Father pleads guilty to killing son by 'squishing'

SARASOTA COUNTY - An Englewood man pleaded guilty to aggravated manslaughter in the death of his 6-year-old son.


During a plea hearing on Thursday, James “Rick” Dearman pleaded guilty to aggravated manslaughter of a child under the age of 18.


His son Jimmy died Christmas Eve 2015 after authorities say Dearman and his girlfriend, Ashley Cole, sat on him.


That night, Jimmy and his sister were heard making noises in their bedroom, Assistant State Attorney Art Jackman said. They were then told to put their noses against the wall as a form of punishment.


The boy did not, instead watching Cole and Dearman play video games. After this, Cole brought the boy to the couch where he sat on his side, his face against the rear cushions, Jackman said. Cole sat on his back, and Dearman sat on his shoulder.


“They had previously used this as a form of punishment,” Jackman said. “They called it 'squishing.'”


Despite the boy's protests of needing to use the bathroom and being unable to breathe, the two remained on the boy.


After approximately five minutes, he stopped moving. After Cole and Dearman left the room to smoke in the garage, they came back about 10 minutes later and called police after finding the boy unresponsive.


At the time, Jimmy weighed about 45 pounds. Dearman weighed about 279 pounds and Cole about 170 pounds. According to the medical examiner's report, Jimmy's death was ruled a homicide by asphyxiation.

Prosecutors: Joint custody dad murdered 3-year-old son to impress teen girlfriend (Camden County, New Jersey)

Lots of crap here. Blame the teenage girlfriend! She was so hostile about kids! How unnatural! Why, her blog posts on the subject where just "unbelievable"! She gave Daddy an ultimatum: me or the kid!

So freaking what.

Dad DAVID "D.J." CREATO JR. is an adult. What the hell was he doing with a teenager? Couldn't find anybody over 18 to date him? So he's dating a high school student? Notice there is no outrage about that. It's all about a kid who just wanted to be a kid.

What she thought or felt is immaterial. It is no crime for a young woman not to like children or prefer to be in a relationship with somebody who does not have children.

It was Daddy's choice to either give up his weekend custody time or stay in a relationship with this teenager. He apparently decided to kill the child instead.

Can't help but wonder whether this father was granted joint custody/visitation time despite a history of abuse and personal irresponsibility.

Dad Killed Son, 3, In Fear of Losing His Girlfriend Who Disliked Children: Prosecutors .

A New Jersey man was charged with murdering his three-year-old son, allegedly killing the child because he feared the boy was getting in the way of his relationship with his teenage girlfriend, prosecutors said.

Little Brendan Creato was found dead on October 13, less than a mile from his dad’s apartment, where he had been dropped off a day earlier.

His father, David “D.J.” Creato, Jr., reported the toddler missing around 6 a.m., telling a 911 operator that he had woken up to find his son was missing.

“I just woke up and he wasn’t in my apartment,” Creato, 22, said. “I don’t know if he wandered out or what happened. I don’t know where he is.

“The door was locked. I guess he unlocked it and left,” he continued.

Brendan’s body was found by a K-9 unit partially submerged in water in a wooded area off South Park Drive about 9 a.m., officials said.

He was still wearing his pajamas.

The child’s cause of death is still undetermined, but medical examiners reportedly found he died of “homicidal violence,” prosecutors said.

Brendan’s brain showed a lack of oxygen before his death, indicating causes such as drowning, smothering or asphyxiation, WPVI reported.

He also had a fresh bruise near his collarbone, investigators said.

Investigators reportedly did not believe that Brenden went to that area on his own, as the boy’s socks were clean despite the muddy surroundings.

The area is very steep at one point and difficult to navigate, authorities said.

He was also known to be afraid of the dark, so it was unlikely he would have gone into the wooded area before it was daylight, prosecutors said.

There were no signs of forced entry at the home, where Brendan slept on a love seat nine feet from his dad’s bedroom, she continued.

“Never once had he left the apartment or his mother’s house or his grandparents’ by himself,” Shah said.

The boy’s father was arrested on Monday and charged with first-degree murder and second-degree endangering the welfare of a child, officials said.

