LOGAN — The child abuse trial for a 32-year-old Logan father, Ryan Udy, has been rescheduled for May 31, 2016, after attorneys for both sides asked for additional time to gather and review new evidence in the case.
Udy appeared in 1st District Court Monday morning. He faces two charges of child abuse, both second-degree felonies. His attorney told the court, they had met with state prosecutors and were requesting additional health records from when the victim had received medical treatment, since the alleged abuse.
Prosecutors have claimed Udy abused his infant son several times, breaking his arm, and causing bruises and other injuries. The abuse was reported in December 2012 and March 2013.
Defense attorneys argue Udy was only with the child for a short time and that the abuse was caused by the child's mother.
On September 2, an eight-day jury trial was postponed after a witness in the case claimed to have received two anonymous emails, describing how the mother reportedly abused the child.
Judge Brandon Maynard had tried to schedule the trial for January but later settled on the May date after prosecutors said the victim's mother was expecting a child in early spring.
Udy was ordered to appear again in court April 19 for a final pretrial conference.

Ogden father suspected of shaking baby, causing hemorrhages

OGDEN -- An Ogden man accused of shaking his infant son hard enough to cause several hemorrhages and broken ribs appeared before Judge Michael DiReda Thursday, Oct. 1, for a preliminary hearing.
Christopher Anderson, 21, is charged with child abuse and intentionally inflicting serious physical injury, second-degree felonies. He was booked into Weber County Jail July 28 and made bail Aug. 4 through a $10,000 bond posted by Hy & Mike’s Bail Bonds.
On July 21, South Ogden police responded to an emergency call from Christopher Anderson, 21, at his apartment in the area of 3700 South Grant Ave. There, Anderson was found rubbing his 3-month-old infant’s chest and told law enforcement that his son was having a hard time breathing to the point his body had gone limp. Police, however, found the infant was not responsive, according to court documents. Anderson was the only person home with the infant.
Anderson said the child was napping when he heard him struggling for air. The father said he picked the boy up and shook him to “bring him out of it.” He also attempted to do CPR, according to the statement.
The child was transported first to McKay Dee Hospital and then to Primary Children’s Medical Center via LifeFlight. According to the statement, the infant continued to have seizures for several days as a result of the abuse.
Karen Hansen, a doctor with Safe and Healthy Families, treated the child and found a subdural hemorrhage, possibly two weeks old, and another fresh hemorrhage on the right side closer to the brain. A retinal study also found hemorrhaging in both eyes. Hansen advised that medical issues were symptoms of “shaken baby syndrome.”.
A skeletal exam also found two broken ribs, according to the statement. Hansen said the long-term effects are still unknown but the significant brain damage will cause the child to have medical problems longterm.
George Zamora, the baby’s grandfather, said although the boy is doing better since going to the hospital, he still suffers from the traumatic event.
“Because of the brain trauma, he forgot how to swallow. He can’t take anything by mouth, he has to have a feeding tube,” Zamora said. “There’s some paralysis on his left side and his legs aren’t working as well as the doctors were hoping.” Zamora, who is now caring for the child after a no contact order was issued against Anderson, also said he hopes that awareness of his grandson’s injuries will help bring justice against Anderson.
“Second of all, we want people to know that this is a problem. There’s ways you can handle things without hurting a baby,“ Zamora said. ”But first of all, I want people to know about this so Carter can receive justice. This isn’t something he should have gone through.“
Anderson is scheduled for a pre-trial hearing 9 a.m. Dec. 4.

Dad shoots 6-year old, 2-year old kids, their mom in murder-suicide (Roy, Utah)
The usual stupidity in reporting. The fact that the (suburban) neighbors observed nothing out of the ordinary is actually more typical than not. In reality, very few of these suburban abusive males are anything but "nice" or "polite" as the neighbors see it. That means nothing.
That Mom (presumably) never called the cops means nothing either. Most victims don't.
That doesn't mean Dad just "snapped." These family annihilator guys almost always have a history of escalating abuse and control issues that are usually invisible to people outside the family.
Dad is identified as RUSSELL SMITH.

Family of four shot dead in Father’s Day murder-suicide
By Associated Press June 22, 2015 | 4:07pm
ROY, Utah — A Utah family of four was found shot to death in their home in what authorities believe is a murder-suicide, police said Monday.
Officers discovered the bodies of Russell Smith, 29; his wife, Shawna Smith, 26; and their children, 6-year-old Tylee and 2-year-old Blake on Sunday night. It appeared Russell Smith shot himself, and investigators were not looking for any suspects, police Lt. Kevin Smith said.
The department received a 911 call about an assault at 10 p.m. Sunday from a relative who stopped by the house in Roy, a city about 32 miles north of Salt Lake City.
There was no history of police responding to the home near Roy High School, Smith said. Investigators talked to family members and were trying to uncover a motive.
The relative who discovered the family decided to come by the house after failing to hear from anyone there since an afternoon text message, said Smith, who is not related to the family. He declined to specify the person’s relationship to the victims or what the text message said.
Neighbor Lynn Everley, 68, said the Smiths were a quiet, young family, and he had never heard any fights or seen any indication of problems.
Everley said Russell Smith worked in the nearby city of Ogden at a company that recycles outdated military supplies, while Shawna Smith worked at a child care facility. Everley said the family lived in the home for at least several years — as long as he had been in the neighborhood.
“They’re a couple that you would never have expected this to happen,” Everley said. “But then, what makes a person snap?”

Dad abuses 2-month-old daughter after being asked to watch her for 30 minutes; baby has multiple fractures, brain injuries (West Haven, Utah)

Utah teen arrested for child abuse after infant daughter rushed to hospital

WEST HAVEN, Utah – A West Haven teen is in jail after his 2-month-old daughter was taken to the hospital for injuries from alleged child abuse that included a brain injury and multiple fractures.
According to a statement of probable cause, the infant’s mother said the father, 18-year-old Mark Berry, was put in charge of watching the baby for about 30 minutes.
When the mother came home, she noticed the child was twitching and seemed to be having a seizure. The child was taken to McKay Dee Hospital, and after a CT scan revealed bleeding in the baby’s brain the child was flown to Primary Children’s Hospital.
Berry did not go to the hospital with the child, but he was later located and he admitted he was frustrated and “forcefully” put the child in a swinging chair twice, according to a statement of probable cause. The statement indicates Berry admitted to police “that he knew his actions would likely cause injury to the child.”
Medical staff reported the child suffered a serious injury to the back of her brain and several fractures, including fractures to the right leg and left arm, according to the PC statement.
Berry was booked into the Weber County Jail. The child is in the hospital in stable condition.

