The fire and discovery of the baby’s death happened in February. Just one month earlier, Wallace was sentenced for a separate child neglect case in Marion County involving another child. Court records show he pleaded guilty to multiple counts of child abuse.

Those records also show Wallace shook, squeezed, and broke the ribs of his then-girlfriend’s two-month-old baby boy. The abuse happened from October to November 2012.

A probable cause affidavit from the 2012 abuse case shows Wallace told his then-girlfriend, “vibrating” the baby would not cause shaken baby syndrome.

The affidavit said:

“She said Cory’s fingers were on (the baby’s) back and Cory’s thumbs were around (the baby’s) shoulders then he vibrated him. She said (the baby) was crying very loud when Cory did this.”

Wallace was sentenced to three years jail time. He pleaded guilty. As part of the plea agreement, he was sentenced to community service, home detention, and probation. He was also sentenced to complete a mandatory parenting class. There’s no record if he began those classes. Wallace spent less than 40 days behind bars.

Prevent Child Abuse Indiana is an organization aimed at helping parents and families prevent abuse before it happens. The organization provides resources and education to parents on proper ways to care for their children.
“This little person cannot defend themselves and they are wholly dependent on the adult or adults in their lives and what has to happen in order for that little person to receive the best and safest care,” said Sandy Runkle, Director of Programs at Prevent Child Abuse Indiana.

Runkle said another important aspect of preventing child abuse is ensuring the child is in a safe environment and that your child is safe around your partner. Some of the warning signs of potential abuse include:

•History of domestic violence
•Cruelty to animals
•Easily angered or frustrated
•High expectations, especially for young children

Dad pleads guilty to voluntary manslaughter in beating death of 1-month-old son (Washington, DC)

This is how f***ed up our country is. MOTHERS of 1-month-old infants are forced into the workforce in order to support their babies and useless deadbeat pieces of sh** like dad TYRIK LAMONT BROWN. HE lounges in bed while SHE (the family breadwinner) bathes and feeds the baby and then leaves him in bed next to the lazy father. Then the useless piece of sh** beats the baby to death because he is "frustrated" by the crying.

Parenting classes aren't going to help aggressive young fathers with poor impulse control. That's just wishful thinking. We need to get a$$holes like this one of bed and into the workforce--that is, is anybody will hire them. They need to support their kids instead of maiming and killing them because they are "frustrated" with normal infantile crying. Moms need paid maternity leaves too, so they don't get pushed into working too early and forced to rely on men like this for babysitters.

Father pleads guilty to voluntary manslaughter in infant’s beating death

#Tyrik Lamont Brown beat his 1-month-old son so badly, prosecutors said, that a D.C. medical examiner found more than a dozen injuries to the infant’s body, including fractures to his leg, ribs and skull.

#Brown pleaded guilty Thursday to voluntary manslaughter in the Oct. 29 death of the infant, Raj’saun Tyrik Brown. Prosecutors said the baby’s mother left the infant with Brown as she went to work. She fed him, bathed him and laid him on the bed next to the baby’s father.

#But when the infant began crying and would not stop, prosecutors said, Brown grew angry and began beating his son. The medical examiner ruled the infant died of blunt force to the body.

#As part of the plea deal with prosecutors, Brown, 20, faces between four and 10 years in prison. Prosecutors also agreed not to charge Brown with first-degree felony murder.

#D.C. Superior Court Judge Rhonda Reid-Winston asked the soft-spoken Brown several questions to ensure he understood the details of the case and the charges to which he was pleading guilty.

#“Did you do something to cause these injuries?” she asked. Brown, with his wrists and ankles in shackles and standing next to his public defender, responded, “Yes, ma’am.”

#“Did you apply blunt force on this day?” she asked.

#“Yes, ma’am,” he said. #“Did you do it by accident?” she asked. Brown initially said yes, but then his public defender, Madalyn Harvey, interjected and whispered in his ear, and he changed his response to “No, ma’am.” #Then the judge asked, “Did you intend to inflict this force on him, and did you know a 1-month-old baby could be injured?” Brown again said yes. #Outside the courtroom, Assistant U.S. Attorney Cynthia Wright, who specializes in infant and child deaths, said the case was an example of why all new parents should take parenting classes. #“The infant wouldn’t stop crying, and he didn’t know what to do or how to respond,” Wright said. #Brown is scheduled to be sentenced April 24.

