As often happens, the mother is erased from the story. The children are now in the custody of an unnamed "relative."

PALM BAY, Fla. - A Brevard County father was arrested on felony child neglect charges Monday after allegedly making his children live in deplorable conditions.

It was inside of a home on Creel Street in Palm Bay where police say Jonathan Nethercutt, 34, badly neglected his three children.

"When we got there, we documented some conditions that were absolutely deplorable," said Yvonne Martinez with Palm Bay police. "You wouldn't expect any human to live in that, much less children."

According to Nethercutt's arrest report, detectives found cigarette butts, trash on the floors and couches, and dirty dishes everywhere, along with an infestation of German cockroaches.

There were so many roaches, that police say they would scatter from the rug when stepped on.

But the tipping point, according to Martinez, were syringes left out in the open, used by Nethercutt because of his heroin addiction. "Drugs, paraphernalia, the environmental hazards in the house, infested with roaches and food. It was just not anything that you would want a child to have to be exposed to," said Martinez.

The children wrote on their bedroom walls how much they hated their father, according to the report. One of them apparently writing, "Giving up hope. I hate my dad."

Palm Bay detectives were notified about the neglect allegations by the Department of Children and Families a few weeks ago after an anonymous caller tipped them off.

After an investigation, Nethercutt was arrested Monday on charges of child neglect and contributing to the dependency of a minor.

He went before a judge for the first time at the Brevard County Jail on Tuesday where a judge ordered he be held on $40,000 bail.

DCF said the three children are in protective custody and staying with a relative.

They're said to be in "good spirits."

A theme often seen with custodial dads and murdered children is that the Evil Step is set up as the Cause of it All. Poor innocent, clueless Daddy just had no idea.

Here we see a twist on the same theme. It's the boyfriend's fault. Er, male friend's fault!

Mothers are routinely bashed in the press and the public at large for living with violent boyfriends or husbands with criminal records, especially if there are indications that the man abused her kids. Doesn't matter if Mom was battered herself, or even if she had defensive wounds as I saw in a case (where else?) in Florida. Doesn't matter if the man has threatened to kill her or the kids if she notifies the authorities. These mothers are routinely jailed for "failure to protect", call the police, or seek medical care in a "timely" manner.  

But nobody is questioning why a father with custody of a 3-year-old girl lived with a man with a "lengthy" criminal history including assault and sexual assault.

And why the hell is a man with this history out on bail? Especially when the forensic evidence (the girl's blood found in his shorts) suggests he was the one who raped a toddler??? Be very afraid women and mothers of Australia...

A LITTLE girl from Brisbane was allegedly locked in a bedroom for so long she was forced to urinate and defecate before she died suddenly with severe internal injuries, a court has been told.

New details of the tragic death of three-year-old Kyhesha-Lee Joughin were aired in the Brisbane Magistrates Court on Wednesday as one of the men accused of her manslaughter was released on bail.

Chief Magistrate Judge Ray Rinaudo granted bail to Christopher Arthur Neville Kent, 46, after carefully considering submissions from his lawyers in relation to the alleged killing and a second charge of cruelty to children.

The girl’s father, Matthew Lee Williamson, is already on bail for identical charges. Kyhesha-Lee was allegedly unable to be revived by ambulance crews after she was found living in “squalid conditions” in her father’s Petrie home, north of Brisbane, on March 30, 2013.

In opposing bail, Crown prosecutor Vicki Loury said the girl had severe penetrative injuries to her vagina that occurred roughly three days before her death, on Easter Saturday two years ago. She said the girl had also sustained blows to her stomach that damaged her bowel.

Ms Loury said the child had not been seen by anyone other than her father and Kent for almost a week before her death.

She said that when a visitor to the house arrived on Good Friday, the little girl was “in extreme distress and extremely unwell”.

Ms Loury said blood was found on Kent’s shorts that allegedly matched Kyhesha-Lee. She said Kent lived in the unit and slept in the lounge room at the time of the little girl’s death and knew Williamson would allegedly lock the child in a bedroom for so long it caused her to urinate and defecate in that room.

Ms Loury told the court Kent fled to New South Wales after the child’s death and she argued that demonstrated a consciousness of guilt.

That was opposed by barrister Soraya Ryan, for Kent, who argued her client fled because he panicked that he failed to do anything to save the child.

She told the court Kent was arrested by police in NSW a day after fleeing Queensland and was jailed for five months for separate traffic offences.

Ms Ryan said Kent was extradited back to Queensland and had been in custody since.

She said Kent wanted to live with his sister in Newcastle and attend an intensive outpatient clinic to assist in his rehabilitation for drug abuse.

Ms Ryan said negotiations were in process with the prosecution for a plea of guilty to the child’s manslaughter only on the basis of criminal negligence.

“If the prosecution don’t accept that plea and if the conviction is on the basis he was actually involved in the child’s death, it’s much more complicated,” she said.

Judge Rinaudo granted bail on the basis Kent was not a flight risk and because he had served some 17-months behind bars on remand.

He said although Kent’s criminal history was lengthy and involved a number of offences of assault and one dated conviction for sexual assault, they were not of such a nature that would lead him to be a risk of re-offending.

Judge Rinaudo said there appeared to be “some issues” with the case against Kent.

He imposed rigorous conditions, including that Kent reside with his sister, not reside with children, participate in rehabilitation, surrender his passport, stay 200m from an international point of departure and report to police.

Kent and Williamson will front court again for a two-day hearing in May for the cross-examination of up to 25 witnesses.

The custodial dad is identified as DANIEL KENDZIERSKI. No explanation as to what happened to this boy's mother. If Dad was capable of treating the son this way, he was more than capable of treating the mother in a similar fashion. This should raise red flags as to what happened to her. Is she deceased? If so, from natural causes? Is she "missing"? If so, why? Or did this father some how manage to strip her of custody? Lots of unanswered questions. Kids are now in foster care.

Parents arrested after teen reports being shackled to bed

POOLER, GA (WTOC) - Police say a Pooler teen was shackled to a metal bed for five months, with his little brother forced to act as jailer.

