PHILADELPHIA - A Philadelphia man has been sentenced to up to 40 years in prison for putting drugs in his baby's bottle and killing the child, according to CBS Philly.

Orlando Rosario, 46, will reportedly spend a minimum of 15 years and a maximum of 40 years in prison in connection with the death of his son.

The defendant reportedly blames his own drug abuse and mental illness for the tragedy.

According to the station, prosecutor Lorraine Donnelly says the victim died of drug intoxication after his father put heroin and methadone - a drug used to treat heroin addiction - in the infant's bottle. The child died two days before his first birthday.

Donnelly reportedly said she doesn't believe the defendant intended to kill his son: "I do believe he put those substances in the baby's bottle, in his warped mind, to calm the baby. The baby was a fussy baby, and in his mind it was like Benadryl."

The judge agreed with Donnelly, according to the station, and told Rosado she doesn't think he knows what he did that night. She also told him that he killed a vulnerable child and rejected his claim of also being a victim for losing his son.
