A father who left his baby daughter brain-damaged after shaking her and throwing her down on to a couch in a “deliberate and violent assault” has had his seven-and-a-half year prison sentence reduced following an appeal.
The Criminal Appeal Court quashed the sentence and imposed a custodial term of six years and nine months after ruling that the sentencing judge’s starting point of nine years – which was discounted due to the unnamed father’s guilty plea – was “not consistent with what was held to be appropriate in these cases”.
Lord Brodie and Lord Drummond Young heard that the appellant “SD” pled guilty at the trial diet of assaulting his six-week-old daughter to her severe injury, permanent impairment and to the danger of her life.
The High Court in Glasgow was told that he had become “frustrated” with the baby and “lost control” after she had kept her parents awake during the previous night.
While the sentencing judge accepted that there was “no wickednesss” in his actions, she viewed this as a “deliberate and violent assault” using a degree of force which was “obviously likely to cause serious harm” to a six-week-old baby, who was left with catastrophic, life threatening injuries.
On 31 March 2015 she sentenced the appellant to seven-and-a-half years’ imprisonment – discounted by around 15 per cent from nine years for the “utilitarian benefit” of the guilty plea, albeit that it had been tendered very late.
But the appellant challenged the sentencing judge’s characterisation of what he had done as being “obviously likely to cause serious harm”.
It was submitted that it would not have been apparent to a layman that such serious harm would be caused by the degree of force which had been used in the case.
There was a short period of shaking by a “hands on” father where there was “no history of previous abuse” of the child.
It was a “momentary loss of control” lasting a few seconds on the part of a young man who was a “loving father” and who had not previously served a custodial sentence.
In these circumstances it was argued that a starting point of nine years imprisonment was “clearly excessive”.
The appeal judges accepted that the consequences of the assault were “unintended” by the appellant, but did not accept the submission that the risk of some degree of serious harm to a young baby was not such as to be obvious to a layman.
Delivering the opinion of the court, Lord Brodie said: “On sentencing in a case of assault assessment of the seriousness of the offence will usually involve consideration of two potentially independent factors, the culpability of the offender’s act and the severity of the consequences of that act.
“We say potentially independent because the likelihood of it having adverse consequences is relevant to the judgment as to the culpability of a particular act. In this case, the consequences of the assault on the child were catastrophic.
“The sentencing judge says in her report that it is difficult to conceive of a more vulnerable victim than a six week old baby. We can only agree and we would see that as being clear to any parent, however inexperienced that parent may be.
“We therefore consider that the sentencing judge was correct to approach this case as one which involved a significant degree of culpability as well as a catastrophic result. She was entitled to take the view that only a significant custodial sentence was appropriate.”
However, the judges noted that she was not addressed on the issue of “comparative justice” and said they did not consider that a starting point of nine years was consistent with what was held to be appropriate in these cases.
Lord Brodie added: “In the present case there was evidence that the appellant had shaken the baby and then violently thrown her down onto a couch. Whether or not the throwing of the infant onto the couch exacerbated her injuries, it pointed to an act of real aggression on the part of the appellant. We see that as something which requires to be reflected in the sentence imposed.
“Accordingly, we shall quash the sentence imposed on 31 March 2015 and impose an alternative sentence of six years and nine months. We have arrived at that figure by taking a starting point of eight years imprisonment and discounting that by a similar percentage to that adopted by the sentencing judge.”

Ian Ruddock killed his five-week old daughter, Olivia, at their family home
Ian Ruddock killed five-week-old Olivia at the family home and two years later attacked the second child.
He was convicted of culpable homicide and attempted murder.
The High Court in Edinburgh heard how the 34-year-old evaded justice and the baby’s fate was only discovered after doctors treating his second victim tipped off police.
The court heard Ruddock left the boy with a fractured skull and ribs – similar to injuries suffered by Olivia. Ruddock, of Shawlands in Glasgow, told the court: “I was trying to get her to wake up. I can just remember holding her and trying to get her to wake up. I don’t remember very much at all. I do not remember much for the next few weeks.”
Asked whether he believed he had harmed his daughter, the father-of-three replied: “I don’t believe for a minute that I’ve caused her death. It’s not even remotely possible.”
Two years after Olivia was killed at a house in Williamwood, East Renfrewshire, Ruddock targeted another child in Glasgow.
He seized the boy – who can’t be identified for legal reasons – inflicting blunt force trauma to his head and body.
Police launched their investigation after hospital staff treated the boy, detectives discovering what happened to Olivia when checking Ruddock’s past.
Consultant radiologist Greg Irwin, who worked at Glasgow’s Yorkhill Children’s Hospital, told the court there was “incontrovertible” evidence Olivia sustained three fractured ribs before her death.
At the time, doctors concluded she had died from bronchial pneumonia.
Mr Irwin said it was a “regular occurrence” for medical staff to misdiagnose fractures.
Ruddock’s wife, Wendy, 37, told the court she “never believed” her husband had done anything wrong after Olivia’s death in March 2011.
Last night, Detective Chief Inspector Maxine Martin said: “It is difficult to understand how anyone could harm a defenceless child, let alone her father, who should have been there to protect her. This was a particularly difficult case due to the passage of time, the ages of the children and complexity of the medical evidence.”
Sentence on Ruddock was deferred and he was remanded in custody.