Dad with joint custody finally has contact with daughter severed after repeated abuse, death threats; Dad now running for office and angry that abuse is brought up (Austin, Texas)

Great piece of investigative journalism. Too often the public still doesn't get how abusers like this are successful in getting joint custody. Mom is very lucky she was able to get this violent creep out of the picture before her daughter was seriously injured or killed, especially in Texas. Most moms are not so lucky.

Notice how Daddy reacts in a typical abuser fashion. Claims he's being lied about, claims ignorance about the medical evidence regarding the abuse, arrogantly refuses to take (useless) parenting classes or anger management classes. Refuses to explain why the injuries only occurred during his visitation time. Refuses any restriction on his guns. Not even so he can see his kid.

Notice he doesn't seem to be protesting that Mom let him off the hook for $15,000 in medical expenses just to keep her daughter safe. That alone proves for me that she's telling the truth. Moms will do away with the money if it means safety for their kids.

When I got custody back, I knew that it meant I would never get child support and that the corrupt Chautauqua County Family Court would never enforce any decree. And I was absolutely right. But it was worth it to keep my kid safe too.

District 6 Council candidate Don Zimmerman injured, alienated daughter, court records state

District 6 candidate Donald Shelly “Don” Zimmerman, founder of the Travis County Taxpayers Union, is an aggressive leader who as president of a municipal utility district brought two lawsuits, one of which resulted in winning a case before the U.S. Supreme Court.

But aggression in disciplining his daughter, Marina Zimmerman, resulted in documented physical and emotional damage and permanent loss of parental rights through civil court action.

Files from a Travis County District Court case include three reports from Deborah Neitsch, MD, from early 2011. The reports state that on separate occasions Zimmerman inflicted bruises, pulled Marina’s hair, pushed her, and “threatened to kill her.” The records indicate the doctor would contact Child Protective Services (CPS). Such reporting is required within 48 hours by Texas Family Code Section 261.101, which states, “A professional may not delegate to or rely on another person to make this report.”

“I got a call from CPS and consulted a couple of attorney friends and was told when lies are made you should demand proof of the allegations and if don't get proof you should not cooperate,” Zimmerman told The Austin Bulldog in a Tuesday telephone interview.

Three documented incidents

The first incident occurred just three days after Marina’s twelfth birthday, then twice more, all within a three-week period in January and February 2011, according to the medical records. She weighed 84 pounds at the time. Each incident occurred during evening or weekend visits when Zimmerman had sole possession as authorized in the divorce decree.

Asked if he did those things to his daughter, Zimmerman replied, “Those are unequivocal lies. They are outright fabrications and absolute lies.”

Doctor’s first examination—January 24, 2011, the physician’s record indicates a “very minor bruise” was found on Marina’s right forearm. “There are concerns that her father is being physically and emotionally abusive to her when she is visiting him.” The record further states, “We will contact the CPS caseworker that is in charge of her case. No serious injury seems to have occurred but I worry about the psychological toll on her.”

Doctor’s second examination—January 28, 2011, the doctor found that Marina had a bruise on her left shoulder blade and a stiff neck. “He wanted to take her phone away and she walked away and he grabbed her shoulder and spun her around and pushed her backwards...He pushed her from behind and now she has a bruise on her left scapula (shoulder blade). Her neck is stiff after he pushed her....”

“[C]ontinued concern of her dad being physically forceful with her,” the record states. “[W]ill keep document for CPS case worker.”

Doctor’s third examination—February 11, 2011, the record states, “Her dad was harsh with her yesterday and pushed her against the microwave and now she has right hip pain and right shoulder pain. ... Her dad has been yelling at her and threatened to hit her but didn’t. He has threatened to kill her and she has fears of (him) shooting her...Her parents are worried that she needs therapy but her dad refuses.”

