There are an amazing number of cases like this. Poor mothers in imporverished countries who lose custody to fathers in the wealthier countries. Fathers who can presumably provide these children with a "better life." And the "better life" turns out to be torture and death.

Melonie’s terrible last days unroll in courtroom as her father’s trial begins
The Crown outlines its case against Everton Biddersingh, whose daughter was found burned in a suitcase in 1991.

Melonie Biddersingh came to Canada from Jamaica in early 1991 with nothing more than a single suitcase.
Whether this was the same suitcase in which her charred remains were found three years later, behind a Vaughan commercial building, is unknown.
The known details are gruesome: 21 healing fractures discovered on autopsy, when that pitiful corpse was examined by a coroner; weight of 50 pounds, far below the normal body index range for a 5-foot-2 teenager, indicating severe malnourishment; an ante-mortem — before death — head contusion that had resulted from trauma or blunt force injury; fluid in the nostrils and bone marrow, indicative of drowning as either a cause of death or major contributing factor — the liquid from a freshwater source, not tap water, perhaps pooling rain.
All of these details were related in a Toronto courtroom Wednesday, as the prosecution laid out its case against Melonie’s biological father.
To the death roll of Randal Dooley and Jeffrey Baldwin, children starved to death and grotesquely mistreated while alive, right in our midst, add now the name of this 17-year-old who lived and died with nobody taking notice.
All but held prisoner, the court was told, in a one-room apartment she shared with her father, her stepmother, two brothers, two half-brothers and, eventually, an infant half-sister for whom she was responsible. When the baby’s diaper needed changing, Melonie would be summoned with a buzzer.
She was not allowed to attend school, though furthering her education — her ambition to one day become a nurse — was the main reason Melonie had been excited about moving to Canada, leaving behind a mother and four other siblings, living in abject poverty in a slum shack.
The harshness of Melonie’s existence was only summarily outlined by Crown Attorney Anna Tenhouse in her opening address to the jury. The details here are all from that address:
At times, the teen was kept in a closet, “hidden from the outside world.”
She was made to shower on the balcony in summer, was at times locked out there as punishment, and forced to use a bucket to relieve herself.
She was called names like “the devil,” told that she’d brought evil to the family.
Made to sleep on a piece of cardboard on the living room floor, though there was a sofa bed nearby.
Had her head placed in the toilet and the toilet flushed, as punishment.
Was kicked and punched about her body, dragged by the hair and stomped upon.
Was at times chained to furniture.
Deprived of food, she became so weak she could no longer hold her baby sister. Enfeebled to the point that her older brother had to help her bathe after the girl urinated or defecated on herself.
That brother, Cleon, was allegedly forced to sell drugs and warned that, if he ever told anyone about it, or about the abuse in their home, “harm would come to him and his family in Jamaica,” Tenhouse told the jury.
Cleon got out by and by, ran away. Melonie’s other brother, Dwayne — 12 when he arrived in Toronto, a year younger than Melonie — died in an accident 17 months later.
Melonie died, court was told, on Sept. 1, 1994. This is not yet evidence. It is the prosecution’s claim.
But the photograph displayed on a screen in the courtroom — that’s evidence.
Blackened, curled into a pathetic heap of limbs, bits of singed hair still visible on the death scalp.
In the front row, Melonie’s mother, Opal Austin, choked on a sob and wept. Melonie’s sister, Racquel Ellis, was overcome: “I can’t breathe, I can’t breathe.”
Who could do this terrible thing?
Melonie’s father, Everton Biddersingh, pleaded not guilty to first-degree murder. His wife, Elaine Biddersingh — Melonie’s stepmother — has also been charged with first-degree murder but will be tried separately next year.
On Aug. 31, 1994, Det. Steven Seabrook, then a constable with the canine unit of York Regional Police, was patrolling in the Highway 7 area when he noticed a plume of black smoke. He tracked it to a spot behind an industrial area. What he saw, at first, were flames a couple of metres high, emanating from a pile close to a garbage bin. At the base of the fire was a tire, largely melted — source of the black smoke, from the burning rubber.
The heat was so intense Seabrook could come no closer than 4 or 5 metres.
Another officer arrived with a fire extinguisher, but that only put the blaze out temporarily. The flames sprung back.
Next came the firefighters, who were able to douse the pyre with water. And then they all saw, amidst the charred heap, a grisly sight.
“At that point, it was obvious to us there was a body lying on the tire, in the fetal position. No flesh on the legs, the head was very black and charred,’’ Seabrook testified yesterday. “I noticed a metal square shape around the body, looked like the frame of a suitcase.’’
The Suitcase Girl, as she became known in the media, once it was determined that the corpse was female.
No name. And no one came forward with information about a missing teenage girl.
Those with long memories may recall, as the years went by, the occasional press conferences as police continued attempts to identify her. The artist’s depiction of how she may have looked. The forensic sculpture of a female head, which triggered no public recognition either.
They never gave up but they never came close to solving the mystery.
Eighteen years would pass, longer than the length and breadth of Melonie’s sad life.
And then, as Tenhouse told court, the secret was exposed, the plotline that police have never revealed. On Dec. 11, 2011, Elaine Biddersingh confessed to her pastor, court heard, that the girl in the suitcase was her step-daughter. The minister took that information to police, and the Toronto Police cold case unit took carriage of the matter.
Opal Austin, living in Jamaica, was contacted. For nearly 20 years she had wondered what had become of her daughter and sought information. Everton Biddersingh told her Melonie had run away to New York.
DNA from the mother was matched to The Suitcase Girl, confirming her identity. She had a name. She claimed her history.
Outside court, Racquel Ellis told reporters: “It’s like the hole of my belly button dropped out. I couldn’t breathe. I had to come out of the courtroom. It’s like my heart was going to stop beating.’’
Everton and Elaine Biddersingh were arrested on March 5, 2012, in Welland, Ont.
Yesterday, the father never appeared to even once glance at the mother of their dead and desecrated daughter.