Dad who chained 7-year-old son to bed because he couldn't "afford" daycare (though he lived in "middle-class neighborhood") gets 30 days in jail (Logan, Utah)
Dad SAMMIE HODGES is obviously custodial though that fact is not mentioned explicitly here. If the mother had resided in the home she probably would have been arrested too. Or at least she would be mentioned. But she's not. In fact, the boy is now in foster care, though I imagine just for the 30 days. Then Daddy will get custody back.
What happened to this child's mother? How did this obviously clueless father get custody?

Sammie Hodges, 29, will serve jail time and community services after his son was found padlocked by his ankle to a bed in June

A Utah father will serve 30 days in jail and 30 days of house arrest for chaining his 7-year-old son to a bed while he was at work.
State Judge Brandon Maynard insisted on jail time Monday despite a recommendation from prosecutors that 29-year-old Sammie Hodges from Logan only serve house arrest.
The judge said he didn't want to keep father and son apart, though.
'My goal is not to undermine reunification efforts with your son, but rather to reinforce making good parenting decisions,' Maynard said.
Hodges was charged in June with four counts of child abuse and pleaded guilty to one count in November as part of a deal with prosecutors.
His son wasn't injured by a heavy chain padlocked to his ankle in June and had access to snacks, water and a bathroom, police said.
Police acting on a tip found the boy in a middle-class neighborhood in Logan, a city of about 49,000 people 80 miles north of Salt Lake City.
Defense attorney David Perry said Hodges chained the boy to keep him from running around the neighborhood because he couldn't afford day care.
Prosecutor Jacob Gordon said his actions absolutely rose to the level of child abuse, according to The Herald Journal.
'This is an inappropriate way of child care; there is no way around it,' Gordon said.
The unnamed boy is in foster care.
Hodges was also sentenced to 80 hours of community service, and will have to take anger management and parenting classes.
He will be released to go to work during his jail sentence.
Hodges was ordered to report to jail on December 26 after spending the holiday with his son.

Dad pleads guilty to chaining 7-year-old son to bed while he is at work; is this a custodial dad? (Logan, Utah)
Once again, check out what is not said, namely: What happened to this child's mother?
It doesn't seem likely that there was a mother in the home, or she would have surely known about Daddy chaining the little boy to his bed. So she would have also been arrested, given that mothers are always held responsible for the acts of abusive/neglectful fathers.
So what happened to Mom? Are we to assume that dad was custodial? If so, how did he get custody? And why does CPS have custody now?
Dad is identified as SAMMIE HODGES.

LOGAN — A 29-year-old father has accepted a plea deal, pleading guilty to chaining his seven-year-old son to a bed while he was away from home.
Court records show Sammie Hodges pleaded guilty on Monday to child abuse, a class A misdemeanor. Three other misdemeanor charges were dismissed.
Hodges was arrested in June after police received an anonymous tip claiming the boy was being chained-up in a Logan home while his father was at work.
Logan City Police Chief Gary Jensen said when police searched the home near 825 North 1400 East, they found the boy chained-up in a bedroom.
Defense attorney David Perry said the boy wasn't injured by the heavy chain attached to his ankle, and he had access to snacks, water and a bathroom. He said Hodges couldn't afford day care.
The child was taken into custody by Department of Child and Family Services.
Perry said he and prosecutors are recommending Hodges wear an ankle monitor for about four-months and complete 80-hours of community service. Sentencing is scheduled for December 15.

SANDY — A 19-year-old man was arrested Sunday for investigation of felony child abuse after doctors found his infant son had 13 fractures.
Zachary Michael Brand was at a fast-food restaurant Friday changing the diaper of his 2-month-old son when he "twisted his son's leg and also the ankle, causing the leg to fracture," according to a Salt Lake County Jail report.
Later that night, as his son continued to cry, Brand used "excessive force" as he grabbed his son's wrist and shook it, the report stated.
The child was taken to Primary Children's Hospital, where doctors discovered the infant had sustained "up to 13 fractures."

Cache Valley man gets year in jail for breaking infant son's leg

A father who plead guilty to charges of forcibly breaking his infant son’s leg will serve one year in the Cache County Jail.
Sean Paul Richmond, 29, was charged with second-degree felony child abuse in February 2013. He finally accepted a plea deal this summer and entered a guilty plea to a third degree felony.
When he walked into the 1st District courtroom Tuesday, he was facing zero to five years in the Utah State Prison.
His attorney, Stephen Loos, stood before Judge Kevin Allen and offered the argument that incarceration would serve no purpose for Richmond, for the victim, or the community.
“There is no person more vulnerable in our society than a 5-month-old baby who depends on its parents for everything,” said Deputy Cache County Attorney Spencer Walsh.
The baby boy was treated in mid-January 2013 for a broken femur, finger-mark bruising on his chest, and other bruises to his body and some scratches.
According to Walsh, medical reports show the baby’s leg had a spiral fracture, which is reportedly indicative of a break caused by “a lot of force” and a “twisting” motion.
“This does not occur by pushing the baby’s legs up toward his chest to relieve gas as the defendant has indicated,” Walsh said. “Child abuse is so serious, especially in an infant this young.”
To date, the child appears to be developing normally, although there are still a number of ongoing medical issues, Walsh said.
Richmond has been ordered to pay $10,000 in restitution to the child’s mother, and the court has the ability to increase that as needed for additional out-of-pocket medical expenses.
While the maximum possible sentence on the charges allowed the judge to send Richmond to prison, he elected to suspend the prison sentence and send him to jail for one year instead.
In three months, Allen will hold a review hearing to determine if Richmond will be allowed work release so he can begin making payments toward his restitution.
“You just don’t understand the severity of what you did,” Allen said. “This is a significant injury to a child, especially a child with no ability whatsoever to defend himself.”

