Dad DAVID "D.J." CREATO JR. is an adult. What the hell was he doing with a teenager? Couldn't find anybody over 18 to date him? So he's dating a high school student? Notice there is no outrage about that. It's all about a kid who just wanted to be a kid.
What she thought or felt is immaterial. It is no crime for a young woman not to like children or prefer to be in a relationship with somebody who does not have children.
It was Daddy's choice to either give up his weekend custody time or stay in a relationship with this teenager. He apparently decided to kill the child instead.
Can't help but wonder whether this father was granted joint custody/visitation time despite a history of abuse and personal irresponsibility.

A New Jersey man was charged with murdering his three-year-old son, allegedly killing the child because he feared the boy was getting in the way of his relationship with his teenage girlfriend, prosecutors said.
Little Brendan Creato was found dead on October 13, less than a mile from his dad’s apartment, where he had been dropped off a day earlier.
His father, David “D.J.” Creato, Jr., reported the toddler missing around 6 a.m., telling a 911 operator that he had woken up to find his son was missing.
“I just woke up and he wasn’t in my apartment,” Creato, 22, said. “I don’t know if he wandered out or what happened. I don’t know where he is.
“The door was locked. I guess he unlocked it and left,” he continued.
Brendan’s body was found by a K-9 unit partially submerged in water in a wooded area off South Park Drive about 9 a.m., officials said.
He was still wearing his pajamas.
The child’s cause of death is still undetermined, but medical examiners reportedly found he died of “homicidal violence,” prosecutors said.
Brendan’s brain showed a lack of oxygen before his death, indicating causes such as drowning, smothering or asphyxiation, WPVI reported.
He also had a fresh bruise near his collarbone, investigators said.
Investigators reportedly did not believe that Brenden went to that area on his own, as the boy’s socks were clean despite the muddy surroundings.
The area is very steep at one point and difficult to navigate, authorities said.
He was also known to be afraid of the dark, so it was unlikely he would have gone into the wooded area before it was daylight, prosecutors said.
There were no signs of forced entry at the home, where Brendan slept on a love seat nine feet from his dad’s bedroom, she continued.
“Never once had he left the apartment or his mother’s house or his grandparents’ by himself,” Shah said.
The boy’s father was arrested on Monday and charged with first-degree murder and second-degree endangering the welfare of a child, officials said.
Prosecutors allege that Creato killed his own son after his 17-year-old girlfriend had told him she disliked children and “issued an ultimatum to him,” saying it was either her or him.
She told Creato that he would have to give up taking custody of Brendan every other weekend to be with her, the Philadelphia Inquirer reported.
The pair had begun dating in June 2015 after meeting on the app Tinder, remaining together despite the girl’s open “dislike” of children, prosecutors said.
She had written a series of “unbelievable” blogs in which she described her “strong dislike of children,” Camden County Assistant Prosecutor Christine Shah said at Creato’s arraignment on Tuesday.
After the girl went away to college, she repeatedly threatened to break up with Creato, who had allegedly become jealous of a boy that she was talking to at school.
Creato reportedly logged into her social media accounts and at one point posed as the girl and told the boy to leave her alone.
Creato did not confess to killing his son, but allegedly told investigators that he felt “jealous and anxious” in the hours before he noticed his son was missing, and that he had been worried that the woman he loved had found someone else, the Inquirer wrote.
Shah said that on the night that Brendan was killed, Creato allegedly called his girlfriend eight times and that he noticed from her Snapchat account—a picture and video-sharing app—that she was with the “guy he was jealous of,” the paper reported.
Creato and the girl had visited the spot where Brendan’s body was found about 30 times, and he told investigators that it was his “favorite place… and he referred to it as spiritual to him,” Shah said.
The pair is still reportedly communicating.
If convicted of murder, Creato faces a minimum of 30 years in prison without parole and a maximum term of life in prison with at least 67 years without parole.
His bail was set at $750,000.
If he posts bail, Creato is not allowed to leave the state or make any contact with Brendan’s mother, Samantha Denoto, or her family.
Creato’s attorney, Richard Fuschino Jr., said his client had cooperated fully and truthfully with investigators.
“He spent an entire day answering questions of investigators,” Fuschino said, saying that the prosecutor’s version of what happened was improbable, the Inquirer wrote.

Once again, we see how a violent father used a "custody" feud as a way to fight the mother. When that didn't win, he murdered the kids to "spite her." This piece of sh** should have been kept from having any access at all. No access=no killing.