Father accused of baby's murder 'performed CPR' before her death

The estranged wife of a man accused of murdering his five-week-old daughter has told a court he performed CPR on the girl before she was taken to hospital.
Wendy Ruddock, 37, told a jury that her partner Ian sounded panicked when he told her to phone an ambulance after Olivia stopped breathing.
The High Court in Edinburgh heard on Thursday how the infant became ill during an early morning feed.
The court heard how Ruddock performed CPR on the youngster before she was taken to Yorkhill hospital in Glasgow.
Medics there tried to save Olivia's life and Ms Ruddock said she remembered seeing the infant hooked up to a number of "machines".
However, the court heard that doctors concluded that she "couldn't survive" her injuries.
Recalling what doctors told her before Olivia passed away, Ms Ruddock said: "They said 'she won't survive this,' and they switched off the machines."
Mrs Ruddock, of Clarkston, Glasgow, was giving evidence on the second day of proceedings against her husband, who lives in the city's Shawlands area.
He denies charges of murder, attempted murder and assault.
On Thursday, Mrs Ruddock told the court he had got up from bed in the early hours one morning to feed their daughter.
But during the feed, Olivia became unwell, prompting him to shout for her.
Saying he sounded panicked, Mrs Ruddock told prosecution lawyer Ashley Edwards: "I knew something wasn't right.
"He shouted on me to phone an ambulance which I did immediately. "The person on the other end of the phone was trying to talk us through CPR. But it was just panic stations."
Mrs Ruddock, who works in financial services, said her husband performed CPR on Olivia "as best he could".
She told the court: "You're not really thinking straight."
Mrs Ruddock also said that her husband went with Olivia in the ambulance.
She added: "I was in a terrible state."
Mrs Ruddock also told the court that at Yorkhill, medics conducted tests in a bid to find out what had made Olivia unwell.
She added: "I just remember Olivia being hooked up to a lot of machines."
Mrs Ruddock also told the court that medics concluded that they couldn't save Olivia's life.
She added: "The damage was too extensive and she couldn't survive."
The court heard that following Olivia's death, police interviewed both her and her husband.
Her daughter's body was not released to her family for six months.
Mrs Ruddock also told the court that she received counselling from the Scottish Cot Death Trust following the death of Olivia.
She said that her husband helped her in the weeks following Olivia's passing.
Mrs Ruddock added: "He was great. He was the one who sorted everything out. He was the one who got counselling for me. He was the one who lifted the phone as I couldn't even do that."
She also told the court that Mr Ruddock was "good" with children.
Mrs Ruddock told the court: "He certainly was very good with children. He was good with kids. He was good with my nieces and nephews.
"Whenever there was a family get together they would go to him. It seemed to be something that ran in his family."
The court also heard that the couple were now separated.
When Ms Edwards asked whether she thought their marriage would survive the trial, Ms Ruddock replied: "It's probably at an end."
Prosecutors allege that in 2009, Mr Ruddock assaulted a child at an address in the south side of Glasgow.
Crown lawyers also allege that on various locations between January 27, 2011 and March 6, 2011, at a house in Clarkston, Glasgow, he assaulted his daughter Olivia.
Prosecutors allege that he seized hold of Olivia, compressed her chest and rib cage with his hands before shaking her repeatedly.
It is also claimed that Ruddock "inflicted blunt force trauma" to her head and that she subsequently died at Yorkhill hospital on March 6, 2011.
The third charge charges that he attempted to murder another child two years ago at an address in Glasgow.
Ruddock is represented by advocate Donald Findlay QC. He has pleaded not guilty to the charges.
The trial, before judge Lord Bannatyne, continues.

A DAD of three has been charged with the murder of his five-week-old daughter and attempting to kill a baby boy.
Financial advisor Ian Ruddock was charged with killing baby daughter Olivia nearly four years after she died in hospital.
Her death was only treated as a crime when police began investigating the alleged attack on the boy last year.
Ruddock, 33, is further accused of assaulting a third boy in 2009.
The list of charges revealed by the Sunday Mail was detailed when Ruddock made his first public appearance at the High Court in Glasgow last week.
The murder allegation spans January 27, 2011 – the day Olivia was born – and March 6 of that year.
Ruddock is said to have assaulted the girl on various occasions between those dates at her home in Vardar Avenue in Clarkston.
The charges state Ruddock got hold of Olivia and compressed her chest and rib cage with his hands.
It is further alleged he seized hold of her body and shook her repeatedly as well as inflicting blunt-force trauma to her head and body.
The charge states Olivia was left so severely injured, she died at the Royal Hospital for Sick Children, at Yorkhill, on March 6, 2011.
The murder probe is said to have been sparked following claims Ruddock also tried to kill a baby boy last year.
Ruddock, now living in the Glasgow’s Shawlands, faces an accusation of attempted murder between March and May 2013.
The child was aged between a week and just over two months at the time.
Ruddock is said to have assaulted the boy in a similar manner to Olivia at the same address in Clarkston.
Ruddock is also accused of an earlier attack on a third child at the house in 2009.
The assault is said to have happened between August and September. The boy would have only been days old at the start of the allegation.
Ruddock’s QC Donald Findlay entered not guilty pleas on Ruddock’s behalf during this week’s hearing.
Mr Findlay told the court the case was of “some considerable complexity”.
Explaining the murder allegation, he went on: “This stems from the attempted murder charge – it is from that an inquiry was carried out into what happened.”
Ruddock is a financial consultant who runs his own company ACR (Consulting) Scotland Ltd.
He married his wife Wendy, 36, who also works in financial services, at Dalmeny Park Country House, Barrhead, East Renfrewshire, in 2008.
Judge Lord Turnbull set a trial due to start next August at the High Court in Edinburgh.
A further hearing will take place before then in February, in Aberdeen. Ruddock’s bail was continued until then.

It's not a big stretch to imagine that dad BRIAN MCKERROW treated his wife and kids in the same threatening, violent way. But the fathers rights movement encourages these guys to believe they are entitled to order any women around and bully them. They are so astonished when women fight back.