"Toxic" dad with joint custody kidnaps 5-year-old son after threatening to kill the entire family (Tooele, Utah)
This is the great unasked question: Why was a father with a history of (untreated?) bipolar disorder and drug abuse with violent tendencies awarded joint custody of three children?
That an incident like this even happens is testament to how powerful the fathers rights movement has become. Every deranged abusive nutcase gets joint custody--AT MINIMUM. Incidents like this are the predictable fallout from years of undue influence in the courts.
Let good mothers raise their kids in peace--without all the drama and death threats from psycho daddies.
Dad is identified as RICHARD MAMALES.

A police K9 has successfully tracked down a five-year-old boy who was kidnapped by his father and threatened with death.
Richard Mamales, 44, allegedly snatched his young son, Derek, following an argument with the boy's mother at his home in Tooele, Utah, on Friday night.
He reportedly threatened to kill the entire family - starting with Derek - before grabbing his son's hand and disappearing for the night.
He was given a paper bag to sniff to learn the missing boy's scent, before tracing it to the shed, where Mamales was hiding with Derek, at around midday yesterday.
'Max was able to walk into the track at that point and take me to where the suspect was hiding,' Mr Honsaker told Fox 13.
Following the discovery, Mamales was promptly arrested, while Derek, who was found in 'a good condition' and eating candy, was returned to his family.
In emotional scenes yesterday, Derek's sisters were seen weeping with emotion as they greeted their younger brother, with one covering him in a blanket and scooping him up in her arms.
Max, who has been finding missing children in Utah for more than eight years, was later given 'a big handful of juicy treats and a lot of attention' for his efforts.
Mamales, who shares custody of Derek, often brings the boy to the house he shares with his daughters - Tiffany and Samantha - at weekends.
But on Friday night, the boy's mother tried to take him home after deciding Mamles was behaving 'erratically', police said.
The suspect, described as 'very toxic' by his daughter Samantha, is alleged to have a history of drug abuse and bipolar disorder.
Another daughter Lindsi Mamales told KSL.com: 'I know he loves us, he just gets off his rocker without his meds.'
Mamales was arrested ye By Saturday evening, police were still in the process of booking him into the Tooele County Jail.
Police said they are unsure of the charges Mamales may face as the investigation is still ongoing.

Dad arrested for abusing 5-month-old daughter; baby has broken leg, rib (Pleaseant Valley, Utan)
Appears to be another case where a deadbeat dad was "caretaking" while Mom had to work. Too many young males lack the patience and nurturing skills to take care of infants. This is why they consistently freak out over normal infantile crying.
Dad is identified as HANSEL ARTURO DEL-CASTILLO.

Police: Pleasant Grove father broke baby's leg, rib

PLEASANT GROVE -- A Pleasant Grove man was arrested late Tuesday night after doctors found signs of abuse against his infant daughter. Hansel Arturo Del-Castillo, 26, was arrested at his home in the 600 South block of 350 East on suspicion of three counts of child abuse, a third-degree felony, according to a police report.
Police were called to Primary Children's Hospital in Salt Lake City after doctors examining the 5-month-old baby found several broken bones. Police said an officer was at the hospital when doctors performed a preliminary examination of the child and found a fractured rib bone and two broken bones in one of the baby's lower legs.
Doctors also said the child’s throat appeared to be burned, and bruises covered the child’s body, according to the report.
During a police interview, Del-Castillo told officers he “lost control” when he could not get the baby to stop crying while he was caring for the child Tuesday, according to police.
The arrest report stated that on three separate occasions the suspect squeezed the baby and threw her down. According to the report, the suspect told police, "I pretty much squeezed the life out of her" and eventually "I tossed her onto my bed."
He also heated a bottle in a microwave for three minutes and tried feeding the child, according to the report.
Police said the child’s mother first noticed something was wrong when she came home from work to the crying child. She told police she found a bruise on the child, but was told by the suspect that an older sibling had fallen on the baby.
Four hours after she arrived home, the mother called a pediatrician who examined the baby and referred her to American Fork Hospital for X-rays. Once the broken bones were discovered, the infant was transported by ambulance to Primary Children’s Hospital.
No condition report was immediately available for the child.

Sanpete County father accused of punching, shaking newborn baby

SPRING CITY, Sanpete County — A 20-year-old father is accused of causing severe and multiple injuries to his newborn baby less than 1 month old by punching and shaking the girl.
The case is the latest in a recent spate of disturbing incidents in Utah involving abuse of children.
"This is happening too often. The last several days I’ve noticed all the … reporting about significant child abuse cases occurring throughout our state. We’ve had several child abuse incidents here in Sanpete County. What do we do?" Sanpete County Attorney Brody Keisel said.
"This is a tragedy in every sense of the word, and we're concerned."
John Reese Elkins, of Spring City, has been charged in Manti's 6th District Court with three counts of child abuse, a second-degree felony.
On Aug. 20, doctors at Primary Children's Hospital told investigators that the baby girl, Haley Petersen, suffered multiple fractured ribs — some fresh and some that had been cracked the week before and were healing — as well as two breaks in her legs, liver and esophagus damage due to severe trauma, and bleeding between the skull and the brain, according to a police affidavit filed in court.
The child was in serious condition at the time and underwent surgery. Haley remained hospitalized Friday but her condition was unknown.
“Hopefully we’re seeing some improvement, but (she) still has some time to go,” Keisel said Friday. “The baby was only 27 days old when the incident occurred, so in a child that young, it’s difficult to know what the long-term prognosis is. Right now, they do expect the child to survive, but time will tell what type of after-effects result.”

The girl's mother, who is 16, and her grandparents told police that the three of them left for some appointments the morning of Aug. 19 and left the baby with Elkins. Just three hours later, the child's mother asked Elkins to bring the baby to her, the affidavit states. The grandparents noticed a rattle in the newborn's chest and decided to take the baby to the doctor because they thought she was sick. "Upon undressing the infant for an exam, the mother and grandparents noticed fist-shaped bruising and marking on the abdomen of the infant," the affidavit filed with the charges state.
A Spring City police officer who listened in on a conversation between the baby's mother and Elkins said the man at first denied any abuse, but later admitted to shaking the baby. He also initially denied punching the child. "A few minutes later, John Elkins stated that he had lost his 'cool' and accidentally punched the baby once or so," according to the affidavit.
When confronted about the broken leg, Elkins admitted that while putting the baby in the car seat, her leg was at a "funny angle so he pushed it into place," the affidavit states. "He also admitted to squeezing the baby the previous week when the baby was crying."
The mother told investigators she had previously scolded Elkins many times for the "aggressive" way he picked up the baby, held her and burped her.
Elkins was arrested and booked into the Sanpete County Jail. A preliminary hearing in his case is scheduled for Sept. 3 in Manti.