A Queens father who was arrested last weekend for allegedly assaulting his 4-month-old son will soon face an upgraded criminal charge after the child died hours before Christmas.
Nevin Janduher died of severe head injuries Wednesday afternoon at Cohen’s Children’s Hospital, a facility that shares a campus in New Hyde Park with Long Island Jewish Medical Center, where the boy’s mother works as a radiologist. The NYPD announced the child’s death Thursday.
The boy suffered the injuries last Friday while in the care of his father, Jagsheer Singh, 28, police said. Singh’s wife, Dr. Reena Malhotra, was at work that day. She returned to the couple’s Bayside home early Saturday and went to sleep without checking on the baby, prosecutors said. Nevin appeared to be fine at 7 a.m. Saturday, when Singh made him a bottle, according to statements he allegedly made, prosecutors said. The father then gave the boy a bath, and during that process the boy fell off a changing table that was about 4 feet off the floor, Singh said. Singh did not tell his wife about the fall, prosecutors said.
At 8 a.m., Singh noticed the child was unresponsive, and he then awakened his wife and called 911, according to his statement.
But doctors determined the baby “suffered multiple severe skull fractures, widespread brain injury resulting from lack of oxygen and retinal hemorrhages,” prosecutors have said. They argued the trauma was inconsistent with a fall.
Singh was arraigned Monday on charges of first-degree assault and child endangerment. He was jailed in lieu of $200,000 bail. In a news release Monday, Queens District Attorney Richard Brown vowed charges would be upgraded against Singh if Nevin died. On Thursday night, a spokeswoman from Brown’s office said upgraded charges would await results of an autopsy performed by the medical examiner. Singh is due in court Jan. 5.
Nevin’s fate appears to mirror the deaths this fall of Jeida Torres, 3, and Thaiya Spruill-Smith, 2, in Brooklyn, and Poseidon Quinones, 3, of the Bronx. The girls died in separate incidents, allegedly at the hands of abusive step-fathers. Poseidon’s step-grandfather was arrested a month ago and charged with beating him to death.

Dad who had just gained "physical custody" pleads not guilty to murdering 7-month-old son; had taken custody just ten days before baby's beating death (Oceanside, California)
The latest edition to the California Killer Dads and Custody list.
So from what I understand, the mother was forced to do "shared custody" with a baby, and then lost "physical custody" to this POS. Within ten days, the POS had killed the baby, beaten him to death.
Who the hell gave this father custody? How much you want to bet he had a prior criminal record or history of violence/abuse that was neatly ignored?
Somebody in authority gave this father the green light to kill an infant, and those people need to start being held responsible. They have bloody hands too.

A man accused of inflicting injuries on his 7-month-old son that led to the infant's death pleaded not guilty Tuesday to murder and assault charges.
Stanford Morocho, 22, was ordered held on $5 million bail. Deputy District Attorney Ryan Saunders told Judge Martin Staven that Morocho shared custody of the victim with the child's mother, with whom the defendant no longer has a relationship.
Morocho took physical custody of the baby on Dec. 2. and by the morning of Dec. 12, the child was dead, according to Saunders.
During that time frame, the defendant allegedly inflicted various forms of physical abuse on the baby, Saunders told the judge.
As a result of the defendant's alleged abuse, his son suffered significant bruising throughout his body and face, a skull fracture, rib fractures and internal bleeding, according to the prosecutor.
Morocho was arrested Friday after the baby was pronounced dead at Naval Hospital Camp Pendleton.
During an interview with detectives, Morocho allegedly made incriminating statements about the case, according to Oceanside police Lt. Sean Marchand.
Morocho will be back in court Dec. 26 for a readiness conference and Dec. 31 for a preliminary hearing. He faces 25 years to life in prison if convicted.