Charles Amon Mihayo, 36, must serve at least 31 years for smothering four-year-old Savannah and three-year-old Indianna with a pillow during a game of hide-and-seek on Easter Sunday.
He told police they would not understand what he had been through and providing a reason for his crime would not make a difference.
But Victorian Supreme Court Justice Lex Lasry said yesterday that Mihayo's crimes were inextricably linked to his conflict with his former wife.
"You determined she would pay the price and inevitably so would your children - with their lives," he said. "You decided to demonstrate to your ex-wife that she did not have the control over the children and their relationship with you that she thought she had.
"Your breach of parental trust is almost beyond belief. You gave in to the basest of instincts, revenge."
Justice Lasry said though Mihayo took responsibility for murdering his daughters, he was not truly remorseful.
"You acknowledged what you did was wrong but I am not at all sure that you actually regret what you have done," he said.
"You do not appear to me to be crushed or broken in spirit by your wrongdoing."
Mihayo separated from his wife in 2011 and the pair began feuding over child custody arrangements.
In the weeks before the April 20 murders, he told his former wife he was relinquishing his entitlement to see the girls.
But he texted her asking to see the children one last time and told her she had "won".
Before they arrived at his home, Mihayo went shopping to buy the girls new dresses and shoes.
He dressed them in the frocks and filmed them dancing to the song Let It Go from the movie Frozen, then suffocated them.
He bathed them and put them back in their dresses before calling police.
The family of Savannah and Indianna said the girls would be "forever missed, loved and never forgotten".
The Tanzanian-born Mihayo did not react in the court dock as he was sentenced.

Dad charged with involutary manslaughter in death of infant daughter; apparently smothered her to death while "co-sleeping" with her (Kansas City, Missouri)
What the hell is going on here? Notice that there is ZERO MENTION of a mother in this story. None. In fact, it appears that the father was custodial, perhaps when the baby was just one month old.
If so, then why was this fool granted custody of an infant? Note the following:
1) He is apparently homeless, drifting between Grandma's house and the City Union Mission, which I believe is a homeless shelter for men. He kept an infant girl here?
2) This guy has a chronic severe drug problem. No red flag there?
3) When the baby was just one month of age, he apparently fell asleep on her and broke her leg. The authorities response: Make him sign a piece of paper promising to be a good boy in the future. Seriously? We don't know why Mom was apparently eliminated from the picture, but was she really worse than this? Why didn't Mom get this kid-glove treatment along with all the breaks?
4) Dad breaks his promise, apparently gets high, and falls asleep on the baby AGAIN. This time he smothers her to death. He TELLS THE POLICE what he did. Yet they don't get around to arresting him for MONTHS.
Why the constant coddling? Who gave him custody? Who supported that decision? What happened to Mom?

KANSAS CITY, Kan. — A little Kansas City, Mo. girl never made it to her first birthday. Friday, her father was accused of smothering the girl to death months ago while the two slept. Deonte Barnett, 22, has been charged with first-degree involuntary manslaughter.
Police picked up Barnett Friday in KCK. He told police everything about his daughter Aubrie’s death, so it is a mystery why it took so long to charge him. Court documents revealed what he said happened the night his daughter died.
Family members of Barnett were stunned to learn of his arrest.
“Hey, I’ll tell you man, I’m a little shocked right now,” said a relative who only wished to be identified as Calvin.
He said Barnett’s grandmother’s house was home base for the dad and his baby girl.
“He was staying here with the child for a while,” Calvin explained.
He says Barnett was in and out with the child, at times even staying at the City Union Mission on Wabash, which is where police were called the night of February 26 earlier this year regarding a deceased infant. Barnett admitted to police that he fell asleep on the child.
“If he was a good dad, that wouldn’t have happened, that’s obvious, you know?”
Calvin said. Calvin said Barnett has a severe drug problem, marijuana being his drug of choice. According to police, Barnett told them he had smoked marijuana the night his baby died. He told them during the night he woke up on top of Aubrie. She felt limp, but was slightly breathing. He put her in a stroller and went back to sleep. When he woke the next day, she was dead.
“You’ve got to let the kid go, right, if he get like that, wouldn’t you?” Calvin asked.
Family members are upset because that was the second time Barnett injured the child while sleeping. When Aubrie was just one-month-old, police say he fell asleep on the infant and fractured her femur in two places. The Children’s Division made Barnett sign a contract stating he wouldn’t sleep with the child again, but that contract appears to have only been as good as the paper it was written on.
“Should have let him go, because it’s better somebody else have her than what end up happening, because that’s as bad as it gets, I’m telling you,” Calvin said.
A representative from the City Union Mission says they do have a no drug policy, but don’t do drug tests upon entry unless someone is clearly high. They also give random drug tests, but it’s not known at this time if Barnett was ever tested.
Barnett is currently in the custody of the Wyandotte County Sheriff’s Office and will be transferred to Jackson County to face his charge. His bond has been set at $1 million.

