Typical example of the way the media erases father custody/visitation "rights" from a child abuse story. Clearly the "girlfriend" is not the mother, or she would have been identified as the mother. Ergo, the mother is elsewhere. So it is obvious that this violent, video-addicted POS had some sort of child access--whether it was court-ordered or not is not specified. But that is also typical. Mustn't let the public know that the family courts either ordered this child into Daddy's "care" and/or pressured the mother into being "cooperative" and providing access "voluntarily."

Man charged with suffocating son against couch

ENGLEWOOD, Fla. (AP) — Authorities say a 6-year-old Florida boy is dead after his father pinned him against a couch while the man and his girlfriend played video games Christmas Eve.
Local media outlets report that 31-year-old James Dearman was charged Thursday with aggravated manslaughter of a child.
A Sarasota County Sheriff's Office report says Dearman and his live-in girlfriend told the victim and his 7-year-old brother to go to bed but the boys continue to run around. Dearman's girlfriend told deputies that the father eventually became angry and used his full body weight to pin his younger son to the couch.
The report says the couple eventually realized the child wasn't breathing, so Dearman called 911 and began performing CPR. The boy was later pronounced dead at Englewood Hospital.
Dearman was being held on $1 million bail.
Jail records didn't list an attorney.

BALTIMORE —A 23-year-old Baltimore man has been charged in the death of his 5-month-old daughter, city police said.
Police said officers responded at 5 p.m. Saturday to a home in the 6400 block of Sefton Avenue for a report of an unresponsive infant. The 5-month-old child was taken to Johns Hopkins Hospital for treatment.
Police said medical staff discovered that the infant had passed the stage of rigor mortis, and 5-month-old Noran Lee Torbet was pronounced dead shortly after arriving at the hospital.
Family members of the child were questioned and detectives centered on the child's father, identified as Jeffery McKinney, as a person of interest.
Police said McKinney confessed that he became frustrated when the infant would not stop crying. He placed a pillow on top of the baby to muffle the sound of her cries, police said.
"This was no accident. This was absolutely no accident. The suspect confessed to us there were several pillows placed over top of the baby's body to get it from crying," Baltimore police Director T.J. Smith said.
After realizing that his daughter was unresponsive, police said, McKinney put the baby on the edge of the mattress against the bedroom wall and piled pillows on top of her.
Police said McKinney went downstairs and asked family members if they had seen the infant. Once they found the child, the infant’s grandmother immediately began CPR while waiting for the ambulance to arrive.
"You talk about an absolute tragedy. This is not an exciting announcement that a murderer is off the street, it's a 5-month-old who's dead as a result. There's a mother who doesn't have the child, there's a grandmother who doesn't have her granddaughter any longer as a result of these actions," Smith said.
Neighbors said the family kept to themselves. They said Sefton Avenue is a street with many young families.
"I couldn't imagine that happening to my daughter. A child's innocent, really. Can't do too much to people. It's sad when anybody gets harmed, but what could a child do to you to kill them?" said Neil Armstrong, who has a 9-month-old daughter.
A neighbor who did not want to be identified said she saw McKinney last week with his baby daughter.
"The baby was crying in the stroller down here, but when he walked back here, he talked to my husband and I. We were out with our dogs, he was holding the baby and loving the baby and said his girlfriend was in Virginia," the neighbor said.
McKinney was arrested and charged with second-degree murder, assault and child abuse.