Ms Poling, who regularly goes undercover with hardened criminals during her investigations, added that she had never been more frightened than she was when dealing with him.
She told the court: “I felt unnerved by what he was saying. I felt scared and I hadn’t felt that way before. Because of the work I do I have dealt with criminals and people who have made horrible threats to me.
“It got to the point where I was scared to answer my phone. It was invading my working day and private life. Even in the evening and at the weekends I was getting calls.”
McKerrow had denied all the charges against him and lodged a list of witnesses, including the Justice Secretary Kenny MacAskill and MSP Roseanna Cunningham.
However, this was objected to by the prosecutors and McKerrow had to rely on his own evidence in his defence.
He was found guilty by Sheriff Vincent Smith and sentence has been deferred for reports.

A SIX-week-old baby suffocated under a plastic sheet after his drunk dad left him alone on a sofa for six hours.
Little Ruaridh McLeod had been taken into the living room after waking up in the night, but dad Roderick Hunter – who had binged on booze and drugs – went to the toilet and didn’t return.
The boy’s mum, hairdresser Ashleigh McLeod, woke the next morning to find him trapped under a cover used to protect furniture while they decorated their Ferry Road Avenue home.
She frantically tried to resuscitate her son while Hunter called for an ambulance, but Ruaridh – described as a “healthy, happy baby” – was already dead.
Neighbours in the street today described tragic Ruaridh as a “bonnie wee thing”.
One said: “I’d only really seen them on the stair as they’d only been here for a few weeks when it happened.
“He was a bonnie wee thing. I’d seen him and his mum but not the dad. It’s such a tragic thing to happen.”
Another said: “They were just in and I knew they’d been decorating. I heard what had happened the next day when police came around asking questions. It’s an absolute tragedy.”
Hunter, 30, was yesterday jailed for 27 months at Edinburgh Sheriff Court after pleading guilty to neglecting his son while under the influence of alcohol and drugs, leaving him unattended for more than six hours and failing to provide for his physical safety and emotional wellbeing on November 23, 2011.
The court heard how chef Hunter had been sipping alcohol secretly from a juice bottle while at work that night, before drinking with a colleague after his shift. He then bought cider on his way home but stopped at a bar for more drinks. When he got back, he continued to knock back booze and smoked cannabis.
Prosecutor Karon Rollo said that when Ruaridh woke at around 3am, Hunter took him into the living room for a feed, but added that the dad now had no memory of placing his son on the sofa.
Ms Rollo said that when Ms McLeod woke up at 10am “she panicked and asked the accused where the child was” before finding him “lying on the settee on his back with the plastic sheeting over his head and face”.
Defence counsel Neil Murray QC told the court that the couple were still together and that Hunter was seeking help for a “long-standing drink problem”.
Jailing Hunter, who now lives in Nichollfield, Newhaven, Sheriff McColl told him: “I accept you are truly remorseful. I expect it is something with you every waking moment.”

A father who has twice been found guilty of murdering his four-month-old baby daughter has been jailed for more than 15 years.
Craig Jamieson, 32, was sentenced to 15 years and a month in prison after being found guilty of fatally injuring daughter Abbie at his then home in Glasgow.
Jamieson, of Knightswood, Glasgow, was charged with inflicting blunt force trauma to her head and body leaving the girl so severely injured she died at Yorkhill Hospital on February 8, 2008.
In April 2010 Jamieson was sentenced to life imprisonment for Abbie's murder following his conviction after trial, with a minimum period of 16 years.
A year later his conviction was overturned by the Appeal Court on the grounds that the trial judge had misdirected the jury in the case.
He was then found guilty at a second trial at the High Court in Glasgow which ended earlier in February.
Sentencing Jamieson, Judge Lord Matthews said that the length of the sentence reflected the original length minus the 11 months he has already spent behind bars.
Under Court of Appeal guidelines, the judge was prevented from handing down a longer sentence than the original.
During the second trial Abbie's mother Nichola Haddock said she met Jamieson at a Glasgow bar in 2004 after moving to the city from Belfast to start a university degree in social work.
The mother told the court how she raced home to their home in Dumbarton Road in Scotstoun from university to help her sick child.
She said: "I got into the flat and went straight into the living room. I called Abbie to say that I was home. Her chair was pointed towards the TV. She was quite pale and her eyes were staring into space.
"When I lifted her, her whole body went back. I screamed and fell to the floor on my knees. Craig called an ambulance. I was still holding her at that stage."
John Dunn, area procurator fiscal for Glasgow and Strathclyde, said: "Craig Jamieson's conviction for the brutal murder of his infant daughter Abbie demonstrates the commitment of the Crown to ensure that those who are guilty of murder and other serious offences against children will not escape justice."

FATHER accused of killing his baby son made his first court appearance over the weekend.
Lee Clark was released on bail after appearing at Peterlee Magistrates’ Court in Peterlee, County Durham on Saturday morning.
During the 20 minute hearing, Mr Clark, 27, who was wearing a grey polo shirt and jeans, spoke only to confirm his name, address and date of birth.
He is accused of the manslaughter of five-month-old Charlee Cameron Clark.
Charlee was admitted to Darlington Memorial Hospital with serious head injuries on February 25 last year.
The infant, who lived with his parents at a house on Neville Close in Gainford, between Barnard Castle and Darlington, was rushed to a specialist unit at the Royal Victoria Infirmary in Newcastle for treatment.
The child died from his injuries the following Tuesday, March 1, prompting the arrest of Mr Clark and an 11-month long police investigation.
He answered his bail on Friday, and was then charged by police.
Mr Clark’s bail conditions mean he must now live at the home of a family member in Fife, Scotland, and report every Wednesday lunch time to Cowdenbeath Police Station.
He will remain on the conditional bail until his next court appearance, which is due to take place at Newcastle Crown Court on the morning of Wednesday, February 8.