At least 60% of shaken baby perpetrators are male caretakers, and usually fathers (Ogden, Utah)
This article is misleading in many ways, starting with the headline. The problem is not Mom's boyfriend per se, which is a typical right-wing backhanded way to bash single moms. It's ALL male caretakers, INCLUDING FATHERS, especially younger males.
Nearly every study I have ever seen on the perpetrators of abusive head trauma report that fathers out number boyfriends. But notice that the data is fudged here. And as a result, the numbers do not add up to 100%. See the statistics tab for the existing data.
And notice that the onus is put on mothers to prevent shaken baby. Fair enough, but the advise is convoluted and misleading. The simplest way? Avoid using male caretakers. Especially young deadbeat ones, including fathers, who are enlisted to do infant care because the mother has to work.
But of course, that's not politically correct to say now, is it? Notice that we are lectured about how fathers are "vital" to a child's development, which of course is a confusing message for mothers who are forced to make child care decisions. But the specifics of how they are "vital" are not articulated. If you review the literature carefully, you'll see that the specifics are in fact rarely explored and when they are, the supporting evidence is dubious at best.
What the research does show is this: What is "vital" to an infant's well-being is consistent, attentive, and loving care. Having a Y chromosome adds nothing special to mix, despite the ongoing anxieties of fathers rights freaks and their allies in public health and elsewhere.

Shaken-baby perpetrator often the mother's boyfriend

OGDEN — Take 10 minutes. Just 10.
That’s what Jenny Johnson from the Utah Department of Health says.
After all, it could save a life.
Johnson, a violence and injury prevention coordinator, stresses that while statistics show an average of four Utah child deaths each year are a result of abusive head trauma, otherwise known as shaken-baby syndrome, there is preventive help.
Just stepping into another room, away from a crying child, for a few minutes could prevent an abuse injury.
Yet another said case occurred in Ogden this week.
Ogden police arrested Adam Joseph Barney, 23, in connection with the death of a toddler Monday evening. They said Barney was arrested after emergency crews responded to reports of an unresponsive child at the Western Colony Inn at 234 24th St., No. 2.
Responders say they found the 14-month-old girl dead.
Barney, a live-in boyfriend, was questioned by police and admitted that he hit the child and squeezed her, causing severe injury, officers said.
The child’s mother was working at the time of the incident.
Statistics have found that child abuse homicide patterns reflect that the perpetrator is always a caregiver.
“It’s important for people to understand it’s not always biological parent(s), but the ones taking care of the child at the time — the boy/girlfriend of the parent, the day-care provider,” Johnson told the Standard-Examiner.
She adds that abusive head trauma is the “most common injury that we see among children.”
To be exact, 55 percent of children injured under the age of 4 are affected by abuse. “
The biological father of the child or the mother’s boyfriend are most often the perpetrators,” Johnson noted. “As scary as that is, by no means does that indicate that males and fathers are not loving caregivers; in fact, they play a vital part in child development.”
But what causes the aggressive behavior?
It may be substance abuse, stress, broken homes, among other risk factors, says Johnson. “So it’s very important mothers make sure they understand the potential risks.”
She offers these statistics on shaken-baby perpetrators:
● 30 percent, mother’s boyfriend.
● 30 percent (or less), biological father.
● 16 percent, biological mother.
● 11 percent, baby sitter.
● Usually young males between 20 and 33 years old with little experience caring for a child.
● Deaths among children, under age 2, are significantly higher in Utah; most deaths abuse-related.
“As a parent, you know it can get pretty frustrating if an infant constantly cries,” Johnson says. “That’s why parent resources are really important, for those who have these stress factors, to access help if you don't have it.”
“Fortunately this doesn't happen as often we think, but that number (statistic) can fluctuate,” she said in a phone interview Wednesday.
The Utah Department of Health violence and injury program studies a large variety of child abuse and maltreatment cases. The department reviews abuse-related deaths among children, a lot of those circumstances surrounding deaths, Johnson said.
According to The Nemours Foundation, abusive head trauma (shaken-baby syndrome) has many other names, including inflicted traumatic brain injury and shaken impact syndrome. However, all mean one thing: an injury to a child's brain as a result of child abuse.
“Sometimes an injury can cause head trauma to an infant without shaking him or her,” thus it is more accurate to title it ’abusive head trauma’,“ Johnson said. “We’ve never had this happen in Utah, but in other parts of the county there are such cases where children experience the same physiological symptoms from being dropped or thrown.” In which case, child abuse resulting in traumatic brain injury may result in lifelong injuries or disabilities.
Elizabeth Sollis, communications director for the Utah Department of Human Services, whose mission is to provide education, service and support to those in need, tells the Standard-Examiner there are crisis nurseries available across the state; Family Support Center runs the crisis nursery in Ogden.
“Child abuse and neglect can be prevented, and resources to support families and help them live safe, healthy and successful lives are detailed on our website,” she said.
If someone suspects child abuse or neglect, they should report it immediately by calling 855-323-3237. In an emergency, they should call 911.
“Don’t keep it a secret; we don’t want to see theses things happen anymore, either,” Johnson said, “and it is against the law — we have an obligation to prevent child abuse.”
In addition to calling the child abuse hotline to report abuse or neglect, the public can be directed to resources in their community. Sollis adds, “Another great resource is 211. By calling (this number), Utahns will be able to learn about a myriad of resources — public and private — in their community.”
These free resources are available for anyone, but especially those new and young parents to make sure they have what it takes to prevent child abuse. It answers questions like: What do I do when my baby’s crying? Resources, she said, recommend taking 10 minutes away from the infant to breathe.
“It sounds simple, but people don’t realize the impact,” Johnson added. “Many families have children that have had abusive head trauma and now suffer lifelong problems; it’s not just death.”
Nearly every study I have ever seen on the perpetrators of abusive head trauma report that fathers out number boyfriends. But notice that the data is fudged here. And as a result, the numbers do not add up to 100%. See the statistics tab for the existing data.