The body of 3-month-old Janna Rivera still is missing three months after the Indianapolis child’s disappearance triggered searches through three counties and various explanations from the girl’s father.
But the person accused of killing Janna has now been charged. Jeffrey D. Fairbanks, the father whose accounts, according to court records, changed from not remembering much of May 28 to saying he picked up a lifeless body to admitting to putting a pillow on his crying daughter’s head, was charged Friday in Marion Superior Court with murder and neglect of a dependent resulting in death.
Her body has not been found.
"We are alleging that she is dead and he knowingly killed her," Marion County Deputy Prosecutor Denise Robinson said.
When asked why it took three months for charges to be filed, Robinson said prosecutors needed time to assess all the statements and evidence.
The absence of an autopsy report could pose a challenge for prosecutors in proving what caused the infant's death.
"There's a considerable amount of things we need to prove," Robinson said.
Police said they were called May 29 to a Northeastside home in the 4100 block of Candy Apple Boulevard after the infant’s mother, Yolanda Rivera-Gonzalez, called 911 to report her baby’s disappearance.
Police interviewed Fairbanks, who told detectives various stories.
He first said he couldn't remember anything about May 28.
Then, according to a probable cause affidavit, he said, "I don't wanna go to jail."
Ultimately, he told police, "let's go," signaling to them he would show them where he left the baby, the affidavit said.
The next day Fairbanks, 45, took police to a dumpster at Maison Garden Apartments on the Northeastside.
"I picked her up, and she wasn't movin' anymore," the affidavit said Fairbanks told police.
The dumpster, though, was nearly empty, the affidavit said, leading to a search of a landfill on the Southside.
Back at a police station, detectives questioned Fairbanks again.
He told police he woke up at 5:30 a.m. that day because the child was crying. He said he "muffled" her with a pillow but denied putting pressure on the pillow, the affidavit said.
Fairbanks said later that morning he noticed the baby wasn't moving and took her to the dumpster, the affidavit said.
He told his wife he buried the child in a cornfield and placed a cross at the burial site, the affidavit said.
One of the children in the home told police Fairbanks would sometimes cover the baby with a pillow when she cried.
Over the next few months investigators chased leads throughout Shelby, Hancock and Marion counties, searching fields, landfills and other undisclosed locations to no avail.
The mother of Janna said her relationship with Fairbanks had turned violent about two years ago, according to a personal protection order she filed in June. Rivera-Gonzalez alleges that Fairbanks would beat her at least once a month, leaving her scarred, bruised and afraid that she and her children were not safe when he was around.
Rivera-Gonzalez also alleges in the personal protection order that Fairbanks admitted to burying their daughter while she was at work.
He said that Janna died while he was watching her and Rivera-Gonzalez's two older children, according to the order.
The order is one of two active protection orders filed against Fairbanks.
The other, filed in June 2013, is associated with a charge of domestic battery that Fairbanks is facing in Hendricks County. Fairbanks is being held without bond in the Marion County Jail.
Judge Sheila Carlisle entered a not-guilty plea on his behalf.
A public defender has been assigned to his case.

ALLEGAN COUNTY, Mich. — An Allegan Township man has entered a plea of no contest to two charges in connection with the death of his 3-month-old son.
Jonathan Colby, 22, pleaded no contest Monday morning to first-degree child abuse and manslaughter, according to Allegan County Prosecutor Fred Anderson. He faces up to life in prison for the child abuse charge and a maximum of 15 years for manslaughter.
He is set to be sentenced in late July.
Colby was arrested Dec. 3, 2014 after his infant son Jase Colby was found unresponsive in his crib by the baby’s mother. The couple lived on Starlite Drive in Allegan Township.
At the time of the initial investigation, officials say Colby admitted to striking Baby Jase in the head twice because he wouldn’t stop crying.
Autopsy results showed that Baby Jase had a cracked skull and other injuries consistent with strangulation and suffocation.

A father accused of killing his baby boy by suffocation after forcing a pacifier in his mouth, has pleaded not guilty.
Danny Adams, 24, of Lewiston is charged with depraved indifference murder and manslaughter in the death of his infant son following his death in December.
He denied the charges Justice MaryGay Kennedy read from a grand jury indictment, handed up last week.
Police said Adams forced a pacifier into the mouth of his 14-week-old son, Zade, shortly before he stopped breathing.
They said he told them he was frustrated that his son would not stop crying so put a pacifier in Jade's mouth and forced him to stay on his stomach by pushing on his back.
An autopsy determined the cause of death was asphyxiation.
Hornblower said he expects a bail hearing to be set to determine whether Adams will be held in jail without bail or allowed release prior to his trial.
Assistant Attorney General Matthew Crockett asked that Adams be barred from contacting Zade's mother, Kaitlyn Baker, 18. Kennedy agreed.
Adams has been held without bail since his arrest in early January following the death of his son on December 14.
A murder conviction in Maine carries a sentence of 25 years to life in prison; manslaughter, up to 30 years.
Adams told police in an earlier interview that he had injected heroin the night before at a friend's house, then smoked marijuana with Baker when he got home. He said he had bruised Zade's ears when he squeezed them with his thumb and fingers as he held the head of the baby, who continued to cry, according to court documents.
Adams said he caused bruising on Zade's forehead when he forced a pacifier in the baby's mouth and held it in place with his palm, while supporting his fingers on the baby's forehead.
Doctors also detected a rib fracture during the autopsy. He told police he had become frustrated with Zade's crying about four weeks earlier and had squeezed the baby with force.