Prosecutors allege that Creato killed his own son after his 17-year-old girlfriend had told him she disliked children and “issued an ultimatum to him,” saying it was either her or him.

She told Creato that he would have to give up taking custody of Brendan every other weekend to be with her, the Philadelphia Inquirer reported.

The pair had begun dating in June 2015 after meeting on the app Tinder, remaining together despite the girl’s open “dislike” of children, prosecutors said.

She had written a series of “unbelievable” blogs in which she described her “strong dislike of children,” Camden County Assistant Prosecutor Christine Shah said at Creato’s arraignment on Tuesday.

After the girl went away to college, she repeatedly threatened to break up with Creato, who had allegedly become jealous of a boy that she was talking to at school.

Creato reportedly logged into her social media accounts and at one point posed as the girl and told the boy to leave her alone.

Creato did not confess to killing his son, but allegedly told investigators that he felt “jealous and anxious” in the hours before he noticed his son was missing, and that he had been worried that the woman he loved had found someone else, the Inquirer wrote.

Shah said that on the night that Brendan was killed, Creato allegedly called his girlfriend eight times and that he noticed from her Snapchat account—a picture and video-sharing app—that she was with the “guy he was jealous of,” the paper reported.

Creato and the girl had visited the spot where Brendan’s body was found about 30 times, and he told investigators that it was his “favorite place… and he referred to it as spiritual to him,” Shah said.

The pair is still reportedly communicating.

If convicted of murder, Creato faces a minimum of 30 years in prison without parole and a maximum term of life in prison with at least 67 years without parole.

His bail was set at $750,000.

If he posts bail, Creato is not allowed to leave the state or make any contact with Brendan’s mother, Samantha Denoto, or her family.

Creato’s attorney, Richard Fuschino Jr., said his client had cooperated fully and truthfully with investigators.

“He spent an entire day answering questions of investigators,” Fuschino said, saying that the prosecutor’s version of what happened was improbable, the Inquirer wrote.

ROCK HILL

A Rock Hill father was arrested Wednesday in a case involving a 6-month-old baby boy who was brought to the emergency room unresponsive in March, and later died.

Joseph Dominic Pesa, 19, was charged with unlawful conduct toward a child and taken to the city jail, Rock Hill Police Department records show. A judge on Wednesday set Pesa’s bond at $150,000.

The York County Coroner’s Office ruled the “most likely” cause of death for 6-month-old Jacob Pesa-Mendoza was asphyxia due to being placed face down on adult bedding. Coroner Sabrina Gast listed the baby’s manner of death as “unable to determine.”

The coroner’s office in March did not rule on the “manner of death” but, after reviewing medical records, autopsy/toxicology results, and interviewing caregivers and experts, Gast said the infant was prevented from being able to breathe.

A police spokesman said the case was turned over to the State Law Enforcement Division’s child fatality task force. An arrest warrant provided by SLED alleges Pesa shook the child, “causing his head to move uncontrollably.”

Pesa’s arrest warrant accuses him of putting the infant face down on a bed without seeking medical attention until “hours later.”

Rock Hill officers went to an apartment on India Hook Road where the infant was found unresponsive by EMS workers on March 16, the police report states.

Paramedics said the infant was having difficulty breathing and he was taken to the hospital. A news release from the coroner’s office states the infant was treated at the Carolinas Medical Center in Charlotte. He died March 21.

PULASKI — After Howard Cole killed his infant son, he placed the body in his car and drove to purchase alcohol. He began drinking as he drove around looking for a place to bury Cory Cole’s 5-month-old body.

Cole signed a plea agreement Thursday which will spare his life: He pleaded guilty to the capital murder of his son and was sentenced to life in prison. He could have faced the death penalty if the case had gone to trial.

He was sentenced to an additional five years after pleading guilty to unlawful concealment of a body.

Cole, 33, listened as prosecutor Mike Fleenor described the details of the night Cory was murdered.

It was cold on that night – Jan. 29, 2014. Temperatures dropped to single digits. After driving for several miles, Cole pulled off Draper Valley Road a short distance from Interstate 81’s Exit 89. He walked almost 600 feet from the roadside to a line of trees where he began digging, though not very deep since the ground was frozen solid from the winter weather.

