SAN DIEGO - A father could face up to 14 years in jail if he’s found guilty of endangering his 9-year-old daughter.
The girl was found to be living in a backyard shed with her father and his 29-year-old girlfriend.
Joe Tavolazzi, 60, and his 29-year-old girlfriend Kimberly Bradeen were arrested Thursday along with six other adults at a property on the 12700 block of Lindo Lane in Lakeside.
Team 10 found out Sheriff's deputies responded to 19 complaints against the Lakeside home in the last two years.
One neighbor told 10News, “Nothing good was happening in there.”
Last Thursday, deputies searched the entire property. Their search quickly focused on the shed that contained a shot gun, a .22-caliber rifle and 8.1 grams of methamphetamine.
In court today, deputy district attorney David Williams III, told a judge there was a serious danger to the child. Via closed circuit TV, Tavolazzi pleaded not guilty to child endangerment and other felony charges.
A judge set his bail to $190,000 and ordered him not to have contact with his daughter. Bradeen also pleaded not guilty to similar charges except the one related to child endangerment. She also faces a charge of being an addict in possession of a firearm and a stun gun.
Shortly after deputies made arrests Thursday, a 10News crew went to the home and encountered hostility. One unidentified person used profanity at our crew.
The girl’s uncle, Ted Tavolazzi insisted the girl had access to a bathroom in the house 100 feet away.
“She was well taken care of, that's enough!” said Ted Tavolazzi.
Deputies say despite the conditions, they found the girl to be in decent health. She’s in the custody of Child Protective Services.
Tavolazzi and Bradeen will be back in court on April 20. They will be charged and tried as co-defendants.

A 24-year-old father was arrested Sunday night after North Las Vegas Police say they found the body of his 2-month-old daughter in a dumpster.
Mason Henderson of North Las Vegas was arrested on counts of first-degree murder and child endangerment in the infant’s death, according to North Las Vegas Police. He also is accused of neglecting his 1-year-old daughter, police said.
He was being held at the Las Vegas City Jail. #The 23-year-old mother of the infant reported about 12:30 a.m. Sunday that she returned home to find the couple’s 1-year-old alone, police said. The home is in the 3800 block of Craig Crossing Drive, near West Craig Road and Allen Lane.
The woman reported Henderson and the infant missing to officers who were in the neighborhood, police said.
Another police agency notified North Las Vegas Police about 6:30 p.m. that it found and detained Henderson, police said.
The investigation led police to the infant’s body about 9 p.m. in a dumpster in the 4000 block of Allen Lane, near West Alexander Road, police said. The infant was identified by the Clark County Coroner's Office as Jessica Henderson.

A Sioux City man charged in connection with his son's death has had a falling out with his attorney and will not go to trial next week.
Michael Williams said in a letter to the court he no longer trusted Matt Pittenger, his court-appointed attorney, because Pittenger did not have his best interests in mind and doesn't believe Williams is innocent.
Williams asked Pittenger to withdraw. At a Monday hearing, Pittenger told District Judge Jeffrey Neary that the attorney-client relationship with Williams had broken down.
Neary approved Williams' request and continued the July 7 trial date.
A new trial date will be set once Williams has a new attorney.
Williams told Neary his family is attempting to hire a private attorney to represent him.
Williams, 27, is charged in Woodbury County District Court with three counts of neglect of a dependent person and single counts of child endangerment resulting in the death of a child and child endangerment resulting in bodily injury of a child.
Williams had taken his dead 2-month-old son, Leonard Williams, to a hospital emergency room on April 29, 2014. An autopsy showed that the infant died of malnutrition and dehydration.
Woodbury County Attorney Patrick Jennings said at Monday's hearing that the continuation was warranted, but he did not want to see the case continue to drag out. Charges were filed in May 2014 and additional charges were filed in November.
The trial has been continued twice before, and Williams has twice been on the verge of agreeing to plead guilty, only to reject a plea offer.
"We can't continue to do this," Jennings said.
According to court documents, Williams told police he left the baby unsupervised for long periods of time in the apartment he shared with Leonard's mother, Rebekah Williams-McCarthy, in the 2800 block of West Fourth Street.
Williams-McCarthy faces the same charges as Williams. Her trial is set for Aug. 4.

