A DIEGO MARTIN man charged with raping his ten-year-old daughter on three occasions last year was denied bail when he appeared before a Port of Spain magistrate yesterday.

The 32-year-old man was remanded into custody by Magistrate Maureen Baboolal-Gafoor and will reappear in court this morning.

His prison detention was as a result of his criminal background trace not being made available during yesterday’s hearing.

Also, the magistrate said she needed further information on where the man would be residing if granted bail, as he would be required to not make any physical or verbal contact with the girl.

Under law, the media are allowed to publish the name of people charged with sexual offences but in this instance, the man’s name has been withheld in order to protect the identity of the child.

He appeared unrepresented before Baboolal-Gafoor in the Seventh Court and was not called upon to plead to the indictable charges.

The man was arrested on Friday during an exercise in the Western Division headed by Snr Supt Ishmael David after the girl’s relatives made a report to police informing them of the alleged offences. During today’s appearance, Baboolal-Gafoor is expected to address the issue of bail.

Dad slaps and chokes 4-year-old son, assaults 14-year-old daughter during "dispute" with mother (Trinidad & Tobago)

For the millionth time, a "dispute" is when two or more persons disagree. It's an "assault" when one person (the father) is choking and generally beating up other people in the family. Are we clear on this yet? UNNAMED DAD.

POLICE arrested a 48-year-old Laventille man on Tuesday night after he allegedly slapped and choked his four-year-old son during a dispute with his wife.

The little boy “tried to break up the fight” by getting in between his parents in order to have them stop, police said.

It was while doing so that the man raised the child off the floor by his T-shirt and began slapping and choking him, police said.

According to police, the child’s 14-year-old sister, who was also at home at the time, intervened when the man started assaulting the boy, but she too was assaulted after she was violently grabbed by one of her arms.

Neighbours who heard the commotion contacted the police, with Task Force officers from the St Barbs Police Post arriving at the scene shortly after.

Officers said they believed the man was intoxicated at the time of the incident. He was later handed over to officers of the Belmont Police Station where he remained in custody up to last night.

Police said the man is expected to charged with two offences under the Children’s Act.

The father of baby Jacob Munroe will be charged with his murder.

Director of Public Prosecutions Roger Gaspard today instructed the police to charge 26-year-old Allan Thomas with his son’s murder.

Thomas will also be charged with attempted suicide.

Gaspard, according to reports, received and reviewed the investigators’ file this morning and made the decision just after 2.30 pm this afternoon.

Thomas was hospitalised since November 19, when he reported to police that abductors had entered his home, made him drink a flammable liquid and then made him slit his own wrists before they snatched the baby.

According to police reports, on that Tuesday afternoon he contacted St Joseph Police saying the child was kidnapped from the family’s home at Santarita Trace, Lluengo Village, Maracas, St Joseph.

The relative claimed three men entered the house, assaulted him and demanded he hand over a gun he was hiding for someone. The men then allegedly grabbed the child and fled the house.

Around 1.30 pm on Wednesday, police searched the family’s property where they found the child’s body, which was wrapped in cloth, in a cesspit.

By Thursday an autopsy found that the baby had been smothered and also revealed bruised to his buttocks indicating that he was beaten before being killed.

Thomas’s hospitalisation had delayed investigations as he was unable to be questioned properly.

This was the first of two murder cases involving young children that have sparked outrage. Days after baby Jacob's body was found, the remains of missing six-year old Keyana Cumberbatch were discovered in a barrel in her mother’s apartment. She had been reported missing two days before the discovery. A post mortem showed she had been beaten to death and sexually assaulted while unconscious.

The DPP's office has not yet been consulted with regard to that investigation.

POLICE are searching for a Valencia man who allegedly sexually assaulted his son while he was spending school holidays at the man’s home. 

 According to police, the seven-year-old boy reported that his father allegedly assaulted him several times between July 9 and August 26.

The child, accompanied by his mother, went to Valencia Police Post yesterday and made the report. Constable Maurice is investigating. —Susan Mohammed

Trinidad Baby Recovering After Father Bites Her Face, Leg

ABC News (PORT OF SPAIN, Trinidad) -- A baby girl is recovering in a hospital on the Caribbean island of Trinidad after police say her father bit off chunks of flesh from her face and leg when he couldn't find food in the family's home.

Jermour Noel, 24, the child's father, has been charged with wounding with intent against a child. Noel appeared in court on Wednesday in connection with the charge, but had to be whisked away earlier than usual because other prisoners being held in the court's holding bay threatened to end Noel's life, officials said.

"We couldn't keep him in the cells. Those prisoners in there would kill him if they only got their hands on him," one Court and Process officer told the Trinidad Express newspaper.

According to police sources, Noel arrived at his Port of Spain home on Sunday and went in search of food. When he couldn't find anything to eat, Noel reportedly got into a dispute with the child's mother, Tineka Henry, and that's when police say he went into a fit of rage, grabbing the 5-day-old child and allegedly biting into her cheek and leg.

The child was then rushed to a local hospital, where she underwent surgery and remains warded in stable condition as she continues to recover from the attack.

Meanwhile, Noel was not granted bail and was taken to a psychiatric hospital where he will undergo a mental evaluation. He is due back in court later this month.

