FARGO - A Fargo father is accused of felony child abuse after allegedly punching a car window near his partner’s head, shattering it and driving glass into the eye of their 4-year-old son nearby.

Tyler Jacob Leitch, 34, was charged Wednesday in Cass County District Court with one count of Class B felony abuse or neglect of a child, and one count each of criminal mischief and domestic assault, both Class B misdemeanors.

Court documents say police were called to the scene of a domestic dispute Feb. 26 in the 300 block of 16th Street South, where a witness told them she picked up her friend, Leitch’s girlfriend, and the couple’s two children.

The girlfriend told police Leitch had been walking in the area, and after an argument between the couple, he punched the window where his girlfriend was sitting, shattering it, and then hitting her on the cheek with his hand.

A piece of glass went into their son’s eye, which was cut and bleeding, the girlfriend said.

A warrant was issued for Leitch on Wednesday.

Former Fargo firefighter now in Duluth used work computer to store child pornography, investigators say

DULUTH - A Duluth - and former Fargo - firefighter who faces sexual misconduct and child pornography charges allegedly used a computer at a Duluth fire station to distribute pornographic images of a 4-month-old child, according to court documents.

Caleb Stuart Lofald, 32, of Hermantown already is charged with sexually assaulting the infant girl and surreptitiously recording a 6-year-old boy and an adult woman in various stages of undress in a guest room at his home.

But court documents and statements from authorities Friday suggested that he remains under investigation for possible additional charges related to the production, possession and distribution of child pornography.

“These are very serious allegations,” prosecutor Gary Bjorklund said. “The defendant is well aware that these charges are part of a much larger investigation that could be headed toward significant federal charges.”

Judge David Johnson set Lofald’s bail at $250,000 without conditions or $100,000 with conditions at an initial appearance Friday morning in State District Court in Duluth. Conditions of the lower bail would include a screening for intensive supervised release and no unsupervised contact with minors.

Lofald, lodged at the St. Louis County Jail since Tuesday, appeared in court wearing an orange jumpsuit. A half-dozen supporters, including his wife and father, sat in the courtroom.

Bjorklund, head of the criminal division of the St. Louis County Attorney’s Office, asked for significant bail, citing the serious nature of the alleged crimes and the possibility of additional state or federal charges.

“The state is concerned about the defendant being a flight risk and the well-being of the public,” Bjorklund told the judge.

Superior attorney Stephen Zuber represented Lofald at the hearing.

Zuber described Lofald as a lifelong resident of the Duluth and Hermantown area and said he has strong ties to the community. He said Lofald has been supported by family and has had numerous supervised visits with his own 3½-year-old son since the investigation was launched nearly two months ago.

“The search warrant in this case was executed on Nov. 20,” Zuber said. “The defendant has been free since that time with no issues.”

Court documents allege that investigators found numerous photographs and recordings on electronic devices seized from both Lofald’s Hermantown home and the Duluth Fire Department’s Fire Station 7.

The devices allegedly included 11 photographs of a partially nude 4-month-old girl, with several images depicting a hand manipulating the child’s genital area, according to the criminal complaint. The photos allegedly were taken in Lofald’s home in May 2013.

Investigators said that video recordings of a 6-year-old boy and adult female also were retrieved from the electronic devices. The videos were recorded by a hidden camera in a guest room at Lofald’s home on separate days in September 2014, according to the complaint.

Additional court documents allege that Lofald admitted to distributing child pornography from the fire station. Images of the 4-month-old were found on a hard drive seized from the station, according to a probable cause application filed this week by investigator Jeanine Pauly of the Lake Superior Forensic Technology and Internet Crimes Against Children Task Force.

While the devices were seized in November, the images were not recovered from the hard drive until last week, Pauly said. Lofald remains under investigation for further child pornography charges as a forensic examination of the devices continues, according to the document.

After Friday’s hearing, Bjorklund declined to elaborate on the ongoing investigation. #Zuber also declined to comment, directing comments to Lofald’s primary attorney, Rick Gondik. Gondik, a Superior attorney, did not return a call requesting comment.

Zuber said during the hearing that Lofald has been a Duluth firefighter for seven years, and previously held the same position in Fargo.

He has been on paid administrative leave since November, but Duluth Mayor Don Ness on Thursday released a statement calling the allegations “beyond heinous” and stating that the city is in the process of firing Lofald.

Noting the nature of the alleged crimes, Bjorklund said he would file a notice of intent to seek a departure from sentencing guidelines should Lofald be found guilty. The most serious charged offense, second-degree criminal sexual conduct, carries a maximum of 25 years in prison.

Lofald’s next court appearance is scheduled for Feb. 4.

Mayville father charged with child abuse after shaking 9-month-old daughter

HILLSBORO, N.D. – A Mayville father is charged with felony child abuse after his 9-month-old baby daughter was sent to the hospital in critical condition with bleeding on the brain from what prosecutors say was a violent shaking.

Christopher Kraay was charged Friday in Traill County District Court with one count of child abuse, a Class B felony.

Court documents filed with the charges say Kraay’s daughter was taken by helicopter to Sanford Medical Center in Fargo on Jan. 2 for severe head trauma.

Hospital staff reported that injuries to the child were consistent with child abuse.

The parents gave statements to hospital social workers saying they gave the baby some Tylenol about 11 a.m. for cold-like symptoms, but that the baby rolled her eyes, threw up and had passed out while Kraay was dressing her.

