True to the Dastardly Dads axiom, a killer dad's custody status will be "forgotten" by the time he goes to trial. See past posts here.


Here's a quote from a July 2015 article: "A man who told police he put bags of garbage in his young daughter’s room to mask the smell of her decomposing body was granted sole custody of the toddler during a divorce last year."

MEDINA, Ohio (WKRC) - A trial is set to start Monday for the father of a 21-month-old Ohio girl whose decomposed body was found in a crib.
Eric Warfel is charged with abuse of a corpse and evidence tampering.
His daughter Ember's body was discovered by a cable worker last July in a Medina apartment.
Warfel had another daughter who died three years ago and it was ruled a "sudden unexplained infant death."

Dad pleads no contest to murder of 3-year-old son; despite previous allegations of child abuse, dad still praised as "kind" and "loving" (Las Vegas, Nevada)

If there was a mother with a long history of child abuse allegations involving multiple fractures and unexplained SIDS death WHO then pleaded no contest to the murder of yet another child after apparently lying about the assault, she would be condemned as an evil monster not fit to live. But given the complete double standard, this POS is praised as "kind" and "loving." Kind and loving how? If this is how a "special person" behaves, I'll stick to non-special people, thanks.

And just why does this guy deserve mercy after all this?

Despite mother’s plea, man sent to prison in death of son

Jonathan Quisano, the 27-year-old father who pleaded no contest on murder charges in the death of his toddler son was sentenced to 10 to 30 years on Tuesday, October 7, 2014.

A 27-year-old Las Vegas father was sentenced to between 10 and 30 years in prison Tuesday in the death of his toddler son, despite a plea from the boy’s mother to keep her husband out of prison.

Jonathan Quisano, who moved to the valley from Hawaii shortly before his son died, pleaded guilty in June to voluntary manslaughter and child abuse neglect or endangerment with substantial bodily harm.

Quisano faced murder charges in June 2013 after his 3-year-old son, Khayden Quisano, died at University Medical Center.

Khayden had been hospitalized after his mother called police to say the child had fallen in a northwest Las Vegas home while under Quisano’s care.

The father told police Khayden fell while playing on the back of a sofa, but authorities said the boy suffered head and internal injuries too severe to have been caused by a fall.

Chief Deputy District Attorney Michael Staudaher said Khayden suffered “very violent” and “very significant” injuries.

At a sentencing hearing Tuesday, Quisano’s wife, Christina Rodrigues, called him a “kind, loving, caring, responsible father.”

She asked District Judge Valerie Adair to offer Quisano a chance at probation, saying she never witnessed Quisano abuse the boy.

“I not only lost one, but two very special people who I love dearly,” Rodrigues said. “Just don’t take him away forever.”

Staudaher said the death wasn’t the first time Quisano had been suspected of abusing Khayden. In 2010, while the family lived in Hawaii, doctors became concerned after noticing fractures on Khayden’s ribs and legs, Staudaher said.

Social workers in Hawaii kept track of Quisano for two years before the family moved to Las Vegas, Staudaher told the judge.

About two years before that, another of Quisano’s children suffered from sudden infant death syndrome at 3 months old, according to the prosecutor.

Deputy Public Defender Nancy Lemcke also argued for probation. A coroner had ruled the manner of Khayden’s death undetermined, she said.

“Not for one single secondary moment did he intend to hurt or certainly kill his own child,” Lemcke said. “If you believe that he inflicted these injuries, it’s an issue of succumbing to a single momentary lapse of patience. … Certainly if nothing else, everybody here agrees that what happened was not some preconceived plan on the part of Mr. Quisano, it wasn’t part of some systemic ongoing torture or abuse.”

Quisano told the judge he was “sorry” and would “do anything possible to get my life back on track.”

In handing down the sentence, Adair pointed to the allegations of previous abuse.

That investigation “if nothing else, put this defendant on notice as to what he should do,” Adair said. “If anything, he should have been more careful with this child than he was.”

The judge gave Quisano credit for 488 days served in the Clark County Detention Center, meaning he would first be eligible for parole in less than nine years.

Judge orders probation in co-sleeping death

A Kenosha father convicted for falling asleep with his 5-month-old son while drunk and unintentionally smothering him will serve probation.

No jail time was ordered as a condition of Gary J. Sauceda’s probation, which will last four years, Kenosha County Circuit Judge Mary Wagner ordered Tuesday. He faced up to 15 years in prison.

After a hung jury in 2011, Sauceda was convicted in February of child neglect leading to his son Joey’s death in January 2010. Sauceda said he fell asleep with 5-month-old Joey on his chest and later woke up on top of the boy.

Blood tests showed Sauceda had an estimated blood alcohol level of 0.17 percent nearly two hours after Joey was found dead. Prosecutor Robert Zapf argued that level would have been much higher when Sauceda took the chance of lying down with the boy.