During his visitation, Dad beats 2-year-old daughter badly enough to put her in hospital, but complains that he feels "unsafe" in jail (Caroni, Trinidad)

The dad who feels "unsafe" going back to jail is identified as ISAAC SAMAROO. I guess it never occurred to this poor little hothouse flower that if he dislikes jail so much, then perhaps he shouldn't have beaten a 2-year-old girl.

Notice that the parents do not live together, and that the beating took place during visitation with Daddy. We are not told (naturally) whether this vistitation was court-ordered or "voluntary" on Mom's part. Not that "voluntary" means much these days , since mothers are under intense social and legal pressure to "share" with fathers regardless of whether the father is addicted, alcoholic, abusive or what have you.

A father accused of beating his two-year-old daughter complained yesterday that he felt unsafe going back to jail. He complained after he was denied bail by a Chaguanas magistrate. Isaac Samaroo, 31, a maxi taxi driver of Caroni, who wanted to plead guilty to assaulting his child, Isabella, while she was in his custody, causing her injury, was remanded until today for a fingerprint trace to determine if he had previous convictions or pending matters. Samaroo appeared before Senior Magistrate Gillian Davis-Scotland. The child lives with her mother, Rhonda Samaroo, but was visiting her father at his home on Caroni Road. The incident took place last Friday. He was charged under Section Three, Sub Section One of the Children Act.

When the magistrate read the charge to Samaroo he said: “I want to plead guilty.” He had no lawyer. However, court prosecutor Sgt Deochan Gosine said he had no recommendation on how to proceed. Samaroo was not called on to enter a plea. Gosine objected to bail on the ground he wanted an opportunity to have Samaroo traced. Constable Ronny-Lee Gopaul, the complainant, said the child was severely traumatised and was in and out of hospital. He said Isabella underwent a series of medical examinations. Samaroo, who was shaking, complained to the magistrate he had not been fed for two days while in police custody. The magistrate assured him he would get something to eat yesterday.

A Cunupia electrician was yesterday sentenced to seven years in jail for having sex with his daughter ten years ago.

The prisoner, 47, was found guilty last Thursday but sentence was handed down yesterday by Justice Rajiv Persad in the Port-of-Spain Sixth Criminal Court. The prosecution led evidence that on October 15, 1999, the victim went to visit her father at his home. She had gone to ask her father for money but he instead made advances towards her. And after fondling her, he forced her to perform oral sex on him. He in turn performed oral sex on her before proceeding to have intercourse with her.

Her mother remained ignorant of the incident until the teen told her about it in March 2000. It was then reported to the police and investigated by Inspector Dennis Housend.

Twenty-Four-year-old Andre Devon Parris, has been committed to stand trial for the murder of his two-year-old son, Jaheim Roberts.

Parris, a labourer, of Croney Drive, off St Lucien Road in Diego Martin, stood in silence yesterday afternoon as he made his last appearance before Chief Magistrate Sherman Mc Nicolls.

Despite a stirring “no case” submission by Parris’ defence attorney, Asha Watkins, in the Port-of-Spain Magistrate’s Eighth Court, the State, represented by prosecutor Giselle Heller, was successful in proving that a prima facie case had been made out against the accused.

In her submissions Watkins argued not all the elements for murder had been proven by the State, namely that Parris lacked the necessary intention to kill, as required by law.

“The State’s evidence is lacking as it does not provide the court with the required mental element for murder. Instead through its evidence and statements induced, the matter instead falls under the issue of the unlawful chastisement of a child. We would therefore move instantly from the issue of murder and if anything, into the realms of manslaughter,” Watkins argued.

If this procedure was adopted, she explained the question would now be one which should be left for a jury to decide whether the punishment used was reasonable.

“A father has the right to punish a child, however it is up to a jury to decide whether the matter is one of lawful chastisement, or whether it has moved on to the realm of unlawful violence,” Watkins said.

She argued the evidence induced through the pathologist Dr McDonald-Boris, did not contradict police statements from the accused, but instead showed the injuries found on baby Jaheim were in accordance to events which took place as reported by Parris.

In her response, Heller argued the State had infact proven the essential mental element of the offence, saying from the evidence provided, the intention to kill or cause grievous bodily harm could be inferred from the actions of the accused.

“When does unlawful violence or chastisement end, and give rise to murder? The victim was two years old, a toddler. Any application of force which led to his death would be deemed an inappropriate application of force,” Heller argued.

The attorney also questioned whether the State’s evidence did prove the sequence of events as laid out by Parris. “From the pathologist’s testimony, it was said the injuries were all fresh and recent. Having been caused hours before death.”

A-24-YEAR-OLD man of Couva has gone on trial in the San Fernando Criminal Assize Court for the 2004 murder of his two-and-half-year old step daughter in 2004.

Anton Hinsley Bruce, of Paradise Avenue, is before Justice Malcolm Holdip and a 12- member jury for the murder of Kameena Roberts whom it is alleged he beat to death on April 4.

Bruce was arraigned and the charge read to him that on that day he murdered the child. The jury, however, is yet to hear evidence in the case as Holdip informed them that certain legal issues have to be dealt with among himself, Senior State Attorney Angelica Teelucksingh and attorney who is defending Bruce, Carol Foderingham instructed by Jason Jackson.

The judge estimated that the legal issues would be thrashed out by tomorrow and has requested the jury to return for further directions.
