Dad rejects plea deal; going to trial for breaking arm of 3-month-old daughter (Grand Forks, North Dakota)

Dad MICHAEL BALEK can't seem to make up his mind. At first he pleaded not guilty to felony child abuse charges (breaking the arm of his 3-month old daughter). Then he was going to plead guilty, but changed his mind again. So now he's going to trial.

Accused child abuser rejects plea deal

Grand Forks, N.D. (AP) A Grand Forks man accused of breaking the arm of his 3-month-old daughter has rejected a plea agreement with prosecutors.

Twenty-six-year-old Michael Balek earlier pleaded not guilty to felony child abuse. He was prepared to change his plea to guilty but changed his mind at a hearing Wednesday. He now will go on trial starting Nov. 3.

Prosecutor David Jones said any plea agreement would have included jail time.

The trial is expected to last four days and feature the testimony of medical experts. Balek faces up to 10 years in prison if convicted.
