A suspended Mountie continued his assertions in an Ottawa court today that he had been a victim of abuse and that, in a fog; he had seen his son as the enemy during the time in which he beat and confined him. The Crown prosecutor was having none of that. The focus today was finding the truth and that discussion led to a combative day between the Crown and the accused who maintained he was legally responsible for abusing his son but not morally.

The boy was just 7 years old when he moved in with his father and stepmother after his birth mother died. Within 4 months of that move, he would spend his first night sleeping in the unfinished basement as punishment.

"He was out of control from the moment he arrived," the father testified in court today, "I was constantly putting out fires."

The 44-year-old father is a suspended RCMP officer, on trial, along with his 36-year-old wife, for confining his son and denying him the necessities of life. The father is also charged with sexual assault.

The man told court that he had hired a child psychologist to ostensibly deal with his son's behavior. When the doctor suggested that the father was "terrorizing his son", court heard that the father ended sessions.

The accused has maintained throughout the Crown's cross examination that he was a man under duress, driven by the demons from his past to view his own son as a demon.

"I don't know what the hell I was doing,” he told court, “why I beat my son, why I burned him."

He has agreed to the abuse, but is mounting a defense, trying to prove he suffers from post-traumatic stress disorder after he says he was raped as child in Lebanon; that he internalized this abuse and saw his son as the enemy.

After 4 years of living in this situation, the son escaped from the chains binding him in the basement and managed to flee the house while rest of family was shopping. He was 11 years old at this point in time and weighed 50 pounds. Doctors at CHEO, who examined him, said he almost starved to death.

When the father returned home and found him missing, he called 911. That was February 12, 2013.

"I’m guilty of this,” he told the 911 operator, “I did bad things with him. I did bad things to him and I regret it."

From here, followed a frustrating exchange between the Crown, trying to prove this man knew exactly what he was doing, and the father maintaining he was living in a fog.

At one point, the Crown presented a 6-foot long piece of wood flooring; similar to what the father admits he used to hit his son.

"Did you hit him on the arm?" the Crown asked.

"I don't know," he answered.

"Did you hit him on the stomach or the head?"

"I don't know," he repeated.

He said he remembers hitting and burning his son but added he didn't rationalize what he was doing. The trial continues tomorrow.

Father and son face separate sex assault charges

The son of a Rindge lawyer accused of sexually assaulting a child in the 1990s was indicted on unrelated sex assault charges.

Luke Czekalski, 26, of Jaffrey is charged with seven counts of aggravated felonious sexual assault on a child.

On Oct. 9, Jaffrey police received a report of a possible sexual assault. After an investigation, police arrested Luke Czekalski on Oct. 30, alleging he sexually assaulted a 6-year-old girl.

It is unclear from court documents how many times the alleged assaults occurred.

An indictment is not an indication of guilt, it is a determination by a grand jury that there is enough evidence to go to trial. Meanwhile, a separate months-long investigation conducted by Rindge and State Police led to the Jan. 25 arrest of Luke Czekalski’s father, Jason A. Czekalski, 51, at his home in Rindge.

Jason Czekalski is charged with one count of aggravated felonious sexual assault and two counts of felonious sexual assault.

Jason Czekalski engaged in a pattern of sexual contact with an 11-year-old child he knew between March 1993 and December 1995, according to court documents. His case has since been forwarded to Cheshire County Superior Court.

Police say the alleged incidents are unrelated.

Luke’s issues had nothing to do with the father,” Jaffrey Police Chief William J. Oswalt said in an interview.

Both men are being held at the Cheshire County jail in Keene.

Father Jailed For Sexually Abusing Daugther

LAGOS - An Ojo Magistrates’ Court in Lagos has, sentenced a 42-year-old man, Udom Emmanuel, to three years imprisonment with hard labour for defiling his 15-year-old daughter.

The Magistrate, Mr T.O. Shomade, said that the sentence was without an option of fine.

“The accused has pleaded guilty to the charge against him before this honourable court.

“He is therefore, convicted as charged and sentenced to three years imprisonment without option of fine,” Shomade ruled.