Shortly thereafter, the baby was pronounced dead.

The mother lived in North Carolina and after Dad gained custody, she basically lost all contact.

SARASOTA - The trees and Spanish moss block out the afternoon sun, casting shade over this house on a dead-end street east of the interstate. A white horse shakes its mane in a nearby pasture and down the road are manicured, expensive homes and a golf course.
It's been nearly two years since 11-year-old Melissa Stoddard was killed here, suffocating after being tied to a plywood board with duct tape placed over her mouth.
Melissa's death would forever alter the lives of those close to her, but none more than her five half-siblings. They were removed from this home but not before witnessing weeks of abuse and the frantic rescue efforts as first-responders tried to save the girl that night in December 2012.
On Friday, Melissa's case ended as a jury convicted her biological father, Kenneth Stoddard, on a trio of felonies — including aggravated manslaughter — that could send him to prison for up to 65 years.
In June, his partner, Misty Stoddard, was found guilty of first-degree murder and aggravated child abuse. She was sentenced to life in prison without the possibility of parole.
It was Misty Stoddard who placed the tape over Melissa's mouth, the fatal act, prosecutors said. But it was the child's father who failed to protect her, bought the board and knew what was happening in the home.
The mother lived in North Carolina and after Dad gained custody, she basically lost all contact.

Stoddard guilty of manslaughter in death of daughter

SARASOTA - The trees and Spanish moss block out the afternoon sun, casting shade over this house on a dead-end street east of the interstate. A white horse shakes its mane in a nearby pasture and down the road are manicured, expensive homes and a golf course.
It's been nearly two years since 11-year-old Melissa Stoddard was killed here, suffocating after being tied to a plywood board with duct tape placed over her mouth.
Melissa's death would forever alter the lives of those close to her, but none more than her five half-siblings. They were removed from this home but not before witnessing weeks of abuse and the frantic rescue efforts as first-responders tried to save the girl that night in December 2012.
On Friday, Melissa's case ended as a jury convicted her biological father, Kenneth Stoddard, on a trio of felonies — including aggravated manslaughter — that could send him to prison for up to 65 years.
In June, his partner, Misty Stoddard, was found guilty of first-degree murder and aggravated child abuse. She was sentenced to life in prison without the possibility of parole.
It was Misty Stoddard who placed the tape over Melissa's mouth, the fatal act, prosecutors said. But it was the child's father who failed to protect her, bought the board and knew what was happening in the home.

Jeremiah Jennings faces charges of endangering the welfare of a child and resisting arrest. They say he was intoxicated. Jenning's is in the county jail on a $250,000 bond.
The coroner says the baby died from accidental suffocation because of an unsafe sleep environment.
Saint Robert police were called to an apartment complex on Carter Street Monday afternoon. Neighbor Torren Moore has lived there for six months. He says nothing has ever happened like what he saw that day.
"It was kind of crazy. I mean, the police are out here and stuff, but to actually see them over here, for something that serious of that nature. Yeah. It was kind of weird," says Moore.
Police are not releasing much information. They say they found the 4-month-old baby boy not breathing upstairs, inside apartment 70Q.
Fire fighters tried to save the baby with CPR, but it was too late. The baby died 40 minutes later at Fort Lenorard Wood hospital.
"For something like this to happen here, you got a lot a heads of turning and a lot of sympathy out for the family," says Moore.

"Stressed" dad pleads guilty to crushing 8-month-old son to death (Anderson, South Carolina)
Poor mom was saddled with a deadbeat loser, and now she has lost custody of her remaining child thanks to Daddy's crimes. This is typical of the way that mothers are punished for the deeds of men. That the mother is not charged with anything that I can tell is irrelevant to the authorities.

