2-year-old child overdoses on Oxycontin while with dad and girlfriend (Ashe County, North Carolina)

So it appears dad BLAYNE JOYAL must have had some sort of custody/visitation rights for his 2-year-old child to be in his company--and for the child to overdose on the painkiller Oxycontin while under Daddy's "supervision." So where is Mom?

Ashe Sheriff James Williams reports that on Tuesday, September 6th, the Ashe County Sheriff’s Office received a report of a 2 year old child that overdosed on the pain killer Oxycontin. The child was taken by ambulance to Ashe Memorial Hospital, and Captain Carolyn Gentry and Lt. Price of the Ashe Sheriff’s Office began their investigation. That probe has now lead to the arrest of the child’s father, Blayne Joyal, age 31, and his girlfriend, Shannon Tutay, age 26, both of Jefferson.

Both are charged with Child Abuse resulting in Serious Physical Injury and Failure to Secure a Weapon to Protect a Minor—that from a loaded .45 caliber handgun being found in the bedroom of the apartment. Both have had first appearance and are awaiting their probably cause hearing in district court.