Zimmerman’s threat to hit Marina was overheard by her mother and stepfather in a phone call that she made to her mother during that confrontation, according to a sworn affidavit filed by her stepfather, Eric “Ani” Fox.

The February 11, 2011, doctor’s record also states, “Concerns of abuse with hip and shoulder strain. Recommended if CPS does not intervene this could lead to a life threatening situation. I recommend they persue (sic) legal full custody as soon as possible. We will contact CPS about the situation.”

For prevention the doctor stated, “Counseling: Domestic violence, warned this was the most common cause of homicide in Texas and in our area and needs to be taken seriously. [T]he situation seems to be escalating quickly due to CPS investigation.”

Zimmerman’s responses

When questioned in the Tuesday interview about the alleged threat to kill his daughter, Zimmerman replied, “That's an outright lie. None of this has ever been shown to me.” When reminded that the cited medical reports are in the files for his divorce case, Zimmerman replied, “These allegations are news to me. I’ve never seen them before. These are offensive lies and I’ve never seen them before. I’m not afraid because these are lies.”

Zimmerman said he has a license to carry a concealed handgun and he has guns and ammunition in the house.

“(Bochenkova) demanded I move all guns and ammunition out of the house,” Zimmerman said. “Why would that demand be made? I can agree to do it or refuse to do it. She's a brilliant manipulator and liar. If I agree to move the guns and ammunition out of the house, then I'm agreeing I'm a violent person who can't be trusted around guns and ammunition. If I do not agree, I'm in denial and won't acknowledge that I'm a violent and dangerous person. The demand is a lie.

“I’m 54 and never in my life have I been violent against anyone. I’ve never shown violence. I get angry. I’m angry now when someone lies and attacks my character.”

Zimmerman met Kateryna “Katya” Bochenkova in Kiev, Ukraine, when he was there teaching English as a second language. She was one of his students. They met again when she was a student at Texas A&M University in College Station. They were married in Brazos County December 6, 1997, when he was 38 and she was 20.

Marina was born in January 1999.

A Final Decree of Divorce was approved May 27, 2005. The marriage was “dissolved on the ground of insupportability,” which is defined in Family Code Section 6.001 as “without regard to fault.”

Mother followed doctor’s advice

The doctor recommended pursuing full legal custody and Bochenkova quickly did so. On February 16, 2011, she petitioned for a Temporary Restraining Order. Included in the petition was a request for the court to order Zimmerman to attend parenting classes and anger-management classes.

Bochenkova told The Austin Bulldog she wanted Zimmerman to take those classes so that he “could modify the behavior that brought us into that conflict situation in the first place.”

Asked if he took those classes, Zimmerman replied, “I did not.”

In response to Bochenkova’s petition, the court issued an Agreed Temporary Injunction to bar Zimmerman from contacting or communicating with his daughter or taking possession of her, rights that had been established by the divorce decree.

Asked to comment on the injunction, Zimmerman said, “The crux of it is that with people willing to lie under oath I'm not going to see my daughter any more. If I persist what would have come next would be false allegations of sexual abuse,” Zimmerman said.

“I’ve seen this bad movie before,” he added. “I won’t see my daughter anymore. I won’t let you play this game.”

There has been no communication between Zimmerman and his daughter in more than three years, both he and Bochenkova said.

Dormant case revived, concluded

On March 10, 2014 Zimmerman’s new attorney, Round Rock-based Stephen Casey of the Casey Law Office PC, filed a motion to enter a final order in the case, stating that Zimmerman’s “relationship with the minor child has become fairly non-existent. ... Respondent remains willing and able to communicate but until it is initiated by the minor child there is no interaction.”

Bochenkova told The Austin Bulldog that Marina has not seen her father in more than three years and does not want to.

The girl’s mother responded to Casey’s motion by filing petitions of her own in April and June of this year.

In a final agreed order filed June 16, the court ordered that Zimmerman “shall have no possession of or access to the child.”

As part of that order, the court found that Zimmerman owed nearly $15,000 in arrearage for the child’s medical support expenses, and that “Bochenkova has agreed to waive all past medical support.”