Christopher Foster admitted to crushing his 8-month-old son to death in a moment of stress and frustration.
He was sentenced to 15 years after pleading guilty to involuntary manslaughter and child neglect charges Thursday.
Foster told investigators shortly after his son died, on June 8, 2012, that he had been feeding Leon Davis Foster and the child became wedged in a chair. Foster showed little emotion in a pair of interviews right after and two days after his son’s death, Assistant Solicitor Catherine Huey said.
Eight months after Leon died, however, Foster teared up in a follow-up interview.
“He confessed and said the child would not stop crying so he held the child to his chest until the child stopped breathing,” Huey said.
Foster held Leon in a way that the infant could not breathe, she said.
Foster’s wife had gone to get a bouncy chair from her in-law’s home and when she came back, she called 911. Leon was pronounced dead at AnMed Health Medical Center.
A forensic pathologist determined at the time that the death was an accident. The same pathologist, Dr. Brett Woodard, later ruled the death a homicide in light of Foster’s confession.
Huey said both an accident and an intentional act had the same medical signs.
Defense attorney Jennifer Johnson said Foster had several mental issues as well as extensive financial and family problems that contributed to his frustration.
“It was a terrible, horrible thing that he did,” Johnson said. “I know he wishes every day he could take it back.”
Foster enlisted in the Navy after graduating from T.L. Hanna High School and married his high school sweetheart, who soon became diagnosed with bipolar disorder, Johnson said. Foster also had his own mental health issues in the military after having a breakdown due to family and job pressures, she said.
“It was too much too soon,” Johnson said. “He made a choice in what I will call a moment of panic.” Foster and his family were living in a room of a home on Edgefield Drive, with 13 people in the small house belonging to his wife’s parents.
Foster also had bounced from job to job, losing work twice after wrecking cars and being underemployed at other jobs. He was not involved in drugs or alcohol, Johnson said.
Judge Brooks Goldsmith rejected Johnson’s request of a 5-year sentence with probation and he went with the prosecution’s recommendation of a 15-+year sentence.
Foster and his wife have an older child, who has been placed in foster care. Foster was originally charged with homicide by child abuse.
Foster made few signs of emotion during the court hearing and told Goldsmith that the stress and mental health issues got to him.
“It should not have happened,” Foster said. “I should never have ended my (mental health) treatment. I feel guilt and burden for an accident that I can never live down and I think about it every day.”

Custodial dad on trial in torture death of 11-year-old daughter; non-custodial mom testifies (Sarasota, Florida)
We're followed this case for a time. But this is the only time I know of where the mother of the murdered girl has been allowed to speak publicly. According to earlier articles, dad KENNETH STODDARD stripped the mother of custody and moved the girl out of state to Florida. From then these sick pups proceeded to torture the girl until she died. Pulling her out of school was a great way to discourage witnesses, so of course they did that too.

Kenneth Stoddard is facing charges of aggravated manslaughter, tampering with evidence, and aggravated child abuse.
Investigators say Kenneth and his wife, Misty Stoddard, routinely tied up his autistic daughter to a wooden board and duct taped her mouth shut.
Eleven-year-old Melissa Stoddard died months after moving in with them from suffocation. Misty Stoddard was convicted of first-degree murder in June.
On Wednesday, Melissa's biological mother took the stand. While Lisha Stoddard said her daughter was known to have outbursts, she says she was a loving and chatty child while in a controlled environment.
"Her behavior at the peak, she'd run around the house, she'd sing songs. She'd do all her tasks, all her work...at school and at home. She was more like a normal kid," Lisha Stoddard said Wednesday.
Her teacher at Oak Park School, Paul Squeo, said Melissa thrived in the classroom. "She improved greatly.
She started understanding the contingency between work and reward," Squeo said.
But Squeo said Kenneth Stoddard didn't approve of the discipline technique. Melissa was pulled out of school weeks later, and dead by December.
Wednesday, prosecutors worked to prove that Melissa did not self-inflict any of the injuries found on her body.
Kenneth Stoddard is expected to take the stand on Thursday. The trial is expected to continue the rest of the week.

Somehow we missed notice of Dad's sentencing back in April. Another case that obviously involved custody/visitation rights involving a baby. HAVRE, Mont. - A Box Elder woman has been sentenced to just over 13 years in prison for her role in the death of her boyfriend's 11-month-old son.
U.S. District Judge Brian Morris of Great Falls sentenced Cecilia Rose Gardipee on Thursday for the Oct. 21 death of Kaidynce Small.
The boy's father, Garrett "Kirby" Lafromboise, received the same sentence in April.
The Havre Daily News reports Jasmine Small asked Morris to impose a life sentence in her son's death.
Gardipee and Lafromboise both pleaded guilty to assault resulting in serious bodily injury and second-degree murder charges were dismissed.
Lafromboise admitted sticking his finger down his son's throat and hitting him in the stomach. Gardipee said she shook the toddler for 90 seconds after covering his mouth and nose to try to get him to stop crying.