BROOKE COUNTY, W.Va. – A Follansbee father is in jail and his 7-week-old baby is in bad shape at a Pittsburgh hospital after an alleged child abuse incident.
Christopher Kinker, 21, is facing child abuse charges resulting in injury for what investigators say he did to his own baby. According to the criminal complaint filed with the magistrate, emergency crews were called to Kinker's home on Banfield Avenue last Friday after a call for help for an infant who wasn't breathing. The 7-week old was rushed to Children's Hospital in Pittsburgh, where doctors made a startling discovery.
According to court papers, the child, had "multiple skull fractures and other injuries," including "multiple broken ribs, which were in the process of healing."
The investigator also noted in the complaint that when asked, Kinker admitted to shaking the child's bassinet repeatedly because the baby wouldn't stop crying.
He's being held on $50,000 bond. The investigation is ongoing.

An 11-month-old Kenosha, Wisconsin, girl suffered fatal injuries Tuesday evening at the hands of her father, police said, in what the town's police chief described as "the most violent child death that I have ever seen."
"This is Serenity Rose who was killed by her father," Chief John Morrissey said during a media briefing, holding a photo of the girl.
An autopsy performed Wednesday revealed the child died from multiple blunt force injuries including several skull fractures. Charges against the father, identified as 34-year-old Russell Lamar Rose, are pending.
"The words that I would like to say about this individual are probably not fit for the media," Morrissey said, "so I'm simply going to refer to him as a monster."
Morrissey said officers responded to a domestic violence call just before 7 p.m. Tuesday from a 27-year-old woman screaming that someone killed her baby. Witnesses told police they heard screams for help and a baby crying outside a triplex in the 5000 block of 21st Avenue.
Morrissey said the witnesses told police they saw Rose hold Serenity over his head and drop her to the ground.
Rose then ran into the apartment, Morrissey said, and officers who surrounded the apartment saw the man setting fire to the curtains. Rose, who police said has an extensive criminal record, later was arrested without incident.
The child was found lifeless, badly bruised and bloody, Morrissey said. Her face was partially disfigured. Serenity's mother, who was not named by police, suffered a swollen face and lacerations.
Serenity and her mother were transported to Kenosha Hospital and Medical Center where the mother was treated for her injuries and the child was pronounced dead.
Morrissey said the incident began because Rose wanted the mother to move out of their home.
"The death of any child is traumatic," Morrissey said, "but for a child to be killed in such a violent nature is unthinkable."
On Wednesday the Kenosha Police Department changed its Facebook cover photo to "reflect on the tragic incident" involving the "death of an 11-month-old baby as a result of Child Abuse."
"The toll this has taken on our officers who were on scene, along with the Fire Department personnel, hospital personnel, etc has been gut wrenching and extremely sad," the department wrote on Facebook, adding, "In memory of the 11 month old victim, this will be our last FB posting for today."

Dad charged with 2nd-degree murder in brutal beating death of 8-month-old daughter; blamed baby's 2-year-old sister (King County, Washington)
Notice that the mother was stuck working a night shift--even with two young children and a baby. Wonder if this batterer and abusive father even had a job.

A Washington man has been charged with second-degree murder for beating his infant daughter to death with an X-Box controller, police say.
Authorities say Ahmed Ibrahim, 26, of Burien, smashed his 8-month-old daughter's skull on Monday and then tried to convince police that his two-year-old daughter was the one who killed the infant.
King County sheriff's deputies responded to the home Monday morning after receiving a call from the child's mother saying her baby wasn't breathing, KOMO News reports.
Deputies arrived to find the 8-month-old visibly battered with trauma to her head and her face distorted. The child was pronounced dead at the scene.
An autopsy found the infant had multiple skull fractures and died from severe, blunt force trauma to her head and torso.
The medical examiner's office said it is 'highly unlikely' that a two-year-old caused such damage, according to The Seattle Times.
Seattle PI reports that Cecelia Gregson, senior deputy prosecutor, described the child's murder as 'brutal and sadistic' saying that Ibrahim 'viciously beat' the child.
The child's mother told authorities that she had left the infant and her two other children -- girls aged four and two -- in the care of her husband at 12.30am. She returned home from work at 10.30am and found Ibrahim lounging in a chair with the infant resting on his chest, Seattle PI reports.
She changed her clothes then went to pick up her baby only to find the child's face distorted and her body cold to the touch. She then rushed to a nearby relative's home for help.
After obtaining a search warrant, investigators arrested Ibrahim and described him as being 'on something' saying his speech was slurred and he repeatedly nodded off.
Ibrahim described the infant as an 'aggressive child' and blamed the deceased 8-month-old for picking a fight with his two-year-old daughter who, he said, caused the infant's injuries by kicking and hitting her, KOMO News reports.
Investigators believe that the infant died shortly after Ibrahim beat her with an X-Box controller. Ibrahim denied drinking alcohol to police, but bottles of liquor were found in the home, Seattle PI reports. Ibrahim also denied abusing his children.
However, the child's mother confessed that Ibrahim has a history of beating both her and their three children, KOMO reports. He reportedly beat the children with cords and hangers often, and even forcefully squeezes their lips shut when they cry.
Ibrahim was arrested Monday and charged Thursday with second-degree murder. He is being held at the Norm Maleng Regional Justice Center in Kent with bail set at $1 million.
So much more could be done to help women escape from situations like this--starting with locking up batters BEFORE they kill somebody.