Reports say that the father, a resident of Etegbin area in Ojo, Lagos, had pleaded guilty to the one-count charge of defilement when he was arraigned.

The Prosecutor, ASP. Friday Eze, told the court that the accused, a bricklayer, committed the offence on Sept. 23.

According to him, the father, who is a widower, had regularly abused his 15-year-old daughter.

He said that the girl’s aunt, who had paid them a visit, discovered that the young lady was not looking good.

According to the prosecutor, upon her inquiry she discovered that it was likely that someone was sexually abusing the young lady.

Eze said that the woman then called on the girl and demanded to know what was wrong with her since she looked sick.

He said that after intensive interrogation, the girl confided in her aunt that her father had been forcefully having sexual intercourse with her.

The prosecutor said that the aunt learnt from her niece that the accused had told his daughter that if she refused his advances, he would stop paying her school fees.

Eze said that the aunt then took the girl to the hospital for a medical check, where it was discovered that she was already a month pregnant.

The prosecutor said that the woman then made a report at the Ojo Police Station, resulting to the arrest of Emmanuel.

He said that the offence contravened section 137 of the Criminal Code Laws of Lagos State, 2011.

A Michigan man has been found guilty of murdering his 15-week-old daughter while orally raping her, the Huffington Post reports.

26-year-old Steven Deuman was convicted of first-degree murder and aggravated sexual assault Wednesday, and faces a mandatory sentence of life in prison without parole.

The baby girl, Evelynne Deuman, was found dead in her father’s home with a condom in her mouth on August 12, 2011. Deuman called his daughter’s mother saying he left the child in bed to go have a smoke, and returned to find the girl unresponsive on the bedroom floor.

An autopsy found that the 15-week-old died of asphyxiation. The prosecution said her father’s claims that she fell out of the bed and choked on a discarded condom didn’t make sense.

Assistant US Attorney Phil Green said, “Even if [she did end up on the floor,] how was she going to suck that condom up?”

The FBI, which was investigating the case since it happened on tribal land, alleged that Deuman had murdered his daughter “during the perpetration, or attempted perpetration, of aggravated sexual abuse.” Deuman was living on the Grand Traverse Band of Ottawa and Chippewa Indians Reservation in northern Michigan.

A forensic pathologist hired by the defense testified that the condom and autopsy were not evidence that Deuman raped or killed his daughter.

“Anything’s possible, but I have difficulty envisioning that,” Ljubisa Jovan Dragovic, the forensic pathologist, said.

During Wednesday’s hearing, Assistant US Attorney Green said:

“This was a very difficult case for anyone to have to hear. This is about as heinous as it gets. That’s a tragic reality here. He did do it. A beautiful 15-week-old baby girl lost her life, lost her future, because of his need for sexual gratification.”

Natasha Maitland, Evelynne Deuman’s mother, testified on behalf of the prosecution, and Green applauded her courage throughout the whole process.

“She is a remarkable young woman. It’s my fervent hope she can put her life back together. She was forced to endure (a loss) no one should ever have to endure,” Green said.

Several other witnesses testified that they had been molested by Steven Deuman when they were children, but defense attorney Richard Stroba claimed his client was a “proud father” who wouldn’t hurt his children. Deuman, Maitland, and their two children, along with several other people were living in a double-wide mobile home, and Stroba said the baby girl’s death wasn’t really a surprise.

“The reality is, that room, that house, was an accident waiting to happen,” Stroba said.

Dad wanted on rape and kidnapping charges a suspect in "suspicious" drowning death of 4-year-old son; where is the mother? (Reynoldsburg, Ohio)

Where to even start with this mess. Dad ALFRED E. HILL is apparently suspected in the "suspicious" drowning death of his 4-year-old son. Police investigators then find out that Daddy is already wanted on "unrelated" kidnapping and rape charges from the previous year. Then, in a rather confusing way, it is revealed that this father does NOT live with the mother of this child, but has been staying one step ahead of the law by "staying with various girlfriends." Or living with his sisters and a younger brother. Whatever.