After killing them, Mihayo bathed them, then redressed them in the ballerina dresses and called police.
When police arrived he told them: "It's done. I've killed them."
He pleaded guilty to two counts of murder in the Melbourne Magistrates Court on Friday.
Mihayo arranged with the girls' mother, his estranged partner, to see them on April 20, telling her in a text he wanted to "see them one last time", according to documents submitted to the court.
He went shopping that morning, buying the dresses and silver shoes for the girls.
Mihayo made the girls dance in the dresses for their mother and grandmother when they arrived at his bungalow in the backyard of the Watsonia home of his ex-partner's parents.
He then told them: "Come back inside and we'll show mum something else in 10 minutes."
He took the girls into his bungalow and filmed them on his phone dancing to a song from the film Frozen.
He then held a pillow over their faces until they stopped moving.
When his ex-partner tried to enter the locked bungalow he said "you'll know when they get here."
Police were soon bashing on the bungalow door and Mihayo shouted out "a minute please", while he finished dressing the girls in their ballerina outfits.
The Tanzanian national later told police he had no reason for murdering his daughters but that it made sense to him at the time, the court documents said.
He told police that they would not understand what he had been through and that providing a reason for his crime would make no difference.
Mihayo appeared in court briefly via video-link to enter his guilty pleas.
He will face a directions hearing in the Victorian Supreme Court in September ahead of his sentence.

I fail to see how this baby's death was "accidental." The father seems pretty deliberate in his actions to me. And then he goes into what certainly looks like this big act, claiming he knew nothing was wrong with the baby...until Mom walks in? Yea, right. WALKER, LA (WAFB) - A 23-year-old man was arrested after he confessed to accidentally smothering his infant daughter.
"He initially denied any wrongdoing, but after about an hour, he admitted that he put his hand over the baby's mouth to try and keep her quiet," Capt. John Sharp, Walker Police Department, said. "It's a really sad situation. Everybody is deeply upset by this. At the end of the day, this is a child's life and we can't place a value on that."
It all started when the Walker Police Department was called out on April 19, 2014.
"Any time you have a call where a child is unresponsive, we [the police] are going to respond, too," Capt. Sharp noted. "At first, there were no indications of a crime scene. All we had were some very upset parents."
The child was transported to a hospital in Baton Rouge where she remained until Tuesday, May 13. The family made the painful decision to remove the child from life support. Just days before, however, investigators learned that this case was more complicated than they first believed.
"We were contacted by the hospital and the Office of Children and Family Services on Saturday," Capt. Sharp said. "They indicated to us that the child's mother, Kayla Depoy, and another family member, commented to some of the medical staff that they were concerned that the child's father, Franklin Finney, might have played some part in the child's respiratory failure."
Finney was questioned on Wednesday and eventually told investigators that his daughter was crying and he was frustrated that he could not console her. He then admitted to placing his hand over her mouth in an attempt to stop her from crying. "
Mr. Finney stated that he did not realize the child was no longer breathing until Ms. Depoy entered the room and saw the baby was unresponsive," Capt. Sharp added.
After obtaining the confession, investigators consulted with the Livingston Parish District Attorney's Office concerning possible charges.
"Contrary to popular belief, we don't get to decide what people are prosecuted for," Capt. Sharp noted. "The DA indicated that manslaughter was the appropriate charge."
Finney was booked into the Livingston Parish Detention Center. He is being held in lieu of a $75,000 bond.

The police account doesn't pass the smell test.
We're supposed to believe that this guy's wife just up and left him and their son because of disagreements over "parenting issues" and because she "didn't make an effort to look after the family."