Custodial dad charged with "neglect" in beating death of 3-year-old son now charged with DUI (Hollywood, Florida)
See our previous posts on this case. Custodial dad NELSON OSCEOLA isn't just a clueless daddy with an affinity for strong drink. Here are some previous descriptions:
Nelson Osceola had been the subject of two reports of physical abuse, and had a lengthy criminal history; the boy’s stepmom had undergone two neglect investigations.
Nelson Osceola’s rap sheet contained nine arrests, including charges of weapons possession on a school property, marijuana possession, aggravated assault with a weapon, burglary, fleeing police and battery. A court pleading cites “numerous” other reports from the Seminole police. The most recent case, the battery, remained pending during much of the time Nelson Osceola had custody of his son.
Less than two months after he was awarded custody of Ahziya, Nelson Osceola came back on DCF’s radar. Ahziya had been living with his father since the end of February 2014. On April 21 of that year, DCF’s hotline was told that the boy had “multiple bruises on his body,” along with fingertip-shaped bruises on his face. The Child Protection Team, which evaluates children for evidence of abuse, decided most of the bruises were inconclusive.
Despite all this, notice that this POS is still hopeful that he will regain custody of his other child (the one he and the step didn't manage to kill) and will "probably go free" from this latest DUI charge too.

HOLLYWOOD (CBSMiami) – The Hollywood father charged with neglect for the death of his 3-year-old son is now facing new trouble.
Nelson Osceola appeared in bond court Thursday for allegedly driving under the influence.
The 24-year-old, who was arrested in March on child neglect charges in connection with the death of his son, Ahziya Osceola, was free on bond but is back behind bars on drunk driving charges.
According to police, in March, Osceola’s son’s bruised body was found stuffed in trash bags, crammed in a box in the home he shared with his wife and other family members.
Osceola’s wife, the 3-year-old’s stepmother, Analiz Osceola Rodenzo is charged with aggravated manslaughter and remains in jail.
Osceola’s lawyer, Hilliard Moldoff, says he’s still dealing with the emotional turmoil over the death of his son.
“Mr. Osceola is the father of a child who’s deceased and has been struggling with the reality that his son is dead. So to say that he was intoxicated doesn’t surprise me in the least and he was on the reservation which unfortunately, maybe, he feels more secure in,” Moldoff said.
But Osceola will most likely go free. Bond is set for just above $20,000.
“He doesn’t need a bond he’s not going anywhere. He’s invested in getting permission to have custody of his other child. I’m sure he’ll be out and be sober and be fine in a week he’ll get the message but this was just probably a wakeup call for Nelson.”
Osceola could post bond as soon as Thursday and be released from jail.
Meanwhile, prosecutors have upgraded his previous charges to child neglect with bodily hard.
Osceola is expected to go to court on that charge in July.

Dad with custody/visitation rights arrested for leaving "mssing" 5-year-old daughter at water park (Beatrice, Nebraska)
Fortunately this is not one of those cases that ended in tragedy. But it does highlight the problem of granting custody/visitation rights to young, probably never married fathers who don't have a clue as to how to supervise young children. Notice this is the second time police became involved because dad ZACHARY C. SHEPARDSON "lost" the child. And this last time, he didn't even bother to contact police though she had been gone for at least two hours.
The poor mother must just shudder every time she has to submit her daughter to this. And yet, how much you want to bet that the court's won't revoke Daddy's "rights"?

BEATRICE — A Beatrice man was arrested after his 5-year-old daughter was found alone in the Beatrice pool.
Shortly after 11 a.m. Saturday, an hour before the Big Blue Water Park opened, a pool worker spotted a child in the pool in chest-high water with no clothing or supervision.
The worker contacted police, who determined the 5-year-old was unable to swim. The father was eventually identified as Zachary C. Shepardson, 23.
Officers got in touch with a family member, who contacted Shepardson, who then contacted police at 12:35 p.m.
During an interview with police, Shepardson said he knew the child had been missing since around 10 a.m. but did not report it to officers because he was afraid he would get in trouble. Shepardson told officers he knew he should have notified police based on a previous experience when his daughter was lost and returned to him by officers, according to Gage County Court documents.
Shepardson was arrested on suspicion of committing intentional child abuse for not notifying police, because it placed his child in a situation that endangered her physical health.
Police Lt. Mike Oliver said the girl was unharmed, and was turned over to her mother, who does not live with Shepardson.
Shepardson appeared in Gage County Court Monday, where bond was set at $5,000 with a 10 percent deposit. He’s due back in court June 23.

Is dad JERRY CONNER a custodial father? Notice that there is mention of "one woman" in the home who is NOT identified as the child's mother, and has not been charged. Not only that, she sounds pretty lackadaisical about the whole wandering 2-year-old thing, which is pretty weird. She sounds more like a casual girlfriend than a mom. What happened to Mom?