By the time they arrived at the hospital, the baby was limp and unresponsive.

The baby’s mother told investigators with the state Bureau of Criminal Investigation that the child seemed fine the night before, and more or less normal when she left for work the previous morning. The next day, however, the baby was crying more than usual as her father changed her.

The mother told investigators she had never known Kraay to physically abuse their daughter, nor had she done so.

Investigators served a search warrant on the couple’s home Jan. 6 while Kraay was there. He refused to open the door for investigators, who used a ramming tool to get it open and detain him.

While being interviewed, Kraay allegedly admitted to investigators he jumped around with the baby the day before she was taken to the hospital, and demonstrated with a doll what he did.

Kraay also allegedly admitted to the BCI agents he violently shook the baby in a rocking motion, saying he got carried away.

No court date in his case has yet been set.

Bismarck father faces felony child abuse charge

A Bismarck man is facing a felony child abuse charge for allegedly shaking his 16-month-old son.

Authorities allege that the son of 21-year-old Jeremy Young suffered eye and brain injuries that might be permanent.

Judge Bruce Romanick on Thursday set bond for Young at $25,000. Young requested a court-appointed attorney. No attorney was listed in court documents on Friday, and a home telephone listing for Young could not immediately be found.

Young could face up to 20 years in prison if convicted.

Dad who murdered three daughters during visitation gets life in prison with no parole (Hudson, Wisconsin)

Dad AARON SCHAFFHAUSEN may be an amoral little sh** but he's not "crazy" in the sense of not knowing what he was doing. He very deliberately made death threats all along. And then when he actually succeeded in murdering his three daughters, he thoughtfully telephoned the mother to inform her.

The problem is that authorities are extremely tolerant of male threats against women and children. If this were a dude making a threat against a male politician or judge, he would have been investigated immediately and very likely locked up. But if it's "just" Mom and the kids, well, he gets a free pass. Any complaint Mom brings up will probably be dismissed as hysterical and untruthful, even if she has evidence. And woe be to any mother who uses Dad's volatility and death threats as a reason to restrict or cut off Dad's access. Parental Alienation! Must lean over backwards and accommodate Daddy no matter what!!! Or you could lose custody!

So the mother (reluctantly I'm sure) granted this sh**head permission to see the kids. And this is how he rewarded her kindness.

Once again, the fathers rights lie is exposed. Fathers don't kill because they have been "deprived" of their kids. They kill because they have the means to do so, meaning somebody granted them access to the victims.

Wisconsin man who killed his 3 daughters to hurt ex-wife gets life in prison with no parole

HUDSON, Wis. — A Wisconsin man who killed his three daughters last year in an act of revenge against his ex-wife was sentenced Monday to life in prison with no chance of parole.

Aaron Schaffhausen, 35, had admitted he killed 11-year-old Amara, 8-year-old Sophie and 5-year-old Cecilia at their River Falls home in July 2012 to hurt his ex-wife, but argued he had a mental defect that kept him from knowing it was wrong.

A jury disagreed and found last April that he was sane when he slit the girls’ throats, tucked them into bed, then tried to set the house on fire to cover his crime.

He faced mandatory life sentences for each girl’s death, but Schaffhausen had the prospect of supervised release after at least 20 years in prison. That was rejected by St. Croix County Circuit Judge Howard Cameron, who called the crime “vicious.”

Cameron said he chose three consecutive life sentences — the maximum — to protect the public and to send a message that “each child is so important.”

Evidence showed that Schaffhausen texted his ex-wife July 10, 2012, to ask for an unscheduled visit with the girls. She consented but said he had to leave before she got home. The girls’ baby sitter told investigators the children were excited when he arrived, and the sitter left.

He called his ex-wife, Jessica Schaffhausen, about two hours later, saying: “You can come home now, I killed the kids.”

Police arrived to find the girls lying in their beds, their throats slit and blankets pulled up to their necks. White T-shirts were tied around their necks. Cecilia’s body also showed signs of strangulation.

As he did throughout his trial, Aaron Schaffhausen sat impassively as family members read their statements.

Jessica Schaffhausen’s sister, Mary Elizabeth Stotz, described Aaron Schaffhausen as “the darkness, the boogeyman” that every child fears.

“He took their unconditional love for him and used that love to lure them to get close enough” then killed them, Stotz said. “Their last memory was what an evil killer their dad was.”

Eryn Schlotte, the girls’ cousin, said: “I thought the world was a better place than this. Not a place where someone got killed before they were even in kindergarten or middle school.”

While family members wiped their eyes, lead prosecutor Gary Freyberg argued for the maximum sentence, saying Schaffhausen used the girls “as pawns ... to make Jessica suffer.”

“How wrong is it to use his intellect, his size and his brute strength not to protect his children from danger, but to become the most dangerous person in the world to them?” he said.

Schaffhausen’s father, Roger, said his son had a mental illness and, to some degree, everyone was responsible for not getting him the help he needed. His mother said he was a good man who did a horrible thing.

Defense attorney John Kucinski told the court that Schaffhausen killed his kids because he was mentally ill, not for revenge.

“A rational, sane person cannot take the girls he loves and kill them,” Kucinski said.

After the hearing, he said mental illness should have been a mitigating factor.

“Everybody loses,” Kucinski said, noting he plans to appeal.

