Brandon Lagorio, who is charged in the death of his 19-day-old son, appeared in a Lodi court Wednesday morning, but has not yet entered a plea.
His arraignment was continued until the end of the month, and was moved to Stockton.
Lagorio is charged with one count of felony child abuse resulting in the death of a child less than 8 years old.
The Lodi Police Department arrested Lagorio on Sept. 1 after finding evidence linking him to the shaking death of his son seven days earlier, in Lodi.
On Aug. 26, Lodi police officers responded to the 300 block of South Orange Street at about 7:10 a.m. to find an infant who had died, according to a police news release.
Deputy District Attorney Valli Israels, who is prosecuting the case, said it is a sad situation.
"We have a three-week-old baby. We have a father who is accused of killing the baby. And we have a mother who lost her baby," she said.
In the past two years, Israels said there have been a number of babies who have died because of non-accidential trauma.
"Sometimes it's young parents," she said. "Sometimes it's people who don't know how to deal with the fragility of a baby."
Lagorio is in jail on $250,000 bail. His next court date is 1:30 p.m. on Sept. 30, where he is scheduled to enter a plea.
