Father exposed himself to his four-year-old son
A father who exposed himself to his four-year-old son was handed a suspended jail term yesterday. She found the version given by the girlfriend to be more credible
They were in the man’s Skoda Forman when, according to his girlfriend, he unzipped his trousers and said to the boy: “Look, when you grow up, you will have one like this.”
The incident happened in April 2009 at the Ta’ Xbiex yacht marina.
He then tried to grope the woman but she rebuffed his advances and told him to stop doing such silly things in the boy’s presence.
Magistrate Audrey Demicoli noted that there were discrepancies in what the witnesses had said with regard to what the child had told his mother about the incident.
Magistrate Demicoli said she found the version given by the girlfriend to be more credible in view of the discrepancies in the witnesses’ testimony when it came to what the boy had said.
She noted that, in its final submissions, the prosecution also seemed to agree with the version given by the girlfriend.
The boy’s parents were going through a separation when, usually, the parties focus on some damaging detail and take full advantage of it, the magistrate said.
Before sentencing, the man’s lawyers requested that his two police statements be removed from the records of the case and not taken into consideration because he did not have access to a lawyer before these were taken.
The magistrate upheld the request and sentenced the man to a 24-month prison term suspended for three years.

It wasn't really Daddy's fault that he tortured the kids, see. We can 'splain it. Really! He had ADHD!
What a load of horse patootie. But hey, even though this POS has previous CONVICTIONS for domestic violence, he's still walking around free on bail. Even though research has shown again and again that these dudes are very dangerous when they can reestablish access to their victims.

Man charged with ‘branding’ children with a soldering gun
Court hears how accused repeatedly kicked 14-year-old son in groin with safety shoes, and marked two of his children on the forearm with a soldering gun
A child psychologist noticed a crescent-shaped mark on one of the boy’s and the girl’s forearm, which both said was made by their father using a soldering gun.

A criminal court yesterday heard how a father in his early 40s would allegedly beat his three children, aged 10, 12 and 14, on a regular basis - sometimes kicking the older son in the groin wearing safety boots; and on some occasions marking the children on the forearm with a soldering gun.
Evidence against the father was brought before Magistrate Antonio Micallef Trigona, who heard Police Inspectors Louise Calleja and Priscilla Caruana recount the events which led them to arrest him and have him charged with causing grievous bodily harm to his three children.
The name of the accused is withheld on court order.
Inspectors Calleja and Caruana informed the court that they had acted on a report made by officials at Dar Merħba Bik, after a mother sought shelter with her children over repeated domestic violence.
A court appointed expert then read out her report into the findings arising from her interviews with the accused's two sons and a daughter.
Child psychologist Mariella Mangion reported that she noticed a crescent shaped mark on one of the boy's and the girl's forearm, which both said was made by their father using a soldering gun.
While explaining that the children were "highly traumatised" Mangion said that she found the children to be bruised and scratched all over.
The eldest son was found to have a dark blue bruise on his groin after he was allegedly kicked hard by his father wearing safety shoes.
According to Mangion's findings, the children suffered bruising to their rib cage, their upper and lower backs, around their necks and arms.
The father's case was originally brought before the family court, but was subsequently forwarded to the criminal court for prosecution after the children's injuries were considered to be grievous.
The daughter was also reported to have had patches of hair pulled out from her scalp.
The father, who is currently on bail, had previous convictions for domestic violence and had attended therapy for anger management.
He has been ordered to keep away from Dar Merhba Bik and prohibited from approaching his wife and children.
During cross examination, lawyer Arthur Azzopardi argued that during the investigations, nobody had ever diagnosed his client's medical and psychiatric history.
Azzopardi said that the father was a victim of a brutal upbringing by his own father, and also suffers from attention deficit hyperactivity disorder (ADHD). He requested that in the next sittings, the court appoint experts to examine his client.

Police officer charged with daughter’s defilement
Police officer denied bail and remanded in custody over charges of defiling 11-year-old daughter.

A police officer was denied bail after facing charges of the defilement of his 11-year-old daughter.
The officer, whose name cannot be published by court order, is a driver to an assistant commissioner.
He was arrested after a police report was filed by his estranged wife. The two are undergoing separation procedures.
It was the daughter who allegedly told the mother about the abuse she sustained at the hands of her father.
Prosecuting inspector Marie-Louise Calleja insisted that this was a serious crime committed by a public officer and that all precautions were taken during investigation.
The defence, led by lawyers José Herrera and Michael Sciriha, argued that their client is undergoing separation procedures with his wife and that there are outstanding issues on the biological paternity of their child, and over the father's disciplinarian parenting.
The defence argued that their client has served for 25 years in the police force and was due to retire in a month, and asked the courts to consider how delicate this case was given the hardship he would endure even if eventually acquitted.
Inspector Calleja assured the defence that it was her priority, as in any case, to see whether this was a matter of spousal pique, but from the evidence she had collected this was not the case.
She added that as soon as the officer's wife got wind of the accusations from her daughter, the mother fled the matrimonial home and is now living in a social shelter. "Granting the accused bail would leave the mother and daughter as victims, and privilege the abuser by leaving him in the matrimonial home."
Magistrate Claire Zammit Stafrace denied the request for bail on the grounds of the seriousness of the charges and the possibility of tampering of evidence.
She recommended the director of prisons to provide for the security of the police officer while in custody.