Defense attorney John A. Ward said evidence showed Joey’s death was due to Sudden Infant Death Syndrome and Sauceda was not at fault. Sauceda also denied responsibility for Joey’s death, despite telling police in the moments after Joey was found lifeless that the situation was his fault.

Maintaining the family


During sentencing Tuesday afternoon, Sauceda, 37, had little to say, other than to clarify an issue related to a pill he swallowed shortly after police arrived at his home in the 4600 block of Eighth Avenue.

But Joey’s mother, Gina Barker, begged Wagner to consider what a good father Sauceda has been to his 11-year-old before and since Joey’s death and what sending Sauceda to jail or prison might do to their family.

“If you split this family, it’s not only going to tear me apart, it’s going to tear my little girl apart and his boy,” Barker said as she began to cry. “It’s brought us together. If you take that away, where’s it going to go? It’s going to go right back down the drain.”

Wagner credited Sauceda for apparently improving his lifestyle and staying sober since his son’s death. She also considered recommendations from Zapf and the Department of Corrections that probation was an appropriate sentence.

High legal bills


Ward argued that a $100 fine would be most appropriate, given the tens of thousands of dollars Sauceda will be forced to pay not only for his legal defense, but also his prosecution; under state law, defendants can be ordered to pay prosecution costs if they are convicted — for Sauceda, that means another $6,375, plus monthly supervision fees, a $250 fee to collect a DNA sample because he is now a felon, plus an estimated $15,000 in defense expert costs, not to mention attorney fees.

“That, along with the loss of his child, is more than anyone should have to bear,” Ward said.

Ward also argued that the state Department of Corrections, which will oversee Sauceda’s probation, would “destroy” Sauceda’s family. Under the “cookie cutter” rules typically applied in neglect cases, Ward feared that Sauceda would be ordered to have no contact with his 11-year-old son — another argument toward not ordering probation.

Wagner rejected that argument, partly because the DOC reported to the court that Sauceda was a “good and responsible parent,” particularly since Joey’s death.

Wagner also ordered probation because she felt Sauceda had to somehow be held accountable for the bad choices that led to Joey’s death.

“I hope many people learn from this,” Wagner said.

Father charged with Capital Murder returned to Central Texas

CORYELL COUNTY - A man arrested in Washington in August and charged with Capital Murder for allegedly sexually assaulting his infant daughter to death has been returned to Central Texas.

In January 2005, 5-month-old Jade Allsop was found dead by her father, Joseph Allsop.

It was initially believed that the child died from "Sudden Infant Death Syndrome," but after an autopsy, the findings were "undetermined" for the cause and manner of death.

According to the arrest affidavit, Allsop restricted the infant's air way while he sexually assaulted her.

During an interview by Special Agents of the Army's Criminal Investigations Division at Joint Base Lewis-McChord in Washington where Allsop was stationed, he reportedly confessed to sexually assaulting "numerous young children," one of them being his now deceased daughter.

Allsop was extradited and booked into the Coryell County Jail on Saturday.

Massillon dad charged with injuring infant girl

MASSILLON — Police arrested a Massillon man accused of seriously injuring his 2-month-old daughter, according to detective Bobby Grizzard.

Christopher Garza, 20, of 217 Chestnut Ave. NE, was charged with felonious assault, a second-degree felony; two counts of endangering children, a third-degree felony; and one count of domestic violence, a first-degree misdemeanor, according to Massillon Municipal Court records. He was arrested Monday.

Garza admitted to causing multiple fractures to Hazel Garza, court records show.

“He made some admissions but we did not believe that it told us an accurate picture of what took place,” Grizzard said.

Grizzard said police built their case with some of the “limited information” supplied by Garza, as well as medical evidence submitted from Akron Children’s Hospital.

The infant suffered fractures to her feet, legs and ribs, and bruises to the left side of her face and back, according to court records. The child underwent surgery at Akron Children’s Hospital last week. On Monday, a night nursing supervisor said Garza was not listed as a patient.

The Stark County Department of Job and Family Services was awarded emergency temporary custody of the child at a hearing last Friday.

A complaint filed last week in Family Court indicated the infant underwent surgery for the injuries to her extremities and additional operations could be needed. Doctors believe the injuries occurred over a period of time, noting some fractures were in “various stages of healing.”

Grizzard said the abuse occurred more than a week before the child was taken to the hospital.

The child was admitted to the hospital June 23 after Garza and his live-in girlfriend scheduled an appointment with her pediatrician for treatment of an ongoing fever. The doctor advised the parents to take the infant to the hospital.

According to court records, Garza and the child’s mother had another child who died of SIDS while the couple lived in Florida. The father reportedly was investigated by Florida officials following the child’s death. The family relocated to Ohio two months ago.