“We wanted Don out of our life and that was the easiest way to achieve that,” Bochenkova told The Austin Bulldog. “It was the easiest way to close the deal, and we gave up that money in exchange for the freedom of our daughter.”

The court action in June also removed the requirement for Marina to live in Austin. She recently moved to Bound Brook, New Jersey, with her mother and stepfather.

On the “About Don Zimmerman” page on his campaign website, Zimmerman states, “I have one remarkable daughter, Marina Lorna Zimmerman.”

But the girl long ago quit using her father’s name. In 2012 and 2013 she won medals in fencing competition and performed classical piano music as Marina Bochenkova, her mother’s maiden name.

“She says she will take my name legally when she is 18,” Bochenkova said.

Dad pleads no contest to assaulting 15-year-old son; dad ordered to stay away unless family court "orders visitation contact" (Long Beach, California)

Not even a slap on the wrist. Dad SALIM MICHAEL KHOURY wastes the tax payers money on useless classes. Even the 10-year ban from seeing the assault victim, his son, means nothing since it can be overturned by family court at any time. And probably will be given that this is California. Meaning a kid who is just weeks away from being a legal adult can be forced to spend time with an violent abuser. Sickening.

Long Beach father pleads no contest to assaulting son

Posted: 05/29/14, 3:36 PM PDT | A Long Beach man accused of assaulting his so pleaded no contest to child abuse charges Wednesday and was ordered to stay away from the teen for the next decade, the Los Angeles County District Attorney’s Office announced Thursday.

Salim Michael Khoury, 57, was immediately sentenced by Los Angeles County Superior Court Judge Jessie I. Rodriguez to five years of formal probation.

Under the terms of the negotiated plea agreement, Khoury also is required to attend parenting and anger management classes for one year and perform 120 days of Caltrans service.

Khoury was also ordered to stay away from his 15-year-old son for 10 years unless a family court orders visitation contact.

Authorities say Khoury beat up his son after a family disagreement on Feb. 10. The extent of his injuries at the time of the attack were not disclosed.

"Sole carer" dad jailed for two years for abusing four children (United Kingdom)

This is classic obfuscation. Notice that UNNAMED DAD just sorta kinda became custodial, ya know:

"He had been left as sole carer for the children through the neglect of the mother."

A couple of things here worth noting:

1) The curious use of the passive tense. He "had been left"? What the heck does that mean? The sentence is robbed of all agency. We're not told who do what to whom, much less when or how or why. We're not told what specifically happened to the mother or why she apparently no longer has custody.  It's implied--without saying so--that she left on her own. But there is no definitive statement to that fact. Or did others take custody away from her through legal means? All we have is meaningless fog.

2) But we do have the complaint that Mum was guilty of "neglect." What we aren't told--once again--is what that means. We have no examples. On the other hand, we see from a carefully reading of Dad's deeds that this wasn't just neglect, but out-and-out abuse. So why does he have custody if the better-parent rule is (presumably) at work?

3) And how do we know any of this? Notice that isn't clarified either. I suspect that this is an abuser's tale. They often speak in this curious vague way. Somehow Mum is, um, not around. And yea, she was no good. Right.

4) If this guy assaulted a 15-year-old girl before (his daughter? Or somebody else's daughter?), why was he allowed to gain and retain custody? Typical double-standard for fathers.

I would like to see the media follow up on these stories for once, and stop taking abuser tales at face value.  Whenever you have a father who turns out to be a violent control freak with what is apparently full custody, and no sign of the mother, that should automatically trigger a red flag. What happened to the mother? Is she alive and safe? Was she driven out of the home by violence that was similar to what was inflicted on the kids?

And what a waste of time and money these "nurturing" programs are. They simply provide cover for these vicious men.

Bromsgrove man jailed for child cruelty

A BROMSGROVE man who subjected his four children, all under 10, to a regime of harsh physical treatment has been jailed for two years.

The 43-year-old, who cannot be named for legal reasons, was described as "more than a bully" by Recorder Edward Coke at Worcester Crown Court.