SO WHERE IS THE MOTHER? The reporter didn't even bother to find out. Did Daddy have full custody? Joint custody? Visitation? Was it Mom's idea that a father bopping around from house to house, trying to dodge the cops on a rape and kidnapping charge, should have the care of a pre-Kindergartener? Or was this some nitwit judge's idea of quality fathering?

But never fear! The idiots are here! A moronic neighbor tells us that Hill was a "family oriented" guy! Yes he was! Suspected rapists on the lam are the very best of fathers, don't you know!

This is how low we have set the bar these days for good fathers....Horrifying.

Police investigating child's death arrest dad on year-old rape charges

Police who went to a Reynoldsburg home this morning to investigate the death of a 4-year-old boy ended up arresting his father, after they found he was wanted on unrelated kidnapping and rape charges from a year ago.

Alfred A. Hill, 26, was in the Franklin County jail tonight after police found him near the apartment he shared with three siblings.

The incident began about 9:30 a.m., when Truro Township firefighters were called to 1229 Baytree Court on the report of a child not breathing.

There they found Hill’s son, Alfred Hill, 4, not breathing, said Reynoldsburg acting police chief Jim O’Neill.

The boy was taken to Nationwide Children’s Hospital, where he later died. An autopsy will be performed on Friday, said Franklin County Coroner Jan Gorniak.

Police are calling the death suspicious.

Family members at the apartment told police that Alfred had been in the bathtub and might have choked or drowned. It was unclear tonight who had called 911 and whether the boy was found in the tub.

When police detectives investigating the death returned to the apartment around 1:30 p.m., they had found out that the child’s father was wanted by Columbus police on rape and kidnapping charges from a 2011 incident.

Police searched the Eden at Reynoldsburg apartment complex for about 10 minutes. A maintenance worker alerted police to Hill in a courtyard area.

Columbus police SWAT officers and U.S. marshals had been looking for Hill for months, said Columbus police Sgt. Terry McConnell. A warrant was filed on July 7, 2011, accusing Hill of kidnapping a 19-year-old woman from her Oakwood Avenue house on the South Side during the early morning hours of July 6, 2011. The 6-foot-3, 285-pound Hill forced her to have sex, court records say.

McConnell said that during the past year, Hill had managed to stay one step ahead of law-enforcement officers by staying with different girlfriends. Kevin Veal, 28, said Hill had been living next door for the past couple of months with two of his sisters, a younger brother and about four children.

Veal said the Hill he knew was a “family oriented” guy.

Veal said he knew that something was wrong quickly this morning when he said hello to one of Hill’s sisters.

“I seen a look on her face that I’ve never seen before,” he said. Moments later, paramedics arrived.

DAYTON, Ohio (AP) - An adoptive father who's been accused of raping three boys in his care was indicted along with another man Friday on rape charges.

The 39-year-old adoptive father from Troy was indicted by a Montgomery County grand jury on three counts of rape of a child under 13 and four counts of complicity to commit rape of a child under 13. Patrick Rieder, 31, of Dayton, was indicted on four counts of rape of a child under 13.

The adoptive father is accused of bringing the boy to Rieder's home, where both men engaged in sexual conduct with the child, county prosecutor Mat Heck Jr. said. The men were introduced in a chat room and eventually agreed to meet, Heck said.

The Associated Press is withholding the father's name to protect the child's identity.

All the counts carry a possible penalty of 10 years to life. Both men also were indicted with sexually violent predator specifications that would make the sentences 25 years to life on each count if the men are convicted.

Rieder's attorney didn't immediately return calls for comment Friday. Court records don't list an attorney for the adoptive father, who is in Miami County jail awaiting trial on 31 counts of rape involving three boys in his care.

The adoptive father was indicted in March in a Miami County on charges that he raped the three boys.

A third man, 29-year-old Jason Zwick, of Beavercreek, was indicted in March in Miami County on three counts of rape. Prosecutors say he raped a boy in meetings arranged through the adoptive father.

Both the adoptive father and Zwick have pleaded not guilty to the charges in Miami County. Zwick's lawyer hasn't returned messages for comment.