Dad who slaughtered ex-sister-in-law's family while looking for estrnaged ex-wife had EXTENSIVE history of domestic violence and JOINT CUSTODY of kids (Houston, Texas)
Dad RON LEE HASKELL should have been imprisoned YEARS AGO. But no, we see the same little footsy games. He's arrested, the charges dismissed. A protective order is obtained, it's dismissed. Mom finally leaves him (with the help of her sister) and the piece of crap gets JOINT CUSTODY of the kids, which means it will be years before she'll ever be able to free of him. Why at minimum wasn't he jailed after his assault on his own mother? Nope, just another useless restraining order and an "investigation."
This is the victory of fathers' rights. Daddy just grows more and more emboldened and entitled as he figures that nothing he ever does will ever result in any real consequences.

The mother of the Houston man accused of killing six members of his ex-wife’s family, including four children, had obtained a restraining order against her son less than a week before the slayings after a violent confrontation.
Ronald Lee Haskell, 33, is accused of killing his ex-wife's sister, Katie Stay, her husband and the children, ranging in age from 4 to 14, after tying them up and putting them face-down on the floor of their suburban Houston home.
Each was shot in the back of the head after the family refused to tell Haskell where he could find his ex-wife, officials said.
The lone survivor of the Wednesday attack, the slain couple's 15-year-old daughter, suffered a fractured skull when a bullet grazed her head. She played dead and called 911 after her uncle left.
The San Diego County, California, sheriff's office said in a Thursday statement that Haskell's mother, Karla Jeanne Haskell, had reported an argument with her son July 2 at her home in San Marcos, California.
During the fight, Mrs Haskell said her son duct taped her wrists, tied her to a computer chair and threatened to kill her for speaking to his ex-wife.
'He yelled at me and twice placed his hands around my neck trying to choke me and caused me to pass out,' the 61-year-old woman told police, according to the court documents. 'He told me he was going to kill me, my family and any officer who stops him. He hid my telephones. I was taped up for four hours.'
Haskell eventually left, and his mother contacted 911, the statement says. She later obtained a restraining order against her son and the case remains under investigation, according to the statement.
On Thursday, new details also emerged about Haskell's arrest outside the home of his former in-laws in Spring, where he was cornered by police officers acting on a tip that he may try to kill his ex-wife's parents as well.
Neighbors told KHOU that officers had Haskell surrounded directly in front of his relatives' home in a quiet cul-de-sac.
Resident Rebecca Butts described Haskell's demeanor at the time of his arrest as 'emotionless' and 'creepy.'
Witnesses said the suspect remained stone-faced and refused to comply with arresting officers' orders to surrender.
Police disabled his car using a spike strip and two SWAT team vehicles sandwiched the vehicle to prevent him escaping. During a tense three-hour standoff he reportedly held a pistol to his head threatening to kill himself before finally giving himself up.
A day after the slayings, investigators slowly built a picture of Haskell, who was the couple's estranged brother-in-law.
Neighbors said Haskell's marriage was so rocky that Katie Stay went to Utah last fall to help her sister escape the relationship and start a new life in Texas.
Stay 'was very instrumental in helping her sister get here so she could have a fresh start. Katie's a spitfire. She has energy to stand up for what she believes is right and true,' said Verena Beckstrand, a neighbor who choked back tears as she talked about the family.
Haskell had previously been jailed in 2008 in Logan, about 80 miles north of Salt Lake City, on charges of assault and domestic violence.
He had a history of previous run-ins with law enforcement in Utah, where he had lived with his wife. the woman complained to police he dragged her by her hair and repeatedly punched her in the head in front of their children.
The couple both told officers they were not getting along and that Haskell had been stressed at work. According to the police report two children, believed to be aged three and five, were at home with them at the time of the assault. Charges were later dismissed as part of a plea deal.
Haskell was incarcerated at the Cache County Jail following an incident in 2008, according to the Cache County Sheriff's Office. He also had several involvements with the Logan City Police Department.
In September 2009 he reportedly flagged down a police cruiser in Utah and told officers his wife had gone missing and that he feared she may kill herself.
He said she had left a note to say she was going away and that she would miss him and their children, but felt she was holding them back.
Police put out a APB but Haskell then claimed to have found his wife and said he was taking her to the hospital.
Haskell was also served last year with a protective order from his ex-wife. It was dismissed in October after the couple filed for divorce, online court records show..
By Thursday morning, a small memorial with three candles and a plant had been set up at the front door of the family's two-story white-brick and brown wood-trimmed home.
A couple with a child left a framed photo of the family with the inscription 'Faith, Hope, Love.'
'I don't think any of us will ever be able to see that house the same again,' said Viri Palacios, who lives across the street. 'I just want the word to get out they were a really, really good family.'
The father, Stephen Stay, was a real estate broker.
The mother was a helpful presence around the neighborhood, planning Halloween and Christmas parties for children, Palacios said.
A few blocks from the home at Lemm Elementary School, Principal Kathy Brown tied multi-colored ribbons around trees in front of the building and encouraged parents to do the same.
'It's to have positive bright thoughts about the family,' Brown said, noting that two of the slain children had attended school there and a third had graduated from Lemm.
Documents from Thursday's preliminary court hearing show that the daughter who survived attempted to close the door after telling Haskell her parents were not home. But he kicked it in. The teen remained in critical condition in a Houston hospital.
In a statement, issued Thursday through the Harris County Sheriff's Office, Katie Stay's father, Roger Lyon, said his 15-year-old granddaughter 'is expected to make a full recovery.'
When the badly wounded daughter contacted authorities, she told them the gunman was planning to shoot other relatives, Hickman said.
Police located Haskell's car, and took him into custody after a three-hour standoff.
'We are grateful for this miracle,' Lyon said in his statement.
'We are in awe of her bravery and courage in calling 911, an act that is likely to have saved all of our lives. She is our hero.'
Haskell was wearing a FedEx shirt at the time of the attack, but authorities seemed uncertain whether it was a deliberate attempt to deceive.
Harris County Constable Ron Hickman initially said Haskell showed up at the Stay home 'in the guise of a FedEx driver.'
But he and other officials later declined to say whether Haskell used the uniform to gain access to the home.
Hickman said investigators were not sure whether the suspect would have needed a disguise to get in the house, or if the children knew him.
Haskell had once done work for FedEx but not since January, the company said in a statement.
Online jail records did not list an attorney for Haskell, who was initially misidentified by authorities as the slain children's father. Police did not explain the mistake.
A divorce decree issued in February shows Haskell and Melanie Kaye Haskell were married in 2002 in Orange County, California. They separated in June 2013.
A judge granted joint custody of the couple's four children, ranging in age from 3 to 11, with Haskell's wife getting primary custody.
At the time of the divorce, Haskell was making $2,300 a month, although the records do not say what kind of work he did.
He was ordered to pay $773 per month in child support. His wife was given the house, valued at $190,000, in the small town of Smithfield, Utah, just outside Logan.
Haskell's motive for the execution-style killing, according to the children's paternal grandfather, was his jealousy for the family's happy life together.
Speaking to MailOnline from his home in Sun City, California, Thomas Stay said that Haskell envied the life his son Stephen had built with his wife Katie and their five children.
According to Thomas Stay, Haskell couldn't accept his separation from his ex-wife Melanie - Katie's sister - and chose to massacre his son and his family because he was ‘jealous of Stephen and Katie's family and what they could have that he didn’t have’.
Thomas also opened up about Haskell’s history and said that he had been ‘unstable for a long time’ - but had been known to his family for years.