Young father poisons toddler, smothers him and throws him from bridge
A 16-month-old toddler named Yu was murdered by his own father, Feng, when the man fed his son pesticides then smothered him with tape to suffocate him upon finding that he was still alive. Wanting to make sure that his son was definitely dead, he put Yu in a bag and threw the bag from a 5-meter-high bridge, according to local reports.
In the early morning of 9th of Sep 2013, a few construction workers, who were working under a bridge in Shenyang, Liaoning province, found a bag containing the body of a baby whose nose, eyes and mouth were all covered by tape.
The police arrived soon after and confirmed the baby’s death. People who were at the scene told reporters that the baby was around 2 years old with chubby cheeks. He was wearing a striped coat and a pair of jeans. Some of his other clothes were inside the bag as well. The police immediately issued a search notice for the dead baby’s relatives. Ten days later, they shockingly confirmed that it was Yu’s father who had killed him.
This horrible killing happened only a few days after Feng’s wife Hong left the family. Feng and Hong got married in 2011 and had baby Yu, who was born with congenital clubfoot in June 2012. The couple had been constantly arguing with each other since Yu was born. Feng had argued with Hong because of her frequent visits to Internet cafes and over parenting issues. He claimed that Hong didn’t make an effort to look after the family. So, not wanting to deal with the volatile marriage, Hong chose to leave Feng and her baby. After Hong left, Feng became very anxious and depressed. Raising the son on his own apparently contributed to the anxiety and depression. On September 8, when Yu was sick and crying all day, Feng felt that he couldn’t deal with the baby anymore and decided to end the crying by killing Yu.
After police questioned Feng and he admitted the crime, they suspected he may have psychological problems. They sent him to Liaoning Forensic Hospital Mental Health Department where doctors were unable to diagnose any apparent mental issues. However, they found that his intelligence level was slightly lower than normal peoples’, and suspected that’s why he couldn’t control himself when he felt the impulse to kill his son. Although Feng confessed to murder, he lacked remorse and, at the time of the killing, he was not aware of the consequences of committing such a horrible crime.
The police concluded that Feng’s unhappy marriage with the boy’s mother Hong and the boy’s congenital clubfoot led to the father’s anxiety, depression and loss of faith in life. The child’s crying had, at the time, fueled his depression and anxiety symptoms more.
Feng has been prosecuted for intentional homicide.

A Caddo Parish jury has recommended the death penalty for a Shreveport man convicted in the murder of his infant son.
SHREVEPORT, LA (KSLA) - A Caddo Parish jury has recommended the death penalty for a Shreveport man convicted in the murder of his infant son.
25-year-old Rodricus Crawford was convicted by a Caddo Parish jury Tuesday night of first degree murder in the death of 1-year-old Roderius Lott.
The child was found unresponsive in a home in the 6800 block of Broadway in February of last year. Lott was rushed to the hospital where he was pronounced dead. An autopsy showed that the little boy had been smothered to death. The coroner also reported finding bruises and other signs of abuse.
At his sentencing hearing Wednesday, jurors had the option of sentencing Crawford to death or life in prison. After a day-long hearing, that jury returned a unanimous recommendation just before 11 p.m. for the death penalty.
A judge will rule on that recommendation in a formal sentencing hearing on November 26.

GAFFNEY, S.C. -- A Jonesville father was arrested on Wednesday accused of injuring his 5-month-old.
Eric Smith is charged with inflicting great bodily injury.
According to an arrest warrant, Smith injured a 5-month-old by hitting him with his hands, putting a pillow over his head until he stopped breathing and grabbing, squeezing and shaking him.
The warrant says the incident happened between Nov. 2 and Nov. 16 at a home on North Limestone Street in Gaffney. Deputies say the child was brought by EMS to the Upstate Carolina Medical Center where Smith first told a nurse the child had a seizure.
According to deputies, Smith then told the nurse he had the child propped on a pillow, went to bathroom and when he came back the child was on the floor.
The nurse called deputies, who say they responded and questioned Smith.
According to deputies, Smith said he was sitting on the couch with the baby when the baby kicked and pushed off of him and fell to the floor on his back and hit his head.
The doctor at Upstate Carolina Medical Center said the child’s injuries were questionable and sent the child to Greenville Memorial Hospital and contacted the Department of Social Services.
The child was taken to GHS by ambulance.
Smith told deputies he watched the child while the mother, his girlfriend, was at work.
The mother told deputies she was at work when the incident happened.
Deputies said Smith came to the Sheriff’s Office the day after the child was hospitalized and gave a statement admitting to hitting the child with his hands, putting a pillow over his head until he stopped breathing and grabbing, squeezing and shaking him.
Smith is at the Cherokee County Detention Center.
The child remains in the hospital.