A Blaine father is being accused in Anoka County District Court of severely injuring his 3-month-old son.
Brandon Joseph Kushinski, 23, was arraigned Oct. 17 on two felony charges of first-degree assault and malicious punishment of a child. His next court appearance is Nov. 12.
According to the criminal complaint, the Blaine Police Department Oct. 1 were alerted to an alleged abuse of a 3-month-old boy who had been brought to the hospital on Sept. 30 and Oct. 1.
The mother told police that her child had vomited the morning of Sept. 30. She stayed home from work that day and later took her child to the hospital when his symptoms did not improve. The child was treated with IV fluids and sent home in the early morning hours of Oct. 1. She went to work and her husband called her about 6 p.m. to say their son had just vomited and they were on their way to the hospital. Kushinski called 911 at 5:54 p.m., according to the complaint.
Dr. Mark Hudson of the Midwest Children’s Resource Center told authorities that the child had a left skull fracture, subdural hematoma and retinal hemorrhaging. He opined that the injuries were indicative of significant blunt force trauma and consistent with abuse, according to the complaint.
A full skeletal examination revealed he had also sustained healing fractures to his left posterior seventh and eighth ribs and possibly the sixth rib. Medical staff said the fractures were approximately one week old, according to the complaint.
Kushinski provided a voluntary statement to police Oct. 2, which was detailed in the complaint. He said he had been kneeling at the foot of his bed changing the diaper of his 13-month-old child. His 3-month-old was on the bed near the other child’s head.
At one point, the infant allegedly started to roll toward the other child’s head and Kushinski shoved him on the head to push him away. The 3-month-old screamed and cried. Kushinski said he was frustrated at the time and noticed a red mark on the baby’s head above his left ear afterward.
According to the complaint, Kushinski said when he picked both of them up, he squeezed them to avoid dropping them. The 3-month-old fussed and cried and Kushinski said he was immediately concerned. He allegedly told police that he believed he had caused the skull and rib fractures, according to the complaint.
On Oct. 9, law enforcement was informed that the infant was receiving anti-seizure medication due to having several seizures since being admitted to the hospital Oct. 1, according to the complaint. His breathing tubes had been removed, but he was still receiving nutrition with a feeding tube. Medical staff told authorities the child may have permanent brain damage, but the extent of damage would have to be monitored.

"Stay-at-home" dad found guilty of murder in death of 4-month-old daughter (Orlando, Florida)
Yet another "stay-at-home" dad who bashed the baby. This one succeeded in killing her. Too often these guys become "stay-at-home" dads because they are unwilling/unable to get a job--sometimes because of a past criminal record. So desperate working mothers put them in charge of infant care. Not a good idea. It's too bad we don't have paid maternity leave in this country, and way to get violent moochers like this one into the labor force and away from young kids.

Father guilty of murder, aggravated child abuse in daughter's death

A stay-at-home father left to care for his 4-month-old daughter the day she died is responsible for the "catastrophic" injuries that killed the little girl about three years ago, a jury decided Thursday afternoon.
Luis Omar Rivera, 29, was convicted of first-degree murder and aggravated child abuse charges after his infant daughter Jaliya Rivera died of blunt-force head trauma which caused multiple skull fractures in November 2010.
Jaliya's mother, Sadie Diaz, and her family sobbed silently as the verdict was read.
"I died on November 19, 2010," Diaz said to Rivera before he was sentenced to life in prison for his daughter's death. "You were a heartless monster who couldn't just love your own daughter. My heart is completely broken."
According to prosecutor Pam Davis, Jaliya was a "bubbly" baby who was still too young to roll over on her own. Rivera cared for the child while his wife worked.
Every morning the couple would wake up about 6:30 a.m. so Diaz could prepare for work and Rivera could feed their daughter. That's how the day started on Nov.18, 2010.
When he was interviewed by police, Rivera said he fed his daughter early that morning then went back to bed. When he woke up a short time later to change the little girl's diaper, that's when he realized his daughter wasn't breathing.
Rivera told police he called his mother instead of 911 because he didn't have the money to pay for an expensive ambulance. His daughter spent the night in the hospital and was pronounced dead the next day.
Since that day, Rivera has maintained that he was not responsible for his daughter's severe injuries.
Rivera's attorney, Gerod Hooper, called the police work that let to Rivera's arrest a "make-it-fit" investigation.
"The facts don't fit, so you make it fit," he said to the jury during his closing statement.
Although he agreed with doctors who said Jaliya's wounds were not accidental, he said there was no way to know for sure if Rivera was responsible for inflicting them or if she died from injuries that were inflicted on Nov. 18 or another day when someone else was caring for the infant.
But after 5 hours of deliberation, those seeds of doubt did not resonate with the jury. Rivera said nothing as his sentence was handed down.

