Dad abducts 19-month-old child; has outdated custody order faxed to local police (Homewood, Alabama)

This case is reminding me of dad Timothy Frazer, who managed to get custody through a similar mess-up regarding custody orders by the police: http://dastardlydads.blogspot.com/2009/07/mom-sues-over-babys-murder-by-custodial.html.

Here, dad CARLTON FENTON "somehow" got a fax sent to the Homewood, Alabama police department saying that the father had full custody of his 19-month-old child, who was actually in the custody of the mother. The fax was some sort of temporary order from 2008. Meanwhile, the mom says Dad took off with the child while they were in a restaurant together, and that he slashed her tires. Now there's going to be a custody hearing in the county family court, and we'll see if Dad's ruse was successful.

Hearing set for Tuesday in case of 19-month-old child reportedly abducted from Homewood Saturday

A hearing has been set for Tuesday in Jefferson County Family Court to determine who has rightful custody of a 19-month-old child who was reported abducted from Homewood Saturday and found safe in New York City today, Homewood police said this afternoon.

The 19-month-old boy's mother, Monique McMillian of Birmingham, has custody of the child, said Homewood police Det. James Evans.

However, someone faxed Homewood police a temporary court order from New York City, issued in December 2008, that stated the father, Carlton Fenton, is the full custodian of the boy, named Cameron Fenton, Evans said. The 2008 court order was pending until another hearing that was supposed to take place in early 2009 but never did, Evans said.

Tuesday's hearing is designed to help clarify the validity of the papers faxed to Homewood police, Evans said.

At a press conference today, McMillian said she had picked up her son's father at the Birmingham International Airport shortly after noon Saturday so he could visit with her and their son. After eating a meal together at the IHOP restaurant in Homewood, McMillian said the boy and his father wandered away while she gathered the leftovers. She then didn't see them anywhere and found her tires slashed outside, she said.

Cameron Fenton was found safe today at Carlton's Fenton's home in the Harlem part of New York City and taken into custody of the New York City Department of Human Resources, Evans said. His father was arrested because of the warrant for his arrest in Homewood on a charge of interfering with custody, Evans said.

McMillian said she was happy her son was found safe and wants his father to get help. "I don't think he thinks he's done anything wrong because he is his biological father," McMillian said.

McMillian's mother, Kim McGraw, said Fenton's actions were an effort to spend more time with his son.

Evans said police believe that a third party picked up Fenton and his son from the IHOP Saturday and that Fenton did not really fly into Birmingham Saturday but was dropped off there by a third party. They have not yet identified that third party, Evans said.