PINEVILLE — A Pineville father is charged with child abuse, after police say the man's son has wandered away from home several times, and he didn't even know it.
Neighbor after neighbor along Pineville Street said they weren't surprised to hear Jerry Conner is charged with child abuse.
Police say at least twice, his 2-year-old son wandered far away from home, and someone called 911 to report it. #Channel 9's Stephanie Maxwell knocked on the door to the family's home, but no one answered.
She talked to one woman, who says she's had a few close calls with the boy.
"The child was in the road, and we almost hit him," says the woman who didn't want to give her name. "He wanders out toward the road a good bit."
Police say the 2-year-old even walked all the way to Lake Park back in April, just feet from a large body of water.
At that time, police say Conner told them-- the boy slipped out the door, and he didn't realize it. That stunned walkers at the park.
"For a 2-year-old to get from home to here, that's about 5, 10 minutes," said Adele Campbell. "If your child is out of your sight for two minutes, why are you not looking for him?"
Last Thursday, police arrested the father when the boy ended up a few streets over from their home. The woman who got close to hitting the toddler says she's always drives extra slow in the neighborhood, just in case.
"I just hate it because he's a precious little boy," she said.

Custodial dad with heroin addiction left kids in "deplorable" conditions (Palm Bay, Florida)
A careful reading shows that JONATHAN NETHERCUTT is a custodial father. But not a word on why this dysfunctional heroin addict had custody, who gave it to him, or what happened to the mother. As often happens, the mother is erased from the story. The children are now in the custody of an unnamed "relative."

It was inside of a home on Creel Street in Palm Bay where police say Jonathan Nethercutt, 34, badly neglected his three children.
"When we got there, we documented some conditions that were absolutely deplorable," said Yvonne Martinez with Palm Bay police. "You wouldn't expect any human to live in that, much less children."
According to Nethercutt's arrest report, detectives found cigarette butts, trash on the floors and couches, and dirty dishes everywhere, along with an infestation of German cockroaches.
There were so many roaches, that police say they would scatter from the rug when stepped on.
But the tipping point, according to Martinez, were syringes left out in the open, used by Nethercutt because of his heroin addiction. "Drugs, paraphernalia, the environmental hazards in the house, infested with roaches and food. It was just not anything that you would want a child to have to be exposed to," said Martinez.
The children wrote on their bedroom walls how much they hated their father, according to the report. One of them apparently writing, "Giving up hope. I hate my dad."
Palm Bay detectives were notified about the neglect allegations by the Department of Children and Families a few weeks ago after an anonymous caller tipped them off.
After an investigation, Nethercutt was arrested Monday on charges of child neglect and contributing to the dependency of a minor.
He went before a judge for the first time at the Brevard County Jail on Tuesday where a judge ordered he be held on $40,000 bail.
DCF said the three children are in protective custody and staying with a relative.
They're said to be in "good spirits."

He went before a judge for the first time at the Brevard County Jail on Tuesday where a judge ordered he be held on $40,000 bail.
DCF said the three children are in protective custody and staying with a relative.

Sacramento County investigators say the boys, ages 7 and 8, roamed the streets Christmas Eve and day. A good Samaritan found them and called police.
The kids were looking for a warm bed and a hot meal.
“We know the small boys had escaped the apartment by crawling out of a second-story window,” said Sgt. Lisa Bowman, a spokesperson for the Sacramento County Sheriff’s Department. “They had each other and the blankets they took with them.”
Officers say their father, Bejamin Montez, was later arrested for allegedly abandoning the boys. Investigators say when they got to Montez’s home, they also found a five-year-old boy who appeared to be abused. The brothers left him behind, because they said he was too small to escape.
Montez was booked into the Sacramento County Main Jail on felony charges of willful abandonment/nonsupport of a child under 14, felony child endangerment and corporal punishment/injury to a child.
“He did not contact our dispatch or sheriff’s department in any shape or form to report the 7- and 8-year-old missing,” Bowman said.
He is being held on $35,000 bail.
The children are in the custody of child protective services.
But their story doesn’t end there. Sheriff’s staff members were so moved by the boys’ situation, they wanted to do more. They organized a surprise holiday party for the kids, complete with donated presents and a Christmas tree.

