Father charged with assaulting infant daughter gets prison time

A man who pleaded guilty to seriously injuring his infant daughter was sentenced to nearly five years behind bars last week in Jackson County Superior Court.

Anthony Daniel Franklin, 25, of Bryson City pleaded guilty to two counts of intentional child abuse with serious bodily injury. The incidents occurred last summer and involved his daughter, who was less than 3 months old. The child suffered a perforated stomach, according to court papers.

On one count, Franklin was sentenced by Judge Brad Letts to not less than 58 nor more than 82 months and was given credit for 233 days served. Substance abuse treatment, psychiatric and/or psychological counseling, work release, the RSAT, Dart Cherry and Evergreen programs and any job training available were recommended.

On the second count, Franklin was given a sentence of not less than 20 nor more than 30 months that was suspended for 36 months. He was placed on supervised probation, ordered to pay a fine of $500 and court costs, perform 72 hours community service, attend and complete the TASK program, have no contact with the victim and not be alone with any child under the age of 18.