He said that the defendant, who pleaded guilty to child cruelty between 2010 and 2013, had caused emotional suffering as well as physical pain. The recorder added that his loss of temper had been appalling.

Prosecutor Peter Grice described how the father had used a two foot piece of wood as a smacking stick to hit the children, although none had been badly injured.

When the family had gone on holiday to Cornwall he had forgotten his smacking stick so he got the children to pick a branch from a tree so he could use it to hit them. He also broke a wooden spoon when he hit one child on the head.

The punishment for a youngster who soiled his clothes was putting him in a cold shower.

Mr Grice said the defendant was in breach of a conditional discharge, imposed in 2011, when he admitted common assault on a 15-year-old girl. He had bruised her head as he roughly carried her through a gate.

Diljit Bachada, in mitigation, said her client had been to nine sessions of a nurturing programme and had been awarded a certificate. He had been left as sole carer for the children through the neglect of the mother. He had not been helped by social services and now regretted his wrongdoing.

The defendant, who described himself as a dinosaur in his treatment of the children, was told he must serve half his sentence before being released on licence. He must also pay a £100 victim surcharge.

Custodial dad, gal pal get prison for abuse of his 2-year-old son; had only had custody for SIX WEEKS (Douglas County, Nebraska)

Of course, dad CHAD CYMBALISTA blames his girlfriend for everything. Even though Daddy Dearest admits putting the makeup on his 2-year-old son to disguise his bruises. And it looks like he admits making the boy sleep on a urine-soaked blanket. And punishing him for wanting food.

But check this out: you have go 13 paragraphs to find out that this sh** of a father HAD CUSTODY, and had only had custody for SIX FREAKING WEEKS.

So of course the big unasked (and unanswered) question is WHO GAVE THIS ABUSER DAD CUSTODY and WHY? What happened to this little boy's mother? As so often happens, the mother has been utterly erased from the news account, as if she had never existed...

Who says daddies are discriminated against again? Notice that this entitled little sh** thinks he can take a few classes and get custody back.

Makeup couldn't mask tot's injuries from 'horrific' abuse; dad, girlfriend get prison

There was no hiding the child's disfiguring injuries in a Douglas County district courtroom Tuesday.

Nor was there any concealing of the abuse of the child by his father and the father's girlfriend.

Not like Chad Cymbalista and his then-girlfriend, Nicole Corcoran, had tried to do April 24, 2012, when they caked makeup on the boy's face and took him to the Nebraska Medical Center. Tuesday, their abuse of the little boy was laid bare.

Several times, prosecutor Molly Keane held up a photo of the 2-year-old — taken moments after doctors removed the makeup.

In the photo, the toothy toddler has a goose-egg knot in the center of his forehead, both eyes swollen shut, abrasions on his cheeks and a lower lip marred by what doctors believe was a burn. Doctors further found marks in the shape of adult hands on his arms — and other bruises in various stages of healing.

The photo of the boy — in a hospital gown adorned with big-eared dogs — cried out for punishment, Keane said.

“This was horrific treatment,” Keane said, noting that one investigator described it as “torture.”

Shuffling through that photo and others, Douglas County District Judge Greg Schatz rejected a probation officer's recommendation of probation for Cymbalista, who had no record.

Cymbalista and Corcoran, both 27, faced up to 20 years in prison.

The judge sentenced Cymbalista to four to five years in prison for attempted child abuse — the reduced charge to which he pleaded guilty. He then sentenced Corcoran, mother of three other young children, to eight to 10 years on the same charge.

In giving Corcoran twice as much time as Cymbalista, Schatz cited comments made by Corcoran's children, who witnessed the beatings.

The children, who lived with Cymbalista and his child, said Corcoran would call the toddler “dumb” and “stupid” and beat him in the face and head while Cymbalista was at work. She and Cymbalista would force him to sleep on a urine-soaked blanket. And they would use toddler gates to pen in the boy “for daring to seek out food,” Keane said.

And, Keane noted, the two did all that damage in just the six weeks that they had taken over custody of the boy.

Douglas County Attorney Don Kleine called the abuse brutal.