Now, his father and step-mother are behind bars. Daniel Kendzierski, 37, is the teen's father. He is charged with false imprisonment and child cruelty. His stepmother, 30-year-old Christine Kendzierski, is charged with child cruelty.

Police were called Thursday night to the family's home on South Rogers Street after the 15-year-old boy confided to a classmate that he had been beaten the night before, for escaping his shackles. According to a police report, officers found the mobile home in disarray – with trash, boxes and clothes scattered everywhere – and six children living inside.

Police say the 15-year-old showed him his metal frame bunk bed, with no mattress on the top and a bare, dingy, heavily stained one on bottom. A set of metal shackles was attached to the bed. Police found bruises on the boy's wrists, his ankles, his ribs, his shoulders and stomach. He told officers he usually gets one meal a day, sometimes two – that he has to eat in the bathroom or the bedroom, sometimes, but rarely, with the rest of the family.

The 15-year-old, his father, his stepmother, and his brother said the boy was unshackled to go to the bathroom, to shower and to go to school.

According to this police report, Christine and Daniel Kendziersk did not think they were doing anything wrong and said they were just disciplining the boy. Christine Kendzierski told officers she was only doing what had been done to her as a child, according to the report, then asked officers, “So what if I leave him, leave his kids and take man and leave. Will that help me out?”

According to the police report, Daniel Kendzierski gave his son what he called, "iron chair beatings," saying the boy would fall to the floor and cover himself as he was being beaten. His little brother was forced to lock and unlock the shackles. The teen asked police not to get his brother in trouble, and said he was only doing what he had been told to do by his parents.

Charles Reid lives just steps away from the home where this all happened, and said there was never any indication that anything was wrong."I haven't noticed any issues. They walk around out here. They have gone to school. They walk the dog. They play back here; have a swing set right out the back door. So, I have not noticed anything," Reid said.

The six children who lived at the home have been placed in foster care.

There is no word yet on whether the Kendzierskis have posted bond, but no one answered when a WTOC crew knocked on the door Friday evening.

Disgusting. CPS demonstrates it usual incompetence by not doing its job at all, not contacting anybody who made abuse complaints. They failed to visit the home. They failed to do anything basically.

Most interesting is that this filthy abusive father had CUSTODY while the PROTECTIVE MOM was on SUPERVISED VISITATION. And the mom was NEVER INFORMED there were even allegations by other parties regarding abuse and neglect. Even the folks at the supervised visitation center (who tend to be very biased against moms) thought Daddy was neglecting these kids and sexually abusing them, but CPS didn't interview them either.

And after all that, CPS exempts any of its higher ups for responsibility.

Dad is identified as DAVID BRASSE, who was eventually let off the hook on all charges.

And that's how things go down in a big fathers rights state like Texas.

CPS caseworkers at fault in child's death — but not managers

SAN ANTONIO — The state Office of the Inspector General found that four Child Protective Services workers failed to follow state policy in the case of Sarah Brasse, an 8-year-old girl who, while under the watch of CPS, died of untreated appendicitis in 2009.

In a report released Thursday, the OIG doesn't recommend any disciplinary action, though it found a family-services specialist, a kinship specialist and two investigators neglected to perform even basic requirements of their jobs, such as making timely visits to ensure Sarah and her brothers were all right, or following up on reports that they possibly were being abused or neglected.

Sarah's father and stepmother were investigated by CPS multiple times for abuse and neglect in the two years prior to her death.

The OIG said there was no evidence to show two high-up program directors didn't comply with policy in their handling of the family referral and documentation process.

Allegations that these managers might have illegally altered state documents were not substantiated, the report states.

“There was no evidence to indicate that any policy violations were to blame for the appendicitis, which is listed as the cause of death,” the report notes.

Jo-Anne Guerrero, Sarah's biological mother who did not have primary custody, said she read the report “with a heavy heart.”

“Why are (managers) being let off the hook?” she asked. “Yes, they are holding some staff accountable, but as usual, it's just the front-line workers. It was managers who held the power to make the truly important decisions in my daughter's case, and they didn't do the right thing. This just seems like CPS sugar-coating things.”

A spokesman for CPS' parent agency stated Thursday that no disciplinary action is expected and the case is closed.

An investigation in 2013 by the San Antonio Express-News found that in the 48 hours before Sarah died, a school counselor, a school nurse and a Schertz police officer alerted CPS about their fears that she was being neglected.

CPS manager Diane Jones declined to open a new investigation or even send a caseworker to check on the ailing Sarah, despite the fact the agency's staffers repeatedly had recorded her father's failure to seek adequate medical care for her.

The OIG report states that Jones followed policy.

CPS failures

In finding that several caseworkers disregarded policies, the OIG report states:

The family-services worker admitted in interviews that she didn't provide a timely service plan in her casework involving Sarah. She didn't alert Sarah's biological mother about an investigation involving alleged medical neglect of her daughter and her two sons.

She also failed to see if the family was accessing required services and didn't conduct visual contact with the children in the months prior to Sarah's death. And she didn't conduct a home assessment that would have “made her aware of provisions for the children and the condition in which they lived.”

The report notes the above failures were “corroborated” by a review of CPS' computerized record system, or IMPACT.

To Penny Williams, a former family-based services caseworker who worked with Sarah's family the year before she died, that statement reveals supervisors and upper management “knew what was going on.”

“Supervisors can see all documentation in IMPACT,” she said. “They had to know nothing was getting done in this case, that the children weren't being seen, and they are ultimately responsible. And it goes higher up: Once a month, supervisors have monthly meetings with program directors and program administrators, and they have to share all this information.”

Other lapses in policy, according to the OIG report:

A CPS investigator failed to contact staff at KidShare Family Services, where the Brasse children had supervised visits with their mother. Staff at KidShare made reports to CPS that the children were being neglected and possibly sexually abused, but the investigator never called back.

* A second CPS investigator also didn't notify JoAnne that her ex-husband David Brasse and his then-fiance Samantha Britain were being investigated by CPS regarding their care of the children.

* A kinship worker didn't contact a physician at Laurel Ridge Hospital, who had reported to CPS that one of Sarah's brothers appeared malnourished. He also failed to respond to an outcry the children made that “they were always hungry and not fed.”