He buried his naked son less than a foot in the ground and pushed a pile of dead leaves over the burial site at the base of a tree.

The next day, authorities arrested Cole on a charge of felony child neglect, but did not know where Cory’s body was, Fleenor said on Thursday in court.

As they questioned Cole, detectives said, “We know your son is dead. We need you to help us find him. Is he in the water?” they asked.

“No,” Cole responded.

“Is he in the ground?” the detectives asked.

Cole nodded and said, “Yes.” After more questions, Cole told investigators, “I’ll take you to him.”

Investigators found Cory’s body on the south side of Draper Mountain. They later found a pair of infant pajamas in a trash bin in Pulaski. The garment was forensically analyzed and tested positive for both Cory and Howard Cole’s DNA.

Cole was indicted by a grand jury in April 2014 on a capital murder charge. Fleenor’s office said at that time the death penalty would be sought.

Fleenor did not comment in court Thursday about why his office accepted the plea deal.

According to Medical Examiner Amy Tharp’s autopsy report, Cory had 26 bruises on his head and neck. Blunt force injuries and asphyxiation by strangulation were declared as the cause of death.

Cory was reported missing Jan. 29, 2014, by his mother, Samantha Warden, who told police that Cole, her fiance at the time, had left with the child. She signed an arrest warrant affidavit on that same day, after she witnessed Cole pick Cory up and yell, “Shut the -- — up,” before throwing him 4 feet onto a nearby bed.

Warden, 30, was charged with felony child neglect in Cory’s death. She pleaded no contest in April and is serving a seven-year prison sentence.

Custody agreements stated that Cole was not supposed to be alone with the boy, but on Jan. 29, he and Warden argued and she left the baby with him.

Cole sat with his defense attorneys Jimmy Turk and Steve Milani during Thursday’s hearing. He answered Circuit Court Judge Marc Long’s questions almost entirely with either a yes or a no.

Only a handful of people sat in the almost empty courtroom — a different scene from the full courtroom when Warden was sentenced.

Long, who has often been vocal in cases regarding child abuse, made no comment to the defendant.

SPENCER, Tenn. — A Middle Tennessee man has been indicted on a charge of aggravated child neglect following the death of his 7-month-old daughter.

The Tennessee Bureau of Investigation says 20-year-old James M. Green of Spencer was arrested Tuesday and was to be held on $50,000 bond in the Van Buren County jail.

The TBI says the child, who died Jan. 25, was found not breathing after sleeping in bed with her father. An autopsy determined Brooklyn Green died of asphyxiation.

Father now charged with murder in death of infant with cracked skull

ALLEGAN, MI -- A 22-year-old Allegan man is now charged with murder after his 3-month-old son died in December from what police allege was abuse.

Allegan County prosecutors recently added charges of open murder and felony murder in the case against Jonathan Joseph Colby.

He initially was charged with first-degree child abuse after the child died Dec. 3.

The case had been on hold pending the results of a psychiatric exam.

Earlier this month, Colby was found competent to stand trial.

Allegan County sheriff's detectives say a medical examiner determined his son, Jase, suffered a cracked skull and injuries consistent with strangulation and suffocation.

In an interview with detectives, Colby admitted to hitting, slapping and choking Jase on several different occasions, including the night that Jase died, detectives said. Colby allegedly hurt his son because he was tired and frustrated.

An April 14 probable cause hearing is scheduled for Colby in Allegan County District Court.

PORT ST. LUCIE — A Port St. Lucie man took his own life Wednesday night after he first tried to strangle his 7-year-old daughter, city police said.

Police found Armando Lawrence Botta dead in his home in the Newport Isles community, south of Gatlin Boulevard and east of Interstate 95, from an apparent self-inflicted stab wound.

Police are investigating the incident as a suicide and an attempted murder, authorities said Thursday. Officers were called shortly before 9 p.m. Wednesday to a Southwest Newport Isles home. According to a police report released Thursday night, Botta was found dead on the living room floor in front of the sofa.

A kitchen knife was lodged just between his chin and several zip ties and a USB cable were tightened around his neck, indicating an attempt at self-asphyxiation, the report said.