GREAT FALLS — A Rocky Boy man has pleaded guilty to assaulting an 11-month-old boy as part of a plea agreement that would dismiss a second-degree murder charge stemming from the child’s Oct. 21 death on the Rocky Boy’s Indian Reservation.
Garrett “Kirby” LaFromboise, 21, pleaded guilty to assault resulting in serious bodily injury on Tuesday during a hearing before U.S. Magistrate Keith Strong in in Great Falls.
Prosecutors said they would have proved in court that on Oct. 21, LaFromboise became frustrated because the child would not stop crying. Court records say he told investigators he put his fingers in the boy’s mouth and gagged him to try to make him stop crying before punching him in the stomach.
LaFromboise’s public defender Evangelo Arvanetes told the magistrate that he and his client reviewed the plea agreement and found it “more appropriate for his offense than what his co-defendant has done.”
Cecilia Rose Gardipee, 22, pleaded not guilty in December to second-degree murder and assault resulting in serious bodily injury and aiding and abetting on each charge in the boy’s death. Assistant U.S. Attorney Danna Jackson said the boy also suffered skull fractures, bleeding and bruising of the brain, bleeding on the spinal cord and may have been suffocated.

Father who suffocated baby while drunk sentenced to prison

YORK On Dec. 2, when Samuel White was supposed to be watching his “miracle baby” Ja’Leyah who had survived her mother’s leap from a burning building before Ja’Leyah was even born, White got drunk instead.
White left the baby alone for hours at a stretch that December day. He made two trips to the liquor store, knocking back a fifth of E&J gin and a 12-pack of Bud as a chaser.
He bought a cellphone and hung out with his buddies in the parking lot of the Oak Hollow Apartments, as Ja’Leyah cried, alone, in the playpen in the apartment.
He smoked marijuana joints and washed it down with more gin and a couple extra beers as Ja’Leyah’s mother worked the second of two full-time minimum wage jobs to support the family.
Then White finally passed out drunk in the bed with Ja’Leyah right next to him. White then killed her when he rolled over on her.
The “miracle baby”, a name that White called Ja’Leyah after the apartment fire, suffocated.
Ja’Leyah White, born Sept. 2, 2013, was exactly 3 months old.
Thursday in court, White admitted it all and was sentenced to 15 years in prison after pleading guilty to involuntary manslaughter and unlawful child neglect. The sentence handed down by Judge Frank Addy was the maximum allowed under South Carolina law after prosecutors agreed to drop the initial charge of homicide by child abuse. All sides agreed that while White was drunk and high, and had been day in and day out instead of caring for his daughter, he did not intentionally harm Ja’Leyah.
But the result was the same, said Addy, as social services agents had already banned White from being alone with his daughter because of his well-known drunken episodes and penchant for hanging out with his pals instead of watching his tiny daughter.
Prosecutors were “extremely generous” in dropping the homicide charge because of the lack of intent, said Addy, but that didn’t mean that White was any less responsible for Ja’Leyah’s death. White, a two-time convicted felon, could have faced life in prison if convicted of homicide by child abuse.
More, White had signed an agreement with the S.C. Department of Social Services weeks before Ja’Leyah’s death, that stated he would not be alone with the baby because of several reports and complaints from neighbors about White’s constant drinking and leaving Ja’Leyah unattended.
“The first obligation of this state is to protect the people who can’t protect themselves,” Addy told a trembling and sobbing White in court. “I have to try to send a message so that other people do not suffer as your daughter suffered. You weren’t even supposed to be around that child. You posed a clear and imminent danger to that child just by being around her.”
White expressed remorse, saying he is “sorry” and that he will live with the guilt for the rest of his life.
“I would do anything to bring my daughter back,” White said in court. “I wish it could have been me. My daughter had her whole life ahead of her.”
Despite losing her only child, Mandi Coley, Ja’Leyah’s mother, defended White in court and asked for leniency. Coley, who was seven months’ pregnant in July 2013 when she and White had to leap from the second floor of the burning apartment building, had to climb in through the window the night her daughter died because White was so drunk he could not answer the door. Coley had worked 16 straight hours at Bojangles’ and Wal-Mart on Dec. 2 and told police she had to physically beat White to get him off Ja’Leyah that night.
Yet, Coley said in court, White was “an amazing father,” who “would not intentionally hurt his child.”
White’s lawyer, assistant public defender Phil Smith, described White as a “severe alcoholic” who was so wasted on booze and dope the day of Ja’Leyah’s death that White’s memory of the day is hazy. Yet, Smith said, White has “overwhelming grief” and admits responsibility.
A cousin of White’s broke down in court, saying he and others should have intervened before White’s drinking and neglect turned deadly.
Yet prosecutor Willy Thompson described Samuel White’s daily drunken binges as White’s choice, where White chose to leave Ja’Leyah crying in the apartment while White drank and hung out and made trips to the store.
White did not shake Ja’Leyah to death, said Thompson the prosecutor. White did not beat his child. But what White did do was get high and drunk on Dec. 2 with his buddies instead of watching his daughter.
White’s constant neglect was “a loaded gun waiting to go off,” Thompson said.
The gun finally went off Dec. 2. The bullet was the gin and pot, the beer and the disdain.