* Staff at Watts Elementary School, where Sarah was in second grade, told OIG investigators they were not informed of an open CPS case involving the Brasse children and were not contacted by any caseworkers over their reported concerns that the children were not being care for adequately.

When EMS arrived at the Brasse home the night of Feb. 5, 2009, Sarah's body already was stiff with rigor mortis, her jaw clenched shut. The house was filthy. Police noted vomit throughout the place — on the stairs, a bathroom sink, on Sarah's bedding and her body.

David Brasse and Britain originally were found guilty of manslaughter and injury to a child, but those verdicts were overturned on appeal, with judges citing insufficient evidence. The state continued to pursue Britain, who was at home most of the day Sarah died, but she ultimately was exonerated.

The OIG report has been referred to Cynthia O'Keefe, general counsel of the Texas Department of Family and Protective Services, the document says.

'Matter closed'

When asked if any actions were planned in response to the report, Patrick Crimmins, spokesman for the Texas Department of Family and Protective Services, replied in an email: “The report was very thorough and we appreciate the input of OIG. This case has been extensively reviewed, and DFPS considers the matter closed.”

Crimmins confirmed that three of the four employees whose policy failures were cited in the report still are employed by the department, but that no disciplinary actions were planned.

Guerrero said the report's noting that CPS' actions didn't cause her daughter's appendicitis is “ridiculous.”

“Of course, they didn't give her appendicitis, but their inaction led to her death,” she said. “If they had acted on stuff that was brought to their attention, they would have recognized she needed help. I kept telling CPS all those years there were problems in that home. I kept saying to them, 'What are you waiting for?'”

Like DFPS and CPS, the Inspector General's office is under the umbrella of the Texas Health and Human Services Commission.

After being given a copy of the report, a former CPS caseworker who's familiar with the case but asked to remain anonymous because she still fears retribution, responded: “I had serious concerns about an HHSC agency investigating another HHSC agency. It seems my concerns were justified.”

The Sunset Advisory Commission, which regularly evaluates state agencies, recently issue a critical report of the OIG, stating the division uses “inefficient and ineffective processes” and is hobbled by communication, a lack of transparency and limited staff training.

Sen. Carlos Uresti, D-San Antonio, who asked the OIG to investigate CPS' handling of Sarah's case after the Express-News reported seven months ago about the missing KidShare referrals, said at two pages long, the report is “not as in depth as I would have hoped for given the complexity of the case. ...”

“Sarah's death is neither excusable, nor will it be forgotten. ... .”

Notice that it was an aunt and uncle who rescued this child. Why did a belligerent, apparently drug-addicted dysfunctional father like this one have access to this child? Did he have custody? What happened to the mother of this child?

A Jonesborough man was found intoxicated inside a trash-strewn home hours after he allegedly left his child alone over night and then threatened a relative, according to a court document detailing his arrest.

Jason A. Keys, 43. 607 Conklin Road, was charged with child abuse and neglect and domestic assault by intimidation after a verbally violent encounter with his sister.

Officers first responded to a home on LC McKee Road in Jonesborough shortly before 7p.m. in reference to a domestic intimidation. At that residence, Jill Emmert told officers that one of her brothers — not Keys — had brought Keys’ 8-year-old son to her house after finding the boy alone at his house, located at 607 Conklin Road.

The child told officers he woke up that morning and his father was not home and he had no idea where he had gone. When the boy’s uncle found him, he took the child to the aunt’s home.

That was early in the day on Wednesday, and Emmert kept her nephew all day. She didn’t hear from the boy’s father, Keys, until around 6 p.m..

That’s when Keys showed up at Emmert’s residence, blew the horn, got out and beat on the end of the trailer.

Emmert told officers she went outside and her brother said, “What do you mean?” She said she had no idea what he meant by that, but then he said he “should just pull out a gun and blow her brains out.”

The woman told officers she never saw a gun and that Keys left without asking about his son.

Deputy John Foister went to Keys’ residence and said the man appeared intoxicated.

“He also had sores on the inside of both arms, conducive of needle drug abuse. The residence where the child was living was covered with trash and clutter and appeared to be an unsafe habitat for a small child,” Foister wrote in the arrest warrant.

Keys was held on a $2,000 bond and scheduled for arraignment Wednesday afternoon.

Investigating officer Rudolf Jansen told the court of the torture and assault the children aged between two and 16 had allegedly been put through by their father.

The man’s 11-year-old son alleged that his father had hung him from the wrists for two days using a rope.

When asked to be set free, his father used teargas on him. He was also assaulted.

A woman dressed in a pink jersey sitting in the court gallery removed her glasses and wiped tears from her eyes.

Reading from the young boy’s medical report, Jansen told the court of the bruises and scars that the child had sustained.

He had numerous scars on his body, one of which was a scar on the head which had come from being struck with a knobkerrie, said Jansen.

The accused, who may not be named to protect the identity of his wife and children, faces charges of assault and kidnapping.

Further charges, including one of rape, were expected to be brought against him after allegations that he had forcefully had sex with his wife.

Jansen told the court in Afrikaans the house in which the family had been kept captive was in a dire state.

“There were live rats and rat droppings in the kitchen of the house.”

There was also lots of pornographic material.

The accused had rented out some outside dwellings on his property.

Jansen told the court that the tenants feared him.

Locals and non-governmental organisations demonstrating outside the court called for the accused to be kept behind bars.

Some carried placards with the words “stop child abuse” or “monster”.

Jansen told the court the accused was a flight risk.

The Springs man was arrested last month after his son fled the house and sought help from neighbours.

They alerted the police.

The matter continues.

Dad charged with neglect in Sioux City infant's death

Michael D. Williams, 26, of Sioux City, was charged with felony neglect of a dependent person on April 30. He’s accused of neglecting his infant son, Leonard. The 2-month-old boy was declared dead at UnityPoint-Health – St. Luke’s.

SIOUX CITY | The mother of a dead 2-month-old baby who was taken to the hospital by his father said a felony neglect charge against him is justified.

"If they charge him with anything else so be it," said Rebekah Williams-McCarthy, 23. "But that's what really seems to fit."