Officials have said that the Troy man adopted three children, including a 9-year-old girl, and was in the process of adopting a fourth child.

Authorities have said Zwick raped a boy at the adoptive father's home in Troy. They say the adoptive father took the boy Rieder is accused of raping to Rieder's Dayton home.

All three men were arrested after an undercover investigation.

Ohio authorities have said they're investigating a private adoption agency that helped place the children with the man. If Ohio Department of Job and Family Services investigators find serious procedural violations, the state could take actions including revoking the license of Action Inc. Several messages left at Action's office in Dayton haven't been returned.

Police officer denied bail and remanded in custody over charges of defiling 11-year-old daughter.

A police officer was denied bail after facing charges of the defilement of his 11-year-old daughter.

The officer, whose name cannot be published by court order, is a driver to an assistant commissioner.

He was arrested after a police report was filed by his estranged wife. The two are undergoing separation procedures.

It was the daughter who allegedly told the mother about the abuse she sustained at the hands of her father.

Prosecuting inspector Marie-Louise Calleja insisted that this was a serious crime committed by a public officer and that all precautions were taken during investigation.

The defence, led by lawyers José Herrera and Michael Sciriha, argued that their client is undergoing separation procedures with his wife and that there are outstanding issues on the biological paternity of their child, and over the father's disciplinarian parenting.

The defence argued that their client has served for 25 years in the police force and was due to retire in a month, and asked the courts to consider how delicate this case was given the hardship he would endure even if eventually acquitted.

Inspector Calleja assured the defence that it was her priority, as in any case, to see whether this was a matter of spousal pique, but from the evidence she had collected this was not the case.

She added that as soon as the officer's wife got wind of the accusations from her daughter, the mother fled the matrimonial home and is now living in a social shelter. "Granting the accused bail would leave the mother and daughter as victims, and privilege the abuser by leaving him in the matrimonial home."

Magistrate Claire Zammit Stafrace denied the request for bail on the grounds of the seriousness of the charges and the possibility of tampering of evidence.

She recommended the director of prisons to provide for the security of the police officer while in custody.

GREENVILLE, N.C. - A local nurse and his son are charged with multiple counts of sexual exploitation of a child.

The Pitt County Sheriff's Office says Melvin Wetzel is charged with 10 counts of sexual exploitation of a child.

According to online records, Wetzel works at the East Carolina Anesthesia Associates in Greenville.

His son Andrew Wetzel, a student at DH Conley, has been charged with 7 counts of sexual exploitation of a child.

A spokesperson says the two were downloading images of children on their computers. At this time they have no reason to believe any of the children in the pictures are local.

Melivin Wetzel is under a 3 million dollar bond, while Andrew Wetzel is under a 30-thousand dollar bond.

A FATHER has been jailed for more than 12 years after a court heard he sexually abused his three children so regularly on a Saturday night, they grew to dread that night of the week.

Although events were happy and normal on other nights the two girls and their brother knew what would happen to one or more of them when their mother went to visit her sister that night of the weekend.

Philip Adams, prosecuting, told Leeds Crown Court yesterday the abuse spanned about a 10-year period from 1973 but the children felt they could not speak out, and even when they were adults and spoke for the first time together they decided to remain quiet for the sake of their mother.

But he said the offences came to light last year after their father told his sister what he had done and the police were informed.

An investigation began and the trio then described their childhood ordeal, revealing how their father would indecently assault them while washing them in the bath and make them touch him sexually after he had a bath.

One girl said she knew what would follow when he told her to bring the cleaning fluid to the bathroom.

He also accepted simulating sex with one of the youngsters in the bath. The boy said his sisters suffered more attention than him.

One of his sisters said she was also made to touch her father in front of her brother on occasions while they were watching television downstairs.

In a victim impact statement one said: “A dad should be someone who you can put your trust in, who does not betray your trust.”

Jailing the 63-year-old grandfather from Leeds for a total of 12 and a half years, Judge Sally Cahill QC told him: “It appears every Saturday night was a night these three children came to dread.”

She said when their mother went out “you targeted these three children and used them for your own purposes.”