One of those witnesses, would have been the baby's 8-year-old brother who was in the family's Bridgewater home Sunday night into Monday morning when Brayden died.
Authorities say the boy's mother was working the overnight shift.
She arrived home after 7 a.m. that morning and found the baby dead on the floor outside the crib.
The felony complaint in this case says Ian Gulbin grabbed and slammed one-year-old Brayden into a hard object causing bruising and contusions to the head and facial areas. He also had two skull fractures, a lacerated liver, and internal bleeding.
Oneida County Assistant District Attorney Dawn Catera-Lupi said, "Basically the case was held for the action of the Grand Jury, which means in the next 45 days it will be presented to the Oneida County Grand Jury."
Brayden's mother, Anastasia Hogen, who is currently pregnant, was in court along with her 8-year-old son. Both would have testified if Ian Gulbin did not waive his right to a felony hearing.

UTICA — If only Jevon Wameling had sought medical attention for his baby son’s head injury.
Maybe 9-month-old Levon would still have been alive to turn 1 year old.
Maybe teddy bears would not now be lining the bridge over the Mohawk River, where Levon’s body had been tossed to its watery grave.
Maybe he wouldn’t be heading to prison soon for allowing his son to die.
But after failing to do what prosecutors say any reasonable parent would have done, knowing that their child was in pain, 27-year-old Wameling found himself ultimately accepting blame for a series of deadly mistakes that never should have happened.
In Oneida County Court, Wameling pleaded guilty Wednesday morning to second-degree manslaughter and will face the maximum 7 ½ to 15 years in prison when he is sentenced Thursday, Jan. 30.
No matter what the public might speculate about how Levon’s head injury was caused, prosecutors firmly point out that nothing suggests Wameling meant to harm his son.
“We have absolutely no proof that this was an intentional homicide,” Oneida County District Attorney Scott McNamara said. “Based on the totality of the facts that we knew and the facts we could prove in court, I can only hope that we have given justice to baby Levon and to baby Levon’s mother, Amy Warney.”
What prosecutors did have were two contradictory stories: On June 11, Wameling first said Levon disappeared from the front porch of his East Utica home. But then in a jailhouse letter to the Observer-Dispatch two weeks ago, Wameling said Levon died in his sleep.
Wameling insists Levon hurt himself after falling off a sofa, McNamara said. And during a visit while Levon’s mother was in jail on May 18 – about 10 days before Levon’s death – Warney claims she told Wameling to take the boy to the hospital after she noticed an injury behind Levon’s left ear.
But Wameling never did, and an autopsy found a crack on the same part of Levon’s skull where Warney says the injury had been, McNamara said.
During Wameling’s surprise plea Wednesday, Wameling simply responded to a series of questions asked by Judge Barry M. Donalty, while Warney sat nearby in the courtroom.
“You knew this child had a medical condition, is that correct? A head injury?” Donalty asked, according to court transcripts.
“Yes,” Wameling replied, acknowledging that he had responsibility for Levon’s welfare as his sole caretaker at that time, starting May 13.
“On May 29 of this year, the child died, is that correct?” Donalty continued. “And rather than call 911, rather than call anybody, you in fact took it upon yourself to put the child in a bag and then the child was placed in the water at the (Mohawk River), is that correct?”
“Yes,” Wameling replied, without elaborating on what prompted him to dispose of Levon in a backpack full of rocks.
Around 2 a.m. that May 29 morning, however, Wameling did leave a frantic voicemail on the phone of Wameling’s mother, McNamara said. When his mother called the next day, Wameling told her he had already taken care of whatever the problem was.
On Wednesday, Wameling also pleaded guilty to two unrelated charges: second-degree burglary for stealing money from his uncle’s home and fourth-degree conspiracy to sell drugs. Wameling will receive five years in prison for the burglary, and two to four years for the drug conspiracy, which will run at the same time as the more serious manslaughter sentence.
Although Wameling had told state police in September where he dumped Levon’s body, investigators continued to interrogate him after he had already asked for an attorney – a legal snafu that prevented prosecutors from being able to use Wameling’s long-awaited answers against him, McNamara said.
Yet, Wameling’s defense attorney, Rebecca Wittman, realized it was best to resolve these matters all at once.
“Because of Jevon Wameling’s actions in disposing of the baby’s body, the District Attorney faced some challenges in establishing the cause and manner of Levon Wameling’s death,” Wittman wrote in a statement. “Conversely, those same actions presented challenges in defending against any charges related to the death of Levon.”
Wittman finished, “We feel we have reached a fair resolution of all matters related to Mr. Wameling.”
Here's a timeline of the series of events from Levon's death to father's guilty plea:
May 18: While in jail, Levon’s mother notices injury behind boy’s left ear and claims she told father Jevon Wameling to take him to the hospital.
May 29: Wameling finds Levon dead in his sleep and leaves a frantic but unrevealing late-night voicemail to Wameling’s mother, then sometime later disposes of baby’s body in Mohawk River.
June 11: About two weeks after Levon died, Wameling tells Utica police that boy disappeared after he was left briefly unattended on the front porch.
Sept. 5: After being charged with burglarizing uncle’s home, Wameling finally tells police where to find Levon in North Utica waterway; a legal mistake, however, prevents prosecutors from being able to use that confession against Wameling.
Sept. 6: Levon’s remains recovered from Mohawk River in backpack full of rocks; autopsy later finds skull fracture, but cause of death is never determined.