Michael Williams, 26, was charged with neglect of a dependent person, a class C felony, in court papers filed late Wednesday. The investigation continues.

He is scheduled to be arraigned Wednesday in Woodbury County District Court.

Williams was arrested April 29 after he brought his dead son, Leonard, into the UnityPoint Health-St. Luke's emergency department.

According to court documents filed at the time of the arrest, Williams told police he left the baby unsupervised for long periods of time in his apartment in the 2800 block of West Fourth Street. Investigators wrote that the apartment was in "poor condition" and littered with feces-filled diapers.

Williams also told police he was addicted to the prescription stimulant Adderall, marijuana and methamphetamine.

Sioux City police Lt. Mark Kirkpatrick said Thursday the investigation into the death is ongoing, but could not comment further on it. He said authorities await results of an autopsy, which could reveal when and how the boy died.

The charging document, known as a trial information, filed by First Assistant Woodbury County Attorney Mark Campbell gave no new details of the circumstances of Leonard's death. The trial information said that from Feb. 16 through April 29, Williams "knowingly or recklessly exposed a child to a hazard or danger against which the child could not reasonably be expected to protect himself ..."

If convicted as charged, Williams would face a 10-year prison sentence.

Campbell said Thursday he could not comment on the case. Williams and his girlfriend also had children ages 1 and 2 in the apartment. The other children have been taken into protective custody.

Williams-McCarthy said she is awaiting a hearing to determine whether they will be placed in foster care or with family members.

Williams-McCarthy has not been charged in connection with Leonard's death.

I'm a little skeptical regarding the line about Mom just moving out. Notice that we only have the neighbor's report of this--presumably from a distance. Very often abusive and neglectful fathers are abusive and neglectful partners, so I think it's highly likely that Mom's disappearance is just a tad more complicated than up and leaving and abandoning her kids. It will be interesting to see if anybody follows up on this.

HOUSTON - A Deer Park man has been charged with endangering a child. He plead guilty to the same crime in 2011.

Ransom David Davis, 35, is accused of failing to provide safe living conditions at his home for his two sons, ages 3 and 8, as well as his daughter, age 13.

"It was completely covered with dog feces and dog urine. It was trashed, trash everywhere, broken glass shards through the inside and out," Deer Park Police Detective J.R. Hill said.

Child Protective Services removed the children from the home on Wednesday. A spokesperson for the state agency said the children are temporarily staying with a family friend and remain together.

Police noted the children had access to an unsecured pellet gun at the James Street home. The pool, dirty, and only partially filled, was also cited as a hazard, according to court documents.

Davis is being held on $2,000 bond.

Neighbors report the children's mother moved out of the home a few months ago.

A family friend seen cleaning up the outside of the home on Friday said the children were not in danger at the house.

"You know how kids are, they make a mess," said a man who identified himself as Oscar.

Police and neighbors agree the children did not appear to be undernourished.

Officially, a CPS spokesperson would not comment how a father convicted of a child abuse charge could regain custody of his children. However a source within the agency told Local 2 that parents are afforded every opportunity to get their children back if a problem is deemed "fixable."

The source added that judges decide whether kids are reunited with parents, not CPS.

A 2011 guilty plea for the same charge noted drug use by Ransom Davis, and easy accessibility to used syringes by the children. He received deferred adjudication in that case with two years probation and a $200 fine.

1) Despite the fact that the police themselves found the children locked alone in a filthy home calling out for food through a grate, they claim they don't have enough "evidence" to press charges. Bull crap. You have the evidence right there. Typical in that when fathers abuse the kids, authorities are always claiming there is no "evidence" when it is staring them right in the face.

2) But then the police contradict themselves and say the offenses are not "serious enough" to press charges. Which is it? No evidence or not serious enough?

3) Notice the excuses made for this POS. We can excuse this treatment because the poor dear is "overworked"? Bullsh**.

4) Notice how the comments about the mother go unchallenged. If this man was capable of doing this to little girls, what was he capable of and/or willing to do to their mother? But we're just going to accept Daddy's word that she left on her own accord. I sincerely doubt it. First of all, it would be useful to confirm that she is even alive and/or not "missing" under suspicious circumstances. Second, if she is alive, maybe you could get her side of the story? Chances are very high she was pushed out by ongoing violence against her and/or death threats.

5) Even the neighbors were afraid of this guy? This should tell you something. But of course, that is ignored as well.

A Sattahip car mechanic detained for imprisoning and beating his toddler daughters with coat hangers was set free by Sattahip police, apparently for lack of evidence.

Akachai Sornsuriya, 24, was taken into custody briefly March 4 after police rescued his 2- and 4-year-old girls from their filthy Sukhumvit Soi 3 home. The door was locked and windows barred by iron grates. The girls called desperately for food through the grating, which barred entry into a house strewn with garbage and spoiled food.

Somrak Charoensuk said Akachai’s ex-wife had left him with the children shortly after the youngest’s birth. Overworked by job and parental responsibilities, he left them locked up while away and, annoyed by their crying upon his return, allegedly beat them into silence with coat hangers.

Neighbors reported hearing their screams from houses away, but feared interfering, other than to sneak them food.

Over the protests of neighbors, police released Akachai with only a warning, claiming that his offenses were not serious enough to be considered child abuse. If the incidents continued, however, he would be arrested and charged, police warned.

Dad charged with 1st-degree murder in death of 8-week-old daughter (Portland, Tennessee)

This article is typical in that the first paragraph implies that both parents are equally responsible. In reality, that is not the case. The father is the one charged with 1st-degree murder. Though the mother is not exactly perfect, her "crime" is more along the lines of being clueless--of not feeding the baby enough and keeping a dirty house. These are "crimes" that fathers are virtually never charged with unless they are single and/or custodial--and even then, people seem to be less judgmental.

Contrary to what fathers rights people claim, mothers are held to MUCH HIGHER standards than fathers--just as we see here.

PORTLAND, TN (WSMV) - A Sumner County couple is suspected of abusing their baby daughter, who died last month at Vanderbilt University Medical Center.