A mother whose baby daughter was allegedly murdered by the child's father has told a court that her partner "did not really" interact with their child.
Nichola Haddock was giving evidence at the trial of Craig Jamieson, accused of killing four-month-old Abbie on February 8, 2008.
The child's mother told the High Court in Glasgow that her daughter's birth was "the happiest day of my life" and said Jamieson showed the same excitement.
She told the jury she was "delighted" to be a new mother, but when asked about how Jamieson felt about the baby's arrival, she said: "Ok, I suppose".
Asked how he interacted with his new child, she appeared to start sobbing and replied: "He didn't really".
Jamieson, of Knightswood, Glasow, is charged with killing his daughter by inflicting blunt force trauma to her head and body leaving the girl so severely injured she died at the city's Yorkhill Hospital on February 8, 2008.

A father who subjected his family to a 20 year ordeal of "violence, depravity and fear" has abandoned his attempt to get his 15 year prison sentence cut.
Former firefighter Kenneth Blair, 66, was jailed in September just after it was announced that police were taking another look at the death of his baby son in 1968.
He was expected to appear at the Court of Criminal Appeal in Edinburgh on Wednesday for his legal team to argue that the sentence imposed by judge Lady Stacey was too severe.
Instead, court officials were told that the appeal against sentence had been abandoned and the case did not call in court.
In September Blair admitted a catalogue of cruelty towards his wife, another son and daughter spanning almost 20 years.
The court heard how the children were punched, kicked and thrashed with a leather belt with a heavy buckle.
After the court heard details of Blair's brutal reign at a number of addresses in Fife between September 1967 and May 1986, defence QC Herbert Kerrigan admitted the conduct was "barbaric."
Lady Stacey told Blair: "You have pled guilty to charges which show that you have subjected your family to violence, depravity and fear."
Blair, who has a record of convictions for sex with underage girls, also admitted rape and attempted rape.
He is also the father of Colin Blair who died in 1968, just six weeks after his birth.
The tragedy was recorded as "unexplained" at the time and the cause of death was put down to inhaling vomit and bleeding inside the baby's skull.
Days before his court appearance, Tayside Police's major crime review team announced that they were looking again at the case, a move which could lead to the baby’s body being exhumed for further tests.

THE father of a baby at the centre of a murder probe has been jailed for 15 years after savagely battering and humiliating his wife and two of his children.
Former fireman Kenneth Blair, 66, brutalised his family in a catalogue of cruelty spanning almost 20 years.
His own counsel called it "barbaric".
Blair pled guilty to the abuse, and admitted raping and trying to rape a child.
Police have begun a new inquiry over his son Colin, who died in infancy in 1968.
Blair was caged yesterday for terrorising wife Isabella, now 60, son Scott, now 42, and daughter Gillian, now 40, at addresses in Fife between 1967 and 1986.
He laughed as he beat his wife, who screamed and asked: "Why? Why? Why?"
Blair slapped, punched and kicked Isabella, pulled her hair, hit her head against a door, struck her with a belt and hurled her down stairs.
He attacked her when she was pregnant with Scott and Gillian. A charge that he hit her while she was carrying Colin was dropped.
Scott and Gillian were punched, kicked and thrashed with a leather belt with a heavy buckle.
Andrew Stewart QC, prosecuting, told the High Court in Edinburgh there were "numerous occasions" when Blair punched and kicked Scott so hard in the stomach and genitals that he vomited.
Blair stopped the children using the toilet at night, then beat them for being "smelly" after they wet themselves.
He enjoyed a "game" where he asked his family questions and slapped anyone who gave a wrong answer. He also made his victims watch films he chose and slapped them if they fell asleep.
Blair dragged Gillian around by the hair and once forced her towards a coal fire and threatened to push her in.
Another time, when the family were moving house on foot, Gillian dropped and lost some of their belongings.
Mr Stewart said: "Blair shouted at Gillian and took off his belt. He then hit Gillian to the back and bottom with the buckle, leaving imprints on Gillian's skin."
Scott and Gillian had one happy week in their young lives - when Isabella tried to leave Blair and took them to Stirling. But he begged his wife in a letter to come home, and she agreed.
Eventually, Blair left the family for a new partner in England. But Mr Stewart said he left behind "victims living in fear - their lives destroyed by the appalling treatment he had inflicted on them".
Blair was finally brought to justice after one of his victims found the courage last year to go to police. Officers launched a year-long investigation which put him in the dock.
As well as the assaults on his family, Blair admitted raping, attempting to rape and molesting a girl of 12 who cannot be named. He has a record for underage sex.
Herbert Kerrigan QC, for Blair, told the court his client's conduct "can only be regarded by any right-thinking person as barbaric".
He added: "The accused has instructed me to apologise to his victims. I can appreciate that will be very difficult for the victims to accept."

Baby Colin was six weeks old when he died. The cause was given as inhaling vomit and bleeding in the skull and the tragedy was treated as "unexplained".
Tayside Police's major crime review team announced this week that they were reopening the case.
Colin's body may now be exhumed for further tests as officers try to establish whether foul play was involved in his death.

Dad convicted of killing 4-month-old daughter freed before retrial (Glasgow, Scotland)
Basically CRAIG JAMIESON is but another one of your garden-variety unemployed chaps drafted into baby tending--with the usual disastrous results. Seems he got "frustrated" or something and smacked the baby's head against something hard, which resulted in an ultimately fatal skull fracture. And then there were severe abdominal injuries, too. Nevertheless, Daddy has persisted in blaming the mum, though she was attending university classes at the time.
I'm not sure I understand why this fellow is getting a retrial. The reasons sound pretty specious to me.