UTICA — If only Jevon Wameling had sought medical attention for his baby son’s head injury.
Maybe 9-month-old Levon would still have been alive to turn 1 year old.
Maybe teddy bears would not now be lining the bridge over the Mohawk River, where Levon’s body had been tossed to its watery grave.
Maybe he wouldn’t be heading to prison soon for allowing his son to die.
But after failing to do what prosecutors say any reasonable parent would have done, knowing that their child was in pain, 27-year-old Wameling found himself ultimately accepting blame for a series of deadly mistakes that never should have happened.
In Oneida County Court, Wameling pleaded guilty Wednesday morning to second-degree manslaughter and will face the maximum 7 ½ to 15 years in prison when he is sentenced Thursday, Jan. 30.
No matter what the public might speculate about how Levon’s head injury was caused, prosecutors firmly point out that nothing suggests Wameling meant to harm his son.
“We have absolutely no proof that this was an intentional homicide,” Oneida County District Attorney Scott McNamara said. “Based on the totality of the facts that we knew and the facts we could prove in court, I can only hope that we have given justice to baby Levon and to baby Levon’s mother, Amy Warney.”
What prosecutors did have were two contradictory stories: On June 11, Wameling first said Levon disappeared from the front porch of his East Utica home. But then in a jailhouse letter to the Observer-Dispatch two weeks ago, Wameling said Levon died in his sleep.
Wameling insists Levon hurt himself after falling off a sofa, McNamara said. And during a visit while Levon’s mother was in jail on May 18 – about 10 days before Levon’s death – Warney claims she told Wameling to take the boy to the hospital after she noticed an injury behind Levon’s left ear.
But Wameling never did, and an autopsy found a crack on the same part of Levon’s skull where Warney says the injury had been, McNamara said.
During Wameling’s surprise plea Wednesday, Wameling simply responded to a series of questions asked by Judge Barry M. Donalty, while Warney sat nearby in the courtroom.
“You knew this child had a medical condition, is that correct? A head injury?” Donalty asked, according to court transcripts.
“Yes,” Wameling replied, acknowledging that he had responsibility for Levon’s welfare as his sole caretaker at that time, starting May 13.
“On May 29 of this year, the child died, is that correct?” Donalty continued. “And rather than call 911, rather than call anybody, you in fact took it upon yourself to put the child in a bag and then the child was placed in the water at the (Mohawk River), is that correct?”
“Yes,” Wameling replied, without elaborating on what prompted him to dispose of Levon in a backpack full of rocks.
Around 2 a.m. that May 29 morning, however, Wameling did leave a frantic voicemail on the phone of Wameling’s mother, McNamara said. When his mother called the next day, Wameling told her he had already taken care of whatever the problem was.
On Wednesday, Wameling also pleaded guilty to two unrelated charges: second-degree burglary for stealing money from his uncle’s home and fourth-degree conspiracy to sell drugs. Wameling will receive five years in prison for the burglary, and two to four years for the drug conspiracy, which will run at the same time as the more serious manslaughter sentence.
Although Wameling had told state police in September where he dumped Levon’s body, investigators continued to interrogate him after he had already asked for an attorney – a legal snafu that prevented prosecutors from being able to use Wameling’s long-awaited answers against him, McNamara said.
Yet, Wameling’s defense attorney, Rebecca Wittman, realized it was best to resolve these matters all at once.
“Because of Jevon Wameling’s actions in disposing of the baby’s body, the District Attorney faced some challenges in establishing the cause and manner of Levon Wameling’s death,” Wittman wrote in a statement. “Conversely, those same actions presented challenges in defending against any charges related to the death of Levon.”
Wittman finished, “We feel we have reached a fair resolution of all matters related to Mr. Wameling.”

Some of this account is not very clear, but it appears that the mother and father did not live together, as it mention the mother leaving the baby with the father "at a home" with a particular address.
So was this an informal babysitting arrangement? Court-ordered custody/visitation with a known violent abuser? Obviously not clarified here. Even if this was not court-ordered contact, it speaks to the pressure that single mothers are under to work, find affordable childcare, and "involve" the freaking father--who more often than not is a useless and violent deadbeat who never was husband or father material.