The 16-year-old male victim told police he had slept in the backyard for at least a month, and that he had to use the hose for drinking water and use the yard as his restroom at night.
Brian Wayne Romine and Shelly Anderson-Romine “treated their dog better than they treated [their son],” said the teen’s uncle, Tray Romine.
The teen left his North Meadows Street home after at least 30 days of the sleeping situation, and went to Tray’s home.
Tray, who said he was unable to get his brother to talk through the situation, called police.
Authorities charged the Romines (Shelly is the teen’s stepmother) with child abuse.
The teen triggered the backyard discipline by doing things like taking loose pocket change from his parents, and smelling cake frosting, according to the uncle and court records.
The suspects did not answer the door when ABC15 stopped by Saturday night.
The outdoor sleeping was done during June and July, records said; the teen was forced to sleep outside during monsoon rains and thunderstorms, according to Tray.
“It’s going to take my nephew a while… for him to pull out of this,” Tray said.
The teen’s mother died years ago, Tray added.
The teen is now staying with a foster parent, Tray said.

It doesn't seem likely that there was a mother in the home, or she would have surely known about Daddy chaining the little boy to his bed. So she would have also been arrested, given that mothers are always held responsible for the acts of abusive/neglectful fathers.

LOGAN — A 29-year-old father has accepted a plea deal, pleading guilty to chaining his seven-year-old son to a bed while he was away from home.
Court records show Sammie Hodges pleaded guilty on Monday to child abuse, a class A misdemeanor. Three other misdemeanor charges were dismissed.
Hodges was arrested in June after police received an anonymous tip claiming the boy was being chained-up in a Logan home while his father was at work.
Logan City Police Chief Gary Jensen said when police searched the home near 825 North 1400 East, they found the boy chained-up in a bedroom.
Defense attorney David Perry said the boy wasn't injured by the heavy chain attached to his ankle, and he had access to snacks, water and a bathroom. He said Hodges couldn't afford day care.
The child was taken into custody by Department of Child and Family Services.
Perry said he and prosecutors are recommending Hodges wear an ankle monitor for about four-months and complete 80-hours of community service. Sentencing is scheduled for December 15.

Dad charged in carbon monoxide death of 6-year-old daughter had court-ordered visitation despite history of child neglect, drug abuse, prison record (Syracuse, New York)
Doing some follow up on recent cases. Remember the case of the Syracuse, New York father charged in the carbon monoxide death of his 6-year-old daughter? The one he left home alone while he was out at the casino? We figured this was a custody/visitation case...and sure enough, subsequent research has shown that it was. COURT-ORDERED visitation no less, in upstate New York, which has been dominated by fathers rights groups for years. We increasingly see the "fruit" of their labors, namely dead kids that were left with unfit fathers.
There was no rational reason for an idiot like GLENN COLLINS to have access. Why don't guys like this get supervised visitation instead of protective mothers? And this sh** has the nerve to intimidate/harass the surviving child into not testifying?

Mother of 6-year-old killed in carbon monoxide poisoning feared for girl's safety