A father serving a life sentence for murdering his baby daughter was freed by appeal judges yesterday.
Craig Jamieson, 31, who was ordered to serve 16 years in prison following the death of his four-month old daughter Abbie, is to face a fresh trial after the Court of Appeal heard criticism of the way the jury was directed by the trial judge, Alastair Stewart, QC.
Lord Osborne, sitting with Lord Eassie and Lord Nimmo Smith decided the conviction could not stand – but ordered that Jamieson should face trial again.
Abbie died in Glasgow’s Yorkhill Hospital in February 2008. A trial heard she had suffered a fractured skull and severe injuries to her abdomen.
Unnemployed Jamieson denied he was responsible but in April last year a jury found him guilty of inflicting blunt force injury “by means unknown” at his then home in Dumbarton Road, Glasgow.
He had lodged a special defence of incrimination against the baby’s mother, Nichola Haddock, 30.
Abbie had no pulse, no circulation and was unconscious and not breathing when admitted to Yorkhill.
Medical experts told the court that her injuries were likely to have been caused by her being hit off a hard surface like a wall or a worktop.
Prosecutors claimed Abbie was uninjured when her mother left for university after 7am on the day the baby died.
Jamieson, now of Drumchapel, claimed in court that he had fed the baby as normal that morning, but phoned his partner and his mother to tell them that she had gone white, was feverish and had injuries to her face and head.
The baby’s life support machine was eventually switched off.
After yesterday’s decision to overturn Jamieson’s conviction, defence QC Ronnie Watson asked for his client to be released on bail to await his new trial.
The appeal judges agreed, ordering Jamieson to stay away from Ms Haddock and not to try to contact her in any way.
It is understood that Ms Haddock, who was studying for a BA in child care and social work at Glasgow Caledonian University at the time of her daughter’s death, has returned to her native city of Belfast.
She had been banned by a bail order from meeting up with Jamieson, but the court heard that she conceived his second daughter around the first anniversary of Abbie’s death.

Killer dad released from prison; murdered 11-week-old son in 2001 (Ediburgh, Scotland)
Dad ALEXANDER NESS was alone with his 11-week-old son when he shook him to death in "a fit of rage." That was back in 2001. In 2003, he was sentenced to 11 years in prison. But now he's out. Somehow the math isn't working for me....
So this piece of sh** is STILL getting out early despite getting plastered the last time he was released early from prison in 2009? And despite the fact that he's considered a "high risk offender" who is prone to violent outbursts?
And this guy had been "freed early" on violence and drug dealing charges when he killed his newborn son!
Be very afraid for the babies of Scotland. I think the authorities have made it quite clear how little they value their safety. Daddies must have their rights, you know.

The baby's death in 2001 led to sweeping reforms of the child protection system in Edinburgh.
Ness, 61, was let out of jail in 2009, but was recalled just days later after breaking his conditions of release by going out drinking.
Police and prison sources were today quoted saying he was a "high risk offender" prone to violent outbursts.
Ness has been seen on the streets of the Capital and is understood to be living in supported accommodation in the centre of Edinburgh until somewhere more permanent is found for him. Conditions of his release reportedly include a ban on any contact with his ex-partner Ms Malcolm.
And he is not allowed to visit Caleb's memorial in the city's Seafield crematorium without permission from his probation officer.
Ness was on licence after being freed early from a five-year sentence for violence and drug dealing when he shook the life out of baby Caleb.
The attack was so violent that the baby suffered broken ribs and bleeding around his brain. Doctors said it was not the first time he had been assaulted.
Ness denied murder and tried to blame Ms Malcolm, but later pled guilty to a reduced charge of culpable homicide. The judge who jailed him, Lady Cosgrove, ordered that he should be closely monitored for four years after his release.
Caleb's death led to major reforms after a report said the child protection system in the Lothians was flawed. It also led to the resignation of Edinburgh's social work director.
Edinburgh Pentlands Conservative MSP David McLetchie said: "If he has such a long list of restrictions and if he is still thought to be dangerous then why on earth has he been set free?"

INCEST victim Anne-Marie Wilson had a slavemaster and a rapist instead of a father.
Monster dad John Thompson, dubbed Scotland's Josef Fritzl, raped his daughter repeatedly and made her pregnant SIX times over 16 years of merciless abuse.
But now, just days after seeing her tormentor caged for 12 years, Anne-Marie feels she finally has some justice.
She told the Sunday Mail: "I do not regard John Thompson as my father. I do not believe he has any right to be thought of as one.
"He made me a prisoner from a very young age and for much of my life. His abuse and cruelty took away my childhood and teenage years."
But she added: "Knowing that the extent of what he did has been recognised by the court means I can move on and close the door on what happened to me."
Dad-of-eight Thompson, now 65, brutalised his daughter in a calculated campaign to have more children and claim more benefits. He would force her to watch hardcore pornography before raping her.
He got three years and nine months in jail in 2007 for making Anne-Marie pregnant at their Glasgow home in 1995.
After that case, we told Anne-Marie's story and our revelations helped drive a major new police investigation.
And the probe by detectives in West Yorkshire, where Thompson and his family lived in the 1980s, ended last week in three rape convictions and a far longer sentence.
Detective Superintendent Colin Prime, of the West Yorkshire force, said: "This was the worst case of sexual abuse I have seen in 30 years' policing.
"I can only hope Anne-Marie can now find some closure and get on with her life. I hope Thompson is never released."
Anne-Marie, now 40, bravely agreed to make a complaint against her father and saw him jailed at Leeds Crown Court. It was the end of an ordeal that began nearly 30 years ago.
The abuse started in 1981, when the family were living in the Yorkshire city of Bradford.
Thompson, also known as John McMillan, first raped Anne-Marie when she was 11 and made her pregnant at 15. She had the first of four miscarriages she would suffer in her years as her father's sex slave.
In 1988, she had a son, Benjamin, but he was stillborn.
Thompson's abuse of Anne-Marie continued after the family returned to Scotland in the 1990s and she had a daughter, Jennifer, in 1996.
The little girl lived only eight months before dying of a brain condition and Anne-Marie finally broke free of Thompson after the agony of losing her child.
Detectives eventually obtained a DNA sample from Jennifer's post mortem which proved Thompson was her father. It was the key piece of evidence that led to his 2007 conviction and sentence.
But the police had not finished with Thompson. West Yorkshire detectives had suspected for years that he had fathered baby Benjamin and they began to focus on him again as part of a review of unsolved sex crimes.
Mr Prime said: "We became aware of the police investigation in Glasgow and newspaper reports of the case.
"At the time of the original offence in Bradford, Anne-Marie said she did not want to make a complaint. But we always suspected Thompson was the father."
Last year, police proved Thompson's guilt, using DNA from Benjamin's post mortem.