While there was no physical coercion there was emotional pressure because “you were there father which meant these children had no choice whatsoever.”

The father admitted 14 charges of indecent assault and 14 of indecency with a child.

Research shows a strong link between domestic violence and child abuse.
Various studies show that in 30 to 60 percent of families where there is woman battering or child maltreatment it is likely that both forms of abuse exist.
That's according to Jeffrey Edleson, a University of Minnesota professor and authority on children exposed to domestic violence.
Jackie Johnson, the children's services supervisor for Harmony House, said she's seen this in some of the children she cares for.
"When a woman is being abused, there's a greater likelihood of child abuse," Johnson said. "Some of our girls have been sexually abused as well."
Researchers have found that the children are also more likely to be abused in larger families. Abused mothers might, in turn, abuse their children.
Florida psychologist Lenore Walker, who has studied battered women extensively, found that battered women were eight times more likely to use harsh discipline on their children while living with the abuser.
"They're much more likely to use abusive techniques than when they're not in abusive relationships,"
Walker said. "I think there's just a sense of desperation to get the kids quiet or do whatever the batterer wants them to do."
Johnson said mothers sometimes come to her for advice in how to discipline their children. She showed one mom how she encouraged the children when it was time to pick up toys by singing a song.
Kendall Seal, an attorney for Legal Services of Southern Missouri, said if the Springfield community wants to get serious about chid abuse, it needs to confront domestic violence.
Seal said, "If we're not dealing with the family unit where we know there's violence, are we really that surprised when children end up dead or battered or used as pawns?"

Now her father, a firefighter, could spend the rest of his life behind bars.

"I hope to God this man never gets out of jail, " says Romulus Police Chief Robert Dickerson.

26-years on the force and Dickerson says he has never seen anything so horrific.

The 48-year-old father is accused of sexual abuse, is a trusted public servant --a firefighter with an unnamed downriver fire department for more than 16 years. He was arrested near his Romulus home, still in his firefighter uniform at the time.

The 15-year-old claims the sexual abuse started when she was just 13. Police say the man also took pornographic photos of her. They confiscated his computers, cameras, disks when they searched his home and his locker at the fire station. Lange was told he even admitted to some of what's being alleged against him.

Police say the girl had to sleep with her father , raise her younger siblings, all while going to school each day, pretending she was ok . But she had enough. She ran away to her mother, who took her to the police.

The man may be arraigned as soon as Saturday.

Chief Dickerson is urging all parents to talk to their children over this Holiday break to ind out what's really going on in their lives --at home, at school - everywhere.

And kids speak up. Dickerson says if you need to, call 911 and the police will come pick you up.

Junkie dad on trial for killing "friend's" 2-month-old son; dad's own son also had signs of brain injury, anal trauma (Fort Carson, Colorado)

Notice that this isn't some random "man." This junkie (addicted to heroin) was "caretaking" for his own infant son as well as the 2-month-old infant son of "a friend."

A former Fort Carson soldier was craving heroin and reeling from a sleepless night when he lashed out against a friend’s 2-month-old son, inflicting injuries that would ultimately kill him, prosecutors said Thursday.

But according to George Peters’ defense attorneys, the child wasn’t the victim of homicide, as prosecutors allege.

They contend that Nicholas Johnson died from an undiagnosed brain injury as Peters bounced the child in an effort to calm his crying.

Those conflicting portraits of the boy’s Feb. 11 death were highlighted as attorneys sparred over evidence on the final day of Peters’ nearly two-week murder trial before 4th Judicial District Judge Thomas L. Kennedy.

The jury was sent home at 5 p.m. and will resume deliberations Friday.

Peters, 24, will spend the rest of his life in prison if convicted of first-degree murder in the boy’s death. He also faces multiple counts of child abuse against both Nicholas and Peters’ infant son Gabriel.

During closing arguments, prosecutors cited testimony by medical experts who tied Nicholas’ death to trauma similar to shaken-baby syndrome.

They also focused on Peters’ heroin use, saying that several days without the drug helped drive him to the breaking point while caring for two fussy baby boys. Peters was caring for his son and babysitting for another Fort Carson soldier in his apartment in the 3900 block of Patrick Drive.