Trial testimony showed that in the months leading up to the killings, Schaffhausen told several people he had thoughts of killing his daughters. His ex-wife testified that in March 2012, he called her from Minot, N.D. — where he was working — and told her he “wanted to drive down there and tie me up and make me pick which child he killed and make me watch while he killed them.”

He also called his ex-wife repeatedly, sometimes up to 30 times a day, and threatened to kill the man she was dating.

Schaffhausen didn’t testify at trial or make a statement during his sentencing.

Carrie Leveille, a friend of Jessica Schaffhausen’s, said the family is working on healing.

“Today we can go home with relief and take the next step forward, knowing that justice has been served to the best that it could be,” she said.

(AP) — A jury on Tuesday rejected an insanity defense by a Wisconsin father who admitted to killing his three young daughters last July, finding he had a mental defect but still understood he was doing something wrong when he slashed his girls' throats, then tucked their bodies into bed.

Aaron Schaffhausen, 35, faces a maximum penalty of life in prison with no parole when he is sentenced. The St. Croix County Circuit Court jury deliberated for about 3½ hours before reaching its unanimous verdict.

Schaffhausen pleaded guilty earlier to three counts of first-degree intentional homicide and one count of attempted arson. But he maintained he wasn't responsible for killing 11-year-old Amara, 8-year-old Sophie and 5-year-old Cecilia because of a mental illness.

The jury was tasked with weighing Schaffhausen's sanity. Prosecutor Gary Freyberg said jurors found "the truth of the case."

 "He was guilty. He was sane. And the jury got it right," Freyberg said. He called the killings a "brutal, brutal series of crimes" and added: "He understood what he was doing. He said he was going to do this, and he went out and did it."

Flint Watt, an uncle of Schaffhausen's ex-wife Jessica, said the family views the verdict as one step in a long recovery.

"Aaron's going to be spending a long time, I think, thinking about what he's done," Watt said. Some of Jessica's family members sighed and quietly cried as the verdict was read.

Defense attorney John Kucinski said he would appeal. He said Judge Howard Cameron instructed the jury on motive when it wasn't relevant. He also said the judge shouldn't have denied the jury's request to have expert reports in the room as they deliberated.

"I don't think the pieces fit with the finding," Kucinski said of the verdict. He said Schaffhausen was depressed by the decision.

Each murder count carries a mandatory term of life in prison, but Wisconsin law allows for parole after 20 years. Judges may also make sentences consecutive or concurrent. That means Schaffhausen faces a minimum of 20 years in prison and a maximum of life in prison without release.

In his closing argument Tuesday, Freyberg told jurors Schaffhausen was a manipulator who knew what he was doing and wanted to punish his ex-wife in the worst way imaginable.

"These children did not have to die. They died because their father made a choice," Freyberg said. "He chose to kill them and betray everything that a parent stands for because he was jealous and angry."

Kucinski argued Schaffhausen has a rare mental disorder, rooted in a deep dependency on his ex-wife. Kucinski said the only way Schaffhausen believed he could "solve" that problem was to commit suicide or homicide. He said a mental disease is the only way to explain how Schaffhausen could kill the girls he loved.

"There is nobody involved in this case that deserves an iota of blame because they could not know how ill his mind is," Kucinski said. "You just look at the guy, and he doesn't look as sick as he is."

Trial testimony showed that in the months leading up to the killings, Schaffhausen told several people he had thoughts of killing his girls. His ex-wife testified that in March 2012, he called her from Minot, N.D., where he was working, and told her he "wanted to drive down there and tie me up and make me pick which child he killed and make me watch while he killed them."

He also called Jessica repeatedly, sometimes up to 30 times a day, and threatened to kill the man she was dating.

One of his co-workers, Jeremy Michels, wrote in an email to police after the killings that Schaffhausen had said things like: "I want to go kill my kids, then my ex-wife. After her, I will go to the man's house she is sleeping with, kill him, cut his head off, put it on a stake in my front yard and then I will sit back and have a beer."

Schaffhausen declined to testify.

But the defense played a recording of his interview with police after the slayings. During the first two hours of the video, he is silent. In the final hour, he cried as an investigator asked him about tucking the girls into their beds. Later, he is seen on the videotape saying, "I don't know what I want; I don't know what I need. I want my girls back. ... I need help."

Under Wisconsin law, to reach a verdict of insanity, only 10 of 12 jurors had to find evidence showing Schaffhausen suffered from a "mental disease or defect" that led him to lack the capacity to either know his conduct was wrong or conform to requirements of the law.

As I read it, dad AARON SCHAFFHAUSEN sounds like a classic lying deadbeat/sociopath. This is not a case of mental illness. It was an abuser daddy out to punish mom for leaving his lazy ass, and slaughtering three kids was simply a way to hurt her the worst. 

Fathers rights folks are always whining about how daddies are discriminated against. Baloney. More often than not, we see a mom who accommodated dad's request for visitation like this one did. And with access secured to the kids, the psycho daddy simply murders the kids. Stop the access for these freaks, and you stop the killing.

HUDSON, Wis. (AP) — Police found a horrifying scene at the Schaffhausen family home in the western Wisconsin city of River Falls last July: three girls dead in their beds, their throats slashed. In the basement, gasoline was sloshed in a possible attempt to burn down their mother's house.

This week, the girls' father goes on trial to determine whether he was insane at the time. Aaron Schaffhausen last week conceded guilt on three counts of first-degree intentional homicide and one of attempted arson, but maintained that he's not responsible for his actions due to mental illness.