Dad GRAHAM DOWNIE was divorced, with weekend visitation with his two daughters. He is a "lonely and troubled" man in need of psychiatric help--and that according to his own lawyer. So how did he get visitation rights? This "socially isolated" sex offender has now been jailed--after police found over 13,000 child porn photos on his computer, including those that are classified as being in the most offensive category. For all that, Daddy will only serve 8 months in prison. His daughters want nothing more to do with him. (I'm surprised nobody is accusing the mother of "parental alientation syndrome" or PAS.) Hopefully, the girls will no longer be required to visit him--unfortunately, stranger things have happened.

Police staged a dawn raid at the home of divorced dad-of-two Graham Downie on May 12 this year after a tip-off.
They found 13,771 indecent images and 58 pornographic movies of children aged between just three months and 13 years old.
More than 2500 images and 31 movies were at level four and five - the most offensive category.
The 42-year-old from Linlithgow, West Lothian, told officers his daughters shared the same computer when they stayed at weekends but had their own password-protected areas.
But when he appeared for sentence at Livingston Sheriff Court yesterday, his lawyer revealed that his daughters wanted nothing more to do with him.
Downie's ex-wife, who was brought into the courtroom to see sentence being passed, broke down in tears as the father of her children was led away to start an extended sentence.
Downie will serve eight months in prison and a further 16 months on licence. His name was added to the Sex Offenders' Register and he will be subject to notification requirements for a further ten years after his release.
He told police he downloaded the pictures because it was "taboo" and he got "a thrill from finding and downloading the images". He admitted he had viewed the abuse of children of all ages.
Darryl Lovie, defending, described Downie as a lonely and troubled man.
He said: "He appears to be a very socially-isolated person, a man who has difficulty establishing and maintaining friendships in the community - a situation not uncommon for an accused person facing charges such as these."
Mr Lovie said his client had sought psychiatric help.
He added: "There's no doubt that his behaviour in committing this offence has devastated the only real valuable relationship in his life.
"His children are finding it very, very difficult to come to terms with the situation and want nothing further to do with their father."
Passing sentence, Sheriff Martin Edington said the high number of images involved meant there was no possible alternative to prison.
He added: "You've shown remorse and indeed disgust, and a willingness to tackle your problem, but the public need to be protected against sexual offenders."

Notice that this UNNAMED DAD had 26 children with at least four women. It appears that Dad deliberately targeted women with substandard intelligence and/or other issues for his apparent personal breeding program and pedophile ring. A DAD who fathered 26 children is facing rape and abuse charges involving his kids.
The 44-year-old, who cannot be identified, is accused of 25 abuse, violence and neglect charges spanning 23 years.
Social workers have spent years removing boys and girls from his care over fears he was grooming them for abuse. Some were taken into care, fostered or adopted.
But when the children are removed, he has bragged to the authorities: "If you keep taking them away I'll just have more."
Glasgow City Council social workers and Strathclyde Police protection officers believe he has 26 kids by at least four women.
Most of the mothers of his children - from babies to a daughter aged 20 - are vulnerable and of low intelligence.
He put his name on the birth certificates of at least eight of his oldest kids but no longer does so in an attempt to avoid social work and police scrutiny.
A source said: "He married and had three daughters and a son. He then had two sons and two daughters to another woman.
"They're the eight with his name on the certificate. He's learned it's harder for the authorities if he isn't named as the father."
His latest partner is 41 and it is thought he has fathered four children with her.
They were last known to be living in the city's Ruchazie area, where neighbours labelled him The Beast.
Five years ago the Sunday Mail first exposed the case, which sickened police and social workers.
He was then living in the city's Dalmarnock area with another woman, who had produced four children to him since 1998. All had been taken into care.
Social workers believe he may have fathered 10 more children.
Sources close to the case say the man and his then partner had an "open" relationship with numerous sexual partners, prompting concerns the group was also a paedophile ring.
The man has never been convicted of any offences against children. However, courts have ordered that his children be removed from his care.
They heard detailed claims of sexual abuse and concerns the children may become targets.
A police source said: "He is allowed legal representation where a local authority is taking a child into care or placing them in foster care or adoption. His legal fees could be £500,000."
The man appeared at Glasgow Sheriff Court last month, facing charges ranging over 23 years from 1987 to 2010.
They include one rape, two of sodomy, three involving lewd and libidinous behaviour, numerous assaults and breach of the peace.
He faces 10 charges under the Children & Young Persons (Scotland) Act 1937, relating to ill treatment, neglect or abandonment. Police and social workers were stunned he was granted bail.
A Crown Office spokesman said: "No dates have been set. The Crown opposed bail."

Judge refuses to increase sentence for killer dad; community outraged (Fife, Scotland)
Dad ROBERT THOMSON was convicted in the stabbing deaths of his two children, and was jailed "for life." Seems Dad was angry that the mother wanted a divorce--you know, the usual abuser/control freak "triggers." However, judges have refused to raise the minimum jail sentence Dad must serve before applying for parole, so he could be out in as little as 17 years. The surviving mother and the community are outraged. And they have every right to be.