“Sometimes it's hard for people to imagine that anyone is capable of hurting a defenseless child,” he said. “There are so many people who would just love to have this child and would be willing to do whatever it takes to raise the child the way it should be raised.”

Fortunately, the child is in one such home now — with a foster family that dotes on him and cares for him, authorities say. Now 3, he's eager and bright and talkative, said Shakil Malik, a deputy Douglas County attorney who met with the boy a couple of months ago.

He's mostly overcome his injuries. There's no discernible brain damage, but the child may have slight scarring beneath the eyes.

The biggest lingering issue: A plastic surgeon testified that the boy likely will need surgery to repair his lower lip. After losing a third of his lip, the child had a severe drooling and dribbling problem — and was unable to swallow properly.

But he's now able to eat and drink.

“He's doing as well as can be expected,” Kleine said.

Cymbalista and Corcoran had told authorities that the toddler tore open a cut to his lip by eating popcorn salt. He then picked at it for more than a month before the two decided to take the boy to the hospital, they said.

Doctors found the popcorn-salt story incredible. They suspect that the child suffered a burn to his lower lip that wasn't treated for weeks.

Cymbalista admitted that they covered up the boy's injuries with makeup. However, neither Cymbalista nor Corcoran admitted to the abuse.

As Corcoran's attorney, Bill Eustice, pointed out, Cymbalista blamed Corcoran and vice versa.

Cymbalista had taken classes and had since made efforts to become involved in the boy's life, with the goal of having custody of him again, said his attorney, James Kozel.

Corcoran, for her part, read a five-minute statement in which she denied abusing the boy. She insisted she loved him as if he were her own. She also said she was “born to be a mother.”

“I don't have a mean bone in my body,” Corcoran said. “I love all children. It breaks my heart to see them in any pain. ... I'm only responsible for not asserting myself in my relationship.”

To that, Schatz pointed to her children's accounts of their mother's abuse of the young boy.

“The judge did a good job in discerning who was the more responsible of the two,” Kleine said. “Even so, it's hard to imagine that the child's own father could just stand by and allow this to happen.”

Under state sentencing guidelines, inmates must serve half the lower term of their sentences before being eligible for parole and most are released after serving half the upper term.

Dad gets probation for abusing newborn daughter (Madison, Nebraska)

Criminal coddling is usually labelled (by conservatives) as a "liberal" thing. But in reality, all the courts make continual excuses and accommodations for criminal daddies who abuse children, even newborns. The poor widdle dear was really STRESSED from all that crying. Boo hoo. Guess that makes it okay for this piece of sh** to shake or bash her?

Probation and a couple of useless classes. Wow. That'll show him.

Notice that there is NO mention of a mother in this home. Makes me wonder if this is a single father who does not live with the mother, but has some sort of visitation.

MADISON — A new father who shook his 2-week-old girl out of frustration because she wouldn’t stop crying has already spent more than six months in jail.

He won’t face additional jail time on his felony child abuse charge but must complete 18 months of probation under his sentence given by Judge Mark Johnson in Madison County district court here Thursday morning.

Justin Gore, 22, admitted to shaking his daughter after he had been up for long hours and she wouldn’t stop crying, according to a police report.

The girl had been taken to the hospital for vomiting and diarrhea last September. Two subsequent doctor’s exams revealed bruising on her body. A CAT scan revealed a subdural bleed on the right side of her head which would be consistent with being shaken or struck.

She was only 19 days old.

Madison County deputy attorney Joe Hurd classified the abuse as especially egregious because of her age — with no ability to speak out against the abuse or defend herself.

Gore’s lawyer, Kyle Melia of the Madison County public defender’s office, said Gore was overwhelmed as a new father.

“He didn’t know how to properly respond to a child he needed to nurture,” he said.

There appears to be no lasting injuries to the girl, he said.

Gore said he hopes one day his family will forgive his actions.

“I’m ashamed of myself for it. I wish I could go back and change it,” he said.

Johnson noted Gore’s lack of criminal history in making his ruling but also stressed that the crime was violent.

“You were very lucky nothing more serious happened,” he told Gore. As part of Gore’s probation, he is required to take anger management and parenting classes.