The officers found a 7-year-old girl who had injuries that were consistent with an attempt at strangulation, the report said. The girl told officers her father was making her a necklace and used a string to measure her neck. The girl said her father pulled the string too tightly, causing her pain.

The girl had heavy bruising on her neck and discoloration in her eyes, nose and mouth. It was not clear if she was conscious when Botta committed suicide, police said.

Police found a suicide note addressed to Botta’s estranged wife. After returning to the home, Botta’s wife told police she and Botta were in the process of separating. His wife said Botta had a history of medical issues, but had never exhibited violent behavior toward her or the children in the past.

The woman said she left Wednesday night to pick up two children from a church where the children also attend school. She received a call from the 7-year-old girl and called 911. The woman hurriedly retrieved the other children before returning home, police said. She told police she and Botta had recently argued about child-custody arrangements once their separation became final.

A father accused of killing his baby boy by suffocation after forcing a pacifier in his mouth, has pleaded not guilty.

Danny Adams, 24, of Lewiston is charged with depraved indifference murder and manslaughter in the death of his infant son following his death in December.

He denied the charges Justice MaryGay Kennedy read from a grand jury indictment, handed up last week.

Police said Adams forced a pacifier into the mouth of his 14-week-old son, Zade, shortly before he stopped breathing.

They said he told them he was frustrated that his son would not stop crying so put a pacifier in Jade's mouth and forced him to stay on his stomach by pushing on his back.

An autopsy determined the cause of death was asphyxiation.

Hornblower said he expects a bail hearing to be set to determine whether Adams will be held in jail without bail or allowed release prior to his trial.

Assistant Attorney General Matthew Crockett asked that Adams be barred from contacting Zade's mother, Kaitlyn Baker, 18. Kennedy agreed.

Adams has been held without bail since his arrest in early January following the death of his son on December 14.

A murder conviction in Maine carries a sentence of 25 years to life in prison; manslaughter, up to 30 years.

Adams told police in an earlier interview that he had injected heroin the night before at a friend's house, then smoked marijuana with Baker when he got home. He said he had bruised Zade's ears when he squeezed them with his thumb and fingers as he held the head of the baby, who continued to cry, according to court documents.

Adams said he caused bruising on Zade's forehead when he forced a pacifier in the baby's mouth and held it in place with his palm, while supporting his fingers on the baby's forehead.

Doctors also detected a rib fracture during the autopsy. He told police he had become frustrated with Zade's crying about four weeks earlier and had squeezed the baby with force.

LEWISTON, Maine —A Lewiston man charged with murder in connection with the death of his 3-month-old son appeared in court Friday morning. Department of Public

Safety spokesman Steve McCausland said state and local police arrested Danny Adams, 24, around 4 p.m. Wednesday.

Adams was ordered held without bail and did not enter a plea.

Investigators said the 3-month-old, Zade Adams, was found unresponsive in a bassinet on Dec. 14. The medical examiner's officer later determined his death was due to asphyxia.

According to court documents, Adams admitted to police that he put a pacifier in Zade's mouth and the child spit it out.

Adams said he held it in the child's mouth so he would stop crying.

Adams said he held the baby down with his right hand on his back, and the baby made small fusses.

Adams said he did not kill Zade, and when he went back to check on him 45 minutes later, he was lifeless and unresponsive.

In the court paperwork, Adams also admitted causing bruising on the child's ear and bruising around the mouth was caused when he held the pacifier in the baby's mouth.

When asked about a broken rib discovered by the medical examiner, Adams said four weeks earlier Zade wouldn't stop crying; he squeezed him hard; and he let out a grunt, according to the court documents.

Dad charged in infant daughter's death to face trial

A 20-year-old man charged in connection to the death of his infant daughter in Green Bay last year is being bound over for trial.

Queondrai L. Farris was charged last month with with first-degree reckless homicide and physical abuse of a child for the June 25 death of 4-month-old Alesana Farris.

At a preliminary hearing on Wednesday, a Brown County Circuit Court commissioner determined there was probable cause for the charges and ordered Farris bound over for trial.

Prosecutors contend Alesana Farris died from "compressional asphyxia" at the hands of her father in a residence at 1251 University Ave. on the city's east side. Medical examiners said the girl had evidence of healing fractures to her ribs, which may indicate "an abusive event at least one week prior to the incident."