Notice that there's mention of Daddy's mom, but not the baby's mom. Where is she? Working while the Daddy got "frustrated"? Was this infant subject to a visitation or custody order?
It is utterly insane for a baby this young to be out "visiting" Daddy or anybody else. He should have been home with his mother. Unfortunately, nobody supports moms anymore. We really need paid maternity leave now, since we can't count on deadbeat abuser daddies like this to support us even for a couple of months.

Thank you, Judge Craig Schwall! A voice of sanity! (Atlanta, Georgia)
Thank you, JUDGE CRAIG SCHWALL! Yours is an increasingly rare voice of reason. You very possibly saved this 3-year-old boy's life by your decision to deny his father visitation.
The facts as reported: Dad MICHAEL CALLAWAY was pretty much caught in the act of smothering his then 3-month-old son in the hospital. A security guard caught him, and the police and the attending doctor did not believe Dad's lame excuse. Fortunately, the baby survived.
Dad was indicted, but found "mentally incompetent" to stand trial (once again, we see that the mental health card works quite well for many dads, contrary to popular opinion). Dad's free on bond, ordered to have outpatient psychiatric treatement, and stay away from his son.
The mom, not surprisingly, decides she wants out of the marriage. But during the divorce case--apparently presided over by JUDGE LYNN ALDERMAN OF UNION COUNTY, GEORGIA--it is decided that "smother" daddy should get two hours of supervised visitation a week--the supervision to be performed by "smother" daddy's own parents! Who somehow managed to get custody of the child (Because Mommy's the one who is labeled the "unfit parent"in all this. The "non-smother" parent. Naturally.).
Well, thank goodness for Judge Schwall. He not only decided that this arrangement was "unacceptable"--given that "smother" daddy lives right down the street from the parents--but banned Daddy from Union County and seeing his other child. He also found out that Daddy had been involved in some racketeering business, but didn't get a mental health get-out-of-jail-free card for THAT. Or the DUI thing. Well, you know it is. He's a real slick dude, Daddy is. We all know the type. Although the family court judges seem to miss the slick dudes routinely.

Accused father ordered to have no contact with son

Saying he felt deceived, a frustrated Fulton County judge on Thursday banned a father accused of trying to smother his son from having any contact with the 3-year-old boy.
“I don’t want him around the child,” Superior Court Judge Craig Schwall told a lawyer for Michael Callaway. “I’m not going to sit here in limbo wondering what’s going on with this child.”
Callaway, 31, faces a first-degree child cruelty charge on allegations he tried to smother his then three-month-old son at Scottish Rite Children’s Hospital in March 2007. A security guard saw him enter the room and place his hands over the baby’s mouth and nose, causing the infant to flail his arms, cry and gasp for air. Callaway said the child was having a seizure, but police and the attending doctor did not believe him.

But in July, in a divorce case filed by the child’s mother, a judge in Union County in far north Georgia allowed Callaway visitation rights with his son for two hours a week. Visits must be supervised by Callaway’s parents, Mike and Peggy Callaway of Blairsville, who gained custody of the child during the divorce.
Schwall said that arrangement was unacceptable, and he noted that Callaway now lives with a relative down the street from his parents.
Schwall banned Callaway from Union County and from seeing his son. He scheduled another hearing Monday to reconsider the conditions of Callaway’s $25,000 bond.
Schwall convened Thursday’s emergency hearing at the request of Fulton prosecutors who want Callaway reevaluated and his bond revoked. They disclosed that Callaway had pleaded guilty in February 2008 to 10 counts of theft by receiving in Gilmer County, also in north Georgia. In that case, Callaway and seven other men were charged in a racketeering scheme in which they stole construction vehicles, such as bulldozers and tractors, and then altered their identification numbers.
Callaway did not claim to be incompetent for trial before pleading guilty to those charges. He was sentenced to 10 years on probation. He also was charged with DUI in April 2008 in Union County, Assistant District Attorney Shireen Hormozdi told Schwall.
Schwall said he “would never, ever have allowed him to be free” had he been notified of those cases. “I think I’ve been deceived.”
Hormozdi also said she and an investigator recently visited the clinic in Blue Ridge and found Callaway hadn’t made regular visits for treatment.
Cornelia attorney Douglas McDonald Sr., Callaway’s lawyer, arrived in court with his shoulder in a sling because of recent surgery. He asked Schwall to postpone the hearing until he was off medication and could effectively represent his client, but Schwall declined.
“I’ve been thrust into a situation where I’m concerned about the safety of the child,” Schwall said.
If McDonald could not represent Callaway, who attended the hearing, he should find someone else to do so, the judge said.
McDonald opposed Schwall’s ruling.
“Michael is stable,” he said. “He ought to see his son.”
In her July ruling in the divorce-custody case, Union County Judge Lynn Alderman found the child’s mother to be an unfit parent. She cited a number of parenting problems and awarded custody to Callaway’s parents, allowing the mother to see the child every other weekend and on holidays.
The child’s mother, Wendy Garland, attended Thursday’s hearing and praised Schwall’s ruling.
“He doesn’t deserve the right to see my son,” Garland, 29, said of Callaway. “He needs to pay for what he’s done.”
The facts as reported: Dad MICHAEL CALLAWAY was pretty much caught in the act of smothering his then 3-month-old son in the hospital. A security guard caught him, and the police and the attending doctor did not believe Dad's lame excuse. Fortunately, the baby survived.
Dad was indicted, but found "mentally incompetent" to stand trial (once again, we see that the mental health card works quite well for many dads, contrary to popular opinion). Dad's free on bond, ordered to have outpatient psychiatric treatement, and stay away from his son.
The mom, not surprisingly, decides she wants out of the marriage. But during the divorce case--apparently presided over by JUDGE LYNN ALDERMAN OF UNION COUNTY, GEORGIA--it is decided that "smother" daddy should get two hours of supervised visitation a week--the supervision to be performed by "smother" daddy's own parents! Who somehow managed to get custody of the child (Because Mommy's the one who is labeled the "unfit parent"in all this. The "non-smother" parent. Naturally.).
Well, thank goodness for Judge Schwall. He not only decided that this arrangement was "unacceptable"--given that "smother" daddy lives right down the street from the parents--but banned Daddy from Union County and seeing his other child. He also found out that Daddy had been involved in some racketeering business, but didn't get a mental health get-out-of-jail-free card for THAT. Or the DUI thing. Well, you know it is. He's a real slick dude, Daddy is. We all know the type. Although the family court judges seem to miss the slick dudes routinely.