He said: ‘Ron’s brother Bobby is Stephen’s best friend. It’s strange. I think that mentally he’s just not right.
‘The whole thing doesn’t make any sense. Ron was just all mixed up.
‘He and Melanie split about six months ago, they were living in Logan, Utah, and he was abusive, very controlling. Their divorce was finalized in February.
‘She couldn’t take it any more.’
Thomas said that his son and daughter-in-law moved to Texas about four years ago having previously lived in Utah.
Like Haskell they had four children, but unlike him their marriage lasted.
He said: ‘Melissa had the kids with her. I don’t know if he was thinking maybe the will be at Stephen’s house.’
Paying tribute to his son and daughter-in-law, he said: ‘They were very religious, they had a lot of faith in the gospel. They loved each other and did things together.
‘They just loved life.’
Stephen’s mother Joyce Stay, 74, added: ‘We lost our son, our daughter-in-law, our four grandkids. We know the man that did it. ‘His family has been friends with ours for years. He was not well person. I watched this kid grow up, I have had him in my home for sleepovers.
‘This is a good family that this man comes from - there is something wrong in him to do this kind of thing, it’s not normal’.
Thomas Stay also revealed that Cassidy, 15, the sole survivor of the shooting, is now out of the Intensive Care Unit and is conscious.
According to NBC News, Melannie Haskell petitioned a court for an order of protection in July 2013. The judge granted this order, and Melannie Haskell filed for divorce the following month.
In October last year, the protective order was lifted when the couple decided on a mutual restraining order and custody arrangements involving their children.
A judge also decreed that Ron Lee Haskell’s visits would be watched by a psychologist.
'Mr. Haskell's parent time will be supervised until such time that his physical therapist can report that the respondent is no longer a threat to the children,' the judge wrote.
Indeed, Haskell has had a number of previous run-ins with the law in his home state of Utah when he was living there with his wife.
Before she filed her restraining orders, Utah law enforcement said that Haskell was arrested several times by the Logan City Police Department and was jailed for a time in the Cache County jail in 2008.
Mr. Haskell was booked into the Cache County Jail on charges of simple assault and child abuse or neglect, both class B misdemeanors, on June 5, 2008,' according to a news release from the Cache County Sheriff’s Office.
Since then, he has had multiple involvements with Logan City Police Department and had a protective order served on him by Cache County Sheriff’s deputies on July 9, 2013.'
According to The Salt Lake Tribune, Haskell was also arrested in June 2008 and charged with simple assault and domestic violence in the presence of a child.
He was also jailed in the same year on charges of assault and child abuse or neglect according to a statement from the Cache County Sheriff's Office.
Both were dismissed the next year.
The teen's call allowed police to rush to the scene and corner the suspected gunman who eventually sank to his knees and surrendered after a tense three-hour stand-off with deputies who had corralled him into a suburban cul-de-sac.
'It appears this stems from a domestic issue with a breakup in the family from what our witness has told us,' Assistant Chief Deputy Constable Mark Herman of the Harris County Precinct 4 Constable's Office told reporters. He did not explain further.
According to documents read out in magistrate court this morning in Houston, the 15-year-old girl managed to give police a witness statement.
The teen said that Haskell arrived in the afternoon on Wednesday dressed as a FedEx worker looking for his estranged wife and asked for her parents, but she told him that none of them were at home.
He left, only to return a short time later and the teen once again told him that her parents were not home.
It was at this point that she recognized him as her 'ex-uncle' and tried to close the door on him.
Haskell kicked the door in and tied her up and then waited for her four brothers and sisters and parents to return.
When they did he tied them up as well and then laid them face-down on the floor.
According to police documents read out in court this morning he demanded to know where hs wife was and when they said they did not know, he shot them all 'execution-style' in the back of the head and left.
However, the bullet only fractured the teen's skull according to Click2Houston - and she played dead until he left and then called 911.
She was able to tell deputies who the shooter was and that she believed he was headed to another residence at Anvil and Ella to possibly attack more family members.
Deputies were able to intercept Haskell, who led them on a chase that came to an end about three miles from the shooting scene.
Haskell, 33, was transferred to the Harris County jail overnight and has been charged with multiple shooting deaths.
The shootings took place about 20 miles north of downtown Houston at a four-bedroom home in a quiet, middle-class residential neighborhood near the town of Spring.
Reached at her home in San Marcos, California, Haskell's mother Karla, 61, fought back the tears as she admitted she still did not know exactly what her son had allegedly done.
She said: 'We have no idea about what went on. We still don't know.
'I can't watch it. I just can't do it. I really can't talk right now'.
Haskell's brother Robert said: 'I would like to say that our thoughts and prayers are going to the family that were affected and people that lost their loved ones.
Asked about his brother's state of mind, he said: 'There's a lot going on but I can't comment further. I have not spoken to the police'.
Police say Haskell held the five children and their parents prisoner, tied up and then shot them all.
Gilliland said the teenager was in 'very critical condition' at Memorial Hermann Hospital in Houston late Wednesday night after being airlifted there.
It was the 15-year-old survivor who told deputies that Haskell was headed to her grandparents' home and they were able to pass along the warning, he said according to local press reports.
Constable Ronald Hickman in Houston said she gave police a description of the suspect and was providing 'critical information' to authorities.
'While quickly responding to that location, we saw him coming up to that residence where other relatives of that family lived and we assumed he meant to shoot them as well,' Hickman said.
According to KHOU in Houston, 'He (Haskell) came to this location yesterday afternoon – late – and came under the guise of a FedEx driver wearing a FedEx shirt,' said Constable Ron Hickman.
'…came to this residence, gathered up the children that were here and awaited the arrival of the parents. Sometime later the victims were shot in this residence, and we now learned that Mr. Haskell was married to a relative of the residents of this home.'
FedEx confirmed that Haskell worked for them through a contractor - but said he had performed no duties for them since the New Year.
'We don't know why this happened,' nearby resident Paul Anthony Slawinski told Reuters. 'This man, his wife, and children were the definition of compassion and charity.'
A woman who said she lives across the street from the house described the family as close-knit to the Houston Chronicle.
'It was a Mormon family,' she said. 'They were very sweet and their kids were very shy. This is a sad, sad day.'
Public records state that Stephen Robert Stay and Katie Stay, ages 39 and 33, are living at the residence on Leaflet Lane, however, they are not listed as the owners of the house.
A web page from the Houston Association of Realtors lists Stephen Stay as a real estate broker in the area and listed the home's address as his residence.
Authorities said the teen's information also helped them intercept the suspect. The suspected gunman then led authorities on a chase, with nearly two dozen deputy constables' patrol cars following him into a cul-de-sac shortly before 7 pm.
There, the suspect's boxed-in vehicle remained for hours. Finally, about 10 p.m., after hours of waiting and negotiations, the man emerged from his car, raised his hands and sank to his knees as deputies placed him under arrest.
During that time, Gilliand said, there were 'two hours of constant talking with a man armed with a pistol to his head and who had just killed six people.'
Gilliland described the man as in his 30s with a beard 'and cool as a cucumber.' He said that when he and other officers first approached, the man was 'just sitting in his car looking out at us.'
'This concluded the way we wanted it to,' Gilliland said after the surrender.
Said Precinct 4 Constable Ron Hickman, 'He was in the car for 3½ hours. He was worn down like the rest of us. He came out of the car without resistance.'
This is the victory of fathers' rights. Daddy just grows more and more emboldened and entitled as he figures that nothing he ever does will ever result in any real consequences.