SYRACUSE, N.Y. -- In the four years since Glenn Collins was released from prison, his daughter's mother feared hearing that her 6-year-old Gabriella was hurt in his care.
After the girl's stays with her father, she complained of being bored, unwashed and of his long absences, said Julianne Steinbrecher, the mother.
On Aug. 29, she received the dreaded phone call.
During that visit with his daughter, Collins arrived home to 106 Carlton Drive in Salina from a trip with a woman to Turning Stone casino. He found Gabriella and his 14-year-old son Jaidon Collins unresponsive, authorities said. Gabriella was pronounced dead at Upstate University Hospital from carbon monoxide poisoning caused by a generator.
Steinbrecher was required by court order to allow her daughter to visit Glenn Collins.
"She would kick and scream and cry, 'Mommy, I don't want to go.' Being a mother it obviously broke my heart but I had to follow what a court order said."
The July court order included specific conditions, many of which were broken the day of Gabriella's death.
The court order requires a parent or adult over the age of 18 to watch the girl at all times. Specifically, the parents agreed that either the father or one of his parents would supervise. But police say Gabriella was left with her half-brother Jaidon, which is explicitly prohibited by the court order.
The court order also requires that Gabriella make regular phone calls to check in with her mother. Steinbrecher expected a call that night, but never received one, typical of visits with Collins, she said.
Under the court order, Collins was required to notify Steinbrecher of any event that would affect the child's health. Power had been cut to the house on Aug. 13. Collins had since placed a generator inside the house, authorities have said. Gabriella had told her mother about a power outage at the house when she returned from her last visit. She told Steinbrecher that she had stayed with Collins' parents. Steinbrecher had no knowledge of a generator being used at the house.
Finally, the court order required each parent to send each other copies of a driving record within a specified time period. When Steinbrecher did not receive Collins', she filed a petition with the court asking to take away Collins' visitation rights until he could prove he had a valid drivers' license. The petition was not processed by the court by the time Gabriella had died.
The court awarded Steinbrecher $8.04 a month, she said. Steinbrecher said she hasn't received a payment since November 2013. Collins has missed several hearings on child support, she said.
The relationship between Steinbrecher and Collins has been difficult since the night of Feb. 10, 2010, when police raided the couple's home for drugs, court papers show. Gabriella was two years old at the time. Police found 800 doses of drugs in a safe, according to the court papers issued by Onondaga County Family Court. Steinbrecher said she did not have access to the safe or know they were there.
A month later, out on bail, Collins was again charged with a drug offense when he was stopped with heroin in New York City, the court papers say. According to the records, Collins pleaded guilty to both charges.
He was admitted to prison in July 2010, and was released in April 2011 on parole.
Surrounded by their parents and other family members, Steinbrecher and her boyfriend Seamus Quinn spoke to Syracuse.com about the loss of the 6-year-old girl. They waited until Thursday, when charges were announced, to avoid interfering with an investigation into the incident.
Steinbrecher said she didn't blame the court, 14-year-old Jaidon or herself. She placed the blame solely on Glenn Collins.
His whereabouts in the hours before the girl's death infuriate her, she said.
"It disgusts me. You have money to go to the casino but you can't pay your NiMo bill, your child support? It doesn't surprise me. Nothing surprises me anymore with his actions."
Days after Gabriella died, the couple published an obituary which left Glenn Collins completely out. The girl's name was listed as Gabriella Antoinette Steinbrecher-Quinn. Collins, they said, didn't have a right to her name or condolences.
"I am her father," Quinn said. "If you asked him what her favorite color was, he wouldn't be able to tell you. If you asked him who her kindergarten teacher was, he wouldn't be able to tell you. I was there on the first day of school. I helped her tie her shoes for the first time. We did so much family stuff together, the three of us."
Quinn, Steinbrecher and the 6-year-old girl lived happily in their Syracuse home for four years, the couple said. They said the girl called Quinn "Dad" and Collins "Glenn."
Before the funeral, Collins texted Steinbrecher, the only communication the two have had since the girl's death. This text message is the only communication Julianne Steinbrecher has received from her 6-year-old daughter's father Glenn Collins since the girl died at his house.
Collins was not invited to the funeral or calling hours.
"I want that memory in his head of what he found that morning - you have to live with that memory," Steinbrecher said. "You're not going to see her at peace in that casket. You live with that memory of you finding her dead. I want that etched in his brain."
Steinbrecher said the charges against Collins (second-degree manslaughter, theft of services and criminal impersonation and harassment) give her some comfort.
"I feel some sort of comfort, I'm angry, and my grieving process starts now after all of this," she said. "This is what I've been waiting for, some kind of justice for her in all this."
Steinbrecher and Quinn said life hasn't been anywhere near the same since their daughter with the great big smile and even bigger personality died.
They described her as loving to sing and dance, as well as spending time outdoors at the family's camp. She learned to love school and had tons of friends who she loved to share her toys with. SpongeBob SquarePants was her favorite cartoon character.
Steinbrecher vowed to be at every one of Collins' court appearances until the day she would be given the opportunity to speak.
"It won't be nice," she said. "He took the best part of me. He took my whole life. It's changed. It's like the day before I was a mother."

Dad leaves toddlers alone in car while he gambles at casino; did this happen during Dad's custody time? (Scottsdale, Arizona)
So we're told that Daddy was with his "girlfriend." We're not told she was the mother of these children, which makes me suspect she wasn't. So was this a custody/visitation situation? We're not told.
Meanwhile, notice that CPS has taken custody of the kids. So if there is a mother somewhere else, she is being punished for Daddy's irresponsibility. Unfortunately, this happens a lot.

SCOTTSDALE, Ariz. — A Mesa dad faces child abuse charges after he allegedly left his two children in a parked car while he was at a Scottsdale casino early Wednesday morning.
The children, ages 2 and 3, were found in the vehicle on the upper level of Talking Stick Resort’s parking garage at 9800 E. Indian Bend Rd. by security officers with the casino’s bike patrol, a court document stated.