The boy’s mother tipped her head and wept as prosecutor Gail Warkentin held up the pajamas Nicholas wore that day.

Public defender Todd Johnson countered that while Peters might be an “ill-equipped” parent, he couldn’t have known that bouncing the child would lead to his death. Seizing on disputed testimony by the coroner who conducted the boy’s autopsy, Johnson said an earlier brain injury could have been exacerbated by the bouncing.

Johnson said the lack of visible injuries on the boy supported the theory.

Prosecutors dismissed the argument as “fantasy,” saying that doctors found similar brain injuries in Peters’ son, who also suffered anal trauma.

Peters was administratively discharged from the Army in January, apparently after failing a drug test, he told his father during a recorded phone call that prosecutors played in court on Thursday.

Police say he acknowledged that he had been using heroin once a week and smoking marijuana to help curb his heroin cravings.

The former soldier told his father he was “high the whole (expletive) time” he watched the children, according to the recording. In a police interview, however, he denied being under the influence the day the child was injured.

Berlin - A German father is to go on trial next week on 400 charges of sexually abusing his own daughters, justice officials disclosed Wednesday, only one day after three decades of incest in another family became public.

In the new case, a daughter who is now 24 gave birth to two children by her father. The abuse began after she was 18. Her younger sister had been abused from the age of 16, prosecutors alleged.

The 46-year-old man from Guenzberg, southern Germany, faces, for each daughter, 200 charges of obtaining sex from a person whom he was under a duty to protect. The trial opens Tuesday. His arrest had not been made public previously.

New details emerged in a case made public on Tuesday of a 69-year-old man arrested six months ago for abusing his daughter over a 34-year period and fathering three sons with congenital defects by her.

Defence lawyer Karl Herzog said an uncle of the woman, who is now 46, had fathered an additional child by her.

The lawyer said his client admits incest, but denies the 500 rape charges, maintaining it was consensual. He said he would ask for a psychological assessment of the woman's credibility as a witness, adding: 'The whole family are of below average intelligence.'

No trial date has been set. The incest in the second case, in a family from the southern village of Willmersbach, came to light after the woman blamed a doctor for one of her son's birth defects and made threats.

Neighbours said the family had kept to themselves through the years, but had not aroused any suspicion.

Nuneaton dad jailed for abusing his kids
A 60-year-old Nuneaton man has been jailed for sexually abusing two of his children.

He claimed his two daughters made up the allegations and put child porn on his computer to try to drive him to suicide.

But a jury rejected his story and he was given a four year jail sentence.

He denied four charges of indecently assaulting one daughter when she was between nine and 15, and three of gross indecency with another when she was eight to 11.

The man, who cannot be named to protect the identities of his daughters, also denied downloading indecent images of children and possessing indecent images on his computer.

But he was found guilty of all the charges against him following a trial at the crown court in Leamington in July, and the case was then adjourned for reports to be prepared on him.

He was initially given bail by Judge Robert Orme, but later remanded in custody after breaching one of the conditions.

And at Birmingham Crown Court, where the judge is now sitting, the father was jailed for a total of four years and ordered to register as a sex offender for life.

During the trial prosecutor James Dunstan said when the older girl, now married and in her 30s, was five something happened when her father came in while she was in the bath.

Although she has no memory of what then happened, it left her screaming and feeling frightened.

By the time she was eight the family had moved to a different address, also in Nuneaton, where her father began going into her room after she had gone to bed.

He would then indecently assault her.

The girl kept a diary in which she referred to what he had done, but he found it and tore out a page – and when she realised he has seen it, she burned it.

Social services became involved when she ran away from home but no action was taken.

Some years later in the late 90s her father turned his attention to his youngest daughter, then aged eight and abused her.

It was only in 2009 when the two sisters talked to each other about what had happened to them as children that they decided to go to the police.

When the defendant was arrested the police seized his computer and found still and moving images of child pornography.

The defendant alleged the child porn had been put on his computer by his family trying to make him commit suicide.

