WILLIAMSON — A Varney resident who was formerly employed as a CPA for Patriot Coal has been indicted on five counts of sexual abuse by a parent, guardian or custodian, and has been incarcerated since Aug. 3, 2012, when he was first arrested on these allegations.

Robert Ryan Hager, 40, was taken into custody following an investigation by Trooper Matheny and Trooper 1st Class Hensley of the West Virginia State Police (WVSP), after they were notified by a Child Protective Services (CPS) worker with the West Virginia Department of Health and Human Resources (DHHR) that the defendant had been accused of sexually abusing his juvenile daughter.

Hensley provided information that the defendant reportedly admitted to the officer that he had made sexual contact with his young daughter on at least five separate occasions, between the dates of May of 2011 and June of 2012. This occurred during his arrest and booking process.

The statute of the five counts of sexual abuse by a parent against Hager state that if any parent, guardian, custodian of, or other person in a position of trust in relation to a child under his or her care, custody or control, engages in or attempts to engage in sexual exploitation of, or in sexual intercourse, sexual intrusion or sexual contact with a minor shall be guilty of a felony, and upon conviction thereof, shall be imprisoned in a correctional facility not less than 10 nor more than 20 years, and can be fined not less than $500 nor more than $5,000.

Hager appeared in Circuit Court for his arraignment process after being indicted, and was represented by Attorney Marsha Webb-Rumora for this process only. He will either be assigned another public defender for his March 26th trial date or will be required to retain one himself, depending on his financial status. Judge Michael Thornsbury made the decision to leave Hager’s bond set at $50,000 full-cash considering the serious nature of the crime, the same amount that was set after his initial arrest by Chief Magistrate Dallas Toler.

Hager was transported back to the Southwestern Regional Jail at Holden where he will remain unless conditions and requirements of his bond are met.