Portland police investigators say medics were called Jan. 2 to a home in the 200 block of Portland Boulevard, where father Robert Jasper, 30, said his 8-week-old daughter was having trouble breathing.

The baby was transported to Sumner Regional Medical Center, where staff members noticed old bruising and swelling to the baby's eyes and face, so they called police.

The baby, named Alionna, was then transferred to Vanderbilt. Tests indicated a severe brain injury in addition to possible signs of abuse, authorities said.

Alionna died at Vanderbilt, and an autopsy revealed head and spinal cord trauma.

In previous interviews, Jasper told detectives he didn't know what happened to Alionna, but he later allegedly said he had a dream that the baby was not breathing, so he shook the baby to get her to breathe.

Police said the baby appeared malnourished and small for her age, and the family's home was dirty and unkempt. Jasper is charged with first-degree murder, aggravated child abuse and child abuse/neglect.

Jenny Gregory, 24, is charged with child abuse/neglect.

An Omaha father has been cited for 3 counts of child neglect after police find his children living in a dirty home.

An employee of the Nebraska Department of Health and Human Services alerted Omaha police to the home near 49th & Hamilton in late December.

When police stopped by, they found food, clothes and vomit on the floor in the living room area. In the bathroom and second bedroom there were more clothes & food reportedly on the floor.

Police also noted the oldest child was sick with a runny nose and that her hair was stuck in the mucous running from her nose.

The middle child was reportedly without clothing to wear. According to the police report, officers took about 10 minutes to find a pair of pants and a shirt for her to wear, and the clothing was dirty.

The father was cited for 3 counts of child neglect.

O'Fallon Father Pleads Not Guilty to Locking Autistic Son in Urine-Soaked Cage

Terry G. Smith of O'Fallon says he is not guilty of keeping his six-year-old autistic son naked and covered in excrement in what police describe as a crude, makeshift cage.

Smith and his wife, Victoria, were charged with felony child endangerment when an anonymous tip to the Missouri Child Abuse and Neglect Hotline spurred a police investigation into their St. Charles County home.

In 2010 the O'Fallon Police Department found the six-year-old boy in the basement, trapped in a three-foot-by-six-foot plywood cage held together with zip ties, tension straps and bungee cords, according to the probable-cause statement.

Three years later, Terry Smith has entered his official not guilty plea, and his wife Victoria is still awaiting arraignment, according to KMOX. The couple is scheduled to stand trial in March 2014.

Details about the child's rescue are sickening and heart-breaking. The child's five siblings -- ranging in age from eleven months to eight years old -- say they fed him hot dogs and chicken nuggets through the bars of his cage.

Terry and Victoria Smith were not at home when first responders arrived, and it took three hours to track them down. An older relative was watching the six children, although she said she had a difficult time looking after them since she was recovering from a stroke.

The home was unsanitary and cluttered, police said, and doorknobs to children's rooms had been installed backward to allow the parents to lock their children in from the outside.

A DAD has been arrested after a baby and four children under 13 were left home alone.

Their mum was out of the country and the father was away from the house when police broke down a door.

Officers went to the property after being alerted by a concerned health visitor. The five youngsters were taken into care – and they were later joined by three more children from the same family who were at school when the others were rescued.

Four of the children found in the house were taken to hospital for check-ups. When their father returned home, he was arrested on suspicion of child neglect.

After being interviewed, he was bailed until December 4.

A police spokesman said: “We had to kick the door down to gain entry.

“The house was not clean. It was dirty.

“We had enough concerns to take the children because of the condition of the house and the children themselves. We contacted social services who took care of the children.”

All eight children, who cannot be identified for legal reasons, were placed in emergency care by council social workers.

Meanwhile, a joint investigation into the family and the father’s conduct was launched by police and social services in Blackburn, Lancs.

Paul Lee, head of safeguarding at Blackburn with Darwen Council, said: “I can confirm we were alerted by police to an alleged case of child neglect.

“We have taken appropriate action to make sure the children are protected.”

Police find 3-year-old in parking lot, arrest father

An Orlando man is accused of leaving his 3-year-old daughter alone inside their apartment while he went out with a friend late Wednesday, according to police.

Nathan Lloyd Peterson, 28, was charged with child neglect after Orlando Police found his child wandering around in the 4000 block of Middlebrook Pointe Drive about 10:44 p.m., said Lt. Daniel Schad, a police spokesman.

Neighbor Melissa Harvey was bemused by the stomping she heard in the apartment above and when she checked, the child was walking down the stairwell alone into the parking lot.

Harvey called police after she couldn't find the girl's father, she said in the report.

Inside their Coconuts Palms apartment, officers found beer cans strewn about and a plate of old food on the girl's play table, according to an arrest report.

Peterson arrived at the apartment 45 minutes later with a friend, slurring his words and wreaking of alcohol. He said he had custody of his daughter because the girl's mother has a drinking problem.

He told police his twin brother Timothy Peterson was supposed to be watching the girl.

But when officers contacted the brother at work he refuted Nathan Peterson's story. He told police his brother was in the apartment with his niece when he left for work.

Timothy Peterson said he would never leave his niece alone if his brother wasn't there.

Police noted in their report that an hour and a half passed before Nathan Peterson inquired about his daughter's well-being.

The Department of Children and Families placed the child with Peterson's cousin.

Peterson is being held in the Orange County Jail.

This case illustrates the total double standards applied to mothers and fathers. Mom appears to be guilty of being a messy housekeeper and smoking a little pot. Within ONE MONTH of getting custody, this POS threw his 2-year-old son into a wall and killed him. Total father fawning by Florida DCF, and all overseen by a child sex trafficker within the department. Adds to the growing pile of evidence showing that fathers rights folks and assorted pedophiles/child porn/human trafficker types are either the same people or work hand in hand.

Homestead man charged with shaking toddler to death

A Homestead man has been charged with shaking his 2-year-old son to death last week — one month after state child welfare administrators gave him custody of the toddler even though he was unemployed, living in a one-bedroom home with eight other children, had been repeatedly accused of domestic violence and had admitted to child-welfare authorities that he had “an anger issue.”

Two-year-old Jayden Antonio Villegas-Morales became the fifth Florida youngster to die since May after having already come to the attention of state child-protection administrators.