"Violent" father gets supervised visitation, suspended sentence (Malta)
UNNAMED DAD, a violent alcoholic who kept his sons out of school, is getting a break from the Maltese courts because he wasn't a bad guy, see. He was just trying to bring up his sons as "strong men" (i.e. as future batterers and abusers just like their father). What kind of crap is this? It's just another way that child abuse by fathers is denied and minimized.
So all Dad gets is a suspended sentence and supervised visitation. And where is the mother of these children? Is there one? Sure doesn't sound like it.

A father, who was violent against his three sons and who is a former alcoholic, was given a one-year jail term suspended to three years
The 48-year old father was accused of causing slight injuries on his children, used violence to force his children do something and behaving in a way that instilled fear in his sons.
It transpired that the father was very strict with his children and that in the summer months, he took them with him to work on a construction site in breach of their right to education and free time.
The court, presided by Magistrate Antonio Vella, considered the father’s early guilty plea but also understood the local reality of Maltese parents who think that exercising strict discipline is positive for their children.
He highlighted that each child should be respected as a person and that persons shouldn’t use force and physical abuse to discipline their children.
Although excessive violence should be condemned, the court decided that the father had not intended to hurt his children but to bring them up as strong men.
The accused, the court said, needs someone to guide him especially since the court understood that he had a drinking problem so he was also assigned a probation officer.
The court also ordered a protection and treatment order to make sure that the siblings are well looked after and so that their father starts addressing his drinking and behaviour problems. The father was allowed supervised access of his sons for two hours a week under Agenzija Appogg’s supervision.
The court’s decision will be revised every six months and changed according to the father’s improvement.
So all Dad gets is a suspended sentence and supervised visitation. And where is the mother of these children? Is there one? Sure doesn't sound like it.

Lara* could not spend Mother's Day with her son yesterday because the court granted her child's temporary care and custody to the father who had walked out of their lives some years ago.
"I feel as though the court stripped me of my motherhood by allowing my child to live with his father and his lover. A part of me also feels betrayed by my son for accepting to be with him after I did so much for the child, including living in a violent marriage for years to keep our family together," she says, battling to hold back tears.
Lara explains how, throughout their marriage, she filed several police reports after her husband beat her. Policemen often turned up at her door, following her desperate phone calls, but she never followed up the reports in court because she ended up forgiving him.
"I wanted to protect my young son and wanted our family together," she says. As the boy started growing up, Lara realised she could not take the abuse any longer and the road to separation began. The introduction of domestic violence legislation helped her pluck up the courage she needed to say "stop".
According to court documents, the Family Court heard how, some years ago, Lara's husband left the matrimonial house and showed little interest in their son. Eventually, after producing her police reports against her husband in court, she got a temporary court ruling giving her care and custody of her son and allowing her to stay in the matrimonial home.
As mediation proceedings drag-ged on for years, the couple moved to separation proceedings.
"Despite his lucrative business in the medical field, I did not want money other than help with our son's maintenance. All I wanted was my child and to close that chapter in my life," she says. All seemed to be going well until the father started showing interest in the child again and demanding to spend more time with him. The boy's attitude towards his mother started changing as he spent more time with his father.
Then, a few weeks ago, court officials knocked at Lara's door to inform her she would have to leave the matrimonial house following a temporary judgment handed down in the separation proceedings. Her husband had filed an application asking for the house and custody of their son. Both requests were temporarily granted.
Lara has now appealed the court decision and is protesting about the fact she was not informed about the father's application. She is claiming the court gave its ruling without listening to her after the application was filed.
A separation lawyer explained that it was not common for this to happen adding that one had to keep in mind that the court may have decided on previously submitted documents and evidence.
"Suddenly, I ended up without a roof over my head and my son was taken away... I can only see him for a few hours on the weekend... Right now I'm so hurt and traumatised by the court decision that I'm unable to see my son. I have no place where I can take him because I'm living like a gypsy... But I know how easily my husband can manipulate people, so am not surprised that he managed to also manipulate my own flesh and blood against me," she says.

He was remanded in custody.
The court ordered a ban on the publication of names to protect the victims, who are now young adults.

Son witnesses dad perform indecent act in public (Msida, Malta)
UNNAMED DAD has been arraigned for performing an unspecificed "indecent act in public" which was witnessed by his 5-year-old son. His girlfriend has corroborated the boy's account. There is also mention of the dad's "estranged wife" hearing of the incident from the son, so there was obviously some sort of visitation/custody arrangement here. Maybe Mom is "estranged" because she has seen other examples of Dad's "indecent" behavior.

Father and son charged with assaulting 2 police officers (Malta)
It's cases like this that really make you wonder whether all kids need two parents all the time.
Father ANTHONY VASSALLO apparently provided a less than bang-up job of modeling anger management for his son. Both have been charged with assaulting two police officers. So what set these guys off? Somebody asked them to move their car. Okaaay.

Two men were yesterday charged with assaulting two police officers on the Gozo ferry on Sunday.
Anthony Vassallo, 61, and his son Clint, 23, pleaded not guilty to seriously injuring police sergeant Mario Pace and WPC Margherita Aqulina. It is understood that the fight broke out after a couple in a car requested the two men to move their car slightly to allow a woman out of the said vehicle which was blocked by a beam.
The two men were also charged with resisting arrest and breaching the peace. The court released them on bail against a deposit of e2,500 and a personal guarantee of e2,500 each. Police inspector Mario Pace prosecuted while Dr Manwel Mallia and Dr Arthur Azzopardi appeared for the accused.