Prosecutors argue Schaffhausen was perfectly aware of what he was doing, and killed 11-year-old Amara, 8-year-old Sophie and 5-year-old Cecilia because he was still bitter about their divorce and furious because he thought she had begun seeing another man. Their evidence, according to a criminal complaint, includes a chilling statement to his ex-wife right after the killings: "You can come home now because I killed the kids."

Jury selection begins Monday in St. Croix County Circuit Court. Trial evidence is expected to include testimony from the girls' mother, Jessica Schaffhausen, and a recording of the 40-minute 911 call she made to police in River Falls, a community of about 15,000 people about 30 miles east of the Twin Cities.

For Schaffhausen, the stakes are likely the difference between spending the rest of his life in prison, if he's judged sane, or being committed to a psychiatric institution from which he might someday be released.

"Our office, as well as the attorney general's office, has put a lot of time into this case, a lot of resources, and I believe we're both prepared," District Attorney Eric Johnson said.

Schaffhausen's public defender, John Kucinski, spent months refusing to concede his client killed the girls. He fought hard in pretrial proceedings to exclude as much damaging evidence as possible, often unsuccessfully, ahead of last week's plea change.

Even though the focus has shifted to Schaffhausen's mental state, the lead prosecutor, Assistant Attorney General Gary Freyberg, said he'll present much of the same evidence he had planned to use to prove guilt because he said it shows Schaffhausen understood what he was doing.

Aaron and Jessica Schaffhausen divorced in January 2011. Court papers indicate their marriage had been rocky for several years, and her mother told police the last straw was when Jessica discovered he was lying about having gone back to school. Her mother told police he either flunked out or dropped out, and kept it secret for several months, until it was too late to get a refund. Jessica and the girls stayed in the house in River Falls. Aaron took a construction job in Minot, N.D.

According to the complaint, Aaron Schaffhausen texted his ex-wife July 10, 2012, to ask for an unscheduled visit with the girls. She consented but said he had to be gone before she got home because she didn't want to see him. The girls' babysitter told investigators the children were excited when he arrived. The babysitter left. He called his wife about two hours later to say he'd killed their children.

"All were found with their throats cut widely and deeply," prosecutors said in court filings. They said the "vast majority" of the blood at the scene was found in Cecilia's room, indicating he killed them there, and then tied the shirts around his girls' necks in an attempt to keep their blood off his own clothes as he carried the other children to their bedrooms. Only Cecilia showed signs of strangulation, they wrote.

Winning with an insanity defense is usually an uphill battle, though the legal test in Wisconsin is somewhat easier than in other states. Wisconsin requires at least 10 of the 12 jurors to find the evidence shows a defendant suffered from a "mental disease or defect" so great at the time that he or she "lacked substantial capacity either to appreciate the wrongfulness of his or her conduct or conform his or her conduct to the requirements of law."

Few details have emerged publicly on Schaffhausen's mental state since the girls were killed. He's been evaluated by experts for the prosecution, the defense and the court. Much of that information remains under seal. In a February filing, prosecutors said the defense had not spelled out Schaffhausen's mental defect or how it affected his actions.

Kucinski offered a hint in pretrial proceedings last week, however, when he said the prosecution expert concluded that Schaffhausen suffers from a "major depressive order." He did not elaborate.

Dad charged with murdering 3 daughters during visitation hopes to profit from sale of family home (River Falls, Wisconsin)

We've posted on this case before.

Once again, we have a father who murdered three young girls to punish their mother. The fathers rights goons will tell you that Daddy was grieving and sad and all the bullsh**. Because the poor baby was "deprived" of his children or some lies like that.

Check this out. Despite the fact that Daddy had threatened to kill the mother before (HUGE RED FLAG IN LETHALITY ASSESSMENTS), Mom bent over backwards to allow this piece of crap to visit her daughters. No "gatekeeping" whatsoever. She did everything the FRs insist that mothers do, which is ignore or minimize their own instincts, experiences, and judgments, and cater to Daddy first. 

And this is how he repaid her. Slaughtered his own daughters in cold blood, and he was just psycho enough to taunt the mother over the phone about it. 

Once again, we see that the problem is not that abuser daddies are being denied access. The problem is that they are being GRANTED ACCESS which they use to further torment, abuse, rape, or even murder their victims. 

Now this creep wants to profit from his crimes by selling the house WHERE HE SLAUGHTERED HIS OWN KIDS so he can use the profits to finance his court costs. 

UTTERLY REVOLTING.  

Thank goodness there are still some ethical companies in this world as once the realty company knew what was going on, the voluntarily withdrew the listing.

A grieving mother is fighting to stop her ex from profiting from the sale of their house as he will put any cash he earns towards his defense funds after allegedly killing their three daughters.

Jessica Schaffhausen allowed her ex-husband Aaron to meet with their three daughters when he surprised them with a visit to their Wisconsin home in July.

She did not return to the home until after he had gone, only to find out that he had stabbed all three of the young girls before tucking their blood-stained bodies into their beds.

Now Aaron, who had legal rights to the Wisconsin home even though he lived in North Dakota, stands to profit from the sale of the house.

Jessica has been successful in stopping Aaron’s ploy, as the realtor has officially taken the house off the market.

