Dad indicted for 2nd-degree murder in death of 2-year-old son (White Plains, New York)

Another case where a dad--in this case RICHARD "RICKY" LEAK--apparently couldn't handle the stresses of caretaking. And now a 2-year-old boy is dead, with dad charged with 2nd-degree murder.

Westchester man indicted for killing his toddler son

WHITE PLAINS – A New Rochelle man has been charged with second-degree murder in connection with the January 9, 2011 death of his two-year-old son.

Richard “Ricky” Leak, 21, called his live-in girlfriend at 1.a.m.; she was not at home. He told her Khalil Leak was not breathing. The girlfriend called a downstairs neighbor and asked her to check on the child. She found the baby unresponsive and called 911.

The toddler was taken to an area hospital where he was pronounced dead about an hour later.

Case and forensic pathology work by the New Rochelle Police Department and the Westchester County Medical Examiner were instrumental in charging the defendant, said Westchester District Attorney Janet DiFiore.

If convicted, Leak faces 25 years to life in state prison.

Indictment which charged Leak said he engaged in reckless conduct that “created a grave risk of serious physical injury or death” to the child.
