision about his child.

“The friend came inside and told the uncle what Malanga,” says the 36-year-old aunt.

She says her husband went into the shack and found Malanga on his bed.

“My husband asked him where the child is, Malanga said he killed the child,” she says.

Malanga then allegedly started digging up the tiny body.

The Richards Bay Regional Court in northern KwaZulu-Natal has convicted and sentenced a 43-year-old man for raping his daughter between 1999 and 2011.

Provincial police spokesperson Jay Naicker says the victim was at home with her father when the he sexually assaulted her. He says the child was 11-years-old when the rapes first started.

"The 43-years-old Richards Bay man has been convicted and sentenced to 39 years imprisonment by the Richards Bay Regional Court. It is alleged that the father raped the victim from 1999 to 2011 and he often threatened to kill her if she report the rape," adds Naicker.

Meanwhile, the case against a 41-year-old father accused of raping his two daughters, has been postponed to Friday at the Vuwani Magistrate's Court, outside Thohoyandou in Limpopo.

The one-month-old baby and her two-year-old sister were left in the care of their father while their mother went to an overnight prayer meeting.

Dad gets 25 years for abduction, murder of 2-year-old son (Capetown, South Africa)

Fathers do not kidnap their kids because they want quality parenting time. In most cases, the objective is to punish the mother. Because these are short-tempered, violent, abusive guys, children often become collateral damage. This poor little boy was murdered for soiling his diapers.

CAPE TOWN - An Atlantis man who was found guilty of murdering his two-year-old son has been sentenced to 25 years behind bars.

John Hendricks was convicted of murder, kidnapping, assault and assault with intent to cause grievous bodily harm in the Western Cape High Court.

He killed his son in 2011.

Hendricks flung his son to the ground three times because he was angry at him for soiling his nappy.

The child suffered convulsions and died several days later.

The 25-year-old stared blankly at the judge as he handed down the sentence.

His grandmother was in court to support him.

She said she was relieved the ordeal had finally come to an end.

Meanwhile, Social Development MEC Albert Fritz says his department welcomes the 25 year sentence.

Fritz says this should serve as a strong message to other parents guilty of child abuse.

“We welcome the 25 year sentence that was given to this father. I think this sends a very strong message to parents that any form of child abuse will not be tolerated.”

Durban - A former Durban policeman has described in chilling detail how he murdered his 14-year-old daughter after he was charged with raping her.

The girl was pregnant with his child when she died in a hail of bullets as she tried to flee from her father, who was armed with his semi-automatic Walther P99 service pistol, 15 rounds of ammunition and a spare magazine.

Yesterday, Simo Mgobhozi, 41, pleaded guilty in the Scottburgh High Court to charges of raping and murdering his daughter, Nontobeko Zandile Mgobhozi.

He was sentenced to life in prison for the murder and an additional 15 years for the rape.

“He knew his daughter was the only witness to implicate him on the rape charge.

“He killed her because he knew the baby would have proved fatal to his conviction,” prosecutor Khatija Essack argued in aggravation of sentence yesterday. “Clearly, the murder was premeditated.”

In a plea statement read out by defence lawyer Theuns Botha yesterday, Mgobhozi admitted that when he went to see the girl’s mother, Zinhle Khuzwayo, about the rape charges, his intention was to kill his daughter.

Mgobhozi learnt that his daughter was about 34 weeks pregnant with his child when he was arrested and charged with her rape in January last year.

The girl had lived with her mother, who had been estranged from Mgobhozi since Nontobeko was about four years old.

In June 2011, Nontobeko visited her father at his home in Isipingo, which he shared with his wife, their three daughters and another daughter from a previous relationship.

Mgobhozi said Nontobeko, who was 13 at the time, asked to sleep in his bed because she was scared. He said he later joined her and raped her in her sleep. She awoke during the intercourse, he said. He described having sex with his daughter as “a moment of weakness and sheer stupidity”.

In his guilty plea, he stated: “This charge of rape of my own daughter caused havoc in my marriage and had a negative impact on relations with my immediate and extended family.”

After the rape charge, Mgobhozi, based at Reunion in the railway police section, was suspended after 17 years’ service with the SAPS.

On March 1 last year, he armed himself and confronted Nontobeko and her mother at their home in uMlazi.

“I entered the room and explained my reason for my visit. I warned them that nobody was going to leave the room. I was very emotional, stressed and angry,” he said.

“I told them that we are all going to die and drew my firearm.”

He said that as Khuzwayo begged him not to kill them, he heard a door opening and saw Nontobeko trying to escape.

“I fired several shots in her direction. Zinhle tried to stop me but failed. I moved towards the door and continued shooting outside.”

The court heard that of the eight shots fired, five hit Nontobeko.

The Grade 8 pupil died at the scene of “perforated gunshots to the head”, according to the post-mortem report.

Mgobhozi said that after the shooting he panicked and left in a state of shock.

He had car trouble and said he stopped when he was approached by a group of people at an undisclosed location.

“I remember telling them that I had shot my girl,” he said. He said he handed his firearm, car keys and cellphone to the group and asked them to call the police.

He was subsequently arrested and charged with murder, after which he resigned from his job.

While awaiting trial, Mgobhozi was informed that a DNA paternity test conducted on the foetus confirmed that he was the father.

Mgobhozi, who has been in custody since his arrest, said he was truly remorseful and accepted full responsibility for his actions.

“I was ashamed of my behaviour and to this day regret what I had done to my daughter. It happened once and never again,” he said, adding he had tried to be a good father to Nontobeko by paying maintenance to her mother and assisting with other expenses.

Handing down sentence, Judge Gregory Kruger said: “The most shocking feature that strikes one is that you raped your own daughter.

“The consequences of your actions were made known in that your daughter fell pregnant. You found yourself in a horrible situation where you were going to be a father and grandfather to a child.” 

However, Judge Kruger said while the rape was serious, it was “not one of the most serious I’ve seen”.

Turning to the murder, he said he accepted that Mgobhozi had been angry.

“You wanted answers and that is understandable. But the difference lies in the fact that you armed yourself to seek those answers. Your intentions were quite clear.”

The court also noted the distance of 6m between the door of the home and where Nontobeko fell.

“She was very close to you. As a trained cop, you fired eight shots at her. Five shots struck her, two of those in her head. The gruesomeness of the murder and your actions preceding it cannot be offset by mitigating factors submitted by your counsel,” the judge said.

The defence had submitted the murder was not premeditated but was “triggered” by Nontobeko’s attempt to escape.

Before sentencing Mgobhozi, Judge Kruger said: “Society… to these courts to punish offenders of these crimes, severely. If the court doesn’t, society might take matters into their own hands. This we cannot let happen.”