BEAUMONT - Shari Pulliam with Family and Protective Services said a toddler who police say was severely injured by her father died Saturday around 1:24 p.m. at Texas Children's Hospital.
The child's father, identified as Shaquille Rawlins, 20, is already facing an injury to a child charge. He was brought to the Jefferson County jail where he is held on a $25,000 bond.
According to police, the child's mother left the baby with Rawlins Thursday at a home in the 4500 block of Buffalo Avenue. When she returned, she couldn't wake her baby.
"When we arrived, she told us the father had left while she was calling 9-1-1. He returned while we were at the scene. He came to the station and gave a statement," said Sgt. Rob Flores.
That statement was enough for police to arrest Rawlins.
The toddler, just 1 1/2 years old, was rushed to Christus Hospital Saint Elizabeth and then quickly sent to Texas Children's Hospital in Houston where she remains in critical condition.
"Doctors in the emergency room confirmed the baby had multiple skull fractures and multiple abrasions to her body," said Sgt. Flores.
Sitting on a porch near the home where the criminal allegations happened, Theresa McCelland was shocked after hearing about the abuse on the news.
"I was just speechless to all these things going on in this world today with the kids," she told 12News.
McCelland says parents should be the protectors of their children.
"They're supposed to give them love and peace and understanding and raise them right," she said.

It's not real clear in this account, but it sounds like dad JONATHAN QUISANO is a single dad. Notice that the grandmother dropped off the child at "his" house. And that Dad ended up calling the mother and SHE was the one who called the paramedics. Wonder if this involved a court-ordered custody/visitation agreement....

(LVMPD) LAS VEGAS (FOX5) - A Las Vegas father facing a first-degree child abuse murder charge following the death of his 3-year-old son is scheduled to appear in court. A felony arraignment for Jonathan Quisano, 26, was slated for 8 a.m. Wednesday in Las Vegas Justice Court.
Quisano is being held in Clark County Detention Center without bail following his arrest last month.
In a Las Vegas Metro police arrest report, Quisano claims his son Khayden fell over the back of a couch while he was watching him on June 6.
In the report, Quisano told police Khayden was dropped off by the boy's grandmother at his residence in the 4700 block of Trim Water Court after he returned from work.
Quisano, in the report, told police he tried splashing water on the boy's face after the fall. The boy began to vomit and cough up blood, the report said. Quisano told police in the report he called the child's mother about the emergency and she called paramedics.
Police, in the report, found Quisano's story inconsistent with the injuries an attending doctor at University Medical Center saw.
According to the report, the doctor said the child suffered two skull fractures, severely bruised lungs and a possible lacerated spleen.
Quisano, in the report, denied injuring the child but did not offer an explanation for the injuries. Metro said Quisano has no prior arrests in its jurisdiction.
Metro said officers haven't been called to the home for reports of abuse. Child Protective Services said its agency does not have any prior history with the family. CPS has placed another family member in its care.

Custodial dad charged in death of 2-year-old son; boy died from multiple skull fractures (Oroville, California)
Another one of those cases where dad's custodial status is well-disguised. First we see the reference to dad MICHAEL LESLIE DOLLAR's "girlfriend." Usually, this is not the mother or the reporter would say so--though some reporters are sloppy. Also notice, however, that it is later clarified that the little boy "lived with" his father--which wouldn't have to be stated if he was married to the biological mother. Also notice the references to a half brother, which also tend to confirm that the "girlfriend" is not the mother of the murdered child.
This poor little boy's skull was fractured in five places before he died. Who gave this father custody and why? What happened to the mother?

Bangor resident Michael Leslie Dollar, 25, will be arraigned today on a charge of assault on a child causing death, according to Butte County District Attorney Mike Ramsey.
Oroville Police Department has been investigating the case for two years.
Nov. 11, 2010, Dollar and his girlfriend took 16-month-old Deagan Jackson to the emergency room at Oroville Hospital with unknown injuries.
Hospital officials called the police department and reported the baby had a grave head injury, according to earlier reports.
The baby was transferred to U.C. Davis Medical Center in Sacramento, but was pronounced dead the next morning.
Dollar lived with the boy in Oroville at the time of the incident. Ramsey said Dollar initially told police the boy had been playing in a bedroom with his 2-year-old half brother and that he believed Deagan had fallen out of his bed.
An autopsy determined the cause of death was blunt-force trauma. The child's skull was fractured in five places, Ramsey said.
Dollar is in custody at Butte County Jail with bail set at $1 million. He could face a sentence of 25 years to life in prison if convicted.