Non-custodial mom angry that CPS managers found not at fault in neglect death of 8-year-old daughter in home of abusive custodial dad, step (San Antonio, Texas)
Disgusting. CPS demonstrates it usual incompetence by not doing its job at all, not contacting anybody who made abuse complaints. They failed to visit the home. They failed to do anything basically.

CPS caseworkers at fault in child's death — but not managers

SAN ANTONIO — The state Office of the Inspector General found that four Child Protective Services workers failed to follow state policy in the case of Sarah Brasse, an 8-year-old girl who, while under the watch of CPS, died of untreated appendicitis in 2009.
In a report released Thursday, the OIG doesn't recommend any disciplinary action, though it found a family-services specialist, a kinship specialist and two investigators neglected to perform even basic requirements of their jobs, such as making timely visits to ensure Sarah and her brothers were all right, or following up on reports that they possibly were being abused or neglected.
Sarah's father and stepmother were investigated by CPS multiple times for abuse and neglect in the two years prior to her death.
The OIG said there was no evidence to show two high-up program directors didn't comply with policy in their handling of the family referral and documentation process.
Allegations that these managers might have illegally altered state documents were not substantiated, the report states.
“There was no evidence to indicate that any policy violations were to blame for the appendicitis, which is listed as the cause of death,” the report notes.
Jo-Anne Guerrero, Sarah's biological mother who did not have primary custody, said she read the report “with a heavy heart.”
“Why are (managers) being let off the hook?” she asked. “Yes, they are holding some staff accountable, but as usual, it's just the front-line workers. It was managers who held the power to make the truly important decisions in my daughter's case, and they didn't do the right thing. This just seems like CPS sugar-coating things.”
A spokesman for CPS' parent agency stated Thursday that no disciplinary action is expected and the case is closed.
An investigation in 2013 by the San Antonio Express-News found that in the 48 hours before Sarah died, a school counselor, a school nurse and a Schertz police officer alerted CPS about their fears that she was being neglected.
CPS manager Diane Jones declined to open a new investigation or even send a caseworker to check on the ailing Sarah, despite the fact the agency's staffers repeatedly had recorded her father's failure to seek adequate medical care for her.
The OIG report states that Jones followed policy.
CPS failures
In finding that several caseworkers disregarded policies, the OIG report states:
The family-services worker admitted in interviews that she didn't provide a timely service plan in her casework involving Sarah. She didn't alert Sarah's biological mother about an investigation involving alleged medical neglect of her daughter and her two sons.
She also failed to see if the family was accessing required services and didn't conduct visual contact with the children in the months prior to Sarah's death. And she didn't conduct a home assessment that would have “made her aware of provisions for the children and the condition in which they lived.”
The report notes the above failures were “corroborated” by a review of CPS' computerized record system, or IMPACT.
To Penny Williams, a former family-based services caseworker who worked with Sarah's family the year before she died, that statement reveals supervisors and upper management “knew what was going on.”
“Supervisors can see all documentation in IMPACT,” she said. “They had to know nothing was getting done in this case, that the children weren't being seen, and they are ultimately responsible. And it goes higher up: Once a month, supervisors have monthly meetings with program directors and program administrators, and they have to share all this information.”
Other lapses in policy, according to the OIG report:
A CPS investigator failed to contact staff at KidShare Family Services, where the Brasse children had supervised visits with their mother. Staff at KidShare made reports to CPS that the children were being neglected and possibly sexually abused, but the investigator never called back.
* A second CPS investigator also didn't notify JoAnne that her ex-husband David Brasse and his then-fiance Samantha Britain were being investigated by CPS regarding their care of the children.
* A kinship worker didn't contact a physician at Laurel Ridge Hospital, who had reported to CPS that one of Sarah's brothers appeared malnourished. He also failed to respond to an outcry the children made that “they were always hungry and not fed.”
* Staff at Watts Elementary School, where Sarah was in second grade, told OIG investigators they were not informed of an open CPS case involving the Brasse children and were not contacted by any caseworkers over their reported concerns that the children were not being care for adequately.
When EMS arrived at the Brasse home the night of Feb. 5, 2009, Sarah's body already was stiff with rigor mortis, her jaw clenched shut. The house was filthy. Police noted vomit throughout the place — on the stairs, a bathroom sink, on Sarah's bedding and her body.
David Brasse and Britain originally were found guilty of manslaughter and injury to a child, but those verdicts were overturned on appeal, with judges citing insufficient evidence. The state continued to pursue Britain, who was at home most of the day Sarah died, but she ultimately was exonerated.
The OIG report has been referred to Cynthia O'Keefe, general counsel of the Texas Department of Family and Protective Services, the document says.
'Matter closed'
When asked if any actions were planned in response to the report, Patrick Crimmins, spokesman for the Texas Department of Family and Protective Services, replied in an email: “The report was very thorough and we appreciate the input of OIG. This case has been extensively reviewed, and DFPS considers the matter closed.”
Crimmins confirmed that three of the four employees whose policy failures were cited in the report still are employed by the department, but that no disciplinary actions were planned.
Guerrero said the report's noting that CPS' actions didn't cause her daughter's appendicitis is “ridiculous.”
“Of course, they didn't give her appendicitis, but their inaction led to her death,” she said. “If they had acted on stuff that was brought to their attention, they would have recognized she needed help. I kept telling CPS all those years there were problems in that home. I kept saying to them, 'What are you waiting for?'”
Like DFPS and CPS, the Inspector General's office is under the umbrella of the Texas Health and Human Services Commission.
After being given a copy of the report, a former CPS caseworker who's familiar with the case but asked to remain anonymous because she still fears retribution, responded: “I had serious concerns about an HHSC agency investigating another HHSC agency. It seems my concerns were justified.”
The Sunset Advisory Commission, which regularly evaluates state agencies, recently issue a critical report of the OIG, stating the division uses “inefficient and ineffective processes” and is hobbled by communication, a lack of transparency and limited staff training.
Sen. Carlos Uresti, D-San Antonio, who asked the OIG to investigate CPS' handling of Sarah's case after the Express-News reported seven months ago about the missing KidShare referrals, said at two pages long, the report is “not as in depth as I would have hoped for given the complexity of the case. ...”
“Sarah's death is neither excusable, nor will it be forgotten. ... .”