The grieving mother publicly reached out to the realtor in an effort to thwart those plans because if the four-bedroom house sells for anywhere near the asking price of $229,900, Aaron will receive some of that cash which could have legal repercussions in the triple-murder case against him.

‘What you may not have thought through in accepting this job is that if you do succeed in selling it that you will allow their murderer to not only benefit financially but will also disqualify him for the public defender he is using which would mean that the entire criminal trial process would be set back drastically,’ Jessica wrote in an email to an Edina real estate agent.

‘I understand that a sale is a sale for you but I needed to let you know exactly what you are contributing to and if you can still sleep at night with that knowledge then by all means move forward as your conscience dictates,’ she wrote, and then posted on a Facebook page dedicated to her fight for justice for her three young girls.

The Star Tribune quotes a spokeswoman for Edina Realty said that after hearing from Jessica Schaffhausen, the company cancelled the listing on Friday and will no longer be handling any transactions to do with the River Falls property.

Aaron Schaffhausen, 35, will appear in court on Wednesday for the latest hearing in his case dealing with pre-trial motions.

He faces three counts of first-degree intentional homicide after allegedly killing his daughters Amara, 11, Sophie, 8, and Cecilia, 5, in July.

He also faces one count of attempted arson as police found a container of spilled gasoline in the basement of the house when they arrived on the scene moments after he fled.

Court records show the mother, Jessica Schaffhausen and Aaron divorced this January.

He lived in Minot, North Dakota while the girls lived with their mother in River Falls, in a house rented from Aaron Schaffhausen, according to a criminal complaint.

Investigators wrote in the complaint that Jessica Schaffhausen thought her ex-husband was working a construction job in Minot when he texted her just before noon Tuesday and asked for an unplanned visit with the girls. He had recently been fired.

The mother agreed, despite him previously making threats on her life, but told him to be gone by mid-afternoon because she didn't want to see him.

The girls' baby sitter told detectives the girls were so excited to see him when he arrived they rushed to him and took him upstairs to show him their things. The baby sitter hugged the girls goodbye and left, the complaint said.

About two hours later, Aaron Schaffhausen called his ex-wife saying: 'You can [come] home now because I killed the kids.'

All three of her young daughters were found tucked in her own bed, dried blood on their faces.

Autopsy results showed that the girls died from 'sharp force injury' to the neck. The youngest child, Cecilia, had also been strangled, according to a criminal complaint.

Mrs Schaffhausen immediately called police, who discovered the grisly scene. The girls' faces were caked in blood, which also covered the carpet in their bedroom.

Officers detected an odor they thought at first was natural gas. They discovered a gasoline container had been tipped over in the basement, spilling its contents.

An hour after he contacted his ex-wife, Aaron Schaffhausen drove into the River Falls Police Station parking lot and surrendered. Officers noted his shorts were stained with what appeared to be blood. Detectives tried to interview him but he said nothing, according to the complaint.

Officials within the community were shocked by the news of the girls deaths.

The father's bail was set at $2 million and ordered him to have no contact with the girls' mother or her immediate family. Each count Schaffhausen is charged with carries a mandatory life sentence.

HUDSON, Wis. -- The attorney for a North Dakota man charged with killing his three young daughters in Wisconsin says the defense will provide evidence that shows the defendant was delusional and depressed before the girls were slain.

Defense lawyer John Kucinski (kuh-SIN'-skee) says Aaron Schaffhausen had been depressed for quite a while and was taking medication. Kucinski tells the Eau Claire Leader-Telegram ( http://bit.ly/MHXQh9) there were people who were concerned about his abnormal behavior, including his ex-wife who told relatives Schaffhausen had serious problems.

The Minot, N.D., construction worker, who turns 35 Wednesday, is being held in the St. Croix (kroy) County Jail on $2 million cash bond. A judge on Tuesday ruled there's enough evidence to hold Schaffhausen for trial.

Eleven-year-old Amara, 8-year-old Sophie and 5-year-old Cecilia Schaffhausen were found slain in their River Falls home July 10.

Children found slain under mattress at father's house, but dad, now jailed for reckless endangerment, not charged (St. Michael, North Dakota)

Though these murders took place on the Spirit Lake Nation reservation in North Dakota, they're quite typical of other child murders committed elsewhere in the world. Given that the parents were separated, the children were either living with their father as a custodial parent, or they were involved in some sort of "shared" arrangement or visitation. Whether this was at the "discretion" of the parents or the result of an official action is not specified.

But notice all the praise for daddy TRAVIS DUBOIS. Even though this man lived in a house that looked like a "three-day party" had just finished up, and even though he is in jail after pleading guilty to public intoxication and child endangerment. Are we to believe that strangers broke into his home and stabbed these kids to death, and then hid their bodies under a mattress? All while Daddy was apparently in the home but drunk? Or did he leave two kids, the youngest of whom was six, all alone while he partied elsewhere? Why would he report them as "missing" when they were in his own home with blood everywhere? Either this guy is the killer or he's an out and out idiot.

And notice this rather bizarre claim: that Daddy didn't have a "reputation" for violence, even though he has a previous conviction for misdemeanor simple assault! Of course his enabler mother is dragged in, who is playing her role as the Queen of Denial. And then there is this irrelevancy: that the murdered daughter apparently wrote down nice things about Daddy. This is not unusual in the slightest, even among severely abused children. And yet after 14 months, the authorities HAVE REFUSED TO CHARGE THE FATHER IN THE DEATHS OF THESE KIDS.