Farris told police he held the girl in his arms and pressed her face into his chest and shirt until the girl stopped crying, according to court documents.

During the hearing, a Green Bay Police Department detective said at one point during an interview with Farris "he looked at me said 'I killed my baby.'"

Farris is due back in court Jan. 23.

GREEN BAY, Wis. (AP) - Green Bay police say a 20-year-old man is charged with the death of his infant daughter.

Queondrai Leondarus (KWEN'-dray lee-on-DAYR'-us) Farris is facing two felony counts - first-degree reckless homicide and reckless child abuse in the death of 4-month-old Aesana Farris last summer.

WLUK-TV reports police and paramedics were called to a home June 25 and found the lifeless child. An autopsy showed she had died of "compressional asphyxia." Farris says he was trying to keep the baby quiet and held her head to his chest. A complaint says he told investigators the death was an accident.

According to Press-Gazette Media, Green Bay police say Farris, who is listed as homeless, was arrested Friday in Milwaukee after he was charged that day in Brown County.

Couple to stand trial in toddler's death

STOCKTON — The image of a toddler’s body with ligature marks on her neck and covered in bruises is not easy to erase.

That is according to a judge who has ordered a Stockton couple to trial in the death of a 2-year-old child found asphyxiated and with numerous injuries inside their home.

The toddler’s biological father, 27-year-old Dwight Slay Jr., and his girlfriend, 30-year-old Latima Denise Coleman, are accused of child abuse resulting in death, torture and corporal injury to a child, facing a potential life sentence in prison if convicted on those charges. Slay additionally faces one count of willful cruelty to a child.

Superior Court Judge Bernard Garber heard testimony in a four-day preliminary hearing and decided Tuesday there was enough evidence to show Slay and Coleman can be tried in the slaying of toddler Tafari Barris.

County Chief Medical Examiner Bennett Omalu described injuries that demonstrated an ongoing pattern of abuse to the child, including scars on her lips, contusions, prior head trauma and a broken arm.

“Those were not fatal wounds,” he said.

Her ultimate demise was due to asphyxiation and blunt force trauma to the head, according to Omalu, whose findings also show Tafari had been smothered.

“A child of that age, she just had too many scars on her body,” Omalu said.

Pictures of Tafari's battered body were shown on a projector screen during the hearing, at one point causing Coleman to tear up.

Garber said he believes the autopsy findings will have an "incredible effect" on a jury if the case goes that far.

“That’s an image that’s difficult to remove from your mind,” he said.

Prosecutors allege the couple had abused Tafari since at least January and evidence presented in court indicates Slay’s sister had been trying to obtain custody of the child because of the abuse.

Public records also reveal that both law enforcement and social workers responded to the couple’s home multiple times for reports of possible abuse from neighbors and family members.

Authorities even upgraded the investigation to an “at-risk” missing person on April 2 following failed attempts to find Tafari.

She was found dead April 6 by emergency responders at the couple’s home in the Sierra Vista housing development after a 911 call was placed reporting the child was unresponsive.

There are witness accounts that are inconsistent with one another from friends who testified they had been at the home the day Tafari died.

Juan Prado, one of the friends, testified he had been drinking at the residence the night before the 911 call, when Slay went upstairs with Tafari. He said Coleman, he and another woman stayed downstairs.

Prado said he grew tired of waiting for Slay and decided to go upstairs to say he was leaving.

“I heard a funny noise,” Prado said, adding that it sounded like a belch. “It had to be the baby.”

Prado said he saw Tafari lying on her belly; vomit on the floor; and Slay standing over the vomit.

According to Prado, Slay said, “she’s just sick bro.”

Prado said he learned Tafari was dead the next day.

Coleman’s defense attorney Rick Gibson argued Tuesday that Prado’s testimony shows his client is not responsible for Tafari’s death. He also argued that Omalu’s findings that the child had vomit in her lungs from suffocation support Prado’s account.

Deputy Public Defender Patrick Smalling, who is representing Slay, contended Prado’s testimony was unreliable because he had “numerous” beers and admittedly ingested marijuana on the evening in question.