YORK On Dec. 2, when Samuel White was supposed to be watching his “miracle baby” Ja’Leyah who had survived her mother’s leap from a burning building before Ja’Leyah was even born, White got drunk instead.
White left the baby alone for hours at a stretch that December day. He made two trips to the liquor store, knocking back a fifth of E&J gin and a 12-pack of Bud as a chaser.
He bought a cellphone and hung out with his buddies in the parking lot of the Oak Hollow Apartments, as Ja’Leyah cried, alone, in the playpen in the apartment.
He smoked marijuana joints and washed it down with more gin and a couple extra beers as Ja’Leyah’s mother worked the second of two full-time minimum wage jobs to support the family.
Then White finally passed out drunk in the bed with Ja’Leyah right next to him. White then killed her when he rolled over on her.
The “miracle baby”, a name that White called Ja’Leyah after the apartment fire, suffocated.

Dad accused of suffocating 8-month-old son during his access time because baby looks like Mom, parents are separated (Holmesville, Ohio)
Yet another case where the father should have NEVER been granted access to the baby. Not clarified here if the parents were ever married, or just what custody/visitation rights were granted to Daddy after the separation.
Chances are quite high he had a history of domestic violence against the mother, which was neatly ignored in providing him with access to the baby.

A Magnolia-area man surrendered to state police Monday to face charges that he recklessly caused the death of his 6-month-old daughter in October, police said Tuesday.
Randy D. Mosley, 27, of the first block of Marshview Drive in St. Jones Commons, was charged with felony endangering the welfare of a child by intentionally, knowingly or recklessly acting in a manner likely to cause injury thus causing death, said Master Cpl. Gary Fournier.
The incident leading to the charges occurred Oct. 11 when Mosley was caring for his infant daughter, Aryanna.
According to police, the baby was placed in her bassinet about 4 a.m. and awoke crying about 7:30 a.m. Mosley then moved the baby and bassinet from his bedroom to another room at the other end of the mobile home, changed her diaper and then gave her a bottle in the bassinet, police said.
Mosley propped the bottle in the baby’s mouth then wrapped a blanket around her head to hold the bottle, leaving her face exposed, police said. He then took another blanket and put it underneath the baby, tucking in her arms and folding the sides around her so she wouldn’t knock the bottle out of her mouth.
At that point, Mosley went back to sleep and awoke about 12:50 p.m. and checked on the baby to find the bottle out of her mouth and the blanket covering her face, Fournier said.
He told investigators that he left the room and returned to her bedroom a half-hour later to find the baby in the same position as he left her.
His attempts at waking her proved she was unresponsive, according to police.
Mosley then called the baby’s mother at work and she called 911, Fournier said.
When paramedics arrived, they rushed the baby to Kent General Hospital, where she was pronounced dead.
An autopsy conducted by the state Medical Examiner’s Office is pending, Fournier said.
Mosley was released on $5,000 unsecured bail.