A Northland father who twice paid his daughter $10 after sexually abusing her had subjected her to behaviour no child should endure, a Whangarei judge said.

The 47-year-old, whose name is suppressed to protect his daughter, was found guilty by a jury in July on two of three charges of unlawful sexual connection with a female under 12.

In the Whangarei District Court this week, the man was sentenced to six years and three months' jail.

The man committed the offences before the girl's 12th birthday but she did not report the abuse until a few years later.

Crown prosecutor Alice Hyndman said that because she was young, the complainant did not realise what her father was doing was wrong. Ms Hyndman said the abuse was a serious breach of trust.

Defence lawyer Nick Leader said his client had showed remorse and has had a good employment history.

However, Mr Leader conceded there were few mitigating factors in his client's favour.

Judge John McDonald said the charge carried a maximum of 20 years' jail, before sentencing the man.

"No child should be subjected to this type of behaviour by an adult. No daughter should be subjected to this type of behaviour by her father," he said.

He said the girl was vulnerable and initially thought it was her fault that the abuse happened.

She now hated him and would never forgive her father, the judge said.

Dad SEAN DEVON BROOKS was obviously a violent and frightening man, with a history of child abuse and domestic violence. But he got custody anyway--thanks to DHS. Less than one month later, the 5-year-old daughter was dead from a fatal beating.

OSBI opens criminal probe in to DHS action

The Oklahoma State Bureau of Investigation has agreed to conduct a criminal inquiry into a state agency's handling of the placement of a young girl who subsequently died from a beating.

Pottawatomie County District Attorney Richard Smothermon requested the investigation. He has been sharply critical of the state Department of Human Services and alleges information was withheld from his office.

“The focus of the investigation will be on the actions and inactions of all parties involved in the custody and placement of Serenity Deal prior to her death,” he wrote the OSBI last week.

He specifically asked the OSBI to look at events that happened and decisions that were made while the girl was in DHS custody, “and what, if any, criminal violations may have occurred.”

An OSBI spokesman confirmed Friday the agency will investigate.

Serenity Deal died June 4, less than a month after she began living with her father full time at the recommendation of DHS workers. She had turned 5 in May.

The girl was placed with her father, Sean Devon Brooks, even though she was injured twice in January during overnight visits with him. DHS was involved because Serenity's mother had been accused of molesting a boy.

Mother not contacted

Brooks, 31, of Oklahoma City, is charged with first-degree murder. In police interviews, he denied beating her.

The Oklahoman has learned that state child-welfare workers failed to fully check into Brooks' violent past.

Specifically, DHS workers never questioned his other children's mother until after Serenity's death, records show.

The ex-girlfriend, Amanda Mallory, told Oklahoma City police she considered him too violent to be around their two daughters and son.

Mallory told police a DHS worker came to her house after Brooks' arrest.

“Amanda said after the worker left she thought it was strange that they had only contacted her after the fact of all that had happened and they didn't ask her in the beginning what type of relationship he had had with his kids. Amanda said she would have told them because of the violence in their past she didn't really let him around her kids,” police reported.

The state child-welfare agency has acknowledged there were errors in Serenity's case.

“We know workers made mistakes, that they did not follow policy and procedures. And they are being held accountable,” DHS spokeswoman Sheree Powell said last week.

The spokeswoman declined to comment specifically on the OSBI inquiry.

Serenity's mother lived at times in Shawnee. Serenity stayed with grandparents in Chandler before she was put in foster care then placed with her father. DHS offices in both Lincoln County and Pottawatomie County were involved in her case and were at odds.

Four child-welfare workers were put on administrative leave after the death.

One, who had urged caution, committed suicide. Another resigned. The other two are in the process of being fired.

Brooks did not know he was the father of Serenity until she was around 3, records show. He told DHS workers in interviews that he had three other children and saw them quite often. He actually rarely saw them.

The agency was aware of the identity of his other children's mother. Mallory is mentioned by name in DHS records about Serenity.

Mallory, 29, of Norman, told police she and Brooks had a rocky off-and-on relationship that had spanned six years. She described to a police inspector how one time in Chandler — when she was seven months pregnant — she fled to a pickup to get away from him.