Despite the lack of direct evidence, Deputy District Attorney Angela Hayes said the defendants were placed alone with the child by witnesses between April 6 and the night before. Both would be responsible as either a perpetrator or as an aider.

Hayes said Slay could have easily given the child to his sister instead of abusing her.

Coleman and Slay are both scheduled to return to court Sept. 15 for arraignment on the charges.

St. Petersburg, Florida -- A 29-year-old father has been charged in the death of his infant son in July who he left alone to run errands. The boy was found unresponsive in his cradle.

Jason Anthony Walker of St. Petersburg faces one charge of child neglect. The incident occurred on or around July 3 and the 5-month-old boy died on July 5 at a local hospital, according to the Pinellas County Sheriff's Office.

Investigators found that Walker was caring for the boy on July 3 when he left the child in his cradle twice for an extended period of time, while ran errands, the sheriff's office said. When Walker returned home, the boy was unresponsive and lying face down on a blanket.

An autopsy found that the boy died of asphyxiation.

Walker is being held in the the Pinellas County Jail.

Father Beats Daughter for Copying Homework

A girl in Hangzhou, Zhejiang province was beaten to death by her father for copying her classmate's homework.

Chou, the 11-year old girl, was tied up by her father, Ye Hung, forced her to kneel and proceeded to beat her.

After physically abusing his own daughter, Ye went out to calm himself. When he came back, he discovered that his daughter had stopped breathing.

Chou was immediately rushed to a local hospital. However, the doctors were not able to save her. She died 12 hours later from a heart attack.

Doctors discovered that Chou had sustained bruises on her neck and back. According to Times of India, medical reports indicate that Chou had suffered from asphyxiation for as long as 5 minutes.

A spokesman for the local authorities said that while in the hospital, Ye had been remorseful for what he had done. He prayed and begged for the gods to heal his daughter so she would get better.

The father's actions may have been brought about by his strong belief in being a good student.

"He loved kids very much but also believed they must do well at school, which means not copying anyone's homework. That kind of cheating made him mad," Park Jen said about his cousin, Ye.

Chou's case marks the most recent incident of domestic child abuse in China.

In Shanxi, a 6-year-old boy had his eyes gouged out. His aunt was suspected of committing the crime. However, it was reported that she had committed suicide a few days later.

Similarly, a 10-year-old boy in Guangdong was allegedly beaten by his stepmother. Photos of the aftermath of the savage beating had outraged Chinese citizens after they went viral on Chinese social media sites. Netizens who saw the photos immediately clamored for the implementation of stricter laws to discourage domestic child abuse.

A man has been indicted on a felony murder count in the killing of his 4-month-old son, according to the Bulloch County Sheriff's Office.

On Sept. 12, deputies and Bulloch County EMS responded to a mobile home in the 2000 block of Old Register Road along for a 4-month-old child reportedly not breathing. EMS transported the child to East Georgia Regional Medical Center, where he died.

Investigators responded to both the scene and hospital to begin an investigation.

Extensive interviews were conducted with the father of the child, Allan Ray Williams, 29, of the mobile home, who had recently moved to Bulloch County from Johnson County. Williams indicated that his son had choked while drinking a bottle in his crib and that upon noticing the child in distress, he called for help, Sheriff Lynn Anderson said in a news release issued Wednesday.

Based on multiple interviews with Williams and others, along with the processing of the residence, inconsistencies appeared in Williams' story, Anderson said.

A subsequent autopsy by the Georgia Bureau of Investigation's Coastal Regional Crime Lab further highlighted the fact that the child did not die as related by Williams, the sheriff said.

Chief Deputy Jared Akins, of the Bulloch County Sheriff's Office, said Wednesday that the autopsy revealed the infant died of asphyxiation.

On Sept. 27, Williams was charged with second-degree cruelty to children and making false statements. He has since remained in custody. On Monday, the Grand Jury of Bulloch County was presented with the facts of the case. The grand jury returned true bills of indictment on the following charges against Williams: felony murder, second-degree cruelty to children and making false statements.

Williams remains in custody with no bond at the Bulloch County Jail.