Four-month-old baby dies from "neglect" at home of custodial dad; dad has history of domestic assault (East Peoria, Illinois)
This baby's death--a homicide--has a very curious history behind it. But you have to tease it out, as it's not clearly explained.
Let's start from the beginning.
1) Mom loses custody for "neglect." Notice that we are NOT told what this "neglect" represented or what evidence there was for said neglect, or how serious it was. Perhaps it was serious, perhaps it wasn't. However, I am suspicious as we then move to the next stage.
2) Dad JOSH TUCKER gets custody. Notice at the very bottom of the article that Dad is in jail for domestic battery that is NOT related to the baby's death. So it is extremely likely that this guy has a history of domestic violence including violence against the baby's mother. Abuser fathers, as we know, make up a disproportionate percentage of fathers seeking custody with the aim of controlling/hurting the mother. It is extremely common for them to lie about the mother and smear her to get what they want. They often go on to abuse the kids. Is this what happened? Well, let's go on.
3) Almost immediately, at just two months of age, the baby has a broken femur. So it's obvious that SERIOUS abuse is going on. Does Daddy lose custody as fast as Mom did? ABSOLUTELY NOT. WHY?
4) The January autopsy reveals other signs of serious abuse--healing fractures, etc. And still no one in authority challenged this father and his new wife? Nobody caught this? Nobody followed up?
5) Then we have the baby's death from "neglect" which sounds pretty fishy. She just fell out of her swing and suffocated? The step didn't even do a good job of lying, since she states she didn't even check on the baby for FOUR HOURS. The police say there is no evidence to back up the step's story, and the coroner calls this a homicide, a murder.
But who gave this abusive father custody and allowed him to retain custody? We need names and we need answers.

EAST PEORIA – A coroner’s jury recently ruled an infant’s death from January as homicide, prompting further investigation from police and the Department of Children and Family Services.
Aspen Neal was nearly 4-months-old when she died in early January from suffocation. Sgt. Brian Despines from the East Peoria Police department voiced his concerns.
“Three-month-olds in general just don't stop breathing. So like I said that's why the investigation has taken a while.”
Despines said the night Aspen died she was home with her sister, step sister and step mother, Stephanie Kirby, now Tucker after marriage. Kirby told police she last saw the baby sleeping in a motorized swing and then found Aspen face down on the floor with a blanket around her neck four hours later.
“We don't have a clear understanding of what occurred yet,” Despines said.
That’s because Aspen’s step-mother is the only person who was there, and Despines says there is no physical evidence that corroborates the statement she gave to police. .
“It says face-down, and that's what we're reported, but the fact they were moved from one apartment to the other, our officers, nor our detectives know that for sure.”
He said the big question is: how did an infant get from the swing onto the floor? The coroner’s notes state that there is no evidence that the swing ejected her, and that it’s unlikely Aspen got onto the floor on her own. The questions don't end there.
“There is a prior report involving Aspen that we're investigating as well,” Despines said.
This isn't the first time DCFS has gotten involved with Aspen. Their records show the child was taken away from her birth mother after she was indicated for neglect in October. Aspen's father, Josh Tucker was awarded custody. In November, DCFS records show Tucker was indicated for neglect after Aspen arrived at the hospital with a broken femur. During Aspen's autopsy in January, the coroner found old bone fractures and bruises that had already started to heal. The coroner says those were “inconstant with multiple accidental causes, and more consistent with blunt trauma or pressure applied to those areas.”
Despines is working to make the case rock solid.
“To make sure justice is served for aspen we have to take our time. We have to do it right we can't jump the gun and haphazard do what needs to be done.”
The other two children who were home the night of Aspen's death have been taken into protective custody by DCFS. Aspen’s father, Josh Tucker is in the Tazewel County Jail under a violation of bail bonds related to his original charge of aggravated domestic battery. Police say that is not related to Aspen's death. Tucker was not home the night aspen died.

"Primary caretaker" dad arrested for smothering to death 16-month-old son so he could play video games (Citrus County, Florida)