And notice that the reporters can't help but take digs at the mother for her drug issues, even though she is apparently not suspected in any way, shape, or form in these crimes. This is a classic illustration of the double standard that's applied to mothers and fathers in terms of expectations. Moms must be June Cleaver, dads can be, well, whatever.

ST. MICHAEL, N.D. — Family and friends searched for several days for Destiny DuBois and her little brother Travis DuBois, Jr., after the children were reported missing by their father.

Their mother, Mena Shaw, decided to go to the home where she had lived with the children’s father until they’d been separated not long before.

Immediately upon entering, she knew something was terribly wrong — witnesses would later describe areas inside the house as covered with blood, some of it in pools.

In one bedroom, small bloody handprints later were found on a wall a couple of feet above the floor.

The search ended when Shaw found the lifeless bodies of 9-year-old “Des” and “Baby Trav,” 6, under a mattress. Authorities said the children appeared to have been dead several days, slain by a knife or another cutting weapon.

The same day the bodies were found, May 21, 2011, the children’s father, Travis DuBois, was arrested and taken into custody. He pleaded guilty to public intoxication and reckless endangerment, according to a tribal prosecutor, and remains in jail serving sentences for those charges.

Waiting

Now, the search here on the Spirit Lake Nation is for answers to crimes that shook the community and have been cited as a grave example of endangered children on the reservation.

Almost 14 months later, nobody has been charged in connection with the siblings’ deaths, and people wait anxiously for investigators to produce results. “

It’s really sad that we have these two children murdered and who’s going to pay for it?” asked Cheryl Good Iron, a grandmother who resides in Fort Totten, expressing a common sentiment on this Dakota Sioux reservation. “Who’s going to be charged for it?”

Federal authorities insist that the investigation, jointly conducted by the FBI and Bureau of Indian Affairs police, has not stalled and remains on track.

“We’ve been working very hard on this case since the day it happened,” Timothy Purdon, the U.S. attorney for North Dakota, whose office would prosecute the case, said Friday.

“A great deal of forensic evidence has been gathered in the investigation,” Purdon said, “and some of that forensic evidence is still being processed.”

He added: “The FBI and BIA have conducted numerous interviews.”

But Purdon declined to say whether DuBois is a suspect, or whether investigators have identified any suspects in the case. He said he understands the frustration at Spirit Lake, and the need for information, but can say little about an ongoing investigation.

A spokesman for the FBI, agent Kyle Loven, was similarly tight-lipped.

“We are looking into this,” he said. “It is an active investigation and we are moving forward. I can’t give any details.”

‘Brutal way to die’

Betty Jo Krenz was the Spirit Lake tribe’s child case worker on call the weekend the DuBois children’s bodies were found.

Her phone rang a few minutes before 4 p.m. on a Saturday afternoon. She rushed to the home in St. Michael, where police and ambulance crews already were on the scene.

Krenz was called in to take care of the mother’s other children — including a 4-year-old boy who was in the house when the bodies were found.

“They were really shaken,” she said of the mother’s several teenage daughters. “They were hysterical.”

Inside the house, Krenz saw a lot of blood, including areas that looked like a paint can had spilled.

“It was a brutal way to die,” she said. “The girls told me they fought hard. They watched their mom cradle those dead kids.”

The floors were strewn with empty bottles and refuse. “It looked like there had been a three-day party or a frat house party,” Krenz said, adding that she’d heard that people had been in and out of the house before the bodies were found.

As neighbors began to gather outside the home, BIA and FBI investigators told Krenz, who no longer works for the tribe, to take the children to the nearby St. Michael recreation center, which has shower rooms.

There, she washed blood off the boy, and gathered the bloody clothing in plastic bags, which she gave to an aunt to be washed. More than a year later, she hasn’t heard anything from investigators or prosecutors.

“There’s no closure for me,” Krenz said, “and I can’t imagine how the family feels.”

Bewildering

Travis DuBois, an army veteran who worked for the reservation’s fire department, does not have a reputation for violence. In state court, he has misdemeanor convictions for drunken driving and simple assault. The tribal prosecutor said he was intoxicated when taken into custody.

Mena Shaw also has had a few scrapes with the law. Her record in state court includes misdemeanor convictions for possession of a controlled substance and drug paraphernalia.

Nothing has been heard publicly from DuBois since he was taken into custody. He has roughly served half of his consecutive sentences, which total two years and two months, for public intoxication and reckless endangerment.

Forum Communications reporters were unable to speak to DuBois last week in the Lake Region Corrections Facility, where he is being held.

His mother, Violet Robertson, said nobody on her side of the family has been interviewed by investigators. Her family is as bewildered as everyone else.

“We know nothing,” she said. “Maybe people think we do. We know nothing.”

She last saw her two DuBois grandchildren just days before they were found dead. They were in a program at the Four Winds School.

Destiny, whose family said she loved school, had just completed third grade. Translated, her Dakota name was Many Stars Woman.

Travis Jr., who had been born premature and was small for his age, had finished first grade. His Dakota name was Walking Elk Boy. His uncle, Burton “B.J.” Robertson, thought of his diminutive nephew as a little warrior.

“I know in my heart I couldn’t believe my son would do something like this,” Robertson said, her eyes welling with tears. “He took care of his kids.

“They’re saying he was a meth head. He didn’t do stuff like that. He worked.”