Accused father ordered to have no contact with son

Saying he felt deceived, a frustrated Fulton County judge on Thursday banned a father accused of trying to smother his son from having any contact with the 3-year-old boy.
“I don’t want him around the child,” Superior Court Judge Craig Schwall told a lawyer for Michael Callaway. “I’m not going to sit here in limbo wondering what’s going on with this child.”
Callaway, 31, faces a first-degree child cruelty charge on allegations he tried to smother his then three-month-old son at Scottish Rite Children’s Hospital in March 2007. A security guard saw him enter the room and place his hands over the baby’s mouth and nose, causing the infant to flail his arms, cry and gasp for air. Callaway said the child was having a seizure, but police and the attending doctor did not believe him.

UNNAMED DAD has been found guilty of attempted murder, and has been jailed for a minimum of 10 years. Seems Daddy Dearest tried to kill his infant son by smothering him and poisoning him with painkillers (Tramadol).

Man jailed for poison of baby son with painkillers
A man has been jailed for a minimum of 10 years for trying to kill his weeks-old baby son by smothering him and poisoning him with painkillers.
Teesside Crown Court heard the father, not named for legal reasons, committed the attacks to stay at the child's mother's house in north-east England.
The 30-year-old, who was found guilty of charges including attempted murder, did not want to return to his own flat.
The judge warned him he was so dangerous he might never be released.
Judge Peter Fox QC, the Recorder of Middlesbrough, branded the defendant's behaviour as "despicable" and gave him an indeterminate jail term.
He said only an "act of mercy" prevented him from imposing a life sentence.
Shaun Dodds, prosecuting, told the court the defendant attacked the baby in autumn 2008 because he was due to return to his flat, which had no gas and electricity.
He said: "You knew full well that after seven days you were having to go back to your flat, so you needed something to keep you at the house.
'Blamed partner'
"To deflect attention away from the fact it is time to go home you poisoned the child. You poisoned [the baby] with codeine."
During the first two months of the baby's life he was admitted to four different hospitals because of episodes of apparent illness which baffled doctors.
However, they became suspicious about the pattern of his admissions and the police and social services became involved.
The painkiller Tramadol was found in a sample of the baby's blood, while previous tests had found codeine in his system.
The defendant even tried to blame his partner for giving his son the drugs overdose, the court heard.
He told police: "The only explanation I can give is that [the baby's mother] gave it somehow but I do not know how or when."
Other times, the baby suffered illnesses likely to be associated with "attempted suffocation", said Mr Dodds.
In addition to attempted murder, the child's father was convicted last month of unlawfully administering a poison so as to endanger life and child cruelty.