MEMBERS of a Fife community stunned by Robert Thomson’s brutal murder of his two children two years ago have reacted with fury after appeal judges refused to increase the killer’s sentence.
Thomson (51) was jailed for life for the horrific killing of his daughter Michelle (25)—who suffered from learning difficulties—and son Ryan (7) at the family home in Buckhaven on May 3, 2008.
But judges at Edinburgh’s Court of Criminal Appeal yesterday rejected a Crown bid to raise the minimum jail sentence Thomson should serve before applying for parole, meaning the killer could potentially serve just 17 years.
Thomson’s estranged wife June, who discovered her children’s bodies at their home in Muiredge Cottages, was not at court yesterday but reacted angrily when the sentence was initially passed, saying, “They were just beautiful, gorgeous children.
“He stole their lives away.
“The sentence wasn’t long enough.
“He is just an evil, sick, nasty, horrible man. He is just full of pure evil and badness.”
While the former family home lies empty, yesterday’s news was met with shock by neighbours who will never forget the tragedy.
Agnes Cormack (59), who stays just yards from the house, said, “I thought he should have got longer because what he did was just vicious.
“OK, he had problems but he shouldn’t have taken it out on the kids and because it was proven beyond doubt he should go to jail for life.”
Dave Anderson (66), who lived locally at the time of the killings, said he believed a far more severe sentence should have been imposed.
He said, “He should be hung for what he’s done.
“Anybody that does that to people, especially a handicapped girl, is not fit to walk amongst mankind.
“The country is too lax in giving out punishment for things like that.”
And his wife Christine added, “Imagine going into a house and finding your bairns murdered—it’s just horrible.
“They should do something with the house because every time you walk past it you just think about what he did to those poor bairns.”
At yesterday’s hearing, advocate depute Alex Prentice argued the minimum sentence imposed by Lord Menzies—cut from 21 years to 17 because Thomson pleaded guilty—was far too low.
“The Crown position is that the judge erred,” said Mr Prentice.
“He did not take into account the brutal and merciless nature of the attack.
“Child murder might well attract a punishment part of 20 years and in this case we have a double murder in particularly brutal circumstances.”
However, defence QC Andrew Lamb said Lord Menzies explained his decision in a “very careful and thoughtful report” about the background.
Thomson could not explain why he committed the murders but had reached a point where he had cracked under the strain.
The lawyer added that Lord Menzies considered “the heinous nature of the offences” but his sentence had been “entirely appropriate.”
Lord Osborne, sitting with Lords Eassie and Malcom, ruled the deaths were “a domestic tragedy” and decided that the sentence imposed on digger driver Thomson was not unduly lenient.
Following yesterday’s events, Central Fife MSP Tricia Marwick was another who felt let down.
“I’m disappointed that the appeal judges have not increased the tariff,” she told The Courier.
“It was a particularly heinous crime and in my view it deserved the biggest sentence that could be awarded.
“I recognise that it is for the appeal judges to decide the sentence but it is one that I profoundly disagree with.”
When Thomson was jailed in October 2008 the court heard he had been showing signs of strain since splitting with his wife in March that year.
Mrs Thomson later claimed the vicious stabbings were an act of revenge because she had walked out and was demanding a £50,000 pay-off as part of a divorce to end their 27-year marriage.
Her daughter had been stabbed 12 times and her son suffered 14 stab wounds before Thomson turned the knife on himself in a botched suicide bid and also swallowed pills.
Thomson spent part of the time waiting for the case to come to court in the state hospital Carstairs.
Giving his response to the sentence, Chief Superintendent Alistair McKeen, who led the murder investigation, said last night, “As with all judicial processes, the appeal against sentence by Robert Thomson is a matter for the courts.”

Dad jailed for life over brutal murder of 4-month-old daughter (Glasgow, Scotland)
We've posted on dad CRAIG JAMIESON before. He's now been jailed for life for murdering his 4-month-old daughter. Believe me, in Scotland, a dad has to be pretty depraved to get a life sentence (okay, maybe just 16 years). But from what I've read, Jamieson more than qualifies.

The trial of a man accused of murdering his five-month-old daughter has been told that she suffered repeated physical abuse before she died.
Consultant paediatric neurologist Conor Mallucci said Abbie Jamieson could have been fatally injured a few hours before an ambulance was called.
Mr Mallucci was giving evidence at the trial of 30-year-old Craig Jamieson.
He denies murdering Abbie in February 2008 and has lodged a special defence blaming her mother, Nichola Haddock.
Mr Mallucci, 44, who is based at Alder Hey children's hospital in Liverpool and is an expert on head injuries in children, told the High Court in Glasgow that the fatal blow or blows to Abbie were struck one or two hours before the ambulance arrived at her family home at 1215 GMT on 8 February.
He said that to all intents and purposes Abbie was dead when the ambulance arrived, although paramedics and doctors at Yorkhill Hospital battled for almost six hours to try to save her.
Certainly on the day of her death she had trauma over and above that she had before, which was non-survivable
Mr Mallucci also told the court that in his opinion Abbie had been physically abused from at least Christmas time in 2007, when she was three months old.
The jury heard that his view was based on medical reports and statements made by Mr Jamieson about what happened to Abbie on the morning she died.
In his statements to police, paramedics and a doctor, Mr Jamieson spoke of waking up Abbie at about 0915 GMT and then feeding her.
He claimed that later in the morning she went white and floppy and he called an ambulance.
Prosecutor Lesley Shand QC asked Mr Mallucci if Abbie could have been injured before her mother Nichola Haddock left to go to Caledonian University at about 0745 GMT and he replied: "I don't think it is feasible. It is not a scenario I think is possible."
Mr Mallucci added that he thought it unlikely Abbie had sustained her injuries prior to being fed.
In a report he said: "If the trauma had been inflicted on Abbie before her father woke it would have been obvious to him. The swelling from blunt force trauma usually happened in minutes."
Under cross-examination, defence QC Ronnie Watson asked: "Is the father's account possible that the child was injured before he woke up?" Mr Mallucci replied: "I think it is unlikely."
Mr Watson then said: "That must leave a possibility that it is possible?" Mr Mallucci replied: "Yes, it's possible."
Mr Mallucci added: "This was a trauma which killed her. Fatal trauma to the abdomen and skull does not result in a normally handling child."
He added that in Mr Jamieson's account of the child's actions that day she was "described as taking feeds and having her eyes open".
Mr Mallucci was asked by Mr Watson: "Does the whole appearance of the child suggest that throughout the part of her life from Christmas onwards Abbie was a child who suffered physical trauma?" He replied: "She had repetitive physical trauma."
The consultant was then asked if the trauma had escalated. He replied: "Yes. Certainly on the day of her death she had trauma over and above that she had before, which was non-survivable."
Mr Jamieson is accused of murdering Abbie by inflicting blunt force trauma to her head and body by means unknown to the prosecutor.
He is also charged with assaulting Abbie to her severe injury on 6 January 2008 at the family home in Dumbarton Road.
The trial, before temporary judge Alastair Stewart, continues.