A father in Florida was arrested for smothering his son to death so he could get back to playing video games, police said Friday.
Cody Wygant is accused of suffocating his 16-month-old son Daymeon in an attempt to quiet him because he was crying, the Associated Press reported. Police said the father was upset because he could not focus on the video games he was playing on an Xbox. Wygant, 24, was arrested and held without bail at the Citrus County Jail.
"It is inconceivable that a father could kill his infant son- it just baffles the mind," Sheriff Jeff Dawsy told the AP. "Our only sense of relief now comes from knowing that we did exactly what we needed to do to bring justice to him swiftly. Our prayers go out to those who knew and loved Daymeon."
Daymeon Wygant was pronounced dead on Thursday when emergency responders brought him to a hospital. The father was charged with third-degree murder and child neglect.
Police said the father covered his son's nose and mouth for about four minutes before placing him in a playpen and wrapping his body and head in bedcovers, the AP reported. Cody Wygnant did not check on his son until five hours later. During that time Cody played games on his Xbox and watched episodes of the TV show "Fringe."
Daymeon had turned blue and was unresponsive by the time Cody checked on him, police told the AP.
Cody told police the baby was placed in the playpen at around 7 a.m. Thursday. But Cody admitted to suffocating the child at around 1 a.m. that morning, the AP reported.
The child's mother, Cody's girlfriend, was not home at the time of the incident. The two have another child, a 3-month-old girl, who was taken by the Department of Children and Families.
Results from an autopsy performed on the son were not released to the media.

Daymeon Wygant was pronounced dead on Thursday when emergency responders brought him to a hospital. The father was charged with third-degree murder and child neglect.
Police said the father covered his son's nose and mouth for about four minutes before placing him in a playpen and wrapping his body and head in bedcovers, the AP reported. Cody Wygnant did not check on his son until five hours later. During that time Cody played games on his Xbox and watched episodes of the TV show "Fringe."
Daymeon had turned blue and was unresponsive by the time Cody checked on him, police told the AP.
Cody told police the baby was placed in the playpen at around 7 a.m. Thursday. But Cody admitted to suffocating the child at around 1 a.m. that morning, the AP reported.
The child's mother, Cody's girlfriend, was not home at the time of the incident. The two have another child, a 3-month-old girl, who was taken by the Department of Children and Families.
Results from an autopsy performed on the son were not released to the media.

A father has been charged for the murder of his two-year-old son after he admitted suffocating the child so he could leave the house and go back to playing online games at an internet cafe. Police arrested the unemployed 22-year-old, in the city of Taegu, South Korea, on Sunday after finding the body of his child in a suitcase wrapped in a trash bag near his home.
The man, identified only by his surname Chung, had earlier reported the boy missing.

Officers initially believed he had left his son to starve to death by abandoning him for 10 days while playing games.
But Chung later confessed to 'covering the child's nose and mouth with his hand,' more than a month ago, killing him so that he could go to an internet cafe, a police officer said.
The whereabouts of the infant's mother was not clear, although local news reports said she had been away from the house for some time working in a factory.
South Korean television aired closed circuit TV footage of Chung that showed him getting into an elevator with a suitcase and checking his hair in the mirror, apparently on his way to dispose of his son's body.
Online game addiction is seen as a serious social issue in South Korea which has near-universal availability of high-speed internet.
The government has tried to limit minors from going online to play late in the evening by cutting their connections.

MINNEAPOLIS (WCCO) – An Eagan, Minn. man was charged Tuesday after police say he rolled on top of his infant son while drunk, suffocating the boy, according to Dakota County Attorney James Backstrom.
Nathan Scott Savage, 30, was charged with three counts of second-degree manslaughter, all felonies, plus neglect and endangerment of a child, both gross misdemeanors.
According to the criminal complaint, the infant, Nolan Scott Sikich, was found dead shortly before 6 a.m. on Oct. 19, 2013. He was less than two months old at the time of his death.
Eagan Police were called to the residence where Savage lived with the child’s mother.
Upon arrival, they heard the child’s mother yelling at Savage in regards to the child, who firefighters found unresponsive and tried to resuscitate.
An officer spoke with Savage and believed he was intoxicated after smelling a strong odor of alcohol on him.
Savage later admitted to police that he had been drinking the evening before. Savage told police that sometime between 10 p.m. and midnight on Oct. 18, he laid Sikich down on his bed, that he shares with the boy’s mother. Savage said that eventually they both fell asleep.
At approximately 5:55 a.m., Savage said he woke to the child’s mother shaking him, asking where the child was, according to the complaint.
Savage said that was when he realized he had been laying on top of Sikich.
Savage admitted to police this was not the first time that the boy had slept in their bed.
An autopsy ruled the cause of death as “asphyxia due to probably overlay.” The manner of death was listed as “accidental,” according to the criminal complaint.
Savage, who appeared in court Tuesday, is set to appear again on May 27.