The deaths may also have claimed the job of Department of Children & Families Secretary David Wilkins, who had been Gov. Rick Scott’s longest-serving agency head.

Wilkins abruptly resigned last week amid a growing scandal over the deaths of children whose safety had already been investigated by DCF.

Jayden’s father, 28-year-old Angel Luis Villegas, was charged Sunday with second-degree murder.
Last week, before Jayden succumbed to his injuries, Villegas told Miami-Dade police he “became frustrated” with the little boy, who had been vomiting for much of the day on July 17, and “threw the victim on the bed, which resulted in [his] striking his head against the wall,” a police report says.

In an unusual move for an agency that had remained extremely tight-lipped as the child death scandal unfolded, DCF’s interim secretary, Esther Jacobo, released nearly 100 pages of records Monday, and discussed Jayden’s death openly with a reporter.

The head of DCF’s privately run foster care agency in Miami, called Our Kids, also discussed the case. “

All of the professionals involved are grieving the senseless and brutal way Jayden’s young life ended,” said a statement released Monday jointly by Our Kids and the Children’s Home Society, a group that had been involved with Jayden’s family.

“These tragedies should not happen. We are working with our partners to understand exactly what happened and what changes need to be made immediately,” the statement added.

Both DCF and Our Kids have launched a “painstaking review of every detail of what went wrong with this family,” the agencies said. “The murder of an innocent child at the hands of his father while the family was under state supervision is completely unacceptable. The review of the details of this case is gut-wrenching for all of the professionals involved.”

LONG HISTORY

Jayden and his siblings had been the subject of at least five prior investigations by DCF. An investigation last month, which resulted in Jayden being removed from his mother’s care and sent to live with his father, was not provided to the newspaper because it involved a sibling whose records are confidential, DCF said.

The Herald filed suit in Miami-Dade court Monday to obtain the records of that investigation, and Jacobo said her department would not fight the request.

The toddler’s involvement with the state appears to have begun in February 2011, with allegations that he was living in a “filthy” home overrun with cockroaches and littered with dirty diapers.

“The baby bottles are nasty and not cleaned after use,” a caller to DCF said, adding that both Villegas and Jayden’s mom, Lourdes Morales, were smoking marijuana “in front of the children.”

The investigation was closed on March 31, 2011, with an investigator concluding he could not substantiate the allegations.

But the case has an odd asterisk: The DCF investigator, Jean Lacroix, was arrested a year later on charges that he was pimping out foster children assigned to his care as part of a sexual trafficking ring.

Lacroix’s supervisor in the case, Duray Smith, resigned in May after the Herald reported he had been moonlighting as a substitute teacher — sometimes on the same days he was working at DCF — without seeking the approval of the department.

For several months, Jayden lived with both Villegas and Morales in an unusual Homestead household: Villegas was living with his girlfriend, 24-year-old Guadalupe Jaramillo, with whom he was expecting a child, and her four children. Morales was living in the home with the couple, and was expecting her fourth child with Villegas.

When an investigator arrived at the home, Jaramillo at first identified herself as Villegas’ sister.

ABUSE

Villegas had been repeatedly accused of abusing Morales, and in April, he was charged with domestic battery after he allegedly “grabbed” Morales “violently, causing injury to her right arm,” according to a Florida City police report.

Prosecutors dropped the charges against Villegas on the same day he is alleged to have attacked Jayden, however, when Morales could not be located, records show.

Villegas acknowledged to a DCF investigator in March 2012 that he had “an anger issue and wants counseling.” It is unclear whether Villegas ever received the treatment, however, when the March 2012 investigation was closed.

“We are really saddened, and pretty upset about this child’s death,” said Jacobo. “There were a lot of missed opportunities in this case.”

An earlier version of this story incorrectly reported the manner in which Duray Smith, a former DCF supervisor, left the agency. Smith resigned in May.

Baby was ‘needle in haystack’ until investigators found and charged father for sex crimes

EDMONTON - They assigned the little girl the random name Baby Alison, and she was, a prosecutor told an Edmonton court, “the needle in a haystack ... a nameless child and could have been from anywhere in the world.”

But she wasn’t from just anywhere in the world. She was from Edmonton.

Pictures of her were found in 2010 in child pornography uncovered during an investigation in Europe. The National Centre for Missing and Exploited Children, an American organization, identified several Internet images and videos of the same infant girl they believed were produced in Canada. Ottawa investigators then took over, and by May 2012, 109 pictures and 13 videos of the child had been discovered. They also identified an unknown man with a heavy build and round face in some of the images.

The pornography was traced to the Edmonton area and the northern Alberta Integrated Child Exploitation Unit took over the investigation, though Baby Alison’s identity was still a mystery.

Crown prosecutor Cheryl Schlecker told court that investigators identified an Edmonton business pamphlet in the videos, as well as a local Capital Health logo. In some of the pornography, the child wore a white helmet used in medical procedures. That led police to the Stollery Children’s Hospital, where a staff member identified the girl as a former patient from 2007.

In May 2012, police investigated the family and visited the unkempt house where the girl lived with her father, uncle and grandmother. Officers noted her father fit the description of the man in some of the images. Items in the house also matched those that appeared in the background of the videos.

The father and his brother, the girl’s uncle, were both arrested.

The 34-year-old father pleaded guilty to the sexual touching of a person under sixteen and the creation, distribution and ownership of child pornography. The uncle’s case is still before the courts.

Schlecker asked the court Wednesday to impose a sentence of 11 to 12 years.

“This breach of trust that he inflicted on his biological daughter was the most extreme betrayal,” Schlecker said. “It is one of the most extreme breaches and betrayals a father can perpetuate against his daughter.”

On computers and electronics seized in her father’s home, sexual videos and pictures of the girl were found. In some of the photos, the girl was dressed in a pink dress and blond wig, “like a doll,” Schlecker said. In one of the videos, the girl softly calls out, “Dada.”

There were also 174 images of child pornography involving other victims from the Internet.

Schlecker told court the abuse began when the girl was three to six months old.

As his crimes were discussed, the father sat motionless in court in an orange prison jumpsuit.