SARASOTA - Misty Stoddard, who is accused of killing her stepdaughter, said she has been left in the dark of the details of her case when she tried unsuccessfully to fire her defense team Tuesday.

“I feel like I should be able to talk to my attorney,” said Stoddard, who spoke in shackles during Tuesday's hearing in Sarasota County Circuit Court.

“I just feel completely uninformed. “I just don't know how I'm supposed to have confidence in lawyers to defend me when they're dishonest in this courtroom."

Stoddard, along with her partner Kenneth Stoddard, are being tried in connection to the death of Melissa Stoddard. Melissa, 11, moved into their house during the summer of 2012, and within months, the child had died from lack of oxygen to the brain, the medical examiner's office ruled.

Court documents detailed how Melissa was ostracized from her half-siblings and allegedly abused. She was deprived of food and removed from Oak Park School. To control her, the Stoddards allegedly tied her to a board and duct-taped her mouth to keep from crying out. Melissa, who had autism and was known for her tantrums, died Dec. 17, 2012.

While Judge Frederick Mercurio called Misty Stoddard's concerns “legitimate,” he said her court-appointed attorneys were working on her case and progressing.

The issue stemmed from an eight-page confidential letter Stoddard wrote in December to her legal team from the Office of Regional Counsel, listing her concerns and questions with her case.

Her defense attorney, David Taylor, said he and his team discussed her letter and some of what she wrote does not fit into their legal strategy.

“There's certain things in the letter we believe is not appropriate for us to do,” Taylor said, adding they had spoken with her about it.

However, Stoddard said she felt her issues went unaddressed for months. At times, she folded her hands in front of her or tapped her foot, looking annoyed next to Taylor in the courtroom. “I sit there with these questions and concerns about my case,” the 37-year-old Sarasota County woman said to the judge.

“I feel like they have all their other cases they're working on and I understand, it's not their lives and it may not be important to them, but it's important to me.”

Also in Tuesday's court hearing, attorneys on both sides asked for Kenneth Stoddard's trial to be delayed from April 7 until August because of a crowded court docket this spring and summer.

Of the Stoddard couple, Misty could be the first to stand trial.

When her trial is expected to start June 16, she will be facing a first-degree murder charge, although the prosecutor's office is not seeking the death penalty.

Grand jury declines to indict Baton Rouge father in infant son's death

BATON ROUGE, Louisiana — A grand jury has declined to indict a 23-year-old Baton Rouge man for murder in the death of his 6-month-old son, Aiden, who showed signs of previous abuse, including having been burned in a scalding bath.

The East Baton Rouge Parish panel did, however, charge Curtis King Thursday with second-degree cruelty to a juvenile and possession with intent to distribute marijuana.

District Attorney Hillar Moore III Friday told The Advocate (http://bit.ly/1gZ0Cws ) the cruelty charge covers alleged child abuse and neglect from May 31 to Nov. 6 — the day the baby was taken off life support. The coroner's office found Aiden asphyxiated while lying in an adult's bed.

The drug charge comes after police found marijuana in King's home Oct. 29 while responding to a report about an unresponsive child.

MINNEAPOLIS (WCCO) – An Eagan, Minn. man was charged Tuesday after police say he rolled on top of his infant son while drunk, suffocating the boy, according to Dakota County Attorney James Backstrom.

Nathan Scott Savage, 30, was charged with three counts of second-degree manslaughter, all felonies, plus neglect and endangerment of a child, both gross misdemeanors.

According to the criminal complaint, the infant, Nolan Scott Sikich, was found dead shortly before 6 a.m. on Oct. 19, 2013. He was less than two months old at the time of his death.

Eagan Police were called to the residence where Savage lived with the child’s mother.

Upon arrival, they heard the child’s mother yelling at Savage in regards to the child, who firefighters found unresponsive and tried to resuscitate.

An officer spoke with Savage and believed he was intoxicated after smelling a strong odor of alcohol on him.

Savage later admitted to police that he had been drinking the evening before. Savage told police that sometime between 10 p.m. and midnight on Oct. 18, he laid Sikich down on his bed, that he shares with the boy’s mother. Savage said that eventually they both fell asleep.

At approximately 5:55 a.m., Savage said he woke to the child’s mother shaking him, asking where the child was, according to the complaint.