On Sunday, Michael Goubeaux, the father of the 4-year-old girl whose mother fled with her to Las Vegas during a custody battle, was charged with child neglect by the Troy Police Department.
Goubeaux, 53, was charged with one count of child neglect, after Troy Police were called to his home after neighbors found the 4-year-old girl unattended near the street around 3:30 p.m. Sunday. The 4-year-old girl was found to be OK at the scene.
The girl was the center of a two-month national search last winter. The mother of the girl, Eva Villmor-Goubeaux, 38, of Dayton, was charged with interference of custody. She was found in Las Vegas last February by U.S. Marshals and extradited to Miami County with the child.
According to the report, the neighbors said their children went to the Goubeaux’s house and found no one home and the doors locked.
The 4-year-old girl told the neighbors that her father went to the gas station while she played in the backyard with another neighborhood child. The girl said the boy left and she tried to go inside the house, but the doors were locked.
The neighbors tried to get a hold of Goubeaux who returned home nearly 20 minutes after the child was found alone. Goubeaux admitted to police he went to the gas station and had left his daughter with the neighborhood boy who was around 7 years old. The parents of the boy claimed there was no prior agreement for them to watch the children that day. The parents also said they were not aware that Goubeaux had left the children to go to the gas station.
Goubeaux denied the doors were locked to his home. Goubeaux was issued a summons for child neglect.
Looks like Mom had her reasons. Unfortunately the clueless control freak daddy now has custody.

Jason Anthony Walker of St. Petersburg faces one charge of child neglect. The incident occurred on or around July 3 and the 5-month-old boy died on July 5 at a local hospital, according to the Pinellas County Sheriff's Office.
Investigators found that Walker was caring for the boy on July 3 when he left the child in his cradle twice for an extended period of time, while ran errands, the sheriff's office said. When Walker returned home, the boy was unresponsive and lying face down on a blanket.
An autopsy found that the boy died of asphyxiation.
Walker is being held in the the Pinellas County Jail.

Mom is LEGALLY required to personally administer a breath analyzer test whenever the stupid, useless drunkard of a father has "custody." The responsibility is heaped all on her to make sure this turd is legally sober and presumably capable of caring for a 3-year-old boy, an age where they can be quite a handful. So is Mom to blame is this idiot gets sh**faced? Or she interpreted the test wrong?