Defence lawyer Mona Duckett made a submission for a sentence of seven to nine years. Schlecker said the father allowed his brother access to his daughter even after he walked in on an alleged sexual assault when she was only a few months old.

“He did not go to police or take steps to protect his daughter. He allowed his brother to use her as a sexual plaything. He didn’t see any harm in it.”

Later, court heard, the father sexually abused the girl himself.

“Is there any chance that this doesn’t have to be, like, known?” The father asked police during a statement. “Is there anyway that this can be kept quiet?”

The girl’s mother left the family when her daughter was two months old.

The girl is now with her maternal grandmother, court heard.

The father is scheduled to be sentenced on July 2.

Custodial dad under arrest; accused of death threats, physical abuse, neglect of two kids (St. Albans, West Virginia)

Dad PAUL NAYLOR is obviously custodial, though the point is not made explicitly. There is no mention of the mother anywhere, though later there is mention of Daddy's pothead girlfriend. The kids are now in "state custody," which suggests that Mom may be dead, "disappeared" or otherwise "unavailable."

Notice that this isn't just a case of a dirty house. There is also evidence that this father physically abused the kids and made death threats. That "should" make the authorities consider the question of what happened to the mother. It's no secret that abusers are unusually successful at gaining and maintaining custody/control of the kids and eliminating the mother through any number of means. Was a family court or child protection services involved in this situation? Who knows. No explanation here.

ST. ALBANS, W.Va. (WSAZ) -- A father is under arrest, accused of abuse, child neglect and using drugs.

Troopers tell WSAZ.com the family lived in disgusting and deplorable conditions.

Paul Naylor, 32, of St. Albans, was charged with two counts of child neglect resulting in injury and one count of conspiracy.

Garbage and junk piled high on the porch were only the beginning of what police and neighbors say was inside a mobile home in St. Albans.

"I've knocked on the door and I've kind of seen inside, and there was trash everywhere," friend Aaron Zabriesack said.

Trash waist high, dog feces, urine and even a dead rat in an aquarium were found, according to the criminal complaint.

However, troopers say what led them to the home was a call for help. A 9-year-old girl feared for her life, according to neighbors, and told police her father, Paul Naylor, made threats and hurt her.

"She had all kinds of bruises and she lied about them," Zabriesack said.

The girl told police Naylor threatened to kill her, her 3-year-old sister and everyone who lives at the trailer park. She says he held a knife to her neck, so she ran for help.

"You know it's ridiculous -- people take people for granted nowadays," neighbor Amy Fields said.

Whisper Oaks Lane is a place filled with kids and families. They play together, go to school together and know each other well. Most of the neighbors say they knew the 9-year-old and 3-year-old sisters were living in filthy conditions.

"Every time she'd come over she'd always smell like animals and she would always be real dirty," Fields said.

"The house smelled bad, and we felt something was going on funny there," friend John Young said.

Troopers searched the home and found dogs, animal waste, roaches, marijuana, drug items and prescription pill bottles. A toilet and hot water tank didn't even work.

State Police say Naylor told them the children had not been bathed in two days. When they searched, troopers say they never did find any soap or cleaning supplies. Instead, troopers found flies, a tub they say was unusable and a unbearable smell.

"They'll get what's coming to them you know for doing that to their kids," Fields said.

The children were taken to the hospital. They are safe and now in state custody.

Naylor was arrested. Police say his girlfriend, Kimberly Anderson, showed up high on drugs. She admitted she had been smoking marijuana, according to the criminal complaint.

Neighbors say now those children can escape from a place they say no one should have to call home.

Naylor and Anderson are both behind bars.

Dallas dad arrested after SWAT officers find home filled with filth

DALLAS -- SWAT officers were sent to a home in the 2900 block of Marideen Avenue to look for weapons after a 16 year old in the house allegedly made threats on social media.

He referred to Adam Lanza, the shooter at Sandy Hook Elementary.

But, when officers went into the home, they didn’t find any weapons -- instead, they found deplorable living conditions.

In a search warrant affidavit, Dallas police say they found the home filled with “[...]trash, food waste, live insects, dead insects, rodent droppings, human waste, and other unidentified filth. 

“All the cookware and eating utensils were filthy with food and insect deposits," the document continues. "The refrigerator contained rotting food, the cabinets did not have food in them, and the clothes washer smelled as if it contained vomit.”

Police arrested the head of the household, Ricardo Hernandez, and charged him with child endangerment. They say he put his teenage sons in jeopardy by making them live in terrible conditions. 

The boys, ages 14 and 16, hadn't been to school in over two years, according to school records. The father told police the boys' mother had been deported, and wasn't there to care for the children. 

The boys told police they stayed home and played video games. One of them said he hadn't taken a shower or bathed in two weeks.

 Police believe that Hernandez placed his children in danger of getting infections and or an illness from living in the home.

Portland father, girlfriend accused of child neglect, mistreatment

A Portland father and his girlfriend face child neglect and criminal mistreatment allegations, accused of leaving the dad's 10-year-old son home alone "in deplorable conditions" in a Southeast Portland apartment for a night.

Brian L. Parmentier , 40 and Sarah Call, 32, were arraigned in Multnomah County Circuit Court Thursday.

They each face allegations of first-degree child neglect, two counts of first-degree criminal mistreatment and second-degree animal neglect.

According to Portland police, Officer Robert Slyter responded Wednesday to a report of a child left unattended at an apartment in the 12500 block of Southeast Powell Boulevard.

The 10-year-old boy invited the officer in when Slyter showed up at the apartment. "Officer Slyter immediately could see that the home was in deplorable conditions with garbage, food and dog feces all over the floor,'' deputy district attorney Susan Howard wrote in a probable cause affidavit filed in court Thursday.

There was no running water, flies everywhere and no phone available in the residence, the affidavit said.

Officer Judy McFarlane, who was also on scene, wrote in her police report that "these were the worst conditions she has seen'' in her 40 years as an officer, Howard wrote in the affidavit.

McFarlane called animal control officers since there were three dogs, a cat and three kittens without food or water inside the apartment.

