SANTA FE, N.M. (AP) - A lawyer representing a 22-year-old Santa Fe man has filed an insanity defense for his client, who is accused of shooting his pregnant girlfriend and her father to death in May.
Marino Leyba, Jr., has pleaded not guilty by reason of insanity.
Ruidoso attorney Gary Mitchell says Leyba might not have been able to form intent when he shot 17-year-old Sarah Lovato, who was nine months pregnant, and her father, 50-year-old Bennie Lovato, Sr.
Mitchell says "there are major mental health issues" in Leyba's family but couldn't be specific about the ailments.
Authorities said Leyba, a security guard, used a handgun he carried while on duty to shoot the Lovatos.
Prosecutors dropped a criminal abortion charge in the death of the fetus, saying it could complicate the two first-degree murder charges.