According to an arrest report, the incident took place shortly after 10 p.m. on Wednesday, outside a home on Deerfield Lane, near the corner of Rudy Lane and N. Hubbards Lane.
Police say a person who lived in the area was outside when he heard a 3-year-old boy say "hello." The boy was allegedly walking around alone in the front yard of his home.
Neighbors went to the boy's home and knocked on the door and honked a car horn in an effort to alert anyone who might be responsible for the child's care that the child had gotten out of the house. According to the arrest report, the front door was already open, and after several minutes of trying to reach someone in the home from the outside, neighbors decided to go inside.
Police say they found 50-year-old Andrew D. Wozniak -- the boy's father -- passed out in the home. They allegedly tried to wake him several times by shaking him and hitting him, but could not rouse Wozniak, so they decided to call police.
By the time the officer arrived, Wozniak was still unconscious and had been so for roughly one hour and 45 minutes, with no knowledge that his son had gotten out of the house. When the officer finally woke Wozniak, police say he didn't know what day it was and told the officer that his son was in his bed in the next room.
"He was not," police said.
Police say the boy's mother is legally required to give Wozniak a portable breathalyzer test when he has custody of the boy. According to the arrest report, he blew a .18 for her and a .290 at the jail.
Wozniak was arrested and charged with second degree wanton endangerment.

A father is facing charges of child abuse after his three-year-old son was found wandering the streets in the early hours of the morning.
The little boy was only found in Longmont, Colarado when he turned up on the doorstep of a house ten blocks away and was spotted by 12-year-old Rocklynn Moldonado.
The police were called and started to track down his parents, but it is alleged when officers knocked on the door of his father, Angelo Fernandez, he refused to answer and wouldn't go and collect the boy.
It is thought the toddler had wandered off from his home around 2.30 am on Friday morning and walked ten blocks by himself, wearing no shirt or shoes, just a pair of shorts.
It wasn't until Miss Moldonado heard a jiggling noise at the front door that she went to investigate and heard a voice at the other side.
She then found the boy, who was asking where his father was and crying.
It then took Longmont Police several hours to identify the boy and in turn track down his father Mr Fernandez.
After he allegedly refused to answer the door or collect his son, he eventually went to the police station.
But Mr Fernandez refutes the police's version of events saying he was the one that called them to report his son missing.
He told 7News Denver: 'I woke up and found my son had unlocked the door and left in the middle of the night while we were sleeping.
'I took off, running around looking for him.'
Mr Fernandez has now been arrested for child abuse and the little boy has been placed in foster care.

A father is facing charges of child abuse after his three-year-old son was found wandering the streets in the early hours of the morning.

The sentencing hearing for a Winnipeg man who abducted his two children and hid them in Mexico for four years may have a much larger audience when it concludes next month.
Kevin Maryk will return to court on Aug. 22 to learn his fate after pleading guilty to one of the province's most notorious missing-persons case.
An application has been made for a live broadcast of the proceedings under a new judicial pilot project. If granted by the judge, the resolution can be seen by anyone with computer access.
Crown and defence lawyers spent a full day making submissions last month, but adjourned the case after being unable to agree on certain factual points.
The Crown is expected to call a further witness to testify before provincial court Judge Ted Lismer gives his decision.
The Crown is seeking a five-year prison sentence, which is half the 10-year maximum for abduction. Maryk is asking for 25 months of time served in custody and an immediate return to the community.
Dominic Maryk, 13, and Abby Maryk, 11, vanished while on a court-authorized visitation with their father in August 2008.
They weren't located until May 2012 in Guadalajara.
The children were kept in what the Crown has called "deplorable" conditions, which included having no access to schools, medical care or even friends.

Police said the children were staying with their 34-year-old father at the Arbor Lofts, which are near Evergreen Road and Civic Center Drive, but he was found slumped over the wheel of his car just after 7 a.m. in a nearby TGI Friday’s parking lot.
Police said it appears the children had been alone since 3 a.m.
The father was arrested on charges of operating a vehicle under the influence of narcotics and child neglect.

A 24-year-old man was arrested Saturday on suspicion of child abuse and neglect after three children left home alone escaped a fire.
Jesse Townsend III was being held on $50,000 bond.
Three children, ages 2, 5 and 6, were home alone Friday at about 4:20 p.m. at 2305 Pendleton Street when a fire began. Two employees of Ram property services who were working at property knocked on the door and the children were able to escape uninjured, according to the Memphis Fire Department.
Approximately 40 fire responders brought the fire under control by 4:32 p.m., said Memphis Fire Lt. Wayne Cooke. Three units were damaged by smoke, fire or water with an estimated damage cost of $30,000.
“The origin and cause of the fire was determined to be the result of children playing with a cigarette lighter in the bedroom,” Cooke said in a news release.
The suspect is the father of the 2-year-old boy left home alone and there was no working smoke detector at the residence. The fire department urges citizens to have a working smoke detector, which can be obtained for free by contacting 901-636-5650.