Familiar story. Mom was going to leave, and Daddy was going to lose control. He just couldn't allow that. So he slaughtered everybody.

Police: Officer who killed family had raped wife
Associated Press 3 hours ago
SALT LAKE CITY (AP) — A Utah police officer who killed his wife, their two children, his mother-in-law and then himself received text messages from his wife just hours earlier threatening to leave him and take their kids and confronting him for raping her, new documents show.
A Spanish Fork Police report shows Joshua Boren and his wife exchanged heated texts the night and morning before the January killings.
In them, Kelly Boren confronted her husband about raping her and told him their marriage was over, The Deseret News reported (http://bit.ly/1oC8lWG ). The couple already had been separated for some time.
Joshua Boren's therapist told authorities that Boren drugged his wife and videotaped himself sexually assaulting her on more than one occasion.
Kelly Boren learned of the assaults when she discovered the tapes in 2013, said Spanish Fork Police Lt. Matt Johnson. She told a few friends, but she did not report the assaults to police because she didn't want to ruin her husband's law enforcement career, the report says.
The night before she was killed, Kelly Boren brought up the alleged sexual assault again, texting the word "rape" to her husband four times, the documents show. "I hate my life because (of) you," she texted. "You killed a part of me."
She wrote in another text: "I don't want to live in fear and hate and anger."
The next morning, Kelly Boren told her husband she would take the kids, prompting Joshua Boren to reply by text: "Don't involve the kids, they are innocent."
The police report says Joshua Boren was sexually abused as a child, struggled with drug addiction as a young man and pornography addiction throughout his life, and had a deep-rooted hatred for his mother.
After his father committed suicide when he was 5, Joshua Boren's mother began using drugs and seeing several men, the report states. One of those men allegedly abused Joshua Boren, and he blamed his mother for not protecting him, his sister told police.
The therapist told police Boren was like a "3-year-old boy stuck in a big man's body."
"Josh was a very troubled individual that felt like he was about to lose his wife and children," police wrote in the report.
Joshua Boren had worked for the Lindon Police Department for only three months when the murder-suicide occurred. Before that, he was a Utah County sheriff's deputy for seven years, Johnson said.
He used the service weapon he was given for his duties as a Lindon police officer when he killed his family members and himself, authorities said. Toxicology reports from the autopsy show he had no drugs or alcohol in his system.
Police said the state medical examiner confirmed what investigators believed: Joshua Boren shot his wife, 32-year-old Kelly Boren; his 55-year-old mother-in-law, Marie King; and his two children, 7-year-old Joshua "Jaden" and 5-year-old Haley, before killing himself.
The shooting happened at the family's home in Spanish Fork, a city of about 37,000 located 50 miles south of Salt Lake City. The events stunned the community, as well as friends and family, said Johnson, who added investigators didn't find anybody who suspected Joshua Boren was capable of such an act.
Though Joshua Boren wasn't living at the house, friends and family said he still came every morning to get the kids ready for school and preschool, Johnson said. He also picked them up every afternoon.
"He was praised as being an excellent father," Johnson said.

Bail set for custodial dad charged with chaining 6-year-old son to bed for 10 days (Logan, Utah)
So UNNAMED DAD has a criminal record. How much you want to bet that this father was just as controlling and abusive with the new girlfriend--and that's why she did not report? How much do you want to bet he demonstrated the same behavior with the little boy's non-custodial mother?
Let's ask the question that the media refuses to ask. WHO GAVE THIS FATHER CUSTODY?
So much for discrimination against poor widdle daddies....