“Amanda said … he got in the back and he was freaking out, beating on the windows. Amanda said Sean was screaming and cussing,” the police inspector reported.

She filed for and got a protective order in 2003 after the confrontation in Chandler. Brooks pleaded guilty in October 2003 to a misdemeanor for making harassing phone calls to Mallory in violation of the order.

Mallory and Brooks later began talking again. She told police, though, that he would freak out when their new baby began crying and tell her to stop the baby from crying.

She and Brooks had another conflict in Shawnee that led to police intervention, records show.

In an interview last week, Mallory told The Oklahoman: “My children haven't seen him, really, in nearly five years. … I kept them away to protect them. I would have told that to DHS had they contacted me. I assume that would be a logical step if you were going to place a child and you know that a parent has other children. … He was a very angry person.”

A 27-year-old man was ordered held without bond Sunday after being charged with fatally stabbing his 3-year-old son and raping and stabbing the boy’s mother in the Friday morning in the Austin neighborhood on the West Side.

Judge Peggy Chiampas ordered Gregory D. Sandifer was held without bond on Sunday, according to a Cook County Criminal Court clerk. Sandifer is scheduled to appear for a preliminary hearing on Tuesday, according to the clerk.

Sandifer, of the 900 block of Bowling Green Drive in Homewood, was charged with murder, aggravated domestic battery and criminal sexual assault, according to police News Affairs.

He remains hospitalized Sunday, according to News Affairs Officer Laura Kubiak, who said the suspect is the boy’s father.

After stabbing the child in the 5000 block of West Division Street about 11:15 a.m. Friday, Sandifer allegedly pushed the boy’s 25-year-old mother out a window before fleeing, police said.

The boy -- identified by the Cook County Medical Examiner’s office as Jaivon Sandifer -- was pronounced dead at 12:18 p.m. Friday at John H. Stroger Jr. Hospital of Cook County, according to the Cook County Medical Examiner’s office. A Saturday autopsy determined he died of multiple stab and incise wounds and the death was ruled a homicide.

According to the report, Sandfier and the woman were arguing when he allegedly displayed a knife, sexually assaulted her and then stabbed her multiples times in the chest, neck and arms.

The woman wrestled the knife from him and threw it out the window. She tried to flee from the window, but Sandifer allegedly punched her in the head and body, picked up a television and hit her with it before pushing her out the second-floor window, according to the report.

When police got inside the apartment and saw the suspect holding a knife, Sandifer fled to the back of the residence, jumped off a second-floor rear porch and fled northbound, the report said.

The woman told officers the man who attacked her was her boyfriend.

Officers found the suspect inside a garage in the 5000 block of West Crystal Street, the report said.

Sandifer allegedly told officers: “I’m tired and thirsty from fighting,” the report said. He was arrested after police positively identified him as the suspect and other officers found the boy’s body, the report said.

The woman was taken to Stroger Hospital, where she was initially listed in critical condition, the report said.

Sandifer is hospitalized at West Suburban Hospital Medical Center in Oak Park for an ankle injury he suffered when he jumped from the second-floor, according to a police report.

Fayette County will pay $242K to attorneys for blocking father

Fayette County has been ordered to pay $242,753 to the civil rights attorneys who represented a man who sued the county for preventing him from seeing his children.

The amount, ordered on Wednesday by U.S. District Senior Judge Donetta W. Ambrose, is less than the $445,000 in fees that the American Civil Liberties Union in Pittsburgh had sought to recover.

The ACLU argued the $445,000 represented hourly fees and travel expenses for three attorneys and a paralegal who worked on the case. The ACLU sued Fayette Children and Youth Services and two caseworkers in 2008 for violating their client's civil rights.

The client, identified only as John Doe in court papers, died in a traffic accident last year.

His estate sued the county because CYS forced him to surrender custody of his three children because he had a sexual relationship with a 16-year-old girl.

The 32-year-old Smithfield man never was charged with child abuse, but the agency took the action based on the state definition that any adult having sex with someone younger than 18 is considered abuse.
