Dad found guilty of 2nd-degree murder in shaking death of 6-week-old daughter (Menomonee Falls, Wisconsin)

Dad ALEX A. LEBOY has been found guilty of 2nd-degree homicide in the shaking death of his 6-week-old daughter. As is usually the case in shaking deaths, the baby died of brain injuries, but also had eight rib fractures. The usual scenario: the baby was crying, dad got angry.

Father found guilty in shaking death of infant daughter

Waukesha — A jury on Friday morning found a 27-year-old Menomonee Falls man guilty of second-degree reckless homicide in the shaking death of his infant daughter in 2007.

The verdict came in Waukesha County Circuit Court after a nearly two-week trial for Alex A. Laboy.

He was accused of fatally injuring his 6-week-old daughter, Autumn, by shaking her in anger while caring for her on Oct. 27, 2007.

According to the criminal complaint, Laboy summoned emergency personnel to the apartment on Fond du Lac Ave. that he shared with the baby and her mother at 10:30 p.m. He told police that the baby was lifeless when he went into a bedroom to check on her.

The child was taken to Community Memorial Hospital in Menomonee Falls and later to Children's Hospital of Wisconsin in Wauwatosa, where it was determined she had no brain activity and was incapable of breathing on her own.

Three days later, Autumn was pronounced dead at Children's Hospital. Medical personnel determined that she had suffered eight rib fractures, and an autopsy revealed that she suffered brain injuries, the complaint says.

Laboy later admitted during an interview with police that he shook his daughter when she was crying, the complaint says.

Judge J. Mac Davis is scheduled to sentence Laboy on Sept. 18.