Judge sets bail at $10K for Utah man accused of chaining 6-year-old son to bed while at work
THE ASSOCIATED PRESS
June 12, 2014 - 6:25 pm EDT
LOGAN, Utah — A judge set bail at $10,000 Thursday for a Utah father accused of chaining his 6-year-old son to a bed while the man was at work.
The 28-year-old man made his initial court appearance via a video that was played in a courtroom in Logan, Utah, reports the Herald Journal of Logan (http://bit.ly/TPvASs ).
The Associated Press is not naming the man to avoid identifying the child.
In addition to setting bail, the judge assigned him a public defender, Dave Perry.
The man asked to be given a different attorney who had represented him previously on a different case, but that request was denied by the judge. The man is due back in court Monday.
Investigators believe he chained his son to the bed post for 10 straight days when he left for work, unchaining him when he got home. The man did general labor for $13 an hour at a company that makes flood-containment systems in Logan, new court records show.
The man was arrested Tuesday after police went to the house on an anonymous tip and found the boy shackled to the bed, home alone.
The boy had water and snacks and just enough slack to reach the bathroom, Logan City Police Chief Gary Jensen said. The heavy, tow or logging-style chain was attached to the boy's ankle, Jensen said.
The boy is with child welfare services, which is looking for the boy's biological mother to see if she is fit to care for the boy, Jensen said.
Authorities also are exploring whether the father's live-in girlfriend knew about what was going on, Jensen said. She and her children lived with the father in the house. She has not been arrested or charged.
The other children in the house go to day care each day, the Herald Journal reported, based on court records.
Online state court records show the father was convicted of felony forgery and theft in 2009. He was arrested in 2011 when he broke the terms of his probation.

Custodial dad had 6-year-old son chained to bed for almost 10 days (Cache County, Utah)
Posted on this case earlier today. Now we find out that dad SAMMIE HODGES is apparently CUSTODIAL. It is reported that the boy "was living with" his father, so it doesn't appear to be a summer visitation situation. Notice also that Mom lived in another town (Ogden). But as we often see, the reporter refuses to explicitly identify this as a custodial father either.
So how did this fine paternal specimen get custody? What judge gave it to him?

Police: Boy, 6, likely chained to bed for almost 10 days

Police say a 6-year-old boy was found chained by his ankle to his bed Tuesday morning in a Logan home at 825 N. 1400 East while his father, 28-year-old Sammie Hodges of Logan, was at work.
Hodges has been booked into the Cache County Jail, where he is being held on four counts of child abuse, a class A misdemeanor.
Police Chief Gary Jensen said while he doesn’t know exactly, it is likely the child has been secured to the bed since school was dismissed for the summer — nearly 10 days.
According to Jensen, a heavy length of chain was padlocked around the bed on one end and the boy’s ankle on the other end.
“This is a heavy, truck chain, not a light chain … but like what you would pull a truck down the road with … It’s big and it’s heavy,” Jensen said.
The boy had enough length to get to a restroom across the hall, and he bad been left some water and some “snack-type” junk food in the adult’s absence, Jensen said.
The child did not appear to be emaciated, nor were there obvious physical injuries, he said.
Police received an anonymous tip via 911 at about 11 a.m. this morning, and officers were immediately sent to the home.
There was no answer at the home in question, so police went door to door to verify it was the home where the child lived before making entry into the home through an open window.
Jensen said he knows the child was living with Hodges, and there is an adult female living in the home as well, but the woman is not the child’s biological mother, Jensen said.
The boy’s mother is reportedly living in the Ogden area.
Jensen said it is not yet known if the woman living in the home will also be questioned or arrested.
The child is now in the custody of the Division of Child and Family Services.
Jensen said police are grateful to the person who reported the child abuse to police.
Without that call, “this child would still be chained to a bed.”

Child porn found on dad's computer at least 17 months before dad killed two sons during "supervised" visitation; FBI "forgot" to tell anybody (Salt Lake City, Utah)
Child pornographer and child killer JOSH POWELL was just coddled from beginning to end, wasn't he? He was never held accountable for one single thing he did.

Child-porn discovery on Josh Powell’s computer might have averted death of boys
The FBI found child pornography while investigating Josh Powell in the 2009 disappearance of his wife, Susan Powell, according to documents. Josh Powell killed himself and his children in 2012.
Seattle Times
SALT LAKE CITY — Investigators found child pornography on Josh Powell’s computer at least 17 months before he killed his children and himself, according to FBI documents obtained by The Salt Lake Tribune.
The paper reported Saturday that documents show the FBI was investigating Powell in the disappearance of his wife, Susan Powell, who was last seen at her West Valley City, Utah, home on Dec. 6, 2009, as well as for possession of child pornography.
Anne Bremner, an attorney for Susan Powell’s parents, said the family was never told the FBI was investigating Josh Powell for child pornography. If the state of Washington’s Department of Social and Health Services had known about the suspected child pornography, Bremner said, it “never would have let him have those kids.”
When a state worker delivered 7-year-old Charlie and 5-year-old Braden to Josh Powell’s rented home in Graham, Pierce County, on Feb. 5, 2012, Josh Powell locked out the worker and ignited a fire that killed him and his sons.
Powell for years had been considered a person of interest in his wife’s disappearance, and eventually he moved back to the Puyallup area, where both his father and his wife’s parents lived.
He lost custody of the boys after his father was arrested for possessing child pornography in another house they previously shared. The boys were in the custody of the state, but living with Susan Powell’s parents. However, Josh Powell was allowed supervised visitation.
Shortly before their deaths, Charlie and Braden Powell had begun talking to their grandparents about things they remembered from the night their mother vanished, a lawyer for the grandparents has said.
On the day of the fire, a state contract worker from Foster Care Resource Network brought the boys for a visit to Powell’s house. Powell answered the door, pulled the boys inside, slammed the door and locked it. The caseworker banged on doors and windows and called 911, but soon smelled gasoline and the fire erupted.
Josh Powell had been previously linked to child pornography, The Tribune reported. At hearings in Washington state to determine custody of his children, then-Assistant Washington Attorney General John M. Long said Powell was under investigation for child pornography after cartoon images of incest between mothers and children were found on his computer in late 2009 or early 2010.
The paper reported that the FBI appeared to be trying to discover what other images might be on Josh Powell’s computer, but the machine had been successfully encrypted by Powell.
Last month, a federal judge ruled that insurance proceeds from the fatal fire could be split between Josh Powell’s parents and sister and Susan Powell’s family.