An Upper Moreland man told police three different stories about the night his 2-month-old daughter died, but none matched the injuries she suffered, according to authorities.
Police said they documented those stories, which were presented as evidence Tuesday during the preliminary hearing for Edward J. Doyle, 29, of the 2500 block of Horsham Road. He's charged with third-degree murder in the child's death.
The prosecution’s case was brief, summarized by a copy of Makayla Doyle’s death certificate and the statement Doyle gave to police the day she died. On the death certificate, forensic pathologist Isidore Mihalakis ruled that Makayla died of multiple traumatic injuries and that the manner of her death was homicide.
Defense attorney Robert Hoopes argued that the third-degree murder charge shouldn’t apply to his client because there was no clear indication that Doyle was aware his behavior could result in Makayla’s death.
District Judge Paul Leo, however, held the murder charge along with charges of recklessly endangering another person and making an unsworn falsification to authorities, moving the case to Montgomery County Court of Common Pleas. A formal arraignment is scheduled for July 17.
Doyle’s statement, which changed three times over a six-hour period Feb. 24, was given to detectives hours after Makayla’s death when he and his father went to the Upper Moreland police station, Montgomery County Detective Paul Bradbury has said. In all three versions, Doyle said he’d gone out drinking to celebrate a friend’s birthday and that, after returning home, his wife went down to a neighbors apartment to get a movie while he went to sleep on his couch, according to a copy of the statement given to the court.
In the first statement, Doyle said he woke that Sunday morning to find Makayla looking “white as a ghost” and “limp,” and called 911. According to the second statement, Doyle said he accidentally struck the back of Makayla’s head while patting her back because he was distracted by something his wife said. And in the third statement, Doyle said he tripped and fell on the child while holding her. Doyle told investigators he weighed 275 pounds at the time.
Makayla’s ribs were crushed, according to court records. Mihalakis told police that none of the injuries were consistent with Doyle’s videotaped reenactment of events and said that in addition to crushed ribs, Makayla had multiple skull fractures. And evidence showed her nose was pinched to prevent her breathing, prosecutors have said.
Doyle has previously pleaded guilty to reduced charges of harassment and disorderly conduct after police investigated a report from Doyle’s wife that he choked her and threw her to the ground. He is being held in Montgomery County prison without bail.

St. Louis man convicted of beating 2-year-old son to death
Jury says Aaron Lucy, 32, committed first-degree murder in assault that left bruises and scrapes on nearly every surface of the boy's body.
ST. LOUIS • A St. Louis man convicted of brutally beating his 2-year-old son to death was sentenced Thursday to life in prison without the possibility of parole.
Aaron Lucy, 32, was sentenced by St. Louis Circuit Judge Robin Vannoy. In January, a jury found Lucy guilty of first-degree murder and four felony counts of child abuse, evidence tampering and armed criminal action in the death of his son, Kyle Lucy.
Prosecutors said Lucy beat Kyle to death the afternoon or evening of Dec. 26, 2010, when the two were alone together for several hours at Lucy’s apartment in the 6900 block of Chippewa Street. Other family members were at a Christmas play.
Authorities said Lucy left bruises and scrapes on almost every part of the toddler’s body and caused two skull fractures and a fatal brain injury. Blood was found throughout the apartment, including on the back of a picture frame and a broken drawer that, along with an overturned television, had been thrown across the floor.
“What Aaron took from us has been devastating,” the boy’s mother, Amanda Newman, 30, of St. Louis County, said in court Thursday. “I don’t look at people the same way as I did before. I don’t look at people and wonder what they can offer me and my life. I now look at people and wonder what they will take from me or how they (will) hurt me. The world got a little darker that day.”

Aaron Lucy’s mother, Gloria Lucy, told the court she believes her son is not “a monster.” She said he had received psychiatric treatment since middle school and suffered from bipolar disorder. She said a mental hospital would be a more effective sentence than prison.
“My son loved his kids dearly,” Gloria Lucy said. “He never mistreated Kyle. The way Kyle died wasn’t abuse, in my opinion. It was rage. I don’t know what happened that night. I really don’t.”
Newman says she, too, still doesn’t know why Aaron Lucy killed Kyle, and says the only time she saw him lose his temper was when he was intoxicated. She said she thought he had stopped drinking alcohol at least a year earlier, but she wonders whether he was drunk the night Kyle died.
Newman said she was satisfied with the life sentence because she believes it will keep Lucy away from their daughter, Abby, who is now 7. Newman said Abby now understands it was her father who ended Kyle’s life, but Newman shields her from the horror of how the boy died.
“When she gets older, she has every right to know every detail,” she said.

St. Louis man convicted of beating 2-year-old son to death
Jury says Aaron Lucy, 32, committed first-degree murder in assault that left bruises and scrapes on nearly every surface of the boy's body.
ST. LOUIS • A St. Louis man convicted of brutally beating his 2-year-old son to death was sentenced Thursday to life in prison without the possibility of parole.
Aaron Lucy, 32, was sentenced by St. Louis Circuit Judge Robin Vannoy. In January, a jury found Lucy guilty of first-degree murder and four felony counts of child abuse, evidence tampering and armed criminal action in the death of his son, Kyle Lucy.
Prosecutors said Lucy beat Kyle to death the afternoon or evening of Dec. 26, 2010, when the two were alone together for several hours at Lucy’s apartment in the 6900 block of Chippewa Street. Other family members were at a Christmas play.
Authorities said Lucy left bruises and scrapes on almost every part of the toddler’s body and caused two skull fractures and a fatal brain injury. Blood was found throughout the apartment, including on the back of a picture frame and a broken drawer that, along with an overturned television, had been thrown across the floor.
“What Aaron took from us has been devastating,” the boy’s mother, Amanda Newman, 30, of St. Louis County, said in court Thursday. “I don’t look at people the same way as I did before. I don’t look at people and wonder what they can offer me and my life. I now look at people and wonder what they will take from me or how they (will) hurt me. The world got a little darker that day.”