A friend gave her a piece of paper retrieved from the house, a note in large printed letters Robertson said was written in Destiny’s penmanship.

“My dad is the best dad and he will always be,” the note said, with a heart shape as a period. “The best dad.”

Robertson, like so many at Spirit Lake, is left wondering what happened in that home to those two children, and by whose hands. “I want answers,” she said.

Assault against 3-month-old leads to arrest of girl's father in Bemidji

BEMIDJI - A 28-year-old Bemidji man was arrested today on suspicion of assaulting his 3-month-old daughter last week.

Roger Darrin Warner was arrested shortly after 1 p.m., according to Beltrami County Sheriff Phil Hodapp.

The girl, injured while at a residence near Cass Lake, suffered serious injuries Jan. 2.

In a news release, Hodapp said the girl remains in critical condition at a Fargo hospital.

Investigators from Beltrami County Sheriff’s Office and Minnesota Bureau of Criminal Apprehension have been working on this case since the initial call was received by law enforcement late Jan. 2.

The mother of the infant initially brought the baby to Sanford Hospital Emergency Room with serious injuries from an apparent assault. The baby was flown from Bemidji to Fargo where it has remained under care of doctors in the trauma unit there.

The news release said Warner came under suspicion as a person of interest early in the investigation.

Investigators obtained medical and witness information which continued to point to Warner as the perpetrator of the assault.

Warner has been booked into the Beltrami County jail, pending review of serious assault and child abuse charges by the Beltrami County Attorney.

Autopsy: Toddler died of 'non-accidental' head injury Wake Forest, N.C. — A Wake Forest toddler, whose father is accused of killing her, died of a "non-accidental" head injury, according to autopsy results released Friday.

Authorities say that 14-month-old JaDajia A'Veyonce Wright died at UNC Hospitals on Dec. 7, 2010, after her father called 911 from a Wake Forest home, saying she wasn't moving.

The father, Johnathan Blake Perry, 23, of 330 Hazelwood Circle in Louisburg, was charged with murder and intentional child abuse resulting in serious bodily injury. He is being held without bond.

An autopsy by the state chief medical examiner found that JaDajia had significant brain swelling, along with hemorrhaging in her brain, eyes and chest. She also had bruises on her face, legs and lower lip and a superficial vaginal abrasion.

The head injuries were listed as the cause of death.

A search warrant states that Perry told a chaplain at UNC Hospitals that he gave his daughter a bottle as she sat on the couch and then went to the bathroom. When he returned about 10 minutes later, JaDajia was unresponsive, and when he picked her up, he thought he heard her neck snap, the affidavit states.

Perry is heard in the 911 call trying to revive the toddler as instructed by emergency dispatchers.

The girl was taken to WakeMed, then flown to UNC Hospitals. WakeMed officials called law enforcement because they suspected abuse.

Bail was set at $2,500 Wednesday for a Grand Forks father accused of fracturing the skull of his infant son.

William Hoehn, 25, was being held at the Grand Forks County jail Wednesday evening.

Prosecutors said Hoehn’s son, who is younger than a year old, is no longer in the hospital and will not suffer long-term consequences from his injuries.

A police report says the boy suffered skull fractures near his right ear Jan. 5 while in Hoehn’s care. Authorities have ruled out the possibility the boy’s injuries were caused by an accident or a medical condition.

During a court appearance Wednesday, Hoehn told state District Judge Sonja Clapp that he has not retained an attorney. Clapp ordered Hoehn to have no contact with his son.

Hoehn, who faces a child abuse charge, has a preliminary hearing set for March 30. If convicted, he could be sentenced to a maximum of 10 years in prison.

A Grand Forks father was charged Monday with fracturing the skull of his infant son.

William Hoehn, 25, was not in custody Monday, but there was a warrant issued for his arrest on a child abuse charge that carries a maximum prison sentence of 10 years.

Prosecutor Jason McCarthy said Hoehn’s son, who is younger than a year old, is doing OK and will not suffer long-term consequences from his injuries. McCarthy said he did not know who has custody of the boy, who is no longer in the hospital.

According to a police report, Hoehn picked up his son at daycare about 3:30 a.m. Jan. 5. Hoehn and the boy’s mother did not notice anything unusual about their son’s head that morning, the report states.

The report says the boy’s mother went to work about 4:40 p.m., leaving the boy in Hoehn’s care. A couple of hours later, she received a call from Hoehn, who was crying; he told her their son’s head was swollen and asked if he should take him to the emergency room, according to the report.

Hoehn brought the boy to Altru Hospital in Grand Forks where he was diagnosed with fractures near his right ear, McCarthy said. Suspecting child abuse, emergency room staff reported the boy’s injuries to police, authorities said.

Two doctors told police that in a case like this, “swelling would have more than likely occurred within a couple of hours after the incident that caused the fracture,” the report says.

McCarthy said authorities have ruled out the possibility the boy’s injuries were caused by an accident or a medical condition such as brittle-bone disease.

Hoehn does not have a listed phone number. A message left for DeWayne Johnston, an attorney believed to be representing Hoehn, was not returned Monday.

I'm a peacenik kind of gal. Really. But that doesn't mean I like gratuitous swipes at the people who serve in the armed forces. Note that Dad KYLE DANAHER wasn't even in the service. His wife was. So why is the Air Force getting so much play in this story? Danaher shook and injured his 2-month-old son in his capacity as a father, NOT as a person residing on a U.S. Air Force base. Whether his wife was a civilian or in the military--or was a waitress, accountant, or airman--is irrelevant to the story.

