Dad gets 25 years in prison for shaking death of 2-month-old son (Hutto, Texas)

Dad JOSHUA SWAIN has pleaded guilty to violently shaking his 2-month-old son to death back in March 2008. It's the usual story--Dad was "caring" for the baby, the baby was crying (they do that you know), and Dad got "angry." So the baby died. Dad will be doing 25 years in prison. My free advise to all you mamas out there: Next time you need a babysitter, find a nice grandmotherly type. They have very low rates of shaken baby syndrome.

A Hutto father charged with capital murder in the violent shaking death of his 2-month-old son Wednesday pleaded guilty to intentional injury to a child.

Investigators say Joshua Swain, 20, shook his son Jason Michael to death in March 2008.

According to an arrest affidavit, Swain was caring for the infant at his Hutto home when he became angry with the boy and shook him back and forth when he would not stop crying.

Prosecutors say Swain admitted to shaking the child.

Swain decided to enter a guilty plea and not proceed with a jury trial. he was sentenced to 25 years in prison.

"Parents and caretakers need to take heed," said Williamson County District Attorney John Bradley, in a news release. "Don’t ever shake an infant or young child. You can cause permanent injury or death."

Swain must serve at least half of his sentence before he is eligible for parole, Bradley said.
