10-week-old infant abused "while in the care, custody and control of the father" (Mount Pleasant, Texas)

I'm not even sure what that phrase means--"while in the care, custody and control of the father." Does that mean that dad CHRISTOPHER MICHAEL AMERSON had sole legal custody of this infant, who was scarcely more than a newborn? If so, how did he get custody and who gave it to him?

Notice there isn't one word about a mother in this home.