GRAND FORKS, N.D. (AP) - A man who admitted to shaking and injuring his 2-month-old son on the Grand Forks Air Force Base has been ordered to serve two years on electronic home monitoring and three years on probation.

Kyle Danaher, 21, pleaded guilty in August to charges of child abuse and neglect. The Grand Forks Herald reported that Danaher in court on Wednesday said he "failed as a father and a husband."

Danaher's wife, Elonmarie, told the judge her husband made a mistake in shaking their son late last year and that she believes it will never happen again. At the time, Danaher was not an airman but was living on base with his wife, who was in the Air Force.

Danaher is being allowed to serve his sentence in North Carolina, where his wife and son now live.

A Bismarck man has been sentenced to 10 years in prison for the murder of his 3½-month-old son.

South Central District Judge David Reich on Friday sentenced Aarin Cratty, 20, to 25 years in prison with all but 10 years suspended and five years of supervised probation.

Because the crime is a violent offense, Cratty must serve 85 percent of the sentence before he can be released on parole.

Hank Allen Arden Cratty died on Oct. 10. He was the son of Cratty and Lori Lyon, of Bismarck. At the time of his death, Cratty told police he played too rough with his son when he wouldn't stop crying, and the child's head struck the father's knee. However, Burleigh County State's Attorney Richard Riha classified the death as a result of shaking.

Riha recommended a sentence of 60 years in prison with all but 20 years suspended and five years of probation.

Public defender Travis Finck recommended a sentence more in line with recent manslaughter cases involving infant deaths, where parents have been sentenced to serve five or seven years in prison. He said the murder charge was inappropriate in the case, as Cratty's conduct was accidental, not intentional.

Cratty's parents and Lyon told Reich they thought Cratty should get time served and probation. They said he had suffered enough in jail, and they believe he is not a danger to anyone.

Jonathan D. Thoennes, 19, Wahpeton, was arrested on the evening of March 9 at the Wahpeton Law Enforcement Center, and is being charged with the offense of abuse or neglect of a child, a Class B felony.

The arrest stems from an incident that occurred on March 1 during which a 4 1/2 month-old infant was taken by ambulance to St. Francis Healthcare Campus in Breckenridge, and later transported by Life Flight to MeritCare Hospital in Fargo. The child suffered from serious injuries, which attending medical personnel determined were consistent with the child having been physically abused.

An investigation conducted by the Wahpeton Police Department and Richland County Social Services led to the arrest of Thoennes, the father of the injured child.

Thoennes remains in custody in the Richland County Corrections Center. The maximum penalty for a Class B felony is 10 years imprisonment, a fine of $10,000, or both said fine and imprisonment.

Additional information concerning the identity and condition of the injured child are not being released.

BISMARCK, N.D. (AP) — A Bismarck man accused of shaking to death his infant son has been granted more time before trial.

Twenty-year-old Aarin Cratty has pleaded not guilty to a felony murder charge that could land him in prison for life if he is convicted. He is accused in the October death of 3-month-old Hank Cratty.

Judge David Reich on Monday granted a 60-day extension on court proceedings. A trial date will be set sometime after June 1.

Prosecutor Lloyd Suhr said the timeline would give the North Dakota State Lab enough time to complete all of its autopsy reports and for the attorneys to study the reports.

Baby dies; case under review

A baby who was allegedly shaken by his father has died.

Hank Allen Arden Cratty, 3 months old, died on Saturday, according to an obituary.

Hank's father, Aarin Paul Cratty, was charged Oct. 8 with Class B felony abuse or neglect of a child for allegedly shaking the boy on Oct. 6.

Cratty, 20, is being held on a $10,000 cash bond.

Burleigh County Assistant State's Attorney Lloyd Suhr said he is still receiving information about the case from law enforcement and cannot comment yet on whether charges could be enhanced until he has a more full picture of the circumstances surrounding the death.

According to an affidavit from Bismarck Police Det. Scott Betz, Officers Nicole Moritz and Chad Fetzer responded to a apartment on Oct. 6 for a report of an unresponsive child. Cratty told them the boy was not breathing. Metro Ambulance transported the child to St. Alexius Medical Center, where Dr. Patricio Fernandez examined him and determined he had a bleed in his brain and retinal hemorrhages - both of which the doctor said are signs of shaken baby syndrome.

Fernandez, a pediatric cardiologist and neonatologist, believed the baby was brain dead at that time, the affidavit said.

Betz wrote in his affidavit that Cratty said he shook the baby on Oct. 6, and the child's head struck his knee. He said he was frustrated when the baby would not stop crying.

Services for Hank will be held at 1 p.m. Friday at Perry Funeral Home in Mandan, according to the obituary.

Rocky Mount Police arrested 44 year-old Antonia Lawrence Saturday and charged him with DWI and Child Abuse.

A father was arrested for taking his kids for a ride on his moped while police say he was intoxicated.

Rocky Mount Police arrested 44 year-old Antonia Lawrence Saturday and charged him with DWI and Child Abuse.

He was also cited for riding without a helmet.

Police say Lawrence told them he was giving his seven and ten year-old a ride when he ran off the side of the road and turned it over.

His two children suffered broken legs but are listed in stable condition according to police.

Lawrence has a court date set for next month.