The 10-year-old boy also hadn't eaten that day, police said. Parmentier told police he thought his son was old enough to stay home by himself.

Call explained why they weren't home: They'd been arrested and accused of possessing methamphetamine and spent the night in jail.

Can't help wondering if Mom "giving up" custody was truly voluntary. Some mothers try to placate abusers by giving them what they want (total control of the children) in return for keeping them safe. Sadly, this strategy seldom works. Other times, it's simply a lie. It wasn't voluntary in any way, shape, or form. It's just a way to further demonize the protective mother.

Notice that Daddy started sexually abusing the daughter shortly after the mother vacated the home. This is one of those "inconvenient truths" that judges like to ignore.

Notice also that Daddy was a deadbeat slob--and was still catered to. This is the result of decades of father exaltation by the fathers rights movement.

Sex abuse case shows CPS revolving door

The detective nearly took a step back as he opened the door to the apartment to serve the search warrant.

The stench of rotting food mixed with that of dirty clothes and feces was overpowering. Dirty dishes and trash were everywhere and the carpets were stained throughout. In a laundry hamper, he found a dead mouse.

The Flagstaff Police Department went to the 40-year-old father's Lake Mary home last October searching for evidence that he had been sexually abusing his 11-year-old daughter.

It was not the first time police and Child Protective Services had been to the home.

The girl and her brother had been taken away from their father at least twice prior to the sex abuse report, but they were returned each time. The mother, who had separated from the father and given up primary custody, had asked for custody again, but she was denied.

The defendant had also been the subject of an investigation by Flagstaff police alleging that he had endangered the life of his son when he was hospitalized after being struck by a car while playing unsupervised in a parking lot.

The endangerment charge was ultimately dismissed in Coconino County Superior Court.

The man was sentenced to 10 years in prison last week for one count of continuous sexual abuse of a child as part of a plea deal with the Coconino County Attorney's Office. The man's name has been withheld to protect the identity of his victim.

CHILDREN REEKED

A police report said that the girl's mother had surrendered primary custody of her children to the man when they separated.

A CPS report filed early in 2012 had detailed how the children had shown up at school reeking and were asked to shower. The principal told CPS that she had sprayed her office with Lysol after the children left because of the stench.

CPS case workers found living conditions similar to what the Flagstaff police detective walked into in October. The case manager said she almost gagged from the smell.

The father spent all day cleaning and the children were returned to him.

Then later in 2012, the mother, who lives in New Mexico, asked the Coconino County Court to give her custody.

"(The girl) said she was with her mom for the summer and she was happier," a report said.

Her motion was denied, court records show.

THREE YEARS OF ABUSE

Then last fall, the girl spoke up at school about being abused, according to a police report. She said she thought what was happening to her was wrong and told investigators about what her father had done to her in disturbing detail.

In a secret hiding place, she'd kept an exact count of how many times she'd been molested, over the course of approximately three years.

An investigator would tell the suspect during questioning that the level of detail -- including specific sights and smells -- would convince a courtroom of jurors of his guilt. The detective told the man he had a very, very intelligent daughter, a police report said.

"This just isn't right," the man said in response.

The girl told investigators that the abuse had started soon after her mother moved out. Her father would tell her not to tell police or he would go to jail, she told investigators.

TWO HOURS ON HOLD

In the fiscal year ending just before the father was arrested, CPS investigated 16 cases of alleged child sexual abuse in Coconino County. Case workers found just one instance in which they said the charge could be substantiated, according to the Department of Economic Security's most recent child welfare report.

At sentencing last week, the mother begged Coconino County Superior Court Division 2 Judge Dan Slayton for the maximum sentence allowable for her former husband, saying she couldn't believe what the defendant had done to his own daughter. Prosecutors also asked for a long prison sentence under the plea -- the plea agreement had set the penalty at between five and 10 years.

"I've been contacted many times by CPS and my kids have been removed from him twice," she said.

The mother said her response was, "What now?" when the school called about her children being taken away last October.

But the school said they couldn't tell her anything about what had happened to her children -- she'd have to contact CPS. It took some two hours on hold before she'd be confronted with the grim accusations.

"Please do not allow the system to fail my children for a second time," she said to Slayton.

HASN'T FULLY ADMITTED GUILT

In contrast, the defense had asked for a lenient sentence within the confines of the plea agreement, which required a five to 10 year prison term.

The man's family, including his brother, appealed to the judge, saying that the defendant had been a good father. His brother and others had asked the defendant not to take a plea deal and to stand up for his innocence at trial.

Under the advice of his attorney, the man took a plea deal for five to 10 years in prison.

The defendant still hasn't actually admitted his guilt, despite his plea. He took what is known as an Alfred plea, or an "I'm guilty but I didn't do it" plea. The plea enables a defendant to maintain innocence and make a deal with prosecutors when they've been advised that there is substantial evidence against them.

Bruce Griffen, the father's lawyer, highlighted strong family support as a reason for a sentence on the lower end of the plea range. In letters to the judge, the family also questioned the girl's credibility and begged for a light sentence.

"The longer he spends in prison, the less productive he'll be when he gets out," the man's brother said.

LIVED IN DISGUSTING CONDITIONS

However, prosecutors questioned the family's perceptions of the defendant, pointing out that he had been unemployed and on food stamps for more than a year, yet allowed his children to live in disgusting conditions.

Senior Trial Attorney Jonathan Mosher said that the man should have benefited from his family's support, but did not.

"We're talking about a young girl that is so traumatized by this that as a prosecutor I have to consider if I can put her through a trial," Mosher said. "We're eager to avoid further traumatizing the victim."

County Attorney David Rozema reiterated that point.

"In these types of cases, one of the things we give a lot of consideration to is whether the victim wants to move forward to trial or not," said Rozema. "You're asking a 12-year-old girl to walk into a court room and talk about what dad did while he's sitting there."

The top local prosecutor said he has to balance the victim's wishes with pursuing long prison terms in the interest of public safety. In this case, Rozema said he was happy with the 10-year prison sentence.

Ultimately, Slayton agreed with prosecutors and issued the maximum sentence, citing emotional harm to the victim. The defendant must also register as a sex offender for the rest of his natural life.