Savage said that was when he realized he had been laying on top of Sikich.

Savage admitted to police this was not the first time that the boy had slept in their bed.

An autopsy ruled the cause of death as “asphyxia due to probably overlay.” The manner of death was listed as “accidental,” according to the criminal complaint.

Savage, who appeared in court Tuesday, is set to appear again on May 27.

Father continues to be questioned following death of two sons

A bleak atmosphere hung over Westport this week after the bodies of two missing children from Carlow were found in the boot of a car which was driven by their father Sanjeev Chada who has been arrested on suspicion of murder.

The bodies of Eoghan (10) and Ruairi (five) Chada were discovered in the car after it crashed into a wall on the Old Coast Road at Rosbeg on Monday afternoon around 3.30pm. The Ford Focus, which was driven by their father Sanjeev, collided head on into a wall after the car drove out off a side road onto the main road. Those who came across the crash found the 43-year-old driver with a noose wrapped around his neck and the bodies of his sons in the car boot.

The boys were reported missing on Sunday night after Sanjeev left the family home at Ballinkillen, Co Carlow, with the children to go bowling in Carlow and never returned. The Child Rescue Ireland alert system was used for the first time by gardaĆ­ on Monday to try and locate the boys, however the grim discovery in Westport was the sad conclusion to the search for the children.

The scene at Rosbeg was immediately preserved for a technical examination and the car was removed from the scene of the collision for further technical and forensic examination. A post mortem of the two children was carried out by the deputy State pathologist Dr Jabbar with the results of the post mortem not being released, however it has been reported that the boys died from asphyxiation, and were killed hours before the crash. 

Sanjeev Chada, who was treated in Mayo General Hospital for injuries sustained in the crash was released from hospital on Wednesday afternoon and was arrested after his release at 12.30pm. He was brought to Westport Garda Station for questioning and was detained under Section 4 of the Criminal Justice Act, 1984 where he could be detained for 24 hours. Questioning was suspended on Wednesday evening to allow him to sleep and resumed on Thursday morning which meant that the period of detention was due to expire on Thursday evening. At the time of going to print Mr Chada had not been charged.

Yesterday a technical examination was carried out on an area near Ballintubber Abbey.

The bodies of the two boys were released on Wednesday night and made the journey home to their mother Kathleen in a single white coffin.

The brothers are to be buried today (Friday) in St Lazerian's Church, Ballinkillen at 1pm, with burial afterwards in the adjoining cemetery.

Cathaoirleach of Mayo County Council, Westport area councillor John O’Malley said that people in Westport are “shocked and stunned” about the events which occurred. “It’s the most horrible news that I have ever heard in the area,” Cllr O’Malley told the Mayo Advertiser. He expressed his sympathy to the family of the deceased and said that he hoped that God would give their mother strength during this difficult time.

Cathaoirleach of Westport Town Council Michael McLaughlin also conveyed his sympathy to the family of the deceased for this “terrible tragedy.”

Struthers dad indicted in abuse case

A Struthers 2-month-old authorities said was abused by his father was taken off a ventilator and is breathing on his own.

Struthers Det. Jeffrey Lewis said Friday the boy is breathing on his own at Akron Children’s Hospital for the first time since he was hospitalized last week.

He said doctors are still unsure the amount of brain damage caused by the abuse or if it will ultimately affect the boy.

The boy’s father, Robert Purfey Jr., 32, was indicted Thursday on two counts of felonious assault, two counts of child endangering and one count of tampering with evidence.

Purfey has been held in the Mahoning County Jail on $150,000 bond since his arrest Monday.

Reports say officers found a bath towel stained with blood, a pair of scissors stained with blood and a baby wipe that was lodged in the baby’s throat at 41 Park Ave.

The boy was taken to Akron Children’s Hospital on Friday.

Nurses there reported the possible abuse.

Purfey, according to a search of court records, was convicted of possessing dangerous drugs and unauthorized use of a motor vehicle in in 2011 and disorderly conduct, a charge amended from possessing drug paraphernalia, in 2009.

He also pleaded guilty in 2011 to assault and criminal damaging in Youngstown Municipal Court.
