Lynn man admits to photographing his teen daughter in the shower

SALEM - An auto parts manager who admitted photographing his teenage daughter as she was taking a shower and putting the images on his own computer is headed to jail for 30 months and then will be on probation for another 10 years.
Andres Aguero, 40, formerly of 9 Clifton Ave., Lynn, changed his plea to guilty to charges of photographing a nude person, possession of child pornography and exhibiting a child in the nude before Salem Superior Court Judge Jack T. Lu on Wednesday.
The victim, now 18, pleaded with the judge not to send her father to jail.
"My father is a good and very caring person. I don't think he should go to jail. We're not perfect. I think he deserves a second chance. My mother just got laid off. We really need the support," the victim told Lu as she wept.
Lu carefully explained that he had "given the case a great deal of study. I regret the damage this has caused to his family, but the case requires a sentence."
Prosecutor Jean M. Curran said in October 2008 the defendant's wife went to the Lynn police station saying she was concerned because she had seen images of her daughter nude on their computer. Through an investigation, authorities determined the pictures came from a Palm Trio phone which Aguero owned.
Authorities learned that Aguero placed the video camera in the shower area just before his daughter went to take a shower and then retrieved the camera after she left on or about July 16, 2008.
The punishment imposed was less than the 3-to-5-year prison term asked by Curran.
Defense lawyer Russell Sobelman pleaded for no committed sentence, pointing out that Aguero had no previous criminal history, is hard working, a good person and "made a mistake."
Aguero's wife also spoke, saying "He's a good person. My family would suffer immensely and emotionally if he was not with us."
The judge ordered that while Aguero is on probation he is to wear a GPS tracking device, have no unsupervised contact with children under the age of 18, which does not abide to his biological children. He also must register as a sex offender, have no internet access or have no access to social networking Web sites, forfeit his computer and any hand held devices and must complete counseling.
Aguero was indicted by an Essex County grand jury in March 2009 and has been free on $2,500 cash bail since being arraigned.