In his statements to police, paramedics and a doctor, Mr Jamieson spoke of waking up Abbie at about 0915 GMT and then feeding her.
He claimed that later in the morning she went white and floppy and he called an ambulance.
Prosecutor Lesley Shand QC asked Mr Mallucci if Abbie could have been injured before her mother Nichola Haddock left to go to Caledonian University at about 0745 GMT and he replied: "I don't think it is feasible. It is not a scenario I think is possible."
Mr Mallucci added that he thought it unlikely Abbie had sustained her injuries prior to being fed.
In a report he said: "If the trauma had been inflicted on Abbie before her father woke it would have been obvious to him. The swelling from blunt force trauma usually happened in minutes."
Under cross-examination, defence QC Ronnie Watson asked: "Is the father's account possible that the child was injured before he woke up?" Mr Mallucci replied: "I think it is unlikely."
Mr Watson then said: "That must leave a possibility that it is possible?" Mr Mallucci replied: "Yes, it's possible."
Mr Mallucci added: "This was a trauma which killed her. Fatal trauma to the abdomen and skull does not result in a normally handling child."
He added that in Mr Jamieson's account of the child's actions that day she was "described as taking feeds and having her eyes open".
Mr Mallucci was asked by Mr Watson: "Does the whole appearance of the child suggest that throughout the part of her life from Christmas onwards Abbie was a child who suffered physical trauma?" He replied: "She had repetitive physical trauma."
The consultant was then asked if the trauma had escalated. He replied: "Yes. Certainly on the day of her death she had trauma over and above that she had before, which was non-survivable."
Mr Jamieson is accused of murdering Abbie by inflicting blunt force trauma to her head and body by means unknown to the prosecutor.
He is also charged with assaulting Abbie to her severe injury on 6 January 2008 at the family home in Dumbarton Road.
The trial, before temporary judge Alastair Stewart, continues.

The Shocking Story of Hollie Greig (Aberdeen, Scotland)
Hat tip to Annie for finding this horrifying story of child sexual abuse and official coverup. I'm sure there are far more pedophile rings of this type than most of us want to acknowledge, and that many of these sickos are more than capable of acting out viciously against anyone who opposes them.

SK-H001 - THE SHOCKING STORY OF HOLLIE GREIG
In the summer of 2000, Hollie told her mother, Anne, that she had been repeatedly sexually abused by her father, Denis Charles Mackie and brother Greg. The abuse had begun when Hollie was just six years` old. Hollie said that Greg had also been abused by his father.
Anne Greig reported this immediately to the local police station in Aberdeen. During the course of that summer, Hollie, who has Down`s Syndrome, began to provide more names of abusers. It transpired that Denis Mackie had been sharing his daughter with a ring of sexual abusers, which included a serving police officer with the Grampian force, Terry Major and an Aberdeen sheriff, Graeme Buchanan.
Medical and other evidence supported Hollie`s account and Grampian Police accepted the truth of Hollie`s statement. Nonetheless, no action was taken by Grampian Police against the perpetrators and despite Anne Greig`s persistence, the Procurator Fiscal, now Lord Advocate, Elish Angiolini prevented any police action taking place.
In fact, the authorities instead attempted to discredit and intimidate Anne by having her forcibly taken to a mental institution, with the intention of handing Hollie back to her abuser father. Fortunately, Anne Greig had the presence of mind to have herself checked by a leading psychiatrist, who proclaimed her perfectly sane, a view with which even the institution were forced to concur.
In the years that have followed, Anne Greig has persisted in her attempts to bring the abusers to justice, not only for the sake of her own children, but also to prevent these dreadful practices continuing against others, which includes adults with learning difficulties as well as children.
It was only in 2009, when the News Of The World courageously broke the story, concentrating on the hitherto unheard of fact that Hollie had received payments from the Criminal Injuries Compensation Authority for crimes that have not even been investigated.
The measures to cover up this terrible story continue unbounded by the authorities.
Several years ago, Denis and Greg Mackie went to live in Portugal. On 8th May 2007, immediately following Madeleine McCann`s disappearance, Anne Greig, accompanied by a victim`s support witness, went to her now local police station in Shrewsbury to tell them to alert the Portuguese Police, as despite the proven case of paedophile abuse, neither of the Mackies had a record of any kind. The McCann team has accepted that the Mackies ought to have been questioned immediately. It is now understood that the British Police failed to pass on these details to their Portuguese counterparts.
Hence, the official cover up has even extended to detracting from the Madeleine McCann investigation.
Investigators have already informed us that discoveries of other paedophile rings in Scotland has been discovered, but it is clear that certain senior figures of authority are prepared to obstruct the course of justice and allow the known sexual abuse of some of society`s most vulnerable people to continue unabated, just to save their own skins.
The Hollie Greig story is now widely known by the media, police, legal, medical and political professions.
The facts are beyond dispute.
The only question that remains will be as to who has sufficient decency and courage to bring this and other issues to a just conclusion.
